١٣۔ كِتَابُ الْبُيُوعِ ص ٢
[Machine] I sent a message to Amir al-Mu'minin Uthman, stating that there is some of his wealth in the valley with some money that belongs to him in Khaybar. When we made the transaction, I walked back on my heels until I left his house, fearing that the transaction would be revoked. It was the Sunnah that the buyers should be given the choice until they separated. Abdullah said, "When the transaction was complete and he sold his share, I realized that I had deceived him. So, I sent him to the land of Thamud for three nights, and he brought me back to the city for three nights." Abu Amr al-Adibi informed us, Abu Bakr al-Isma'ili said, Abu Imran narrated to me, Ar-Ramadi said, Abu Bakr was informed by Al-Hasan who was informed by Ya'qub bin Sufyan who said, and I am Abu Al-Qasim who was informed by Ibn Zanjawayh who said, they said, Abu Salih narrated to me, Al-Laith narrated to me, Shaykh narrated it, and Abu Salih also narrated it, and Yahya bin Bukair narrated it from Al-Laith, who narrated it from Yunus bin Yazid, who narrated it from Ibn Shihab with a similar meaning.
بِعْتُ مِنْ أَمِيرِ الْمُؤْمِنِينَ عُثْمَانَ ؓ مَالًا بِالْوَادِي بِمَالٍ لَهُ بِخَيْبَرَ فَلَمَّا تَبَايَعْنَا رَجَعْتُ عَلَى عَقِبِي حَتَّى خَرَجْتُ مِنْ بَيْتِهِ خَشْيَةَ أَنْ يَرُدَّنِي الْبَيْعَ وَكَانَتِ السُّنَّةُ أَنَّ الْمُتَبَايِعَيْنِ بِالْخِيَارِ حَتَّى يَتَفَرَّقَا قَالَ عَبْدُ اللهِ فَلَمَّا وَجَبَ بَيْعِي وَبَيْعُهُ رَأَيْتُ أَنِّي قَدْ غَبَنْتُهُ فَإِنِّي سُقْتُهُ إِلَى أَرْضِ ثَمُودَ بِثَلَاثِ لَيَالٍ وَسَاقَنِي إِلَى الْمَدِينَةِ بِثَلَاثِ لَيَالٍ 10450 أَخْبَرَنَا أَبُو عَمْرٍو الْأَدِيبُ أنا أَبُو بَكْرٍ الْإِسْمَاعِيلِيُّ قَالَ حَدَّثَنِيهِ أَبُو عِمْرَانَ ثنا الرَّمَادِيُّ قَالَ أَبُو بَكْرٍ وَأَخْبَرَنِي الْحَسَنُ ثنا يَعْقُوبُ بْنُ سُفْيَانَ قَالَ وَأنا أَبُو الْقَاسِمِ ثنا ابْنُ زَنْجُوَيْهِ قَالُوا ثنا أَبُو صَالِحٍ حَدَّثَنِي اللَّيْثُ بِهَذَا قَالَ الشَّيْخُ وَرَوَاهُ أَبُو صَالِحٍ أَيْضًا وَيَحْيَى بْنُ بُكَيْرٍ عَنِ اللَّيْثِ عَنْ يُونُسَ بْنِ يَزِيدَ عَنِ ابْنِ شِهَابٍ بِمَعْنَاهُ
[Machine] Jareer said, "I pledged allegiance to the Messenger of Allah ﷺ on hearing and obeying and advising every Muslim." He said, "So whenever Jareer pledged allegiance to someone for anything, he would say, 'Indeed, we have taken from you what is more beloved to us than what we have given you, so choose what you want with it, as it is the completion of his pledge.' And Ibn Abdan informed us, narrating from Ahmad, from Uthman ibn Umar al-Dabbi, from Mussaddad, from Yazid ibn Zurai', from Yunus, who mentioned it in a similar manner except that he did not say, 'as it is the completion of his pledge.'"
قَالَ جَرِيرٌ بَايَعْتُ رَسُولَ اللهِ ﷺ عَلَى السَّمْعِ وَالطَّاعَةِ وَالنُّصْحِ لِكُلِّ مُسْلِمٍ قَالَ فَكَانَ جَرِيرٌ إِذَا بَايَعَ إِنْسَانًا شَيْئًا قَالَ أَمَا إِنَّمَا أَخَذْنَا مِنْكَ أَحَبُّ إِلَيْنَا مِمَّا أَعْطَيْنَاكَ فَاخْتَرْ يُرِيدُ بِذَلِكَ إِتْمَامَ بَيْعَتِهِ 10452 وَأَخْبَرَنَا ابْنُ عَبْدَانَ أنا أَحْمَدُ ثنا عُثْمَانُ بْنُ عُمَرَ الضَّبِّيُّ ثنا مُسَدَّدٌ ثنا يَزِيدُ بْنُ زُرَيْعٍ ثنا يُونُسُ فَذَكَرَهُ بِنَحْوِهِ إِلَّا أَنَّهُ لَمْ يَقُلْ يُرِيدُ بِذَلِكَ إِتْمَامَ بَيْعَتِهِ
[Machine] About the Prophet, ﷺ , regarding two types of sale involving options, as long as they have not separated. They reported it to Abu Hanifa, and he said, "This is nothing. What do you think if they were in a ship?" Ali said, "Indeed, Allah will ask him about what he said."
عَنِ النَّبِيِّ ﷺ فِي الْبَيِّعَيْنِ بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا قَالَ فَحَدَّثُوا بِهِ أَبَا حَنِيفَةَ فَقَالَ أَبُو حَنِيفَةَ هَذَا لَيْسَ بِشَيْءٍ أَرَأَيْتَ إِنْ كَانَا فِي سَفِينَةٍ؟ قَالَ عَلِيٌّ إِنَّ اللهَ سَائِلُهُ عَمَّا قَالَ
13.8 [Machine] In the interpretation of the sale of options: the narration of Al-Laith ibn Saad, from Nafi indicating that the sale of options is the right of choice after the contract, before the separation, and also the narration of Ayyub al-Sikhtyani, from Nafi, and we have mentioned them in the chapter before this.
١٣۔٨ بَابٌ فِي تَفْسِيرِ بَيْعِ الْخِيَارِ حَدِيثُ اللَّيْثِ بْنِ سَعْدٍ , عَنْ نَافِعٍ يَدُلُّ عَلَى أَنَّ بَيْعَ الْخِيَارِ هُوَ التَّخْيِيرُ بَعْدَ الْعَقْدِ , وَقَبْلَ التَّفَرُّقِ , وَكَذَلِكَ رِوَايَةُ أَيُّوبَ السِّخْتِيَانِيِّ , عَنْ نَافِعٍ وَقَدْ ذَكَرْنَاهُمَا فِي الْبَابِ قَبْلَ هَذَا
[Machine] The Messenger of Allah ﷺ said: "When two men engage in a transaction, they both have the option to cancel it as long as they have not separated, or if the selling party has not set conditions. It has been narrated by Matarif bin Tarif from Al-Shabi from Umar, and by Ataa bin Abi Rabah from Umar, that the transaction is either a sale or an option, and both of them are considered weak due to the discontinuity of the chain of narration. If their authenticity is confirmed, the intended meaning is that Allah knows best, the sale has a condition in which the option is extinguished after the transaction, and a sale in which the option is not specified, they both have the option as long as they have not separated. Many scholars weaken the narration from Umar and argue that setting a condition of the option's extinguishment in a sale is not permissible. And the intended meaning of selling the option is either the option to choose after the sale or a sale in which a three-day option is specified, and their option is not terminated by separation due to the place of the condition. And the correct view is that he intended with it, and Allah knows best, the option to choose after the sale, except that sometimes it is expressed as selling the option, and sometimes it is explained, and the one who explains that is the one who clarifies it."
قَالَ رَسُولُ اللهِ ﷺ إِذَا تَبَايَعَ الرَّجُلَانِ فَهُمَا بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا أَوْ يَكُونُ بَيْعُهُمَا عَنْ خِيَارٍ وَكَانَ عُمَرُ أَوِ ابْنُ عُمَرَ يُنَادِي الْبَيْعُ صَفْقَةٌ أَوْ خِيَارٌ وَرُوِيَ عَنْ مُطَرِّفِ بن طَرِيفٍ تَارَةً عَنِ الشَّعْبِيِّ عَنْ عُمَرَ وتَارَةً عَنْ عَطَاءِ بْنِ أَبِي رَبَاحٍ عَنْ عُمَرَ ؓ الْبَيْعُ صَفْقَةٌ أَوْ خِيَارٌ وَكِلَاهُمَا مَعَ الْأَوَّلِ ضَعِيفٌ؛ لِانْقِطَاعِ ذَلِكَ فَإِنْ صَحَّ فَالْمُرَادُ بِهِ وَاللهُ أَعْلَمُ بَيْعُ شَرْطٍ فِيهِ قَطْعُ الْخِيَارِ فَلَا يَكُونُ لَهُمَا بَعْدَ الصَّفْقَةِ خِيَارٌ وَبَيْعٌ لَمْ يُشْتَرَطْ فِيهِ قَطْعُ الْخِيَارِ فَهُمَا بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا وَقَدْ ذَهَبَ كَثِيرٌ مِنْ أَهْلِ الْعِلْمِ إِلَى تَضْعِيفِ الْأَثَرِ عَنْ عُمَرَ وَأنَّ الْبَيْعَ لَا يَجُوزُ فِيهِ شَرْطُ قَطْعِ الْخِيَارِ وَأنَّ الْمُرَادَ بِبَيْعِ الْخِيَارِ إِمَّا التَّخْيِيرُ بَعْدَ الْبَيْعِ أَوْ بَيْعُ شَرْطٍ فِيهِ خِيَارُ ثَلَاثَةِ أَيَّامٍ فَلَا يَنْقَطِعُ خِيَارُهُمَا بِالتَّفَرُّقِ؛ لِمَكَانِ الشَّرْطِ وَالصَّحِيحُ أَنَّهُ أَرَادَ بِهِ وَاللهُ أَعْلَمُ التَّخْيِيرَ بَعْدَ الْبَيْعِ إِلَّا أَنَّ نَافِعًا رُبَّمَا عَبَّرَ عَنْهُ بِبَيْعِ الْخِيَارِ وَرُبَّمَا فَسَّرَهُ وَالَّذِي يُبَيِّنُ ذَلِكَ
[Machine] The Messenger of Allah ﷺ said, "The two parties involved in a transaction have the option to cancel it until they separate, or the transaction is of a good choice." He said, "And perhaps one of them says to the other, 'Choose.'"
قَالَ رَسُولُ اللهِ ﷺ الْبَيِّعَانِ بِالْخِيَارِ حَتَّى يَتَفَرَّقَا أَوْ يَكُونَ بَيْعَ خِيَارٍ قَالَ وَرُبَّمَا قَالَ نَافِعٌ أَوْ يَقُولُ أَحَدُهُمَا لِلْآخَرِ اخْتَرْ
13.9 [Machine] The evidence that it is not permissible to stipulate a period of more than three days for a sale.
١٣۔٩ بَابُ الدَّلِيلِ عَلَى أَنْ لَا يَجُوزَ شَرْطُ الْخِيَارِ فِي الْبَيْعِ أَكْثَرَ مِنْ ثَلَاثَةِ أَيَّامٍ
[Machine] The Messenger of Allah ﷺ said, "Whoever buys a whip, it is valid for three days, and if he returns it, he should return it with a measure of dates."
قَالَ رَسُولُ اللهِ ﷺ مَنِ ابْتَاعَ مُصَرَّاةً فَهُوَ بِالْخِيَارِ ثَلَاثَةَ أَيَّامٍ فَإِنْ رَدَّهَا رَدَّهَا وَمَعَهَا صَاعٌ مِنْ تَمْرٍ
[Machine] He heard Ibn Umar say that a man mentioned to the Messenger of Allah ﷺ that he was being deceived in his trade transactions, so the Messenger of Allah ﷺ said to him, "If you have entered into a transaction, then say 'no deception.’"
أَنَّهُ سَمِعَ ابْنَ عُمَرَ يَقُولُ ذَكَرَ رَجُلٌ لِرَسُولِ اللهِ ﷺ أَنَّهُ يُخْدَعُ فِي الْبُيُوعِ فَقَالَ لَهُ رَسُولُ اللهِ ﷺ مَنْ بَايَعْتَ فَقُلْ لَا خِلَابَةَ
[Machine] Hubban ibn Munqidh was a weak man who had a baldness in his head. The Messenger of Allah ﷺ allowed him to choose what he bought. He had a heavy tongue, so the Messenger of Allah ﷺ told him to sell and not to deceive. I used to hear him saying "No deception, no deception" while buying something and when he brought it to his family, they would say it's expensive. He would say that the Messenger of Allah ﷺ allowed me to choose in my buying.
كَانَ حَبَّانُ بْنُ مُنْقِذٍ رَجُلًا ضَعِيفًا وَكَانَ قَدْ سُفِعَ فِي رَأْسِهِ مَأْمُومَةً فَجَعَلَ رَسُولُ اللهِ ﷺ لَهُ الْخِيَارَ فِيمَا اشْتَرَى ثَلَاثًا وَكَانَ قَدْ ثَقُلَ لِسَانُهُ فَقَالَ لَهُ رَسُولُ اللهِ ﷺ بِعْ وَقُلْ لَا خِلَابَةَ فَكُنْتُ أَسْمَعُهُ يَقُولُ لَا خِذَابَةَ لَا خِذَابَةَ وَكَانَ يَشْتَرِي الشَّيْءَ فَيَجِيءُ بِهِ أَهْلَهُ فَيَقُولُونَ هَذَا غَالٍ فَيَقُولُ إنَّ رَسُولَ اللهِ ﷺ خَيَّرَنِي فِي بَيْعِي
[Machine] I heard a man from the Ansar, and there was foulness in his tongue. He would complain to the Messenger of Allah ﷺ that he was constantly being deceived in his trade. So the Messenger of Allah ﷺ said to him, "When you engage in a transaction, say 'No deception.' And after that, you are at liberty to choose in every transaction that you enter into for three nights. If you are pleased with it, then keep it. But if you are displeased, then return it." Ibn 'Umar said, "It is as if I can still hear him saying when he would purchase something, 'No deception,' and his tongue would become foul." Ibn Ishaq said, "I narrated this hadith from Muhammad ibn Yahya ibn Habban. He said, 'My grandfather Munqidh ibn 'Amr was a man who had been struck in the head and his tongue was broken and his mind was affected. He used to be deceived in his trades and he would never leave doing business. So he complained about that to the Prophet ﷺ, who said, 'When you engage in a transaction, say 'No deception.' And after that, in every transaction you enter into, choose for three nights. If you are pleased with it, then keep it. But if you are displeased, then return it.' So he remained in this state until the time of 'Uthman came while he was 130 years old. The people multiplied during the time of 'Uthman. So whenever he would buy something and return with it, they would say to him, 'Why do you buy, you?' So he would say, 'The Messenger of Allah ﷺ has made me do it in what I choose for three.' They would say, 'Return it, for you have been deceived or cheated.' So he would go back to his transaction and say, 'Take your goods and return my dirhams.' He would say, 'I will not do that, for I am pleased with it and have taken it.' Until one man from the Companions of the Messenger of Allah ﷺ would pass by him and say, 'The Messenger of Allah ﷺ has made him choose for three in his purchases.' He would return his dirhams to him and take his goods." Abu Bakr narrated to us from Abu Ash-Shaykh from Ishaq ibn Jamil from Muhammad ibn 'Amr ibn Al-'Abbas from 'Abdul 'Ala from Muhammad ibn Ishaq, something similar to this.
سَمِعْتُ رَجُلًا مِنَ الْأَنْصَارِ وَكَانَتْ بِلِسَانِهِ لُوثَةٌ يَشْكُو إِلَى رَسُولِ اللهِ ﷺ أَنَّهُ لَا يَزَالُ يُغْبَنُ فِي الْبَيْعِ فَقَالَ لَهُ رَسُولُ اللهِ ﷺ إِذَا بَايَعْتَ فَقُلْ لَا خِلَابَةَ ثُمَّ أَنْتَ بِالْخِيَارِ فِي كُلِّ سِلْعَةٍ ابْتَعْتَهَا ثَلَاثَ لَيَالٍ فَإِنْ رَضِيتَ فَأَمْسِكْ وَإِنْ سَخِطْتَ فَارْدُدْ قَالَ ابْنُ عُمَرَ فَلَكَأَنِّي الْآنَ أَسْمَعُهُ إِذَا ابْتَاعَ يَقُولُ لَا خِلَابَةَ يَلُوثُ لِسَانُهُ قَالَ ابْنُ إِسْحَاقَ فَحَدَّثْتُ بِهَذَا الْحَدِيثِ مُحَمَّدَ بْنَ يَحْيَى بْنِ حَبَّانَ قَالَ كَانَ جَدِّي مُنْقِذُ بْنُ عَمْرٍو وَكَانَ رَجُلًا قَدْ أُصِيبَ فِي رَأْسِهِ آمَّةً فَكَسَرَتْ لِسَانَهُ وَنَقَضَتْ عَقْلَهُ وَكَانَ يُغْبَنُ فِي الْبُيُوعِ وَكَانَ لَا يَدَعُ التِّجَارَةَ فَشَكَا ذَلِكَ إِلَى النَّبِيِّ ﷺ فَقَالَ إِذَا أَنْتَ بِعْتَ فَقُلْ لَا خِلَابَةَ ثُمَّ أَنْتَ فِي كُلِّ بَيْعٍ تَبْتَاعُهُ بِالْخِيَارِ ثَلَاثَ لَيَالٍ إِنْ رَضِيتَ فَأَمْسِكْ وَإِنْ سَخِطْتَ فَرُدَّ فَبَقِيَ حَتَّى أَدْرَكَ زَمَانَ عُثْمَانَ ؓ وَهُوَ ابْنُ مِائَةٍ وَثَلَاثِينَ سَنَةً وَكَثُرَ النَّاسُ فِي زَمَانِ عُثْمَانَ فَكَانَ إِذَا اشْتَرَى شَيْئًا فَرَجَعَ بِهِ فَقَالُوا لَهُ لِمَ تَشْتَرِي أَنْتَ؟ فَيَقُولُ قَدْ جَعَلَنِي رَسُولُ اللهِ ﷺ فِيمَا ابْتَعْتُ بِالْخِيَارِ ثَلَاثًا فَيَقُولُونَ ارْدُدْهُ فَإِنَّكَ قَدْ غُبِنْتَ أَوْ قَالَ غُشِشْتَ فَيَرْجِعُ إِلَى بَيِّعِهِ فَيَقُولُ خُذْ سِلْعَتَكَ وَرُدَّ دَرَاهِمِي فَيَقُولُ لَا أَفْعَلُ قَدْ رَضِيتُ فَذَهَبْتَ بِهِ حَتَّى يَمُرَّ بِهِ الرَّجُلُ مِنْ أَصْحَابِ رَسُولِ اللهِ ﷺ فَيَقُولُ إِنَّ رَسُولَ اللهِ ﷺ قَدْ جَعَلَهُ بِالْخِيَارِ فِيمَا يَبْتَاعُ ثَلَاثًا فَيَرُدُّ عَلَيْهِ دَرَاهِمَهُ وَيَأْخُذُ سِلْعَتَهُ 10460 وَأَخْبَرَنَا أَبُو بَكْرٍ أنا أَبُو الشَّيْخِ أنا إِسْحَاقُ بْنُ جَمِيلٍ ثنا مُحَمَّدُ بْنُ عَمْرِو بْنِ الْعَبَّاسِ ثنا عَبْدُ الْأَعْلَى ثنا مُحَمَّدُ بْنُ إِسْحَاقَ نَحْوَهُ
[Machine] The Messenger of Allah ﷺ said, "The best days are three." The scholar said, "And this is a summary of the narration of Ibn Ishaq."
قَالَ رَسُولُ اللهِ ﷺ الْخِيَارُ ثَلَاثَةُ أَيَّامٍ قَالَ الشَّيْخُ وَهَذَا مُخْتَصَرٌ مِنْ حَدِيثِ ابْنِ إِسْحَاقَ
[Machine] "I cannot find anything wider for you than what the Messenger of Allah ﷺ has assigned to Habban ibn Munqidh. He was blind, so the Messenger of Allah ﷺ appointed him a duration of three days. If he was pleased, he would take it, and if he was displeased, he would leave it." Ubaid ibn Abi Qurra narrated this from Ibn Lahi'ah, from Habban ibn Wasil, from his father, from his grandfather, from Umar, in a shortened form, and he did not mention "blind." This hadith is unique to Ibn Lahi'ah, and Allah knows best."
مَا أَجِدُ لَكُمْ شَيْئًا أَوْسَعَ مِمَّا جَعَلَ رَسُولُ اللهِ ﷺ لِحَبَّانَ بْنِ مُنْقِذٍ إِنَّهُ كَانَ ضَرِيرَ الْبَصَرِ فَجَعَلَ لَهُ رَسُولُ اللهِ ﷺ عُهْدَةَ ثَلَاثَةِ أَيَّامٍ إِنْ رَضِيَ أَخَذَ وَإِنْ سَخِطَ تَرَكَ وَرَوَاهُ عُبَيْدُ بْنُ أَبِي قُرَّةَ عَنِ ابْنِ لَهِيعَةَ عَنْ حَبَّانَ بْنِ وَاسِعٍ عَنْ أَبِيهِ عَنْ جَدِّهِ عَنْ عُمَرَ مُخْتَصَرًا وَلَمْ يَقُلْ ضَرِيرَ الْبَصَرِ وَالْحَدِيثُ يَنْفَرِدُ بِهِ ابْنُ لَهِيعَةَ وَاللهُ أَعْلَمُ
13.10 [Machine] Taken by way of a pledge and by a sale in which the option is stipulated.
١٣۔١٠ بَابُ الْمَأْخُوذِ عَلَى طَرِيقِ السَّوْمِ وَعَلَى بَيْعٍ شُرِطَ فِيهِ الْخِيَارُ
[Machine] A relief for a lifetime that you have taken correctly and safely, and you are responsible for returning it correctly and safely. So Umar ibn al-Khattab was amazed and sent him as a judge and he mentioned the saying.
شُرَيْحٌ لِعُمَرَ أَخَذْتَهُ صَحِيحًا سَلِيمًا وَأَنْتَ لَهُ ضَامِنٌ حَتَّى تَرُدَّهُ صَحِيحًا سَلِيمًا فَأَعْجَبَ عُمَرَ بْنَ الْخَطَّابِ فَبَعَثَهُ قَاضِيًا وَذَكَرَ الْحَدِيثَ

١٣۔١٢ بَابُ تَحْرِيمِ الرِّبَا, وَأَنَّهُ مَوْضُوعٌ مَرْدُودٌ إِلَى رَأْسِ الْمَالِ قَالَ اللهُ جَلَّ ثَنَاؤُهُ: {يَا أَيُّهَا الَّذِينَ آمَنُوا اتَّقُوا اللهَ وَذَرُوا مَا بَقِيَ مِنَ الرِّبَا إِنْ كُنْتُمْ مُؤْمِنِينَ فَإِنْ لَمْ تَفْعَلُوا فَأْذَنُوا بِحَرْبٍ مِنَ اللهِ وَرَسُولِهِ وَإِنْ تُبْتُمْ فَلَكُمْ رُءُوسُ أَمْوَالِكُمْ لَا تَظْلِمُونَ وَلَا تُظْلَمُونَ}
[Machine] Narrated Jabir ibn Abdullah about the pilgrimage of the Prophet ﷺ and his sermon at Arafah, he said, "The Messenger of Allah ﷺ said: 'Indeed, your blood and your wealth are forbidden to you, as the sanctity of this day of yours, in this month of yours, in this land of yours. Behold! Every practice of the days of ignorance is under my feet. And the blood of ignorance is abolished, and the first blood shed by me to be abolished was the blood of Rabiah bin Al-Harith, who was fostered in Bani Sa'd and killed by Hudhayl in the period of ignorance. The usury of ignorance is abolished, and the first usury I abolish is the usury of Abbas bin Abdul-Muttalib. Surely, it is all abolished.' He mentioned the hadith."
عَنْ جَابِرِ بْنِ عَبْدِ اللهِ فِي حَجِّ النَّبِيِّ ﷺ وَخُطْبَتِهِ بِعَرَفَةَ قَالَ فَقَالَ يَعْنِي رَسُولَ اللهِ ﷺ إِنَّ دِمَاءَكُمْ وَأَمْوَالَكُمْ حَرَامٌ عَلَيْكُمْ كَحُرْمَةِ يَوْمِكُمْ هَذَا فِي شَهْرِكُمْ هَذَا فِي بَلَدِكُمْ هَذَا أَلَا وَإنَّ كُلَّ شَيْءٍ مِنْ أَمْرِ الْجَاهِلِيَّةِ مَوْضُوعٌ تَحْتَ قَدَمِيَّ هَاتَيْنِ وَدِمَاءُ الْجَاهِلِيَّةِ مَوْضُوعَةٌ وَأَوَّلُ دَمٍ أَضَعُهُ دَمُ رَبِيعَةَ بْنِ الْحَارِثِ كَانَ مُسْتَرْضَعًا فِي بَنِي سَعْدٍ فَقَتَلَتْهُ هُذَيْلٌ فِي زَمَنِ الْجَاهِلِيَّةِ وَرِبَا الْجَاهِلِيَّةِ مَوْضُوعٌ وَأَوَّلُ رِبًا أَضَعُهُ رِبَا الْعَبَّاسِ بْنِ عَبْدِ الْمُطَّلِبِ وَإِنَّهُ مَوْضُوعٌ كُلُّهُ وَذَكَرَ الْحَدِيثَ
On the authority of his father: I heard the Messenger of Allah ﷺ say in the Farewell Pilgrimage: "Lo, all claims to usury of the pre-Islamic period have been abolished. You shall have your capital sums, deal not unjustly and you shall not be dealt with unjustly. Lo, all claims for blood-vengeance belonging to the pre-Islamic period have been abolished. The first of those murdered among us whose blood-vengeance I remit is al-Harith ibn AbdulMuttalib, who suckled among Banu Layth and killed by Hudhayl." He then said: O Allah, have I conveyed the message? They said: Yes, saying it three times. He then said: O Allah, be witness, saying it three times. (Using translation from Abū Dāʾūd 3334)
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ فِي حَجَّةِ الْوَدَاعِ أَلَا إِنَّ كُلَّ رِبًا مِنْ رِبَا الْجَاهِلِيَّةِ مَوْضُوعٌ لَكُمْ رُءُوسُ أَمْوَالِكُمْ لَا تَظْلِمُونَ وَلَا تُظْلَمُونَ أَلَا وَإِنَّ كُلَّ دَمٍ مِنْ دَمِ الْجَاهِلِيَّةِ مَوْضُوعٌ وَأَوَّلُ دَمٍ أَضَعُ مِنْهَا دَمُ الْحَارِثِ بْنِ عَبْدِ الْمُطَّلِبِ كَانَ مُسْتَرْضَعًا فِي بَنِي لَيْثٍ فَقَتَلَتْهُ هُذَيْلٌ اللهُمَّ قَدْ بَلَّغْتُ؟ قَالُوا نَعَمْ ثَلَاثًا قَالَ اللهُمَّ اشْهَدْ ثَلَاثَ مَرَّاتٍ
[Machine] Narrated Mujahid: Regarding His saying: 'And if you do not do so, then take a notice of war from Allah and His Messenger' (2:279), he said: "It used to be that a man would have a debt owed to him by another man, and he would say: 'Give me an increase of such and such amount, and delay payment for me.'" [Tafsir Ibn Kathir, Al-Baqarah 278]
عَنْ مُجَاهِدٍ فِي قَوْلِهِ {وَذَرُوا مَا بَقِيَ مِنَ الرِّبَا إِنْ كُنْتُمْ مُؤْمِنِينَ} [البقرة 278] قَالَ كَانَ يَكُونُ لِرَجُلٍ عَلَى رَجُلٍ دَيْنٌ فَيَقُولُ لَكَ زِيَادَةُ كَذَا وَكَذَا وَتُؤَخِّرُ عَنِّي
[Machine] For one person to have a right over another person for a certain period of time. When the right period ends, they will say, "Do you settle or extend?" If they settle it, they take it, but if not, it increases their right and the other person's period.
أَنْ يَكُونَ لِلرَّجُلِ عَلَى الرَّجُلِ الْحَقُّ إِلَى أَجَلٍ فَإِذَا حَلَّ الْحَقُّ قَالَ أَتَقْضِي أَمْ تُرْبِي؟ فَإِنْ قَضَاهُ أَخَذَ وَإِلَّا زَادَهُ فِي حَقِّهِ وَزَادَهُ الْآخَرُ فِي الْأَجَلِ
13.13 [Machine] What has been mentioned regarding the prohibition of usury
١٣۔١٣ بَابُ مَا جَاءَ مِنَ التَّشْدِيدِ فِي تَحْرِيمِ الرِّبَا
[Machine] "The Messenger of Allah ﷺ cursed the one who consumes riba (usury), the one who gives it, the one who records it, and the two witnesses. He said: They are all equal in sin according to the narration of Abu Salih."
لَعَنَ رَسُولُ اللهِ ﷺ آكِلَ الرِّبَا وَمُؤْكِلَهُ وَكَاتِبَهُ وَشَاهِدَيْهِ قَالَ هُمْ سَوَاءٌ لَفْظُ حَدِيثِ أَبِي صَالِحٍ
The Messenger of Allah ﷺ cursed the one who accepted usury, the one who paid it, the witness to it, and the one who recorded it. (Using translation from Abū Dāʾūd 3333)
أَنَّ النَّبِيَّ ﷺ لَعَنَ آكِلَ الرِّبَا وَمُؤْكِلَهُ وَشَاهِدَيْهِ أَوْ قَالَ شَاهِدَهُ وَكَاتِبَهُ
[Machine] The Prophet ﷺ used to come to us after he had prayed, and he would say, "Did anyone of you see a dream last night?" The Hadith said, "The Prophet ﷺ said, ‘I saw two men who came to me and took me out to a spacious land or a spacious area. Then we proceeded until we came to a river of blood, wherein there were men standing with their naked breasts and a man standing at its bank with stones in front of him. He would lower his head, and whenever he had the desire to come out, he would throw a stone at him until he drove him back to where he was. So, whenever he wanted to come out, the man threw a stone at him and thus he threw him back.’ I asked them both, ‘What is this?’ They replied, ‘The one whom you saw in the river with his chest exposed and whom you saw throwing stones at him is the one who consumes usury.’"
كَانَ رَسُولُ اللهِ ﷺ إِذَا صَلَّى أَقْبَلَ عَلَيْنَا بِوَجْهِهِ فَقَالَ هَلْ رَأَى أَحَدٌ مِنْكُمُ اللَّيْلَةَ رُؤْيَا؟ الْحَدِيثَ قَالَ رَسُولُ اللهِ ﷺ رَأَيْتُ اللَّيْلَةَ رَجُلَيْنِ أَتَيَانِي فَأَخَذَا بِيَدِي فَأَخْرَجَانِي إِلَى أَرْضٍ مُسْتَوِيَةٍ أَوْ فَضَاءٍ الْحَدِيثَ وَقَالَ فِيهِ فَانْطَلَقْنَا حَتَّى انْتَهَيْنَا إِلَى نَهْرٍ مِنْ دَمٍ فِيهِ رِجَالٌ قِيَامٌ وَرَجُلٌ قَائِمٌ عَلَى شَطِّ النَّهْرِ بَيْنَ يَدَيْهِ حِجَارَةٌ فَيُقْبِلُ الَّذِي فِي النَّهْرِ فَإِذَا أَرَادَ أَنْ يَخْرُجَ مِنْهُ رَمَاهُ الرَّجُلُ بِحَجَرٍ فِي فِيهِ فَرَدَّهُ حَيْثُ كَانَ فَجَعَلَ كُلَّمَا جَاءَ؛ لِيَخْرُجَ رَمَاهُ فِي فِيهِ بِحَجَرٍ فَرَدَّهُ حَيْثُ كَانَ فَقُلْتُ لَهُمَا مَا هَذَا؟ فَقَالَ الَّذِي رَأَيْتَهُ فِي النَّهْرِ آكِلُ الرِّبَا
[Machine] The last verse and revelation that Allah ﷻ sent down to the Messenger of Allah ﷺ was the verse regarding riba (usury). The intermediary said it was revealed.
آخِرُ آيَةٍ أَنْزَلَهَا اللهُ ﷻ عَلَى رَسُولِ اللهِ ﷺ آيَةُ الرِّبَا وَقَالَ الْوَاسِطِيُّ أُنْزِلَتْ
[Machine] "The Messenger of Allah ﷺ said that there will come a time upon people when they consume riba (usury), and either some people eat it or all people do. So, whoever does not consume it will still be affected by its dust."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ يَأْتِي عَلَى النَّاسِ زَمَانٌ يَأْكُلُونَ فِيهِ الرِّبَا فَيَأْكُلُ نَاسٌ أَوِ النَّاسُ كُلُّهُمْ فَمَنْ لَمْ يَأْكُلْ مِنْهُمْ نَالَهُ مِنْ غُبَارِهِ
“There will come a time when there will be no one left who does not consume usury (interest), and whoever does not consume it will nevertheless be affected by it."' (Using translation from Ibn Mājah 2278)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَيَأْتِيَنَّ عَلَى النَّاسِ زَمَانٌ لَا يَبْقَى أَحَدٌ إِلَّا أَكَلَ الرِّبَا فَإِنْ لَمْ يَأْكُلْهُ أَصَابَهُ مِنْ بُخَارِهِ
13.14 [Machine] The types that were mentioned in the text regarding the occurrence of riba in them.
١٣۔١٤ بَابُ الْأَجْنَاسِ الَّتِي وَرَدَ النَّصُّ بِجَرَيَانِ الرِّبَا فِيهَا
[Machine] He heard, so Umar said: "By Allah, she should not leave him until she takes from him." Then he said: "The Messenger of Allah ﷺ said: Gold for gold is usury, except for this and this, and silver for silver is usury, except for this and this, and barley for barley is usury, except for this and this, and dates for dates is usury, except for this and this, and wheat for wheat is usury, except for this and this." Their wording in the hadith is the same, except in the hadith of Imam Ash-Shafi'i, where it says: "until my treasurer comes or until my servant girl comes from the forest." Ash-Shafi'i said: "I recited it to Malik, it is authentic, I have no doubt about it. Then time prolonged on me and I did not memorize it perfectly, so I doubted in my servant girl or my treasurer, and others say about it, my treasurer."
يَسْمَعُ فَقَالَ عُمَرُ ؓ وَاللهِ لَا تُفَارِقُهُ حَتَّى تَأْخُذَ مِنْهُ ثُمَّ قَالَ قَالَ رَسُولُ اللهِ ﷺ الذَّهَبُ بِالذَّهَبِ رِبًا إِلَّا هَا وَهَا وَالْوَرِقُ بِالْوَرِقِ رِبًا إِلَّا هَا وَهَا وَالْبُرُّ بِالْبُرِّ رِبًا إِلَّا هَا وَهَا وَالتَّمْرُ بِالتَّمْرِ رِبًا إِلَّا هَا وَهَا وَالشَّعِيرُ بِالشَّعِيرِ رِبًا إِلَّا هَا وَهَا لَفْظُ حَدِيثِهِمْ سَوَاءٌ إِلَّا أَنَّ فِي حَدِيثِ الشَّافِعِيِّ حَتَّى يَأْتِيَ خَازِنِي أَوْ حَتَّى تَأْتِيَ جَارِيَتِي مِنَ الْغَابَةِ قَالَ الشَّافِعِيُّ قَرَأْتُهُ عَلَى مَالِكٍ صَحِيحًا لَا أَشُكُّ فِيهِ ثُمَّ طَالَ عَلَيَّ الزَّمَانُ وَلَمْ أَحْفَظْ حِفْظًا فَشَكَكْتُ فِي جَارِيَتِي أَوْ خَازِنِي وَغَيْرِي يَقُولُ عَنْهُ خَازِنِي
[Machine] The Messenger of Allah ﷺ said, "Do not sell gold for gold unless it is like for like, and do not increase one over the other. Do not sell silver for silver unless it is like for like, and do not increase one over the other. Do not sell a deficiency in quantity for an equivalent amount, and in the narration of Abu Nasr, do not sell a deficiency in amount for an equivalent amount."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا تَبِيعُوا الذَّهَبَ بِالذَّهَبِ إِلَّا مِثْلًا بِمِثْلٍ وَلَا تُشِفُّوا بَعْضَهَا عَلَى بَعْضٍ وَلَا تَبِيعُوا الْوَرِقَ بِالْوَرِقِ إِلَّا مِثْلًا بِمِثْلٍ وَلَا تُشِفُّوا بَعْضَهَا عَلَى بَعْضٍ وَلَا تَبِيعُوا غَائِبًا مِنْهَا بِنَاجِزٍ وَفِي رِوَايَةِ أَبِي نَصْرٍ وَلَا تَبِيعُوا مِنْهَا غَائِبًا بِنَاجِزٍ
[Machine] The Messenger of Allah ﷺ said, "Do not sell gold for gold, silver for silver, wheat for wheat, barley for barley, dates for dates, salt for salt, except if they are equivalent in amount, hand to hand. But you may sell gold for silver, silver for gold, wheat for barley, barley for wheat, dates for salt, and salt for dates, hand to hand, however you wish. If one of them is increased or decreased, then he has involved in usury. It is said that this hadith is narrated by Abdullah ibn Ubayd." 10477 Abu Al-Hasan Ali ibn Muhammad Al-Muqri informed us. I am Al-Hasan ibn Muhammad ibn Ishaq. Yusuf ibn Ya'qub narrated to me. Muhammad ibn Abi Bakr narrated to me. Yazid ibn Zurai narrated to us. Salamah ibn Alqamah narrated to us. Muhammad ibn Sireen narrated that Muslim ibn Yasir and Abdullah ibn Ubayd told him that the meeting between Ubada and Mu'awiyah took place either during a sale or in a church. He mentioned the hadith in detail, and Muslim ibn Yasir had not heard this hadith from Ubada ibn As-Samit. He had only heard it from Abi Al-Ash'ath As-Sanaani, who had heard it from Ubada.
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا تَبِيعُوا الذَّهَبَ بِالذَّهَبِ وَلَا الْوَرِقَ بِالْوَرِقِ وَلَا الْبُرَّ بِالْبُرِّ وَلَا الشَّعِيرَ بِالشَّعِيرِ وَلَا التَّمْرَ بِالتَّمْرِ وَلَا الْمِلْحَ بِالْمِلْحِ إِلَّا سَوَاءً بِسَوَاءٍ عَيْنًا بِعَيْنٍ يَدًا بِيَدٍ وَلَكِنْ بِيعُوا الذَّهَبَ بِالْوَرِقِ وَالْوَرِقَ بِالذَّهَبِ وَالْبُرَّ بِالشَّعِيرِ وَالشَّعِيرَ بِالْبُرِّ وَالتَّمْرَ بِالْمِلْحِ وَالْمِلْحَ بِالتَّمْرِ يَدًا بِيَدٍ كَيْفَ شِئْتُمْ وَنَقَصَ أَحَدُهُمَا الْمِلْحَ أَوِ التَّمْرَ وَزَادَ أَحَدُهُمَا مَنْ زَادَ أَوِ ازْدَادَ فَقَدْ أَرْبَى الرَّجُلُ الْآخَرُ يُقَالُ هُوَ عَبْدُ اللهِ بْنُ عُبَيْدٍ 10477 أَخْبَرَنَا أَبُو الْحَسَنِ عَلِيُّ بْنُ مُحَمَّدٍ الْمُقْرِئُ أنا الْحَسَنُ بْنُ مُحَمَّدِ بْنِ إِسْحَاقَ ثنا يُوسُفُ بْنُ يَعْقُوبَ ثنا مُحَمَّدُ بْنُ أَبِي بَكْرٍ ثنا يَزِيدُ بْنُ زُرَيْعٍ ثنا سَلَمَةُ بْنُ عَلْقَمَةَ ثنا مُحَمَّدُ بْنُ سِيرِينَ أَنَّ مُسْلِمَ بْنَ يَسَارٍ وَعَبْدَ اللهِ بْنَ عُبَيْدٍ حَدَّثَاهُ قَالَا جَمَعَ الْمَنْزِلُ بَيْنَ عُبَادَةَ وَمُعَاوِيَةَ إِمَّا فِي بَيْعَةٍ أَوْ كَنِيسَةٍ قَالَ وَذَكَرَ الْحَدِيثَ فِي الصَّرْفِ بِطُولِهِ وَهَذَا الْحَدِيثُ لَمْ يَسْمَعْهُ مُسْلِمُ بْنُ يَسَارٍ مِنْ عُبَادَةَ بْنِ الصَّامِتِ إِنَّمَا سَمِعَهُ مِنْ أَبِي الْأَشْعَثِ الصَّنْعَانِيِّ عَنْ عُبَادَةَ
[Machine] O people, you have introduced transactions, I don't know what they are. And indeed, gold with gold should be hand to hand in equal amounts, and silver with silver should be hand to hand in equal amounts. Women should not be exchanged for women, and barley should be exchanged for barley, measure for measure, hand to hand. It is permissible to exchange barley for wheat and the majority of them can be hand to hand. Women should not be exchanged for bad ones. Dates with dates should be exchanged until the salt is counted with salt, like for like, hand to hand. Whoever adds or increases, then he has committed riba. Qatadah said, "Ubadah bin Samit, one of the leaders of the Ansar, gave allegiance to the Messenger of Allah ﷺ that he would not fear the blame of any blamer."
يَا أَيُّهَا النَّاسُ إِنَّكُمْ قَدْ أَحْدَثْتُمْ بُيُوعًا مَا أَدْرِي مَا هِيَ؟ وَإِنَّ الذَّهَبَ بِالذَّهَبِ تِبْرُهُ وَعَيْنُهُ وَزْنًا بِوَزْنٍ يَدًا بِيَدٍ وَالْفِضَّةُ بِالْفِضَّةِ وَزْنًا بِوَزْنٍ يَدًا بِيَدٍ وَلَا يَصْلُحُ نَسَاءً وَالْبُرُّ بِالْبُرِّ مُدًّا بِمُدٍّ يَدًا بِيَدٍ وَالشَّعِيرُ بِالشَّعِيرِ مُدًّا بِمُدٍّ يَدًا بِيَدٍ وَلَا بَأْسَ بِبَيْعِ الشَّعِيرِ بِالْبُرِّ وَالشَّعِيرُ أَكْثَرُهُمَا يَدًا بِيَدٍ وَلَا يَصْلُحُ نَسِيئَةً وَالتَّمْرُ بِالتَّمْرِ حَتَّى عَدَّ الْمِلْحَ بِالْمِلْحِ مِثْلًا بِمِثْلٍ يَدًا بِيَدٍ مَنْ زَادَ أَوِ ازْدَادَ فَقَدْ أَرْبَى قَالَ قَتَادَةُ وَكَانَ عُبَادَةُ بَدْرِيًّا عَقَبِيًّا أَحَدَ نُقَبَاءِ الْأَنْصَارِ وَكَانَ بَايَعَ رَسُولَ اللهِ ﷺ عَلَى أَنْ لَا يَخَافَ فِي اللهِ لَوْمَةَ لَائِمٍ كَذَا
[Machine] "Narrated by the Prophet ﷺ: Gold is to be paid for with gold, like for like. Silver is to be paid for with silver, like for like. Grain is to be paid for with grain, like for like. Dates are to be paid for with dates, like for like. Salt is to be paid for with salt, like for like. Whoever increases or asks for more has dealt in usury, but there is no harm in buying grain with gold hand to hand. The greater amount of the two commodities should be paid as it is the correct one. This hadith is authentic and is narrated by Abu Qilabah from Abu Al-Ash'ath from 'Ubadah."
عَنِ النَّبِيِّ ﷺ الذَّهَبُ بِالذَّهَبِ تِبْرُهُ وَعَيْنُهُ وَزْنًا بِوَزْنٍ وَالْفِضَّةُ بِالْفِضَّةِ تِبْرُهَا وَعَيْنُهَا وَزْنًا بِوَزْنٍ وَالْبُرُّ بِالْبُرِّ وَالشَّعِيرُ بِالشَّعِيرِ وَالتَّمْرُ بِالتَّمْرِ وَالْمِلْحُ بِالْمِلْحِ مَنْ زَادَ أَوِ ازْدَادَ فَقَدْ أَرْبَى وَلَا بَأْسَ بِبَيْعِ الشَّعِيرِ بِالْبُرِّ يَدًا بِيَدٍ وَالشَّعِيرُ أَكْثَرُهُمَا هَذَا هُوَ الصَّحِيحُ وَالْحَدِيثُ الثَّابِتُ صَحِيحٌ عَنْ أَبِي قِلَابَةَ عَنْ أَبِي الْأَشْعَثِ عَنْ عُبَادَةَ مَرْفُوعًا
I was in Syria (having) a circle (of friends). in which was Muslim b. Yasir. There came Abu'l-Ash'ath. He (the narrator) said that they (the friends) called him: Abu'l-Ash'ath, Abu'l-Ash'ath, and he sat down. I said to him: Narrate to our brother the hadith of Ubada b. Samit. He said: Yes. We went out on an expedition, Mu'awiya being the leader of the people, and we gained a lot of spoils of war. And there was one silver utensil in what we took as spoils. Mu'awiya ordered a person to sell it for payment to the people (soldiers). The people made haste in getting that. The news of (this state of affairs) reached 'Ubada b. Samit, and he stood up and said: I heard Messenger of Allah ﷺ forbidding the sale of gold by gold, and silver by silver, and wheat by wheat, and barley by barley, and dates by dates, and salt by salt, except like for like and equal for equal. So he who made an addition or who accepted an addition (committed the sin of taking) interest. So the people returned what they had got. This reached Mu'awiya. and he stood up to deliver an address. He said: What is the matter with people that they narrate from the Messenger ﷺ such tradition which we did not hear though we saw him (the Holy Prophet) and lived in his company? Thereupon, Ubida b. Samit stood up and repeated that narration, and then said: We will definitely narrate what we heard from Messenger of Allah ﷺ though it may be unpleasant to Mu'awiya (or he said: Even if it is against his will). I do not mind if I do not remain in his troop in the dark night. Hammad said this or something like this. (Using translation from Muslim 1587a)
نَعَمْ غَزَوْنَا غَزْوَةً وَعَلَى النَّاسِ مُعَاوِيَةُ فَغَنِمْنَا غَنَائِمَ كَثِيرَةً وَكَانَ فِيمَا غَنِمْنَا آنِيَةٌ مِنْ فِضَّةٍ فَأَمَرَ مُعَاوِيَةُ رَجُلًا أَنَّ بَيْعَهَا فِي أَعْطِيَاتِ النَّاسِ فَسَارَعَ النَّاسُ فِي ذَلِكَ فَبَلَغَ عُبَادَةَ بْنَ الصَّامِتِ ؓ فَقَامَ فَقَالَ إِنِّي سَمِعْتُ رَسُولَ اللهِ ﷺ يَنْهَى عَنْ بَيْعِ الذَّهَبِ بِالذَّهَبِ وَالْفِضَّةِ بِالْفِضَّةِ وَالْبُرِّ بِالْبُرِّ وَالشَّعِيرِ بِالشَّعِيرِ وَالتَّمْرِ بِالتَّمْرِ وَالْمِلْحِ بِالْمِلْحِ إِلَّا سَوَاءً بِسَوَاءٍ عَيْنًا بِعَيْنٍ فَمَنْ زَادَ أَوِ ازْدَادَ فَقَدْ أَرْبَى فَرَدَّ النَّاسُ مَا أَخَذُوا فَبَلَغَ ذَلِكَ مُعَاوِيَةَ فَقَامَ خَطِيبًا فَقَالَ أَلَا مَا بَالُ رِجَالٍ يَتَحَدَّثُونَ عَنْ رَسُولِ اللهِ ﷺ أَحَادِيثَ قَدْ كُنَّا نَشْهَدُهُ وَنَصْحَبُهُ وَلَمْ نَسْمَعْهَا مِنْهُ؟ فَقَامَ عُبَادَةُ ؓ فَأَعَادَ الْقِصَّةَ ثُمَّ قَالَ لَنُحَدِّثَنَّ بِمَا سَمِعْنَا من رَسُولَ اللهِ ﷺ وَإِنْ كَرِهَ مُعَاوِيَةُ أَوْ قَالَ وَإنْ رَغِمَ مُعَاوِيَةُ مَا أُبَالِي أَنْ لَا أَصْحَبَهُ فِي جُنْدِهِ لَيْلَةً سَوْدَاءَ قَالَ حَمَّادٌ هَذَا أَوْ نَحْوُهُ
[Machine] We were raiding and Ma'awiya was with us. We obtained gold and silver, so Ma'awiya ordered a man to sell it to the people at their own rates. The people rushed to buy, and 'Ubadah bin As-Samit got up and warned them against it (i.e. against the purchase of gold in exchange for silver). Then 'Ubadah got up again and said, "I testified that I heard Allah's Messenger ﷺ saying, 'The selling of gold for silver is Riba (usury), except if it be by like for like, and similarly, the selling of wheat for wheat is Riba (usury) unless it be by like for like. And the selling of barley for barley is usury unless it be by like for like.'"
كُنَّا فِي غَزَاةٍ عَلَيْنَا مُعَاوِيَةُ فَأَصَبْنَا ذَهَبًا وَفِضَّةً فَأَمَرَ مُعَاوِيَةُ رَجُلًا أَنْ يَبِيعَهَا فِي النَّاسِ فِي أُعْطِيَاتِهِمْ فَتَسَارَعَ النَّاسُ فِيهَا فَقَامَ عُبَادَةُ بْنُ الصَّامِتِ ؓ فَنَهَاهُمْ فَرَدُّوهَا فَأَتَى الرَّجُلُ مُعَاوِيَةَ فَشَكَا إِلَيْهِ فَقَامَ مُعَاوِيَةُ خَطِيبًا فَقَالَ مَا بَالُ رِجَالٍ يَتَحَدَّثُونَ عَنْ رَسُولِ اللهِ ﷺ أَحَادِيثَ يَكْذِبُونَ فِيهَا عَلَيْهِ لَمْ نَسْمَعْهَا مِنْهُ فَقَامَ عُبَادَةُ بْنُ الصَّامِتِ فَقَالَ وَاللهِ لَنُحَدِّثَنَّ عَنْ رَسُولِ اللهِ ﷺ وَإِنْ كَرِهَ مُعَاوِيَةُ قَالَ رَسُولُ اللهِ ﷺ لَا تَبِيعُوا الذَّهَبَ بِالذَّهَبِ وَلَا الْفِضَّةَ بِالْفِضَّةِ وَلَا الْبُرَّ بِالْبُرِّ وَلَا الشَّعِيرَ بِالشَّعِيرِ وَلَا الْمِلْحَ بِالْمِلْحِ وَلَا التَّمْرَ بِالتَّمْرِ إِلَّا مِثْلًا بِمِثْلٍ سَوَاءً بِسَوَاءٍ عَيْنًا بِعَيْنٍ
[Machine] The Messenger of Allah ﷺ said, "Gold should be exchanged with gold based on weight, and silver should be exchanged with silver based on weight. Salt should be exchanged with salt in equal measure, barley should be exchanged with barley in equal measure, wheat should be exchanged with wheat in equal measure, and dates should be exchanged with dates in equal measure. Anyone who adds more or asks for more has engaged in a form of usury. So, sell gold for silver hand to hand, however you wish, sell dates for salt hand to handing, and sell barley for wheat hand to hand, however you wish."
قَالَ رَسُولُ اللهِ ﷺ الذَّهَبُ بِالذَّهَبِ وَزْنًا بِوَزْنٍ وَالْفِضَّةُ بِالْفِضَّةِ وَزْنًا بِوَزْنٍ وَالْمِلْحُ بِالْمِلْحِ مِثْلًا بِمِثْلٍ وَالشَّعِيرُ بِالشَّعِيرِ مِثْلًا بِمِثْلٍ وَالْبُرُّ بِالْبُرِّ مِثْلًا بِمِثْلٍ وَالتَّمْرُ بِالتَّمْرِ مِثْلًا بِمِثْلٍ فَمَنْ زَادَ أَوِ اسْتَزَادَ فَقَدْ أَرْبَى فَبِيعُوا الذَّهَبَ بِالْفِضَّةِ يَدًا بِيَدٍ كَيْفَ شِئْتُمْ وَالتَّمْرَ بِالْمِلْحِ يَدًا بِيَدٍ وَالشَّعِيرَ بِالْبُرِّ يَدًا بِيَدٍ كَيْفَ شِئْتُمْ
[Machine] "He said that gold should be exchanged for gold, silver for silver, grain for grain, barley for barley, dates for dates, and salt for salt, like for like, equally, hand in hand. But if these commodities differ, then sell as you wish, as long as it is hand in hand. Abu Ali Al-Rudhbari informed us, I am Muhammad bin Bakr, Abu Dawood narrated to us, Abu Bakr bin Abi Shaybah narrated to us, I am Waqee', H and I am Abu Abdullah Al-Hafiz, I am Abu Al-Fadl bin Ibrahim, Ahmad bin Salamah narrated to us, Ishaq bin Ibrahim reported, and it was mentioned in the hadith."
أَنَّهُ قَالَ الذَّهَبُ بِالذَّهَبِ وَالْفِضَّةُ بِالْفِضَّةِ وَالْبُرُّ بِالْبُرِّ وَالشَّعِيرُ بِالشَّعِيرِ وَالتَّمْرُ بِالتَّمْرِ وَالْمِلْحُ بِالْمِلْحِ مِثْلًا بِمِثْلٍ سَوَاءً بِسَوَاءٍ يَدًا بِيَدٍ فَإِذَا اخْتَلَفَ هَذِهِ الْأَصْنَافُ فَبِيعُوا كَيْفَ شِئْتُمْ إِذَا كَانَ يَدًا بِيَدٍ أَخْبَرَنَاهُ أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنا مُحَمَّدُ بْنُ بَكْرٍ ثنا أَبُو دَاوُدَ ثنا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ أنا وَكِيعٌ ح وَأنا أَبُو عَبْدِ اللهِ الْحَافِظُ أنا أَبُو الْفَضْلِ بْنُ إِبْرَاهِيمَ ثنا أَحْمَدُ بْنُ سَلَمَةَ ثنا إِسْحَاقُ بْنُ إِبْرَاهِيمَ أنبأ وَكِيعٌ ثنا سُفْيَانُ فَذَكَرَ الْحَدِيثَ
[Machine] I heard the Messenger of Allah ﷺ saying, "Gold is measured with gold, and silver is measured with silver, until he specified saying, 'Salt is measured with salt.'" Muawiyah said, "This does not say anything." 'Ubada said, "I bear witness that I heard the Messenger of Allah ﷺ saying that."
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ الذَّهَبُ الْكِفَّةُ بِالْكِفَّةِ وَالْفِضَّةُ الْكِفَّةُ بِالْكِفَّةِ حَتَّى خَصَّ أَنْ قَالَ الْمِلْحُ بِالْمِلْحِ فَقَالَ مُعَاوِيَةُ إِنَّ هَذَا لَا يَقُولُ شَيْئًا فَقَالَ عُبَادَةُ ؓ أَشْهَدُ أَنِّي سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ ذَلِكَ
13.15 [Machine] Prohibition of discrimination in the same gender as the occurrence of usury with the prohibition of women as evidence by what has passed.
١٣۔١٥ بَابُ تَحْرِيمِ التَّفَاضُلِ فِي الْجِنْسِ الْوَاحِدِ مِمَّا يَجْرِي فِيهِ الرِّبَا مَعَ تَحْرِيمِ النَّسَاءِ اسْتِدْلَالًا بِمَا مَضَى
[Machine] The Messenger of Allah ﷺ said, "Do not sell gold dinar for two gold dinars and do not sell silver dirham for two silver dirhams." These are the words of the hadith of Ibn Abbad.
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا تَبِيعُوا الدِّينَارَ بِالدِّينَارَيْنِ وَلَا الدِّرْهَمَ بِالدِّرْهَمَيْنِ لَفْظُ حَدِيثِ ابْنِ عَبْدَانَ
[Machine] The Messenger of Allah (PBUH) said, "A dinar should be exchanged for a dinar, with no difference between the two, and a dirham should be exchanged for a dirham, with no difference between them."
قَالَ رَسُولُ اللهِ ﷺ الدِّينَارُ بِالدِّينَارِ لَا فَضْلَ بَيْنَهُمَا وَالدِّرْهَمُ بِالدِّرْهَمِ لَا فَضْلَ بَيْنَهُمَا
Gold is to be paid for by gold, silver by silver, wheat by wheat, barley by barley, dates by dates, salt by salt, like by like, payment being made hand to hand. He who made an addition to it, or asked for an addition, in fact dealt in usury. The receiver and the giver are equally guilty. (Using translation from Muslim 1584e)
قَالَ رَسُولُ اللهِ ﷺ الذَّهَبُ بِالذَّهَبِ وَالْفِضَّةُ بِالْفِضَّةِ وَالْبُرُّ بِالْبُرِّ وَالشَّعِيرُ بِالشَّعِيرِ وَالتَّمْرُ بِالتَّمْرِ وَالْمِلْحُ بِالْمِلْحِ مِثْلًا بِمِثْلِ يَدًا بِيَدٍ فَمَنْ زَادَ أَوِ ازْدَادَ فَقَدْ أَرْبَى الْآخِذُ وَالْمُعْطِي فِيهِ سَوَاءٌ
[Machine] "From Abu Sa'id al-Khudri, Abu Sa'id came and settled in this house. He took me by the hand until we approached him and he said, 'What is this news about you?' Abu Sa'id said, 'With my own eyes I saw and with my own ears I heard the Messenger of Allah ﷺ using his finger saying, "Do not sell gold for gold nor silver for silver, except equally and at the spot. Do not keep one hand over the other hand nor sell the absent for the present.'
عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ فَقَدِمَ أَبُو سَعِيدٍ فَنَزَلَ هَذِهِ الدَّارَ فَأَخَذَ بِيَدِي حَتَّى أَتَيْنَاهُ فَقَالَ مَا يُحَدِّثُ هَذَا عَنْكَ؟ قَالَ أَبُو سَعِيدٍ بَصُرَ عَيْنِي وَسَمِعَ أُذُنِي قَالَ فَمَا نَسِيتُ قَوْلَهُ بِأُصْبُعِهِ رَسُولُ اللهِ ﷺ نَهَى عَنْ بَيْعِ الذَّهَبِ بِالذَّهَبِ وَبَيْعِ الْوَرِقِ بِالْوَرِقِ إِلَّا سَوَاءً بِسَوَاءٍ مِثْلًا بِمِثْلٍ وَلَا تُشِفُّوا أَحَدَهُمَا عَلَى الْآخَرِ وَلَا تَبِيعُوا غَائِبًا بِنَاجِزٍ
[Machine] "Narrated by the Prophet ﷺ , he said, 'The dinar should be exchanged for a dinar, and the dirham should be exchanged for a dirham. There is no difference between them. Abdullah then walked with Nafi' until he entered upon Abu Sa'id Al-Khudri and asked him. He said, 'I have seen with my own eyes and heard with my own ears the Messenger of Allah ﷺ saying, 'The dinar should be exchanged for a dinar, and the dirham should be exchanged for a dirham, weight for weight, with no difference between them. And a deferred payment cannot be exchanged for a lump sum payment.'"
عَنِ النَّبِيِّ ﷺ قَالَ الدِّينَارُ بِالدِّينَارِ وَالدِّرْهَمُ بِالدِّرْهَمِ لَا فَضْلَ بَيْنَهُمَا فَمَشَى عَبْدُ اللهِ وَمَعَهُ نَافِعٌ حَتَّى دَخَلَ عَلَى أَبِي سَعِيدٍ الْخُدْرِيِّ فَسَأَلَهُ فَقَالَ بَصُرَ عَيْنِي وَسَمِعَ أُذُنِي رَسُولَ اللهِ ﷺ يَقُولُ الدِّينَارُ بِالدِّينَارِ وَالدِّرْهَمُ بِالدِّرْهَمِ وَزْنًا بِوَزْنٍ لَا فَضْلَ بَيْنَهُمَا وَلَا يُبَاعُ عَاجِلٌ بِآجِلٍ
[Machine] He heard from the Prophet ﷺ something, he said: 'Umar said: Do not sell gold for gold, nor silver for silver, except like for like, equal for equal, and do not defer payment of one debt with another debt. Verily, I fear for you the ruin.' I asked Nafi', "What is the ruin?" He said, "Interest."
يَسْمَعْ فِيهِ مِنَ النَّبِيِّ ﷺ شَيْئًا قَالَ قَالَ عُمَرُ ؓ لَا تَبَايَعُوا الذَّهَبَ بِالذَّهَبِ وَلَا الْوَرِقَ بِالْوَرِقِ إِلَّا مِثْلًا بِمِثْلٍ سَوَاءً بِسَوَاءٍ وَلَا تُشِفُّوا بَعْضَهُ عَلَى بَعْضٍ إِنِّي أَخَافُ عَلَيْكُمُ الرَّمَاءَ قَالَ قُلْتُ لِنَافِعٍ وَمَا الرَّمَاءَ؟ قَالَ الرِّبَا قَالَ فَحَدَّثَهُ رَجُلٌ مِنَ الْأَنْصَارِ عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ حَدِيثًا قَالَ نَافِعٌ فَأَخَذَ بِيَدِ الْأَنْصَارِيِّ وَأَنَا مَعَهُمَا حَتَّى دَخَلْنَا عَلَى أَبِي سَعِيدٍ الْخُدْرِيِّ فَقَالَ يَا أَبَا سَعِيدٍ هَذَا حَدَّثَ عَنْكَ حَدِيثَ كَذَا وَكَذَا قَالَ مَا هُوَ فَذَكَرَهُ قَالَ نَعَمْ سَمِعَ أُذُنَايَ وَبَصُرَ عَيْنِي قَالَهَا ثَلَاثًا فَأَشَارَ بِأُصْبُعِهِ حِيَالَ عَيْنَيْهِ مِنْ رَسُولِ اللهِ ﷺ وَهُوَ يَقُولُ لَا تَبَايَعُوا الذَّهَبَ بِالذَّهَبِ وَلَا تَبَايَعُوا الْوَرِقَ بِالْوَرِقِ إِلَّا مِثْلًا بِمِثْلٍ سَوَاءً بِسَوَاءٍ وَلَا تَبِيعُوا شَيْئًا مِنْهَا غَائِبًا بِنَاجِزٍ وَلَا تُشِفُّوا بَعْضَهُ عَلَى بَعْضٍ
[Machine] Regarding this, the goldsmith began to reply to him, and Ibn Umar forbade him until they reached the gate of the mosque to a mount that he would ride. Ibn Umar said, "Dinar for dinar, and dirham for dirham. There is no difference between them. This is the covenant of our Prophet ﷺ with us and our covenant with you." In another narration by Salim and Nafi', it indicates that Ibn Umar did not hear anything from the Prophet ﷺ regarding this, but he only heard it from his father, then from Abu Sa'eed.
عَنْ ذَلِكَ فَجَعَلَ الصَّائِغُ يَرُدُّ عَلَيْهِ الْمَسْأَلَةَ وَابْنُ عُمَرَ يَنْهَاهُ حَتَّى انْتَهَى إِلَى بَابِ الْمَسْجِدِ إِلَى دَابَّةٍ يَرْكَبُهَا فَقَالَ ابْنُ عُمَرَ الدِّينَارُ بِالدِّينَارِ وَالدِّرْهَمُ بِالدِّرْهَمِ لَا فَضْلَ بَيْنَهُمَا هَذَا عَهْدُ نَبِيِّنَا ﷺ إِلَيْنَا وَعَهْدُنَا إِلَيْكُمْ وَفِي رِوَايَةِ سَالِمٍ وَنَافِعٍ دَلَالَةٌ عَلَى أَنَّ ابْنَ عُمَرَ لَمْ يَسْمَعْ مِنَ النَّبِيِّ ﷺ فِي ذَلِكَ شَيْئًا وَإِنَّمَا سَمِعَهُ مِنْ أَبِيهِ ثُمَّ عَنْ أَبِي سَعِيدٍ
"Umar said: Dinar for Dinar, Dirham for Dirham, no difference between them, this is the obligation that our Prophet enjoined upon us." (Using translation from Nasāʾī 4568)
أَنَّهُ قَالَ الدِّينَارُ بِالدِّينَارِ وَالدِّرْهَمُ بِالدِّرْهَمِ لَا فَضْلَ بَيْنَهُمَا هَذَا عَهْدُ نَبِيِّنَا ﷺ إِلَيْنَا وَعَهْدُنَا إِلَيْكُمْ
[Machine] "And Al-Shafi'i narrated it in the story of Al-Sa'igh, then he said, this is a mistake. Sufyan bin 'Uyaynah narrated from Wardan Al-Rumi that he asked Ibn 'Umar, and he said, I am a man who crafts jewelry and then sells it, and I prefer in it the value of my wage or the work of my hands. Ibn 'Umar said, gold is exchanged with gold, there is no difference between them. This is the covenant of our companion to us, and our covenant to you. Al-Shafi'i meant by our companion, 'Umar bin Al-Khattab. Abu Ishaq Al-Armani narrated to us, I am Shafi'i bin Muhammad, I am Abu Ja'far bin Salamah, Al-Muzani narrated to us, Al-Shafi'i mentioned it."
وَرَوَاهُ الشَّافِعِيُّ فِي رِوَايَةِ الْمُزَنِيِّ عَنْهُ بِطُولِهِ فِي قِصَّةِ الصَّائِغِ ثُمَّ قَالَ هَذَا خَطَأٌ أَخْبَرَنَا سُفْيَانُ بْنُ عُيَيْنَةَ عَنْ وَرْدَانَ الرُّومِيِّ أَنَّهُ سَأَلَ ابْنَ عُمَرَ فَقَالَ إِنِّي رَجُلٌ أَصُوغُ الْحُلِيَّ ثُمَّ أَبِيعُهُ وَأَسْتَفْضِلُ فِيهِ قَدْرَ أُجْرَتِي أَوْ عَمَلِ يَدِي فَقَالَ ابْنُ عُمَرَ الذَّهَبُ بِالذَّهَبِ لَا فَضْلَ بَيْنَهُمَا هَذَا عَهْدُ صَاحِبِنَا إِلَيْنَا وَعَهْدُنَا إِلَيْكُمْ قَالَ الشَّافِعِيُّ يَعْنِي بِصَاحِبِنَا عُمَرَ بْنِ الْخَطَّابِ أَخْبَرَنَاهُ أَبُو إِسْحَاقَ الْأَرْمَوِيُّ أنا شَافِعُ بْنُ مُحَمَّدٍ أنا أَبُو جَعْفَرِ بْنُ سَلَامَةَ ثنا الْمُزَنِيُّ ثنا الشَّافِعِيُّ فَذَكَرَهُ
[Machine] Abu al-Abbas al-Asam narrated to us, I am al-Rabee’; al-Shafi’i informed us that he is Malik, and Ali ibn Ahmad ibn Abdan informed us, I am Ahmad ibn Ubayd al-Saffar. Isma'il ibn Ishaq narrated to us, Abdullah, meaning al-Qa'nabi, narrated from Malik, from Zaid ibn Aslam, from Ataa ibn Yasar, that Muawiyah ibn Abi Sufyan sold a cup made of gold or silver that was heavier than its weight. So Abu al-Darda' said to him, "I heard the Messenger of Allah ﷺ forbidding such a thing unless it is like for like." Muawiyah said, "I don't see anything wrong in it." Abu al-Darda' said to him, "Who will defend me against Muawiyah? I inform him about the Messenger of Allah ﷺ while he informs me about his opinion." Abu al-Darda' then visited Umar ibn al-Khattab and mentioned this to him, so Umar wrote to Muawiyah that he should not sell it except for a cup of the same weight. The narration of al-Muzani does not mention al-Rabee' from al-Shafi'i in this context, as Abu al-Darda' had come to Umar and al-Shafi'i had already mentioned it.
ثنا أَبُو الْعَبَّاسِ الْأَصَمُّ أنا الرَّبِيعُ أنبأ الشَّافِعِيُّ أنا مَالِكٌ ح وَأَخْبَرَنَا عَلِيُّ بْنُ أَحْمَدَ بْنِ عَبْدَانَ أنا أَحْمَدُ بْنُ عُبَيْدٍ الصَّفَّارُ ثنا إِسْمَاعِيلُ بْنُ إِسْحَاقَ ثنا عَبْدُ اللهِ يَعْنِي الْقَعْنَبِيَّ عَنْ مَالِكٍ عَنْ زَيْدِ بْنِ أَسْلَمَ عَنْ عَطَاءِ بْنِ يَسَارٍ أَنَّ مُعَاوِيَةَ بْنَ أَبِي سُفْيَانَ بَاعَ سِقَايَةً مِنْ ذَهَبٍ أَوْ مِنْ وَرِقٍ بِأَكْثَرَ مِنْ وَزْنِهَا فَقَالَ لَهُ أَبُو الدَّرْدَاءِ سَمِعْتُ رَسُولَ اللهِ ﷺ يَنْهَى عَنْ مِثْلِ هَذَا إِلَّا مِثْلًا بِمِثْلٍ فَقَالَ مُعَاوِيَةُ مَا أَرَى بِهَذَا بَأْسًا فَقَالَ لَهُ أَبُو الدَّرْدَاءِ مَنْ يَعْذِرُنِي مِنْ مُعَاوِيَةَ؟ أُخْبِرُهُ عَنْ رَسُولِ اللهِ ﷺ وَيُخْبِرُنِي عَنْ رَأْيِهِ لَا أُسَاكِنُكَ بِأَرْضٍ أَنْتَ بِهَا ثُمَّ قَدِمَ أَبُو الدَّرْدَاءِ عَلَى عُمَرَ بْنِ الْخَطَّابِ ؓ فَذَكَرَ لَهُ ذَلِكَ فَكَتَبَ عُمَرُ إِلَى مُعَاوِيَةَ أَنْ لَا يَبِيعَ ذَلِكَ إِلَّا مِثْلًا بِمِثْلٍ وَزْنًا بِوَزْنٍ وَلَمْ يَذْكُرِ الرَّبِيعُ عَنِ الشَّافِعِيِّ فِي هَذَا قَدُومَ أَبِي الدَّرْدَاءِ عَلَى عُمَرَ وَقَدْ ذَكَرَهُ الشَّافِعِيُّ فِي رِوَايَةِ الْمُزَنِيِّ
13.16 [Machine] Who said: Usury is in negligence.
١٣۔١٦ بَابُ مَنْ قَالَ: الرِّبَا فِي النَّسِيئَةِ
[Machine] That the Prophet ﷺ said: "Interest is in bad actions."
أَنَّ النَّبِيَّ ﷺ قَالَ الرِّبَا فِي النَّسِيئَةِ
[Machine] That the Messenger of Allah ﷺ said: The dirham is to be exchanged for a dirham and the dinar for a dinar, like for like, with no surplus between them. I said to Abu Sa'eed: I heard Ibn Abbas say that there is no harm in it. Abu Sa'eed said: I met Ibn Abbas and asked him about this matter. Did you find anything about it in the Book of Allah or did you hear it from the Messenger of Allah ﷺ ? He said: I did not find anything about it in the Book of Allah, nor did I hear it from the Messenger of Allah ﷺ . And you are more knowledgeable than the Messenger of Allah ﷺ and me. But Usamah ibn Zaid told me that the Messenger of Allah ﷺ said: Verily, riba is in the exchange of gold for silver.
أَنَّ رَسُولَ اللهِ ﷺ قَالَ الدِّرْهَمُ بِالدِّرْهَمِ وَالدِّينَارُ بِالدِّينَارِ مِثْلًا بِمِثْلٍ لَيْسَ بَيْنَهُمَا فَضْلٌ قُلْتُ لِأَبِي سَعِيدٍ كَانَ ابْنُ عَبَّاسٍ لَا يَرَى بِهِ بَأْسًا فَقَالَ أَبُو سَعِيدٍ قَدْ لَقِيتُ ابْنَ عَبَّاسٍ فَقُلْتُ لَهُ أَخْبِرْنِي عَنْ هَذَا الَّذِي تَقُولُ أَشَيْءٌ وَجَدْتَهُ فِي كِتَابِ اللهِ أَوْ شَيْءٌ سَمِعْتَهُ مِنْ رَسُولِ اللهِ ﷺ؟ فَقَالَ مَا وَجَدْتُهُ فِي كِتَابِ اللهِ وَلَا سَمِعْتُهُ مِنْ رَسُولِ اللهِ ﷺ وَلَأَنْتُمْ أَعْلَمُ مِنْ رَسُولِ اللهِ ﷺ مِنِّي وَلَكِنْ أَخْبَرَنِي أُسَامَةُ بْنُ زَيْدٍ أَنَّ رَسُولَ اللهِ ﷺ قَالَ إِنَّ الرِّبَا فِي النَّسِيئَةِ
[Machine] They said, "We were merchants during the time of the Messenger of Allah ﷺ and we asked the Messenger of Allah ﷺ about currency exchange. He said, 'If it is hand to hand, then there is no problem. And if it involves any riba (usury or interest), then it is prohibited.'
عَنِ الصَّرْفِ فَقَالَا كُنَّا تَاجِرَيْنِ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ فَسَأَلْنَا رَسُولَ اللهِ ﷺ عَنِ الصَّرْفِ فَقَالَ مَا كَانَ مِنْهُ يَدًا بِيَدٍ فَلَا بَأْسَ وَمَا كَانَ مِنْهُ نَسِيئَةً فَلَا
[Machine] Regarding the exchange, both of them say that the Prophet ﷺ forbade selling paper for gold as a debt.
عَنِ الصَّرْفِ فَكِلَاهُمَا يَقُولُ نَهَى رَسُولُ اللهِ ﷺ عَنْ بَيْعِ الْوَرِقِ بِالذَّهَبِ دَيْنًا
13.17 [Machine] What can be inferred from the statement of the first Imam: "There is no usury except in nasi'ah, according to his statement and his withdrawal from it
١٣۔١٧ بَابُ مَا يُسْتَدَلُّ بِهِ عَلَى رُجُوعِ مَنْ قَالَ مِنَ الصَّدْرِ الْأَوَّلِ: لَا رِبًا إِلَّا فِي النَّسِيئَةِ عَنْ قَوْلِهِ وَنُزُوعِهِ عَنْهُ
I asked Ibn Umar and Ibn Abbas (Allah be pleased with them) about the conversion of gold with gold but they did not find any harm in that. I was sitting in the company of Abd Sa'id al-Khudri (Allah be pleased with him) and asked him about this exchange, and he said: Whatever is addition is an' interest. I refused to accept it on account of their statement (statement of Ibn 'Abbas and Ibn 'Umar). He said: I am not narrating to you except what I heard from Messenger of Allah ﷺ. There came to him the owner of a date-palm with one sa' of fine dates, and the dates of Allah's Apostle ﷺ were of that colour. Allah's Apostle ﷺ said to him: Where did you get these dates? I went with two sa's of (inferior dates) and bought one sa' of (these fine dates), for that is the prevailing price (of inferior dates) in the market and that is the price (of the fine quality of dates in the market), whereupon Messenger of Allah ﷺ said: Woe be upon you! You have dealt in interest, when you decide to do it (i. e. exchange superior quality of dates for inferior quality) ; so you should sell your dates for another commodity (or currency) and then with the help of that commodity buy the dates you like. Abu Sa'ad said: When dates are exchanged for dates (with different qualities) there is the possibility (of the element of) interest (creeping into that) or when gold is exchanged for gold having different qualities. I subsequently came to Ibn 'Umar and he forbade me (to do it), but I did not come to Ibn 'Abbas; (Allah be pleased with them). He (the narrator) said: Abu as-Sahba' narrated to me: He asked Ibn Abbas (Allah be pleased with them) in Mecca, and he too disapproved of it. (Using translation from Muslim 1594d)
عَنِ الصَّرْفِ فَلَمْ يَرَيَا بِهِ بَأْسًا وَإِنِّي لَقَاعِدٌ عِنْدَ أَبِي سَعِيدٍ الْخُدْرِيِّ فَسَأَلْتُهُ عَنِ الصَّرْفِ فَقَالَ مَا زَادَ فَهُوَ رِبًا فَأَنْكَرْتُ ذَلِكَ لِقَوْلِهِمَا فَقَالَ لَا أُحَدِّثُكُمْ إِلَّا مَا سَمِعْتُ مِنْ رَسُولِ اللهِ ﷺ جَاءَهُ صَاحِبُ نَخْلَةٍ بِصَاعٍ مِنْ تَمْرٍ طَيِّبٍ وَكَانَ تَمْرُ النَّبِيِّ ﷺ هُوَ الدُّونَ فَقَالَ لَهُ النَّبِيُّ ﷺ أَنَّى لَكَ هَذَا؟ قَالَ انْطَلَقْتُ بِصَاعِي وَاشْتَرَيْتُ بِهِ هَذَا الصَّاعَ فَإِنَّ سِعْرَ هَذَا بِالسُّوقِ كَذَا وَسِعْرَ هَذَا بِالسُّوقِ كَذَا فَقَالَ لَهُ رَسُولُ اللهِ ﷺ أَرْبَيْتَ إِذَا أَرَدْتَ ذَلِكَ فَبِعْ تَمْرَكَ بِسِلْعَةٍ ثُمَّ اشْتَرِ بِسِلْعَتِكَ أِيَّ تَمْرٍ شِئْتَ فَقَالَ أَبُو سَعِيدٍ فَالتَّمْرُ بِالتَّمْرِ أَحَقُّ أَنْ يَكُونَ رِبًا وَالْفِضَّةُ بِالْفِضَّةِ قَالَ فَأَتَيْتُ ابْنَ عُمَرَ بَعْدُ فَنَهَانِي وَلَمْ آتِ ابْنَ عَبَّاسٍ قَالَ فَحَدَّثَنِي أَبُو الصَّهْبَاءِ أَنَّهُ سَأَلَ ابْنَ عَبَّاسٍ عَنْهُ فَكَرِهَهُ
[Machine] "That the Prophet ﷺ forbade it, so I forbid you from it."
أَنَّ النَّبِيَّ ﷺ نَهَى عَنْهُ فَأَنَا أَنْهَاكُمْ عَنْهُ
[Machine] There is no harm if the man marries her, and Abdullah was in charge of the treasury, and he used to sell the waste of the treasury, giving more and taking less. Until he arrived in the city, and asked the companions of Muhammad, ﷺ , and they said, "This man is not allowed to marry this woman, and silver is not accepted except by weight." When Abdullah arrived, he went to the man but did not find him, and he found his people and said, "Indeed, the one I gave the fatwa for said that it is not allowed." They said, "She has scattered her belly." He said, "Even if he came to the market, he said, 'O people of the market, indeed, the one I used to sell to you is not allowed. Silver cannot be exchanged for silver except by weight.'"
لَا بَأْسَ فَتَزَوَّجَهَا الرَّجُلُ وَكَانَ عَبْدُ اللهِ عَلَى بَيْتِ الْمَالِ وَكَانَ يَبِيعُ نِفَايَةَ بَيْتِ الْمَالِ يُعْطِي الْكَثِيرَ وَيَأْخُذُ الْقَلِيلَ حَتَّى قَدِمَ الْمَدِينَةَ فَسَأَلَ أَصْحَابَ مُحَمَّدٍ ﷺ فَقَالُوا لَا يَحِلُّ لِهَذَا الرَّجُلِ هَذِهِ الْمَرْأَةُ وَلَا تَصْلُحُ الْفِضَّةُ إِلَّا وَزْنًا بِوَزْنٍ فَلَمَّا قَدِمَ عَبْدُ اللهِ انْطَلَقَ إِلَى الرَّجُلِ فَلَمْ يَجِدْهُ وَوَجَدَ قَوْمَهُ فَقَالَ إِنَّ الَّذِي أَفْتَيْتُ بِهِ صَاحِبَكُمْ لَا يَحِلُّ فَقَالُوا إِنَّهَا قَدْ نَثَرَتْ لَهُ بَطْنَهَا قَالَ وَإِنْ كَانَ وَأَتَى الصَّيَارِفَةَ فَقَالَ يَا مَعْشَرَ الصَّيَارِفَةِ إِنَّ الَّذِي كُنْتُ أُبَايِعُكُمْ لَا يَحِلُّ لَا تَحِلُّ الْفِضَّةُ بِالْفِضَّةِ إِلَّا وَزْنًا بِوَزْنٍ
13.18 [Machine] Permission to differentiate between the sexes, and that barley and wheat are two types along with the prohibition of women if they are combined due to a common reason in usury.
١٣۔١٨ بَابُ جَوَازِ التَّفَاضُلِ فِي الْجِنْسَيْنِ , وَأَنَّ الْبُرَّ وَالشَّعِيرَ جِنْسَانِ مَعَ تَحْرِيمِ النَّسَاءِ إِذَا جَمَعَتْهُمَا عِلَّةٌ وَاحِدَةٌ فِي الرِّبَا
It is to be made on the spot. This is what I heard (from Messenger of Allah (may peace be upon him ). (Using translation from Muslim 1590a)
نَهَى رَسُولُ اللهِ ﷺ عَنْ بَيْعِ الْفِضَّةِ بِالْفِضَّةِ وَالذَّهَبِ بِالذَّهَبِ إِلَّا سَوَاءً بِسَوَاءٍ وَأَمَرَنَا أَنْ نَشْتَرِيَ الْفِضَّةَ بِالذَّهَبِ وَنَشْتَرِيَ الذَّهَبَ بِالْفِضَّةِ كَيْفَ شِئْنَا قَالَ فَسَأَلَهُ رَجُلٌ فَقَالَ يَدًا بِيَدٍ؟ فَقَالَ هَكَذَا سَمِعْتُ
