١٣۔ كِتَابُ الْبُيُوعِ
He who buys a tree after it has been fecundated, its fruit belongs to one who sells it except when the provision has been laid down by the buyer (that it will belong to him), and he who buys a slave, his property belongs to one who sells him except when a provision has been laid down by the buyer (that it will be transferred to him with the slave). سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَنِ ابْتَاعَ نَخْلًا بَعْدَ أَنْ تُؤَبَّرَ فَثَمَرَتُهَا لِلَّذِي بَاعَهَا إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ وَمَنِ ابْتَاعَ عَبْدًا فَمَالُهُ لِلَّذِي بَاعَهُ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ
[Machine] From the Prophet ﷺ, he said: "Whoever sells a palm tree after it has been pollinated and its fruits have appeared, the fruits belong to the one who pollinated it, unless the buyer stipulates otherwise. And whoever sells a slave who has wealth, his wealth belongs to the one who sold him, unless the buyer stipulates otherwise." And we were informed by Abu Abdullah al-Hafiz, who narrated to us Ali ibn Muhammad ibn Sahtawayh, who narrated to us Ismail ibn Qutaybah and Muhammad ibn Abdul Salam, who said: Yahya ibn Yahya narrated to me - Sufyan mentioned it.
عَنِ النَّبِيِّ ﷺ قَالَ مَنْ بَاعَ نَخْلًا بَعْدَ أَنْ تُؤَبَّرَ فَثَمَرَتُهَا لِلَّذِي أَبَّرَهَا إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ وَمَنْ بَاعَ عَبْدًا لَهُ مَالٌ فَمَالُهُ لِلَّذِي بَاعَهُ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ 10759 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ حَدَّثَنِي عَلِيُّ بْنُ مُحَمَّدِ بْنِ سَخْتَوَيْهِ ثنا إِسْمَاعِيلُ بْنُ قُتَيْبَةَ وَمُحَمَّدُ بْنُ عَبْدِ السَّلَامِ قَالَا ثنا يَحْيَى بْنُ يَحْيَى أنا سُفْيَانُ فَذَكَرَهُ
Messenger of Allah ﷺ said, "If somebody sells pollinated date palms, the fruits will be for the seller unless the buyer stipulates that they will be for himself (and the seller agrees). (Using translation from Bukhārī 2204)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنْ بَاعَ نَخْلًا قَدْ أُبِّرَتْ فَثَمَرَتُهَا لِلْبَائِعِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ
[Machine] Nafi' is beneficial, and even if he is healthy, be cautious of him. I saw in the book of Al-'Ilal by Abu 'Isa At-Tirmidhi, from Abu 'Isa who said, I asked about him (meaning Muhammad, i.e. Al-Bukhari, may Allah have mercy on him). He said, "Indeed, Nafi' contradicts Salim in some narrations, and this is from those narrations, as if he considered both narrations to be authentic and that it is possible that they are both from them." He said, "And this hadith has been narrated from 'Ubaydullah bin Abi Ja'far and others." The sheikh said, "As for the narration from him (i.e. 'Ubaydullah bin Abi Ja'far), it is from him (i.e. 'Ubaydullah) from Bukayr bin Al-Ashajj from Nafi' from Ibn 'Umar from the Prophet ﷺ, contrary to this wording."
نَافِعٌ وَإِنْ كَانَ سَالِمٌ أَحْفَظَ مِنْهُ وَرَأَيْتُ فِي كِتَابِ الْعِلَلِ لِأَبِي عِيسَى التِّرْمِذِيِّ عَنْ أَبِي عِيسَى قَالَ سَأَلْتُ عَنْهُ مُحَمَّدًا يَعْنِي الْبُخَارِيَّ رَحِمَهُ اللهُ فَقَالَ إِنَّ نَافِعًا يُخَالِفُ سَالِمًا فِي أَحَادِيثَ وَهَذَا مِنْ تِلْكَ الْأَحَادِيثِ وَكَأَنَّهُ رَأَى الْحَدِيثَيْنِ صَحِيحَيْنِ وَأَنَّهُ يُحْتَمَلُ عَنْهُمَا جَمِيعًا قَالَ وَقَدْ رُوِيَ هَذَا الْحَدِيثُ عَنْ عُبَيْدِ اللهِ بْنِ أَبِي جَعْفَرٍ وَغَيْرِهِ قَالَ الشَّيْخُ أَمَّا الرِّوَايَةُ فِيهِ عَنْ عُبَيْدِ اللهِ بْنِ أَبِي جَعْفَرٍ فَإِنَّهَا عَنْهُ عَنْ بُكَيْرِ بْنِ الْأَشَجِّ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ عَنِ النَّبِيِّ ﷺ بِخِلَافِ هَذَا اللَّفْظِ
[Machine] From the Messenger of Allah ﷺ that he said: "Whoever frees a slave, his wealth will not decrease except that the master of the slave stipulates his wealth and it will be for him." In another narration from Abu Sa'eed that the Prophet ﷺ said: "Whoever frees a slave and he has wealth, the wealth of the slave will not decrease except that the master stipulates it." This is in contrast to the narration of the majority from Nafi', for indeed he said...
عَنْ رَسُولِ اللهِ ﷺ أَنَّهُ قَالَ مَنْ أَعْتَقَ عَبْدًا فَمَالُهُ لَهُ إِلَّا أَنْ يَشْتَرِطَ السَّيِّدُ مَالَهُ فَيَكُونَ لَهُ وَفِي رِوَايَةِ أَبِي سَعِيدٍ أَنَّ النَّبِيَّ ﷺ وَالْبَاقِي سَوَاءٌ وَرَوَاهُ ابْنُ وَهْبٍ عَنِ ابْنِ لَهِيعَةَ وَاللَّيْثِ بْنِ سَعْدٍ وَقَالَ فِي لَفْظِهِ مَنْ أَعْتَقَ عَبْدًا وَلَهُ مَالٌ فَمَالُ الْعَبْدِ لَهُ إِلَّا أَنْ يَشْتَرِطَ السَّيِّدُ وَهَذَا بِخِلَافِ رِوَايَةِ الْجَمَاعَةِ عَنْ نَافِعٍ فَقَدْ
[Machine] The Prophet ﷺ said, "Whoever sells a slave, his wealth is only for the seller, unless the buyer stipulates otherwise, and likewise."
أَنَّ النَّبِيَّ ﷺ قَالَ أَيُّمَا رَجُلٍ بَاعَ عَبْدًا فَمَالُهُ لِلْبَائِعِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ وَكَذَلِكَ
[Machine] The Messenger of Allah ﷺ said: "Whichever man sells a date-palm tree that has started producing fruit, its produce belongs to its original owner (the seller), and whichever man sells a slave while still possessing wealth, his wealth belongs to his original owner (the seller), except if the buyer stipulates otherwise." Shu'bah said: "So I narrated it to him (Ibrahim al-Nakh'i) with a narration from Ayyub from Nafi' that he narrated it from the Prophet ﷺ regarding date-palm trees, and from 'Umar regarding slaves." 'Abd, the servant of his Lord, said: "I only know it from the Prophet ﷺ." Then he said it again and narrated it from the Prophet ﷺ without any doubt, and Sulaiman bin Musa narrated it from Nafi' as a marfu' (elevated) narration.
أَنَّ رَسُولَ اللهِ ﷺ قَالَ أَيُّمَا رَجُلٍ بَاعَ نَخْلًا قَدْ أُبِّرَتْ فَثَمَرَتُهَا لِرَبِّهَا الْأَوَّلِ وَأَيُّمَا رَجُلٍ بَاعَ مَمْلُوكًا وَلَهُ مَالٌ فَمَالُهُ لِرَبِّهِ الْأَوَّلِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ قَالَ شُعْبَةُ فَحَدَّثْتُهُ بِحَدِيثِ أَيُّوبَ عَنْ نَافِعٍ أَنَّهُ حَدَّثَ بِالنَّخْلِ عَنِ النَّبِيِّ ﷺ وَالْمَمْلُوكِ عَنْ عُمَرَ فَقَالَ عَبْدُ رَبِّهِ لَا أَعْلَمُهَا إِلَّا عَنِ النَّبِيِّ ﷺ ثُمَّ قَالَ مَرَّةً أُخْرَى فَحَدَّثَ عَنِ النَّبِيِّ ﷺ وَلَمْ يَشُكَّ وَرَوَاهُ سُلَيْمَانُ بْنُ مُوسَى عَنْ نَافِعٍ مَرْفُوعًا
[Machine] "The Prophet ﷺ said: 'Any man who sells a slave that he possesses, his wealth belongs to his Lord first, unless the buyer specifies otherwise. And any man who sells a palm tree that has been pollinated, its fruit belongs to its Lord first, unless the buyer specifies otherwise.' This hadith is narrated from Hisham al-Dastuwaai, from Qatadah, from Ikrimah ibn Khalid, from al-Zuhri, from Ibn Umar, from the Prophet ﷺ . It is also narrated from Jabir ibn Abdullah, from the Prophet ﷺ ."
أَنَّ النَّبِيَّ ﷺ قَالَ أَيُّمَا رَجُلٍ بَاعَ مَمْلُوكًا لَهُ مَالٌ فَمَالُهُ لِرَبِّهِ الْأَوَّلِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ وَأَيُّمَا رَجُلٍ بَاعَ نَخْلًا قَدْ أُبِّرَتْ فَثَمَرَتُهَا لِرَبِّهَا الْأَوَّلِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ وَهَذَا مُنْقَطِعٌ وَقَدْ رُوِيَ عَنْ هِشَامٍ الدَّسْتُوَائِيِّ عَنْ قَتَادَةَ عَنْ عِكْرِمَةَ بْنِ خَالِدٍ عَنِ الزُّهْرِيِّ عَنِ ابْنِ عُمَرَ عَنِ النَّبِيِّ ﷺ وَكَأَنَّهُ أَرَادَ حَدِيثَ الزُّهْرِيِّ عَنْ سَالِمٍ عَنْ أَبِيهِ وَرُوِيَ عَنْ جَابِرِ بْنِ عَبْدِ اللهِ عَنِ النَّبِيِّ ﷺ
[Machine] "That the Messenger of Allah ﷺ said, and I (Abu Ahmad) said, and I (Hasan bin Sufyan) narrated from Abdul Rahman bin Ibrahim, who narrated from Al-Walid, who narrated from Abu Mu'ayid Hafs bin Ghaylan, who narrated from Sulaiman bin Musa, who narrated from Nafi', who narrated from Ibn Umar and Ata', who narrated from Jabir, that the Messenger of Allah ﷺ said: 'Whoever sells a slave and he has property, his property is for him and his debt is upon him, unless the seller stipulates otherwise. And whoever straightens a palm tree and then sells it after making it straight, he is entitled to its fruits unless the buyer stipulates otherwise."
أَنَّ رَسُولَ اللهِ ﷺ ح قَالَ وَأنا أَبُو أَحْمَدَ قَالَ وَأنا الْحَسَنُ بْنُ سُفْيَانَ ثنا عَبْدُ الرَّحْمَنِ بْنُ إِبْرَاهِيمَ ثنا الْوَلِيدُ عَنْ أَبِي مُعَيْدٍ حَفْصِ بْنِ غَيْلَانَ عَنْ سُلَيْمَانَ بْنِ مُوسَى عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ وَعَطَاءٍ عَنْ جَابِرٍ أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنْ بَاعَ عَبْدًا وَلَهُ مَالٌ فَمَالُهُ لَهُ وَعَلَيْهِ دَيْنُهُ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ وَمَنْ أَبَّرَ نَخْلًا فَبَاعَ بَعْدَمَا يُؤَبِّرُهُ فَلَهُ ثَمَرَتُهُ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ
[Machine] Narrated from the Prophet ﷺ that he said, "Whoever sells a date palm or a slave, he owns the fruit and the money, except if the buyer stipulates otherwise, and likewise."
عَنِ النَّبِيِّ ﷺ أَنَّهُ قَالَ مَنْ بَاعَ نَخْلًا مُؤَبَّرًا أَوْ عَبْدًا لَهُ مَالٌ فَالثَّمَرَةُ وَالْمَالُ لِلْبَائِعِ إِلَّا أَنْ يَشْتَرِطَ الْمُشْتَرِي وَكَذَلِكَ
[Machine] "Allah's Messenger ﷺ said, 'Whoever sells a slave and has money in return, the money belongs to the seller unless the buyer stipulates otherwise, and likewise.'"
اللهِ ﷺ مَنْ بَاعَ عَبْدًا وَلَهُ مَالٌ فَمَالُهُ لِلْبَائِعِ إِلَّا أَنْ يَشْتَرِطَ الْمُشْتَرِي وَكَذَلِكَ
Messenger of Allah ﷺ said, "If somebody sells pollinated date palms, the fruits will be for the seller unless the buyer stipulates that they will be for himself (and the seller agrees). (Using translation from Bukhārī 2204)
أَنْ يَشْتَرِطَ الْمُبْتَاعُ قَضَى بِهِ رَسُولُ اللهِ ﷺ وَمَنْ بَاعَ نَخْلًا قَدْ أُبِّرَتْ فَثَمَرَتُهَا لِلْبَائِعِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ
"The Messenger of Allah ﷺ ruled that the fruit of a palm tree belongs to the one who pollinated it, and that the wealth of a slave belongs to the one who sold him, unless the purchaser stipulated a condition." (Using translation from Ibn Mājah 2213)
إِنَّ مِنْ قَضَاءِ رَسُولِ اللهِ ﷺ أَنَّ ثَمَرَ النَّخْلِ لِمَنْ أَبَّرَهَا إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ وَأَنَّ مَالَ الْمَمْلُوكِ لِمَنْ بَاعَهُ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ
[Machine] Abdullah said to him, "What is wrong with you, O Umair? I want to free you, for I heard the Messenger of Allah ﷺ saying, 'Whoever frees a slave, his wealth belongs to the one who freed him.'" We were also informed by Al-Qasim ibn Abdur Rahman that Ibn Mas'ud said this to Umair, even though it is possible that he was sent with this message, and there is strength in the narration of Abdul Ala. Ath-Thawri also narrated it from Abu Khalid, from Imran ibn Umair, from his father, that Ibn Mas'ud freed his father, Umair, and then he said, "Indeed, your wealth is for me, and then he left it."
قَالَ لَهُ عَبْدُ اللهِ مَا مَالُكَ يَا عُمَيْرُ فَإِنِّي أُرِيدُ أَنْ أُعْتِقَكَ؟ إِنِّي سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَنْ أَعْتَقَ عَبْدًا فَمَالُهُ لِلَّذِي أَعْتَقَ وَرُوِّينَا عَنِ الْقَاسِمِ بْنِ عَبْدِ الرَّحْمَنِ أَنَّ ابْنَ مَسْعُودٍ قَالَ ذَلِكَ لِعُمَيْرٍ وَهُوَ وَإِنْ كَانَ مُرْسَلًا فَفِيهِ قُوَّةٌ لِرِوَايَةِ عَبْدِ الْأَعْلَى وَرَوَاهُ الثَّوْرِيُّ عَنْ أَبِي خَالِدٍ عَنْ عِمْرَانَ بْنِ عُمَيْرٍ عَنْ أَبِيهِ أَنَّ ابْنَ مَسْعُودٍ أَعْتَقَ أَبَاهُ عُمَيْرًا ثُمَّ قَالَ أَمَا إنَّ مَالَكَ لِي ثُمَّ تَرَكَهُ
[Machine] I heard the Messenger of Allah ﷺ saying, "Allah does not create a servant who fulfills the rights of Allah upon him and the rights of his master, except that Allah will grant him his reward twice."
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَا خَلَقَ اللهُ عَبْدًا يُؤَدِّي حَقَّ اللهِ عَلَيْهِ وَحَقَّ سَيِّدِهِ إِلَّا وَفَّاهُ اللهُ أَجْرَهُ مَرَّتَيْنِ
[Machine] To spend some of his money and not give it to anyone except with the permission of his master, unless he uses it for what is known or wears it.
أَنْ يُنْفِقَ مِنْ مَالِهِ شَيْئًا وَلَا يُعْطِيَهُ أَحَدًا إِلَّا بِإِذْنِ سَيِّدِهِ إِلَّا أَنْ يَأْكُلَ فِيهِ بِالْمَعْرُوفِ أَوْ يَكْتَسِيَ
[Machine] "That the slave does not own anything from his blood or his wealth."
أَنَّ الْمَمْلُوكَ لَا يَمْلِكُ مِنْ دَمِهِ وَلَا مَالِهِ شَيْئًا
[Machine] I came to the Messenger of Allah ﷺ with a handful of bread and meat. He asked, "What is this, Salman?" I replied, "It is a donation." He did not eat it and said to his companions, "Eat." Then, I came to him with a handful of bread and meat again, and he asked, "What is this, Salman?" I replied, "It is a gift." He ate it and said, "We eat gifts and do not eat donations." I asked, "O Messenger of Allah, what do you say about the Christians?" He said, "O Salman, there is no goodness in the Christians or in those who love them three times unless they are upon the same religion as your companion." I understood that my companion, the monk who was with me, was upon the religion of Jesus. The sheikh also mentioned a narration from Buraida that indicates that Salman was a slave when he gave a gift to the Prophet ﷺ.
أَتَيْتُ رَسُولَ اللهِ ﷺ بِجَفْنَةٍ مِنْ خُبْزٍ وَلَحْمٍ فَقَالَ مَا هَذَا يَا سَلْمَانُ؟ قُلْتُ صَدَقَةٌ فَلَمْ يَأْكُلْ وَقَالَ لِأَصْحَابِهِ كُلُوا ثُمَّ أَتَيْتُهُ بِجَفْنَةٍ مِنْ خُبْزٍ وَلَحْمٍ فَقَالَ مَا هَذَا يَا سَلْمَانُ؟ قُلْتُ هَدِيَّةٌ فَأَكَلَ وَقَالَ إِنَّا نَأْكُلُ الْهَدِيَّةَ وَلَا نَأْكُلُ الصَّدَقَةَ قَالَ قُلْتُ يَا رَسُولَ اللهِ مَا تَقُولُ فِي النَّصَارَى؟ قَالَ يَا سَلْمَانُ لَا خَيْرَ فِي النَّصَارَى وَلَا فِيمَنْ يُحِبُّهُمْ ثَلَاثَ مَرَّاتٍ إِلَّا مَنْ كَانَ عَلَى مِثْلِ دِينِ صَاحِبِكَ قَالَ فَعَلِمْتُ أَنَّ صَاحِبِي كَانَ عَلَى دِينِ عِيسَى يَعْنِي الرَّاهِبَ الَّذِي كَانَ مَعَهُ سَلْمَانُ قَالَ الشَّيْخُ وَفِي حَدِيثِ بُرَيْدَةَ زِيَادَةٌ تَدُلُّ عَلَى كَوْنِ سَلْمَانَ عَبْدًا حِينَ أَهْدَى إِلَى النَّبِيِّ ﷺ
