١٣۔ كِتَابُ الْبُيُوعِ ص ١٢
[Machine] The Messenger of Allah ﷺ said, "Whoever keeps a dog, except a dog for herding or guarding, then every day, two qirats (a measurement of weight) will be deducted from his good deeds." And in another narration, it says, "a dog for guarding."
قَالَ رَسُولُ اللهِ ﷺ مَنِ اقْتَنَى كَلْبًا إِلَّا كَلْبَ مَاشِيَةٍ أَوْ ضَارِيًا نَقَصَ مِنْ عَمَلِهِ كُلَّ يَوْمٍ قِيرَاطَانِ وَفِي رِوَايَةِ يَحْيَى ضَارِيَةٍ
[Machine] The Messenger of Allah ﷺ said: "Whoever keeps a dog, except a dog used for herding, will have two good deeds deducted from his reward each day."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنِ اقْتَنَى كَلْبًا إِلَّا كَلْبَ مَاشِيَةٍ نَقَصَ مِنْ أَجْرِهِ كُلَّ يَوْمٍ قِيرَاطَانِ
[Machine] The Messenger of Allah ﷺ said, "Whoever keeps a dog, except for a dog used for herding livestock or hunting, his rewards will be decreased by one Qirat every day."
قَالَ رَسُولُ اللهِ ﷺ مَنِ اتَّخَذَ كَلْبًا إِلَّا كَلْبَ مَاشِيَةٍ أَوْ كَلْبًا ضَارِيًا نَقَصَ مِنْ عَمَلِهِ كُلَّ يَوْمٍ قِيرَاطٌ
[Machine] I heard the Messenger of Allah ﷺ saying, "Whoever acquires a dog, except for a hunting dog or a herding dog, will have his reward decreased by two Qiraats every day". Abu Abdullah Al-Hafiz informed us, he said: Abu Bakr ibn Ishaq narrated to us, he said: Ahmad ibn Salamah narrated to us, he said: Ishaq ibn Ibrahim reported to us from Waki' that he mentioned it in a similar manner, and he added, Salim said, "Abu Hurairah used to say, 'or a guarding dog, and he was the owner of a land."'
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَنِ اقْتَنَى كَلْبًا إِلَّا كَلْبًا ضَارِيًا لِصَيْدٍ أَوْ كَلْبَ مَاشِيَةٍ نَقَصَ مِنْ أَجْرِهِ كُلَّ يَوْمٍ قِيرَاطَانِ 11026 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو بَكْرِ بْنُ إِسْحَاقَ ثنا أَحْمَدُ بْنُ سَلَمَةَ ثنا إِسْحَاقُ بْنُ إِبْرَاهِيمَ أنبأ وَكِيعٌ عَنْ حَنْظَلَةَ بْنِ أَبِي سُفْيَانَ فَذَكَرَهُ بِنَحْوِهِ وَزَادَ قَالَ سَالِمٌ وَكَانَ أَبُو هُرَيْرَةَ يَقُولُ أَوْ كَلْبَ حَرْثٍ وَكَانَ صَاحِبَ حَرْثٍ
[Machine] I heard the Messenger of Allah ﷺ saying, "Whoever owns a dog, except for a dog used for herding animals or farming, will have two Qirats deducted from his reward every day." This narration is reported by Abdullah ibn Dinar in a Sahih Hadith from another source.
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَنِ اقْتَنَى كَلْبًا إِلَّا كَلْبَ ضَارِيَةٍ أَوْ مَاشِيَةٍ نَقَصَ مِنْ أَجْرِهِ كُلَّ يَوْمٍ قِيرَاطَانِ أَخْرَجَاهُ فِي الصَّحِيحِ مِنْ وَجْهٍ آخَرَ عَنْ عَبْدِ اللهِ بْنِ دِينَارٍ
[Machine] The messenger of Allah ﷺ commanded the killing of dogs, except for a dog used for herding or hunting. It was said to Ibn Umar that Abu Hurairah says: "Or a dog used for farming." He said: "Abu Hurairah indeed had a farm."
أَمَرَ رَسُولُ اللهِ ﷺ بِقَتْلِ الْكِلَابِ إِلَّا كَلْبَ مَاشِيَةٍ أَوْ صَيْدٍ فَقِيلَ لِابْنِ عُمَرَ إِنَّ أَبَا هُرَيْرَةَ يَقُولُ أَوْ كَلْبَ زَرْعٍ فَقَالَ إِنَّ لِأَبِي هُرَيْرَةَ زَرْعًا
[Machine] "Narrated by the Prophet ﷺ, he said: Whoever takes a dog except as a dog for agricultural purposes, or herding, or hunting, then he will have his reward decreased by one qirat every day."
عَنِ النَّبِيِّ ﷺ قَالَ مَنِ اتَّخَذَ كَلْبًا إِلَّا كَلْبَ زَرْعٍ أَوْ غَنَمٍ أَوْ صَيْدٍ فَإِنَّهُ يَنْقُصُ مِنْ أَجْرِهِ كُلَّ يَوْمٍ قِيرَاطٌ
[Machine] The Messenger of Allah ﷺ said, "Whoever takes a dog, other than a dog meant for farming or herding, his rewards will decrease every day by a Qirat." So I said to Ibn Umar, "If the dog is in the house and I am uncomfortable with it?" He said, "He is the owner of the house to which he belongs."
قَالَ رَسُولُ اللهِ ﷺ مَنِ اتَّخَذَ كَلْبًا غَيْرَ كَلْبِ زَرْعٍ وَلَا ضَرْعٍ فَقَدْ نَقَصَ مِنْ عَمَلِهِ كُلَّ يَوْمٍ قِيرَاطٌ فَقُلْتُ لِابْنِ عُمَرَ إِنْ كَانَ فِي دَارٍ وَأَنَا لَهُ كَارِهٌ؟ فَقَالَ هُوَ عَلَى رَبِّ الدَّارِ الَّذِي يَمْلِكُهَا
قَالَ رَسُولُ اللهِ ﷺ مَنْ أَمْسَكَ كَلْبًا فَإِنَّهُ يَنْقُصُ مِنْ عَمَلِهِ كُلَّ يَوْمٍ قِيرَاطٌ إِلَّا كَلْبَ حَرْثٍ أَوْ مَاشِيَةٍ وَفِي رِوَايَةِ الْأَوْزَاعِيِّ مَنِ اقْتَنَى
[Machine] "And Abu Abdullah al-Hafiz and Abu Nasser al-Faqih al-Shirazi told us, they said: Abu Abdullah Muhammad ibn Ya'qub narrated to us, from Abu Abdullah al-Marwazi and Ja'far ibn Muhammad. They said: Yahya ibn Yahya said: I read to Malik from Yazid ibn Khusaifah that Sa'ib ibn Yazid informed him that he heard Sufyan ibn Abi Zuhair, may Allah be pleased with him, who was a man from the tribe of Shano'ah of the companions of the Messenger of Allah ﷺ , saying: I heard the Messenger of Allah ﷺ say: Whoever keeps a dog that does not guard his crops or herds, then his reward is diminished by one Qirat every day. He asked: Did you hear this from the Messenger of Allah ﷺ ? He said: Yes, by the Lord of this mosque. This is the wording of the hadith of Abu Abdullah from Abu Abdullah ibn Ya'qub."
وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ وَأَبُو نَصْرٍ الْفَقِيهُ الشِّيرَازِيُّ قَالَا ثنا أَبُو عَبْدِ اللهِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا أَبُو عَبْدِ اللهِ الْمَرْوَزِيُّ وَجَعْفَرُ بْنُ مُحَمَّدٍ قَالَا ثنا يَحْيَى بْنُ يَحْيَى قَالَ قَرَأْتُ عَلَى مَالِكٍ عَنْ يَزِيدَ بْنِ خُصَيْفَةَ أَنَّ السَّائِبَ بْنَ يَزِيدَ أَخْبَرَهُ أَنَّهُ سَمِعَ سُفْيَانَ بْنَ أَبِي زُهَيْرٍ وَهُوَ رَجُلٌ مِنْ شَنُوءَةَ مِنْ أَصْحَابِ رَسُولِ اللهِ ﷺ قَالَ سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَنِ اقْتَنَى كَلْبًا لَا يُغْنِي عَنْهُ زَرْعًا وَلَا ضَرْعًا نَقَصَ مِنْ عَمَلِهِ كُلَّ يَوْمٍ قِيرَاطٌ قَالَ أَنْتَ سَمِعْتَ هَذَا مِنْ رَسُولِ اللهِ ﷺ؟ قَالَ إِي وَرَبِّ هَذَا الْمَسْجِدِ لَفْظُ حَدِيثِ أَبِي عَبْدِ اللهِ عَنْ أَبِي عَبْدِ اللهِ بْنِ يَعْقُوبَ
[Machine] The Prophet ﷺ ordered the killing of dogs, then he said, "What is wrong with me and dogs?" He exempted the herding dog and the hunting dog.
أَنَّ النَّبِيَّ ﷺ أَمَرَ بِقَتْلِ الْكِلَابِ ثُمَّ قَالَ مَا بَالِي وَالْكِلَابَ فَرَخَّصَ فِي كَلْبِ الرِّعَاءِ وَكَلْبِ الصَّيْدِ
[Machine] The Messenger of Allah ﷺ ordered us to kill the dogs, so we killed them even if the Bedouin woman came with her dog, we would kill it. Then the Messenger of Allah ﷺ said, "If the dogs were not a nation from among the nations, I would have ordered their killing, but kill every black dog with two blue spots on its eyes."
أَمَرَنَا رَسُولُ اللهِ ﷺ بِقَتْلِ الْكِلَابِ فَقَتَلْنَاهَا حَتَّى إنْ كَانَتِ الْأَعْرَابِيَّةُ تَجِيءُ مَعَهَا كَلْبُهَا فَنَقْتُلُهُ ثُمَّ قَالَ رَسُولُ اللهِ ﷺ لَوْلَا أَنَّ الْكِلَابَ أُمَّةٌ مِنَ الْأُمَمِ أَكْرَهُ أَنْ أُفْنِيَهَا لَأَمَرْتُ بِقَتْلِهَا وَلَكِنِ اقْتُلُوا مِنْهَا كُلَّ أَسْوَدَ بَهِيمٍ ذِي عَيْنَيْنِ بَيْضَاوَيْنِ
Messenger of Allah ﷺ ordered us to kill dogs, and we carried out this order so much so that we also kill the dog coming with a woman from the desert. Then Allah's Apostle ﷺ forbade their killing. He (the Prophet further) said: It is your duty the jet-black (dog) having two spots (on the eyes), for it is a devil. (Using translation from Muslim 1572)
أَنَّهُ سَمِعَ جَابِرَ بْنَ عَبْدِ اللهِ يَقُولُ أَمَرَنَا رَسُولُ اللهِ ﷺ بِقَتْلِ الْكِلَابِ حَتَّى إِنَّ الْمَرْأَةَ تَقْدَمُ مِنَ الْبَادِيَةِ بِكَلْبِهَا فَنَقْتُلُهُ ثُمَّ نَهَى النَّبِيُّ ﷺ عَنْ قَتْلِهَا وَقَالَ عَلَيْكُمْ بِالْأَسْوَدِ الْبَهِيمِ ذِي النُّقْطَتَيْنِ؛ فَإِنَّهُ شَيْطَانٌ
13.124 [Machine] What was in the price of the Sinor?
١٣۔١٢٤ بَابُ مَا جَاءَ فِي ثَمَنِ السِّنَّوْرِ
زَجَرَ النَّبِيُّ ﷺ عَنْ ذَلِكَ
[Machine] He heard Jabir ibn Abdullah say that the Messenger of Allah ﷺ forbade the eating of cat and the eating of its price.
أَنَّهُ سَمِعَ جَابِرَ بْنَ عَبْدِ اللهِ يَقُولُ نَهَى رَسُولُ اللهِ ﷺ عَنْ أَكْلِ الْهِرِّ وَأَكْلِ ثَمَنِهِ
[Machine] The Messenger of Allah ﷺ forbade the price of a dog and a leopard.
نَهَى رَسُولُ اللهِ ﷺ عَنْ ثَمَنِ الْكَلْبِ وَالسِّنَّوْرِ
[Machine] The scholar, if the hadith is confirmed and its abrogation is not confirmed, the statement of Ata does not apply to it.
الشَّيْخُ إِذَا ثَبَتَ الْحَدِيثُ وَلَمْ يَثْبُتْ نَسْخُهُ لَمْ يَدْخُلْ عَلَيْهِ قَوْلُ عَطَاءٍ
13.125 [Machine] The Prohibition of Trade in Alcoholic Beverages
١٣۔١٢٥ بَابُ تَحْرِيمِ التِّجَارَةِ فِي الْخَمْرِ
[Machine] When the last verses of Surah Al-Baqarah were revealed, the Messenger of Allah ﷺ came out and recited them to us. He said, "Trade of alcohol is prohibited." This is the wording of the narration of Shu'bah, and in another narration, Ya'la narrated that the verses are in the end of Surah Al-Baqarah regarding usury. He said, "Recite them to the people and prohibit the trade of alcohol." This hadith was reported in the authentic narrations from various angles by Al-A'mash and was narrated by Al-Bukhari from Muslim ibn Ibrahim.
لَمَّا نَزَلَتِ الْآيَاتُ الْأَوَاخِرُ مِنْ سُورَةِ الْبَقَرَةِ خَرَجَ رَسُولُ اللهِ ﷺ فَقَرَأَهُنَّ عَلَيْنَا وَقَالَ حُرِّمَتِ التِّجَارَةُ فِي الْخَمْرِ لَفْظُ حَدِيثِ شُعْبَةَ وَفِي رِوَايَةِ يَعْلَى الْآيَاتُ فِي آخِرِ سُورَةِ الْبَقَرَةِ فِي الرِّبَا وَقَالَ فَتَلَاهُنَّ عَلَى النَّاسِ وَحَرَّمَ التِّجَارَةَ فِي الْخَمْرِ أَخْرَجَاهُ فِي الصَّحِيحِ مِنْ أَوْجُهٍ عَنِ الْأَعْمَشِ وَرَوَاهُ الْبُخَارِيُّ عَنْ مُسْلِمِ بْنِ إِبْرَاهِيمَ
I heard Messenger of Allah ﷺ addressing in Medina. He said: O people, Allah is giving an indication (of the prohibition) of wine. and He is probably soon going to give an order about it. So he who has anything of it with him should sell that, and derive benefit out of it. He (the narrator) said: We waited for some time that Allah's Apostle ﷺ said: Verily Allah, the Exalted, has forbidden wine. So who hears this verse and he has anything of it with him, he should neither drink it nor sell it. He (the narrator) said: The people then brought whatever they had of it with them on the streets of Medina and spilt that. (Using translation from Muslim 1578)
سَمِعْتُ رَسُولَ اللهِ ﷺ يَخْطُبُ بِالْمَدِينَةِ فَقَالَ يَا أَيُّهَا النَّاسُ إِنِّي أَرَى اللهَ جَلَّ ذِكْرُهُ يُعَرِّضُ بِالْخَمْرِ وَلَعَلَّ اللهَ سَيُنْزِلُ فِيهَا أَمْرًا فَمَنْ كَانَ عِنْدَهُ مِنْهَا شَيْءٌ فَلْيَبِعْهُ وَلْيَنْتَفِعْ قَالَ فَمَا لَبِثَ إِلَّا يَسِيرًا حَتَّى قَالَ إِنَّ اللهَ حَرَّمَ الْخَمْرَ فَمَنْ أَدْرَكَتْهُ هَذِهِ الْآيَةُ وَعِنْدَهُ مِنْهَا شَيْءٌ فَلَا يَشْرَبْ وَلَا يَبِعْ فَاسْتَقْبَلَ النَّاسُ بِمَا كَانَ عِنْدَهُمْ مِنْهَا طُرُقَ الْمَدِينَةِ فَسَفَكُوهَا
[Machine] Ibn Abbas: A man gave the Messenger of Allah ﷺ a container of wine as a gift. The Messenger of Allah ﷺ said to him, "Did you not know that Allah has forbidden it?" The man replied, "No." Then, the man left and the Messenger of Allah ﷺ said, "What do you think he did with it?" Someone said, "I commanded him to sell it." The Messenger of Allah ﷺ said, "The one who has forbidden its consumption has also forbidden its sale." Then, the two containers were opened, and what was inside them was poured out, amounting to 11043. Abu Abdullah Al-Hafith, Abu Zakariya, and Abu Abdur Rahman reported to us, saying: Abu Al-Abbas informed us that Muhammad informed him that Ibn Wahb informed him that Suleiman ibn Bilal informed him from Yahya ibn Sa'id from Abdul Rahman ibn 'Ula from Ibn Abbas from the Messenger of Allah ﷺ with a similar narration.
ابْنُ عَبَّاسٍ إِنَّ رَجُلًا أَهْدَى إِلَى رَسُولِ اللهِ ﷺ رَاوِيَةَ خَمْرٍ فَقَالَ لَهُ رَسُولُ اللهِ ﷺ هَلْ عَلِمْتَ أَنَّ اللهَ قَدْ حَرَّمَهَا؟ فَقَالَ لَا فَسَارَّ إِنْسَانًا فَقَالَ رَسُولُ اللهِ ﷺ بِمَ سَارَرْتَهُ؟ قَالَ أَمَرْتُهُ أَنْ يَبِيعَهَا قَالَ إِنَّ الَّذِي حَرَّمَ شُرْبَهَا حَرَّمَ بَيْعَهَا قَالَ فَفَتَحَ الْمَزَادَتَيْنِ حَتَّى ذَهَبَ مَا فِيهَا 11043 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ وَأَبُو زَكَرِيَّا وَأَبُو عَبْدِ الرَّحْمَنِ قَالُوا ثنا أَبُو الْعَبَّاسِ أنبأ مُحَمَّدٌ أنبأ ابْنُ وَهْبٍ أَخْبَرَنِي سُلَيْمَانُ بْنُ بِلَالٍ عَنْ يَحْيَى بْنِ سَعِيدٍ عَنْ عَبْدِ الرَّحْمَنِ بْنِ وَعْلَةَ عَنِ ابْنِ عَبَّاسٍ عَنْ رَسُولِ اللهِ ﷺ مِثْلَهُ
[Machine] "That the Messenger of Allah ﷺ said: 'May Allah curse the Jews. Fat is forbidden for them, so they made it into soap and sold it.'"
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَعَنَ اللهُ الْيَهُودَ؛ حُرِّمَتْ عَلَيْهِمُ الشُّحُومُ فَجَمَلُوهَا فَبَاعُوهَا
The Prophet ﷺ said: Allah has cursed wine, its drinker, its server, its seller, its buyer, its presser, the one for whom it is pressed, the one who conveys it, and the one to whom it is conveyed. (Using translation from Abū Dāʾūd 3674)
أَنَّهُمَا خَرَجَا مِنْ مِصْرَ حَاجَّيْنِ فَجَلَسَا إِلَى ابْنِ عُمَرَ فَذَكَرَ الْقِصَّةَ فَقَالَ ابْنُ عُمَرَ أَشْهَدُ لَسَمِعْتُ رَسُولَ اللهِ ﷺ وَهُوَ يَقُولُ لَعَنَ اللهُ الْخَمْرَ وَشَارِبَهَا وَسَاقِيَهَا وَبَائِعَهَا وَمُبْتَاعَهَا وَعَاصِرَهَا وَمُعْتَصِرَهَا وَحَامِلَهَا وَالْمَحْمُولَةَ إِلَيْهِ وَآكِلَ ثَمَنِهَا
The Prophet ﷺ said: He who sold wine should shear the flesh of swine. (Using translation from Abū Dāʾūd 3489)
عَنِ النَّبِيِّ ﷺ قَالَ مَنْ بَاعَ الْخَمْرَ فَلْيُشَقِّصِ الْخَنَازِيرَ
13.126 [Machine] The prohibition of selling alcohol, dead animals, pigs, and idols.
١٣۔١٢٦ بَابُ تَحْرِيمِ بَيْعِ الْخَمْرِ وَالْمَيْتَةِ وَالْخِنْزِيرِ وَالْأَصْنَامِ
[Machine] "He heard the Messenger of Allah ﷺ say during the Year of the Conquest while he was in Makkah, 'Indeed, Allah and His Messenger have forbidden the sale of alcohol, carrion, pigs, and idols.' It was then asked, 'O Messenger of Allah, what about the fat of carrion? It is used for greasing ships, tanning leather, and people use it for lighting.' He ﷺ said, 'No, it is also forbidden.' Then the Messenger of Allah ﷺ said, 'May Allah curse the Jews, for when Allah forbade the fat of (dead) animals to them, they melted it, sold it, and ate its price.' This is a wording of the Hadith of Qutaybah ibn Sa'id."
أَنَّهُ سَمِعَ رَسُولَ اللهِ ﷺ يَقُولُ عَامَ الْفَتْحِ وَهُوَ بِمَكَّةَ إِنَّ اللهَ وَرَسُولَهُ حَرَّمَ بَيْعَ الْخَمْرِ وَالْمَيْتَةِ وَالْخِنْزِيرِ وَالْأَصْنَامِ فَقِيلَ يَا رَسُولَ اللهِ أَرَأَيْتَ شُحُومَ الْمَيْتَةِ؛ فَإِنَّهَا تُطْلَى بِهَا السُّفُنُ وَيُدْهَنُ بِهَا الْجُلُودُ وَيَسْتَصْبِحُ بِهَا النَّاسُ؟ فَقَالَ لَا هُوَ حَرَامٌ ثُمَّ قَالَ رَسُولُ اللهِ ﷺ قَاتَلَ اللهُ الْيَهُودَ؛ إِنَّ اللهَ لَمَّا حَرَّمَ عَلَيْهِمْ شُحُومَهَا جَمَلُوهَا ثُمَّ بَاعُوهُ وَأَكَلُوا ثَمَنَهُ لَفْظُ حَدِيثِ قُتَيْبَةَ بْنِ سَعِيدٍ
The Messenger of Allah ﷺ as saying: Allah forbade wine and the price paid for it, and forbade dead meat and the price paid for it, and forbade swine and the price paid for it. (Using translation from Abū Dāʾūd 3485)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ إِنَّ اللهَ جَلَّ ثَنَاؤُهُ حَرَّمَ الْخَمْرَ وَثَمَنَهَا وَحَرَّمَ الْمَيْتَةَ وَثَمَنَهَا وَحَرَّمَ الْخِنْزِيرَ وَثَمَنَهُ
[Machine] The passage states: "Bribery is forbidden in judgment, as well as the dowry of injustice, the price of dogs, the price of monkeys, the price of pigs, the price of alcohol, the price of carrion, the price of blood, the fee of the horse breeder, the fee of the wailer, the fee of the singer, the fee of the priest, the fee of the sorcerer, the fee of the fortune-teller, the price of animal skins, the price of the carrion skin, and if they are tanned, there is no harm in them. Also mentioned are the fees of statues, the gift of intercession, and the share of war spoils. This is a disputed matter between Habib ibn Salih and Ibn Abbas, and it is suspended."
السُّحْتُ الرِّشْوَةُ فِي الْحُكْمِ وَمَهْرُ الْبَغِيِّ وَثَمَنُ الْكَلْبِ وَثَمَنُ الْقِرْدِ وَثَمَنُ الْخِنْزِيرِ وَثَمَنُ الْخَمْرِ وَثَمَنُ الْمَيْتَةِ وَثَمَنُ الدَّمِ وَعَسْبُ الْفَحْلِ وَأَجْرُ النَّائِحَةِ وَأَجْرُ الْمُغَنِّيَةِ وَأَجْرُ الْكَاهِنِ وَأَجْرُ السَّاحِرِ وَأَجْرُ الْقَائِفِ وَثَمَنُ جُلُودِ السِّبَاعِ وَثَمَنُ جُلُودِ الْمَيْتَةِ فَإِذَا دُبِغَتْ فَلَا بَأْسَ بِهَا وَأَجْرُ صُوَرِ التَّمَاثِيلِ وَهَدِيَّةُ الشَّفَاعَةِ وَجَعِيلَةُ الْغَزْوِ هَذَا مُنْقَطِعٌ بَيْنَ حَبِيبِ بْنِ صَالِحٍ وَابْنِ عَبَّاسٍ وَهُوَ مَوْقُوفٌ
13.127 [Machine] The Prohibition of Selling Impure Items That Are Unlawful to Consume
١٣۔١٢٧ بَابُ تَحْرِيمِ بَيْعِ مَا يَكُونُ نَجِسًا لَا يَحِلُّ أَكْلُهُ
[Machine] I saw the Messenger of Allah (peace and blessings be upon him) sitting at the corner, he raised his gaze to the sky, smiled, and said, "May Allah curse the Jews three times. Indeed, Allah prohibited them from consuming fat, but they sold it and ate its price. Indeed, when Allah forbids a people from consuming something, He also forbids them from benefiting from its price." Isma'il narrated to us, Salim ibn Harb narrated to us, Wahayb narrated to us, Khalid Al-Hadha' narrated from Barakah Abu Al-Walid, from Ibn Abbas, that the Messenger of Allah (peace and blessings be upon him) was sitting behind the Maqam (station), he raised his gaze to the sky and said, then he mentioned its meaning.
رَأَيْتُ رَسُولَ اللهِ ﷺ جَالِسًا عِنْدَ الرُّكْنِ فَرَفَعَ بَصَرَهُ إِلَى السَّمَاءِ فَضَحِكَ وَقَالَ لَعَنَ اللهُ الْيَهُودَ ثَلَاثًا إِنَّ اللهَ حَرَّمَ عَلَيْهِمُ الشُّحُومَ فَبَاعُوهَا وَأَكَلُوا أَثْمَانَهَا إِنَّ اللهَ إِذَا حَرَّمَ عَلَى قَوْمٍ أَكْلَ شَيْءٍ حَرَّمَ عَلَيْهِمْ ثَمَنَهُ قَالَ وَحَدَّثَنَا إِسْمَاعِيلُ ثنا سُلَيْمَانُ بْنُ حَرْبٍ ثنا وُهَيْبٌ ثنا خَالِدٌ الْحَذَّاءُ عَنْ بَرَكَةَ أَبِي الْوَلِيدِ عَنِ ابْنِ عَبَّاسٍ أَنَّ رَسُولَ اللهِ ﷺ كَانَ قَاعِدًا خَلْفَ الْمَقَامِ رَفَعَ بَصَرَهُ إِلَى السَّمَاءِ وَقَالَ فَذَكَرَ مَعْنَاهُ
[Machine] Trade is not permissible in anything that is not permissible to consume or drink.
لَا تَحِلُّ التِّجَارَةُ فِي شَيْءٍ لَا يَحِلُّ أَكْلُهُ وَشُرْبُهُ
13.128 [Machine] The Prohibition of Selling Free Individuals
١٣۔١٢٨ بَابُ تَحْرِيمِ بَيْعِ الْحُرِّ
[Machine] The Messenger of Allah ﷺ said, "Your Lord (mighty and sublime is He) said: 'These are three whom I will contend with on the Day of Resurrection: a man who gives his word and then betrays it, a man who sells a free man and consumes the price, and a man who hires someone and takes full work from him but does not pay him his wages."
قَالَ رَسُولُ اللهِ ﷺ يَعْنِي قَالَ رَبُّكُمْ ﷻ ثَلَاثَةٌ أَنَا خَصْمُهُمْ يَوْمَ الْقِيَامَةِ وَمَنْ كُنْتُ خَصْمَهُ خَصَمْتُهُ رَجُلٌ أَعْطَى بِي ثُمَّ غَدَرَ وَرَجُلٌ بَاعَ حُرًّا فَأَكَلَ ثَمَنَهُ وَرَجُلٌ اسْتَأْجَرَ أَجِيرًا فَاسْتَوْفَى مِنْهُ وَلَمْ يُوفِّ أَجْرَهُ
13.129 [Machine] What is said about the sale of female singers
١٣۔١٢٩ بَابُ مَا جَاءَ فِي بَيْعِ الْمُغَنِّيَاتِ
[Machine] From the Messenger of Allah, ﷺ , he said: "Do not buy female singers, do not hire them, do not teach them, and there is no good in trades involving them. Their price is haram (forbidden), and regarding a similar hadith, the following verse was revealed: 'And of the people is he who buys the amusement of speech' (Quran 31:6), with its similar meaning."
عَنْ رَسُولِ اللهِ ﷺ قَالَ لَا تَبْتَاعُوا الْمُغَنِّيَاتِ وَلَا تَشْتَرُوهُنَّ وَلَا تُعَلِّمُوهُنَّ وَلَا خَيْرَ فِي تِجَارَةٍ فِيهِنَّ وَثَمَنُهُنَّ حَرَامٌ وَفِي مِثْلِ هَذَا الْحَدِيثِ نَزَلَتْ {وَمِنَ النَّاسِ مَنْ يَشْتَرِي لَهْوَ الْحَدِيثِ} [لقمان 6] وَبِمَعْنَاهُ
[Machine] The Messenger of Allah ﷺ said: "It is not permissible to buy or sell female singers, nor engage in any trade involving them. Consuming their earnings is Haram." In another narration by Bakr bin Mudar, the Messenger of Allah ﷺ said: "Do not sell or buy female singers, do not teach them, and there is no good in any trade involving them. Their earnings are Haram." A similar Hadith was revealed in the Quran in Surah Luqman, verse 6: "And among the people is he who sells his wordly life for the sake of idle talk, distracting others from the path of Allah without knowledge and who adopts it for amusement. Those will have a humiliating punishment." (Luqman 6)
قَالَ رَسُولُ اللهِ ﷺ لَا يَحِلُّ بَيْعُ الْمُغَنِّيَاتِ وَلَا شِرَاؤُهُنَّ وَلَا تِجَارَةٌ فِيهِنَّ وَأَكْلُ أَثْمَانِهِنَّ حَرَامٌ وَفِي رِوَايَةِ بَكْرِ بْنِ مُضَرَ عَنْ رَسُولِ اللهِ ﷺ قَالَ لَا تَبِيعُوا الْمُغَنِّيَاتِ وَلَا تَشْتَرُوهُنَّ وَلَا تُعَلِّمُوهُنَّ وَلَا خَيْرَ فِي تِجَارَةٍ فِيهِنَّ وَثَمَنُهُنَّ حَرَامٌ وَفِي مِثْلِ هَذَا الْحَدِيثِ نَزَلَتْ {وَمِنَ النَّاسِ مَنْ يَشْتَرِي لَهْوَ الْحَدِيثِ} [لقمان 6] حَتَّى بَلَغَ {أُولَئِكَ لَهُمْ عَذَابٌ مُهِينٌ} [لقمان 6]
13.130 [Machine] Prohibition of selling the surplus of water
١٣۔١٣٠ بَابُ النَّهْيِ عَنْ بَيْعِ فَضْلِ الْمَاءِ
[Machine] I heard the Messenger of Allah ﷺ prohibit the selling of water. Al-Shafi'i mentioned in his Sunan that Harimla transmitted this report from Sufyan. Then he said, the meaning of this hadith is that water should be sold in the place where Allah created it. For example, if a man brings water from the desert and uses it to drink and his livestock also benefit from it, the Messenger of Allah ﷺ prohibited the owner of the water from selling the excess and forbade him from preventing others from using it. Then he mentioned that if someone carries the water on his back, it is permissible for him to sell it to others, as he is the owner of what he carries. The sheikh said, and it has been
سَمِعْتُ رَسُولَ اللهِ ﷺ يَنْهَىعَنْ بَيْعِ الْمَاءِ ذَكَرَ الشَّافِعِيُّ رَحِمَهُ اللهُ فِي سُنَنِ حَرْمَلَةَ عَنْهُ هَذَا الْخَبَرَ عَنْ سُفْيَانَ ثُمَّ قَالَ مَعْنَى هَذَا الْحَدِيثِ أَنْ يُبَاعَ الْمَاءُ فِي الْمَوْضِعِ الَّذِي خَلَقَهُ اللهُ فِيهِ وَذَلِكَ أَنْ يَأْتِيَ بِالْبَادِيَةِ الرَّجُلُ لَهُ الْبِئْرُ لِيَسْقِيَ بِهَا مَاشِيَتَهُ وَيَكُونُ فِي مَائِهَا فَضْلٌ عَنْ مَاشِيَتِهِ فَنَهَى رَسُولُ اللهِ ﷺ مَالِكَ الْمَاءِ عَنْ بَيْعِ ذَلِكَ الْفَضْلِ وَنَهَاهُ عَنْ مَنْعِهِ ثُمَّ سَاقَ الْكَلَامَ إِلَى أَنَّهُ إِذَا حَمَلَ الْمَاءَ عَلَى ظَهْرِهِ فَلَا بَأْسَ أَنْ يَبِيعَهُ مِنْ غَيْرِهِ؛ لِأَنَّهُ مَالِكٌ لِمَا حَمَلَ قَالَ الشَّيْخُ وَقَدْ
[Machine] The Messenger of Allah ﷺ forbade selling the virtue of water.
نَهَى رَسُولُ اللهِ ﷺ عَنْ بَيْعِ فَضْلِ الْمَاءِ
[Machine] It is reported that the Prophet ﷺ forbade the sale of water and the striking of camels. He also said that a person should not sell his land and water. The scholar said regarding this narration that when the Prophet mentioned the selling of land and water, he intended for it (the land) to be irrigated with water for cultivation.
أَنَّ النَّبِيَّ ﷺ نَهَى عَنْ بَيْعِ الْمَاءِ وَعَنْ ضِرَابِ الْجَمَلِ وَأَنْ يَبِيعَ الرَّجُلُ أَرْضَهُ وَمَاءَهُ قَالَ الشَّيْخُ قَوْلُهُ فِي هَذَا الْحَدِيثِ وَأَنْ يَبِيعَ الرَّجُلُ أَرْضَهُ وَمَاءَهُ فَإِنَّمَا أَرَادَ بِهِ وَاللهُ أَعْلَمُ أَنْ يُكْرِيَهَا مَعَ الْمَاءِ لِلْحَرْثِ بِبَعْضِ مَا يَخْرُجُ مِنْهَا فَقَدْ
[Machine] The Messenger of Allah ﷺ said, "The benefit of water should not be sold in order to sell the impurities."
قَالَ رَسُولُ اللهِ ﷺ لَا يُبَاعُ فَضْلُ الْمَاءِ لِيُبَاعَ بِهِ الْكَلَأُ
The Messenger of Allah ﷺ forbade the sale of excess water. (Using translation from Abū Dāʾūd 3478)
سَمِعْتُ رَسُولَ اللهِ ﷺ يَنْهَى عَنْ بَيْعِ فَضْلِ الْمَاءِ
[Machine] "He removes it and carries it, there is no harm in it, for it is not like the virtue of the water that disappears in the ground."
هَذَا يَنْزِعُهُ وَيَحْمِلُهُ لَا بَأْسَ بِهِ لَيْسَ كَفَضْلِ الْمَاءِ الَّذِي يَذْهَبُ فِي الْأَرْضِ
13.131 [Machine] What is mentioned regarding the dislike of selling copies of the Qur'an?
١٣۔١٣١ بَابُ مَا جَاءَ فِي كَرَاهِيَةِ بَيْعِ الْمَصَاحِفِ
[Machine] "That we make it a store, but what you have done with your own hands, there is no harm in it." Ibn Wahb said, and Malik said to me about the sale of the Qur'ans and their purchases, there is no harm in it."
أَنْ نَجْعَلَهُ مُتَّجَرًا وَلَكِنْ مَا عَمِلْتَ بِيَدَيْكَ فَلَا بَأْسَ بِهِ قَالَ ابْنُ وَهْبٍ وَقَالَ لِي مَالِكٌ فِي بَيْعِ الْمَصَاحِفِ وَشِرَائِهَا لَا بَأْسَ بِهِ
[Machine] The Qur'ans were not sold. A man would come with a piece of paper to the Prophet ﷺ , and the man would stand up, calculate, and then write. Then another man would stand up and write until they finished the Qur'an.
كَانَتِ الْمَصَاحِفُ لَا تُبَاعُ كَانَ الرَّجُلُ يَأْتِي بِوَرَقَةٍ عِنْدَ النَّبِيِّ ﷺ فَيَقُومُ الرَّجُلُ فَيَحْتَسِبُ فَيَكْتَبُ ثُمَّ يَقُومُ آخَرُ فَيَكْتُبُ حَتَّى يُفْرَغَ مِنَ الْمُصْحَفِ
[Machine] About Sa'id ibn Jubayr, a similar saying of his is as follows:
عَنْ سَعِيدِ بْنِ جُبَيْرٍ مِثْلَهُ مِنْ قَوْلِهِ
[Machine] That hands were cut off in the selling of manuscripts.
أَنَّ الْأَيْدِيَ قُطِعَتْ فِي بَيْعِ الْمَصَاحِفِ
[Machine] Ibn Umar used to pass by the people of the Qur'an and say, "What a terrible trade."
كَانَ ابْنُ عُمَرَ يَمُرُّ بِأَصْحَابِ الْمَصَاحِفِ فَيَقُولُ بِئْسَ التِّجَارَةُ
[Machine] The companions of the Messenger of Allah ﷺ used to dislike the selling of the Qur'an.
كَانَ أَصْحَابُ رَسُولِ اللهِ ﷺ يَكْرَهُونَ بَيْعَ الْمَصَاحِفِ
[Machine] Al-Shafi'i, may Allah have mercy on him, does not mean that some Iraqis say that there is no harm in buying and selling the Qur'an. And among the people there are those who do not see any harm in its sale, while we dislike its sale. The scholar said, "This dislike is based on the honor and respect of the Qur'an, so as not to belittle it by selling it or making it a trade." It has been narrated from Ibn Mas'ud that he permitted its sale, but the chain of narration is weak. And the saying of Ibn Abbas, "Buy the Qur'an and do not sell it, if this is true from him, indicates that it is permissible to sell it with dislike. And Allah knows best.
الشَّافِعِيُّ رَحِمَهُ اللهُ وَلَيْسُوا يَعْنِي بَعْضَ الْعِرَاقِيِّينَ يَقُولُونَ بِهَذَا لَا يَرَوْنَ بَأْسًا بِبَيْعِهَا وَشِرَائِهَا وَمِنَ النَّاسِ مَنْ لَا يَرَى بِشِرَائِهَا بَأْسًا وَنَحْنُ نَكْرَهُ بَيْعَهَا قَالَ الشَّيْخُ وَهَذِهِ الْكَرَاهَةُ عَلَى وَجْهِ التَّنْزِيهِ تَعْظِيمًا لِلْمُصْحَفِ عَنْ أَنْ يُبْتَذَلَ بِالْبَيْعِ أَوْ يُجْعَلَ مُتَّجَرًا وَرُوِيَ عَنِ ابْنِ مَسْعُودٍ أَنَّهُ رَخَّصَ فِيهِ وَإِسْنَادُهُ ضَعِيفٌ وَقَوْلُ ابْنِ عَبَّاسٍ اشْتَرِ الْمُصْحَفَ وَلَا تَبِعْهُ إِنْ صَحَّ ذَلِكَ عَنْهُ يَدُلُّ عَلَى جَوَازِ بَيْعِهِ مَعَ الْكَرَاهِيَةِ وَاللهُ أَعْلَمُ
الشَّيْخُ هَذَا إِسْنَادٌ ضَعِيفٌ
[Machine] The scholars of this nation do not see any harm in it, Hassan and Shabi.
فَقِيهَا هَذِهِ الْأُمَّةِ لَا يَرَيَانِ بِهِ بَأْسًا الْحَسَنُ وَالشَّعْبِيُّ
[Machine] How excellent is your craftsmanship in conveying the Book of Allah, leaf by leaf, verse by verse, word by word. This is permissible, there is no harm in it. 11074 said and narrated to us Sa'eed, narrated to us Abd al-Aziz ibn Abd al-Samad, narrated to us Malik ibn Dinar that Ikrimah sold a copy of the Qur'an and that Hasan did not see any harm in it.
مَا أَحْسَنَ صَنْعَتَكَ تَنْقُلُ كِتَابَ اللهِ ﷻ وَرَقَةً إِلَى وَرَقَةٍ وَآيَةً إِلَى آيَةٍ وَكَلِمَةً إِلَى كَلِمَةٍ هَذَا الْحَلَالُ لَا بَأْسَ بِهِ 11074 قَالَ وَحَدَّثَنَا سَعِيدٌ ثنا عَبْدُ الْعَزِيزِ بْنُ عَبْدِ الصَّمَدِ ثنا مَالِكُ بْنُ دِينَارٍ أَنَّ عِكْرِمَةَ بَاعَ مُصْحَفًا لَهُ وَأَنَّ الْحَسَنَ كَانَ لَا يَرَى بِهِ بَأْسًا
13.132 [Machine] What is included in sales of necessity and forced sales?
١٣۔١٣٢ بَابُ مَا جَاءَ فِي بَيْعِ الْمُضْطَرِّ وَبَيْعِ الْمُكْرَهِ
[Machine] The Messenger of Allah, ﷺ , said: "I will never meet Allah before I give something from someone's wealth to someone else without his willing consent. Verily, commerce is only based on mutual agreement."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَأَلْقَيَنَّ اللهَ ﷻ مِنْ قَبْلِ أَنْ أُعْطِيَ أَحَدًا مِنْ مَالِ أَحَدٍ شَيْئًا بِغَيْرِ طِيبِ نَفْسِهِ إِنَّمَا الْبَيْعُ عَنْ تَرَاضٍ
ʿAli ؓ addressed us - or he said: ‘Ali said: There will come a difficult time when the rich man will hold fast to that which is in his hand although he was not enjoined to do that. Allah says: ʿAnd do not forget liberality between yourselvesʿ [Al-Baqarah 2:237]. The evil [people] will be elevated and good people will be humiliated. And those who are under compulsion (of force or necessity) will be bought from. The Prophet ﷺ forbade forced sales, transactions based on ambiguity and selling crops before they have ripened. قَالَ عَلِيٌّ سَيَأْتِي عَلَى النَّاسِ زَمَانٌ عَضُوضٌ يَعَضُّ الْمُوسِرُ عَلَى مَا فِي يَدَيْهِ وَلَمْ يُؤْمَرْ بِذَلِكَ قَالَ اللهُ جَلَّ ثَنَاؤُهُ {وَلَا تَنْسَوَا الْفَضْلَ بَيْنَكُمْ} [البقرة 237] وَتَنْهَدُ الْأَشْرَارُ وَيُسْتَذَلُّ الْأَخْيَارُ وَيُبَايِعُ الْمُضْطَرُّونَ وَقَدْ نَهَى رَسُولُ اللهِ ﷺ عَنْ بَيْعِ الْمُضْطَرِّ وَعَنْ بَيْعِ الْغَرَرِ وَعَنْ بَيْعِ الثَّمَرَةِ قَبْلَ أَنْ تُطْعَمَ
[Machine] There will come a time when evil individuals will rise and be considered good, and the desperate will be compelled to sell their belongings. The Prophet Muhammad ﷺ prohibited the sale of items of necessity, fraud, and produce before it ripens. Abu Amer, who is Salih ibn Rustum al-Khazzaz al-Basri, did not fully understand this prohibition. Some narrations from Ali and Ibn Umar exist, but they are not strong in authenticity. يَأْتِي عَلَى النَّاسِ زَمَانٌ تُقَدَّمُ الْأَشْرَارُ لَيْسَتْ بِالْأَخْيَارِ وَيُبَايِعُ الْمُضْطَرُّ وَقَدْ نَهَى رَسُولُ اللهِ ﷺ عَنْ بَيْعِ الْمُضْطَرِّ وَبَيْعِ الْغَرَرِ وَبَيْعِ الثَّمَرَةِ قَبْلَ أَنْ تُدْرِكَ أَبُو عَامِرٍ هَذَا هُوَ صَالِحُ بْنُ رُسْتُمَ الْخَزَّازُ الْبَصْرِيُّ وَقَدْ رُوِيَ مِنْ أَوْجُهٍ عَنْ عَلِيٍّ وَابْنِ عُمَرَ وَكُلُّهَا غَيْرُ قَوِيَّةٍ وَاللهُ أَعْلَمُ
