٥٥۔ كِتَابُ الشُّرُوطِ ص ٢

nasai-kubra:11739Muḥammad b. Ismāʿīl b. Ibrāhīm > Yaḥyá b. Abū Bukayr > Shuʿbah > ʿAbd al-Raḥman b. al-Qāsim from his father > ʿĀʾishah

"Shu'bah narrated to us, from 'Abdur-Rahman bin Al-Qasim, from his father, from 'Aishah. He (Shu'bah) said: "And he ('Abdur-Rahman) was the executor for his father." He (Shu'bah) said: "I was afraid to say to him: 'Did you hear this from your father.'" -- 'Aishah said: "I asked the Messenger of Allah about Barirah, as I wanted to buy her but it was stipulated that the Wala' would go to her (former) masters. He said: 'Buy her, for the Wala' is to the one who sets the slave free.' And she was given the choice, as her husband was a slave." Then he said, after that: "I do not know." --"And some meat was brought to the Messenger of Allah and they said: 'This is some of that which was given in charity to Barirah.' He said: 'It is charity for her and a gift for us.'" (Using translation from Nasāʾī 3454)

سَأَلْتُ رَسُولَ اللهِ ﷺ عَنْ بَرِيرَةَ وَأَرَدْتُ أَنْ أَشْتَرِيَهَا وَأَشْتَرِطَ الْوَلَاءَ لِأَهْلِهَا فَقَالَ «اشْتَرِيهَا فَإِنَّ الْوَلَاءَ لِمَنْ أَعْتَقَ» قَالَ وَخُيِّرَتْ وَكَانَ زَوْجِهَا عَبْدًا ثُمَّ قَالَ بَعْدَ ذَلِكَ مَا أَدْرِي مَا أَدْرِي وَأُتِيَ رَسُولُ اللهِ ﷺ بِلَحْمٍ فَقَالُوا هَذَا مِمَّا تُصُدِّقَ بِهِ عَلَى بَرِيرَةَ قَالَ «هُوَ لَهَا صَدَقَةٌ وَلَنَا هَدِيَّةٌ»

Aisha said that Barirah came to seek her help in the writing of her emancipation. ʿAisha said to her, "If you wish, I will pay your masters (your price) and the wala' will be for me." When Messenger of Allah ﷺ came, she told him about it. The Prophet ﷺ said to her, "Buy her (i.e. Barirah) and manumit (free) her, for the Wala is for the one who manumits." Then Messenger of Allah ﷺ ascended the pulpit and said, "What about those people who stipulate conditions which are not in Allah's Laws? Whoever stipulates such conditions as are not in Allah's Laws, then those conditions are invalid even if he stipulated a hundred such conditions." (Using translation from Bukhārī 2735)   

الكبرى للنسائي:١١٧٤٠عَنْ مُحَمَّدِ بْنِ مَنْصُورٍ عَنْ سُفْيَانَ عَنْ يَحْيَى بْنِ سَعِيدٍ عَنْ عَمْرَةَ عَنْ عَائِشَةَ أَنَّ بَرِيرَةَ جَاءَتْ إِلَى عَائِشَةَ تَسْأَلُهَا فِي كِتَابَتِهَا فَقَالَ

أَهْلُهَا إِنْ شِئْتِ أَعْطَيْتِ بَاقِي كِتَابَتِهَا وَيَكُونُ لَنَا الْوَلَاءُ فَلَمَّا أَنْ جَاءَ النَّبِيُّ ﷺ ذَكَرَتْ ذَلِكَ لَهُ فَقَالَ «اشْتَرِيهَا فَأَعْتِقِيهَا فَإِنَّ الْوَلَاءَ لِمَنْ أَعْتَقَ» ثُمَّ صَعِدَ رَسُولُ اللهِ ﷺ الْمِنْبَرَ فَقَالَ «مَا شَأْنُ النَّاسِ يَشْتَرِطُونَ شُرُوطًا لَيْسَ فِي كِتَابِ اللهِ مَنِ اشْتَرَط شَرْطًا لَيْسَ فِي كِتَابِ اللهِ لَم يَجُزْ لَهُ وَإِنِ اشْتَرَطَ مِائَةَ شَرْطٍ»

[Machine] On the authority of the Prophet Muhammad ﷺ , he said, "Every condition that is not in the Book of Allah is invalid."  

الكبرى للنسائي:١١٧٤١عَنْ إِسْحَاقَ بْنِ إِبْرَاهِيمَ عَنْ سُفْيَانَ عَنْ يَحْيَى بْنِ سَعِيدٍ عَنْ عَمْرَةَ عَنْ عَائِشَةَ

عَنِ النَّبِيِّ ﷺ قَالَ «كُلُّ شَرْطٍ لَيْسَ فِي كِتَابِ اللهِ فَهُوَ بَاطِلٌ»

He who kept a dog other than one meant for hunting or for watching the herd, lost two qirat of his reward every day. (Using translation from Muslim 1574b)

عَنِ النَّبِيِّ ﷺ قَالَ «مَنِ اقْتَنَى كَلْبًا إِلَّا كَلْبَ صَيْدٍ أَوْ مَاشِيَةٍ نَقَصَ مِنْ أَجْرِهِ كُلَّ يَوْمٍ قِيرَاطَانِ»

"The Messenger of Allah said:' whoever keeps a dog except one that is trained for hunting or a dog for herding livestock, two Qirats will be deducted from his reward each day." (Using translation from Nasāʾī 4286)  

الكبرى للنسائي:١١٧٤٣عَنْ قُتَيْبَةَ بْنِ سَعِيدٍ عَنِ اللَّيْثِ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ

أَنَّهُ سَمِعَهُ يَقُولُ إِنَّ رَسُولَ اللهِ ﷺ قَالَ «مَنْ أَمْسَكَ كَلْبًا إِلَّا كَلْبًا ضَارِيًا أَوْ كَلْبَ مَاشِيَةٍ نَقَصَ مِنْ أَجْرِهِ كُلَّ يَوْمٍ قِيرَاطَانِ»

Two men brought a dispute before the Messenger of Allah ﷺ. One of them said: Pronounce judgement between us in accordance with Allah’s Book, Messenger of Allah! The other who had more understanding said: Yes, Messenger of Allah! Pronounce judgement between us in accordance with Allah’s Book, and allow me to speak. He (the Prophet) said: Speak, He then said: My son who was a hired servant with this(man) committed fornication with his wife, and when I was told that my son must be stoned to death, I ransomed him with a hundred sheep and a slave girl of mine; but when I asked the learned, they told me that my son should receive a hundred lashes and be banished for a year, and that stoning to death applied only to man’s wife. The apostle of Allah ﷺ replied: By him in whose hand my soul is, I shall certainly pronounce judgment between you in accordance with Allah’s Book. Your sheep and your slave girl must be returned to you, and your son shall receive a hundred lashes and be banished for a year. And he commanded Unias al-Aslami go to that man’s wife, and if she confessed, he should stone her to death. She confessed and he stoned her. (Using translation from Abū Dāʾūd 4445)  

الكبرى للنسائي:١١٧٤٥عَنْ يُونُسَ بْنِ عَبْدِ الْأَعْلَى عَن ابْنِ وَهْبٍ عَنْ مَالِكٍ وَيُونُسَ بْنِ يَزِيدَ وَعَنِ الْحَارِثِ بْنِ مِسْكِينٍ عَنِ ابْنِ وَهْبٍ عَنْ يُونُسَ وَغَيْرِهِ كِلَاهُمَا مَالِكٌ وَيُونُسُ عَنِ ابْنِ شِهَابٍ عَنْ عُبَيْدِ اللهِ بْنِ عَبْدِ اللهِ بْنِ عُتْبَةَ عَنْ زَيْدِ بْنِ خَالِدٍ وَأَبِي هُرَيْرَةَ

أَنَّ رَجُلَيْنِ أَتَيَا رَسُولَ اللهِ ﷺ يَخْتَصِمَانِ إِلَيْهِ فَقَالَ أَحَدُهُمَا اقْضِ بَيْنَنَا بِكِتَابِ اللهِ وَقَالَ الْآخَرُ وَكَانَ أَفْقَهَهُمَا أَجْلْ فَاقْضِ بَيْنَنَا بِكِتَابِ اللهِ وَائْذَنْ لِي فِي أَنْ أَتَكَلَّمَ قَالَ «تَكَلَّمْ» قَالَ إِنَّ ابْنِي كَانَ عَسِيفًا عَلَى هَذَا وَإِنَّهُ زَنَى بِامْرَأَتِهِ فَأَخْبَرَنِي أَنَّ عَلَى ابْنِي الرَّجْمَ فَافْتَدَيْتُ مِنْهُ بِمَائَةِ شَاةٍ وَجَارِيَةٍ ثُمَّ إِنِّي سَأَلْتُ أَهْلَ الْعِلْمِ فَأَخْبَرُونِي أَنَّمَا عَلَى ابْنِي جَلْدُ مَائَةٍ وَتَغْرِيبُ عَامٍ وَإِنَّمَا الرَّجْمُ عَلَى امْرَأَتِهِ قَالَ رَسُولُ اللهِ ﷺ «وَالَّذِي نَفْسِي بِيَدِهِ لَأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ اللهِ أَمَّا غَنَمُكَ وَجَارِيَتُكَ فَرَدٌّ إِلَيْكَ» وَجَلَدَ ابْنَهُ مَائَةً وَغَرَّبَهُ عَامًا وَأَمَرَ أُنَيْسًا أَنْ يُرْجَمَ امْرَأَةَ الْآخَرِ إِنِ اعْتَرَفَتْ فَاعْتَرَفَتْ فَرَجَمَهَا

“Umm Salamah freed me but stipulated that I should serve the Prophet ﷺ as long he lived.” (Using translation from Ibn Mājah 2526)  

الكبرى للنسائي:١١٧٤٦عَنْ مُحَمَّدِ بْنِ عُثْمَانَ عَنْ بَهْزٍ عَنْ حَمَّادِ بْنِ سَلَمَةَ عَنْ سَعِيدِ بْنِ جُمْهَانَ عَنْ سَفِينَةَ قَالَ «§أَعْتَقَتْنِي أُمُّ سَلَمَةَ وَاشْتَرَطَتْ عَلِيَّ

أَنْ أَخْدُمَ النَّبِيَّ ﷺ مَا عَاشَ»

[Machine] That the Prophet of Allah ﷺ reconciled with the polytheists on the day of Hudaybiyah. He said to Ali, "Write, O Ali, this is what is agreed upon by Muhammad, the messenger of Allah." They said, "If we had known that you are the messenger of Allah, we would not have fought against you." The messenger of Allah ﷺ said, "Erase, O Ali, O Allah, You know that I am the messenger of Allah, erase, O Ali, and write, this is what is agreed upon by Muhammad ibn Abdullah, abbreviated, and it is an abbreviation of the Hadeeth of Al-Hururiyyah."  

الكبرى للنسائي:١١٧٤٧عَنْ عَمْرو بْنِ عَلِيٍّ عَنِ ابْنِ مَهْدِيٍّ عَنْ عِكْرِمَةَ بْنِ عَمَّارٍ عَنْ أَبِي زُمَيْلٍ سِمَاكِ بْنِ الْوَلِيدِ عَنِ ابْنِ عَبَّاسٍ

أَنَّ نَبِيَّ اللهِ ﷺ يَوْمَ الْحُدَيْبِيَةِ صَالَحَ الْمُشْرِكِينَ فَقَالَ لِعَلِيٍّ اكْتُبْ يَا عَلِيُّ هَذَا مَا صَالَحَ عَلَيْهِ مُحَمَّدٌ رَسُولُ اللهِ قَالُوا لَوْ نَعْلَمُ أَنَّكَََ رَسُولُ اللهِ مَا قَاتَلْنَاكَ فَقَالَ رَسُولُ اللهِ ﷺ امْحُ يَا عَلِيٌّ اللهُمَّ إِنَّكَ تَعْلَمُ أَنِّي رَسُولُ اللهِ امْحُ يَا عَلِيٌّ وَاكْتُبْ هَذَا مَا صَالِحَ عَلَيْهِ مُحَمَّدُ بْنُ عَبْدِ اللهِ مُخْتَصَرٌ وَهُوَ مُخْتَصَرٌ مِنْ حَدِيثِ الْحَرُورِيَّةِ

(from the companions of Messenger of Allah ﷺ) When Suhail bin ʿAmr agreed to the Treaty (of Hudaibiya), one of the things he stipulated then, was that the Prophet ﷺ should return to them (i.e. the pagans) anyone coming to him from their side, even if he was a Muslim; and would not interfere between them and that person. The Muslims did not like this condition and got disgusted with it. Suhail did not agree except with that condition. So, the Prophet ﷺ agreed to that condition and returned Abu Jandal to his father Suhail bin ʿAmr. Thenceforward the Prophet ﷺ returned everyone in that period (of truce) even if he was a Muslim. During that period some believing women emigrants including Um Kulthum bint ʿUqba bin Abu Muait who came to Messenger of Allah ﷺ and she was a young lady then. Her relative came to the Prophet ﷺ and asked him to return her, but the Prophet ﷺ did not return her to them for Allah had revealed the following Verse regarding women: "O you who believe! When the believing women come to you as emigrants. Examine them, Allah knows best as to their belief, then if you know them for true believers, Send them not back to the unbelievers, (for) they are not lawful (wives) for the disbelievers, Nor are the unbelievers lawful (husbands) for them (60.10) (Using translation from Bukhārī 2711)  

الكبرى للنسائي:١١٧٤٨عَنْ يَعْقُوبَ بْنِ إِبْرَاهِيمَ الدَّوْرَقِيِّ عَنْ يَحْيَى بْنِ سَعِيدٍ عَنِ ابْنِ الْمُبَارَكِ عَنْ مَعْمَرٍ عَنِ الزُّهْرِيِّ عَنْ عُرْوَةَ عَنِ الْمِسْوَرِ بْنِ مَخْرَمَةَ وَمَرْوَانَ بْنِ الْحَكَمِ يُخْبِرَانِ

عَنْ أَصْحَابِ رَسُولِ اللهِ ﷺ قَالَ لَمَّا كَاتَبَ سُهَيْلُ بْنُ عَمْرٍو يَوْمَئِذٍ كَانَ فِيمَا اشْتَرَطَ سُهَيْلُ بْنُ عَمْرٍو عَلَى النَّبِيِّ ﷺ أَنْ لَا يَأْتِيَكَ مِنَّا أَحَدٌ وَإِنْ كَانَ عَلَى دَينِكَ إِلَّا رَدَدْتَهُ إِلَيْنَا وَخَلَّيْتَ بَيْنَنَا وَبَيْنَهُ فَكَرِهَ الْمُؤْمِنُونَ ذَلِكَ وَامْتَعَضُوا مِنْهُ وَأَبَى سُهَيْلٌ إِلَّا ذَلِكَ «فَكَاتَبَهُ النَّبِيُّ ﷺ عَلَى ذَلِكَ» فَرَدَّ يَوْمَئِذٍ أَبَا جَنْدَلٍ إِلَى أَبِيهِ سُهَيْلِ بْنِ عَمْرٍو وَلَمْ يَأْتِهِ أَحَدٌ مِنَ الرِّجَالِ إِلَّا رَدَّهُ فِي تِلْكَ الْمُدَّةِ وَإِنْ كَانَ مُسْلِمًا وَجَاءَ الْمُؤْمِنَاتُ مُهَاجِرَاتٍ وَكَانَتْ أُمُّ كُلْثُومٍ بِنْتُ عُقْبَةَ بْنِ أَبِي مُعَيْطٍ مِمَّنْ خَرَجَ إِلَى رَسُولِ اللهِ ﷺ يَوْمَئِذٍ وَهِيَ عَاتِقٌ فَجَاءَ أَهْلُهَا يَسْأَلُونَ النَّبِيَّ ﷺ أَنْ يُرْجِعَهَا إِلَيْهِمْ «فَلَمْ يُرْجِعَهَا إِلَيْهِمْ» لَمَّا أَنْزَلَ اللهُ فِيهِنَّ {إِذَا جَاءَكُمُ الْمُؤْمِنَاتُ مُهَاجِرَاتٍ فَامْتَحِنُوهُنَّ اللهُ أَعْلَمُ بِإِيمَانِهِنَّ} [الممتحنة 10] إِلَى قَوْلِه {وَلَا هُمْ يَحِلُّونَ لَهُنَّ} [الممتحنة 10]  

nasai-kubra:11749ʿImrān b. Bakkār > ʿAlī b. ʿAyyāsh > Shuʿayb b. Abū Ḥamzah > Abū al-Zinād > al-Aʿraj > Abū Hurayrah > al-Anṣār Lilnnabī ﷺ Āqsim Baynanā And Bayn Ikhwāninā al-Nakhīl

The Ansar said to the Prophet ﷺ "Distribute the date palm trees between us and our emigrant brothers." He replied, "No." The Ansar said (to the emigrants), "Look after the trees (water and watch them) and share the fruits with us." The emigrants said, "We listen and obey." (Using translation from Bukhārī 2325)  

الكبرى للنسائي:١١٧٤٩عَنْ عِمْرَانَ بْنِ بَكَّارٍ عَنْ عَلِيِّ بْنِ عَيَّاشٍ عَنْ شُعَيْبِ بْنِ أَبِي حَمْزَةَ عَنْ أَبِي الزِّنَادِ عَن الْأَعْرَجِ عَنْ أَبِي هُرَيْرَةَ قَالَ

قَالَتِ الْأَنْصَارُ لِلنَّبِيِّ ﷺ اقْسِمْ بَيْنَنَا وَبَيْنَ إِخْوَانِنَا النَّخِيلَ قَالَ «لَا» فَقَالُوا تَكْفُونَا الْمَؤُونَةَ وَنُشْرِكُكُمْ فِي الثَّمَرَةِ قَالُوا سَمِعْنَا وَأَطَعْنَا

The Prophet ﷺ said, "The people of my generation are the best, then those who follow them, and then whose who follow the latter. After that there will come some people whose witness will go ahead of their oaths, and their oaths will go ahead of their witness." Ibrahim (a sub-narrator) said, "We used to be beaten for taking oaths by saying, 'I bear witness by the Name of Allah or by the Covenant of Allah." (Using translation from Bukhārī 2652)

عَنِ النَّبِيِّ ﷺ قَالَ «خَيْرُ أُمَّتِي الْقَرْنُ الَّذِينَ يَلُونِي ثُمَّ الَّذِينَ يَلُونَهُمْ ثُمَّ الَّذِينَ يَلُونَهُمْ ثُمَّ يَجِيءُ أَقْوَامٌ تَسْبِقُ شَهَادَةُ أَحَدُهُمْ يَمِينًَهُ وَيَمِينُهُ شَهَادَتهُ»

It was narrated from Al-Hasan that he disliked to hire a man without telling him what his wages would be. (Using translation from Nasāʾī 3858)

أَنْ يَسْتَأْجِرَ الرَّجُلَ حَتَّى يُعْلِمَهُ أَجْرَهُ»

الكبرى للنسائي:١١٧٥٢عَنْ مُحَمَّدِ بْنِ حَاتِمٍ عَنْ حِبَّانَ بْنِ مُوسَى عَنْ عَبْدِ اللهِ عَنْ جَرِيرِ بْنِ حَازِمٍ عَنْ L2483 حَمَّادِ بْنِ أَبِي سُلَيْمَانَ أَنَّهُ سُئِلَ عَنْ §رَجُلٍ اسْتَأْجَرَ أَجِيرًا عَلَى طَعَامِهِ قَالَ

«لَا حَتَّى يُعْلِمَهُ»

"I do not know that Shuraih ever ruled on Mudarabah disputes except in two ways. He would say to the Mudarib (the one who contributed his labor to the partnership): 'You must provide proof that a calamity befell you so that you may be excused.' Or he would say to the one who invested his money in the partnership: 'You must provide proof that your trustee betrayed his trust, otherwise his oath sworn by Allah that he did not betray you is sufficient.'" الكبرى للنسائي:١١٧٥٣عَنْ عَمْرو بْنِ زُرَارَةَ عَنْ إِسْمَاعِيلَ عَنْ أَيُّوبَ عَنْ مُحَمَّدٍ قَالَ

لَمْ أَعْلَمْ شُرَيْحًا كَانَ يَقْضِي فِي الْمُضَارِبِ إِلَّا بِقَضَاءَيْنِ كَانَ رُبَّمَا قَالَ لِلْمُضَارِبِ «بَيِّنَتُكَ عَلَى مُصِيبَة تُعْذَرُ بِهَا» وَرُبَّمَا قَالَ لِصَاحِبِ الْمَالِ «بَيِّنَتُكَ عَلَى أَنَّ أَمِينُكَ خَانَكَ وَإِلَّا فَيَمِينُهُ بِاللهِ مَا خَانَكَ»

"I said to 'Ata': 'What if I hire a slave for a year in return for his food, and for another year, in return for such and such?' He said: 'There is nothing wrong with that, and you may stipulate your conditions of hiring even for a few days.' 'How about if I make a deal to hire him when part of the year has passed?' He said: 'Do not hold me to account for what has passed.'" (Using translation from Nasāʾī 3861)

قُلْتُ لِعَطَاءٍ عَبْدٌ أُؤَاجِرُهُ سَنَةً بِطَعَامِهِ وَسُنَّةً أُخْرَى بِخَرَاجِ كَذَا وَكَذَا؟ قَالَ «لَا بَأْسَ» قَالَ وَكَرِهَ اشْتِرَاطَكَ حَتَّى تُؤَاجِرَهُ أَيَّامًا لَغْوًا أَوْ آجَرْتَهُ وَقَدْ مَضَى بَعْضُ الشَّهْرِ قَالَ «إِنَّكَ لَا تُحَاسِبُنِي بِمَا مَضَى»
