٥٥۔ كِتَابُ الشُّرُوطِ ص ١

He who forgets the prayer, or he slept (and it was omitted), its expiation is (only) that he should observe it when he remembers it. (Using translation from Muslim 684c)

عَنِ النَّبِيِّ ﷺ قَالَ «مَنْ نَسِيَ صَلَاةً أَوْ نَامَ عَنْهَا فَكَفَّارَتُهَا أَنْ يُصَلِّيَهَا إِذَا ذَكَرَهَا»

The Apostle of Allah ﷺ saw sputum sticking to the Qibla of the mosque. He scratched it off with a pebble and then forbade spitting on the right side or in front, but (it is permissible) to spit on the left side or under the left foot. (Using translation from Muslim 548a)

أَنَّ النَّبِيَّ ﷺ «رَأَى نُخَامَةً فِي قِبْلَةِ الْمَسْجِدِ فَحَكَّهَا بِحَصَاةٍ ثُمَّ نَهَى أَنْ يَبْزُقَ الرَّجُلُ عَنْ يَمِينِهِ أَوْ أَمَامَهُ وَلَكِنْ يَبْزُقُ عَنْ يَسَارِهِ أَوْ تَحْتَ قَدَمِهِ الْيُسْرَى»

"I pledged to the Messenger of Allah to be sincere toward ever Muslim." (Using translation from Nasāʾī 4156)

«بَايَعْتُ النَّبِيَّ ﷺ عَلَى النُّصْحِ لِكُلِّ مُسْلِمٍ»

[Machine] The Messenger of Allah ﷺ mandated the giving of Zakat al-Fitr upon the young and old, males and females, free persons and slaves, one saa' of dates or one saa' of barley. And it was narrated by Qutaybah, from Layth, from Nafi', and by Qutaybah, from Malik, from Nafi'.

فَرَضَ رَسُولُ اللهِ ﷺ صَدَقَةَ الْفِطْرِ عَلَى الصَّغِيرِ وَالْكَبِيرِ وَالذَّكَرِ وَالْأُنْثَى وَالْحُرِّ وَالْعَبْدِ صَاعًا مِن تَمْرٍ أَوْ صَاعًا مِنْ شَعِيرٍ [354] 11658 وَعَنْ قُتَيْبَةَ عَنِ اللَّيْثِ عَنْ نَافِعٍ بِهِ 11659 وَعَنْ قُتَيْبَةَ عَنْ مَالِكٍ عَنْ نَافِعٍ بِهِ

“The Messenger of Allah ﷺ used to gently pat our shoulders (to make sure the row was straight) at the time of prayer, saying: ‘Keep (the rows) straight, do not differ from one another lest your hearts should suffer from discord. Let those who are forbearing and wise stand closest to me, then those who are next to them, then those who are next to them.’” (Using translation from Ibn Mājah 976)   

الكبرى للنسائي:١١٦٦٠عَنْ حُمَيْدِ بْنِ مَسْعَدَةَ عَنْ يَزِيدَ بْنِ زُرَيْعٍ عَنْ خَالِدٍ الْحَذَّاءِ عَنْ زِيَادِ بْنِ كُلَيْبٍ أَبِي مَعْشَرٍ عَنْ إِبْرَاهِيمَ عَنْ عَلْقَمَةَ عَنِ ابْنِ مَسْعُودٍ

عَنِ النَّبِيِّ ﷺ قَالَ «لَيَلِيَنِّي مِنْكُمْ أُولُو الْأَحْلَامِ وَالنُّهَى ثُمَّ الَّذِينَ يَلُونَهُمْ ثُمَّ الَّذِينَ يَلُونَهُمْ وَلَا تَخْتَلِفُوا فَتَخْتَلِف قُلُوبُكُمْ وَإِيَّاكُمْ وَهَوَشَاتِ الْأَسْوَاقِ»

"If you wish, you may 'freeze' it and give it in charity." So he 'froze' it, stipulating that it should not be sold, given as a gift or inherited, and he gave it in charity to the poor, relatives, slaves, the needy, wayfarers and guests. There is no sin on the administrator if he eats from it on a reasonable basis or feeds a friend with no intention of becoming wealthy from it. (Using translation from Nasāʾī 3601)  

الكبرى للنسائي:١١٦٦١عَنْ إِسْحَاقَ بْنِ إِبْرَاهِيمَ عَنْ أَزْهَرَ بْنِ سَعْدٍ عَنْ عَبْدِ اللهِ بْنِ عَوْنِ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ

أَنَّ عُمَرَ أَصَابَ أَرْضًا بِخَيْبَرَ فَأَتَى النَّبِيَّ ﷺ يَسْتَأْمِرُهُ فِي ذَلِكَ فَقَالَ «إِنْ شِئْتَ حَبَسْتَ أَصْلَهَا وَتَصَدَّقْتَ بِهَا» فَحَّبَسَ أَصْلَهَا أَنْ لَا يُبَاعَ وَلَا يُوهَبَ وَلَا يُورَثَ فَتَصَدَّقَ بِهَا عَلَى الْفُقَرَاءِ وَالْقُرْبَى وَالرِّقَابِ وَفِي الْمَسَاكِينِ وَابْنِ السَّبِيلِ وَالضَّيْفِ لَا جُنَاحَ عَلَى مِن وَلِيَهَا أَنْ يَأْكُلَ مِنْهَا بِالْمَعْرُوفِ أَوْ يُطْعِمَ صَدِيقَهُ غَيْرَ مُتَمَوِّلٍ فِيهِ

(A man broke his fast intentionally) during Ramadan. The Messenger of Allah ﷺ commanded him to emancipate a slave, or fast for two months, or feed sixty poor men. He said: I cannot provide. The Messenger of Allah ﷺ said: Sit down. Thereafter a huge basket of dates ('araq) was brought to the Messenger of Allah ﷺ. He said: Take this and give it as sadaqah (alms). He said: Messenger of Allah, there is no poorer than I. The Messenger of Allah ﷺ thereupon laughed so that his canine teeth became visible and said: Eat it yourself. Abu Dawud said: Ibn Juraij narrated it from al-Zuhri in the wordings of the narrator Malik that a man broke his fast. This version says: You should either free a slave, or fast for two months, or provide food for sixty poor men. (Using translation from Abū Dāʾūd 2392)

أَنْ رَجُلًا أَفْطَرَ فِي رَمَضَانَ فِي زَمَانِ النَّبِيِّ ﷺ «فَأَمَرَهُ رَسُولُ اللهِ صَلَّى اللهِ عَلَيْهِ وَسَلَّمَ أَنْ يُكَفِّرَ بِعِتْقِ رَقَبَةٍ أَوْ صِيَامِ شَهْرَيْنِ أَوْ إِطْعَامِ سِتِّينَ مِسْكِينًا» قَالَ فَقَالَ لَا أَجِدُ فَأُتِي النَّبِيُّ ﷺ بِعَرَقِ تَمْرٍ فَقَالَ «خُذْ هَذَا فَتَصَدَّقَ بِهِ» فَقَالَ يَا رَسُولَ اللهِ لَا أَجِدُ أَحْوَجَ إِلَيْهِ مِنِّي فَقَالَ فَضَحِكَ رَسُولُ اللهِ ﷺ حَتَّى بَدَتْ أَنْيَابُهُ ثُمَّ قَالَ «كُلْهِ»

"If a woman is married off by two guardians, then the first marriage is the one that counts, and if a man sells something to two men, it belongs to the first one." (Using translation from Nasāʾī 4682)  

الكبرى للنسائي:١١٦٦٣عَنْ قُتَيْبَةَ عَنْ غُنْدَرٍ عَنْ سَعِيدِ بْنِ أَبِي عَرُوبَةَ عَنْ قَتَادَةَ عَنْ الْحَسَنِ عَنْ سَمُرَةَ بْنِ جُنْدُبٍ

أَنَّ رَسُولَ اللهِ ﷺ قَالَ «أَيُّمَا امْرَأَةٍ زَوَّجَهَا وَلِيَّانِ فَهِي لِلْأَوَّلِ مِنْهُمَا وَمَنْ بَاعَ بَيْعًا مِنْ رَجُلَيْنِ فَهُوَ لِلْأَوَّلِ مِنْهُمَا»

‘Uqbah bin ‘Amir reported the Apostle of Allaah ﷺ as saying “The condition worthier to be fulfilled by you is the one by which you made the private parts (of your wife) lawful (for you). (Using translation from Abū Dāʾūd 2139)  

الكبرى للنسائي:١١٦٦٤عَنْ عُبَيْدِ اللهِ بْنِ سَعِيدٍ عَنْ يَحْيَى بْنِ سَعِيدٍ عَنْ عَبْدِ الْحَمِيدِ بْنِ جَعْفَرٍ عَنْ يَزِيدَ بْنِ أَبِي حَبِيبٍ عَنْ أَبِي الْخَيْرِ الْيَزَنِيِّ مَرْثَدِ بْنِ عَبْدِ اللهِ عَنْ عُقْبَةَ بْنِ عَامِرٍ

عَنِ النَّبِيِّ ﷺ قَالَ «إِنَّ أَحَقَّ الشُّرُوطِ أَنْ تُوَفُّوا بِهِ مَا اسْتَحْلَلْتُمْ بِهِ الْفُرُوجَ»  

nasai-kubra:11665ʿAlī b. Ḥujr > Saʿdān b. Yaḥyá > Zakariyyā b. Abū Zāʾidah > al-Shaʿbī > Jābir b. ʿAbdullāh

"I was with the Prophet on a journey, and my camel got tired. I thought I wanted to let it go, but the Messenger of "Allah met me and prayed for it (the camel) and hit it. Then it started to run like never before. He said: 'Sell it to me for one Uwqyah.' I said" 'No.' He said: 'Sell it to me.' So I sold it to him for one Uwqiyah but stipulated an exception, to ride it until we reached al-Madinah. When we reached Al-Medina, I brought the camel to him and asked him for its price, then I went back. He sent word to me saying; 'Do you think I bargained with you to take your camel?' Take your camel and your Dirhams. (Using translation from Nasāʾī 4637)  

الكبرى للنسائي:١١٦٦٥عَنْ عَلِيِّ بْنِ حُجْرٍ عَنْ سَعْدَانَ بْنِ يَحْيَى عَنْ زَكَرِيَّا بْنِ أَبِي زَائِدَةَ عَنِ الشَّعْبِيِّ عَنْ جَابِرِ بْنِ عَبْدَ اللهِ قَالَ

كُنْتُ مَعَ النَّبِيِّ ﷺ فِي سَفَرٍ فَأَعْيَا جَمَلِي فَأَرَدْتُ أَنْ أُسَيِّبَهُ فَلَحِقَنِي رَسُولُ اللهِ ﷺ فَدَعَا لَهُ وَضَرَبَهُ فَسَارَ سَيْرًا لَمْ يَسِرْ مِثْلَهُ قَالَ «بِعْنِيهِ بِوُقِيَّةٍ» قُلْتُ لَا قَالَ «بِعْنِيهِ» فَبِعْتُهُ بِوُقِيَّةٍ وَاسْتَثْنَيْتُ حُمْلَانَهُ إِلَى الْمَدِينَةِ فَلَمَّا بَلَغَنَا الْمَدِينَةَ أَتَيْتُهُ بِالْجَمَلِ وَانْتَقَدْتُ ثَمَنَهُ ثُمَّ رَجَعْتُ فَأَرْسَلَ إِلَيَّ فَقَالَ «أَتُرَانِي إِنَّمَا مَاكَسْتُكَ لِآخُذَ جَمَلَكَ؟ خُذْ جَمَلَكَ وَدَرَاهِمَكَ»

The Prophet ﷺ said, "The buyer and the seller have the option of canceling or confirming the bargain unless they separate, and if they spoke the truth and made clear the defects of the goods, them they would be blessed in their bargain, and if they told lies and hid some facts, their bargain would be deprived of Allah's blessings." (Using translation from Bukhārī 2110)  

الكبرى للنسائي:١١٦٦٦عَنْ عَمْرو بْنِ عَلِيٍّ عَنْ يَحْيَى عَنْ شُعْبَةَ عَنْ قَتَادَةَ عَنْ صَالِحٍ أَبِي الْخَلِيلِ عَنْ عَبْدِ اللهِ بْنِ الْحَارِثِ بْنِ نَوْفَلٍ الْقُرَشِيِّ عَنْ حَكِيمِ بْنِ حِزَامٍ قَالَ

قَالَ رَسُولُ اللهِ ﷺ «الْبَيِّعَانِ بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا فَإِن صِدْقًا وَبَيَّنَا بُورِكَ لَهُمَا فِي بَيْعِهِمَا وَإِنْ كَذَبَا وَكَتَمَا مُحِقَ بَرَكَةُ بَيْعِهِمَا»

[Machine] The Messenger of Allah ﷺ said, "Every transaction is null and void unless the two parties separate, except for the exchange of choice goods." (11668) And from Abd al-Hamid ibn Muhammad al-Harani, from Makhlad ibn Yazid, from Sufyan al-Thawri, from Abdullah ibn Dinar, with the same narration number (11669). And from Qutaybah, from Sufyan ibn Uyaynah, from Abdullah ibn Dinar, with the same narration number (11670). And from Amr ibn Yazid, from Bahz ibn Asad, from Shu'bah ibn al-Hajjaj, from Abdullah ibn Dinar, with the same narration number (11671). And from al-Rabi' ibn Sulayman ibn Dawud, from Ishaq ibn Bakr ibn Mudar, from his father, from Yazid ibn Abdullah ibn al-Had, from Abdullah ibn Dinar, with the same narration number (11671).  

الكبرى للنسائي:١١٦٦٧عَنْ عَلِيِّ بْنِ حُجْرٍ عَنْ إِسْمَاعِيلَ بْنِ جَعْفَرٍ عَنْ عَبْدِ اللهِ بْنِ دِينَارٍ عَنِ ابْنِ عُمَرَ قَالَ

قَالَ رَسُولُ اللهِ ﷺ «كُلُّ بَيِّعَيْنِ لَا بَيْعَ بَيْنَهُمَا حَتَّى يَتَفَرَّقَا إِلَّا بَيْعَ الْخِيَارِ» 11668 وَعَنْ عَبْدِ الْحَمِيدِ بْنِ مُحَمَّدٍ الْحَرَّانِيِّ عَنْ مَخْلَدِ بْنِ يَزِيدَ عَنْ سُفْيَانَ الثَّوْرِيِّ عَنْ عَبْدِ اللهِ بْنِ دِينَارٍ بِهِ 11669 عَنْ قُتَيْبَةَ عَنْ سُفْيَانَ بْنِ عُيَيْنَةَ عَنْ عَبْدِ اللهِ بْنِ دِينَارٍ بِهِ 11670 عَنْ عَمْرو بْنِ يَزِيدَ عَنْ بَهْزِ بْنِ أَسَدٍ عَنْ شُعْبَةَ بْنِ الْحَجَّاجِ عَنْ عَبْدِ اللهِ بْنِ دِينَارٍ بِهِ 11671 وَعَنْ الرَّبِيعِ بْنِ سُلَيْمَانَ بْنِ دَاوُدَ عَنْ إِسْحَاقَ بْنِ بَكْرِ بْنِ مُضَرَ عَنْ أَبِيهِ عَنْ يَزِيدَ بْنِ عَبْدِ اللهِ بْنِ الْهَادِ عَنْ عَبْدِ اللهِ بْنِ دِينَارٍ بِهِ

[Machine] "The Messenger of Allah, may Allah bless him and grant him peace, said: 'The two parties in a transaction have the option [to cancel the transaction] as long as they have not separated, or one of them says to the other 'choose [whether to proceed with the transaction or not].'" And from Ziyad ibn Ayoub, from Ismail ibn Ulayyah, from Ayoub with the same narration. And from Ali ibn Maymun al-Raqqi, from Sufyan, from Ibn Jurayj, from Nafi', with the same narration. And from Amr ibn Ali, from Yahya ibn Saeed al-Qattan, from Ubaidullah ibn Umar, from Nafi', with the same narration. And from Qutaibah, from Layth, from Nafi', with the same narration. And from Muhammad ibn Salamah and Harith ibn Muskin, both from Ibn al-Qasim, from Malik, from Nafi', with the same narration."

أَنَّ رَسُولَ اللهِ صَلَّى اللهِ عَلَيْهِ وَسَلَّمَ قَالَ الْبَيِّعَانِ بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا أَوْ يَقُولَ أَحَدُهُمَا لِلْآخَرِ اخْتَرْ 11673 وَعَنْ زِيَادِ بْنِ أَيُّوبَ عَنْ إِسْمَاعِيلَ ابْنِ عُلَيَّةَ عَنْ أَيُّوبَ بِهِ 11674 وَعَنْ عَلِيِّ بْنِ مَيْمُونٍ الرَّقِّيِّ عَنْ سُفْيَانَ عَنِ ابْنِ جُرَيْجٍ عَنْ نَافِعٍ بِهِ 11675 وَعَنْ عَمْرو بْنِ عَلِيٍّ عَنْ يَحْيَى بْنِ سَعِيدٍ الْقَطَّانِ عَنْ عُبَيْدِ اللهِ بْنِ عُمَرَ عَنْ نَافِعٍ بِهِ 11676 وَعَنْ قُتَيْبَةَ عَنِ اللَّيْثِ عَنْ نَافِعٍ بِهِ 11677 وَعَنْ مُحَمَّدِ بْنِ سَلَمَةَ وَالْحَارِثِ بْنِ مِسْكِينٍ كِلَاهُمَا عَنِ ابْنِ الْقَاسِمِ عَنْ مَالِكٍ عَنْ نَافِعٍ بِهِ

[Machine] "The Messenger of Allah ﷺ forbade me from selling what I do not possess." [358] 11679 It was narrated from Al-Hasan ibn Ishaaq Al-Marwazi, from Khalid ibn Khidash, from Hammad ibn Zaid, from Yahya ibn Atiq, from Ibn Sirin, from Ayyub bihi, who said: Hammad narrated it to me from Ayyub, 11680 and Humaid ibn Mas'adah narrated it from Abdul-Warith, from Ayyub with the same chain of narration. 11681 And Imran ibn Yazid narrated it from Marwan Al-Fazari, from Auf, and they both mentioned it from Muhammad ibn Sirin, from Hakim ibn Hizam, from the Prophet ﷺ with a similar wording.

"Abdul Majid bin Wahb narrated to us, he said: 'Al-'Adda' bin Khalid bin Hawdhah said to me: "Shall I not read to you a letter that was written for me from the Messenger of Allah ﷺ ?'" He said: 'I said: "Of course." So he took out a letter for me: "This is what Al-'Adda' bin Khalid bin Hawdhah purchased from Muhammad, the Messenger of Allah ﷺ: He purchased from him a slave' - or - 'a female slave, having no ailments, nor being a runaway, nor having any malicious behavior. Sold by a Muslim to a Muslim.'" (Using translation from Tirmidhī 1216)

قَالَ لِيَ الْعَدَّاءُ بْنُ خَالِدٍ أَلَا أُقْرِئَكَ كِتَابًا كَتَبَهُ لِي رَسُولُ اللهِ ﷺ؟ قَالَ قُلْتُ بَلَى فَأَخْرَجَ لِي كِتَابًا «هَذَا مَا اشْتَرَى الْعَدَّاءُ بْنُ خَالِدِ بْنِ هَوْذَةَ مِنْ مُحَمَّدٍ ﷺ اشْتَرَى مِنْهُ عَبْدًا أَوْ أُمَّةً لَا دَاءَ وَلَا غَائِلَةَ وَلَا خِبْثَةَ بَيْعَ الْمُسْلِمِ الْمُسْلِمَ»

The Prophet ﷺ as saying: If anyone buys a slave who possesses property. his property belongs to the seller unless buyer makes a provision and if anyone buys palm-trees after they have been fecundated, the fruit belongs to the seller unless the buyer make a provision. [361] 11694 Ahmad bin Abdullah bin Al-Hakam narrated from Muhammad bin Ja'far, from Shu'bah, from Abd Rabih bin Saeed Al-Ansari, from Nafi that Muhammad bin Salamah narrated from Ibn Al-Qasim, from Malik, from Nafi, that Ata and Ibn Abi Mulaykah said, "The Prophet ﷺ mentioned it in a Mursal form."

It was narrated from Sahl bin Abi Hathamah that the Prophet forbade selling fruits before their condition was known, but he granted a concession allowing 'Araya sales by estimate, so its people could eat fresh dates. (Using translation from Nasāʾī 4542)

«أَنَّ النَّبِيَّ ﷺ نَهَى عَن بَيْعِ الثَّمَرِ حَتَّى يَبْدُو صَلَاحُهُ وَرَخَّصَ فِي الْعَرَايَا أَنْ تُبَاعَ بِخَرْصِهَا يَأْكُلُهَا أَهْلُهَا رُطَبًا»

It was narrated from Au Hurairah that the prophet granted a concession allowing estimation for 'Ararya sales, so long as they were five Wasq or less then that (Using translation from Nasāʾī 4541)

«أَنَّ النَّبِيَّ ﷺ رَخَّصَ فِي الْعَرَايَا أَنْ تُبَاعَ بِخَرْصِهَا فِي خَمْسَةِ أَوْسُقٍ أَوْ مَا دُونَ خَمْسَةٍ»

"The Messenger of Allah forbade us to lease our land. At that time there was no gold nor silver. A man would lease his land in return for what grew on the banks of streams and where the springs emerged, and in return for something specific." (Using translation from Nasāʾī 3902)

«نَهَانَا رَسُولُ اللهِ ﷺ عَنْ كِرَاءِ أَرْضِيْنَا» وَلَمْ يَكُنْ يَوْمَئِذٍ ذَهَبٌ وَلَا فِضَّةٌ فَكَانَ الرَّجُلُ يُكْرِي أَرْضَهُ بِمَا عَلَى الرَّبِيعِ وَالْأَقْبَالِ وَأَشْيَاءَ مَعْلُومَةٍ وَسَاقَهُ

Jabir bin 'Abdullah (Allah be pleased with them) said that the Messenger of Allah ﷺ decreed pre-emption in every joint ownership and not divided-the one-it may be a dwelling or a garden. It is not lawful for him (for the partner) to sell that until his partner gives his consent. He (the partner) is entitled to buy it when he desires and he can abandon it if he so likes. And if he (the one partner) sells it without getting the consent of the (other partner), he has the greatest right to it. (Using translation from Muslim 1608b)

And Zakariyya ibn Yahya reported from Abu Ma'mar Isma'il ibn Ibrahim al-Hudhali from Hushaym from Mansur from Al-Hakam from Amr ibn Shuayb from a man of the Al-Sharid family who said: The Prophet ﷺ mentioned it.

قَالَ النَّبِيُّ ﷺ «الْجَارُ أَحَقُّ بِسَقَبِهِ» 11725 وَعَنْ زَكَرِيَّا بْنِ يَحْيَى عَنْ أَبِي مَعْمَرٍ إِسْمَاعِيلَ بْنِ إِبْرَاهِيمَ الْهُذَلِيِّ عَنْ هُشَيْمٍ عَنْ مَنْصُورٍ عَنِ الْحَكَمِ عَنْ عَمْرو بْنِ شُعَيْبٍ عَنْ رَجُلٍ مِنْ آلِ الشَّرِيدِ قَالَ قَالَ النَّبِيُّ ﷺ فَذَكَرَهُ

[Machine] "That the Messenger of Allah ﷺ ruled by intercession in cases where there was no distribution, but when prescribed punishments were inflicted, there is no intercession." 11733 And narrated from Al-Harith bin Miskin, from Ibn Al-Qasim, from Malik, from Ibn Shihab, from Sa'id and Abu Salamah, from the Prophet ﷺ , who said it as a Mursal Hadith.

«أَنَّ رَسُولَ اللهِ ﷺ قَضَى بِالشُّفْعَةِ فِيمَا لَمْ يُقْسَمْ فَإِذَا وَقَعَتِ الْحُدُودُ فَلَا شُفْعَةَ» 11733 وَعَنِ الْحَارِثِ بْنِ مِسْكِينٍ عَنِ ابْنِ الْقَاسِمِ عَنْ مَالِكٍ عَنِ ابْنِ شِهَابٍ عَنْ سَعِيدٍ وَأَبِي سَلَمَةَ عَنِ النَّبِيِّ ﷺ بِهِ مُرْسَلًا

[Machine] "That the Prophet ﷺ ruled in favor of intercession when there was no division." [369] 11735 And Qutaibah reported from Bakr ibn Mudar, from Ja'far ibn Rabiah, from Bukayr ibn Ashajj, from Ibn al-Musayyib, saying

«أَنَّ النَّبِيَّ ﷺ قَضَى بِالشُّفْعَةِ فِيمَا لَمْ يُقْسَمْ» [369] 11735 وَعَنْ قُتَيْبَةَ عَنْ بَكْرِ بْنِ مُضَرَ عَنْ جَعْفَرِ بْنِ رَبِيعَةَ عَنْ بُكَيْرِ بْنِ الْأَشَجِّ عَنِ ابْنِ الْمُسَيِّبِ قَوْلَهُ

The Messenger of Allah said: "No town-dweller should sell for a desert-dweller, do not artificially inflate prices, no man should urge a seller to cancel a sale already agreed upon with another buy so as to by the goods himself, no one should make a proposal over the proposal of his brother and no woman should make a proposal over the proposal of his brother and no woman should ask for her sister in faith) to be divorced so as to turn over what is in her vessel Deprived her of her share of maintenance) and so that she may get married in her place: she will have what Allah has decreed or her." الكبرى للنسائي:١١٧٣٦عَنْ مُجَاهِدِ بْنِ مُوسَى عَنْ إِسْمَاعِيلَ بْنِ إِبْرَاهِيمَ عَنْ مَعْمَرٍ عَنِ الزُّهْرِيِّ عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ عَنْ أَبِي هُرَيْرَةَ قَالَ

قَالَ رَسُولُ اللهِ ﷺ «لَا يَبِيعَنَّ حَاضِرٌ لِبَادٍ وَلَا تَنَاجَشُوا وَلَا يُسَاوِمِ الرَّجُلُ عَلَى سَوْمِ أَخِيهِ وَلَا يَخْطُبْ عَلَى خِطْبَةِ أَخِيهِ وَلَا تَسْأَلِ الْمَرْأَةُ طَلَاقَ أُخْتِهَا لِتَكْتَفِئَ مَا فِي إِنَائِهَا وَلْتَنْكِحْ فَإِنَّمَا لَهَا مَا كَتَبَ اللهُ لَهَا»

[Machine] "That the Prophet ﷺ gave to the Jews Khaybar's palm trees and its land, on the condition that they would work it with their own wealth, and that the Messenger of Allah ﷺ has a share of its fruits." 11738 And from Abdullah bin Abd al-Rahman bin Abd al-Hakam, from Shuayb bin al-Layth, from his father al-Layth bin Saad bihi

«أَنَّ النَّبِيَّ ﷺ دَفَعَ إِلَى يَهُودِ خَيْبَرَ نَخْلَ خَيْبَرَ وَأَرْضَهَا عَلَى أَنْ يَعْتَمِلُوهَا مِنْ أَمْوَالِهِمْ وَأَنَّ لِرَسُولِ اللهِ ﷺ شَطْرَ ثَمَرَتِهَا» 11738 وَعَنْ عَبْدِ الرَّحْمَنِ بْنِ عَبْدِ اللهِ بْنِ عَبْدِ الْحَكَمِ عَنْ شُعَيْبِ بْنِ اللَّيْثِ عَنْ أَبِيهِ اللَّيْثِ بْنِ سَعْدِ بِهِ
