13. Commerce
١٣۔ كِتَابُ الْبُيُوعِ
[Machine] About Ali, regarding a man who bought a slave girl and examined her, finding a defect in her. Ali said he must keep her, and the seller must return anything between health and illness, even if he hadn't examined her, he must return her in the same manner.
عَنْ عَلِيٍّ فِي رَجُلٍ اشْتَرَى جَارِيَةً فَوَطِئَهَا فَوَجَدَ بِهَا عَيْبًا قَالَ لَزِمَتْهُ وَيَرُدُّ الْبَائِعُ مَا بَيْنَ الصِّحَّةِ وَالدَّاءِ وَإنْ لَمْ يَكُنْ وَطِئَهَا رَدَّهَا وَكَذَلِكَ
[Machine] If she was a mature woman, she would pay half of the tenth. If she was a virgin, she would pay the full tenth. Ali said, "This is a forged verse. It is not known to be proven by Umar or Ali or any of them." Al-Shafi'i said, "We don't know it to be proven by Umar or Ali or anyone else. Some of those who attended and debated him, from the people of hadith, said that it is not proven. This is what Abu Abdullah Al-Hafiz narrated from him, from Abu Abbas, from Ar-Rabi', from Ash-Shafi'i, in the book of the disputes of the Iraqis."
إِنْ كَانَتْ ثَيِّبًا رَدَّ مَعَهَا نِصْفَ الْعُشْرِ وَإنْ كَانَتْ بِكْرًا رَدَّ الْعُشْرَ قَالَ عَلِيٌّ هَذَا مُرْسَلٌ عَامِرٌ لَمْ يُدْرِكْ عُمَرَ قَالَ الشَّافِعِيُّ ؓ لَا نَعْلَمُهُ يَثْبُتُ عَنْ عُمَرَ وَلَا عَلِيٍّ وَلَا وَاحِدٍ مِنْهُمَا وَكَذَلِكَ قَالَ بَعْضُ مَنْ حَضَرَهُ وَحَضَرَ مَنْ يُنَاظِرُهُ فِي ذَلِكَ مِنْ أَهْلِ الْحَدِيثِ أَنَّ ذَلِكَ لَا يَثْبُتُ وَهُوَ فِيمَا أَجَازَ لِي أَبُو عَبْدِ اللهِ الْحَافِظُ رِوَايَتَهُ عَنْهُ عَنْ أَبِي الْعَبَّاسِ عَنِ الرَّبِيعِ عَنِ الشَّافِعِيِّ فِي كِتَابِ اخْتِلَافِ الْعِرَاقِيِّينَ
