13. Commerce
١٣۔ كِتَابُ الْبُيُوعِ
[Machine] O mother of Zaid, I have sent Zaid as a slave for eight hundred bad deeds and I bought him from him with six hundred in cash. Then Aisha said, "Inform Zaid that you have invalidated your jihad with the Messenger of Allah, except unless you repent. How bad is what you have sold and how bad is what you have bought." This is what Shu'bah reported through the method of transmission.
أُمُّ وَلَدِ زَيْدٍ إِنِّي بِعْتُ مِنْ زَيْدٍ عَبْدًا بِثَمَانِمِائَةٍ نَسِيئَةً وَاشْتَرَيْتُهُ مِنْهُ بِسِتِّمِائَةٍ نَقْدًا فَقَالَتْ عَائِشَةُ ؓ أَبْلِغِي زَيْدًا أَنْ قَدْ أَبْطَلْتَ جِهَادَكَ مَعَ رَسُولِ اللهِ ﷺ إِلَّا أَنْ تَتُوبَ بِئْسَمَا شَرَيْتَ وَبِئْسَ مَا اشْتَرَيْتَ كَذَا جَاءَ بِهِ شُعْبَةُ عَنْ طَرِيقِ الْإِرْسَالِ
[Machine] "So, I sent her as a maid to him for eight hundred bad deeds, and indeed he wanted to sell her, so I bought her from him for six hundred in cash. She said to her, 'How bad of a purchase you made, and how bad of a purchase he made! Inform Zaid that he has invalidated his jihad with the Messenger of Allah ﷺ if he does not repent 10800'. Sufyan Ath-Thawri narrated from Abu Ishaq from his noble wife that the wife of Abu As-Safar sold her maid to At-Ta'a from Zaid bin Arqam for eight hundred dirhams. He mentioned it, except that he said, 'How bad of a thing you bought, and how bad of a thing you sold.' He added, 'She said, 'What if I only take my capital?' He said, 'If he receives advice from his Lord and repents, then he can have what has preceded.' Abu Bakr Muhammad bin Ibrahim Al-Ardestani Al-Hafiz informed us, that I, Abu Nasr Al-Iraqi, that I am Sufyan bin Muhammad. Ali bin Al-Hassan narrated to me, on the authority of Abdullah bin Al-Walid, on the authority of Sufyan. He mentioned it in this manner."
فَإِنِّي بِعْتُهُ جَارِيَةً إِلَى عَطَائِهِ بِثَمَانِمِائَةٍ نَسِيئَةً وَإِنَّهُ أَرَادَ بَيْعَهَا فَاشْتَرَيْتُهَا مِنْهُ بِسِتِّمِائَةٍ نَقْدًا فَقَالَتْ لَهَا بِئْسَ مَا اشْتَرَيْتِ وَبِئْسَ مَا اشْتَرَى أَبْلِغِي زَيْدًا أَنَّهُ قَدْ أَبْطَلَ جِهَادَهُ مَعَ رَسُولِ اللهِ ﷺ إِنْ لَمْ يَتُبْ 10800 وَرَوَاهُ سُفْيَانُ الثَّوْرِيُّ عَنْ أَبِي إِسْحَاقَ عَنِ امْرَأَتِهِ الْعَالِيَةِ أَنَّ امْرَأَةَ أَبِي السَّفَرِ بَاعَتْ جَارِيَةً لَهَا إِلَى الْعَطَاءِ مِنْ زَيْدِ بْنِ أَرْقَمَ بِثَمَانِمِائَةِ دِرْهَمٍ فَذَكَرَهُ إِلَّا أَنَّهُ قَالَ بِئْسَ مَا شَرَيْتِ وَبِئْسَ مَا اشْتَرَيْتِ وَزَادَ قَالَتْ أَرَأَيْتِ إِنْ لَمْ آخُذْ إِلَّا رَأْسَ مَالِي قَالَتْ فَمَنْ جَاءَهُ مَوْعِظَةٌ مِنْ رَبِّهِ فَانْتَهَى فَلَهُ مَا سَلَفَ أَخْبَرَنَاهُ أَبُو بَكْرٍ مُحَمَّدُ بْنُ إِبْرَاهِيمَ الْأَرْدَسْتَانِيُّ الْحَافِظُ أنا أَبُو نَصْرٍ الْعِرَاقِيُّ أنا سُفْيَانُ بْنُ مُحَمَّدٍ ثنا عَلِيُّ بْنُ الْحَسَنِ ثنا عَبْدُ اللهِ بْنُ الْوَلِيدِ ثنا سُفْيَانُ فَذَكَرَهُ كَذَا
[Machine] A man sold a saddle to another man and did not receive its price. Then, the owner of the saddle wanted to sell it, but the one who sold it wanted to take it back without giving back what he had sold from it. So, Ibn Umar was asked about this, and he did not see any problem with it. Ibn Umar said: Perhaps if he sold it to someone else, he would have sold it for that price or even less. And Sufyan narrated from Hisham from Ibn Sirin that a man sold a camel to another man and said: Accept your camel and thirty dirhams from me. They asked Shurayh, and he did not see any problem with it.
أَنَّ رَجُلًا بَاعَ مِنْ رَجُلٍ سَرْجًا وَلَمْ يَنْقُدْ ثَمَنَهُ فَأَرَادَ صَاحِبُ السَّرْجِ الَّذِي اشْتَرَاهُ أَنْ يَبِيعَهُ فَأَرَادَ الَّذِي بَاعَهُ أَنْ يَأْخُذَهُ بِدُونِ مَا بَاعَهُ مِنْهُ فَسَأَلَ عَنْ ذَلِكَ ابْنَ عُمَرَ فَلَمْ يَرَ بِهِ بَأْسًا وَقَالَ ابْنُ عُمَرَ فَلَعَلَّهُ لَوْ بَاعَهُ مِنْ غَيْرِهِ بَاعَهُ بِذَلِكَ الثَّمَنِ أَوْ أَنْقَصَ 10802 وَعَنْ سُفْيَانَ ثنا هِشَامٌ عَنِ ابْنِ سِيرِينَ أَنَّ رَجُلًا بَاعَ بَعِيرًا مِنْ رَجُلٍ فَقَالَ اقْبَلْ مِنِّي بَعِيرَكَ وَثَلَاثِينَ دِرْهَمًا فَسَأَلُوا شُرَيْحًا فَلَمْ يَرَ بِذَلِكَ بَأْسًا
