13. Commerce
١٣۔ كِتَابُ الْبُيُوعِ
[Machine] In His saying, "{Whoever is wealthy, let him refrain [from spending extravagantly]; and whoever is poor, let him eat [only] in an acceptable manner.}" [Surah An-Nisa: 6], it is said to have been revealed regarding the guardian of the wealth of the orphan when he is poor, that he should eat from the wealth of the orphan in place of his own sustenance in a manner that is acceptable. And Abu Abdullah narrated to us, and Abu Al-Waleed narrated to me, from Al-Hassan bin Sufyan, from Abu Bakr bin Abi Shaybah, from Abdullah bin Sulaiman, from Hisham, and he mentioned this except that he said, "It was revealed regarding the guardian of the wealth of the orphan who takes care of him and rectifies his affairs when he is in need, that he should eat from it."
ؓ فِي قَوْلِهِ ﷻ {مَنْ كَانَ غَنِيًّا فَلْيَسْتَعْفِفْ وَمَنْ كَانَ فَقِيرًا فَلْيَأْكُلْ بِالْمَعْرُوفِ} [النساء 6] قَالَتْ إِنَّمَا نَزَلَتْ فِي وَالِي مَالِ الْيَتِيمِ إِذَا كَانَ فَقِيرًا أَنَّهُ يَأْكُلُ مِنْهُ مَكَانَ قِيَامِهِ عَلَيْهِ بِالْمَعْرُوفِ 10992 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ أَخْبَرَنِي أَبُو الْوَلِيدِ ثنا الْحَسَنُ بْنُ سُفْيَانَ ثنا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ ثنا عَبْدَةُ بْنُ سُلَيْمَانَ عَنْ هِشَامٍ فَذَكَرَهُ بِنَحْوِهِ إِلَّا أَنَّهُ قَالَ أُنْزِلَتْ فِي وَالِي مَالِ الْيَتِيمِ الَّذِي يَقُومُ عَلَيْهِ وَيُصْلِحُهُ إِذَا كَانَ مُحْتَاجًا أَنْ يَأْكُلَ مِنْهُ
[Machine] I said to the Messenger of Allah ﷺ, "What should I give as a compensation for striking my orphan?" He replied, "Give from what you have been striking your child with, without causing harm, and without taking any of his wealth or seeking any wealth from him."
قُلْتُ لِرَسُولِ اللهِ ﷺ مِمَّ أَضْرِبُ مِنْهُ يَتِيمِي؟ فَقَالَ مِمَّا كُنْتَ ضَارِبًا وَلَدَكَ غَيْرَ وَاقٍ مَالَكَ بِمَالِهِ وَلَا مُتَأَثِّلٍ مِنْ مَالِهِ مَالًا كَذَا
[Machine] "O Messenger of Allah, what should I use to discipline my orphaned child?"
He replied, "Use what you used to discipline him when he was living with you."
The person then asked, "Would I face any harm if I take from his wealth?"
The Prophet replied, "No, as long as you do not take his wealth in excess or leave him without any."
يَا رَسُولَ اللهِ مِمَّ أَضْرِبُ مِنْهُ يَتِيمِي؟ قَالَ مِمَّا كُنْتَ مِنْهُ ضَارِبًا وَلَدَكَ قَالَ أَفَأُصِيبُ مِنْ مَالِهِ؟ قَالَ غَيْرَ مُتَأَثِّلٍ مَالًا وَلَا وَاقٍ مَالَكَ بِمَالِهِ هَذَا مُرْسَلٌ
[Machine] "So he drank from its messenger, which means from its milk."
فَأَصِبْ مِنْ رِسْلِهَا يَعْنِي مِنْ لَبَنِهَا
[Machine] If you want to reply to her call and splash in her pool and enjoy her stream, then drink something that does not harm the offspring or breach the laws in milk. [Sa'id said] Jarir narrated from Abu Ishaq Ash-Shaybani from 'Ikrimah from Ibn 'Abbas who said: "The guardian puts his hand in their hands and does not wear the turban or anything above it."
إِنْ كُنْتَ تَرُدُّ نَادَّتَهَا وَتَلُوطُ حَوْضَهَا وَتَهْنَأُ جَرْبَاهَا فَاشْرَبْ غَيْرَ مُضِرٍّ بِنَسْلٍ وَلَا نَاهِكٍ فِي حَلْبٍ 10997 قَالَ وَحَدَّثَنَا سَعِيدٌ ثنا جَرِيرٌ عَنْ أَبِي إِسْحَاقَ الشَّيْبَانِيِّ عَنْ عِكْرِمَةَ عَنِ ابْنِ عَبَّاسٍ قَالَ يَضَعُ الْوَصِيُّ يَدَهُ مَعَ أَيْدِيهِمْ وَلَا يَلْبَسُ الْعِمَامَةَ فَمَا فَوْقَهَا
[Machine] He eats the wealth of the orphan with his own fingers, and does not exceed that.
يَأْكُلُ مَالَ الْيَتِيمِ بِأَصَابِعِهِ لَا يَزِيدُ عَلَى ذَلِكَ
إِنْ كَانَ فَقِيرًا فَلْيَضْرِبْ بِيَدِهِ مَعَ أَيْدِيهِمْ فَلْيَأْكُلْ وَلَا يَكْتَسِي عِمَامَةً فَمَا فَوْقَهَا
