١٣۔ كِتَابُ الْبُيُوعِ ص ٩
[Machine] "A man from the Banu Kilab asked the Messenger of Allah ﷺ about the lineage of a male horse, and he prohibited him from doing so. So, he said, 'O Messenger of Allah, we breed and honor, thus we inquire about lineage.'"
أَنَّ رَجُلًا مِنْ بَنِي كِلَابٍ سَأَلَ رَسُولَ اللهِ ﷺ عَنْ عَسْبِ الْفَحْلِ فَنَهَاهُ عَنْ ذَلِكَ فَقَالَ يَا رَسُولَ اللهِ إِنَّا نُطْرِقُ وَنُكْرَمُ فَرَخَّصَ فِي الْكَرَامَةِ
[Machine] The Messenger of Allah ﷺ prohibited it, so he mentioned it.
نَهَى رَسُولُ اللهِ ﷺ فَذَكَرَهُ
13.85 [Machine] The prohibition of selling what you do not possess and selling what you do not own.
١٣۔٨٥ بَابُ النَّهْيِ عَنْ بَيْعِ مَا لَيْسَ عِنْدَكَ , وَبَيْعِ مَا لَا تَمْلِكُ
[Machine] The Messenger of Allah ﷺ forbade me from selling what I do not possess, and in another narration by Hammad, the Messenger of Allah ﷺ said to him, "Do not sell what you do not have."
نَهَانِي رَسُولُ اللهِ ﷺ أَنْ أَبِيعَ مَا لَيْسَ عِنْدِي وَفِي رِوَايَةِ حَمَّادٍ أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَهُ لَا تَبِعْ مَا لَيْسَ عِنْدَكَ
[Machine] That the Messenger of Allah ﷺ sent Attab bin Asid to the people of Mecca to inform them about four qualities: that two conditions should not be included in a sale, that there should be no sale with a debt, that there should be no sale of what one does not own, and that there should be no profit without guarantee.
أَنَّ رَسُولَ اللهِ ﷺ أَرْسَلَ عَتَّابَ بْنَ أَسِيدٍ إِلَى أَهْلِ مَكَّةَ أَنْ أَبْلِغْهُمْ عَنِّي أَرْبَعَ خِصَالٍ أَنْ لَا يَصْلُحَ شَرْطَانِ فِي بَيْعٍ وَلَا بَيْعٌ وَسَلَفٌ وَلَا بَيْعُ مَا لَا يَمْلِكُ وَلَا رِبْحُ مَا لَا يَضْمَنُ
13.86 [Machine] What is mentioned in the prohibition of selling wool on the back of the sheep, and milk in the udders of the sheep, and fat in the milk.
١٣۔٨٦ بَابُ مَا جَاءَ فِي النَّهْيِ عَنْ بَيْعِ الصُّوفِ عَلَى ظَهْرِ الْغَنَمِ , وَاللَّبَنِ فِي ضُرُوعِ الْغَنَمِ , وَالسَّمْنِ فِي اللَّبَنِ
[Machine] The Prophet ﷺ forbade the selling of fruits until their goodness becomes apparent. And the selling of wool on the back [of the sheep], or fat in milk, or milk in the udder. 'Umar ibn Farrukh insisted on lifting the prohibition, but he was not strong. Waki' narrated this hadith from him and others narrated it with a different chain of narrators.
نَهَى رَسُولُ اللهِ ﷺ أَنْ تُبَاعَ الثَّمَرَةُ حَتَّى يَبْدُوَ صَلَاحُهَا أَوْ يُبَاعَ صُوفٌ عَلَى ظَهْرٍ أَوْ سَمْنٌ فِي لَبَنٍ أَوْ لَبَنٌ فِي ضَرْعٍ تَفَرَّدَ بِرَفْعِهِ عُمَرُ بْنُ فَرُّوخَ وَلَيْسَ بِالْقَوِيِّ وَقَدْ أَرْسَلَهُ عَنْهُ وَكِيعٌ وَرَوَاهُ غَيْرُهُ مَوْقُوفًا

13.87 [Machine] What is mentioned in the prohibition of selling fish in water
١٣۔٨٧ بَابُ مَا جَاءَ فِي النَّهْيِ عَنْ بَيْعِ السَّمَكِ فِي الْمَاءِ
[Machine] The Prophet ﷺ said, "Do not buy fish in the water, for it is deception." This was narrated as a marfu' report and it includes correspondence between Musayyib and Ibn Mas'ud. The authentic (sahih) narration is...
قَالَ رَسُولُ اللهِ ﷺ لَا تَشْتَرُوا السَّمَكَ فِي الْمَاءِ فَإِنَّهُ غَرَرٌ هَكَذَا رُوِيَ مَرْفُوعًا وَفِيهِ إِرْسَالٌ بَيْنَ الْمُسَيِّبِ وَابْنِ مَسْعُودٍ وَالصَّحِيحُ مَا
13.88 [Machine] Prohibition of selling the rope of the spinning top.
١٣۔٨٨ بَابُ النَّهْيِ عَنْ بَيْعِ حَبَلِ الْحَبَلَةِ
Messenger of Allah ﷺ forbade the sale called 'Habal-al-Habala which was a kind of sale practiced in the Pre- Islamic Period of ignorance. One would pay the price of a she-camel which was not born yet would be born by the immediate offspring of an extant she-camel. (Using translation from Bukhārī 2143)
أَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنْ بَيْعِ حَبَلِ الْحَبَلَةِ وَكَانَ بَيْعًا يَتَبَايَعُهُ أَهْلُ الْجَاهِلِيَّةِ كَانَ يَبْتَاعُ الْجَزُورَ إِلَى أَنْ تُنْتَجَ النَّاقَةُ وَتُنْتَجَ الَّتِي فِي بَطْنِهَا
[Machine] About the Prophet ﷺ forbidding the sale of the rope of Al-Habalah.
عَنِ النَّبِيِّ ﷺ أَنَّهُ نَهَى عَنْ بَيْعِ حَبَلِ الْحَبَلَةِ
[Machine] The people of ignorance used to sell the jazoor until the hable al-habalata, and the hable al-habalata would produce what was in the camel's stomach and then the one that produced it would carry it. The Messenger of Allah ﷺ prohibited them from that. Abu Abdullah al-Hafiz Muhammad bin Ibrahim informed us, narrating from Ahmad bin Salamah, narrating from Muhammad bin al-Muthanna, narrating from Yahya bin Saeed, who mentioned it in a similar manner except that he said they used to sell the meat of the jazoor.
كَانَ أَهْلُ الْجَاهِلِيَّةِ يَبْتَاعُونَ الْجَزُورَ إِلَى حَبَلِ الْحَبَلَةِ وَحَبَلُ الْحَبَلَةِ أَنْ تُنْتَجَ النَّاقَةُ مَا فِي بَطْنِهَا ثُمَّ تَحْمِلَ الَّتِي تُنْتَجُ فَنَهَاهُمْ رَسُولُ اللهِ ﷺ عَنْ ذَلِكَ وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنا مُحَمَّدُ بْنُ إِبْرَاهِيمَ ثنا أَحْمَدُ بْنُ سَلَمَةَ ثنا مُحَمَّدُ بْنُ الْمُثَنَّى ثنا يَحْيَى بْنُ سَعِيدٍ فَذَكَرَهُ بِنَحْوِهِ إِلَّا أَنَّهُ قَالَ يَبِيعُونَ لَحْمَ الْجَزُورِ
[Machine] He used to say that there is no usury in animals and that animals are prohibited from three things: the nodes, the malaqih, and the hawala rope. The nodes are in the stomachs of female camels, and the malaqih are on the backs of camels. The Sheikh said, in another narration from Al-Muzani, from Al-Shafi'i, that the nodes are on the backs of camels, and the malaqih are in the stomachs of female camels. Abu Ubaid also explained it in the same way.
أَنَّهُ كَانَ يَقُولُ لَا رِبَا فِي الْحَيَوَانِ وَإِنَّمَا نُهِيَ مِنَ الْحَيَوَانِ عَنْ ثَلَاثٍ عَنِ الْمَضَامِينِ وَالْمَلَاقِيحِ وَحَبَلِ الْحَبَلَةِ وَالْمَضَامِينُ مَا فِي بُطُونِ إِنَاثِ الْإِبِلِ وَالْمَلَاقِيحُ مَا فِي ظُهُورِ الْجَمَالِ قَالَ الشَّيْخُ وَفِي رِوَايَةِ الْمُزَنِيِّ عَنِ الشَّافِعِيِّ أَنَّهُ قَالَ الْمَضَامِينُ مَا فِي ظُهُورِ الْجَمَالِ وَالْمَلَاقِيحُ مَا فِي بُطُونِ إِنَاثِ الْإِبِلِ وَكَذَلِكَ فَسَّرَهُ أَبُو عُبَيْدٍ
[Machine] Narrated by Abu Abdullah, on the authority of ibn Umar, who said: The Prophet ﷺ forbade the sale of a pack of animals for what is inside the belly of a female camel. The Sheikh said: This Hadith is specific to Musa bin Ubaidah. Yahya bin Ma'een disapproved of Musa for reporting this, and it was one of the causes for considering him weak. Abu Muhammad al-Sukkari narrated to us on the authority of Abu Bakr al-Shafi'i, on the authority of Ja'far bin Muhammad bin al-Azhar, on the authority of al-Mufaddal bin Ghasan, on the authority of Yahya bin Ma'een that he mentioned it. Imam Ahmad also mentioned it.
عَنِ النَّبِيِّ ﷺ أَنَّهُ نَهَى عَنِ الْمَجْرِ فَأَخْبَرَنَاهُ أَبُو عَبْدِ الرَّحْمَنِ السُّلَمِيُّ أنا أَبُو الْحَسَنِ الْكَارِزِيُّ ثنا عَلِيُّ بْنُ عَبْدِ الْعَزِيزِ ثنا أَبُو عُبَيْدٍ حَدَّثَنِي زَيْدُ بْنُ الْحُبَابِ عَنْ مُوسَى بْنِ عُبَيْدَةَ عَنْ عَبْدِ اللهِ بْنِ دِينَارٍ عَنِ ابْنِ عُمَرَ عَنِ النَّبِيِّ ﷺ بِذَلِكَ قَالَ أَبُو عُبَيْدٍ قَالَ أَبُو زَيْدٍ الْمَجْرُ أَنْ يُبَاعَ الْبَعِيرُ أَوْ غَيْرُهُ بِمَا فِي بَطْنِ النَّاقَةِ قَالَ الشَّيْخُ وَهَذَا الْحَدِيثُ بِهَذَا اللَّفْظِ تَفَرَّدَ بِهِ مُوسَى بْنُ عُبَيْدَةَ قَالَ يَحْيَى بْنُ مَعِينٍ فَأُنْكِرَ عَلَى مُوسَى هَذَا وَكَانَ مِنْ أَسْبَابِ تَضْعِيفِهِ 10865 أَخْبَرَنَاهُ أَبُو مُحَمَّدٍ السُّكَّرِيُّ أنا أَبُو بَكْرٍ الشَّافِعِيُّ ثنا جَعْفَرُ بْنُ مُحَمَّدِ بْنِ الْأَزْهَرِ ثنا الْمُفَضَّلُ بْنُ غَسَّانَ عَنْ يَحْيَى بْنِ مَعِينٍ فَذَكَرَهُ قَالَ الْإِمَامُ أَحْمَدُ وَقَدْ
13.89 [Machine] Prohibition of Selling Touchables and Thrown Objects
١٣۔٨٩ بَابُ النَّهْيِ عَنْ بَيْعِ الْمُلَامَسَةِ وَالْمُنَابَذَةِ
[Machine] The Messenger of Allah ﷺ forbade touching and pushing away.
أَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنِ الْمُلَامَسَةِ وَالْمُنَابَذَةِ
Two types of trarisactions have been forbidden (by the Holy Prophet), al-Mlulamasa and al-Munabadha. As far as Mulamasa transaction is concerned, it is that every one of them (the parties entering into transaction) should touch the garment of the other without careful consideration, and al-Munabadha is that every one of them should throw his cloth to the other and one of them should not see the cloth of his friend. فَأَنْ يَلْمِسَ كُلُّ وَاحِدٍ مِنْهُمَا ثَوْبَ صَاحِبِهِ بِغَيْرِ تَأَمُّلٍ وَالْمُنَابَذَةُ أَنْ يَنْبُذَ كُلُّ وَاحِدٍ مِنْهُمَا ثَوْبَهُ إِلَى الْآخَرِ وَلَمْ يَنْظُرْ وَاحِدٌ مِنْهُمَا إِلَى ثَوْبِ صَاحِبِهِ
Messenger of Allah ﷺ forbade two ways of wearing clothes and two kinds of dealings. (A) He forbade the dealings of the Mulamasa and the Munabadha. In the Mulamasa transaction the buyer just touches the garment he wants to buy at night or by daytime, and that touch would oblige him to buy it. In the Munabadha, one man throws his garment at another and the latter throws his at the former and the barter is complete and valid without examining the two objects or being satisfied with them (B) The two ways of wearing clothes were Ishtimal-as-Samma, i e., to cover one's shoulder with one's garment and leave the other bare: and the other way was to wrap oneself with a garment while one was sitting in such a way that nothing of that garment would cover one's private part. نَهَى رَسُولُ اللهِ ﷺ عَنْ /لِبْسَتَيْنِ وَبَيْعَتَيْنِ نَهَى عَنِ الْمُلَامَسَةِ وَالْمُنَابَذَةِ فِي الْبَيْعِ وَالْمُلَامَسَةُ لَمْسُ الرَّجُلِ ثَوْبَ الْآخَرِ بِيَدِهِ بِاللَّيْلِ أَوِ النَّهَارِ لَا يُقَلِّبُهُ إِلَّا ذَلِكَ وَالْمُنَابَذَةُ أَنْ يَنْبُذَ الرَّجُلُ إِلَى الرَّجُلِ ثَوْبَهُ وَيَنْبُذَ الْآخَرُ ثَوْبَهُ وَيَكُونُ ذَلِكَ بَيْعَهُمَا عَنْ غَيْرِ نَظَرٍ وَلَا تَرَاضٍ وَاللِّبْسَتَانِ اشْتِمَالُ الصَّمَّاءِ وَالصَّمَّاءُ أَنْ يَجْعَلَ ثَوْبَهُ عَلَى أَحَدِ عَاتِقَيْهِ فَيَبْدُوَ أَحَدُ شِقَّيْهِ لَيْسَ عَلَيْهِ ثَوْبٌ وَاللِّبْسَةُ الْأُخْرَى احْتِبَاؤُهُ بِثَوْبِهِ لَيْسَ عَلَى فَرْجِهِ مِنْهُ شَيْءٌ
[Machine] He said: The Messenger of Allah ﷺ forbade touching and throwing in sales, and then he explained the explanation that was mentioned in the hadith of Al-Layth.
أَنَّهُ قَالَ نَهَى رَسُولُ اللهِ ﷺ عَنِ الْمُلَامَسَةِ وَالْمُنَابَذَةِ فِي الْبَيْعِ ثُمَّ فَسَّرَ هَذَا التَّفْسِيرَ الَّذِي مَضَى فِي حَدِيثِ اللَّيْثِ
[Machine] The Messenger of Allah ﷺ forbade the two types of bay'ah (transaction) and the two types of clothing. As for the two types of bay'ah, they are touching and throwing. And as for the two types of clothing, they are a woman covering her face completely, and a man wrapping himself in a single garment without anything covering his private parts.
نَهَى رَسُولُ اللهِ ﷺ عَنْ بَيْعَتَيْنِ وَعَنْ لِبْسَتَيْنِ فَأَمَّا الْبَيْعَتَانِ فَالْمُلَامَسَةُ وَالْمُنَابَذَةُ وَأَمَّا اللِّبْسَتَانِ فَاشْتِمَالُ الصَّمَّاءِ وَاحْتِبَاءُ الرَّجُلِ فِي الثَّوْبِ الْوَاحِدِ لَيْسَ عَلَى فَرْجِهِ مِنْهُ شَيْءٌ
"Wearing the samma' means that a man puts his garment over his left shoulder and keeps his right side uncovered. Munabadhah means that a man says (to another): If I throw this garment to you, the sale will be certain. Mulamasah means that a man touches it (another's garment) with his hand and neither he unfolds it nor turns it over. When he touched it, the sale becomes binding. عَنِ النَّبِيِّ ﷺ بِهَذَا الْحَدِيثِ زَادَ فَاشْتِمَالُ الصَّمَّاءِ يَشْتَمِلُ فِي ثَوْبٍ وَاحِدٍ يَضَعُ طَرَفَيِ الثَّوْبِ عَلَى عَاتِقِهِ الْأَيْسَرِ وَيُبْرِزُ شِقَّهُ الْأَيْمَنَ قَالَ وَالْمُنَابَذَةُ أَنْ يَقُولَ إِذَا نَبَذْتُ هَذَا الثَّوْبَ فَقَدْ وَجَبَ الْبَيْعُ وَالْمُلَامَسَةُ أَنْ يَمَسَّهُ بِيَدِهِ وَلَا يَنْشُرَهُ وَلَا يُقَلِّبَهُ إِذَا مَسَّهُ وَجَبَ الْبَيْعُ
13.90 [Machine] The prohibition of selling stones.
١٣۔٩٠ بَابُ النَّهْيِ عَنْ بَيْعِ الْحَصَاةِ
[Machine] The Messenger of Allah ﷺ prohibited the sale of Gharar (ambiguous transactions) and the sale of stones. Abu Abdullah Al-Hafiz informed us, Abu Bakr ibn Balawiyyah narrated to us, Musa ibn Harun told me that Zuhayr ibn Harb narrated to us, and Yahya ibn Sa'id narrated to us, from Ubaidullah who said: Abu Zinad mentioned it in a similar way.
أَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنْ بَيْعِ الْغَرَرِ وَعَنْ بَيْعِ الْحَصَاةِ 10873 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنا أَبُو بَكْرِ بْنُ بَالَوَيْهِ ثنا مُوسَى بْنُ هَارُونَ حَدَّثَنِي زُهَيْرُ بْنُ حَرْبٍ ثنا يَحْيَى بْنُ سَعِيدٍ عَنْ عُبَيْدِ اللهِ قَالَ حَدَّثَنِي أَبُو الزِّنَادِ فَذَكَرَهُ بِنَحْوِهِ
13.91 [Machine] Prohibition of selling slaves
١٣۔٩١ بَابُ النَّهْيِ عَنْ بَيْعِ الْعُرْبَانِ
[Machine] He said: The Messenger of Allah ﷺ prohibited the sale of unborn animals. Ibn Wahb said: Malik said to me, and that is what we see, and Allah knows best, that if a man buys a slave or a female slave or engages in renting, and then he says to the one he bought or rented from, I will give you a dinar or a dirham or more than that or less, on the condition that I take the merchandise or ride the animal that I rented from you, then what I gave you is part of the price of the merchandise or the rent of the animal. But if I leave the house or the rent, then what I gave you is null and void without any obligation. The sheikh said: thus narrated Malik bin Anas this hadith in the Muwatta, but he did not mention the narrator.
أَنَّهُ قَالَ نَهَى رَسُولُ اللهِ ﷺ عَنْ بَيْعِ الْعُرْبَانِ قَالَ ابْنُ وَهْبٍ فَقَالَ لِي مَالِكٌ وَذَلِكَ فِيمَا نَرَى وَاللهُ أَعْلَمُ أَنْ يَشْتَرِيَ الرَّجُلُ الْعَبْدَ أَوِ الْأَمَةَ أَوْ يَتَكَارَى الْكِرَاءَ ثُمَّ يَقُولُ لِلَّذِي اشْتَرَى أَوْ تَكَارَى مِنْهُ أُعْطِيكَ دِينَارًا أَوْ دِرْهَمًا أَوْ أَكْثَرَ مِنْ ذَلِكَ أَوْ أَقَلَّ عَلَى أَنِّي إِنْ أَخَذْتُ السِّلْعَةَ أَوْ رَكِبْتُ مَا تَكَارَيْتُ مِنْكَ فَالَّذِي أَعْطَيْتُكَ هُوَ مِنْ ثَمَنِ السِّلْعَةِ أَوْ مِنْ كِرَاءِ الدَّابَّةِ وَإِنْ تَرَكْتُ الْبَيْتَ أَوِ الْكِرَاءَ فَمَا أَعْطَيْتُكَ فَهُوَ لَكَ بَاطِلٌ بِغَيْرِ شَيْءٍ قَالَ الشَّيْخُ هَكَذَا رَوَى مَالِكُ بْنُ أَنَسٍ هَذَا الْحَدِيثَ فِي الْمُوَطَّأِ لَمْ يُسَمِّ مَنْ
13.92 [Machine] Prohibition of Two Sales in One Sale
١٣۔٩٢ بَابُ النَّهْيِ عَنْ بَيْعَتَيْنِ فِي بَيْعَةٍ
[Machine] The Prophet ﷺ prohibited the practice of two sales in one sale, and in a narration, Yahya said that the Messenger of Allah ﷺ forbade two sales in one sale. Abdul Wahhab said, meaning that one would say to the other, "I will give you ten with one payment, and ninety with another." And likewise...
أَنَّ النَّبِيَّ ﷺ نَهَى عَنْ بَيْعَتَيْنِ فِي بَيْعَةٍ وَفِي رِوَايَةِ يَحْيَى قَالَ نَهَى رَسُولُ اللهِ ﷺ عَنْ بَيْعَتَيْنِ فِي بَيْعَةٍ قَالَ عَبْدُ الْوَهَّابِ يَعْنِي يَقُولُ هُوَ لَكَ بِنَقْدٍ بِعَشَرَةٍ وَبِنَسِيئَةٍ بِعِشْرِينَ وَكَذَلِكَ
[Machine] The Messenger of Allah ﷺ said: "Whoever sells two sales in one transaction, he has the option to take one of them or receive riba (interest)." Abu Abdullah Al-Hafiz informed us, Abdullah ibn Muhammad Al-Saydalani narrated to us, Ismail ibn Qutaybah narrated to us, Abu Bakr ibn Abi Shaybah narrated to us, Yahya ibn Zakariya mentioned it.
قَالَ رَسُولُ اللهِ ﷺ مَنْ بَاعَ بَيْعَتَيْنِ فِي بَيْعَةٍ فَلَهُ أَوْكَسُهُمَا أَوِ الرِّبَا أَخْبَرَنَاهُ أَبُو عَبْدِ اللهِ الْحَافِظُ أَخْبَرَنِي عَبْدُ اللهِ بْنُ مُحَمَّدٍ الصَّيْدَلَانِيُّ ثنا إِسْمَاعِيلُ بْنُ قُتَيْبَةَ ثنا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ ثنا يَحْيَى بْنُ زَكَرِيَّا فَذَكَرَهُ
[Machine] The Prophet ﷺ prohibited the sale of debt and the combination of two sales in one transaction, and the sale of what you do not own. The Prophet ﷺ said, "It is forbidden to sell what is not in your possession."
أَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنْ بَيْعٍ وَسَلَفٍ وَعَنْ بَيْعَتَيْنِ فِي صَفْقَةٍ وَاحِدَةٍ وَعَنْ بَيْعِ مَا لَيْسَ عِنْدَكَ وَقَالَ رَسُولُ اللهِ ﷺ حَرَامٌ شَفُّ مَا لَمْ يُضْمَنْ
13.93 [Machine] Prohibition of Tattooing
١٣۔٩٣ بَابُ النَّهْيِ عَنِ النَّجْشِ
أَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنِ النَّجْشِ
[Machine] Abu Al-Abbas Al-Asamm narrated that Al-Rabi' and Al-Shafi'i and Sufyan and Ibn Shihab and Ibn Al-Musayyib and Abu Hurairah said that the Messenger of Allah ﷺ said, "Do not try to outbid each other." And I (Al-Shafi'i) and Sufyan and Malik and Abu Al-Zinad and Al-A'raj and Abu Hurairah narrated the Prophet ﷺ saying the same. And Al-Shafi'i and Sufyan and Malik narrated from Abu Al-Zinad and Ayyub and Ibn Sireen from Abu Hurairah that the Prophet ﷺ said the same.
ثنا أَبُو الْعَبَّاسِ الْأَصَمُّ أنا الرَّبِيعُ أنا الشَّافِعِيُّ أنا سُفْيَانُ عَنِ ابْنِ شِهَابٍ عَنِ ابْنِ الْمُسَيِّبِ عَنْ أَبِي هُرَيْرَةَ قَالَ قَالَ رَسُولُ اللهِ ﷺ لَا تَنَاجَشُوا 10883 قَالَ وَأنا الشَّافِعِيُّ أنا سُفْيَانُ وَمَالِكٌ عَنْ أَبِي الزِّنَادِ عَنِ الْأَعْرَجِ عَنْ أَبِي هُرَيْرَةَ عَنِ النَّبِيِّ ﷺ مِثْلَهُ 10884 قَالَ وَأَخْبَرَنَا الشَّافِعِيُّ أنا سُفْيَانُ وَمَالِكٌ عَنْ أَبِي الزِّنَادِ عَنْ أَيُّوبَ عَنِ ابْنِ سِيرِينَ عَنْ أَبِي هُرَيْرَةَ عَنِ النَّبِيِّ ﷺ مِثْلَهُ
[Machine] That a man attends the goods being sold and he gives something for it, but he does not intend to buy it; the horse sellers follow his example and they give more for it than they would have given if they had not heard his bidding. So, whoever incites or encourages (others) to bid is considered a transgressor, if he knows about the prohibition of the Messenger of Allah ﷺ . He ﷺ said: "And selling is permissible, and it is not spoiled by the disobedience of a man who incites (others to bid)." He ﷺ said: "And there had been a sale made with someone who exceeded the covenant of the Messenger of Allah ﷺ , and the sale is valid." And it is allowed that someone who does not intend to buy adds to the price.
أَنْ يَحْضُرَ الرَّجُلُ السِّلْعَةَ تُبَاعُ فَيُعْطِي بِهَا الشَّيْءَ وَهُوَ لَا يُرِيدُ شِرَاءَهَا؛ لِيَقْتَدِيَ بِهِ السُّوَّامُ فَيُعْطُونَ بِهَا أَكْثَرَ مِمَّا كَانُوا يُعْطُونَ لَوْ لَمْ يَسْمَعُوا سَوْمَهُ فَمَنْ نَجَشَ فَهُوَ عَاصٍ بِالنَّجْشِ إِنْ كَانَ عَالِمًا بِنَهْيِ رَسُولِ اللهِ ﷺ قَالَ وَالْبَيْعُ جَائِزٌ لَا يُفْسِدُهُ مَعْصِيَةُ رَجُلٍ نَجَشَ عَلَيْهِ قَالَ وَقَدْ بِيعَ فِيمَنْ يَزِيدُ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ فَجَازَ الْبَيْعُ وَقَدْ يَجُوزُ أَنْ يَكُونَ زَادَ مَنْ لَا يُرِيدُ الشِّرَاءَ
[Machine] The Prophet ﷺ called out for a rope and a pot to hang from, asking who would like to contribute. A man gave him a dirham, and another man gave him two dirhams, so he sold it.
أَنَّ النَّبِيَّ ﷺ نَادَى عَلَى حِلْسٍ وَقَدَحٍ فِيمَنْ يَزِيدُ فَأَعْطَاهُ رَجُلٌ دِرْهَمًا وَأَعْطَاهُ آخَرُ دِرْهَمَيْنِ فَبَاعَهُ
[Machine] The Messenger of Allah ﷺ prohibited anyone from selling to his brother until he leaves, except for spoils of war and inheritances. And likewise.
نَهَى رَسُولُ اللهِ ﷺ أَنْ يَبِيعَ أَحَدُكُمْ عَلَى بَيْعِ أَخِيهِ حَتَّى يَذَرَ إِلَّا الْغَنَائِمَ وَالْمَوَارِيثَ وَكَذَلِكَ
13.94 [Machine] None of you should sell to each other
١٣۔٩٤ بَابٌ: لَا يَبِيعُ بَعْضُكُمْ عَلَى بَيْعِ بَعْضٍ
[Machine] The Prophet ﷺ said, "None of you should sell anything over the sale of another. In the narration of Abu Zakariyya, he said, 'None of you should sell.'"
أَنَّ النَّبِيَّ ﷺ قَالَ لَا يَبِعْ بَعْضُكُمْ عَلَى بَيْعِ بَعْضٍ وَفِي رِوَايَةِ أَبِي زَكَرِيَّا لَا يَبِيعُ
[Machine] "That the Messenger of Allah ﷺ said, 'None of you should sell upon the sale of his brother, nor propose to the betrothed of his brother, except with his permission.'"
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا يَبِيعَنَّ أَحَدُكُمْ عَلَى بَيْعِ أَخِيهِ وَلَا يَخْطُبْ عَلَى خِطْبَةِ أَخِيهِ إِلَّا بِإِذْنِهِ
[Machine] "From the Prophet ﷺ, he said: 'Do not compete in prices, nor should one who has already made an offer sell his goods to someone else, and a man should not propose to a woman who has already been proposed to. And a woman should not ask for her sister's divorce in order to take what is in her possession.' And Abu 'Abdullah Al-Hafiz narrated to us, and Abu 'Amr ibn Abi Ja'far narrated to me, and I am Abu Ya'la narrated to 'Amr ibn Muhammad Al-Naqid, who narrated from Sufyan, and he mentioned it with its chain of narration, with the exception that he said that the Prophet ﷺ conveyed it, and he added: 'And a man should not name a price for his brother's offer.' This was narrated by Al-Bukhari in his Sahih from 'Ali ibn Al-Madini, and it was narrated by Muslim from Zuhair ibn Harb and others from Sufyan, and it was also narrated by 'Amr ibn Muhammad Al-Naqid with an addition."
عَنِ النَّبِيِّ ﷺ قَالَ لَا تَنَاجَشُوا وَلَا يَبِعْ حَاضِرٌ لِبَادٍ وَلَا يَبِعِ الرَّجُلُ عَلَى بَيْعِ أَخِيهِ وَلَا يَخْطُبْ عَلَى خِطْبَتِهِ وَلَا تَسْأَلِ الْمَرْأَةُ طَلَاقَ أُخْتِهَا لِتُكْفِئَ مَا فِي إِنَائِهَا 10891 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أَخْبَرَنِي أَبُو عَمْرِو بْنُ أَبِي جَعْفَرٍ أنا أَبُو يَعْلَى ثنا عَمْرُو بْنُ مُحَمَّدٍ النَّاقِدُ ثنا سُفْيَانُ فَذَكَرَهُ بِإِسْنَادِهِ نَحْوَهُ إِلَّا أَنَّهُ قَالَ يَبْلُغُ بِهِ النَّبِيَّ ﷺ وَزَادَ وَلَا يَسُمِ الرَّجُلُ عَلَى سَوْمِ أَخِيهِ وَرَوَاهُ الْبُخَارِيُّ فِي الصَّحِيحِ عَنْ عَلِيِّ بْنِ الْمَدِينِيِّ وَرَوَاهُ مُسْلِمٌ عَنْ زُهَيْرِ بْنِ حَرْبٍ وَغَيْرِهِ عَنْ سُفْيَانَ وَرَوَاهُ أَيْضًا عَنْ عَمْرِو بْنِ مُحَمَّدٍ النَّاقِدِ بِزِيَادَتِهِ
[Machine] "That the Messenger of Allah ﷺ said: 'None of you should sell something that another person has already bought.' This is narrated in Sahih Hadith of Malik, and Imam Shafi'i (may Allah have mercy on him) also endorsed it. It applies to anyone who buys an item from someone, and they have not separated (from each other) until another person comes to him and offers him the same item or something better than it at a lower price. In this case, the seller can revoke the sale because he still has the option before the separation. If this happens, it will be considered corruption, even though Allah has forbidden disobedience when one has knowledge of the Hadith, and the sale in this case becomes obligatory."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا يَبِيعُ بَعْضُكُمْ عَلَى بَيْعِ بَعْضٍ أَخْرَجَاهُ فِي الصَّحِيحِ مِنْ حَدِيثِ مَالِكٍ وَقَدْ حَمَلَهُ الشَّافِعِيُّ رَحِمَهُ اللهُ عَلَى مَنِ اشْتَرَى مِنْ رَجُلٍ سِلْعَةً فَلَمْ يَتَفَرَّقَا حَتَّى أَتَاهُ آخَرُ فَعَرَضَ عَلَيْهِ مِثْلَ سِلْعَتِهِ أَوْ خَيْرًا مِنْهَا بِأَقَلَّ مِنَ الثَّمَنِ فَيَفْسَخُ بَيْعَ صَاحِبِهِ فَإِنَّ لَهُ الْخِيَارَ قَبْلَ التَّفَرُّقِ فَيَكُونُ هَذَا فَسَادًا وَقَدْ عَصَى اللهَ إِذَا كَانَ بِالْحَدِيثِ عَالِمًا وَالْبَيْعُ فِيهِ لَازِمٌ
13.95 [Machine] Do not outbid each other on your brother's bid
١٣۔٩٥ بَابٌ: لَا يَسُومُ أَحَدُكُمْ عَلَى سَوْمِ أَخِيهِ
[Machine] From the Prophet ﷺ that he said: "None of you should outbid his brother upon his bid. If it is certain and I am not certain about it, then it is similar to one who does not propose to his brother's betrothed and does not outbid his bid when the seller is satisfied and allows the sale to take place before the final sale. Even if he sells, he must abide by this. The Messenger of Allah ﷺ bought from someone who added and sold to someone who added to his brother's bid. However, the seller was not satisfied with the first bid until he sought an increase. Abu Abdullah al-Hafiz informed us, Abu al-Abbas informed us, Rabi' informed us, and al-Shafi'i mentioned it. The sheikh said: The hadith of outbidding has been proven from multiple angles."
عَنِ النَّبِيِّ ﷺ أَنَّهُ قَالَ لَا يَسُومُ أَحَدُكُمْ عَلَى سَوْمِ أَخِيهِ فَإِنْ كَانَ ثَابِتًا وَلَسْتُ أَحْفَظُهُ ثَابِتًا فَهُوَ مِثْلَ لَا يَخْطُبُ أَحَدُكُمْ عَلَى خِطْبَةِ أَخِيهِ وَلَا يَسُومُ عَلَى سَوْمِهِ إِذَا رَضِيَ الْبَائِعُ وَأَذِنَ بِأَنْ يُبَاعَ قَبْلَ الْبَيْعِ حَتَّى لَوْ بِيعَ لَزِمَهُ قَالَ وَرَسُولُ اللهِ ﷺ بَاعَ فِيمَنْ يَزِيدُ وَبَيْعُ مَنْ يَزِيدُ سَوْمُ رَجُلٍ عَلَى سَوْمِ أَخِيهِ وَلَكِنَّ الْبَائِعَ لَمْ يَرْضَ السَّوْمَ الْأَوَّلَ حَتَّى طَلَبَ الزِّيَادَةَ أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنا أَبُو الْعَبَّاسِ أنا الرَّبِيعُ أنا الشَّافِعِيُّ فَذَكَرَهُ قَالَ الشَّيْخُ حَدِيثُ السَّوْمِ قَدْ ثَبَتَ مِنْ أَوْجُهٍ
[Machine] The Messenger of Allah ﷺ forbade a person from outbidding his brother and mentioned other terms that have been previously mentioned in the chapter of trade.
أَنَّ رَسُولَ اللهِ ﷺ نَهَى أَنْ يَسْتَامَ الرَّجُلُ عَلَى سَوْمِ أَخِيهِ وَذَكَرَ سَائِرَ الْأَلْفَاظِ الَّتِي قَدْ مَضَتْ فِي بَابِ التَّصْرِيَةِ
[Machine] Narrated by the Prophet ﷺ that he forbade a person from outbidding his brother in a purchase and from proposing marriage to a woman who has already been proposed to by his brother.
عَنِ النَّبِيِّ ﷺ أَنَّهُ نَهَى أَنْ يَسْتَامَ الرَّجُلُ عَلَى سَوْمِ أَخِيهِ وَأَنْ يَخْطُبَ عَلَى خِطْبَةِ أَخِيهِ
[Machine] The Messenger of Allah, may ﷺ , said, "A Muslim should not attribute his fasting to the fasting of another Muslim." Abu Abdullah al-Hafiz narrated to us, Abu Ahmad al-Hafiz informed me, I am Muhammad ibn Ishaq, Abu Bakr narrated to us, Ali ibn Hujr narrated to us, Ismail ibn Jafar mentioned it.
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا يَسُمِ الْمُسْلِمُ عَلَى سَوْمِ الْمُسْلِمِ أَخْبَرَنَاهُ أَبُو عَبْدِ اللهِ الْحَافِظُ أَخْبَرَنِي أَبُو أَحْمَدَ الْحَافِظُ أنا مُحَمَّدُ بْنُ إِسْحَاقَ أَبُو بَكْرٍ ثنا عَلِيُّ بْنُ حُجْرٍ ثنا إِسْمَاعِيلُ بْنُ جَعْفَرٍ فَذَكَرَهُ
A man must not make proposal of marriage to a woman when his brother has done so already. And he must not offer a price for a thing for which his brother had already offered a price; and a woman must not be combined in marriage with her father's sister, nor with her mother's sister, and a woman must not ask to have her sister divorced in order to deprive her of what belongs to her, but she must marry, because she will have what Allah has decreed for her. قَالَ رَسُولُ اللهِ ﷺ لَا يَخْطُبُ الرَّجُلُ عَلَى خِطْبَةِ أَخِيهِ وَلَا يَسُومُ عَلَى سَوْمِ أَخِيهِ وَلَا تُنْكَحُ الْمَرْأَةُ عَلَى عَمَّتِهَا وَلَا عَلَى خَالَتِهَا وَلَا تَسْأَلُ الْمَرْأَةُ طَلَاقَ أُخْتِهَا؛ لِتُكْفِئَ مَا فِي صَحْفَتِهَا وَلِتُنْكَحَ إِنَّمَا لَهَا مَا كَتَبَ اللهُ لَهَا
[Machine] The Messenger of Allah ﷺ said, "One of you should not fast on his brother's fast, nor should he propose to the one who has already been proposed to, and this is the wording."
قَالَ رَسُولُ اللهِ ﷺ لَا يَسُومَنَّ أَحَدُكُمْ عَلَى سَوْمِ أَخِيهِ وَلَا يَخْطُبْ عَلَى خِطْبَتِهِ وَبِهَذَا اللَّفْظِ
A believer is the brother of a believer, so it is not lawful for a believer to outbid his brother, and he should not propose an engagement when his brother has thus proposed until he gives it up. (Using translation from Muslim 1414)
أَنَّهُ سَمِعَ عُقْبَةَ بْنَ عَامِرٍ عَلَى الْمِنْبَرِ يَقُولُ إِنَّ رَسُولَ اللهِ ﷺ قَالَ الْمُؤْمِنُ أَخُو الْمُؤْمِنِ وَلَا يَحِلُّ لِمُؤْمِنٍ أَنْ يَبْتَاعَ عَلَى بَيْعِ أَخِيهِ حَتَّى يَذَرَ وَلَا يَخْطُبَ عَلَى خِطْبَةِ أَخِيهِ حَتَّى يَذَرَ
13.96 [Machine] He does not sell a gift for an eggplant. The narration of Ibn Musayyib has passed, from Abu Hurairah in that.
١٣۔٩٦ بَابٌ: لَا يَبِيعُ حَاضِرٌ لِبَادٍ قَدْ مَضَى حَدِيثُ ابْنِ الْمُسَيِّبِ , عَنْ أَبِي هُرَيْرَةَ فِي ذَلِكَ
[Machine] The Messenger of Allah ﷺ said: "Do not engage in monetary disputes (i.e. bargaining back and forth), and do not sell what is already sold to another person, and a man should not sell over the sale of his brother, and do not propose to a woman who is already engaged."
قَالَ رَسُولُ اللهِ ﷺ لَا تَنَاجَشُوا وَلَا يَبِيعُ حَاضِرٌ لِبَادٍ وَلَا يَبِيعُ الرَّجُلُ عَلَى بَيْعِ أَخِيهِ وَلَا يَخْطُبُ عَلَى خُطْبَتِهِ
[Machine] The Messenger of Allah ﷺ said, "Monks are not to be sold or sold to, and none of you should sell to each other, and do not argue. A present should not be sold for profit, and do not urge the sale of camels and sheep. Whoever buys them after that is in the better of the two sights, after he has milked them. If he is pleased with them, he may keep them, but if he is displeased, he may return them, and a measurement of dates."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا يُتَلَقَّى الرُّكْبَانُ لِلْبَيْعِ وَلَا يَبِيعُ بَعْضُكُمْ عَلَى بَيْعِ بَعْضٍ وَلَا تَنَاجَشُوا وَلَا يَبِيعُ حَاضِرٌ لِبَادٍ وَلَا تُصَرُّوا الْإِبِلَ وَالْغَنَمَ فَمَنِ ابْتَاعَهَا بَعْدَ ذَلِكَ فَهُوَ بِخَيْرِ النَّظَرَيْنِ بَعْدَ أَنْ يَحْلُبَهَا فَإِنْ رَضِيَهَا أَمْسَكَهَا وَإنْ سَخِطَهَا رَدَّهَا وَصَاعًا مِنْ تَمْرٍ
[Machine] The Messenger of Allah ﷺ said: "A seller should not make a sale for a present buyer." He ﷺ was asked, "What does it mean for a seller to make a sale for a present buyer?" He ﷺ said, "Do not be an intermediary for him."
قَالَ رَسُولُ اللهِ ﷺ لَا يَبِيعُ حَاضِرٌ لِبَادٍ قَالَ قُلْتُ مَا لَا يَبِيعُ حَاضِرٌ لِبَادٍ؟ قَالَ لَا تَكُنْ لَهُ سِمْسَارًا
نُهِينَا أَنْ يَبِيعَ حَاضِرٌ لِبَادٍ
The Prophet ﷺ said: A townsman must not sell for a man from the desert, even if he is his brother or father. Abu Dawud said: Anas b. Malik said: It was said: A townsman must not sell for a man from the desert. This phrase carries a broad meaning. It means that the (the townsman) must not sell anything for him or buy anything for him. (Using translation from Abū Dāʾūd 3440)
عَنِ النَّبِيِّ ﷺ قَالَ لَا يَبِيعُ حَاضِرٌ لِبَادٍ وَإنْ كَانَ أَخَاهُ أَوْ أَبَاهُ
[Machine] The Messenger of Allah ﷺ said, "A seller should not sell goods to one who is persistent. Let people be provided for from each other."
قَالَ رَسُولُ اللهِ ﷺ لَا يَبِيعُ حَاضِرٌ لِبَادٍ دَعُوا النَّاسَ يُرْزَقْ بَعْضُهُمْ مِنْ بَعْضٍ
[Machine] "The Messenger of Allah ﷺ said: 'Do not sell what is present for what is absent." This hadith is narrated through this chain of transmission, considered among the individuals of Shafi'i from Malik."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا يَبِيعُ حَاضِرٌ لِبَادٍ هَذَا الْحَدِيثُ بِهَذَا الْإِسْنَادِ مِمَّا يُعَدُّ فِي أَفْرَادِ الشَّافِعِيِّ عَنْ مَالِكٍ
[Machine] The Messenger of Allah ﷺ said, "One who is present should not sell to one who is absent." And Abu Bakr al-Ardastani narrated to us that Qadi Abu Nasr Shuayb ibn Ali al-Hamdani informed him, narrating from Abdul Rahman ibn Muhammad, who narrated from Ibrahim ibn Nasr al-Razi, who narrated from Abdullah ibn Muslimah al-Qa'ni, who mentioned it in a similar manner, and he had already been mentioned.
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا يَبِيعُ حَاضِرٌ لِبَادٍ 10908 وَأَخْبَرَنَا أَبُو بَكْرٍ الْأَرْدَسْتَانِيُّ أَخْبَرَنِي الْقَاضِي أَبُو نَصْرٍ شُعَيْبُ بْنُ عَلِيٍّ الْهَمْدَانِيُّ بِهَا ثنا عَبْدُ الرَّحْمَنِ بْنُ مُحَمَّدٍ ثنا إِبْرَاهِيمُ بْنُ نَصْرٍ الرَّازِيُّ ثنا عَبْدُ اللهِ بْنُ مَسْلَمَةَ الْقَعْنَبِيُّ فَذَكَرَهُ بِنَحْوِهِ وَقَدْ
13.97 [Machine] The License in its Support and Recommendation When Encouraging Him
١٣۔٩٧ بَابُ الرُّخْصَةِ فِي مَعُونَتِهِ وَنَصِيحَتِهِ إِذَا اسْتَنْصَحَهُ
[Machine] And Abu Abdullah Al-Hafiz informed us that Abu Abdullah Al-Shaybani narrated to us, from Muhammad bin Nuaim, from Qutaybah bin Saeed, from Ismail bin Jafar, from Al-Ala'a, from his father, from Abu Huraira, that the Messenger of Allah ﷺ said: "The right of a Muslim upon another Muslim are six: when you meet him, greet him; when he invites you, accept his invitation; when he seeks advice from you, advise him sincerely; when he sneezes and praises Allah, say 'Yarhamuk Allah' (may Allah have mercy on you); when he is sick, visit him; and when he dies, follow his funeral procession."
وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنا أَبُو عَبْدِ اللهِ الشَّيْبَانِيُّ ثنا مُحَمَّدُ بْنُ نُعَيْمٍ ثنا قُتَيْبَةُ بْنُ سَعِيدٍ ثنا إِسْمَاعِيلُ بْنُ جَعْفَرٍ عَنِ الْعَلَاءِ عَنْ أَبِيهِ عَنْ أَبِي هُرَيْرَةَ أَنَّ رَسُولَ اللهِ ﷺ قَالَ حَقُّ الْمُسْلِمِ عَلَى الْمُسْلِمِ سِتٌّ قِيلَ مَا هِيَ يَا رَسُولَ اللهِ؟ قَالَ إِذَا لَقِيتَهُ فَسَلِّمْ عَلَيْهِ وَإِذَا دَعَاكَ فَأَجِبْهُ وَإِذَا اسْتَنْصَحَكَ فَانْصَحْ لَهُ وَإِذَا عَطَسَ فَحَمِدَ اللهَ فَشَمِّتْهُ وَإِذَا مَرِضَ فَعُدْهُ وَإِذَا مَاتَ فَاتْبَعْهُ
[Machine] The Messenger of Allah ﷺ said, "Let people sustain one another as Allah provides for each other. And when any one of you advises his brother, let him advise him sincerely." This was narrated in meaning by Hakim ibn Abi Yazid from his father from the Prophet ﷺ , and it was also said to be narrated from his father through someone who heard the Prophet ﷺ .
قَالَ رَسُولُ اللهِ ﷺ دَعُوا النَّاسَ يَرْزُقِ اللهُ بَعْضَهُمْ مِنْ بَعْضٍ فَإِذَا اسْتَنْصَحَ أَحَدُكُمْ أَخَاهُ فَلْيَنْصَحْهُ وَرُوِيَ ذَلِكَ بِمَعْنَاهُ عَنْ حَكِيمِ بْنِ أَبِي يَزِيدَ عَنْ أَبِيهِ عَنِ النَّبِيِّ ﷺ وَقِيلَ عَنْهُ عَنْ أَبِيهِ عَمَّنْ سَمِعَ النَّبِيَّ ﷺ
That a bedouin told him that he brought a milch she-camel in the time of the Messenger of Allah ﷺ. He alighted with Talhah ibn Ubaydullah (and wanted to sell his milch animal to him). He said: The Prophet ﷺ forbade a townsman to sell for a man from the desert. But go to the market and see who buys from you. consult me thereafter, and then I shall ask you (to sell) or forbid you. (Using translation from Abū Dāʾūd 3441)
قَالَ قَدِمْتُ الْمَدِينَةَ بِحَلُوبَةٍ لِي عَلَى عَهْدِ رَسُولِ اللهِ ﷺ فَنَزَلْتُ عَلَى طَلْحَةَ بْنِ عُبَيْدِ اللهِ فَقُلْتُ إِنِّي لَا عِلْمَ لِي بِأَهْلِ هَذِهِ السُّوقِ فَلَوْ بِعْتَ لِي فَقَالَ إِنَّ رَسُولَ اللهِ ﷺ نَهَى أَنْ يَبِيعَ حَاضِرٌ لِبَادٍ وَلَكِنِ اذْهَبْ إِلَى السُّوقِ فَإِنْ جَاءَكَ مَنْ يُبَايِعُكَ فَشَاوِرْنِي حَتَّى آمُرَكَ أَوْ أَنْهَاكَ
