١٣۔ كِتَابُ الْبُيُوعِ ص ١١
[Machine] "He (the narrator) narrated that he heard the Messenger of Allah ﷺ saying to his companions, 'Do not scare yourselves.' It was said, 'O Messenger of Allah, how do we scare ourselves?' He said, 'By debt.'"
أَنَّهُ سَمِعَ رَسُولَ اللهِ ﷺ يَقُولُ لِأَصْحَابِهِ لَا تُخِيفُوا أَنْفُسَكُمْ فَقِيلَ لَهُ يَا رَسُولَ اللهِ وَبِمَا نُخِيفُ أَنْفُسَنَا؟ قَالَ بِالدَّيْنِ
[Machine] He heard 'Uqbah bin 'Amir saying, "The Messenger of Allah ﷺ said, 'Do not frighten souls after they have been settled in tranquility.'" They asked, "O Messenger of Allah! And what is that?" He said, "Debt." Bakr bin 'Amr informed me from Ja'far bin Rubi'ah that Mu'awiyah bin Abi Sufyan said, "Debt unsettles and causes anxiety." Hawwah also narrated from Bakr bin 'Amr, except that Jafar bin Shurahbil (al-Dain) said, and he was Ja'far bin Rubi'ah bin Shurahbil bin Hasana
أَنَّهُ سَمِعَ عُقْبَةَ بْنَ عَامِرٍ يَقُولُ إِنَّ رَسُولَ اللهِ ﷺ قَالَ لَا تُخِيفُوا الْأَنْفُسَ بَعْدَ أَمْنِهَا قَالُوا يَا رَسُولَ اللهِ وَمَا ذَاكَ؟ قَالَ الدَّيْنُ 10967 قَالَ وَأَخْبَرَنِي بَكْرُ بْنُ عَمْرٍو عَنْ جَعْفَرِ بْنِ رَبِيعَةَ أَنَّ مُعَاوِيَةَ بْنَ أَبِي سُفْيَانَ قَالَ الدَّيْنُ يُرِقُّ الْحُرَّ تَابَعَهُ حَيْوَةُ عَنْ بَكْرِ بْنِ عَمْرٍو إِلَّا أَنَّهُ قَالَ جَعْفَرُ بْنُ شُرَحْبِيلَ وَهُوَ جَعْفَرُ بْنُ رَبِيعَةَ بْنِ شُرَحْبِيلَ بْنِ حَسَنَةَ
[Machine] Aisha, the wife of the Prophet ﷺ, informed him that the Messenger of Allah ﷺ used to supplicate during the prayer, saying, "O Allah, I seek refuge in You from committing sins and incurring debts." She said, so someone said to him, "How often do you seek refuge from incurring debts?" He replied, "Indeed, when a person incurs a debt, he speaks and lies, and he promises and breaks his word, so the wording of the hadith of Ibn Sakhtawayh was adopted."
أَنَّ عَائِشَةَ زَوْجَ النَّبِيِّ ﷺ أَخْبَرَتْهُ أَنَّ رَسُولَ اللهِ ﷺ كَانَ يَدْعُو فِي الصَّلَاةِ فَيَقُولُ اللهُمَّ إِنِّي أَعُوذُ بِكَ مِنَ الْمَأْثَمِ وَالْمَغْرَمِ قَالَتْ فَقَالَ لَهُ قَائِلٌ مَا أَكْثَرَ مَا تَسْتَعِيذُ مِنَ الْمَغْرَمِ قَالَ إنَّ الرَّجُلَ إِذَا غَرِمَ حَدَّثَ فَكَذَبَ وَوَعَدَ فَأَخْلَفَ لَفْظُ حَدِيثِ ابْنِ سَخْتَوَيْهِ
[Machine] A caravan arrived, so the Prophet ﷺ purchased some goods from it and made a profit from gold. He then gave it as charity to the orphans of Abdul-Muttalib and said, "I will not buy something that I do not have the price for." And so it was.
قَدِمَتْ عِيرٌ فَابْتَاعَ النَّبِيُّ ﷺ مِنْهَا بَيْعًا فَرَبِحَ أَوَاقٍ مِنْ ذَهَبٍ فَتَصَدَّقَ بِهَا بَيْنَ يَتَامَى عَبْدِ الْمُطَّلِبِ وَقَالَ لَا أَشْتَرِي مَا لَيْسَ عِنْدِي ثَمَنُهُ وَكَذَلِكَ
13.109 [Machine] What is mentioned in the rulings pertaining to the debtor and the one who is capable of paying off their debts
١٣۔١٠٩ بَابُ مَا جَاءَ فِي إِنْظَارِ الْمُعْسِرِ وَالتَّجَوُّزِ عَنِ الْمُوسِرِ
Did you do anything good? He said: No. they said: Try to recall. He said: I used to lend to people and order my servants to give respite to one in straitened circumstances and give allowance to the solvent, for Allah, the Exalted and Majestic, said (to the angels): You should ignore (his failing). قَالَ رَسُولُ اللهِ ﷺ تَلَقَّتِ الْمَلَائِكَةُ رُوحَ رَجُلٍ مِمَّنْ كَانَ قَبْلَكُمْ فَقَالُوا أَعَمِلْتَ مِنَ الْخَيْرِ شَيْئًا؟ قَالَ لَا قَالُوا تَذَكَّرْ قَالَ كُنْتُ أُدَايِنُ النَّاسَ فَآمُرُ فِتْيَانِي أَنْ يُنْظِرُوا الْمُعْسِرَ وَيَتَجَوَّزُوا عَنِ الْمُوسِرِ قَالَ فَقَالَ اللهُ تَعَالَى تَجَوَّزُوا عَنْهُ
[Machine] I heard the Messenger of Allah ﷺ saying, "A man died and it was said to him, 'What have you done?' He said, 'I used to extend leniency to people in matters and give respite to those in difficulty.' So he entered Paradise." Abu Mas'ood Al Badri said, "I have also heard this from the Prophet ﷺ ."
سَمِعْتُ رَسُولَ اللهِ ﷺ قَالَ مَاتَ رَجُلٌ فَقِيلَ لَهُ مَا عَمِلْتَ؟ قَالَ كُنْتُ أُبَايِعُ النَّاسَ فَأَتَجَاوَزُ فِي الْمَسْأَلَةِ وَأُنْظِرُ الْمُعْسِرَ فَدَخَلَ الْجَنَّةَ قَالَ أَبُو مَسْعُودٍ الْبَدْرِيُّ وَأَنَا قَدْ سَمِعْتُهُ مِنَ النَّبِيِّ ﷺ
[Machine] The Messenger of Allah, ﷺ , said: The man who was before you will be held accountable, and it will be found that he had no good deeds except that he was someone who was easy-going and mixed with people. He would say to his servants, "Go easy on the one who is in debt." Allah said to His angels, "We are more deserving of that." So forgive him. This is the wording of the hadith of Abu Bakr.
قَالَ رَسُولُ اللهِ ﷺ حُوسِبَ رَجُلٌ مِمَّنْ كَانَ قَبْلَكُمْ فَلَمْ يُوجَدْ لَهُ مِنَ الْخَيْرِ شَيْءٌ إِلَّا أَنَّهُ كَانَ رَجُلًا مُوسِرًا يُخَالِطُ النَّاسَ فَيَقُولُ لِغِلْمَانِهِ تَجَاوَزُوا عَنِ الْمُعْسِرِ فَقَالَ اللهُ لِمَلَائِكَتِهِ فَنَحْنُ أَحَقُّ بِذَلِكَ فَتَجَاوَزُوا عَنْهُ لَفْظُ حَدِيثِ أَبِي بَكْرٍ
[Machine] I heard the Messenger of Allah ﷺ say, "There was a man who would borrow from people, and when he couldn't repay, he would say to his servant, 'Let him off, perhaps Allah will let us off.' So, when he met Allah, Allah let him off."
سَمِعْتُ رَسُولَ اللهِ ﷺ يقول كَانَ رَجُلٌ يُدَايِنُ النَّاسَ فَإِذَا أَعْسَرَ الْمُعْسِرُ قَالَ لِفَتَاهُ تَجَاوَزْ عَنْهُ فَلَعَلَّ اللهَ يَتَجَاوَزُ عَنَّا فَلَقِيَ اللهَ فَتَجَاوَزَ عَنْهُ
I am hard up financially, whereupon he said: (Do you state it) by God? He said: By God. Upon this he (Qatada) said: I heard Messenger of Allah ﷺ as saying: He who loves that Allah saves him from the torments of the Day of Resurrection should give respite to the insolvent or remit (his debt). أَنَّ أَبَا قَتَادَةَ طَلَبَ غَرِيمًا لَهُ فَتَوَارَى عَنْهُ ثُمَّ وَجَدَهُ فَقَالَ إِنِّي مُعْسِرٌ فَقَالَ لَهُ قَالَ آللَّهِ قَالَ آللَّهِ قَالَ أَبُو قَتَادَةَ سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَنْ سَرَّهُ أَنْ يُنَجِّيَهُ اللهُ مِنْ كُرَبِ يَوْمِ الْقِيَامَةِ فَلْيُنْظِرْ مُعْسِرًا أَوْ لِيَضَعْ عَنْهُ
[Machine] My father and I went out seeking knowledge in this neighborhood from the Ansar before they passed away. The first person we met was Abu Al-Yasar, the companion of the Messenger of Allah ﷺ . He had a young boy with him, as well as a bundle of papers. He had a cloak on his shoulder and his face showed signs of anger. My father said to him, "O uncle, I see anger in your face." Abu Al-Yasar replied, "Indeed, I had some money with Fulan ibn Fulan Al-Harami, so I went to his family to greet them. I asked about him, and they said he was not here. Then his young son came out, and I asked him, 'Where is your father?' He said, 'He heard your voice, so he went into my mother's closet.' I said, 'Come out to me, for I know where you are.' He came out, and I asked him, 'What made you hide from me?' He said, 'I swear by Allah, I wanted to talk to you, but I feared that I would lie to you or break my promise to you. And you were the companion of the Messenger of Allah ﷺ , and I was a difficult person.' I said, 'By Allah,' He said, 'By Allah.' I said, 'By Allah.' He said, 'By Allah.' I said, 'By Allah.' He said, 'By Allah.' Then he brought his papers and erased them with his own hand and said, 'If you find any injustice, then judge me. Otherwise, you are in the right.' He placed his fingers on his eyes and said, 'I bear witness with my own sight.' He put his fingers on his ears and said, 'I hear with my own ears.' He touched his heart and said, 'This is my heart.' The Messenger of Allah ﷺ pointed to the strings of his heart and said, 'Whoever shows kindness to a difficult person or helps him, Allah will shade him in His shade on the Day of Judgment.'
خَرَجْنَا أَنَا وَأَبِي نَطْلُبُ الْعَلِّمَ فِي هَذَا الْحِيِّ مِنَ الْأَنْصَارِ قَبْلَ أَنْ يَهْلِكُوا فَكَانَ أَوَّلَ مَا لَقِينَا أَبُو الْيَسَرِ صَاحِبُ رَسُولِ اللهِ ﷺ وَمَعَهُ غُلَامٌ لَهُ وَمَعَهُ ضِمَامَةٌ مِنْ صُحُفٍ وَعَلَى أَبِي الْيَسَرِ بُرْدَةٌ وَمَعَافِرِيٌّ وَعَلَى غُلَامِهِ بُرْدَةٌ وَمَعَافِرِيٌّ فَقَالَ لَهُ أَبِي يَا عَمُّ إِنِّي أَرَى فِي وَجْهِكَ سَفَعةً مِنْ غَضِبٍ قَالَ أَجَلْ كَانَ لِي عَلَى فُلَانِ بْنِ فُلَانٍ الْحَرَمِيِّ مَالٌ فَأَتَيْتُ أَهْلَهُ فَسَلَّمْتُ فَقُلْتُ ثَمَّ هُوَ؟ قَالُوا لَا فَخَرَجَ عَلَيَّ ابْنٌ لَهُ صَغِيرٌ فَقُلْتُ أَيْنَ أَبُوكَ؟ قَالَ سَمِعَ صَوْتَكَ فَدَخَلَ أَرِيكَةَ أُمِّي فَقُلْتُ اخْرُجْ إِلِيَّ فَقَدْ عَلِمْتُ أَيْنَ أَنْتَ فَخَرَجَ فَقُلْتُ مَا حَمَلَكَ عَلَى أَنِ اخْتَبَأْتَ مِنِّي؟ قَالَ أَنَا وَاللهِ أُحَدِّثُكَ ثُمَّ قَالَ لَا أَكْذِبُكَ خَشِيتُ وَاللهِ أَنْ أُحَدِّثَكَ فَأَكْذِبَكَ وَأَنْ أَعِدَكَ فَأُخْلِفَكَ وَكُنْتَ صَاحِبَ رَسُولِ اللهِ ﷺ وَكُنْتُ وَاللهِ مُعْسِرًا قَالَ قُلْتُ آللَّهِ قَالَ آللَّهِ قَالَ قُلْتُ آللَّهِ قَالَ آللَّهِ قَالَ قُلْتُ آللَّهِ قَالَ آللَّهِ قَالَ فَأَتَى بِصَحِيفَتِهِ ثُمَّ مَحَاهَا بِيَدِهِ وَقَالَ إِنْ وَجَدْتَ قَضَاءً فَاقْضِنِي وَإِلَّا أَنْتَ فِي حِلٍّ فَأَشْهَدُ بَصُرَ عَيْنِي هَاتَيْنِ وَوَضَعَ أُصْبُعَيْهِ عَلَى عَيْنَيْهِ وَسَمِعَ أُذُنِي هَاتَيْنِ وَوَعَاهُ قَلْبِي هَذَا وَأَشَارَ إِلَى نِيَاطِ قَلْبِهِ رَسُولَ اللهِ ﷺ وَهُوَ يَقُولُ مَنْ أَنْظَرَ مُعْسِرًا أَوْ وَضَعَ لَهُ أَظَلَّهُ اللهُ فِي ظِلِّهِ
[Machine] The Messenger of Allah ﷺ said, "Whoever helps a person in difficulty, he will have a reward similar to it every day." The person asked, "O Messenger of Allah, is there a reward every day?" Then, he asked, "Is there a reward similar to it every day?" The Prophet ﷺ replied, "Yes, there is a reward every day as long as the debt has not been settled. But if the debt has been settled, then he will have a reward similar to it every day if he helps him after the settlement."
قَالَ رَسُولُ اللهِ ﷺ مَنْ أَنْظَرَ مُعْسِرًا فَإِنَّ لَهُ بِكُلِّ يَوْمٍ مِثْلِهِ صَدَقَةً قَالَ قُلْتُ يَا رَسُولَ اللهِ بِكُلِّ يَوْمٍ صَدَقَةٌ ثُمَّ قُلْتُ لَهُ بِكُلِّ يَوْمٍ مِثْلِهِ صَدَقَةٌ فَقَالَ لَهُ بِكُلِّ يَوْمٍ صَدَقَةٌ مَا لَمْ يَحِلَّ الدَّيْنُ فَإِذَا حَلَّ الدَّيْنُ فَإِنْ أَنْظَرَهُ بَعْدَ الْحِلِّ فَلَهُ بِكُلِّ يَوْمٍ مِثْلِهِ صَدَقَةٌ
13.110 [Machine] What happens in sight when money belongs to orphans?
١٣۔١١٠ بَابُ مَا جَاءَ فِي الْإِنْظَارِ إِذَا كَانَ الْمَالُ لِلْيَتَامَى
[Machine] The Messenger of Allah ﷺ left the city to confront the disbelievers in battle. He mentioned a conversation regarding the killing of someone's father and the intensification of creditors against him in seeking repayment. The Prophet ﷺ said, "Pray for me, so-and-so, the creditor who has pressed me in seeking repayment." Ayyash ibn Jabir replied, "Should I bring some of your debt that is owed by his father to this threshold?" The Prophet ﷺ said, "I am not someone who fulfills his own debts, but he is the property of orphans." The Messenger of Allah ﷺ asked, "Where is Jabir?" He then mentioned a conversation regarding debt settlement.
خَرَجَ رَسُولُ اللهِ ﷺ مِنَ الْمَدِينَةِ إِلَى الْمُشْرِكِينَ؛ لِيُقَاتِلَهُمْ فَذَكَرَ الْحَدِيثَ فِي قَتْلِ أَبِيهِ وَاشْتِدَادِ الْغُرَمَاءِ عَلَيْهِ فِي التَّقَاضِي قَالَ فَقَالَ النَّبِيُّ ﷺ ادْعُ لِي فُلَانًا الْغَرِيمَ الَّذِي اشْتَدَّ عَلَيَّ فِي التَّقَاضِي فَقَالَ أَيْسِرْ جَابِرًا بَعْضَ دَيْنِكِ الَّذِي عَلَى أَبِيهِ إِلَى هَذَا الصِّرَامِ الْمُقْبِلِ قَالَ مَا أَنَا بِفَاعِلٍ وَاعْتَلَّ قَالَ إِنَّمَا هُوَ مَالُ يَتَامَى فَقَالَ رَسُولُ اللهِ ﷺ وَأَيْنَ جَابِرٌ؟ فَذَكَرَ الْحَدِيثَ فِي قَضَاءِ الدَّيْنِ
13.111 [Machine] The Ease and Permissibility in Buying and Selling, and Whoever Seeks a Right, Let Them Seek it Honorably.
١٣۔١١١ بَابُ السُّهُولَةِ وَالسَّمَاحَةِ فِي الشِّرَاءِ وَالْبَيْعِ , وَمَنْ طَلَبَ حَقًّا فَلْيَطْلُبْهُ فِي عَفَافٍ
[Machine] The Messenger of Allah ﷺ said, "May Allah have mercy on a gentle person when he sells, a gentle person when he buys, and a gentle person when he settles."
قَالَ رَسُولُ اللهِ ﷺ رَحِمَ اللهُ عَبْدًا سَمْحًا إِذَا بَاعَ سَمْحًا إِذَا اشْتَرَى سَمْحًا إِذَا قَضَى
That the Messenger of Allah ﷺ said: "Allah forgave a man who was before you: He was tolerant when selling, tolerant when purchasing, and tolerant when repaying." He said: This Hadith is Gharib Sahih Hasan from this route. (Using translation from Tirmidhī 1320)
قَالَ رَسُولُ اللهِ ﷺ غَفَرَ اللهُ لِرَجُلٍ كَانَ قَبْلَكُمْ كَانَ سَهْلًا إِذَا بَاعَ سَهْلًا إِذَا اشْتَرَى سَهْلًا إِذَا قَضَى سَهْلًا إِذَا اقْتَضَى
“Whoever demands his rights let him do so in a decent manner as much as he can.” (Using translation from Ibn Mājah 2421)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنْ طَلَبَ حَقًّا فَلْيَطْلُبْ فِي عَفَافٍ وَافٍ أَوْ غَيْرَ وَافٍ
13.112 [Machine] The Trade of Guardianship of Orphaned Property or its Lending
١٣۔١١٢ بَابُ تِجَارَةِ الْوَصِيِّ بِمَالِ الْيَتِيمِ أَوْ إِقْرَاضِهِ
[Machine] Narrated by the Prophet ﷺ : "Whoever becomes the guardian of an orphan's wealth, let him trade with it and not leave it until it is consumed by charity. This has been mentioned in the Book of Zakat, narrated from Al-Muthanna bin As-Sabbah, from Amr bin Shu'ayb, and also narrated from Mindal bin Ali, from Abu Ishaq Ash-Shaybani, from Amr."
عَنِ النَّبِيِّ ﷺ قَالَ مَنْ وَلِيَ لِيَتِيمٍ مَالًا فَلْيَتَّجِرْ بِهِ وَلَا يَدَعْهُ حَتَّى تَأْكُلَهُ الصَّدَقَةُ وَقَدْ رُوِّينَاهُ فِي كِتَابِ الزَّكَاةِ عَنِ الْمُثَنَّى بْنِ الصَّبَّاحِ عَنْ عَمْرِو بْنِ شُعَيْبٍ وَرُوِيَ عَنْ مِنْدَلِ بْنِ عَلِيٍّ عَنْ أَبِي إِسْحَاقَ الشَّيْبَانِيِّ عَنْ عَمْرٍو
[Machine] Abu al-Abbas al-Asamm narrated that al-Rabi' told us that al-Shafi'i informed us that Abdullah bin Majid narrated from Ibn Jurayj from Yusuf bin Mahak that the Messenger of Allah ﷺ said, "Seek wealth from the orphan's property or from the property of the orphans, do not waste it or consume it as charity."
ثنا أَبُو الْعَبَّاسِ الْأَصَمُّ أنبأ الرَّبِيعُ أنبأ الشَّافِعِيُّ أنبأ عَبْدُ الْمَجِيدِ عَنِ ابْنِ جُرَيْجٍ عَنْ يُوسُفَ بْنِ مَاهَكٍ أَنَّ رَسُولَ اللهِ ﷺ قَالَ ابْتَغُوا فِي مَالِ الْيَتِيمِ أَوْ فِي مَالِ الْيَتَامَى لَا تُذْهِبُهَا أَوْ لَا تَسْتَهْلِكُهَا الصَّدَقَةُ
[Machine] Seek in the wealth of orphans; do not let charity consume it.
ابَتْغُوا فِي أَمْوَالِ الْيَتَامَى؛ لَا تَسْتَهْلِكُهَا الصَّدَقَةُ
[Machine] He paid me ten thousand, but I refused it as God willed. Then I returned to him and he asked me about the money. I said to him, "This is it, it has reached one hundred thousand." He replied, "Return our money, we do not need it."
فَدَفَعَ إِلِيَّ عَشَرَةَ آلَافٍ فَغِبْتُ عَنْهُ مَا شَاءَ اللهُ ثُمَّ رَجَعْتُ إِلَيْهِ فَقَالَ لِي مَا فَعَلَ الْمَالُ؟ قَالَ قُلْتُ هُوَ ذَا قَدْ بَلَغَ مِائَةَ أَلْفٍ قَالَ رُدَّ عَلَيْنَا مَالَنَا لَا حَاجَةَ لَنَا بِهِ
[Machine] Aisha purifies our wealth and indeed she trades with it in the two seas.
عَائِشَةُ ؓ تُزَكِّي أَمْوَالَنَا وَإِنَّهَا لَيُتَّجَرُ بِهَا فِي الْبَحْرَيْنِ
[Machine] And he used to pay his Zakat (obligatory charity) from his wealth.
وَكَانَ يُؤَدِّي زَكَاتَهُ مِنْ أَمْوَالِهِمْ
13.113 [Machine] Buy him real estate with his money when he sees happiness in it
١٣۔١١٣ بَابُ يَشْتَرِي لَهُ بِمَالِهِ الْعَقَارَ إِذَا رَأَى فِيهِ غِبْطَةً
[Machine] He had the money of two orphans, so he started giving them zakah. I said, "O my father, do not trade with it and do not spend what is not rightfully yours." He said, "I will continue giving zakah, even if only a dirham remains." He said, "Then he bought a house for them with it."
أَنَّهُ كَانَ عِنْدَهُ مَالُ يَتِيمَيْنِ فَجَعَلَ يُزَكِّيهِ فَقُلْتُ يَا أَبَتَاهُ لَا تَتَّجِرْ فِيهِ وَلَا تَضْرِبْ مَا أَسْرَعَ هَذِهِ فِيهِ قَالَ لَأُزَكِّيَنَّهُ وَلَوْ لَمْ يَبْقَ إِلَّا دِرْهَمٌ قَالَ ثُمَّ اشْتَرَى لَهُمَا بِهِ دَارًا
13.114 [Machine] He does not buy for himself from his own wealth when he is a guardian
١٣۔١١٤ بَابُ لَا يَشْتَرِي مِنْ مَالِهِ لِنَفْسِهِ إِذَا كَانَ وَصِيًّا
لَا تَشْتَرِهِ وَلَا تَسْتَقْرِضْ مِنْ مَالِهِ
13.115 [Machine] Who buys from his own money for himself from himself when he is a father or a grandfather from the side of the father
١٣۔١١٥ بَابُ مَنْ يَشْتَرِي مِنْ مَالِهِ لِنَفْسِهِ مِنْ نَفْسِهِ إِذَا كَانَ أَبًا أَوْ جَدًّا مِنْ قِبَلِ الْأَبِ
[Machine] His grandmother died at Abi Burdah's house, so they advised Abi Burdah to follow some of her female slaves. He said and mentioned the narration.
أَنَّ جَدَّتَهُ مَاتَتْ عِنْدَ أَبِي بُرْدَةَ فَأَفْتَوْا أَبَا بُرْدَةَ يَتْبَعُ بَعْضَ جَوَارِيهَا قَالَ وَذَكَرَ الْحَدِيثَ
13.116 [Machine] The guardian eats from the orphan's wealth in return for his good care if he is poor.
١٣۔١١٦ بَابُ الْوَلِيِّ يَأْكُلُ مِنْ مَالِ الْيَتِيمِ مَكَانَ قِيَامِهِ عَلَيْهِ بِالْمَعْرُوفِ إِذَا كَانَ فَقِيرًا
[Machine] In His saying, "{Whoever is wealthy, let him refrain [from spending extravagantly]; and whoever is poor, let him eat [only] in an acceptable manner.}" [Surah An-Nisa: 6], it is said to have been revealed regarding the guardian of the wealth of the orphan when he is poor, that he should eat from the wealth of the orphan in place of his own sustenance in a manner that is acceptable. And Abu Abdullah narrated to us, and Abu Al-Waleed narrated to me, from Al-Hassan bin Sufyan, from Abu Bakr bin Abi Shaybah, from Abdullah bin Sulaiman, from Hisham, and he mentioned this except that he said, "It was revealed regarding the guardian of the wealth of the orphan who takes care of him and rectifies his affairs when he is in need, that he should eat from it."
ؓ فِي قَوْلِهِ ﷻ {مَنْ كَانَ غَنِيًّا فَلْيَسْتَعْفِفْ وَمَنْ كَانَ فَقِيرًا فَلْيَأْكُلْ بِالْمَعْرُوفِ} [النساء 6] قَالَتْ إِنَّمَا نَزَلَتْ فِي وَالِي مَالِ الْيَتِيمِ إِذَا كَانَ فَقِيرًا أَنَّهُ يَأْكُلُ مِنْهُ مَكَانَ قِيَامِهِ عَلَيْهِ بِالْمَعْرُوفِ 10992 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ أَخْبَرَنِي أَبُو الْوَلِيدِ ثنا الْحَسَنُ بْنُ سُفْيَانَ ثنا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ ثنا عَبْدَةُ بْنُ سُلَيْمَانَ عَنْ هِشَامٍ فَذَكَرَهُ بِنَحْوِهِ إِلَّا أَنَّهُ قَالَ أُنْزِلَتْ فِي وَالِي مَالِ الْيَتِيمِ الَّذِي يَقُومُ عَلَيْهِ وَيُصْلِحُهُ إِذَا كَانَ مُحْتَاجًا أَنْ يَأْكُلَ مِنْهُ
[Machine] I said to the Messenger of Allah ﷺ, "What should I give as a compensation for striking my orphan?" He replied, "Give from what you have been striking your child with, without causing harm, and without taking any of his wealth or seeking any wealth from him."
قُلْتُ لِرَسُولِ اللهِ ﷺ مِمَّ أَضْرِبُ مِنْهُ يَتِيمِي؟ فَقَالَ مِمَّا كُنْتَ ضَارِبًا وَلَدَكَ غَيْرَ وَاقٍ مَالَكَ بِمَالِهِ وَلَا مُتَأَثِّلٍ مِنْ مَالِهِ مَالًا كَذَا
[Machine] "O Messenger of Allah, what should I use to discipline my orphaned child?"
He replied, "Use what you used to discipline him when he was living with you."
The person then asked, "Would I face any harm if I take from his wealth?"
The Prophet replied, "No, as long as you do not take his wealth in excess or leave him without any."
يَا رَسُولَ اللهِ مِمَّ أَضْرِبُ مِنْهُ يَتِيمِي؟ قَالَ مِمَّا كُنْتَ مِنْهُ ضَارِبًا وَلَدَكَ قَالَ أَفَأُصِيبُ مِنْ مَالِهِ؟ قَالَ غَيْرَ مُتَأَثِّلٍ مَالًا وَلَا وَاقٍ مَالَكَ بِمَالِهِ هَذَا مُرْسَلٌ
[Machine] "So he drank from its messenger, which means from its milk."
فَأَصِبْ مِنْ رِسْلِهَا يَعْنِي مِنْ لَبَنِهَا
[Machine] If you want to reply to her call and splash in her pool and enjoy her stream, then drink something that does not harm the offspring or breach the laws in milk. [Sa'id said] Jarir narrated from Abu Ishaq Ash-Shaybani from 'Ikrimah from Ibn 'Abbas who said: "The guardian puts his hand in their hands and does not wear the turban or anything above it."
إِنْ كُنْتَ تَرُدُّ نَادَّتَهَا وَتَلُوطُ حَوْضَهَا وَتَهْنَأُ جَرْبَاهَا فَاشْرَبْ غَيْرَ مُضِرٍّ بِنَسْلٍ وَلَا نَاهِكٍ فِي حَلْبٍ 10997 قَالَ وَحَدَّثَنَا سَعِيدٌ ثنا جَرِيرٌ عَنْ أَبِي إِسْحَاقَ الشَّيْبَانِيِّ عَنْ عِكْرِمَةَ عَنِ ابْنِ عَبَّاسٍ قَالَ يَضَعُ الْوَصِيُّ يَدَهُ مَعَ أَيْدِيهِمْ وَلَا يَلْبَسُ الْعِمَامَةَ فَمَا فَوْقَهَا
[Machine] He eats the wealth of the orphan with his own fingers, and does not exceed that.
يَأْكُلُ مَالَ الْيَتِيمِ بِأَصَابِعِهِ لَا يَزِيدُ عَلَى ذَلِكَ
إِنْ كَانَ فَقِيرًا فَلْيَضْرِبْ بِيَدِهِ مَعَ أَيْدِيهِمْ فَلْيَأْكُلْ وَلَا يَكْتَسِي عِمَامَةً فَمَا فَوْقَهَا
13.117 [Machine] Who said: 'He fulfills it when it becomes easier'
١٣۔١١٧ بَابُ مَنْ قَالَ: يَقْضِيهِ إِذَا أَيْسَرَ
[Machine] 'Omar bin Al-Khattab said to me: "I have lowered myself from Allah's wealth for the sake of the orphan. If I am in need, I would take from him, and if I am capable, I would return it back to him. And if I become self-sufficient, I would abstain from taking anything from him."
قَالَ لِي عُمَرُ بْنُ الْخَطَّابِ ؓ إِنِّي أَنْزَلْتُ نَفْسِي مِنْ مَالِ اللهِ بِمَنْزِلَةِ وَالِي الْيَتِيمِ إِنِ احْتَجْتُ أَخَذْتُ مِنْهُ فَإِذَا أَيْسَرْتُ رَدَدْتُهُ وَإِنِ اسْتَغْنَيْتُ اسْتَعْفَفْتُ
[Machine] In his statement, {And whoever is poor, let him eat in a reasonable manner} [An-Nisa 6], he said: The guardian of the orphan should eat from the orphan's wealth what is enough for him, and should clothe himself from it with what covers him, and should drink the excess of milk, and should ride the excess of transportation. So if the guardian is well-to-do, he should spend [according to his means]; and if he is poor, let him spend according to what Allah has given him. This was narrated from 'Ubaydah, Mujahid, Sa'id bin Jubayr, and Abu Al-'Ala; they said: He should spend [according to his means]. And it was narrated from Al-Hasan Al-Basri and 'Ata bin Abi Rabah that he should not spend [more than his means].
فِي قَوْلِهِ {وَمَنْ كَانَ فَقِيرًا فَلْيَأْكُلْ بِالْمَعْرُوفِ} [النساء 6] قَالَ يَأْكُلُ وَالِي الْيَتِيمِ مِنْ مَالِ الْيَتِيمِ قُوتَهُ وَيَلْبَسُ مِنْهُ مَا يَسْتُرُهُ وَيَشْرَبُ فَضْلَ اللَّبَنِ وَيَرْكَبُ فَضْلَ الظَّهْرِ فَإِنْ أَيْسَرَ قَضَى وَإِنْ أَعْسَرَ كَانَ فِي حِلٍّ وَرُوِّينَا عَنْ عُبَيْدَةَ وَمُجَاهِدٍ وَسَعِيدِ بْنِ جُبَيْرٍ وَأَبِي الْعَالِيَةِ أَنَّهُمْ قَالُوا يَقْضِيهِ وَرُوِّينَا عَنِ الْحَسَنِ الْبَصْرِيِّ وَعَطَاءِ بْنِ أَبِي رَبَاحٍ لَا يَقْضِيهِ
13.118 [Machine] The guardian mixes his wealth with the wealth of the orphan while seeking to improve his own financial condition with his own wealth
١٣۔١١٨ بَابُ الْوَلِيِّ يَخْلِطُ مَالَهُ بِمَالِ الْيَتِيمِ وَهُوَ يُرِيدُ إِصْلَاحَ مَالِهِ بِمَالِ نَفْسِهِ
[Machine] When the verse {And do not approach the orphan's property except in the way that is best} [An-Nahl 152] was revealed, they separated their wealth from the wealth of the orphans. As a result, the food spoiled and the meat became rotten. They complained about this to the Messenger of Allah ﷺ , so Allah revealed {Say, "Reform is best. And if you associate with them, then they are your brothers"} [Al-Baqarah 220]. He said, "So associate with them."
لَمَّا نَزَلَتْ {وَلَا تَقْرَبُوا مَالَ الْيَتِيمِ إِلَّا بِالَّتِي هِيَ أَحْسَنُ} [الأنعام 152] عَزَلُوا أَمْوَالَهُمْ عَنْ أَمْوَالِ الْيَتَامَى فَجَعَلَ الطَّعَامُ يَفْسُدُ وَاللَّحْمُ يَنْتُنُ فَشَكَوْا ذَلِكَ إِلَى رَسُولِ اللهِ ﷺ فَأَنْزَلَ اللهُ تَعَالَى {قُلْ إِصْلَاحٌ لَهُمْ خَيْرٌ وَإِنْ تُخَالِطُوهُمْ فَإِخْوَانُكُمْ} [البقرة 220] قَالَ فَخَالَطُوهُمْ
13.119 [Machine] What Happened in the Invasion of Abyssinia
١٣۔١١٩ بَابُ مَا جَاءَ فِي مُدَايَنَةِ الْعَبْدِ
[Machine] That the Messenger of Allah ﷺ said: "Whoever sells a slave while still having a debt, the debt is upon him unless the buyer stipulates otherwise. And whoever cultivates a palm tree and sells it after it has borne fruit, the fruit is for him unless the buyer stipulates otherwise. This is valid if it is correct, for Allah knows best. As for the debtor who engages in trade with money and has a debt tied to it, the creditor takes his money and settles his debt from it."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنْ بَاعَ عَبْدًا وَلَهُ مَالٌ فَلَهُ مَالُهُ وَعَلَيْهِ دَيْنُهُ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ وَمَنْ أَبَّرَ نَخْلًا فَبَاعَهُ بَعْدَ تَوْبِيرِهِ فَلَهُ ثَمَرَتُهُ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ وَهَذَا إِنْ صَحَّ فَإِنَّمَا أَرَادَ وَاللهُ أَعْلَمُ الْعَبْدَ الْمَأْذُونَ لَهُ فِي التِّجَارَةِ إِذَا كَانَ فِي يَدِهِ مَالٌ وَفِيهِ دَيْنٌ يَتَعَلَّقُ بِهِ فَالسَّيِّدُ يَأْخُذُ مَالَهُ وَيَقْضِي مِنْهُ دَيْنَهُ
[Machine] They used to say that the debt of the mamluk was guaranteed and that the only thing that was affected by people's wealth was the debt, like something that is stolen, or money that is taken by force, or a camel that is sacrificed. That is all similar to a wound that is inflicted, either its master will heal it, or its slave will submit it.
كَانُوا يَقُولُونَ دَيْنُ الْمَمْلُوكِ فِي ذِمَّتِهِ وَمَا أَصَابَ مِنْ أَمْوَالِ النَّاسِ سِوَى الدَّيْنِ مِثْلُ الشَّيْءِ يَخْتَلِسُهُ أَوِ الْمَالِ يَغْتَصِبُهُ أَوِ الْبَعِيرُ يَنْحَرُهُ فَذَلِكَ كُلُّهُ بِمَنْزِلَةِ الْجُرْحِ يَجْرَحُهُ إِمَّا أَنْ يَفْدِيَهُ سَيِّدُهُ وَإِمَّا أَنْ يُسَلِّمَ عَبْدَهُ
13.120 [Machine] The Assembly of Selling Dogs and other Forbidden Animals
١٣۔١٢٠ جُمَّاعُ أَبْوَابِ بُيُوعِ الْكِلَابِ وَغَيْرِهَا مِمَّا لَا يَحِلُّ
13.121 [Machine] Prohibition of the price of the dog
١٣۔١٢١ بَابُ النَّهْيِ عَنْ ثَمَنِ الْكَلْبِ
[Machine] "That the Prophet ﷺ forbade the price of a dog, the dowry of a prostitute, and the earnings of a fortune-teller."
أَنَّ النَّبِيَّ ﷺ نَهَى عَنْ ثَمَنِ الْكَلْبِ وَمَهْرِ الْبَغِيِّ وَحُلْوَانِ الْكَاهِنِ
[Machine] And he said, "Indeed, the Messenger of Allah ﷺ forbade the price of blood, and the price of a dog, and the dowry of a prostitute, and cursed the eater of usury and its giver, and the tattooer and the one who gets tattooed, and cursed the painter."
وَقَالَ إِنَّ رَسُولَ اللهِ ﷺ نَهَى عَنْ ثَمَنِ الدَّمِ وَعَنْ ثَمَنِ الْكَلْبِ وَمَهْرِ الْبَغِيِّ وَلَعَنَ آكِلَ الرِّبَا وَمُؤْكِلَهُ وَالْوَاشِمَةَ وَالْمُسْتَوْشِمَةَ وَلَعَنَ الْمُصَوِّرَ
[Machine] The Messenger of Allah ﷺ said, "The earnings of a cupper are impure, the earnings of a robber are impure, and the price of a dog is impure."
قَالَ رَسُولُ اللهِ ﷺ كَسْبُ الْحَجَّامِ خَبِيثٌ وَكَسْبُ الْبَغِيِّ خَبِيثٌ وَثَمَنُ الْكَلْبِ خَبِيثٌ
[Machine] The Messenger of Allah ﷺ forbade the price of alcohol, the dowry of wrongdoing, and the price of a dog. He said, "If someone comes asking for the price of a dog, then fill his hand with dirt."
نَهَى رَسُولُ اللهِ ﷺ عَنْ ثَمَنِ الْخَمْرِ وَمَهْرِ الْبَغِيِّ وَثَمَنِ الْكَلْبِ وَقَالَ إِذَا جَاءَ يَطْلُبُ ثَمَنَ الْكَلْبِ فَامْلَأْ كَفَّهُ تُرَابًا
The Prophet ﷺ said: The price paid for a dog, the price given to a soothsayer, and the hire paid to a prostitute are not lawful. (Using translation from Abū Dāʾūd 3484)
قَالَ رَسُولُ اللهِ ﷺ لَا يَحِلُّ ثَمَنُ الْكَلْبِ وَلَا حُلْوَانُ الْكَاهِنِ وَلَا مَهْرُ الْبَغِيِّ
[Machine] About the Prophet ﷺ , there are three things, all of which are sinful: he mentioned the earnings of cupping, the dowry of an unlawful marriage, and the price of a dog except for a guard dog. Also, Al-Walid and Al-Muthanna are considered weak.
عَنِ النَّبِيِّ ﷺ ثَلَاثٌ كُلُّهُنَّ سُحْتٌ فَذَكَرَ كَسْبَ الْحَجَّامِ وَمَهْرَ الْبَغِيِّ وَثَمَنَ الْكَلْبِ إِلَّا كَلْبًا ضَارِيًا وَالْوَلِيدُ وَالْمُثَنَّى ضَعِيفَانِ
[Machine] Narrated by the Prophet Muhammad ﷺ and reported by Ubaidullah ibn Musa, from Hammad, with doubt in mentioning the Prophet Muhammad ﷺ . It was also narrated by Haytham ibn Jameel from Hammad, who said: The Messenger of Allah ﷺ forbade it. It was also narrated by Hasan ibn Abi Ja'far from Abu Zubair, from Jabir, from the Prophet Muhammad ﷺ , and it is not strong. The authentic Hadiths do not mention the Prophet Muhammad ﷺ forbidding the price of dogs, except for this exception. And the exception is only in the authentic Hadiths that prohibit possession. Perhaps those narrators who mentioned the price of dogs in this Hadith were compared to those who are below the level of the Sahaba (companions) and Tabi'in (followers). And Allah knows best.
عَنِ النَّبِيِّ ﷺ وَرَوَاهُ عُبَيْدُ اللهِ بْنُ مُوسَى عَنْ حَمَّادٍ بِالشَّكِّ فِي ذِكْرِ النَّبِيِّ ﷺ فِيهِ وَرَوَاهُ الْهَيْثَمُ بْنُ جَمِيلٍ عَنْ حَمَّادٍ فَقَالَ نَهَى رَسُولُ اللهِ ﷺ وَرَوَاهُ الْحَسَنُ بْنُ أَبِي جَعْفَرٍ عَنْ أَبِي الزُّبَيْرِ عَنْ جَابِرٍ عَنِ النَّبِيِّ ﷺ وَلَيْسَ بِالْقَوِيِّ وَالْأَحَادِيثُ الصِّحَاحُ عَنِ النَّبِيِّ ﷺ فِي النَّهْيِ عَنْ ثَمَنِ الْكَلْبِ خَالِيَةٌ عَنْ هَذَا الِاسْتِثْنَاءِ وَإِنَّمَا الِاسْتِثْنَاءُ فِي الْأَحَادِيثِ الصِّحَاحِ فِي النَّهْيِ عَنِ الِاقْتِنَاءِ وَلَعَلَّهُ شُبِّهَ عَلَى مَنْ ذَكَرَ فِي حَدِيثِ النَّهْيِ عَنْ ثَمَنِهِ مِنْ هَؤُلَاءِ الرُّوَاةِ الَّذِينَ هُمْ دُونَ الصَّحَابَةِ وَالتَّابِعِينَ وَاللهُ أَعْلَمُ
[Machine] Uthman fell in love with a man who killed a dog worth twenty camels. Al-Shafi'i said to him, "What if this was established about Uthman? You would not argue about something that was established by the Messenger of Allah ﷺ , while what is established about Uthman contradicts it." He said, "Then mention it." I said, "Al-Thiqa informed us from Yunus from Al-Hasan who said, 'I heard Uthman ibn Affan giving a sermon and ordering the killing of dogs.'" Al-Shafi'i said, "So how can he order the killing of what its worth is paid for by its killer?" The sheikh said, "This is what was narrated from Uthman about the inclusion of the dog, and it was narrated from other sources, including Yahya ibn Said Al-Ansari, who mentioned it about Uthman in a case that was mentioned discontinuously, and it was narrated from Abdullah ibn Amr ibn Al-As."
أَنَّ عُثْمَانَ ؓ أَغْرَمَ رَجُلًا ثَمَنَ كَلْبٍ قَتَلَهُ عِشْرِينَ بَعِيرًا قَالَ الشَّافِعِيُّ فَقُلْتُ لَهُ أَرَأَيْتَ لَوْ ثَبَتَ هَذَا عَنْ عُثْمَانَ كُنْتَ لَمْ تَصْنَعْ شَيْئًا فِي احْتِجَاجِكَ عَلَى شَيْءٍ ثَبَتَ عَنْ رَسُولِ اللهِ ﷺ وَالثَّابِتُ عَنْ عُثْمَانَ خِلَافُهُ قَالَ فَاذْكُرْهُ قُلْتُ أَخْبَرَنَا الثِّقَةُ عَنْ يُونُسَ عَنِ الْحَسَنِ قَالَ سَمِعْتُ عُثْمَانَ بْنَ عَفَّانَ يَخْطُبُ وَهُوَ يَأْمُرُ بِقَتْلِ الْكِلَابِ قَالَ الشَّافِعِيُّ فَكَيْفَ يَأْمُرُ بِقَتْلِ مَا يُغْرَمُ مَنْ قَتَلَهُ قِيمَتَهُ؟ قَالَ الشَّيْخُ هَذَا الَّذِي رُوِيَ عَنْ عُثْمَانَ ؓ فِي تَضْمِينِ الْكَلْبِ مُنْقَطِعٌ وَقَدْ رُوِيَ مِنْ أَوْجُهٍ أُخَرَ عَنْ يَحْيَى بْنِ سَعِيدٍ الْأَنْصَارِيِّ أَنَّهُ ذَكَرَهُ عَنْ عُثْمَانَ فِي قَضِيَّةٍ ذَكَرَهَا مُنْقَطِعَةً وَرُوِيَ عَنْ عَبْدِ اللهِ بْنِ عَمْرِو بْنِ الْعَاصِ
[Machine] He (referring to the Prophet Muhammad) ruled in a hunting dog case, where a man killed it for forty dirhams, and he ruled in a livestock dog case, where a ram was involved. This ruling is attributed to Ibn Juraij and his son, who did not hear it from 'Amr. Al-Bukhari said, may Allah have mercy on him, that he did not hear it.
أَنَّهُ قَضَى فِي كَلْبِ صَيْدٍ قَتَلَهُ رَجُلٌ بِأَرْبَعِينَ دِرْهَمًا وَقَضَى فِي كَلْبِ مَاشِيَةٍ بِكَبْشٍ هَذَا مَوْقُوفٌ وَابْنُ جُرَيْجٍ لَا يَرَوْنَ لَهُ سَمَاعًا مِنْ عَمْرٍو قَالَ الْبُخَارِيُّ رَحِمَهُ اللهُ لَمْ يَسْمَعْهُ
[Machine] It cost forty dirhams to settle (the issue) in the case of the hunting dog, and in the case of the sheep dog, a sheep from the flock, and in the case of the farm dog, a difference in food, and in the case of the house dog, a difference in soil. It is the right of the one who killed it to give it (compensation), and it is the right of the owner of the dog to accept it with a deduction from the reward. Abu Hazim al-Hafiz informed us, Abu al-Fadl ibn Khameerawayh narrated to us, Ahmad ibn Najdah narrated to us, Sa'id ibn Mansur narrated to us, Hushaim narrated to us, from Ya'la ibn 'Ata', from Ismail, and he mentioned it.
قُضِيَ فِي كَلْبِ الصَّيْدِ أَرْبَعُونَ دِرْهَمًا وَفِي كَلْبِ الْغَنَمِ شَاةٌ مِنَ الْغَنَمِ وَفِي كَلْبِ الزَّرْعِ بِفَرَقٍ مِنْ طَعَامٍ وَفِي كَلْبِ الدَّارِ فَرَقٌ مِنْ تُرَابٍ حَقٌّ عَلَى الَّذِي قَتَلَهُ أَنْ يُعْطِيَهُ وَحَقٌّ عَلَى صَاحِبِ الْكَلْبِ أَنْ يَقْبَلَ مَعَ نَقْصٍ مِنَ الْأَجْرِ أَخْبَرَنَاهُ أَبُو حَازِمٍ الْحَافِظُ أنبأ أَبُو الْفَضْلِ بْنُ خَمِيرَوَيْهِ ثنا أَحْمَدُ بْنُ نَجْدَةَ ثنا سَعِيدُ بْنُ مَنْصُورٍ ثنا هُشَيْمٌ ثنا يَعْلَى بْنُ عَطَاءٍ عَنْ إِسْمَاعِيلَ فَذَكَرَهُ
عَنْ عَبْدِ اللهِ بْنِ عَمْرٍو خِلَافُ هَذَا
[Machine] About the price of a dog, the dowry of the rebellious (woman), the wage of the priest, and the income of the cupper.
عَنْ ثَمَنِ الْكَلْبِ وَمَهْرِ الْبَغِيِّ وَأَجْرِ الْكَاهِنِ وَكَسْبِ الْحَجَّامِ
13.122 [Machine] What was mentioned about killing dogs.
١٣۔١٢٢ بَابُ مَا جَاءَ فِي قَتْلِ الْكِلَابِ
[Machine] The Messenger of Allah ﷺ commanded the killing of dogs. Abu Abdullah al-Hafiz informed us that Yahya ibn Mansur al-Qadi informed me that Muhammad ibn Abd al-Salam al-Warraq narrated to me that Yahya ibn Yahya said, "I read to Malik, and he mentioned it."
أَنَّ رَسُولَ اللهِ ﷺ أَمَرَ بِقَتْلِ الْكِلَابِ 11019 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أَخْبَرَنِي يَحْيَى بْنُ مَنْصُورٍ الْقَاضِي ثنا مُحَمَّدُ بْنُ عَبْدِ السَّلَامِ الْوَرَّاقُ ثنا يَحْيَى بْنُ يَحْيَى قَالَ قَرَأْتُ عَلَى مَالِكٍ فَذَكَرَهُ
[Machine] "That the Prophet ﷺ ordered the killing of dogs in the city, and it was reported that there was a woman who had a dog in a part of the city, so he sent someone to her and the dog was killed."
أَنَّ النَّبِيَّ ﷺ أَمَرَ بِقَتْلِ الْكِلَابِ بِالْمَدِينَةِ فَأُخْبِرَ بِامْرَأَةٍ لَهَا كَلْبٌ فِي نَاحِيَةِ الْمَدِينَةِ فَأَرْسَلَ إِلَيْهَا فَقُتِلَ
