١٣۔ كِتَابُ الْبُيُوعِ
[Machine] Will I not read to you a book that the Messenger of Allah ﷺ wrote for me? So he brought out a book and behold, in it was what Al-A`da' bin Khalid bin Hawzah purchased from Muhammad, the Messenger of Allah. He bought from him a male or female slave who was suffering from neither illness nor blemish, and there was no deceit in the transaction between the two Muslim parties. The sheikh said, "This Hadith is known by the name of Abbad bin Al-Laith, and we have transcribed it from another reliable source."
أَلَا أُقْرِئُكَ كِتَابًا كَتَبَهُ لِي رَسُولُ اللهِ ﷺ؟ فَأَخْرَجَ كِتَابًا فَإِذَا فِيهِ هَذَا مَا اشْتَرَى الْعَدَّاءُ بْنُ خَالِدِ بْنِ هَوْذَةَ مِنْ مُحَمَّدٍ رَسُولِ اللهِ اشْتَرَى مِنْهُ عَبْدًا أَوْ أُمَّةً عَبَّادٌ يَشُكُّ لَا دَاءَ لَهُ وَلَا غَائِلَةَ وَلَا خِبْثَةَ بَيْعَ الْمُسْلِمِ الْمُسْلِمَ قَالَ الشَّيْخُ هَذَا الْحَدِيثُ يُعْرَفُ بِعَبَّادِ بْنِ اللَّيْثِ وَقَدْ كَتَبْنَاهُ مِنْ وَجْهٍ آخَرَ غَيْرِ مُعْتَمَدٍ
"Adda' bin Khalid bin Hawdhah said to me: 'Shall I not read to you a letter that the Messenger of Allah ﷺ, wrote to me?' I said: 'Yes.' So he took out a letter. In it was: 'This is what 'Adda' bin Khalid bin Hawdhah bought [from] Muhammad the Messenger of Allah ﷺ He bought from him a slave' or 'a female slave, having no ailments, nor being a runaway, not having any malicious behavior. Sold by a Muslim to a Muslim.'" (Using translation from Ibn Mājah 2251)
قَالَ الْعَدَّاءُ بْنُ خَالِدِ بْنِ هَوْذَةَ أَلَا أُقْرِئُكُمْ كِتَابًا كَتَبَهُ لِي رَسُولُ اللهِ ﷺ؟ فَقُلْنَا بَلَى فَإِذَا فِيهِ مَكْتُوبٌ بِسْمِ اللهِ الرَّحْمَنِ الرَّحِيمِ هَذَا مَا اشْتَرَى الْعَدَّاءُ بْنُ خَالِدِ بْنِ هَوْذَةَ مِنْ مُحَمَّدٍ رَسُولِ اللهِ ﷺ اشْتَرَى مِنْهُ عَبْدًا أَوْ أَمَةً شَكَّ عُثْمَانُ بِيَاعَةً أَوْ بَيْعَ الْمُسْلِمِ الْمُسْلِمَ لَا دَاءَ وَلَا غَائِلَةَ وَلَا خِبْثَةَ
عَنْ أَشْعَثَ بْنِ سَوَّارٍ
[Machine] Shariq responded differently than what was in his book, and we did not find any basis for this statement. The sheikh said, "The most authentic narration regarding this matter is."
أَجَابَ شَرِيكٌ عَلَى غَيْرِ مَا كَانَ فِي كِتَابِهِ وَلَمْ نَجِدْ لِهَذَا الْحَدِيثِ أَصْلًا قَالَ الشَّيْخُ أَصَحُّ مَا رُوِيَ فِي هَذَا الْبَابِ
[Machine] That the boy swore to him, "Indeed, I have sold him," and he has a hidden illness that only he knows. So Abdullah refused to swear to him, and the slave returned. Abdullah bin Umar then sold him for one thousand and five hundred dirhams. Malik said that the agreed-upon matter among us is that whoever sells a slave, a child, or an animal with a declaration of innocence, then he is declared innocent of all defects, except if he knew of a defect and concealed it. If he knew of a defect and concealed it, his declaration of innocence is of no benefit to him, and what he sold is returned to him. We have also narrated from Ash-Shafi'i that he said regarding a man who sells a slave or any animal with a declaration of innocence from defects, "What we rely upon, and Allah knows best, is the verdict of Uthman ibn Affan, that he is innocent of every defect that he did not know, and he is not declared innocent of a defect that he knew, and the seller did not describe him."
أَنْ يَحْلِفَ لَهُ لَقَدْ بَاعَهُ الْغُلَامُ وَمَا بِهِ دَاءٌ يَعْلَمُهُ فَأَبَى عَبْدُ اللهِ أَنْ يَحْلِفَ لَهُ وَارْتَجَعَ الْعَبْدَ فَبَاعَهُ عَبْدُ اللهِ بْنُ عُمَرَ بَعْدَ ذَلِكَ بِأَلْفٍ وَخَمْسِمِائَةِ دِرْهَمٍ قَالَ مَالِكٌ الْأَمْرُ الْمُجْتَمَعُ عَلَيْهِ عِنْدَنَا فِيمَنْ بَاعَ عَبْدًا أَوْ وَلِيدَةً أَوْ حَيَوَانًا بِالْبَرَاءَةِ فَقَدْ بَرِئَ مِنْ كُلِّ عَيْبٍ إِلَّا أَنْ يَكُونَ عَلِمَ فِي ذَلِكَ عَيْبًا فَكَتَمَهُ فَإِنْ كَانَ عَلِمَ عَيْبًا فَكَتَمَهُ لَمْ تَنْفَعْهُ تَبْرِئَتُهُ وَكَانَ مَا بَاعَ مَرْدُودًا عَلَيْهِ وَرُوِّينَا عَنِ الشَّافِعِيِّ أَنَّهُ قَالَ فِي الرَّجُلِ يَبِيعُ الْعَبْدَ أَوْ مَا شَاءَ مِنَ الْحَيَوَانِ بِالْبَرَاءَةِ مِنَ الْعُيُوبِ فَالَّذِي نَذْهَبُ عَلَيْهِ وَاللهُ أَعْلَمُ قَضَاءُ عُثْمَانَ بْنِ عَفَّانَ ؓ أَنَّهُ بَرِيءٌ مِنْ كُلِّ عَيْبٍ لَمْ يَعْلَمْهُ وَلَمْ يَبْرَأْ مِنْ عَيْبٍ عَلِمَهُ وَلَمْ يُسَمِّهِ الْبَائِعُ
[Machine] That a person had a condition that could not be cured until it was shown to him. Yahya said: I was cured of such and such, but if a disease entered between my thighs, I would not be cured until it was shown to me. And it was narrated from Ibrahim al-Nakha'i about a man who sells goods and is cured of a disease, he said: He is cured of what he was called by. And from Shurayh the judge, he does not get cured until he puts his hand on the disease. And from Ata ibn Abi Rabah, the same.
أَنَّ شُرَيْحًا كَانَ لَا يُبَرِّئُ مِنَ الدَّاءِ حَتَّى يُرِيَهُ إِيَّاهُ قَالَ يَحْيَى يَقُولُ بَرِئْتُ مِنْ كَذَا وَكَذَا وَإِنْ دَخَلَ دَاءٌ بَيْنَ ظَهْرَانَيْ ذَلِكَ لَمْ يَبْرَأْ حَتَّى يُرِيَهُ ذَلِكَ الْعَيْبَ وَرُوِّينَا عَنْ إِبْرَاهِيمَ النَّخَعِيِّ فِي الرَّجُلِ يَبِيعُ السِّلْعَةَ وَيَبْرَأُ مِنَ الدَّاءِ قَالَ هُوَ بَرِيءٌ مِمَّا سَمَّى وَعَنْ شُرَيْحٍ الْقَاضِي لَا يَبْرَأُ حَتَّى يَضَعَ يَدَهُ عَلَى الدَّاءِ وَعَنْ عَطَاءِ بْنِ أَبِي رَبَاحٍ مِثْلَهُ
