١٣۔ كِتَابُ الْبُيُوعِ
[Machine] That the Prophet ﷺ forbade the sale of fruits until their ripeness is evident and selling dates before they are ripe. Abdullah narrated to us that Zaid bin Thabit told us that the Prophet ﷺ permitted the selling of male camels of the age of 10648 (months). And Abdullah Al-Hafiz informed us that Abu Amr bin Abi Ja'far narrated to me that Abu Ya'la told us that Zuhair bin Harb narrated to us that Sufyan mentioned him.
أَنَّ النَّبِيَّ ﷺ نَهَى عَنْ بَيْعِ الثَّمَرِ حَتَّى يَبْدُوَ صَلَاحُهُ وَعَنْ بَيْعِ الثَّمَرِ بِالتَّمْرِ قَالَ عَبْدُ اللهِ حَدَّثَنَا زَيْدُ بْنُ ثَابِتٍ أَنَّ النَّبِيَّ ﷺ أَرْخَصَ فِي بَيْعِ الْعَرَايَا 10648 وَأَخْبَرَنَا عَبْدِ اللهِ الْحَافِظُ أَخْبَرَنِي أَبُو عَمْرِو بْنُ أَبِي جَعْفَرٍ أنا أَبُو يَعْلَى ثنا زُهَيْرُ بْنُ حَرْبٍ ثنا سُفْيَانُ فَذَكَرَهُ
[Machine] On the authority of the Messenger of Allah ﷺ , he said, "Do not sell the fruits until their goodness becomes apparent, and do not sell the fruits with dates." 10649 H. And Abu Al-Hassan informed us that Ahmad, the son of Milhan, narrated to us that Yahya told me from Al-Laith, from Uqail, from Ibn Shihab, from Salim, that he said: "And Abdullah informed me that Zaid ibn Thabit narrated from the Messenger of Allah ﷺ that he later permitted the selling of goods with dried dates or fresh dates, and he did not permit anything else." Both Al-Bukhari and Muslim narrated this in authentic Hadith, through different chains of narration, from Yahya ibn Bukair and another narration from Al-Laith through a different chain.
عَنْ رَسُولِ اللهِ ﷺ أَنَّهُ قَالَ لَا تَبِيعُوا الثَّمَرَ حَتَّى يَبْدُوَ صَلَاحُهُ وَلَا تَبِيعُوا الثَّمَرَ بِالتَّمْرِ 10649 ح وَأَخْبَرَنَا أَبُو الْحَسَنِ أنا أَحْمَدُ أنا ابْنُ مِلْحَانَ ثنا يَحْيَى حَدَّثَنِي اللَّيْثُ عَنْ عُقَيْلٍ عَنِ ابْنِ شِهَابٍ عَنْ سَالِمٍ أَنَّهُ قَالَ وَأَخْبَرَنِي عَبْدُ اللهِ عَنْ زَيْدِ بْنِ ثَابِتٍ عَنْ رَسُولِ اللهِ ﷺ أَنَّهُ رَخَّصَ بَعْدَ ذَلِكَ فِي بَيْعِ الْعَرِيَّةِ بِالرُّطَبِ أَوِ التَّمْرِ وَلَمْ يُرَخِّصْ فِي غَيْرِ ذَلِكَ رَوَاهُمَا الْبُخَارِيُّ فِي الصَّحِيحِ عَنْ يَحْيَى بْنِ بُكَيْرٍ وَأَخْرَجَهُمَا مُسْلِمٌ مِنْ وَجْهٍ آخَرَ عَنِ اللَّيْثِ عَلَى إِرْسَالٍ فِي الْأَوَّلِ
[Machine] The Messenger of Allah ﷺ gave the owner of the farmland permission to sell it for its produce. This is the wording of the narration of Yahya, and in the narration of Shafi'i and Qanabi, he allowed the owner of the land to sell it for its produce.
أَنَّ رَسُولَ اللهِ ﷺ رَخَّصَ لِصَاحِبِ الْعَرِيَّةِ أَنْ يَبِيعَهَا بِخَرْصِهَا مِنَ التَّمْرِ هَذَا لَفْظُ حَدِيثِ يَحْيَى وَفِي رِوَايَةِ الشَّافِعِيِّ وَالْقَعْنَبِيِّ أَرْخَصَ لِصَاحِبِ الْعَرِيَّةِ أَنْ يَبِيعَهَا بِخَرْصِهَا
[Machine] The Messenger of Allah ﷺ permitted selling clothes by their measurement of dates.
رَخَّصَ رَسُولُ اللهِ ﷺ أَنْ تُبَاعَ الْعَرَايَا بِخَرْصِهَا تَمْرًا
[Machine] That the Messenger of Allah ﷺ allowed the sale of garments by their measurement.
أَنَّ رَسُولَ اللهِ ﷺ رَخَّصَ فِي بَيْعِ الْعَرَايَا بِخَرْصِهَا كَيْلًا
[Machine] The Messenger of Allah ﷺ prohibited the practices of al-Muhaqalah, al-Muzabanah, and al-Mukhabarah, and the sale of fruits until their goodness becomes apparent, and they are not sold except for dinars or dirhams, except for 'araya.
نَهَى رَسُولُ اللهِ ﷺ عَنِ الْمُحَاقَلَةِ وَالْمُزَابَنَةِ وَالْمُخَابَرَةِ وَعَنْ بَيْعِ الثَّمَرِ حَتَّى يَبْدُوَ صَلَاحُهُ وَلَا يُبَاعُ إِلَّا بِالدِّينَارِ أَوِ الدِّرْهَمِ إِلَّا الْعَرَايَا
[Machine] The Messenger of Allah ﷺ prohibited selling fruits until they become ripe, and nothing from it should be sold except with a dinar or a dirham, except for the low-quality fruits.
نَهَى رَسُولُ اللهِ ﷺ عَنْ بَيْعِ الثَّمَرِ حَتَّى يَطِيبَ وَلَا يُبَاعُ شَيْءٌ مِنْهُ إِلَّا بِالدِّينَارِ وَالدِّرْهَمِ إِلَّا الْعَرَايَا
[Machine] That the Messenger of Allah ﷺ forbade mixing dates with dates except for the people of 'Araya, as permission was granted to them.
أَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنِ الْمُزَابَنَةِ الثَّمَرِ بِالتَّمْرِ إِلَّا أَصْحَابَ الْعَرَايَا فَإِنَّهُ قَدْ أَذِنَ لَهُمْ
