[Machine] From the Prophet ﷺ, he said: "Whoever sells a palm tree after it has been pollinated and its fruits have appeared, the fruits belong to the one who pollinated it, unless the buyer stipulates otherwise. And whoever sells a slave who has wealth, his wealth belongs to the one who sold him, unless the buyer stipulates otherwise." And we were informed by Abu Abdullah al-Hafiz, who narrated to us Ali ibn Muhammad ibn Sahtawayh, who narrated to us Ismail ibn Qutaybah and Muhammad ibn Abdul Salam, who said: Yahya ibn Yahya narrated to me - Sufyan mentioned it.  

البيهقي:١٠٧٥٨ – أَخْبَرَنَا أَبُو مَنْصُورٍ الظَّفَرُ بْنُ أَحْمَدَ الْعَلَوِيُّ رَحِمَهُ اللهُ أنا أَبُو جَعْفَرٍ مُحَمَّدُ بْنُ عَلِيِّ بْنِ دُحَيْمٍ أنا أَحْمَدُ بْنُ حَازِمٍ ثنا عُبَيْدُ اللهِ بْنُ مُوسَى أنا ابْنُ عُيَيْنَةَ عَنِ الزُّهْرِيِّ عَنْ سَالِمٍ عَنِ ابْنِ عُمَرَ

عَنِ النَّبِيِّ ﷺ قَالَ مَنْ بَاعَ نَخْلًا بَعْدَ أَنْ تُؤَبَّرَ فَثَمَرَتُهَا لِلَّذِي أَبَّرَهَا إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ وَمَنْ بَاعَ عَبْدًا لَهُ مَالٌ فَمَالُهُ لِلَّذِي بَاعَهُ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ 10759 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ حَدَّثَنِي عَلِيُّ بْنُ مُحَمَّدِ بْنِ سَخْتَوَيْهِ ثنا إِسْمَاعِيلُ بْنُ قُتَيْبَةَ وَمُحَمَّدُ بْنُ عَبْدِ السَّلَامِ قَالَا ثنا يَحْيَى بْنُ يَحْيَى أنا سُفْيَانُ فَذَكَرَهُ  

رَوَاهُ مُسْلِمٌ فِي الصَّحِيحِ عَنْ يَحْيَى بْنِ يَحْيَى وَغَيْرِهِ هَكَذَا رَوَاهُ سَالِمُ بْنُ عَبْدِ اللهِ عَنْ أَبِيهِ عَنِ النَّبِيِّ ﷺ قِصَّةَ النَّخْلِ وَالْعَبْدِ جَمِيعًا وَخَالَفَهُ نَافِعٌ فَرَوَى قِصَّةَ النَّخْلِ عَنِ ابْنِ عُمَرَ عَنِ النَّبِيِّ ﷺ وَقِصَّةَ الْعَبْدِ عَنِ ابْنِ عُمَرَ عَنْ عُمَرَ ؓ

[361] 11694 Ahmad bin Abdullah bin Al-Hakam narrated from Muhammad bin Ja'far, from Shu'bah, from Abd Rabih bin Saeed Al-Ansari, from Nafi that Muhammad bin Salamah narrated from Ibn Al-Qasim, from Malik, from Nafi, that Ata and Ibn Abi Mulaykah said, "The Prophet ﷺ mentioned it in a Mursal form."

bayhaqi:10578 – Abū ʿAbdullāh al-Ḥāfiẓ Fī Ākharīn Qālūā

[Machine] Abu al-Abbas narrated that Rabi' said, Shafi'i said, Malik said: and Abu Abdullah al-Hafiz informed us, narrating from Ali ibn Isa ibn Ibrahim al-Hiriy, who narrated from Muhammad ibn Amr and Ibrahim ibn Ali and Musa ibn Muhammad. They said: Yahya ibn Yahya said: I read from Malik, from Nafi', from Ibn Umar, that the Messenger of Allah ﷺ said: "Whoever sells a palm tree that has already been pollinated, the fruits belong to the seller, unless the buyer stipulates otherwise." In the narration of Shafi'i, it is mentioned "the fruits."  

البيهقي:١٠٥٧٨ – أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ فِي آخَرِينَ قَالُوا

ثنا أَبُو الْعَبَّاسِ أنا الرَّبِيعُ أنا الشَّافِعِيُّ أنا مَالِكٌ ح وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا عَلِيُّ بْنُ عِيسَى بْنِ إِبْرَاهِيمَ الْحِيرِيُّ ثنا مُحَمَّدُ بْنُ عَمْرٍو وَإِبْرَاهِيمُ بْنُ عَلِيٍّ وَمُوسَى بْنُ مُحَمَّدٍ قَالُوا ثنا يَحْيَى بْنُ يَحْيَى قَالَ قَرَأْتُ عَلَى مَالِكٍ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنْ بَاعَ نَخْلًا قَدْ أُبِّرَتْ فَثَمَرَتُهَا لِلْبَائِعِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ وَفِي رِوَايَةِ الشَّافِعِيِّ فَثَمَرُهَا
