13. Commerce (10/15)
[Machine] On the authority of the Prophet ﷺ , he forbade accepting sales.
[Machine] "That the Messenger of Allah ﷺ prohibited receiving goods until they reach the market. This was narrated in the authentic Hadith from Malik and others, from Nafi'."
[Machine] The Prophet ﷺ prohibited taking an advanced payment for a deferred delivery, and selling something that is still being transported. I said to Ibn Abbas, "What does it mean that 'one should not sell something that is still being transported'?" He replied, "It means that it should not have a middleman."
[Machine] The Messenger of Allah ﷺ said, "Do not accept the payment from the passengers" and he mentioned the rest of the Hadith, extracted from the authentic narration of Malik, as mentioned before.
[Machine] The Messenger of Allah ﷺ said, "Do not receive merchandise from caravans." Al-Shafi'i said, "I have heard in this hadith that whoever receives it, the person who owns the merchandise has the option to choose after it has been presented to the market. And with this, we can conclude that if it is confirmed, when a man receives the merchandise and buys it, the sale is permissible, except that the owner of the merchandise has the option after it has been presented to the market."
[Machine] The Messenger of Allah ﷺ said, "Do not engage in price manipulation. Whoever engages in it, let him buy something from it, as the companion with the best choice when he arrives at the market." Imam al-Awza'i narrated that when he arrives at the market, let him arrive with the best choice. And Abu Abdullah al-Hafiz told us that Abu Amr ibn Abi Ja'far informed me, from Abdullah ibn Muhammad, from Ibn Abi Umar, from Hisham ibn Sulayman, from Ibn Jurayj, he said: Hisham al-Qurdusi narrated it to me, except that he said, "When his lord comes to the market, he is the best choice."
[Machine] The Prophet ﷺ forbade receiving Jallab. He said, "If one receives it from a receiver, the one who possesses the merchandise in it has the choice [to sell it] when it reaches the market." 10920 And Abu Ali Al-Rudhbari informed us, that Abu Bakr ibn Dasa told us, that Abu Dawood told us, that Rabee'ah ibn Nafi' informed him from Abu Tawbah, who mentioned it in a similar statement, except that he added "if one receives it from a receiver who is a buyer, then he may purchase it."
[Machine] They used to trade food during the time of the Messenger of Allah ﷺ from the caravans, so he prohibited them from selling it in the place where they bought it until they transported it to the food market.
13.99 [Machine] Prohibition of sale and loan
[Machine] That the Prophet prohibited the sale and loan, and he prohibited two sales in one sale, and he prohibited profiting from something that is not guaranteed.
13.100 [Machine] What is mentioned in the book "Ghabn al-Mustarsil
[Machine] The Messenger of Allah ﷺ said, "Whoever deceives a believer, Allah will deceive him. This is the deception of Musa bin Umayr al-Qurashi." Abu Sa'd al-Malini said, "Abu Ahmad bin Adi al-Hafiz said that most of what he narrates is not followed by reliable narrators." The Sheikh said, "And its meaning has also been narrated to us from Ya'ish bin Hisham al-Qarqisiani from Malik, and there is disagreement concerning its chain of transmission, and it is weaker than this."
[Machine] The Messenger of Allah ﷺ said: "The one who engages in usury is a thief."
[Machine] On the authority of the Prophet ﷺ he said, "Taking undue advantage of someone's vulnerability is usury." And on the authority of Ja'far ibn Muhammad from his father from Ali ﷺ from the Prophet ﷺ he said, "Taking undue advantage of someone's vulnerability is usury."
13.101 [Machine] Every loan that brings a benefit is considered usury
[Machine] "Come with me to the house, and I will give you a drink in a cup that the Messenger of Allah ﷺ drank from, and you will pray in a mosque where he prayed." So, I went with him, and he gave me a drink in a leather flask and fed me dates. Then, I prayed in his mosque, and he said to me, "Verily, you are in a land of usury where people engage in it. One of the forms of usury is that one of you lends a loan with a term, and when it is due, he asks for it along with a gift in a basket. So, be aware of that basket and its contents."
[Machine] So that you may not come to the house until I feed you سَوِيقًا and dates? So we went and he fed us سَوِيقًا and dates. Then he said, "Indeed, you are in a land of usury, so be careful. If you have a debt on a person, then he offers you hay or barley or straw, do not accept it, for that is usury."
[Machine] Indeed, you are in a land of interest, where there is plenty of profit. So when you lend someone and they offer you a gift, take your loan and return their gift to them.
[Machine] Ubay, why did you refuse my gift when you knew that I am one of the most generous people in the city of Thamara? Take back whatever you want from me in return for my gift. This is a sum of ten thousand dirhams, and it is non-refundable.
[Machine] He said, concerning a man who had twenty dirhams on another man, that he would give gifts to him. And every time he gave him a gift, he would sell it until its price reached thirteen dirhams. So Ibn Abbas said, "Do not take from him except seven dirhams."
[Machine] About a man who borrowed some money from another man, then it became apparent that the borrower was poorer than the lender because his camel's back was exposed. Abdullah said, "Whatever is taken from the back of the camel is interest." Abu Ubaid said, "It can be interpreted as a loan with extra benefit." Sheikh Ahmad said, "This narration is cut off, but we have been narrated from Ibn Aoun from Ibn Seereen that a man borrowed some money from another man and he stipulated that his horse's back is exposed. This was mentioned to Ibn Masood and he said, "Whatever is taken from its back is interest."
[Machine] On the authority of Fadalah ibn Ubayd, a companion of the Prophet Muhammad ﷺ , he said: "Every loan that carries a benefit is a form of interest, and it is prohibited."
[Machine] The Messenger of Allah ﷺ said: "When one of you lends someone money, and the borrower presents a dish as a gift, he should not accept it or ride upon any animal carrying it, unless there was a previous arrangement between them. This was narrated by Ibn 'Umar and Hisham ibn 'Ammar, who heard it from Isma'il, who heard it from 'Utbah, who heard it from Yahya ibn Abi Ishaq. I asked Anas ibn Malik about this, and he informed us that Abu al-Hasan ibn Abdan told him. I, Ahmed ibn 'Ubayd, narrated from Al-Hasan ibn Ali al-Ma'mari, who narrated from Hisham ibn 'Ammar, who mentioned it in this manner. Al-Ma'mari said that Hisham mentioned in this hadith Yahya ibn Abi Ishaq al-Hunayyi. In my opinion, I have only seen him once, and it was doubtful." This hadith was also narrated by Shu'bah and Muhammad ibn Dinar, who both narrated it.
13.102 [Machine] It is better to lend than to withhold, even if what is lent is better than what is received.
[Machine] "O Abu Abdullah, I lent a man a loan while stipulating a better condition than what I lent him. Abdullah bin Umar said, 'That is usury.' He then asked, 'So, what do you command me, O Abu Abdullah?' Abdullah said, 'Lending involves three scenarios: lending for the sake of Allah's pleasure, which is for your benefit and the reward is for you; lending for the sake of benefiting your companion, which is for your benefit and the reward is for your companion; and lending in order to receive something better than what you lent, which is usury.' He then asked, 'So, what do you command me, O Abu Abdullah?' Abdullah replied, 'I suggest that you tear up the document. If he gives you the same amount as what you lent him, then accept it. If he gives you less than what you lent him, then take it as compensation. And if he gives you more than what you lent him, then take it as a gift.'
[Machine] A man said to Ibn Mas'ood that he borrowed five hundred (units) from a man on the condition that he lends him (the man who borrowed) the back of his horse. Abdullah (Ibn Mas'ood) said, "Whatever is obtained from it is riba (usury)." Ibn Seereen reported this from Abdullah and said, "It is cut off (i.e., invalid)."
13.103 [Machine] The man spends it better than himself without any condition a good deed benefiting himself.
A man demanded his debts from Messenger of Allah ﷺ in such a rude manner that the companions of the Prophet intended to harm him, but the Prophet ﷺ said, "Leave him, no doubt, for he (the creditor) has the right to demand it (harshly). Buy a camel and give it to him." They said, "The camel that is available is older than the camel he demands. "The Prophet ﷺ said, "Buy it and give it to him, for the best among you are those who repay their debts handsomely. " (Using translation from Bukhārī 2390)
[Machine] A man came to the Messenger of Allah ﷺ and asked him, so the Messenger of Allah ﷺ asked for half of a certain measure of water for him and gave it to him. Then the man came back asking for it again, so he gave him a full measure of the water and said, "Half is for you as a fulfillment, and half is for you as a gift from me."
[Machine] I sent a camel as a gift to the Messenger of Allah ﷺ , then I came to collect its payment. I said, "O Messenger of Allah, give me the price for my camel." He said, "Yes, I will only pay you what I have available." Then he paid me and he paid me in the best way possible. Then an Arab came and said, "O Messenger of Allah, give me my camel." So he paid him with an old, weak camel. The Arab said, "O Messenger of Allah, this is better than my camel." He said, "It is yours, for indeed the best of people are those who are the best in fulfilling their obligations."
[Machine] I entered upon the Prophet ﷺ in the mosque in the morning. He said to me, "Stand and pray." I had a debt owed to him, so he settled it for me and even gave me more.
[Machine] I passed by the Messenger of Allah ﷺ while I was riding a lame camel at the rear of the group. He asked me, "What is the matter with your camel?" I said, "It is either lame or stubborn, O Messenger of Allah." He then held its reins, hit it, and said, "Ride it. I have seen it since its beginning, and I have been restraining it." When we approached, I wanted to hurry ahead to meet my family, so he said, "Do not reach your family hastily." He then asked, "Are you married?" I said, "Yes." He asked, "Is she a virgin or previously married?" I said, "Previously married." He said, "Why don't you marry a virgin, so that both of you can amuse each other?" I said, "O Messenger of Allah, Abdullah (my son) has abandoned his slave girls, and I disliked bringing women of their kind to be like them, so I wanted to marry a woman who has understanding." He did not say anything to me, neither scolding nor approving. Then he said to me about my camel, "It is yours, O Messenger of Allah." I said, "It is yours, O Messenger of Allah." When he insisted, I said, "If anyone owes a debt to someone, it belongs to the creditor." He said, "Yes, send it to your family and inform Bilal to give you one dinar and increase it." So, he gave me a gold dinar and increased it by a Qirat (a unit of weight). I said, "This Qirat will never leave me, as it was an increase by the Messenger of Allah ﷺ ." I put it in a bag and it stayed with me until it was taken by the people of Sham (Greater Syria) on the day of Harrah. They mentioned it in Sahih Al-Bukhari, citing it from the hadith of Al-A'mash with a gesture, and it is also mentioned in Sahih Muslim through narration.

13.104 [Machine] What is mentioned in the details?
[Machine] The Messenger of Allah ﷺ gave me fifty wasq of dates in Khaybar and twenty sa' of barley. 'Asim ibn 'Adi came to me and said, "Do you want me to give you your share of Khaybar's wealth here in Madinah and I will take it from you in Khaybar?" She said, "No, until I ask about this." I mentioned this to 'Umar ibn al-Khattab, and he said, "Don't do it. How can you trust in that when there is a dispute between that and the narration of Ibn Abi Ghurzah and in the narration of Ibn 'Abd al-Wahhab?" She said, " 'Asim ibn 'Adi came to me during the leadership of 'Umar." And it was narrated from Ibrahim al-Nakha'i that he disliked that. And it was narrated in a raised hadith and it is weak in one narration, so I did not mention it due to its weakness.

[Machine] So he did not see any harm in it, and it was said to him, "If they take more than their amount of money, he said, "There is no harm in it if they take it with the weight of their money." And it has also been narrated from Ali, and if this is authenticated from him and from Ibn Abbas, then Allah knows best, if that is without condition, and Allah knows best.

[Machine] A man had a camel with the Prophet ﷺ, and he came to him asking for it. The Prophet ﷺ said, "Give it to him." They searched and found only an older camel above its age. The Prophet ﷺ said, "Give it to him." The man said, "You have done justice to me. May Allah make you do justice." The Messenger of Allah ﷺ said, "Indeed, the best among you is the one who is the best in giving verdicts."
[Machine] The Messenger of Allah ﷺ borrowed from a man a year, so he gave him more than a year. He then said, "The best among you are those who fulfill their commitments."
[Machine] That the Messenger of Allah ﷺ borrowed a camel-litter from a man, and as it was brought to the Prophet ﷺ , it was found that it contained four camels. Abu Rafi' (the narrator) said: "The Messenger of Allah ﷺ commanded me to give the man his camel-litter, and I searched in the camels and found nothing except four camels. So, I mentioned it to the Prophet ﷺ , and he said: 'Give it to him, for surely the best of people in their judgments are the most balanced.'"

13.106 [Machine] What came in the virtue of lending
[Machine] "To give both of them as a charity, because I lend them and they return to me, so I give them as a charity and I receive the reward for both of them twice. It is narrated from Ibn Abbas that he said, 'To lend twice is more beloved to me than giving once.' And it is narrated in that regard from Abdullah bin Amr bin al-Aas and it is narrated from Abdullah bin Mas'ud that he said, 'To lend twice is more beloved to me than giving once.' And it is narrated from him as a raised narration."
[Machine] The Messenger of Allah ﷺ said: "Whoever lends a leaf twice, it is like giving a charity once."
[Machine] He has the black one. If you wish, you can postpone it from us, as we have rights in this transaction. The merchant said to him, "I won't do it," so the black one gave him five hundred dirhams. When the merchant received it, he said to him, "It's all yours, take it." The black one said to him, "I asked you for this, and you refused." The merchant said to him, "I heard you talking about Abdullah bin Masoud, that the Prophet ﷺ used to say, 'Whoever lends something twice, will have the reward of both, even if he gives it in charity.' Abdullah bin Al-Hussain, Abu Hariz the judge of Sijistan, did exactly that." He is not strong.

13.107 [Machine] What is mentioned in the borrowing permit and the good intention for its fulfillment
[Machine] The Messenger of Allah ﷺ said, "Whoever takes people's wealth with the intention of repaying it, Allah will repay it on his behalf. And whoever takes it with the intention of wasting it, Allah will waste it."
Allah Apostle said, "If I had gold equal to the mountain of Uhud, it would not please me that anything of it should remain with me after three nights (i.e., I would spend all of it in Allah's Cause) except what I would keep for repaying debts." (Using translation from Bukhārī 6445)
[Machine] She was in debt, so she was told, "You have a debt and you are able to repay it, so you should increase the debt." [Machine] She had a debt, so someone said to her, "Why do you have a debt and you don't have the means to pay it off?" She said, "I heard the Messenger of Allah ﷺ saying, 'There is no servant who intends to repay his debt, except that Allah will provide him with assistance.' So, I seek that assistance and it has been narrated to me on another occasion from Aisha."
[Machine] The Messenger of Allah, ﷺ , said, "There is no servant who has an intention to fulfill his debt except that he will receive help from Allah. So, I seek the help mentioned in the narration of Al-Hajjaj. It is also said that it was narrated by Muhammad ibn Ali from Abdullah ibn Jafar."
[Machine] I heard the Prophet (PBUH) saying: "Indeed, Allah, the blessed and exalted, is with the debtor until he repays his debt, as long as the debt does not involve what Allah dislikes. So, he used to say to his slave, 'Take a debt for us, for I dislike going to sleep at night while having a debt. By Allah, the One whom I heard this from the Messenger of Allah (PBUH), Al-Humaydi and others have narrated it from Ibn Abi Fudayk."

[Machine] That the Messenger of Allah, ﷺ , borrowed some money, about twelve thousand, and when the Messenger of Allah, ﷺ , returned on the day of Hunayn, he came across some wealth. So, he said, "Call for me Ibn Abi Rabia." He said to him, "Take what you borrowed, may Allah bless you in your wealth and your children. Indeed, the reward for a loan is gratitude and fulfillment." Hisham said, "The reward and fulfillment. And the Messenger of Allah, ﷺ , said, 'Whoever deceives us is not one of us.'"

13.108 [Machine] What came from the intensity in debt
[Machine] A man came to the Prophet ﷺ and said, "O Messenger of Allah, if I am killed in the way of Allah, will Allah forgive my sins?" The Messenger of Allah ﷺ replied, "If you are killed in the way of Allah while being patient, expecting reward, not turning away, then Allah will forgive your sins." When the man sat down, the Prophet called him and asked, "How did you phrase your question?" So he repeated it and added, "Except for the debt." Gabriel ﷺ informed me in the same way.
"We were sitting with the Messenger of Allah when he raised his head toward the sky, and put his palm on his forehead, then he said: 'Subhan Allah, what a stern warning has been revealed! We fell silent and were scared. The following day I asked him: 'O Messenger of Allah, what is this stern warning that has been revealed? He said: 'By the One in Whose hand is my soul, if a man were to be killed in the cause of Allah then brought back to life, then killed, but he owed a debt, he would not enter paradise until his debt was paid off," (Using translation from Nasāʾī 4684)
[Machine] The Messenger of Allah ﷺ said, "Whoever leaves their physical body while free from three things, will enter Paradise: being unjust in taking the property of others, having debts, and being arrogant. And likewise."
