13. Commerce
١٣۔ كِتَابُ الْبُيُوعِ
[Machine] The predecessor is binding to a specific term, and Allah has made it permissible, allowed it, and recited this verse: "O you who have believed when you contract a debt for a specified term, write it down." He said: And Ibrahim narrated to us, and Abu Hudhaifa narrated to us, from Sufyan, from Abu Hayyan, from a man, from Ibn Abbas regarding this verse: "O you who have believed, when you contract a debt for a specified term." He said: In wheat, in a known measure.
أَنَّ السَّلَفَ الْمَضْمُونَ إِلَى أَجَلٍ مُسَمًّى إِنَّ اللهَ ﷻ أَحَلَّهُ وَأَذِنَ فِيهِ وَقَرَأَ هَذِهِ الْآيَةَ {يَا أَيُّهَا الَّذِينَ آمَنُوا إِذَا تَدَايَنْتُمْ بِدَيْنٍ إِلَى أَجَلٍ مُسَمًّى فَاكْتُبُوهُ} [البقرة 282] 11082 قَالَ وَحَدَّثَنَا إِبْرَاهِيمُ ثنا أَبُو حُذَيْفَةَ عَنْ سُفْيَانَ عَنْ أَبِي حَيَّانَ عَنْ رَجُلٍ عَنِ ابْنِ عَبَّاسٍ فِي هَذِهِ الْآيَةِ {يَا أَيُّهَا الَّذِينَ آمَنُوا إِذَا تَدَايَنْتُمْ بِدَيْنٍ إِلَى أَجَلٍ مُسَمًّى} [البقرة 282] قَالَ فِي الْحِنْطَةِ فِي كَيْلٍ مَعْلُومٍ
[Machine] The Prophet ﷺ arrived in Medina while they were lending in fruit for two or three years. He said, "Whoever lends in fruit, let him lend with a known weight and measure, and for a known period of time." This is the wording of the narration of Amr an-Naqid, and in the narration of Yahya ibn Yahya, it is mentioned as two or three years, and he said, "for a known period of time" without mentioning the word "and". And in the narration of Ash-Shafi'i, it is mentioned as "for a known period of time". Ash-Shafi'i said, "I memorized it as I was described by Sufyan many times, and someone whom I trust informed me that Sufyan said, 'Whenever I mention the word 'to a known period of time', it is referring to a specific period.'"
قَدِمَ النَّبِيُّ ﷺ الْمَدِينَةَ وَهُمْ يُسْلِفُونَ فِي الثَّمَرِ سَنَتَيْنِ وَثَلَاثًا فَقَالَ مَنْ أَسْلَفَ فِي ثَمَرٍ فَلْيُسْلِفْ فِي كَيْلٍ مَعْلُومٍ وَوَزْنٍ مَعْلُومٍ وَإِلَى أَجَلٍ مَعْلُومٍ هَذَا لَفْظُ حَدِيثِ عَمْرٍو النَّاقِدِ وَفِي رِوَايَةِ يَحْيَى بْنِ يَحْيَى السَّنَتَيْنِ وَالثَّلَاثَ وَقَالَ إِلَى أَجَلٍ مَعْلُومٍ لَمْ يَذْكُرِ الْوَاوَ وَفِي رِوَايَةِ الشَّافِعِيِّ وَأَجَلٍ مَعْلُومٍ قَالَ الشَّافِعِيُّ حَفِظْتُهُ كَمَا وَصَفْتُ مِنْ سُفْيَانَ مِرَارًا وَأَخْبَرَنِي مَنْ أُصَدِّقُهُ عَنْ سُفْيَانَ أَنَّهُ قَالَ كُلَّمَا قُلْتُ وَقَالَ فِي الْأَجَلِ إِلَى أَجَلٍ مَعْلُومٍ
أَنَّ ابْنَ عُمَرَ كَانَ يُجِيزُهُ
[Machine] That a person lends in food with a specific price for a set period, as long as it is not in planting or fruit that has not shown its quality, the Sheikh said, "He means that Allah knows whether he lends it in its own planting or its own fruit, so it is not permissible because selling the fruit goods on top of the trees is only permissible when its quality is apparent."
بِأَنْ يُسْلِفَ الرَّجُلُ فِي الطَّعَامِ الْمَوْصُوفِ بِسِعْرٍ مَعْلُومٍ إِلَى أَجَلٍ مُسَمًّى مَا لَمْ يَكُنْ ذَلِكَ فِي زَرْعٍ لَمْ يَبْدُ صَلَاحُهُ أَوْ ثَمَرٍ لَمْ يَبْدُ صَلَاحُهُ قَالَ الشَّيْخُ يُرِيدُ بِهِ وَاللهُ أَعْلَمُ أَنْ يُسْلِفَهُ فِي زَرْعٍ بِعَيْنِهِ أَوْ ثَمَرٍ بِعَيْنِهِ فَلَا يَجُوزُ؛ لِأَنَّ بَيْعَ أَعْيَانِ الثِّمَارِ عَلَى رُءُوسِ الْأَشْجَارِ إِنَّمَا يَجُوزُ إِذَا بَدَا فِيهَا الصَّلَاحُ
