13. Commerce
١٣۔ كِتَابُ الْبُيُوعِ
[Machine] The Messenger of Allah ﷺ forbade bribery, fraud, spying, and usury. He also advised against selling two debts or engaging in deceitful transactions. However, he allowed certain exceptions regarding the trading of araya. Abu Abdullah Al-Hafiz narrates from Abu Al-Nadr Al-Faqih, who was told by Muhammad ibn Muhammad ibn Raja Al-Hanzhali and Tamim ibn Muhammad, who were both informed by Muhammad ibn Ubaid ibn Hisab, who was told by Hammad ibn Zaid. He mentioned it in a similar way, except that he said when the Messenger of Allah ﷺ arrived, he forbade.
أَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنِ الْمُحَاقَلَةِ وَالْمُزَابَنَةِ وَالْمُخَابَرَةِ وَالْمُعَاوَمَةِ وَقَالَ الْآخَرُ عَنْ بَيْعِ السِّنِينَ وَعَنِ الثُّنْيَا وَرَخَّصَ فِي الْعَرَايَا 10833 وَأَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أَخْبَرَنِي أَبُو النَّضْرِ الْفَقِيهُ ثنا مُحَمَّدُ بْنُ مُحَمَّدِ بْنِ رَجَاءٍ الْحَنْظَلِيُّ وَتَمِيمُ بْنُ مُحَمَّدٍ قَالَا ثنا مُحَمَّدُ بْنُ عُبَيْدِ بْنِ حِسَابٍ ثنا حَمَّادُ بْنُ زَيْدٍ فَذَكَرَهُ بِنَحْوِهِ إِلَّا أَنَّهُ قَالَ لَمَّا قَدِمَ رَسُولُ اللهِ ﷺ نَهَى
[Machine] That Umar ibn al-Khattab gave a woman from Abdullah ibn Mas'ud as a slave girl from the khums (one-fifth of war booty) and she sold her to Abdullah ibn Mas'ud for a thousand dirhams. She stipulated that she would serve him. Umar ibn al-Khattab was informed of this and said to him, "O Abu Abdur-Rahman, you bought your wife's slave girl and she stipulated her service to you?" He said, "Yes." Umar said, "Do not buy her, for she has a twofold stipulation." Sufyan al-Thawri narrated this chain of narration from Khalid ibn Salamah from Muhammad ibn Amr except that he said Umar said to Abdullah ibn Mas'ud, "Do not place any conditions on her that are not in her favor." Al-Qasim ibn Abdur-Rahman narrated this as a mursal hadith, and Umar said, "It is not from your wealth what has a twofold stipulation except for you." And we narrated from Aisha that she disliked the stipulation that the slave girl be sold or given away with a condition.
أَنَّ عُمَرَ بْنَ الْخَطَّابِ ؓ أَعْطَى امْرَأَةَ عَبْدِ اللهِ بْنِ مَسْعُودٍ جَارِيَةً مِنَ الْخُمُسِ فَبَاعَتْهَا مِنْ عَبْدِ اللهِ بْنِ مَسْعُودٍ بِأَلْفِ دِرْهَمٍ وَاشْتَرَطَتْ عَلَيْهِ خِدْمَتَهَا فَبَلَغَ عُمَرَ بْنَ الْخَطَّابِ فَقَالَ لَهُ يَا أَبَا عَبْدِ الرَّحْمَنِ اشْتَرَيْتَ جَارِيَةَ امْرَأَتِكَ فَاشْتَرَطَتْ عَلَيْكَ خِدْمَتَهَا؟ فَقَالَ نَعَمْ فَقَالَ لَا تَشْتَرِهَا وَفِيهَا مَثْنَوِيَّةٌ وَرَوَاهُ سُفْيَانُ الثَّوْرِيُّ عَنْ خَالِدِ بْنِ سَلَمَةَ عَنْ مُحَمَّدِ بْنِ عَمْرٍو إِلَّا أَنَّهُ قَالَ فَقَالَ عُمَرُ لِعَبْدِ اللهِ ؓ لَا تَقَعَنَّ عَلَيْهَا وَلِأَحَدٍ فِيهَا شَرْطٌ وَرَوَاهُ الْقَاسِمُ بْنُ عَبْدِ الرَّحْمَنِ مُرْسَلًا قَالَ فَقَالَ عُمَرُ ؓ إِنَّهُ لَيْسَ مِنْ مَالِكَ مَا كَانَ فِيهِ مَثْنَوِيَّةٌ لِغَيْرِكَ وَرُوِّينَا عَنْ عَائِشَةَ أَنَّهَا كَرِهَتِ الشَّرْطَ فِي الْخَادِمِ أَنْ يُبَاعَ أَوْ يُوهَبَ بِشَرْطٍ
[Machine] So the Messenger of Allah ﷺ caught up with me and hit me, and he cursed him. Then he walked away in a manner that no one else had walked. Then he said, "By Allah, he has touched me with a wound." I said, "No." Then he said again, "By Allah, he has touched me with a wound." I said, "No." Then I sent him and I exempted him from his duties and sent him to my family. When we arrived, I brought him a camel and paid him its price. Then I left. He sent someone after me saying, "I did not pay you for your camel, take your camel and the money for it, they belong to you."
فَلَحِقَنِي رَسُولُ اللهِ ﷺ فَضَرَبَهُ وَدَعَا لَهُ فَسَارَ سَيْرًا لَمْ يَسِرْ مِثْلَهُ ثُمَّ قَالَ بِعْنِيهِ بِوُقِيَّةٍ قُلْتُ لَا ثُمَّ قَالَ بِعْنِيهِ بِوُقِيَّةٍ قَالَ فَبِعْتُهُ فَاسْتَثْنَيْتُ حُمْلَانَهُ إِلَى أَهْلِي فَلَمَّا قَدِمْنَا أَتَيْتُهُ بِالْجَمَلِ فَنَقَدَنِي ثَمَنَهُ ثُمَّ انْصَرَفْتُ فَأَرْسَلَ عَلَى أَثَرِي أَنِّي مَا مَاكَسْتُكَ لِآخُذَ جَمَلَكَ خُذْ جَمَلَكَ وَدَرَاهِمَكَ فَهُمَا لَكَ
[Machine] The Prophet ﷺ came to me while my camel was exhausted. He said, "Let me clean it for you." So, he cleaned it and it jumped. After that, I kept its reins tight, but I couldn't control it. Then, the Messenger of Allah ﷺ caught up with me and said, "Give it to me." I sent him five camels in return and told him to deliver it to me at Medina. He said, "Its back is towards Medina." When I arrived in Medina, I brought it to him, and he gave me additional rewards and gifted it to me.
أَتَى عَلَيَّ النَّبِيُّ ﷺ وَقَدْ أَعْيَا بَعِيرِي قَالَ فَنَخَسَهُ فَوَثَبَ فَكُنْتُ بَعْدَ ذَلِكَ أَحْبِسُ خِطَامَهُ فَمَا أَقْدِرُ عَلَيْهِ فَلَحِقَنِي رَسُولُ اللهِ ﷺ فَقَالَ بِعْنِيهِ فَبِعْتُهُ مِنْهُ بِخَمْسِ أَوَاقٍ وَقُلْتُ عَلَى أَنَّ ظَهْرَهُ لِي إِلَى الْمَدِينَةِ قَالَ وَلَكَ ظَهْرُهُ إِلَى الْمَدِينَةِ فَلَمَّا قَدِمْتُ الْمَدِينَةَ أَتَيْتُهُ بِهِ فَزَادَنِي وُقِيَّةً ثُمَّ وَهَبَهُ لِي
