١٣۔ كِتَابُ الْبُيُوعِ ص ١
[Machine] From Mujahid's statement about the verse "Eat from the good things which We have provided for you" [Al-Baqarah 57], he said, "Trading..."
عَنْ مُجَاهِدٍ فِي قَوْلِهِ ﷻ {كُلُوا مِنْ طَيِّبَاتِ مَا رَزَقْنَاكُمْ} [البقرة 57] قَالَ التِّجَارَةُ
[Machine] He said about this verse, "O you who have believed, spend from the good things which you have earned." He said, "from trade."
أَنَّهُ قَالَ فِي هَذِهِ الْآيَةِ يَا أَيُّهَا الَّذِينَ آمَنُوا أَنْفِقُوا مِنْ طَيِّبَاتِ مَا كَسَبْتُمْ قَالَ مِنَ التِّجَارَةِ
[Machine] About this verse {O you who have believed, do not consume one another's wealth unjustly but only [in lawful] business by mutual consent.}[Quran 4:29], Qatadah said: "Trade is sustenance from the sustenance of Allah, it is lawful from the lawful (provision) of Allah for those who seek it with its truthfulness and righteousness."
عَنْ قَتَادَةَ فِي هَذِهِ الْآيَةِ {يَا أَيُّهَا الَّذِينَ آمَنُوا لَا تَأْكُلُوا أَمْوَالَكُمْ بَيْنَكُمْ بِالْبَاطِلِ إِلَّا أَنْ تَكُونَ تِجَارَةً عَنْ تَرَاضٍ مِنْكُمْ} [النساء 29] قَالَ التِّجَارَةُ رِزْقٌ مِنْ رِزْقِ اللهِ حَلَالٌ مِنْ حَلَالِ اللهِ لِمَنْ طَلَبَهَا بِصِدْقِهَا وَبِرِّهَا
[Machine] The Messenger of Allah ﷺ was asked, "Which earning is better or best?" He replied, "The work of a man with his own hands and every lawful transaction."
سُئِلَ رَسُولُ اللهِ ﷺ أِيُّ الْكَسْبِ أَطْيَبُ أَوْ أَفْضَلُ؟ قَالَ عَمَلُ الرَّجُلِ بِيَدِهِ وَكُلُّ بَيْعٍ مَبْرُورٍ هَكَذَا
[Machine] The Prophet ﷺ was asked, "Which earning is the best for a man?" He replied, "The work of a man's hand, and every sale that is approved. This is what is saved." This narration is attributed to Sa'id from his uncle. The Prophet ﷺ was asked, "Which earning is better?" He said, "A righteous earning." Sahih Al-Bukhari narrated it from Abu Abdullah Al-Hafiz, from Abu Al-Abbas Al-Asamm, from Al-Abbas bin Muhammad, from Al-Aswad bin 'Amir, from Sufyan Ath-Thawri, from Wael bin Dawud, from Sa'id bin 'Umayr, from his uncle. He mentioned it, and it was transmitted by others from Sufyan. And Shurayk narrated it from Wael bin Dawud, from Jumai' bin Umayr, from his maternal uncle Abu Burdah, and all of them are wrong. And Al-Mas'udi narrated it from Wael bin Dawud, from 'Abayat bin Rafi' bin Khadij, from his father, and it is also incorrect. The authentic narration is from Wael bin Dawud, from Sa'id bin 'Umayr, from the Prophet ﷺ, and it is reported as a Mursal narration. Al-Bukhari said, "Some of them narrated it with a weak chain, and it is also incorrect."
سُئِلَ النَّبِيُّ ﷺ أِيُّ كَسْبِ الرَّجُلِ أَطْيَبُ؟ قَالَ عَمَلُ الرَّجُلِ بِيَدِهِ وَكُلُّ بَيْعٍ مَبْرُورٍ هَذَا هُوَ الْمَحْفُوظُ مُرْسَلًا وَيُقَالُ عَنْهُ عَنْ سَعِيدٍ عَنْ عَمِّهِ قَالَ سُئِلَ رَسُولُ اللهِ ﷺ أِيُّ الْكَسْبِ أَفْضَلُ؟ قَالَ كَسْبٌ مَبْرُورٌ 10399 أَخْبَرَنَاهُ أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو الْعَبَّاسِ هُوَ الْأَصَمُّ أنا الْعَبَّاسُ بْنُ مُحَمَّدٍ أنا الْأَسْوَدُ بْنُ عَامِرٍ ثنا سُفْيَانُ الثَّوْرِيُّ عَنْ وَائِلِ بْنِ دَاوُدَ عَنْ سَعِيدِ بْنِ عُمَيْرٍ عَنْ عَمِّهِ فَذَكَرَهُ وَقَدْ أَرْسَلَهُ غَيْرُهُ عَنْ سُفْيَانَ وَقَالَ شَرِيكٌ عَنْ وَائِلِ بْنِ دَاوُدَ عَنْ جُمَيْعِ بْنِ عُمَيْرٍ عَنْ خَالِهِ أَبِي بُرْدَةَ وَجُمَيْعٌ خَطَأٌ وَقَالَ الْمَسْعُودِيُّ عَنْ وَائِلِ بْنِ دَاوُدَ عَنْ عَبَايَةَ بْنِ رَافِعِ بْنِ خَدِيجٍ عَنْ أَبِيهِ وَهُوَ خَطَأٌ وَالصَّحِيحُ رِوَايَةُ وَائِلٍ عَنْ سَعِيدِ بْنِ عُمَيْرٍ عَنِ النَّبِيِّ ﷺ مُرْسَلًا قَالَ الْبُخَارِيُّ أَسْنَدَهُ بَعْضُهُمْ وَهُوَ خَطَأٌ
13.2 [Machine] Seeking Halal and Avoiding Doubtful Matters
١٣۔٢ بَابُ طَلَبِ الْحَلَالِ وَاجْتِنَابِ الشُّبُهَاتِ
I heard Messenger of Allah ﷺ saying, 'Both legal and illegal things are evident but in between them there are doubtful (suspicious) things and most of the people have no knowledge about them. So whoever saves himself from these suspicious things saves his religion and his honor. And whoever indulges in these suspicious things is like a shepherd who grazes (his animals) near the Hima (private pasture) of someone else and at any moment he is liable to get in it. (O people!) Beware! Every king has a Hima and the Hima of Allah on the earth is His illegal (forbidden) things. Beware! There is a piece of flesh in the body if it becomes good (reformed) the whole body becomes good but if it gets spoilt the whole body gets spoilt and that is the heart. سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ الْحَلَالُ بَيِّنٌ وَالْحَرَامُ بَيِّنٌ وَبَيْنَهُمَا مُشْتَبِهَاتٌ لَا يَعْلَمُهَا كَثِيرٌ مِنَ النَّاسِ فَمَنِ اتَّقَى الشُّبُهَاتِ اسْتَبْرَأَ لِعِرْضِهِ وَدِينِهِ وَمَنْ وَقَعَ فِي الشُّبُهَاتِ وَقَعَ فِي الْحَرَامِ كَالرَّاعِي يَرْعَى حَوْلَ الْحِمَى يُوشِكُ أَنْ يُوَاقِعَهُ ثُمَّ إنَّ لِكُلِّ مَلِكٍ حِمًى أَلَا وَإِنَّ حِمَى اللهِ مَحَارِمُهُ أَلَا إِنَّ فِي الْجَسَدِ مُضْغَةً إِذَا صَلُحَتْ صَلُحَ الْجَسَدُ كُلُّهُ وَإنْ فَسَدَتْ فَسَدَ الْجَسَدُ كُلُّهُ أَلَا وَهِيَ الْقَلْبُ
[Machine] The Messenger of Allah ﷺ said: "The lawful is clear, and the unlawful is clear, and between them are doubtful matters. Whoever avoids doubtful matters, he keeps his religion and honor intact. But whoever falls into doubtful matters, he may fall into what is unlawful, just as a shepherd who grazes his flock around forbidden land may soon enter it."
قَالَ رَسُولُ اللهِ ﷺ الْحَلَالُ بَيِّنٌ وَالْحَرَامُ بَيِّنٌ وَبَيْنَ ذَلِكَ أُمُورٌ مُشْتَبِهَةٌ فَمَنْ تَرَكَ مَا اشْتَبَهَ عَلَيْهِ كَانَ لِمَا اسْتَبَانَ لَهُ أَتْرَكَ وَمَنِ اجْتَرَأَ عَلَى مَا يَشُكُّ فِيهِ أَوْشَكَ أَنْ يُوَاقِعَ مَا اسْتَبَانَ لَهُ وَالْمَعَاصِي حِمَى اللهِ وَمَنْ يَرْتَعْ حَوْلَ الْحِمَى يُوشِكْ أَنْ يُوَاقِعَهُ
[Machine] That the Messenger of Allah (Peace be upon him) said, "A time will come upon people when they would not care whether they earned money through lawful or unlawful means."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَيَأْتِيَنَّ عَلَى النَّاسِ زَمَانٌ لَا يُبَالِي الْمَرْءُ بِمَا أَخَذَ الْمَالَ بِحَلَالٍ أَمْ بِحَرَامٍ
13.3 [Machine] The pursuit of worldly gains and renouncing the pursuit of them by means that are not permissible
١٣۔٣ بَابُ الْإِجْمَالِ فِي طَلَبِ الدُّنْيَا وَتَرْكِ طَلَبِهَا بِمَا لَا يَحِلُّ
[Machine] "The Messenger of Allah ﷺ said, 'Seek the beauty in the pursuit of this world, for each person has been made easy for him what has been written for him from it.'"
أَنَّ رَسُولَ اللهِ ﷺ قَالَ أَجْمِلُوا فِي طَلَبِ الدُّنْيَا فَإِنَّ كُلًّا مُيَسَّرٌ لَهُ مَا كُتِبَ لَهُ مِنْهَا
[Machine] The Messenger of Allah ﷺ said, "Do not be slow in seeking sustenance, for no servant dies until he reaches his last sustenance that is meant for him. So fear Allah and be good in seeking lawful means and avoiding the forbidden."
قَالَ رَسُولُ اللهِ ﷺ لَا تَسْتَبْطِئُوا الرِّزْقَ فَإِنَّهُ لَمْ يَكُنْ عَبْدٌ يَمُوتُ حَتَّى يَبْلُغَهُ آخِرُ رِزْقٍ هُوَ لَهُ فَاتَّقُوا اللهَ وَأَجْمِلُوا فِي الطَّلَبِ مِنَ الْحَلَالِ وَتَرْكِ الْحَرَامِ
[Machine] The Messenger of Allah ﷺ said, "O people, indeed, none of you will die until he completes his provision, so do not hasten for sustenance and fear Allah, O people, and be beautiful in seeking (sustenance). Take what is lawful and leave what is prohibited, and so
قَالَ رَسُولُ اللهِ ﷺ أَيُّهَا النَّاسُ إِنَّ أَحَدَكُمْ لَنْ يَمُوتَ حَتَّى يَسْتَكْمِلَ رِزْقَهُ فَلَا تَسْتَبْطِئُوا الرِّزْقَ وَاتَّقُوا اللهَ يَا أَيُّهَا النَّاسُ وَأَجْمِلُوا فِي الطَّلَبِ خُذُوا مَا حَلَّ وَدَعُوا مَا حُرِّمَ وَكَذَلِكَ
13.4 [Machine] Disliking the right of sale
١٣۔٤ بَابُ كَرَاهِيَةِ الْيَمِينِ فِي الْبَيْعِ
[Machine] I heard the Messenger of Allah ﷺ say, "Taking oaths excessively is a depletion of goods and a destruction of blessings." Abu Abdullah Al-Hafiz informed us that I am Abu Bakr ibn Ishaq the jurist, and I am Ahmad ibn Ibrahim. Yahya ibn Bukair narrated it to me and mentioned it in a similar manner, except that he attributed it to Ibn Musayyib and said, "A destruction of blessings."
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ الْحَلِفُ مَنْفَقَةٌ لِلسِّلْعَةِ مَمْحَقَةٌ لِلرِّبْحِ 10407 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنا أَبُو بَكْرِ بْنُ إِسْحَاقَ الْفَقِيهُ أنا أَحْمَدُ بْنُ إِبْرَاهِيمَ ثنا يَحْيَى بْنُ بُكَيْرٍ فَذَكَرَهُ بِنَحْوِهِ إِلَّا أَنَّهُ قَالَ عَنِ ابْنِ الْمُسَيِّبِ وَقَالَ مَمْحَقَةٌ لِلْبَرَكَةِ
"Taking oaths may help you to make a sale but it takes (blessing) away from the earnings "(Sahih ) (Using translation from Nasāʾī 4461)
النَّبِيَّ ﷺ الْيَمِينُ الْكَاذِبَةُ مَنْفَقَةٌ لِلسِّلْعَةِ مَمْحَقَةٌ لِلْكَسْبِ
[Machine] Abu Abdullah Al-Hafiz and Abu Abdulrahman As-Sulami informed us from their sources and others. They said: Abu Abbas Muhammad bin Ya'qub bin Yusuf informed us, he said: Abu Jafar Ahmad bin Abdulhamid Al-Harithi informed me, he said: Abu Usamah informed us, that Al-Walid bin Kathir informed him, from Ma'bad bin Ka'b bin Malik, from Abu Qatadah Al-Ansari, that he heard the Messenger of Allah ﷺ saying: "Beware of excessive swearing in sales transactions, for it depletes (the blessings) and causes loss".
أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ وَأَبُو عَبْدِ الرَّحْمَنِ السُّلَمِيُّ مِنْ أَصْلِهِ وَغَيْرُهُمَا قَالُوا ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ بْنِ يُوسُفَ ثنا أَبُو جَعْفَرٍ أَحْمَدُ بْنُ عَبْدِ الْحَمِيدِ الْحَارِثِيُّ ثنا أَبُو أُسَامَةَ أَخْبَرَنِي الْوَلِيدُ بْنُ كَثِيرٍ عَنْ مَعْبَدِ بْنِ كَعْبِ بْنِ مَالِكٍ عَنْ أَبِي قَتَادَةَ الْأَنْصَارِيِّ أَنَّهُ سَمِعَ رَسُولَ اللهِ ﷺ يَقُولُ إِيَّاكُمْ وَكَثْرَةَ الْحَلِفِ فِي الْبَيْعِ فَإِنَّهُ يُنْفِقُ ثُمَّ يَمْحَقُ
[Machine] The Messenger of Allah ﷺ said: "There are three types of people whom Allah will neither look at on the Day of Judgment, nor speak to, and they will have a painful punishment. I asked: 'O Messenger of Allah, who are they?' He replied: 'The one who lets his garment drag below his ankles, the one who takes false oaths for selling his goods, and the one who spends his wealth ostentatiously.'"
قَالَ رَسُولُ اللهِ ﷺ ثَلَاثَةٌ لَا يَنْظُرُ اللهُ إِلَيْهِمْ يَوْمَ الْقِيَامَةِ وَلَا يُكَلِّمُهُمُ اللهُ وَلَهُمْ عَذَابٌ أَلِيمٌ قَالَ قُلْتُ يَا رَسُولَ اللهِ فَمَنْ هَؤُلَاءِ؟ فَقَدْ خَابُوا وَخَسِرُوا فَقَالَ الْمَنَّانُ وَالْمُسْبِلُ إِزَارَهُ وَالْمُنَفِّقُ سِلْعَتَهُ بِالْحَلِفِ الْكَاذِبِ
In the time of the Messenger of Allah ﷺ we used to be called brokers, but the Prophet ﷺ came upon us one day, and called us by a better name than that, saying: O company of merchants, unprofitable speech and swearing takes place in business dealings, so mix it with sadaqah (alms). (Using translation from Abū Dāʾūd 3326)
كُنَّا فِي عَهْدِ رَسُولِ اللهِ ﷺ نَشْتَرِي فِي الْأَسْوَاقِ وَنُسَمِّي أَنْفُسَنَا السَّمَاسِرَةَ فَأَتَى رَسُولُ اللهِ ﷺ فَسَمَّانَا بِاسْمٍ هُوَ أَحْسَنُ مِنْهُ فَقَالَ يَا مَعْشَرَ التُّجَّارِ إِنَّ هَذَا الْبَيْعَ يَحْضُرُهُ الْكَذِبُ وَاللَّغْوُ فَشُوبُوهُ بِالصَّدَقَةِ
[Machine] The Prophet ﷺ said: "O merchants! Indeed, your market is mixed with swearing, so purify it with charity or something from charity. And the speech of Sufyan is close to it."
النَّبِيُّ ﷺ يَا مَعْشَرَ التُّجَّارِ إِنَّ سُوقَكُمْ هَذِهِ يُخَالِطُهَا الْحَلِفُ فَشُوبُوهُ بِالصَّدَقَةِ أَوْ بِشَيْءٍ مِنَ الصَّدَقَةِ وَلَفْظُ سُفْيَانَ قَرِيبٌ مِنْهُ
From his father, from his grandfather, that he went with the Messenger of Allah ﷺ to the Musalla, and he saw the people doing business so he said: 'O people of trade!' and they replied to the Messenger of Allah ﷺ turning their necks and their gazes towards him, and he said: Indeed the merchants will be resurrected on the Day of judgement with the wicked, except the one who has Taqwa of Allah, who behaves charitably and is truthful.'" أَنَّهُ خَرَجَ مَعَ رَسُولِ اللهِ ﷺ إِلَى الْمُصَلَّى بِالْمَدِينَةِ فَوَجَدَ النَّاسَ يَتَبَايَعُونَ فَقَالَ يَا مَعْشَرَ التُّجَّارِ فَاسْتَجَابُوا لَهُ وَرَفَعُوا أَبْصَارَهُمْ وَأَعْنَاقَهُمْ إِلَى رَسُولِ اللهِ ﷺ فَقَالَ إِنَّ التُّجَّارَ يُبْعَثُونَ يَوْمَ الْقِيَامَةِ فُجَّارًا إِلَّا مَنِ اتَّقَى وَبَرَّ وَصَدَقَ
[Machine] Abdulrahman ibn Shibl, a man from the companions of the Prophet ﷺ , reported that he heard the Messenger of Allah ﷺ saying, "Indeed, the merchants are among the wicked ones." A man asked, "O Messenger of Allah, did Allah not permit trading?" He replied, "Yes, but they swear falsely and commit sins."
عَنْ عَبْدِ الرَّحْمَنِ بْنِ شِبْلٍ رَجُلٌ مِنْ أَصْحَابِ النَّبِيِّ ﷺ قَالَ سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ إِنَّ التُّجَّارَ هُمُ الْفُجَّارُ فَقَالَ رَجُلٌ يَا رَسُولَ اللهِ أَلَمْ يَحِلَّ اللهُ الْبَيْعَ؟ قَالَ بَلَى وَلَكِنَّهُمْ يَحْلِفُونَ فَيَأْثَمُونَ
[Machine] The Messenger of Allah, ﷺ , said: "The truthful and trustworthy Muslim merchant will be with the martyrs on the Day of Resurrection." And this was narrated by Al-Hasan from Abu Sa'eed from the Prophet, ﷺ .
قَالَ رَسُولُ اللهِ ﷺ التَّاجِرُ الصَّدُوقُ الْأَمِينُ الْمُسْلِمُ مَعَ الشُّهَدَاءِ يَوْمَ الْقِيَامَةِ وَرُوِيَ ذَلِكَ عَنِ الْحَسَنِ عَنْ أَبِي سَعِيدٍ عَنِ النَّبِيِّ ﷺ
13.5 [Machine] Who said it is not permissible to sell the missing eye?
١٣۔٥ بَابُ مَنْ قَالَ لَا يَجُوزُ بَيْعُ الْعَيْنِ الْغَائِبَةِ
[Machine] The Prophet ﷺ forbade the sale of deception and the sale of pebbles.
أَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنْ بَيْعِ الْغَرَرِ وَعَنْ بَيْعِ حَصَاةٍ
[Machine] The Messenger of Allah ﷺ said: "It is not permissible to engage in a transaction without a clear price, nor is it permissible to make conditions in a transaction, and there is no profit in a transaction unless it is guaranteed. And do not sell what you do not possess." And Ismail ibn 'Ulayah narrated from Ayyub, who said: "Amr ibn Shu'ayb narrated to me, who said: "My father narrated to me, until Abdullah ibn Amr mentioned it." Abu Ali al-Rudhbary informed us that Muhammad ibn Bakr informed him, narrating from Abu Dawud, who narrated from Zuhayr ibn Harb, who narrated from Ismail, and he mentioned it.
قَالَ رَسُولُ اللهِ ﷺ لَا يَحِلُّ سَلَفٌ وَبَيْعٌ وَلَا شَرْطَانِ فِي بَيْعٍ وَلَا رِبْحٌ مَا لَمْ يُضْمَنْ وَلَا بَيْعُ مَا لَيْسَ عِنْدَكَ 10420 وَرَوَاهُ إِسْمَاعِيلُ بْنُ عُلَيَّةَ عَنْ أَيُّوبَ قَالَ حَدَّثَنِي عَمْرُو بْنُ شُعَيْبٍ قَالَ حَدَّثَنِي أَبِي عَنْ أَبِيهِ حَتَّى ذَكَرَ عَبْدَ اللهِ بْنَ عَمْرٍو أَخْبَرَنَاهُ أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنا مُحَمَّدُ بْنُ بَكْرٍ ثنا أَبُو دَاوُدَ ثنا زُهَيْرُ بْنُ حَرْبٍ ثنا إِسْمَاعِيلُ فَذَكَرَهُ
[Machine] The Prophet ﷺ forbade me from selling what I do not have, or selling a commodity that I do not possess.
نَهَانِي النَّبِيُّ ﷺ أَنْ أَبِيعَ مَا لَيْسَ عِنْدِي أَوْ أَبِيعَ سِلْعَةً لَيْسَتْ عِنْدِي
"I said: 'O Messenger of Allah, a man is asking me to sell him something that I do not possess; Shall I sell it to him?' He said: 'Do not sell what is not with you."' (Using translation from Ibn Mājah 2187)
قُلْتُ يَا رَسُولَ اللهِ الرَّجُلُ يَطْلُبُ مِنِّي الْبَيْعَ وَلَيْسَ عِنْدِي أَفَأَبِيعُهُ لَهُ؟ فَقَالَ رَسُولُ اللهِ ﷺ لَا تَبِعْ مَا لَيْسَ عِنْدَكَ
13.6 [Machine] Who said it is permissible to sell the absent eye?
١٣۔٦ بَابُ مَنْ قَالَ يَجُوزُ بَيْعُ الْعَيْنِ الْغَائِبَةِ
[Machine] The Prophet, ﷺ , wished that Uthman and Abdur Rahman bin Awf would enter into a business transaction so that we could see which of them is greater in trade. So Abdur Rahman bought a horse from Uthman for another piece of land for forty thousand dirhams or something similar, if the deal was completed and it was sound. Then he hesitated a little and returned, saying, "I will give you an additional six thousand dirhams if my messenger finds it safe." Uthman agreed and his messenger found it safe. Then Abdur Rahman found out that the horse had died, so he returned it according to the other condition that was added, and it was narrated by anyone else, and he added to it, "And Abdur Rahman will not enter into something unless he has knowledge of it."
النَّبِيِّ ﷺ وَدِدْنَا أَنَّ عُثْمَانَ وَعَبْدَ الرَّحْمَنِ بْنَ عَوْفٍ قَدْ تَبَايَعَا حَتَّى نَنْظُرَ أَيُّهُمَا أَعْظَمُ جِدًّا فِي التِّجَارَةِ فَاشْتَرَى عَبْدُ الرَّحْمَنِ مِنْ عُثْمَانَ ؓ فَرَسًا بِأَرْضٍ أُخْرَى بِأَرْبَعِينَ أَلْفَ دِرْهَمٍ أَوْ نَحْوِ ذَلِكَ إِنْ أَدْرَكَتْهَا الصَّفْقَةُ وَهِيَ سَالِمَةٌ ثُمَّ أَجَازَ قَلِيلًا فَرَجَعَ فَقَالَ أَزِيدُكَ سِتَّةَ آلَافِ دِرْهَمٍ إنْ وَجَدَهَا رَسُولِي سَالِمَةً فَقَالَ نَعَمْ فَوَجَدَهَا رَسُولُ عَبْدِ الرَّحْمَنِ قَدْ هَلَكَتْ فَخَرَجَ مِنْهَا بِشَرْطِهِ الْآخَرِ وَرَوَاهُ غَيْرُهُ وَزَادَ فِيهِ وَلَا أَخَالُ عَبْدَ الرَّحْمَنِ إِلَّا وَقَدْ عَرَفَهَا
[Machine] "This hadith is narrated from the Prophet ﷺ , and it is not valid."
عَنِ النَّبِيِّ ﷺ وَلَا يَصِحُّ
[Machine] Narrated by Makhol, he raised the speech to the Prophet ﷺ and said: "Whoever buys something without seeing it, he is free to take it if he likes it, and he is also free to leave it if he dislikes it." This hadith is weak and Abu Bakr ibn Abi Maryam narrated it to me. Abu Bakr ibn Al-Harith and others also narrated it from Ali ibn Umar, the father of Al-Hassan, Daraqutni, the Hafiz, may Allah have mercy on him. It was also narrated from another source that the Prophet ﷺ said this, but it is not considered authentic.
عَنْ مَكْحُولٍ رَفَعَ الْحَدِيثَ إِلَى النَّبِيِّ ﷺ قَالَ مَنِ اشْتَرَى شَيْئًا لَمْ يَرَهُ فَهُوَ بِالْخِيَارِ إِذَا رَآهُ إِنْ شَاءَ أَخَذَهُ وَإِنْ شَاءَ تَرَكَهُ هَذَا مُرْسَلٌ وَأَبُو بَكْرِ بْنُ أَبِي مَرْيَمَ ضَعِيفٌ قَالَهُ لِي أَبُو بَكْرِ بْنُ الْحَارِثِ وَغَيْرُهُ عَنْ عَلِيِّ بْنِ عُمَرَ أَبِي الْحَسَنِ الدَّارَقُطْنِيِّ الْحَافِظِ رَحِمَهُ اللهُ وَرُوِيَ مِنْ وَجْهٍ آخَرَ عَنِ النَّبِيِّ ﷺ وَلَا يَصِحُّ
[Machine] The Messenger of Allah ﷺ said, "Whoever buys something without seeing it, then he has the option to return it if he sees it is not satisfactory."
قَالَ رَسُولُ اللهِ ﷺ مَنِ اشْتَرَى شَيْئًا لَمْ يَرَهُ فَهُوَ بِالْخِيَارِ إِذَا رَآهُ وَكَذَلِكَ
[Machine] I heard Al-Hassan say, "Whoever buys something without seeing it, then he is at a great risk if he sees it."
سَمِعْتُ الْحَسَنَ يَقُولُ مَنِ اشْتَرَى شَيْئًا لَمْ يَرَهُ فَهُوَ بِالْخِيَارِ إِذَا رَآهُ
[Machine] He used to say, "If he adheres to what was described to him, then he will follow it."
أَنَّهُ كَانَ يَقُولُ إِنْ كَانَ عَلَى مَا وَصَفَهُ لَهُ فَقَدْ لَزِمَهُ
13.7 [Machine] The buyers of options have not concluded a deal except for the sale of the option.
١٣۔٧ بَابٌ: الْمُتَبَايِعَانِ بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا إِلَّا بَيْعَ الْخِيَارِ
[Machine] "That the Messenger of Allah ﷺ said: The two parties in a transaction have the right to continue their transaction (and take possession of the item) as long as they have not separated, except when there is an option to choose (to cancel the transaction). And in another narration from Ash-Shafi'i: The right to choose lies with the owner."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ الْمُتَبَايِعَانِ كُلُّ وَاحِدٍ مِنْهُمَا بِالْخِيَارِ عَلَى صَاحِبِهِ مَا لَمْ يَتَفَرَّقَا إِلَّا بَيْعَ الْخِيَارِ وَفِي رِوَايَةِ الشَّافِعِيِّ عَلَى صَاحِبِهِ بِالْخِيَارِ
[Machine] I came to Nafi' and he threw a bag to me, so I sat on it and he dictated to me on the tablets. He said, "I heard Abdullah bin Umar saying, 'The Messenger of Allah ﷺ said: When the two parties to a transaction have concluded the sale, then each one of them has the option to cancel the sale, as long as they have not separated or the sale has not been concluded with an option.' He said, 'So whenever Ibn Umar concluded a transaction, and wanted to take back what he had sold, he would walk a little, then he would go back.'"
أَتَيْتُ نَافِعًا فَطَرَحَ إِلِيَّ حَقِيبَةً فَجَلَسْتُ عَلَيْهَا فَأَمْلَى عَلَيَّ فِي أَلْوَاحِي قَالَ سَمِعْتُ عَبْدَ اللهِ بْنَ عُمَرَ يَقُولُ قَالَ رَسُولُ اللهِ ﷺ إِذَا تَبَايَعَ الْمُتَبَايِعَانِ فَكُلُّ وَاحِدٍ مِنْهُمَا بِالْخِيَارِ مِنْ بَيْعِهِ مَا لَمْ يَتَفَرَّقَا أَوْ يَكُونُ بَيْعُهُمَا عَنْ خِيَارٍ قَالَ فَكَانَ ابْنُ عُمَرَ إِذَا تَبَايَعَ الْبَيْعَ فَأَرَادَ أَنْ يَجُبَّ مَشَى قَلِيلًا ثُمَّ رَجَعَ
[Machine] "From the Messenger of Allah, ﷺ , he said: 'Verily, the buyers have the option in their transaction as long as they have not separated, except if the sale is an option.' Nafi' said: 'And Abdullah, when he bought something that pleased him, would separate from its owner.'"
عَنْ رَسُولِ اللهِ ﷺ قَالَ إِنَّ الْمُتَبَايِعَيْنِ بِالْخِيَارِ فِي بَيْعِهِمَا مَا لَمْ يَتَفَرَّقَا إِلَّا أَنْ يَكُونَ الْبَيْعُ خِيَارًا قَالَ فَقَالَ نَافِعٌ وَكَانَ عَبْدُ اللهِ إِذَا اشْتَرَى الشَّيْءَ يُعْجِبُهُ فَارَقَ صَاحِبَهُ
Messenger of Allah ﷺ said, "Both the buyer and the seller have the option of canceling or confirming the bargain, as long as they are still together; and unless they separate or one of them gives the other the option of keeping or returning the things and a decision is concluded then, in which case the bargain is considered final. If they separate after the bargain and none of them has rejected it, then the bargain is rendered final." (Using translation from Bukhārī 2112)
عَنْ رَسُولِ اللهِ ﷺ قَالَ إِذَا تَبَايَعَ الرَّجُلَانِ فَكُلُّ وَاحِدٍ مِنْهُمَا بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا وَكَانَا جَمِيعًا أَوْ يُخَيِّرُ أَحَدُهُمَا صَاحِبَهُ فَتَبَايَعَا عَلَى ذَلِكَ فَقَدْ وَجَبَ الْبَيْعُ وَإِنْ تَفَرَّقَا بَعْدَ أَنْ يَتَبَايَعَا وَلَمْ يَتْرُكْ وَاحِدٌ مِنْهُمَا الْبَيْعَ فَقَدْ وَجَبَ الْبَيْعُ
[Machine] Abu Amr Al-Adibi informed us, "I am Abu Bakr Al-Ismaeeli, I am Jafar Al-Farayabi," who narrated to us Muhammad ibn Ubaid ibn Hisab and Abu Kamil H, and Abu Al-Hasan Ali ibn Muhammad ibn Ali Al-Muqri informed us, "I am Hasan ibn Muhammad ibn Ishaq," who narrated to us Yusuf ibn Ya'qub Al-Qadi, who narrated to us Abu Al-Rabi', who said, "I am Hammad ibn Zaid," who narrated from Ayoub, from Nafi', from Ibn Umar, who attributed it to the Prophet ﷺ, who said, "Both the buyer and the seller have the option (to cancel) as long as they do not separate, or one of them says to the other, 'Choose.' And perhaps he said, 'Or it could be the wording of the narration of the Muqri'. And in another narration of the Adibi, it is mentioned that the Messenger of Allah ﷺ said, 'Both the buyer and the seller have the option (to cancel) as long as they do not separate, except if it is the sale of Khair (something good), or one of them says to the other, 'Choose.'"
أَخْبَرَنَا أَبُو عَمْرٍو الْأَدِيبُ أنا أَبُو بَكْرٍ الْإِسْمَاعِيلِيُّ أنا جَعْفَرٌ الْفَارَيَابِيُّ ثنا مُحَمَّدُ بْنُ عُبَيْدِ بْنِ حِسَابٍ وَأَبُو كَامِلٍ ح وَأَخْبَرَنَا أَبُو الْحَسَنِ عَلِيُّ بْنُ مُحَمَّدِ بْنِ عَلِيٍّ الْمُقْرِئُ أنا الْحَسَنُ بْنُ مُحَمَّدِ بْنِ إِسْحَاقَ ثنا يُوسُفُ بْنُ يَعْقُوبَ الْقَاضِي ثنا أَبُو الرَّبِيعِ قَالَوا أنا حَمَّادُ بْنُ زَيْدٍ ثنا أَيُّوبُ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ يَرْفَعُهُ إِلَى النَّبِيِّ ﷺ قَالَ الْبَيِّعَانِ بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا أَوْ يَقُولُ أَحَدُهُمَا لِصَاحِبِهِ اخْتَرْ قَالَ وَرُبَّمَا قَالَ أَوْ يَكُونُ خِيَارٌ لَفْظُ حَدِيثِ الْمُقْرِئِ وَفِي رِوَايَةِ الْأَدِيبِ أَنَّ رَسُولَ اللهِ ﷺ قَالَ الْبَيِّعَانِ بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا إِلَّا أَنْ يَكُونَ بَيْعَ خِيَارٍ أَوْ يَقُولَ لِصَاحِبِهِ اخْتَرْ
[Machine] The Messenger of Allah ﷺ said: "Every transaction is null and void until the two parties separate, except in the case of exchanging the best of goods."
قَالَ رَسُولُ اللهِ ﷺ كُلُّ بَيِّعَيْنِ لَا بَيْعَ بَيْنَهُمَا حَتَّى يَتَفَرَّقَا إِلَّا بَيْعَ الْخِيَارِ
[Machine] The Messenger of Allah ﷺ said, "The two parties involved in a trade of good things are allowed to continue as long as they have not separated. If they both are honest and clear, their sale will be blessed. But if they lie and conceal, the blessing of their sale will be destroyed."
قَالَ رَسُولُ اللهِ ﷺ الْبَائِعَانِ بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا فَإِنْ صَدَقَا وَبَيَّنَا بُورِكَ لَهُمَا فِي بَيْعِهِمَا وَإِنْ كَذَبَا وَكَتَمَا مُحِقَتْ بَرَكَةُ بَيْعِهِمَا
[Machine] The Messenger of Allah ﷺ said, "The two parties involved in a business transaction have the right to rescind it as long as they have not separated. Hamam said, "I found in my book that the Prophet ﷺ emphasized this three times. If they are truthful and clear in their dealings, they will be blessed in their transaction. But if they lie and conceal, they may gain some profit, but the blessing of their transaction will be destroyed." Hamam said, "I narrated this hadith to Abu Al-Tayyah, who then said, 'I was with Abu Al-Khalil and Abdullah bin Al-Harith narrated this hadith to us. Al-Harith is the narrator.'"
أَنَّ رَسُولَ اللهِ ﷺ قَالَ الْبَيِّعَانِ بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا قَالَ هَمَّامٌ وَوَجَدْتُ فِي كِتَابِي وَيَخْتَارُ ثَلَاثَ مَرَّاتٍ فَإِنْ صَدَقَا وَبَيَّنَا بُورِكَ لَهُمَا فِي بَيْعِهِمَا وَإِنْ كَذَبَا وَكَتَمَا فَعَسَى أَنْ يَرْبَحَا رِبْحًا وَتُمْحَقَ بَرَكَةُ بَيْعِهِمَا قَالَ هَمَّامٌ فَحَدَّثْتُ بِهَذَا الْحَدِيثِ أَبَا التَّيَّاحِ فَقَالَ كُنْتُ مَعَ أَبِي الْخَلِيلِ فَحَدَّثَنَا عَبْدُ اللهِ بْنُ الْحَارِثِ هَذَا الْحَارِثُ
We fought one of our battle, and encamped at a certain place. One of our companions sold a horse for a slave. After that they remained there for the rest of day and night. When the next morning came, they prepared themselves for departure. The buyer of the horse began to saddle it, but the seller was ashamed (of the transaction). He went to the man (buyer) and asked him to annul the transaction. The man refused to hand it over (the horse) to him. He said: AbuBarzah, the companion of the Prophet ﷺ, is to decide between me and you. They went to AbuBarzah in the corner of the army. They related this story to him. He said: Do you agree that I make a decision between you on the basis of the decision of the Messenger of Allah ﷺ? The Messenger of Allah ﷺ said: Both parties in a business transaction have an option (right) to annul it so long as they have not separated. Hisham to Hassan said that Jamil said in his version: "I do not think that you separated." (Using translation from Abū Dāʾūd 3457)
غَزَوْنَا غَزْوَةً لَنَا فَنَزَلْنَا مَنْزِلًا فَبَاعَ صَاحِبٌ لَنَا فَرَسًا بِغُلَامٍ ثُمَّ أَقَامَا بَقِيَّةَ يَوْمِهِمَا وَلَيْلَتِهِمَا فَلَمَّا أَصْبَحْنَا مِنَ الْغَدِ حَضَرَ الرَّجُلُ فَقَامَ إِلَى فَرَسِهِ يُسْرِجُهُ وَنَدِمَ فَأَتَى الرَّجُلَ وَأَخَذَهُ بِالْبَيْعِ فَأَبَى الرَّجُلُ أَنْ يَدْفَعَهُ إِلَيْهِ فَقَالَ بَيْنِي وَبَيْنَكَ أَبُو بَرْزَةَ صَاحِبُ رَسُولِ اللهِ ﷺ فَأَتَيَا أَبَا بَرْزَةَ فِي نَاحِيَةِ الْعَسْكَرِ فَقَالُوا لَهُ هَذِهِ الْقِصَّةِ فَقَالَ أَتَرْضَيَانِ أَنْ أَقْضِيَ بَيْنَكُمَا بِقَضَاءِ رَسُولِ اللهِ ﷺ؟ قَالَ رَسُولُ اللهِ ﷺ الْبَيِّعَانِ بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا قَالَ هِشَامُ بْنُ حَسَّانَ حَدَّثَ جَمِيلٌ أَنَّهُ قَالَ مَا أُرَاكُمَا افْتَرَقْتُمَا
”The two parties to a transaction have the choice (of annulling it) so long as they have not yet parted." (Using translation from Ibn Mājah 2182)
قَالَ رَسُولُ اللهِ ﷺ الْبَيِّعَانِ بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا
[Machine] On the authority of the Messenger of Allah ﷺ: Whoever buys a sale, it becomes obligatory upon him and it is in his choice as long as the seller does not separate from it. If he chooses, then he can take it, but if the seller separates from it, then he has no choice.
عَنْ رَسُولِ اللهِ ﷺ مَنِ اشْتَرَى بَيْعًا فَوَجَبَ لَهُ فَهُوَ بِالْخِيَارِ مَا لَمْ يُفَارِقْهُ صَاحِبُهُ إِنْ شَاءَ أَخَذَهُ فَإِنْ فَارَقَهُ فَلَا خِيَارَ لَهُ
[Machine] That the Prophet ﷺ pledged allegiance to a man. And when he pledged allegiance to him, he said, "Choose." Then the Messenger of Allah ﷺ said, "This is how the sale is done."
أَنَّ النَّبِيَّ ﷺ بَايَعَ رَجُلًا فَلَمَّا بَايَعَهُ قَالَ اخْتَرْ ثُمَّ قَالَ رَسُولُ اللهِ ﷺ هَكَذَا الْبَيْعُ
[Machine] He said that the Prophet ﷺ bought from an Arab. The narrator thought that Abu Zubair said it was from the Banu 'Amir bin Sa'sa'ah, carrying barley. When it was weighed, the Prophet ﷺ told him to choose. The Arab said to him, "If I have ever seen a better and more knowledgeable buyer than you today, then it is from the Quraysh." And that is how it was.
أَنَّهُ قَالَ اشْتَرَى النَّبِيُّ ﷺ مِنْ أَعْرَابِيٍّ قَالَ حَسِبْتُ أَنَّ أَبَا الزُّبَيْرِ قَالَ مِنْ بَنِي عَامِرِ بْنِ صَعْصَعَةَ حِمْلَ خَبَطٍ فَلَمَّا وَجَبَ قَالَ لَهُ النَّبِيُّ ﷺ اخْتَرْ فَقَالَ لَهُ الْأَعْرَابِيُّ إِنْ رَأَيْتُ كَالْيَوْمِ قَطُّ بَيْعًا خَيْرًا وَأَفْقَهَ مِمَّنْ أَنْتَ؟ قَالَ مِنْ قُرَيْشٍ وَكَذَلِكَ
[Machine] The Prophet (PBUH) bought a camel from a Bedouin which had a defect. When it was time for the sale, the Prophet (PBUH) told him to choose. The Bedouin said to him, "May Allah bless your sale, and likewise."
أَنَّ النَّبِيَّ ﷺ اشْتَرَى مِنْ أَعْرَابِيٍّ حِمْلَ خَبَطٍ فَلَمَّا وَجَبَ الْبَيْعُ قَالَ لَهُ النَّبِيُّ ﷺ اخْتَرْ فَقَالَ لَهُ الْأَعْرَابِيُّ عَمْرَكَ اللهَ بَيِّعًا وَكَذَلِكَ
[Machine] The Messenger of Allah ﷺ chose a man after the sale. The man said to him, "May Allah lengthen your life, who are you?" The Messenger of Allah ﷺ replied, "I am a man from the Quraysh." The man said, "So, my father used to swear that the choice only comes after the sale."
خَيَّرَ رَسُولُ اللهِ ﷺ رَجُلًا بَعْدَ الْبَيْعِ فَقَالَ لَهُ الرَّجُلُ عَمْرَكَ اللهَ مِمَّنْ أَنْتَ؟ فَقَالَ رَسُولُ اللهِ ﷺ امْرُؤٌ مِنْ قُرَيْشٍ قَالَ فَكَانَ أَبِي يَحْلِفُ مَا الْخِيَارُ إِلَّا بَعْدَ الْبَيْعِ
[Machine] Before prophethood, the Prophet ﷺ bought a camel or something similar from an Arab man. When it was time to make the payment, the Prophet ﷺ told him to choose. The Arab man looked at him and asked, "May Allah bless you, who are you?" The Prophet ﷺ said, "When Islam came, the Prophet ﷺ made it a practice to choose after the sale."
ابْتَاعَ النَّبِيُّ ﷺ قَبْلَ النُّبُوَّةِ مِنْ أَعْرَابِيٍّ بَعِيرًا أَوْ غَيْرَ ذَلِكَ فَلَمَّا وَجَبَ الْبَيْعُ قَالَ لَهُ النَّبِيُّ ﷺ اخْتَرْ فَنَظَرَ إِلَيْهِ الْأَعْرَابِيُّ فَقَالَ عَمْرَكَ اللهَ مَنْ أَنْتَ؟ قَالَ فَلَمَّا كَانَ الْإِسْلَامُ جَعَلَ النَّبِيُّ ﷺ الْخِيَارَ بَعْدَ الْبَيْعِ
[Machine] The Messenger of Allah ﷺ said, "Two should not separate except by mutual consent."
قَالَ رَسُولُ اللهِ ﷺ لَا يَفْتَرِقَنَّ اثْنَانِ إِلَّا عَنْ تَرَاضٍ
[Machine] Anas saw the Messenger of Allah ﷺ passing by the people of al-Baqi' and he said, "O people of al-Baqi', be patient." He then said, "O people of al-Baqi', they will never be separated except by the will of pleasure."
أَنَسٌ مَرَّ رَسُولُ اللهِ ﷺ عَلَى أَهْلِ الْبَقِيعِ فَقَالَ يَا أَهْلَ الْبَقِيعِ فَاشْرَأَبُّوا فَقَالَ يَا أَهْلَ الْبَقِيعِ لَا يَفْتَرِقَنَّ بَيِّعَانِ إِلَّا عَنْ رِضًا
[Machine] The Messenger of Allah ﷺ said: "The two parties of a transaction have the option to renege on it until they separate, and each party takes what satisfies them from the transaction."
قَالَ رَسُولُ اللهِ ﷺ الْبَيِّعَانِ بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا وَيَأْخُذْ كُلُّ وَاحِدٍ مِنْهُمَا مَا رَضِيَ مِنَ الْبَيْعِ
[Machine] I heard the Messenger of Allah ﷺ say: "Whoever buys something from someone, then each of them has the option until they separate from each other, except in the case of a valid contract. It is not lawful for anyone to leave his companion out of fear that his statement may invalidate the contract. In this regard, Uthman bin Affan, Abdullah bin Umar, Jarir bin Abdullah, Shuraih, Sa'id bin Al-Musayyib, and Ata bin Abi Rabah have narrated to us."
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ أَيُّمَا رَجُلٍ ابْتَاعَ مِنْ رَجُلٍ بَيْعَةً فَإِنَّ كُلَّ وَاحِدٍ مِنْهُمَا بِالْخِيَارِ حَتَّى يَتَفَرَّقَا مِنْ مَكَانِهِمَا إِلَّا أَنْ يَكُونَ صَفْقَةَ خِيَارٍ وَلَا يَحِلُّ لِأَحَدٍ أَنْ يُفَارِقَ صَاحِبَهُ مَخَافَةَ أَنْ يُقِيلَهُ قَوْلُهُ يُقِيلَهُ أَرَادَ بِهِ وَاللهُ أَعْلَمُ يَفْسَخُهُ فَعَبَّرَ بِالْإِقَالَةِ عَنِ الْفَسْخِ وَرُوِّينَا فِي ذَلِكَ عَنْ عُثْمَانَ بْنِ عَفَّانَ وَعَبْدِ اللهِ بْنِ عُمَرَ وَجَرِيرِ بْنِ عَبْدِ اللهِ ثُمَّ عَنْ شُرَيْحٍ وَسَعِيدِ بْنِ الْمُسَيِّبِ وَعَطَاءِ بْنِ أَبِي رَبَاحٍ
