[Machine] From the Prophet ﷺ , he said, "If people were to be given what they claimed, some people would claim the lives and wealth of others. However, the burden of proof is upon the claimant."  

البيهقي:١٠٨٠٣ – أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ وَأَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو قَالَا ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا يَحْيَى بْنُ أَبِي طَالِبٍ أنا عَبْدُ الْوَهَّابِ بْنُ عَطَاءٍ أنا ابْنُ جُرَيْجٍ عَنْ عَبْدِ اللهِ بْنِ أَبِي مُلَيْكَةَ عَنِ ابْنِ عَبَّاسٍ

عَنِ النَّبِيِّ ﷺ قَالَ لَوْ يُعْطَى النَّاسُ بِدَعْوَاهُمْ لَادَّعَى نَاسٌ دِمَاءَ قَوْمٍ وَأَمْوَالَهُمْ وَلَكِنَّ الْيَمِينَ عَلَى الْمُدَّعَى عَلَيْهِ  

أَخْرَجَهُ مُسْلِمٌ فِي الصَّحِيحِ مِنْ حَدِيثِ ابْنِ جُرَيْجٍ وَأَخْرَجَهُ الْبُخَارِيُّ مِنْ وَجْهٍ آخَرَ عَنِ ابْنِ أَبِي مُلَيْكَةَ قَالَ الشَّافِعِيُّ فَإِذَا تَبَايَعَ رَجُلَانِ عَبْدًا فَقَالَ الْبَائِعُ بِعْتُكَهُ بِأَلْفٍ وَقَالَ الْمُبْتَاعُ بِخَمْسِمِائَةٍ فَكُلُّ وَاحِدٍ مِنْهُمَا مُدَّعٍ وَمُدَّعًى عَلَيْهِ الْبَائِعُ يَدَّعِي فَضْلَ الثَّمَنِ وَالْمُشْتَرِي يَدَّعِي السِّلْعَةَ بِأَقَلَّ مِنَ الثَّمَنِ فَيَتَحَالَفَانِ وَيُبْدَأُ بِيَمِينِ الْبَائِعِ
