13. Commerce
١٣۔ كِتَابُ الْبُيُوعِ
[Machine] The Prophet ﷺ said, "The responsibility of the seller lasts for three nights." 'Abdul-Wahhab said, Sa'id asked Qatadah, "How does this work?" He said, "If the buyer finds a defect in the merchandise, he can return it within those three days without being asked for proof. But if the three days pass, he can only return it with proof that he bought it and that the defect was in it. Otherwise, the seller can testify that he did not sell it in that condition."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ عُهْدَةُ الرَّقِيقِ ثَلَاثُ لَيَالٍ قَالَ عَبْدُ الْوَهَّابِ قَالَ سَعِيدٌ فَقُلْتُ لِقَتَادَةَ كَيْفَ يَكُونُ هَذَا؟ قَالَ إِذَا وَجَدَ الْمُشْتَرِي عَيْبًا بِالسِّلْعَةِ فَإِنَّهُ يَرُدُّهَا فِي تِلْكَ الثَّلَاثَةِ أَيَّامٍ وَلَا يُسْأَلُ الْبَيِّنَةَ وَإِذَا مَضَتِ الثَّلَاثَةُ أَيَّامٍ فَلَيْسَ لَهُ أَنْ يَرُدَّهَا إِلَّا بِبَيِّنَةٍ أَنَّهُ اشْتَرَاهَا وَذَلِكَ الْعَيْبُ بِهَا وَإِلَّا فَيَمِينُ الْبَائِعِ أَنَّهُ لَمْ يَبِعْهُ كَذَا وَكَذَلِكَ
[Machine] On the authority of the Prophet ﷺ , he said: "The nanny's commitment is for four nights." Abdullah al-Wahhab said: Hisham said: Qatadah and the people of Madinah say it is three nights, and that is also the case.
عَنِ النَّبِيِّ ﷺ قَالَ عُهْدَةُ الرَّقِيقِ أَرْبَعُ لَيَالٍ قَالَ عَبْدُ الْوَهَّابِ قَالَ هِشَامٌ قَالَ قَتَادَةُ وَأَهْلُ الْمَدِينَةِ يَقُولُونَ ثَلَاثًا وَكَذَلِكَ
[Machine] Narrated by Abu Bakr ibn Furak, Abdullah ibn Ja'far informed us, Yunus ibn Habib narrated to us, Abu Dawud mentioned it and Yunus ibn Ubaid narrated it from Al-Hasan.
عَنِ النَّبِيِّ ﷺ قَالَ عُهْدَةُ الرَّقِيقِ أَرْبَعَةُ أَيَّامٍ حَدَّثَنَاهُ أَبُو بَكْرِ بْنُ فُورَكٍ أنا عَبْدُ اللهِ بْنُ جَعْفَرٍ ثنا يُونُسُ بْنُ حَبِيبٍ ثنا أَبُو دَاوُدَ فَذَكَرَهُ وَرَوَاهُ يُونُسُ بْنُ عُبَيْدٍ عَنِ الْحَسَنِ
[Machine] The Messenger of Allah ﷺ said: "There is no agreement above four months. This Hadith is narrated by Al-Hasan from 'Uqbah ibn 'Amir, and he is reliable. 'Ali ibn 'Abdullah Al-Madani said that Al-Hasan did not hear anything from 'Uqbah ibn 'Amir. Abu 'Abdullah Al-Hafiz informed us about this. I am Al-Hasan ibn Muhammad ibn Ishaq, and I am Muhammad ibn Ahmad ibn Al-Bara'. I heard 'Ali ibn 'Abdullah Al-Madani mention it, and a group of the Ahl al-Naql (scholars of Hadith transmission) also said the same. Al-Shafi'i said it is narrated that the Messenger of Allah ﷺ made Habban ibn Munqidh responsible for three specific things. It is also narrated from Sa'id ibn Salim, from Ibn Juraij, from 'Ata' that he said: "There was no agreement in the past about a period of time for something, neither for hypnotism, leprosy, nor anything else." I asked him: "What about three days?" He said: "There is no problem if he buys it legitimately. I can only see that Allah can decree in His matter whatever He wants, unless He brings forth evidence of something that existed before it was bought. This is how the matter is seen now."
قَالَ رَسُولُ اللهِ ﷺ لَا عُهْدَةَ فَوْقَ أَرْبَعٍ مَدَارُ هَذَا الْحَدِيثِ عَلَى الْحَسَنِ عَنْ عُقْبَةَ بْنِ عَامِرٍ وَهُوَ مُرْسَلٌ قَالَ عَلِيُّ بْنُ عَبْدِ اللهِ الْمَدِينِيُّ لَمْ يَسْمَعِ الْحَسَنُ مِنْ عُقْبَةَ بْنِ عَامِرٍ شَيْئًا 10756 أَخْبَرَنَا بِذَلِكَ أَبُو عَبْدِ اللهِ الْحَافِظُ أنا الْحَسَنُ بْنُ مُحَمَّدِ بْنِ إِسْحَاقَ أنا مُحَمَّدُ بْنُ أَحْمَدَ بْنِ الْبَرَاءِ قَالَ سَمِعْتُ عَلِيَّ بْنَ عَبْدِ اللهِ الْمَدِينِيَّ فَذَكَرَهُ وَكَذَلِكَ قَالَهُ جَمَاعَةٌ مِنْ أَئِمَّةِ أَهْلِ النَّقْلِ قَالَ الشَّافِعِيُّ وَالْخَبَرُ فِي أَنَّ رَسُولَ اللهِ ﷺ جَعَلَ لِحَبَّانَ بْنِ مُنْقِذٍ عُهْدَةَ ثَلَاثٍ خَاصٌّ وَرُوِيَ عَنْ سَعِيدِ بْنِ سَالِمٍ عَنِ ابْنِ جُرَيْجٍ عَنْ عَطَاءٍ أَنَّهُ قَالَ لَمْ يَكُنْ فِيمَا مَضَى عُهْدَةٌ فِي الْأَرْضِ لَا مِنْ هِيَامٍ وَلَا مِنْ جُذَامٍ وَلَا شَيْءٍ قُلْتُ لَهُ مَا ثَلَاثَةُ أَيَّامٍ؟ قَالَ لَا شَيْءَ إِذَا ابْتَاعَهُ صَحِيحًا لَا أَرَى إِلَّا ذَلِكَ اللهُ يُحْدِثُ مِنْ أَمْرِهِ مَا يَشَاءُ إِلَّا أَنْ يَأْتِيَ بِبَيِّنَةٍ عَلَى شَيْءٍ كَانَ قَبْلَ أَنْ يَبْتَاعَهُ وَكَذَلِكَ يُرَى الْأَمْرُ الْآنَ
