13. Commerce
١٣۔ كِتَابُ الْبُيُوعِ
[Machine] From the Prophet ﷺ , he said, "If people were to be given what they claimed, some people would claim the lives and wealth of others. However, the burden of proof is upon the claimant."
عَنِ النَّبِيِّ ﷺ قَالَ لَوْ يُعْطَى النَّاسُ بِدَعْوَاهُمْ لَادَّعَى نَاسٌ دِمَاءَ قَوْمٍ وَأَمْوَالَهُمْ وَلَكِنَّ الْيَمِينَ عَلَى الْمُدَّعَى عَلَيْهِ
Muhammad ibn al-Ash'ath said: Al-Ash'ath bought slaves of booty from Abdullah ibn Mas'ud for twenty thousand (dirhams. Abdullah asked him for payment of their price. He said: I bought them for ten thousand (dirhams). Abdullah said: Appoint a man who may adjudicate between me and you. Al-Ash'ath said: (I appoint) you between me and yourself. Abdullah said: I heard the Messenger of Allah ﷺ say: If both parties in a business transaction differ (on the price of an article), and they have witness between them, the statement of the owner of the article will be accepted (as correct) or they may annul the transaction. اشْتَرَى الْأَشْعَثُ رَقِيقًا مِنْ رَقِيقِ الْخُمُسِ مِنْ عَبْدِ اللهِ بِعِشْرِينَ أَلْفًا فَأَرْسَلَ عَبْدُ اللهِ إِلَيْهِ فِي ثَمَنِهِمْ فَقَالَ إِنَّمَا أَخَذْتُهُمْ بِعَشَرَةِ آلَافٍ فَقَالَ عَبْدُ اللهِ فَاخْتَرْ رَجُلًا يَكُونُ بَيْنِي وَبَيْنَكَ فَقَالَ الْأَشْعَثُ أَنْتَ بَيْنِي وَبَيْنَ نَفْسِكَ قَالَ عَبْدُ اللهِ إِنِّي سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ إِذَا اخْتَلَفَ الْبَيِّعَانِ وَلَيْسَ بَيْنَهُمَا بَيِّنَةٌ فَهُوَ مَا يَقُولُ رَبُّ السِّلْعَةِ أَوْ يَتَتَارَكَانِ
That the Messenger of Allah ﷺ said: "When the two parties (in a deal) disagree then the seller's statement is taken as valid, and the purchaser retains the option." (Using translation from Tirmidhī 1270)
قَالَ رَسُولُ اللهِ ﷺ إِذَا اخْتَلَفَ الْبَيِّعَانِ فَالْقَوْلُ مَا قَالَ الْبَائِعُ وَالْمُبْتَاعُ بِالْخِيَارِ
[Machine] I heard from the Messenger of Allah ﷺ that he said, "When the buyer and the seller differ, the saying is what the buyer and seller said with good intentions. Awn bin Abdullah did not understand Abdullah bin Mas'ud, and he was a witness to what had preceded, and indeed, [the disagreement] occurred."
سَمِعْتُ مِنْ رَسُولِ اللهِ ﷺ سَمِعْتُهُ يَقُولُ إِذَا اخْتَلَفَ الْبَائِعُ وَالْمُبْتَاعُ فَالْقَوْلُ مَا قَالَ الْبَائِعُ وَالْمُبْتَاعُ بِالْخِيَارِ عَوْنُ بْنُ عَبْدِ اللهِ لَمْ يُدْرِكْ عَبْدَ اللهِ بْنَ مَسْعُودٍ وَهُوَ شَاهِدٌ لِمَا تَقَدَّمَ وَقَدْ
[Machine] I accompanied the Messenger of Allah ﷺ and we came across a situation like this. The seller was instructed to take an oath, and then the buyer was given the choice to either take it or leave it. If he wished, he could take it, and if he wished, he could leave it. This narration is from Abdullah bin Ahmad who said that Ahmadd ibn Hanbal informed me about Hisham bin Yusuf, who narrated from Ibn Juraij, who narrated from Isma'il bin Umayyah, who narrated from Abd al-Malik bin Ubaid, who said that Hajjaj al-Awar narrated from Abd al-Malik bin Ubaidah 10808. Abu Abdullah al-Hafiz informed us, who was narrated by Abu Bakr bin Ishaq al-Faqih, who was narrated by Abdullah bin Ahmad bin Hanbal, who narrated it from my father and mentioned the narration.
حَضَرْتُ رَسُولَ اللهِ ﷺ أُتِيَ فِي مِثْلِ هَذَا فَأَمَرَ الْبَائِعَ أَنْ يُسْتَحْلَفَ ثُمَّ لِيُخَيَّرَ الْمُبْتَاعُ فَإِنْ شَاءَ أَخَذَ وَإِنْ شَاءَ تَرَكَ زَادَ فِيهِ غَيْرُهُ عَنْ عَبْدِ اللهِ بْنِ أَحْمَدَ قَالَ عَبْدُ اللهِ قَالَ أَحْمَدُ أُخْبِرْتُ عَنْ هِشَامِ بْنِ يُوسُفَ عَنِ ابْنِ جُرَيْجٍ عَنْ إِسْمَاعِيلَ بْنِ أُمَيَّةَ عَنْ عَبْدِ الْمَلِكِ بْنِ عُبَيْدٍ قَالَ أَحْمَدُ وَقَالَ حَجَّاجٌ الْأَعْوَرُ عَبْدُ الْمَلِكِ بْنُ عُبَيْدَةَ 10808 أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو بَكْرِ بْنُ إِسْحَاقَ الْفَقِيهُ ثنا عَبْدُ اللهِ بْنُ أَحْمَدَ بْنِ حَنْبَلٍ حَدَّثَنِي أَبِي فَذَكَرَهُ
[Machine] About the Prophet ﷺ , when the two parties in a transaction disagree and there is no witness between them, the seller is asked to swear an oath, and then the buyer has the choice to either go ahead with the purchase or leave it. Ali ibn Ahmad ibn Abdan narrated to us, from Ahmad ibn Ubayd, from Ahmad ibn Ali, from Ya'qub ibn Humaid, from Yahya ibn Sulaim, that Ibn Abdan mentioned it to us. Abu Hassan ibn Abdan narrated to us, from Ahmad ibn Ubayd, from Abbas ibn Al-Fadl, from Al-Hakam ibn Musa, from Sa'id ibn Muslim, that he mentioned it, except that he said, "the two parties in the transaction have no clear evidence." Others narrated it from Sa'id ibn Muslim: Ismail ibn Umayyah, from Abdul-Malik ibn Ubaidah. Abu Bakr ibn Al-Harith Al-Asfahani narrated to us, from Ali ibn Umar, from Abu Bakr Al-Naysaburi, from Muhammad ibn Ghaleb Al-Antaki, from Sa'id ibn Muslim, that he mentioned it. And this hadith is also transmitted by Abu Ubaidah as a mursal hadith, as his father did not reach it.
عَنِ النَّبِيِّ ﷺ إِذَا اخْتَلَفَ الْمُتَبَايِعَانِ وَلَيْسَ بَيْنَهُمَا شَاهِدٌ اسْتُحْلِفَ الْبَائِعُ ثُمَّ كَانَ الْمُبْتَاعُ بِالْخِيَارِ إِنْ شَاءَ أَخَذَ وَإِنْ شَاءَ تَرَكَ أَخْبَرَنَاهُ عَلِيُّ بْنُ أَحْمَدَ بْنِ عَبْدَانَ أنا أَحْمَدُ بْنُ عُبَيْدٍ ثنا أَحْمَدُ بْنُ عَلِيٍّ ثنا يَعْقُوبُ بْنُ حُمَيْدٍ ثنا يَحْيَى بْنُ سُلَيْمٍ فَذَكَرَهُ 10810 وَرَوَاهُ سَعِيدُ بْنُ مَسْلَمَةَ عَنْ إِسْمَاعِيلَ بْنِ أُمَيَّةَ عَنْ عَبْدِ الْمَلِكِ عَنِ ابْنِ عَبْدِ اللهِ بْنِ مَسْعُودٍ عَنْ أَبِيهِ بِنَحْوِهِ أَخْبَرَنَاهُ أَبُو الْحَسَنِ بْنُ عَبْدَانَ أنا أَحْمَدُ بْنُ عُبَيْدٍ ثنا عَبَّاسُ بْنُ الْفَضْلِ ثنا الْحَكَمُ بْنُ مُوسَى ثنا سَعِيدُ بْنُ مَسْلَمَةَ فَذَكَرَهُ إِلَّا أَنَّهُ قَالَ الْبَيِّعَانِ وَلَيْسَ بَيْنَهُمَا بَيِّنَةٌ وَرَوَاهُ غَيْرُهُ عَنْ سَعِيدٍ ثنا إِسْمَاعِيلُ بْنُ أُمَيَّةَ عَنْ عَبْدِ الْمَلِكِ بْنِ عُبَيْدَةَ 10811 أَخْبَرَنَا أَبُو بَكْرِ بْنُ الْحَارِثِ الْأَصْفَهَانِيُّ أنا عَلِيُّ بْنُ عُمَرَ أنا أَبُو بَكْرٍ النَّيْسَابُورِيُّ ثنا مُحَمَّدُ بْنُ غَالِبٍ الْأَنْطَاكِيُّ ثنا سَعِيدُ بْنُ مَسْلَمَةَ فَذَكَرَهُ وَهَذَا الْحَدِيثُ أَيْضًا مُرْسَلٌ أَبُو عُبَيْدَةَ لَمْ يُدْرِكْ أَبَاهُ
[Machine] As for me, I will decide between you and me based on a verdict that I heard from the Messenger of Allah ﷺ . He said, "If the two parties involved in a transaction disagree and there is no clear evidence between them, it is what the lord of the merchandise says or they may part ways." Al-Ash'ath then said, "Indeed, I am leaving this sale, so he left it and that is how it happened."
أَمَا إِنِّي سَأَقْضِي بَيْنِي وَبَيْنَكَ بِقَضَاءٍ سَمِعْتُهُ مِنْ رَسُولِ اللهِ ﷺ يَقُولُ إِذَا اخْتَلَفَ الْبَيِّعَانِ وَلَيْسَ بَيْنَهُمَا بَيِّنَةٌ فَهُوَ مَا يَقُولُ رَبُّ السِّلْعَةِ أَوْ يَتَتَارَكَانِ فَقَالَ الْأَشْعَثُ فَإنَّى أُتَارِكُكَ الْبَيْعَ فَتَارَكَهُ وَكَذَلِكَ
[Machine] "Abdullah, if you wish, I can tell you a hadith that I heard from the Messenger of Allah ﷺ . He said: 'Bring it forth.' He said: 'I heard the Messenger of Allah ﷺ saying: When the two parties to a sale differ, and the sale is ongoing but there is no clear evidence between them, then the statement of the seller should be what is considered, or they should mutually cancel the sale.' Al-Ash'ath said, 'I think the sale should be returned according to the narration of Ibn Abi Shaybah, as Ibn Abi Layla narrated it in a different way, where he said from his father, and in its text where he added to it that the sale is ongoing in its entirety.' Isma'il ibn 'Ayyash narrated it from Musa ibn 'Uqbah, from Muhammad ibn 'Abdul Rahman ibn Abi Layla, and he said in it, 'and the commodity is as it is in its entirety.' And when Isma'il narrated from the people of Hijaz, he cannot be relied upon. And Muhammad ibn 'Abdul Rahman ibn Abi Layla, even though he is great in his knowledge of fiqh, he is weak in narration due to his poor memory and frequent errors in both chains of narration and texts. May Allah forgive us and him. In this narration, it is also followed by Al-Qasim, Al-Hasan ibn 'Umrah, but he is abandoned and cannot be relied upon."
عَبْدُ اللهِ إِنْ شِئْتَ حَدَّثْتُكَ بِحَدِيثٍ سَمِعْتُهُ مِنْ رَسُولِ اللهِ ﷺ قَالَ هَاتِ قَالَ سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ إِذَا اخْتَلَفَ الْبَيِّعَانِ وَالْبَيْعُ قَائِمٌ بِعَيْنِهِ وَلَيْسَ بَيْنَهُمَا بَيِّنَةٌ فَالْقَوْلُ مَا قَالَ الْبَائِعُ أَوْ يَتَرَادَّانِ الْبَيْعَ قَالَ الْأَشْعَثُ أَرَى أَنْ يُرَدَّ الْبَيْعُ لَفْظُ حَدِيثِ ابْنِ أَبِي شَيْبَةَ خَالَفَ ابْنُ أَبِي لَيْلَى الْجَمَاعَةَ فِي رِوَايَةِ هَذَا الْحَدِيثِ فِي إِسْنَادِهِ حَيْثُ قَالَ عَنْ أَبِيهِ وَفِي مَتْنِهِ حَيْثُ زَادَ فِيهِ وَالْبَيْعُ قَائِمٌ بِعَيْنِهِ وَرَوَاهُ إِسْمَاعِيلُ بْنُ عَيَّاشٍ عَنْ مُوسَى بْنِ عُقْبَةَ عَنْ مُحَمَّدِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ أَبِي لَيْلَى وَقَالَ فِيهِ وَالسِّلْعَةُ كَمَا هِيَ بِعَيْنِهَا وَإِسْمَاعِيلُ إِذَا رَوَى عَنْ أَهْلِ الْحِجَازِ لَمْ يُحْتَجَّ بِهِ وَمُحَمَّدُ بْنُ عَبْدِ الرَّحْمَنِ بْنِ أَبِي لَيْلَى وَإِنْ كَانَ فِي الْفِقْهِ كَبِيرًا فَهُوَ ضَعِيفٌ فِي الرِّوَايَةِ؛ لِسُوءِ حِفْظِهِ؛ وَكَثْرَةِ أَخْطَائِهِ فِي الْأَسَانِيدِ وَالْمُتُونِ وَمُخَالَفَتِهِ الْحُفَّاظَ فِيهَا وَاللهُ يَغْفِرُ لَنَا وَلَهُ وَقَدْ تَابَعَهُ فِي هَذِهِ الرِّوَايَةِ عَنِ الْقَاسِمِ الْحَسَنُ بْنُ عُمَارَةَ وَهُوَ مَتْرُوكٌ لَا يُحْتَجُّ بِهِ
[Machine] About the jurists who follow the saying of the people of Madinah, they used to say: when two men enter into a transaction and they disagree about the price, their disagreement should be settled by a judge. If they both take an oath, then the statement of the seller is accepted and the buyer is given the choice to either accept that price or to leave it. It has been narrated from Shurayh that he said: "If they both take an oath and swear by the right hand, then the transaction is intended."
عَنِ الْفُقَهَاءِ الَّذِينَ يُنْتَهَى إِلَى قَوْلِهِمْ مِنْ أَهْلِ الْمَدِينَةِ كَانُوا يَقُولُونَ إِذَا تَبَايَعَ الرَّجُلَانِ بِالْبَيْعِ وَاخْتَلَفَا فِي الثَّمَنِ اخْتَلَفَا جَمِيعًا فَأَيُّهُمَا نَكَلَ لَزِمَهُ الْقَضَاءُ فَإِنْ حَلَفَا جَمِيعًا كَانَ الْقَوْلُ مَا قَالَ الْبَائِعُ وَخُيِّرَ الْمُبْتَاعُ إِنْ شَاءَ أَخَذَ بِذَلِكَ الثَّمَنِ وَإِنْ شَاءَ تَرَكَ وَرُوِّينَا عَنْ شُرَيْحٍ أَنَّهُ قَالَ فَإِنْ نَكَلَا عَنِ الْيَمِينِ تَرَادَّا الْبَيْعَ
