١٣۔ كِتَابُ الْبُيُوعِ ص ٤
[Machine] The Prophet ﷺ was asked about eating dried dates. He said, "What is the benefit in eating them when they are dry?" They responded, "Indeed, there is no benefit." So he prohibited it. This narration was reported to us by Sufyan ibn 'Uyaynah, from Isma'il ibn Umayyah, in a similar wording from Al-Thawri.
سُئِلَ النَّبِيُّ ﷺ عَنِ الرُّطَبِ بِالتَّمْرِ قَالَ أَيَنْقُصُ إِذَا يَبِسَ؟ قَالُوا نَعَمْ فَنَهَى عَنْهُ وَرُوِّينَاهُ عَنْ سُفْيَانَ بْنِ عُيَيْنَةَ عَنْ إِسْمَاعِيلَ بْنِ أُمَيَّةَ بِنَحْوٍ مِنْ رِوَايَةِ الثَّوْرِيِّ
[Machine] He informed him that he heard Saad bin Abi Waqqas saying that the Messenger of Allah ﷺ prohibited selling fresh dates with dried dates. And Abu Al-Hassan bin Abdan narrated to us that Ahmad bin Ubayd informed us that Hisham bin Ali narrated to him from Abdullah bin Raja'a, from Harb, from Yahya, from Abdullah bin Yazid, he mentioned it in a similar way. Abu Abdur Rahman Al-Salmi and Abu Bakr bin Al-Harith Al-Faqeeh narrated to us that Abu Al-Hassan Al-Daraqutni Al-Hafiz said: Malik, Ismail bin Umayyah, Dahhak bin Uthman, and Usama bin Zaid differed with him, and they narrated it from Abdullah bin Yazid without mentioning any disapproval. And the agreement of these four on the contrary of what... [rest is missing].
أَخْبَرَهُ أَنَّهُ سَمِعَ سَعْدَ بْنَ أَبِي وَقَّاصٍ يَقُولُ نَهَى رَسُولُ اللهِ ﷺ عَنْ بَيْعِ الرُّطَبِ بِالتَّمْرِ نَسِيئَةً 10561 وَأَخْبَرَنَا أَبُو الْحَسَنِ بْنُ عَبْدَانَ أنا أَحْمَدُ بْنُ عُبَيْدٍ ثنا هِشَامُ بْنُ عَلِيٍّ ثنا عَبْدُ اللهِ بْنُ رَجَاءٍ ثنا حَرْبٌ عَنْ يَحْيَى ثنا عَبْدُ اللهِ بْنُ يَزِيدَ فَذَكَرَهُ بِنَحْوِهِ 10562 أَخْبَرَنَا أَبُو عَبْدِ الرَّحْمَنِ السُّلَمِيُّ وَأَبُو بَكْرِ بْنُ الْحَارِثِ الْفَقِيهُ قَالَا ثنا أَبُو الْحَسَنِ الدَّارَقُطْنِيُّ الْحَافِظُ قَالَ خَالَفَهُ مَالِكٌ وَإِسْمَاعِيلُ بْنُ أُمَيَّةَ وَالضَّحَّاكُ بْنُ عُثْمَانَ وَأُسَامَةُ بْنُ زَيْدٍ رَوَوْهُ عَنْ عَبْدِ اللهِ بْنِ يَزِيدَ وَلَمْ يَقُولُوا فِيهِ نَسِيئَةً وَاجْتِمَاعُ هَؤُلَاءِ الْأَرْبَعَةِ عَلَى خِلَافِ مَا
[Machine] And Saad said: The Messenger of Allah ﷺ was asked about buying ripe dates with dried dates, so he said: "Is there a difference between them? They said: Yes, the ripe dates are reduced." So the Messenger of Allah ﷺ said: "Then it is not good."
وَقَالَ سَعْدٌ سُئِلَ رَسُولُ اللهِ ﷺ عَنِ اشْتِرَاءِ الرُّطَبِ بِالتَّمْرِ فَقَالَ رَسُولُ اللهِ ﷺ أَبَيْنَهُمَا فَضْلٌ؟ قَالُوا نَعَمِ الرُّطَبُ يَنْقُصُ فَقَالَ رَسُولُ اللهِ ﷺ فَلَا يَصْلُحُ
[Machine] The Messenger of Allah ﷺ was asked about fresh dates. He said, "Does the freshness of dates decrease when they become dry?" They said, "Yes." He said, "Dry dates should not be sold as fresh, and this statement is a good and valid witness to what has been mentioned."
أَنَّ رَسُولَ اللهِ ﷺ سُئِلَ عَنْ رُطَبٍ بِتَمْرٍ فَقَالَ أَيَنْقُصُ الرُّطَبُ إِذَا يَبِسَ؟ قَالُوا نَعَمْ فَقَالَ لَا يُبَاعُ رُطَبٌ بِيَابِسٍ وَهَذَا مُرْسَلٌ جَيِّدٌ شَاهِدٌ لِمَا تَقَدَّمَ
[Machine] "On the authority of the Messenger of Allah ﷺ, he said: Do not sell fruits until their goodness appears, and do not sell fruits with dates."
عَنْ رَسُولِ اللهِ ﷺ أَنَّهُ قَالَ لَا تَبِيعُوا الثَّمَرَ حَتَّى يَبْدُوَ صَلَاحُهُ وَلَا تَبِيعُوا الثَّمَرَ بِالتَّمْرِ
[Machine] The Prophet ﷺ said, "Do not buy fruits with dates, or dates with dates. And do not sell fruits until their goodness becomes apparent."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا تَبَايَعُوا الثَّمَرَةَ بِالتَّمْرِ ثَمَرَ النَّخْلِ بِثَمَرِ النَّخْلِ وَلَا تَبَايَعُوا الثَّمَرَ حَتَّى يَبْدُوَ صَلَاحُهُ
13.33 [Machine] Allah has permitted trading and prohibited usury
١٣۔٣٣ بَابٌ: أَحَلَّ اللهُ الْبَيْعَ وَحَرَّمَ الرِّبَا
[Machine] The Messenger of Allah ﷺ was brought some dates, and he asked, "Where did these dates come from?" A man replied, "O Messenger of Allah, we acquired these dates by exchanging two measures of ours for one measure of these." Then the Messenger of Allah ﷺ said, "This is usury, so return it and sell our dates, and then buy some for us with the money." Abu Abdullah Al-Hafiz informed us that he is Abu Abdullah Muhammad ibn Ya'qub, and he told us that Abu Jafar Ahmad ibn Abi Khalid Al-Asbahani narrated to us, and he told us that Salamah ibn Shabib narrated to us, and he told us that Al-Hasan ibn Muhammad ibn A'yan narrated to us, and he told us that Maqil ibn Ubaydullah mentioned it in a similar way.
أُتِيَ رَسُولُ اللهِ ﷺ بِتَمْرٍ فَقَالَ مَا هَذَا مِنْ تَمْرِنَا فَقَالَ رَجُلٌ يَا رَسُولَ اللهِ بِعْنَا تَمْرَنَا صَاعَيْنِ بِصَاعٍ مِنْ هَذَا فَقَالَ رَسُولُ اللهِ ﷺ ذَلِكَ الرِّبَا رُدُّوهُ ثُمَّ بِيعُوا تَمْرَنَا ثُمَّ اشْتَرُوا لَنَا مِنْ هَذَا 10568 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنا أَبُو عَبْدِ اللهِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا أَبُو جَعْفَرٍ أَحْمَدُ بْنُ أَبِي خَالِدٍ الْأَصْبَهَانِيُّ ثنا سَلَمَةُ بْنُ شَبِيبٍ ثنا الْحَسَنُ بْنُ مُحَمَّدِ بْنِ أَعْيَنَ ثنا مَعْقِلُ بْنُ عُبَيْدِ اللهِ فَذَكَرَهُ بِنَحْوِهِ
13.34 [Machine] Sale of meat from live animals
١٣۔٣٤ بَابُ بَيْعِ اللَّحْمِ بِالْحَيَوَانِ
[Machine] "That the Prophet ﷺ forbade selling sheep by its meat. This is a sahih (authentic) narration, and whoever establishes that Al-Hasan Al-Basri heard it from Samurah ibn Jundub, then it is connected and whoever does not establish it, then it is a good marfu (elevated) narration, attributed to Sa'id ibn Al-Musayyib, Qasim ibn Abi Bazza, and the statement of Abu Bakr As-Siddiq."
أَنَّ النَّبِيَّ ﷺ نَهَى أَنْ تُبَاعَ الشَّاةُ بِاللَّحْمِ هَذَا إِسْنَادٌ صَحِيحٌ وَمَنْ أَثْبَتَ سَمَاعَ الْحَسَنِ الْبَصْرِيِّ مِنْ سَمُرَةَ بْنِ جُنْدُبٍ عَدَّهُ مَوْصُولًا وَمَنْ لَمْ يُثْبِتْهُ فَهُوَ مُرْسَلٌ جَيِّدٌ يُضَمُّ إِلَى مُرْسَلِ سَعِيدِ بْنِ الْمُسَيِّبِ وَالْقَاسِمِ بْنِ أَبِي بَزَّةَ وَقَوْلِ أَبِي بَكْرٍ الصِّدِّيقِ ؓ
[Machine] "That the Prophet ﷺ prohibited selling meat from a living animal, this is the correct narration and it was reported by Yazid ibn Marwan al-Khallal from Malik from Az-Zuhri from Sahl ibn Sa'd from the Prophet ﷺ, and there is an error in it."
أَنَّ النَّبِيَّ ﷺ نَهَى عَنْ بَيْعِ اللَّحْمِ بِالْحَيَوَانِ هَذَا هُوَ الصَّحِيحُ وَرَوَاهُ يَزِيدُ بْنُ مَرْوَانَ الْخَلَّالُ عَنْ مَالِكٍ عَنِ الزُّهْرِيِّ عَنْ سَهْلِ بْنِ سَعْدٍ عَنِ النَّبِيِّ ﷺ وَغَلَطَ فِيهِ
[Machine] The Prophet Muhammed ﷺ forbade selling meat obtained from animals that are still alive.
أَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنْ بَيْعِ اللَّحْمِ بِالْحَيَوَانِ
[Machine] I arrived in the city and found a sheep that had been slaughtered and divided into four parts. Each part had a distinct neck. I wanted to buy one of the parts, so a man from the city told me that the Messenger of Allah ﷺ prohibited selling a living animal for a dead one. I then asked about that man and was informed that he was a good person.
قَدِمْتُ الْمَدِينَةَ فَوَجَدْتُ جَزُورًا قَدْ جُزِرَتْ فَجُزِّئَتْ أَرْبَعَةَ أَجْزَاءٍ كُلُّ جُزْءٍ مِنْهَا بِعَنَاقٍ فَأَرَدْتُ أَنْ أَبْتَاعَ مِنْهَا جُزْءًا فَقَالَ لِي رَجُلٌ مِنْ أَهْلِ الْمَدِينَةِ إنَّ رَسُولَ اللهِ ﷺ نَهَى أَنْ يُبَاعَ حَيٌّ بِمَيِّتٍ قَالَ فَسَأَلْتُ عَنْ ذَلِكَ الرَّجُلِ فَأُخْبِرْتُ عَنْهُ خَيْرًا
أَنَّهُ كَرِهَ بَيْعَ الْحَيَوَانِ بِاللَّحْمِ
[Machine] Abu al-Zinad, and this used to be written in the contracts of workers during the time of Aban ibn Uthman and Hisham ibn Ismail, they prohibited it.
أَبُو الزِّنَادِ وَكَانَ ذَلِكَ يُكْتَبُ فِي عُهُودِ الْعُمَّالِ فِي زَمَانِ أَبَانَ بْنِ عُثْمَانَ وَهِشَامِ بْنِ إِسْمَاعِيلَ يَنْهَوْنَ عَنْهُ
[Machine] He heard Sa'id ibn al-Musayyib saying, "It used to be common among the people of pre-Islamic ignorance to sell meat in exchange for sheep and goats."
أَنَّهُ سَمِعَ سَعِيدَ بْنَ الْمُسَيِّبِ يَقُولُ كَانَ مِنْ مَيْسِرِ أَهْلِ الْجَاهِلِيَّةِ بَيْعُ اللَّحْمِ بِالشَّاةِ وَالشَّاتَيْنِ
13.35 [Machine] The fruit of the wall is sold its origin.
١٣۔٣٥ بَابُ ثَمَرِ الْحَائِطِ يُبَاعُ أَصْلُهُ
[Machine] He said, "I heard the Messenger of Allah ﷺ say, 'Whoever buys a date palm after it is pollinated, its fruit belongs to the one who sold it, unless the buyer stipulates otherwise.'"
أَنَّهُ قَالَ سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَنِ ابْتَاعَ نَخْلًا بَعْدَ أَنْ تُؤَبَّرَ فَثَمَرَتُهَا لِلَّذِي بَاعَهَا إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ
[Machine] "That the Messenger of Allah ﷺ said, 'Whoever sells a palm tree after it has been pollinated, its produce belongs to the seller, unless the buyer stipulates otherwise.'"
أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنْ بَاعَ نَخْلًا بَعْدَ أَنْ تُؤَبَّرَ فَثَمَرُهَا لِلْبَائِعِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ
[Machine] Abu al-Abbas narrated that Rabi' said, Shafi'i said, Malik said: and Abu Abdullah al-Hafiz informed us, narrating from Ali ibn Isa ibn Ibrahim al-Hiriy, who narrated from Muhammad ibn Amr and Ibrahim ibn Ali and Musa ibn Muhammad. They said: Yahya ibn Yahya said: I read from Malik, from Nafi', from Ibn Umar, that the Messenger of Allah ﷺ said: "Whoever sells a palm tree that has already been pollinated, the fruits belong to the seller, unless the buyer stipulates otherwise." In the narration of Shafi'i, it is mentioned "the fruits."
ثنا أَبُو الْعَبَّاسِ أنا الرَّبِيعُ أنا الشَّافِعِيُّ أنا مَالِكٌ ح وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا عَلِيُّ بْنُ عِيسَى بْنِ إِبْرَاهِيمَ الْحِيرِيُّ ثنا مُحَمَّدُ بْنُ عَمْرٍو وَإِبْرَاهِيمُ بْنُ عَلِيٍّ وَمُوسَى بْنُ مُحَمَّدٍ قَالُوا ثنا يَحْيَى بْنُ يَحْيَى قَالَ قَرَأْتُ عَلَى مَالِكٍ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنْ بَاعَ نَخْلًا قَدْ أُبِّرَتْ فَثَمَرَتُهَا لِلْبَائِعِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ وَفِي رِوَايَةِ الشَّافِعِيِّ فَثَمَرُهَا
[Machine] The Prophet ﷺ said, "Whoever takes care of a date palm and then sells its trunk, then the fruit of the date palm belongs to the one who took care of it, unless the buyer stipulates otherwise."
أَنَّ النَّبِيَّ ﷺ قَالَ أَيُّمَا امْرِئٍ أَبَّرَ نَخْلًا ثُمَّ بَاعَ أَصْلَهَا فَلِلَّذِي أَبَّرَ ثَمَرُ النَّخْلِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ
[Machine] From the Prophet ﷺ and the narration of the servant about Umar ibn al-Khattab.
عَنِ النَّبِيِّ ﷺ وَحَدِيثُ الْعَبْدِ عَنْ عُمَرَ بْنِ الْخَطَّابِ ؓ
[Machine] Narrated by Prophet Muhammad ﷺ , "Whichever man sells a palm tree that has been pollinated and its fruits have appeared, the first harvest will belong to its Lord (i.e., the palm tree will belong to the buyer for the subsequent harvests) unless the buyer specifies otherwise." Umar ibn Al-Khattab also ruled, "Whichever man sells a slave who owns wealth, his wealth will belong to his Lord (i.e., the slave's wealth will transfer to the buyer) unless the buyer specifies otherwise." This was also narrated by Salim ibn Abdullah from his father from Prophet Muhammad ﷺ regarding palm trees and slaves, and this is mentioned at its proper place, InshaAllah (if Allah wills).
عَنِ النَّبِيِّ ﷺ أَنَّهُ قَالَ أَيُّمَا رَجُلٍ بَاعَ نَخْلًا قَدْ أُبِّرَتْ فَثَمَرَتُهَا لِرَبِّهَا الْأَوَّلِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ قَالَ وَقَضَى عُمَرُ بْنُ الْخَطَّابِ ؓ أَيُّمَا رَجُلٍ بَاعَ مَمْلُوكًا لَهُ مَالٌ فَمَالُهُ لِرَبِّهِ الْأَوَّلِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ وَرَوَاهُ سَالِمُ بْنُ عَبْدِ اللهِ عَنْ أَبِيهِ عَنِ النَّبِيِّ ﷺ فِي النَّخْلِ وَالْعَبْدِ جَمِيعًا وَذَلِكَ يَرِدُ فِي مَوْضِعِهِ إِنْ شَاءَ اللهُ تَعَالَى
13.36 [Machine] Prohibition of Selling Mucous membranes.
١٣۔٣٦ بَابُ النَّهْيِ عَنْ بَيْعِ الْمُخَاضَرَةِ
[Machine] The Messenger of Allah ﷺ prohibited arguing, arguing back, mockery, Ibn 'Umar bin Yunus added, along with provoking and touching.
نَهَى رَسُولُ اللهِ ﷺ عَنِ الْمُخَاضَرَةِ وَالْمُحَاقَلَةِ وَالْمُزَابَنَةِ زَادَ ابْنُ عُمَرَ بْنِ يُونُسَ وَالْمُنَابَذَةِ وَالْمُلَامَسَةِ
لَا إِلَّا جَزَّةً
13.37 [Machine] The time for selling fruits
١٣۔٣٧ بَابُ الْوَقْتِ الَّذِي يَحِلُّ فِيهِ بَيْعُ الثِّمَارِ
[Machine] The Messenger of Allah ﷺ said, "Do not buy fruits until their goodness appears, and do not trade fruits with dates." Ibn Shihab said, "Sālim narrated to me from his father from the Messenger of Allah ﷺ, something similar to it."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا تَبْتَاعُوا الثَّمَرَ حَتَّى يَبْدُوَ صَلَاحُهُ وَلَا تَبَايَعُوا الثَّمَرَ بِالتَّمْرِ قَالَ ابْنُ شِهَابٍ وَحَدَّثَنِي سَالِمٌ عَنْ أَبِيهِ عَنْ رَسُولِ اللهِ ﷺ مِثْلَهُ
[Machine] The Messenger of Allah, ﷺ , prohibited selling fruits until they are ripe and he forbade selling fruits by dates.
أَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنْ بَيْعِ الثَّمَرِ حَتَّى يَبْدُوَ صَلَاحُهُ وَنَهَى عَنْ بَيْعِ الثَّمَرِ بِالتَّمْرِ
[Machine] That the Messenger of Allah, ﷺ , forbade the selling of fruits until their quality becomes evident. He forbade the seller and the buyer. And in one narration of Al-Shafi'i, he forbade the selling of fruits, and the buyer can replace the seller.
أَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنْ بَيْعِ الثَّمَرِ حَتَّى يَبْدُوَ صَلَاحُهَا نَهَى الْبَائِعَ وَالْمُبْتَاعَ وَفِي رِوَايَةِ الشَّافِعِيِّ عَنْ بَيْعِ الثِّمَارِ وَقَالَ الْمُشْتَرِيَ بَدَلَ الْمُبْتَاعِ
[Machine] The Messenger of Allah ﷺ said, "Do not sell fruit until its goodness becomes apparent and its harm is removed." He said, "Its goodness becomes apparent with its redness and yellowness."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا تَبَايَعُوا الثَّمَرَةَ حَتَّى يَبْدُوَ صَلَاحُهَا وَتَذْهَبَ عَنْهَا الْآفَةُ قَالَ يَبْدُو صَلَاحُهَا حُمْرَتُهُ وَصُفْرَتُهُ
[Machine] The Messenger of Allah ﷺ said, "Do not sell the fruit until its goodness becomes apparent."
قَالَ رَسُولُ اللهِ ﷺ لَا تَبِيعُوا الثَّمَرَ حَتَّى يَبْدُوَ صَلَاحُهُ
[Machine] The Messenger of Allah ﷺ forbade the sale of palm trees until their goodness becomes apparent. Ibn Umar said, "Its goodness is that it can be eaten." 10591 He informed us that Abu Abdullah al-Hafiz informed me that Abu Amr ibn Abi Ja'far narrated to us from Abdullah ibn Muhammad who narrated from Muhammad ibn al-Muthanna who narrated from Muhammad ibn Jafar who narrated from Shu'bah. He mentioned this narration except that he said, "It was asked to Ibn Umar, what is its goodness?" He said, "Its blemishes are removed."
أَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنْ بَيْعِ النَّخْلِ حَتَّى يَبْدُوَ صَلَاحُهُ قَالَ ابْنُ عُمَرَ وَصَلَاحُهُ أَنْ يُؤْكَلَ مِنْهُ 10591 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أَخْبَرَنِي أَبُو عَمْرِو بْنُ أَبِي جَعْفَرٍ ثنا عَبْدُ اللهِ بْنُ مُحَمَّدٍ ثنا مُحَمَّدُ بْنُ الْمُثَنَّى ثنا مُحَمَّدُ بْنُ جَعْفَرٍ ثنا شُعْبَةُ فَذَكَرَهُ إِلَّا أَنَّهُ قَالَ فَقِيلَ لِابْنِ عُمَرَ مَا صَلَاحُهُ؟ قَالَ تَذْهَبُ عَاهَتُهُ
[Machine] The Messenger of Allah ﷺ prohibited the sale of fruits until they are clearly ripened. It was asked, "When is that, O Abu Abdur-Rahman?" He said, "When the Thurya rises."
نَهَى رَسُولُ اللهِ ﷺ عَنْ بَيْعِ الثِّمَارِ حَتَّى تُؤْمَنَ عَلَيْهَا الْعَاهَةُ قِيلَ وَمَتَى ذَلِكَ يَا أَبَا عَبْدِ الرَّحْمَنِ؟ قَالَ إِذَا طَلَعَتِ الثُّرَيَّا
[Machine] The Messenger of Allah ﷺ prohibited the sale of fruits until they ripen. It was asked, "O Messenger of Allah, when do they ripen?" He replied, "Until they turn red." The Messenger of Allah ﷺ also said, "What do you think if Allah prevents the fruit from ripening, how would someone take the property of his brother?"
أَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنْ بَيْعِ الثِّمَارِ حَتَّى تُزْهَى فَقِيلَ يَا رَسُولَ اللهِ وَمَا تُزْهَى؟ قَالَ حَتَّى تَحْمَرَّ وَقَالَ رَسُولُ اللهِ ﷺ أَرَأَيْتَ إِذَا مَنَعَ اللهُ الثَّمَرَةَ فَبِمَ يَأْخُذُ أَحَدُكُمْ مَالَ أَخِيهِ؟
[Machine] The Messenger of Allah ﷺ said: "If Allah does not make it fruitful, then how can any of you rightfully take the wealth of his brother?"
قَالَ رَسُولُ اللهِ ﷺ إِنْ لَمْ يُثْمِرْهَا اللهُ فَبِمَ يَسْتَحِلُّ أَحَدُكُمْ مَالَ أَخِيهِ؟
Anas said, "The Prophet ﷺ forbade the selling of dates till they were almost ripe." We asked Anas, "What does 'almost ripe' mean?" He replied, "They get red and yellow. The Prophet ﷺ added, 'If Allah destroyed the fruits present on the trees, what right would the seller have to take the money of his brother (somebody else)?' " (Using translation from Bukhārī 2208)
نَهَى رَسُولُ اللهِ ﷺ عَنْ بَيْعِ الثَّمَرَةِ ثَمَرَةِ النَّخْلِ حَتَّى تَزْهُوَ قُلْنَا لِأَنَسٍ مَا زَهْوُهُ؟ قَالَ يَحْمَرُّ قَالَ أَرَأَيْتَ إِذَا مَنَعَ اللهُ الثَّمَرَةَ بِمَ تَسْتَحِلُّ مَالَ أَخِيكَ؟
[Machine] The Prophet ﷺ forbade selling palm fruits until they become ripe. I asked Anas, "What does it mean for the fruits to become ripe?" He said, "They turn red and yellow." I said, "What if Allah withholds the fruit, how will your brother earn money?"
أَنَّ النَّبِيَّ ﷺ نَهَى عَنْ بَيْعِ ثَمَرِ النَّخْلِ حَتَّى تَزْهُوَ قُلْتُ لِأَنَسٍ وَمَا زَهْوُهَا؟ قَالَ تَحْمَرُّ وَتَصْفَرُّ قَالَ أَرَأَيْتَ إنْ مَنَعَ اللهُ الثَّمَرَةَ فَبِمَ تَسْتَحِلُّ مَالَ أَخِيكَ؟
[Machine] The Messenger of Allah ﷺ forbade the sale of fruit until it becomes ripe and colored. It was asked, "O Abu Hamzah, what does 'ripe and colored' mean?" He said, "Until it turns red and yellow." It was said, "What if Allah withholds the fruits, what will you do with your brother's money?" He replied, "Likewise."
نَهَى رَسُولُ اللهِ ﷺ عَنْ بَيْعِ الثَّمَرَةِ حَتَّى تَزْهُوَ قِيلَ يَا أَبَا حَمْزَةَ وَمَا زَهْوُهَا؟ قَالَ حَتَّى تَحْمَرَّ وَتَصْفَرَّ قَالَ أَرَأَيْتَ إِنْ حَبَسَ اللهُ الثِّمَارَ فَبِمَ تَسْتَحِلُّ مَالَ أَخِيكَ؟ وَكَذَلِكَ
The Prophet ﷺ forbade the sale of grapes till they became black and the sale of grain till it had become hard. (Using translation from Abū Dāʾūd 3371)
أَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنْ بَيْعِ الثَّمَرَةِ حَتَّى تَزْهُوَ وَعَنْ بَيْعِ الْحَبِّ حَتَّى يَشْتَدَّ وَعَنْ بَيْعِ الْعِنَبِ حَتَّى يَسْوَدَّ
[Machine] "He heard Jabir ibn Abdullah saying that the Messenger of Allah ﷺ forbade the sale of fruits until their goodness becomes apparent."
أَنَّهُ سَمِعَ جَابِرَ بْنَ عَبْدِ اللهِ يَقُولُ نَهَى رَسُولُ اللهِ ﷺ عَنْ بَيْعِ الثَّمَرِ حَتَّى يَبْدُوَ صَلَاحُهُ
The Messenger of Allah ﷺ forbade the sale of fruits until they are ripened (tushqihah). He was asked: What do you mean by their ripening (ishqah)? He replied: They become red or yellow, and they are eaten. (Using translation from Abū Dāʾūd 3370)
سَمِعْتُ جَابِرَ بْنَ عَبْدِ اللهِ يَقُولُ نَهَى رَسُولُ اللهِ ﷺ أَنْ تُبَاعَ الثَّمَرَةُ حَتَّى تُشَقِّحَ قِيلَ وَمَا تُشَقِّحُ؟ قَالَ تَحْمَارُّ أَوْ تَصْفَارُّ وَيُؤْكَلُ مِنْهَا
[Machine] The Messenger of Allah ﷺ forbade hazardous transactions, uncertain exchanges, and undisclosed sales, and prohibited the sale of fruit until they ripen.
نَهَى رَسُولُ اللهِ ﷺ عَنِ الْمُزَابَنَةِ وَالْمُحَاقَلَةِ وَالْمُخَابَرَةِ وَعَنْ بَيْعِ الثَّمَرِ حَتَّى تُشَقِّحَ
[Machine] Narrated from the Messenger of Allah ﷺ that he forbade us from drying dates, buying and selling based on estimation, and from selling palm trees until they produce fruit. He said, "As for drying dates, it is the process of making them turn red or yellow or being eaten from. Selling based on estimation is when a field is sold based on a known specific measure of food." Zaid said, "I asked Ata bin Abi Rabah, 'Did you hear Jabir bin Abdullah mention this from the Messenger of Allah ﷺ ?' He replied, 'Yes.'"
عَنْ رَسُولِ اللهِ ﷺ أَنَّهُ نَهَى عَنِ الْمُحَاقَلَةِ وَالْمُزَابَنَةِ وَالْمُخَابَرَةِ وَعَنْ بَيْعِ النَّخْلِ حَتَّى تُشَقِّحَ قَالَ وَالْإِشْقَاحُ أَنْ يَحْمَرَّ أَوْ يَصْفَرَّ أَوْ يُؤْكَلَ مِنْهُ شَيْءٌ وَالْمُحَاقَلَةُ أَنْ يُبَاعَ الْحَقْلُ بِكَيْلٍ مِنَ الطَّعَامِ مَعْلُومٌ فَقَالَ زَيْدٌ فَقُلْتُ لِعَطَاءِ بْنِ أَبِي رَبَاحٍ أَسَمِعْتَ جَابِرَ بْنَ عَبْدِ اللهِ يَذْكُرُ ذَلِكَ عَنْ رَسُولِ اللهِ ﷺ؟ فَقَالَ نَعَمْ
[Machine] The Messenger of Allah ﷺ prohibited the selling of fruits until they become ripe.
نَهَى رَسُولُ اللهِ ﷺ عَنْ بَيْعِ الثَّمَرَةِ حَتَّى تَطِيبَ
[Machine] The Messenger of Allah ﷺ forbade selling palm trees until they are eaten from and weighed. I asked, "What should be weighed?" One man from the people said, "Until it is estimated." In another narration, Adam said, "And what should be weighed?" A man replied, "Beside it, until it is estimated."
نَهَى رَسُولُ اللهِ ﷺ عَنْ بَيْعِ النَّخْلِ حَتَّى يُؤْكَلَ مِنْهُ وَحَتَّى يُوزَنَ قُلْتُ مَا يُوزَنُ؟ فَقَالَ رَجُلٌ مِنَ الْقَوْمِ حَتَّى يُحْزَرَ وَفِي رِوَايَةِ آدَمَ فَقَالَ رَجُلٌ وَأِيُّ شَيْءٍ يُوزَنُ؟ فَقَالَ رَجُلٌ إِلَى جَنْبِهِ حَتَّى يُحْزَرَ
[Machine] "He informed him that Zaid bin Thabit used to say: During the time of the Messenger of Allah ﷺ , people used to exchange fruits. So when people gathered and their transactions were about to take place, the seller would say, 'This fruit has been affected by the enemy of fruits, it has been affected by spotted marks, it has been affected by mold and defects.' And the mold refers to something that affects it so that it does not ripen. So the Messenger of Allah ﷺ said when disputes increased in this matter: 'As for the one who does not do that, then do not engage in the transaction until the goodness of the fruit becomes apparent as if it is glowing, pointing to it.' Because of their many disputes. Abu Az-Zinad said: Kharijah bin Zaid informed me that Zaid bin Thabit would not sell his fruits until the Thurya (a specific star) appears and the red becomes distinguishable from the yellow."
أَنَّهُ أَخْبَرَهُ أَنَّ زَيْدَ بْنَ ثَابِتٍ كَانَ يَقُولُ كَانَ النَّاسُ فِي عَهْدِ رَسُولِ اللهِ ﷺ يَتَبَايَعُونَ الثِّمَارَ فَإِذَا جَدَّ النَّاسُ وَحَضَرَ تَقَاضِيهِمْ قَالَ الْمُبْتَاعُ إِنَّهُ أَصَابَ الثَّمَرَ الْعَفَنُ الدُّمَانُ أَصَابَهُ مَرَاقٌ أَصَابَهُ قُشَامٌ عَاهَاتٌ يَحْتَجُّونَ بِهَا وَالْقُشَامُ شَيْءٌ يُصِيبُهُ حَتَّى لَا يَرْطَبَ قَالَ فَقَالَ رَسُولُ اللهِ ﷺ لَمَّا كَثُرَتْ عِنْدَهُ الْخُصُومَةُ فِي ذَلِكَ فَأَمَّا لَا فَلَا تَبَايَعُوا حَتَّى يَبْدُوَ صَلَاحُ الثَّمَرِ كَالْمَشُورَةِ يُشِيرُ بِهَا؛ لِكَثْرَةِ خُصُومَتِهِمْ قَالَ وَقَالَ أَبُو الزِّنَادِ وَأَخْبَرَنِي خَارِجَةُ بْنُ زَيْدٍ أَنَّ زَيْدَ بْنَ ثَابِتٍ لَمْ يَكُنْ يَبِيعُ ثِمَارَ أَمْوَالِهِ حَتَّى تَطْلُعَ الثُّرَيَّا فَيَسْتَبِينَ الْأَحْمَرُ مِنَ الْأَصْفَرِ
[Machine] "And we heard Ibn Abbas saying, 'The fruit should not be sold until it is tasted.'"
وَسَمِعْنَا ابْنَ عَبَّاسٍ يَقُولُ لَا يُبَاعُ الثَّمَرُ حَتَّى يُطْعَمَ
[Machine] That his righteousness is apparent and he says there is no master between the servant and his Lord.
أَنْ يَبْدُوَ صَلَاحُهُ وَيَقُولُ لَيْسَ بَيْنَ الْعَبْدِ وَبَيْنَ سَيِّدِهِ رِبًا
13.38 [Machine] The prohibition of selling years, and that which is not created from the second pregnancy does not follow that which was created from the first pregnancy.
١٣۔٣٨ بَابُ النَّهْيِ عَنْ بَيْعِ السِّنِينَ , وَأَنَّ مَا لَمْ يَخْلَقْ مِنَ الْحِمْلِ الثَّانِي لَا يَتْبَعُ مَا خَلَقَ مِنَ الْحِمْلِ الْأَوَّلِ
[Machine] That the Prophet ﷺ prohibited the sale of fruits using credit for a period of time.
أَنَّ النَّبِيَّ ﷺ نَهَى عَنْ بَيْعِ الثَّمَرِ سِنِينَ
"The Messenger of Allah ﷺ forbade Gharar transactions. " (Using translation from Ibn Mājah 2195)
أَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنْ بَيْعِ الْغَرَرِ
13.39 [Machine] What is mentioned in the sale of wheat in its stalks
١٣۔٣٩ بَابُ مَا يُذْكَرُ فِي بَيْعِ الْحِنْطَةِ فِي سُنْبُلِهَا
[Machine] The Messenger of Allah ﷺ prohibited the sale of deceit (cheating) and the sale of pebbles.
أَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنْ بَيْعِ الْغَرَرِ وَعَنْ بَيْعِ الْحَصَى
[Machine] Narrated by the Prophet that he allowed the sale of wheat in its stalks when it turns white, and he said, "As for it, it is a type of gharar (uncertainty)." Because it goes through a transformation that cannot be seen. If this narration from the Prophet is established, then we say it is permissible. This ruling was derived from a specific situation that occurred during a particular year. The Messenger of Allah prohibited selling gharar, but he allowed this.
عَنِ النَّبِيِّ ﷺ أَنَّهُ أَجَازَ بَيْعَ الْقَمْحِ فِي سُنْبُلِهِ إِذَا ابْيَضَّ فَقَالَ أَمَّا هُوَ فَغَرَرٌ؛ لِأَنَّهُ مَحُولٌ دُونَهُ لَا يُرَى فَإِنْ ثَبَتَ الْخَبَرُ عَنِ النَّبِيِّ ﷺ قُلْنَا بِهِ وَكَانَ هَذَا خَاصًّا مُسْتَخْرَجًا مِنْ عَامٍّ؛ لِأَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنْ بَيْعِ الْغَرَرِ وَأَجَازَ هَذَا
[Machine] The Prophet ﷺ forbade selling date palm trees until they bear fruit, and selling wheat until it becomes white and free from defects. He also forbade the seller and the buyer from engaging in dishonesty.
أَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنْ بَيْعِ النَّخْلِ حَتَّى يَزْهُوَ وَعَنْ بَيْعِ السُّنْبُلِ حَتَّى يَبْيَضَّ وَيَأْمَنَ الْعَاهَةَ نَهَى الْبَائِعَ وَالْمُشْتَرِيَ
[Machine] The Prophet ﷺ forbade the selling of grain until it has ripened, and the selling of grapes until they have turned black, and the selling of fruit until it has become ripe. Abu al-Hasan Ali ibn Muhammad al-Muqri informed us. I am al-Hasan ibn Muhammad ibn Ishaq. Yusuf ibn Ya'qub al-Qadi narrated to us. Abu al-Walid al-Tayalisi narrated to us. Hammad ibn Salamah mentioned it, and he mentioned the ripening of grain and the turning black of grapes in this hadith, from what Hammad ibn Salamah had exclusively narrated from Humayd among the companions of Humayd.
نَهَى النَّبِيُّ ﷺ عَنْ بَيْعِ الْحَبِّ حَتَّى يَشْتَدَّ وَعَنْ بَيْعِ الْعِنَبِ حَتَّى يَسْوَدَّ وَعَنْ بَيْعِ الثَّمَرِ حَتَّى يَزْهُوَ أَخْبَرَنَاهُ أَبُو الْحَسَنِ عَلِيُّ بْنُ مُحَمَّدٍ الْمُقْرِئُ أنا الْحَسَنُ بْنُ مُحَمَّدِ بْنِ إِسْحَاقَ ثنا يُوسُفُ بْنُ يَعْقُوبَ الْقَاضِي ثنا أَبُو الْوَلِيدِ الطَّيَالِسِيُّ ثنا حَمَّادُ بْنُ سَلَمَةَ فَذَكَرَهُ وَذِكْرُ الْحَبِّ حَتَّى يَشْتَدَّ وَالْعِنَبِ حَتَّى يَسْوَدَّ فِي هَذَا الْحَدِيثِ مِمَّا تَفَرَّدَ بِهِ حَمَّادُ بْنُ سَلَمَةَ عَنْ حُمَيْدٍ مِنْ بَيْنِ أَصْحَابِ حُمَيْدٍ فَقَدْ
