١٣۔ كِتَابُ الْبُيُوعِ ص ١٣
[Machine] The Messenger of Allah ﷺ said: "No man should ride the sea except as a warrior, a pilgrim, or a traveler. For beneath the sea is fire, and beneath the fire is another sea, and beneath that sea is fire. And the wealth of a Muslim cannot be bought with injustice."
قَالَ رَسُولُ اللهِ ﷺ لَا يَرْكَبَنَّ رَجُلٌ بَحْرًا إِلَّا غَازِيًا أَوْ مُعْتَمِرًا أَوْ حَاجًّا؛ فَإِنَّ تَحْتَ الْبَحْرِ نَارًا وَتَحْتَ النَّارِ بَحْرًا وَتَحْتَ الْبَحْرِ نَارًا وَلَا يُشْتَرَى مَالُ امْرِئٍ مُسْلِمٍ فِي ضُغْطَةٍ
[Machine] The Messenger of Allah ﷺ said, "No one should ride the sea except for a pilgrim, a person performing 'umrah, or someone fighting in the cause of Allah. For beneath the sea is fire, and beneath the fire is a sea." He also said, "Do not buy anything from a person who imposes pressure with authority," the wording of this hadith is narrated by Sha'raani. It has also been said that Sa'id ibn Mansur reported this chain of narration from Bashir ibn Muslim from Abdullah ibn Amr.
قَالَ رَسُولُ اللهِ ﷺ لَا يَرْكَبُ الْبَحْرَ إِلَّا حَاجٌّ أَوْ مُعْتَمِرٌ أَوْ غَازٍ فِي سَبِيلِ اللهِ؛ فَإِنَّ تَحْتَ الْبَحْرِ نَارًا وَتَحْتَ النَّارِ بَحْرًا وَقَالَ لَا يَشْتَرِي مِنْ ذِي ضُغْطَةٍ سُلْطَانٌ شَيْئًا لَفْظُ حَدِيثِ الشَّعْرَانِيِّ وَقَدْ قِيلَ عَنْ سَعِيدِ بْنِ مَنْصُورٍ بِهَذَا الْإِسْنَادِ عَنْ بِشْرٍ أَبِي عَبْدِ اللهِ عَنْ بَشِيرِ بْنِ مُسْلِمٍ عَنْ عَبْدِ اللهِ بْنِ عَمْرٍو
[Machine] Marriage and sale are not permissible for an oppressed person.
لَا يَجُوزُ عَلَى مُضْطَهَدٍ نِكَاحٌ وَلَا بَيْعٌ

١٣۔١٣٤ بَابُ جَوَازِ السَّلَفِ الْمَضْمُونِ بِالصِّفَةِ قَالَ اللهُ تَعَالَى جَلَّ ثَنَاؤُهُ {يَا أَيُّهَا الَّذِينَ آمَنُوا إِذَا تَدَايَنْتُمْ بِدَيْنٍ إِلَى أَجَلٍ مُسَمًّى فَاكْتُبُوهُ} [البقرة: 282].
[Machine] The predecessor is binding to a specific term, and Allah has made it permissible, allowed it, and recited this verse: "O you who have believed when you contract a debt for a specified term, write it down." He said: And Ibrahim narrated to us, and Abu Hudhaifa narrated to us, from Sufyan, from Abu Hayyan, from a man, from Ibn Abbas regarding this verse: "O you who have believed, when you contract a debt for a specified term." He said: In wheat, in a known measure.
أَنَّ السَّلَفَ الْمَضْمُونَ إِلَى أَجَلٍ مُسَمًّى إِنَّ اللهَ ﷻ أَحَلَّهُ وَأَذِنَ فِيهِ وَقَرَأَ هَذِهِ الْآيَةَ {يَا أَيُّهَا الَّذِينَ آمَنُوا إِذَا تَدَايَنْتُمْ بِدَيْنٍ إِلَى أَجَلٍ مُسَمًّى فَاكْتُبُوهُ} [البقرة 282] 11082 قَالَ وَحَدَّثَنَا إِبْرَاهِيمُ ثنا أَبُو حُذَيْفَةَ عَنْ سُفْيَانَ عَنْ أَبِي حَيَّانَ عَنْ رَجُلٍ عَنِ ابْنِ عَبَّاسٍ فِي هَذِهِ الْآيَةِ {يَا أَيُّهَا الَّذِينَ آمَنُوا إِذَا تَدَايَنْتُمْ بِدَيْنٍ إِلَى أَجَلٍ مُسَمًّى} [البقرة 282] قَالَ فِي الْحِنْطَةِ فِي كَيْلٍ مَعْلُومٍ
[Machine] The Prophet ﷺ arrived in Medina while they were lending in fruit for two or three years. He said, "Whoever lends in fruit, let him lend with a known weight and measure, and for a known period of time." This is the wording of the narration of Amr an-Naqid, and in the narration of Yahya ibn Yahya, it is mentioned as two or three years, and he said, "for a known period of time" without mentioning the word "and". And in the narration of Ash-Shafi'i, it is mentioned as "for a known period of time". Ash-Shafi'i said, "I memorized it as I was described by Sufyan many times, and someone whom I trust informed me that Sufyan said, 'Whenever I mention the word 'to a known period of time', it is referring to a specific period.'"
قَدِمَ النَّبِيُّ ﷺ الْمَدِينَةَ وَهُمْ يُسْلِفُونَ فِي الثَّمَرِ سَنَتَيْنِ وَثَلَاثًا فَقَالَ مَنْ أَسْلَفَ فِي ثَمَرٍ فَلْيُسْلِفْ فِي كَيْلٍ مَعْلُومٍ وَوَزْنٍ مَعْلُومٍ وَإِلَى أَجَلٍ مَعْلُومٍ هَذَا لَفْظُ حَدِيثِ عَمْرٍو النَّاقِدِ وَفِي رِوَايَةِ يَحْيَى بْنِ يَحْيَى السَّنَتَيْنِ وَالثَّلَاثَ وَقَالَ إِلَى أَجَلٍ مَعْلُومٍ لَمْ يَذْكُرِ الْوَاوَ وَفِي رِوَايَةِ الشَّافِعِيِّ وَأَجَلٍ مَعْلُومٍ قَالَ الشَّافِعِيُّ حَفِظْتُهُ كَمَا وَصَفْتُ مِنْ سُفْيَانَ مِرَارًا وَأَخْبَرَنِي مَنْ أُصَدِّقُهُ عَنْ سُفْيَانَ أَنَّهُ قَالَ كُلَّمَا قُلْتُ وَقَالَ فِي الْأَجَلِ إِلَى أَجَلٍ مَعْلُومٍ
أَنَّ ابْنَ عُمَرَ كَانَ يُجِيزُهُ
[Machine] That a person lends in food with a specific price for a set period, as long as it is not in planting or fruit that has not shown its quality, the Sheikh said, "He means that Allah knows whether he lends it in its own planting or its own fruit, so it is not permissible because selling the fruit goods on top of the trees is only permissible when its quality is apparent."
بِأَنْ يُسْلِفَ الرَّجُلُ فِي الطَّعَامِ الْمَوْصُوفِ بِسِعْرٍ مَعْلُومٍ إِلَى أَجَلٍ مُسَمًّى مَا لَمْ يَكُنْ ذَلِكَ فِي زَرْعٍ لَمْ يَبْدُ صَلَاحُهُ أَوْ ثَمَرٍ لَمْ يَبْدُ صَلَاحُهُ قَالَ الشَّيْخُ يُرِيدُ بِهِ وَاللهُ أَعْلَمُ أَنْ يُسْلِفَهُ فِي زَرْعٍ بِعَيْنِهِ أَوْ ثَمَرٍ بِعَيْنِهِ فَلَا يَجُوزُ؛ لِأَنَّ بَيْعَ أَعْيَانِ الثِّمَارِ عَلَى رُءُوسِ الْأَشْجَارِ إِنَّمَا يَجُوزُ إِذَا بَدَا فِيهَا الصَّلَاحُ
13.135 [Machine] Mortgage and loan guarantee in pre-Islamic times as evidenced by the verse at the end of the debt, and the verse on the debt is mentioned in the pre-Islamic times.
١٣۔١٣٥ بَابُ جَوَازِ الرَّهْنِ وَالْحَمِيلِ فِي السَّلَفِ اسْتِدْلَالًا بِالْكِتَابِ فِي آخِرِ آيَةِ الدَّيْنِ، وَآيَةُ الدَّيْنِ وَارِدَةٌ فِي السَّلَفِ الْمَضْمُونِ
[Machine] "Indeed, the pre-determined term for a secured debt that Allah has ordained in His book and allowed is as follows: 'O you who have believed, when you contract a debt for a specified term, write it down.' [Al-Baqarah 282]"
أَنَّ السَّلَفَ الْمَضْمُونَ إِلَى أَجَلٍ مُسَمًّى قَدْ أَحَلَّهُ اللهُ فِي كِتَابِهِ وَأَذِنَ فِيهِ ثُمَّ قَالَ {يَا أَيُّهَا الَّذِينَ آمَنُوا إِذَا تَدَايَنْتُمْ بِدَيْنٍ إِلَى أَجَلٍ مُسَمًّى فَاكْتُبُوهُ} [البقرة 282]
[Machine] That the Messenger of Allah, ﷺ , bought food from a Jewish person on credit and he pawned his shield.
أَنَّ رَسُولَ اللهِ ﷺ اشْتَرَى مَنْ يَهُودِيٍّ طَعَامًا إِلَى أَجَلٍ وَرَهَنَهُ دِرْعَهُ
[Machine] "He did not see any harm in collateral and obligating the debtor with the lender."
أَنَّهُ كَانَ لَا يَرَى بِالرَّهْنِ وَالْحَمِيلِ مَعَ السَّلَفِ بَأْسًا
13.136 [Machine] The Predecessor in the matter is not in the hands of people when its place is conditioned in a time in which it exists.
١٣۔١٣٦ بَابُ السَّلَفِ فِي الشَّيْءِ لَيْسَ فِي أَيْدِي النَّاسِ إِذَا شَرَطَ مَحِلَّهُ فِي وَقْتٍ يَكُونُ مَوْجُودًا فِيهِ
[Machine] The Messenger of Allah ﷺ arrived in Medina while they were borrowing money for two or three years to pay back in a known timeframe. The Messenger of Allah ﷺ said, "Borrow, but with a known quantity, to be repaid within a known period." This is the narration of Abu Nu'aim and Al-Firiyabi, similar to it except that it mentions a known quantity and a known weight, to be repaid within a known period.
قَدِمَ رَسُولُ اللهِ ﷺ الْمَدِينَةَ وَهُمْ يُسْلِفُونَ فِي الثِّمَارِ السَّنَتَيْنِ وَالثَّلَاثَ فَقَالَ رَسُولُ اللهِ ﷺ أَسْلِفُوا فِي الثِّمَارِ فِي كَيْلٍ مَعْلُومٍ إِلَى أَجَلٍ مَعْلُومٍ لَفْظُ حَدِيثِ أَبِي نُعَيْمٍ وَحَدِيثُ الْفِرْيَابِيِّ مِثْلُهُ إِلَّا أَنَّهُ قَالَ فِي كَيْلٍ مَعْلُومٍ وَوَزْنٍ مَعْلُومٍ إِلَى أَجَلٍ مَعْلُومٍ
'Abd Allah b. Shaddad and Abu Burdah disputed over salaf (payment in advance). They sent me to Ibn Abi Awfa and I asked him (about it) and he replied: We used to pay in advance (salaf) during the time of the Messenger of Allah ﷺ, Abu Bakr and 'Umar in wheat, barley, dates and raisins. Ibn Kathir added: "to those people who did not possess these things." The agreed version then goes: I then asked Ibn Abza who gave a similar reply. (Using translation from Abū Dāʾūd 3464)
إنْ كُنَّا لَنُسْلِفُ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ وَأَبِي بَكْرٍ وَعُمَرَ فِي الْحِنْطَةِ وَالشَّعِيرِ وَالتَّمْرِ وَالزَّبِيبِ زَادَ ابْنُ كَثِيرٍ إِلَى قَوْمٍ مَا هُوَ عِنْدَهُمْ ثُمَّ اتَّفَقَا فَسَأَلْتُ ابْنَ أَبْزَى فَقَالَ مِثْلَ ذَلِكَ
Abu Burda and ʿAbdullah bin Shaddad sent me to ʿAbdur Rahman bin Abza and ʿAbdullah bin Abi ʿAufa to ask them about the Salaf (Salam). They said, "We used to get war booty while we were with Messenger of Allah ﷺ and when the peasants of Sham came to us we used to pay them in advance for wheat, barley, and oil to be delivered within a fixed period." I asked them, "Did the peasants own standing crops or not?" They replied, "We never asked them about it." (Using translation from Bukhārī 2254)
عَنِ السَّلَفِ فَقَالَا كُنَّا نُصِيبُ الْمَغَانِمَ مَعَ رَسُولِ اللهِ ﷺ وَكَانَ يَأْتِينَا أَنْبَاطُ الشَّامِ فَنُسْلِفُهُمْ فِي الْحِنْطَةِ وَالشَّعِيرِ وَالزَّيْتِ إِلَى أَجَلٍ مُسَمًّى قَالَ أَكَانَ لَهُمْ زَرْعٌ أَوْ لَمْ يَكُنْ لَهُمْ زَرْعٌ؟ قَالَ مَا كُنَّا نَسْأَلُهُمْ
[Machine] That a man sells something for a term that he does not possess its original 11094. Al-Shafi'i reported that Said narrated from Ibn Jurayj from Nafi' from Ibn 'Umar similar to it.
أَنْ يَبِيعَ الرَّجُلُ شَيْئًا إِلَى أَجَلٍ لَيْسَ عِنْدَهُ أَصْلُهُ 11094 قَالَ وَأنبأ الشَّافِعِيُّ أنبأ سَعِيدٌ عَنِ ابْنِ جُرَيْجٍ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ مِثْلَهُ
13.137 [Machine] The current passport requirements as stated by 'Ata' ibn Abi Rabah
١٣۔١٣٧ بَابُ جَوَازِ السَّلَمِ الْحَالِّ قَالَهُ عَطَاءُ بْنُ أَبِي رَبَاحٍ
[Machine] She said, "The Messenger of Allah ﷺ bought a pig from an Arab with a kilogram of dates. The Messenger of Allah ﷺ asked his family for some dates, but they did not have any. So he mentioned this to the Arab, and the Arab shouted at him and accused him of being deceptive. The companions of the Messenger of Allah ﷺ said, 'No, it is you who is the enemy of Allah, the deceptive one.' The Messenger of Allah ﷺ said, 'Leave him, for the one who has the truth has a strong argument.' So the Messenger of Allah ﷺ sent to Khawla bint Hakim, and he sent the Arab with the messenger. He said to her, 'Tell her that I bought this pig from this Arab with a kilogram of dates, but I could not find any with my family. So please lend me a kilogram of dates to give to this Arab.' When the Arab received his due, he returned to the Prophet ﷺ , who asked him, 'Did you receive it?' He replied, 'Yes, and I have fulfilled and made it better.' The Prophet ﷺ said, 'Those are the best of people, those who fulfill their obligations and make them better.' And in the narration of Abi al-Azhar, narrated to me Yahya ibn Umayr, the freed slave of Bani Asad, who narrated from Hisham ibn Urwah, and this hadith was also narrated summarily from Hammad ibn Salamah, who narrated from Hisham ibn Urwah."
قَالَتِ اشْتَرَى رَسُولُ اللهِ ﷺ جَزُورًا مِنْ أَعْرَابِيٍّ بِوَسْقِ تَمْرِ عَجْوَةٍ فَطَلَبَ رَسُولُ اللهِ ﷺ عِنْدَ أَهْلِهِ تَمْرًا فَلَمْ يَجِدْهُ فَذَكَرَ ذَلِكَ لِلْأَعْرَابِيِّ فَصَاحَ الْأَعْرَابِيُّ وَاغَدْرَاهُ فَقَالَ أَصْحَابُ رَسُولِ اللهِ ﷺ بَلْ أَنْتَ يَا عَدُوَّ اللهِ أَغْدَرُ فَقَالَ رَسُولُ اللهِ ﷺ دَعُوهُ؛ فَإِنَّ لِصَاحِبِ الْحَقِّ مَقَالًا فَأَرْسَلَ رَسُولُ اللهِ ﷺ إِلَى خَوْلَةَ بِنْتِ حَكِيمٍ وَبَعَثَ بِالْأَعْرَابِيِّ مَعَ الرَّسُولِ فَقَالَ قُلْ لَهَا إِنِّي ابْتَعْتُ هَذَا الْجَزُورَ مِنْ هَذَا الْأَعْرَابِيِّ بِوَسْقِ تَمْرِ عَجْوَةٍ فَلَمْ أَجِدْهُ عِنْدَ أَهْلِي فَأَسْلِفِينِي وَسْقَ تَمْرِ عَجْوَةٍ لِهَذَا الْأَعْرَابِيِّ فَلَمَّا قَبَضَ الْأَعْرَابِيُّ حَقَّهُ رَجَعَ إِلَى النَّبِيِّ ﷺ فَقَالَ لَهُ قَبَضْتَ؟ قَالَ نَعَمْ وَأَوْفَيْتَ وَأَطَيَبْتَ فَقَالَ رَسُولُ اللهِ ﷺ أُولَئِكَ خِيَارُ النَّاسِ الْمُوفُونَ الْمُطَيِّبُونَ وَفِي رِوَايَةِ أَبِي الْأَزْهَرِ حَدَّثَنِي يَحْيَى بْنُ عُمَيْرٍ مَوْلَى بَنِي أَسَدٍ حَدَّثَنِي هِشَامُ بْنُ عُرْوَةَ وَرُوِيَ هَذَا الْحَدِيثُ مُخْتَصَرًا عَنْ حَمَّادِ بْنِ سَلَمَةَ عَنْ هِشَامِ بْنِ عُرْوَةَ
[Machine] "I saw the Messenger of Allah, ﷺ , passing through the market of Dhi al-Majaz while I was in my shop. He passed by wearing a red garment, and I heard him saying, 'O people, say there is no god but Allah, and you will succeed.' A man following him was throwing stones at him, causing his heels to bleed. The man said, 'O people, do not obey him, for he is a liar.' I asked, 'Who is this?' They said, 'He is a young boy from the Bani Abd al-Muttalib tribe.' I asked, 'Who is the one throwing stones at him?' They said, 'His uncle, Abd al-Uzza Abu Lahab bin Abd al-Muttalib.' When Allah made Islam apparent, we left the mountain pass, and we had with us a herd of camels. We came close to the city when we were sitting down, and a man wearing two garments greeted us. He asked, 'Which tribe are you from?' We replied, 'We are from the mountain pass, and we have with us a red camel.' He asked, 'Are you selling the camel?' We replied, 'Yes.' He asked, 'For how much?' We said, 'For this much and this much (giving the measurement in weight) of dates.' He said, 'I take it.' He took hold of the camel's reins and went away with it until he disappeared into the city walls. Some of us said to each other, 'Do you know who this man is?' None of us knew him, so the people started asking each other, 'Are you selling your camels to someone you do not know?' The herd of camels replied, 'Do not blame each other, for we have seen a man who will not betray you. We have not seen anyone whose face resembles the full moon on the night of the full moon.' When evening came, a man came to us and greeted us, saying, 'Peace and Allah's mercy be upon you. Are you the people who came from the mountain pass?' We replied, 'Yes.' He said, 'I am the Messenger of Allah, ﷺ , and he commands you to eat from these dates until you are satisfied and take as much as you can hold in your hands.' So we ate from the dates until we were satisfied and took as much as we could hold. The next day, we arrived in the city, and there was the Messenger of Allah, ﷺ , standing on the pulpit, addressing the people. I heard him say, 'The hand that gives is better than the hand that takes, and start with those who rely on you the most—your mother, your father, your sister, your brother—and work your way down.' Then a man from the Ansar stood up and said, 'O Messenger of Allah, these are the sons of Tha'laba bin Yarbu, who killed so and so during the time of ignorance. Take revenge on our behalf.' The Messenger of Allah, ﷺ , raised his hands until I could see the whiteness of his armpits and said, 'A mother should not be held accountable for her child, a mother should not be held accountable for her child.' And he repeated the hadith, which was also narrated by Abu Jannab al-Kalbi from Jamee bin Shaddad."
رَأَيْتُ رَسُولَ اللهِ ﷺ مَرَّ بِسُوقِ ذِي الْمَجَازِ وَأَنَا فِي بَيَاعَةٍ لِي فَمَرَّ وَعَلَيْهِ حُلَّةٌ حَمْرَاءُ فَسَمِعْتُهُ يَقُولُ يَا أَيُّهَا النَّاسُ قُولُوا لَا إِلَهَ إِلَّا اللهُ تُفْلِحُوا وَرَجُلٌ يَتَّبِعُهُ يَرْمِيهِ بِالْحِجَارَةِ قَدْ أَدْمَى كَعْبَيْهِ وَهُوَ يَقُولُ يَا أَيُّهَا النَّاسُ لَا تُطِيعُوا هَذَا؛ فَإِنَّهُ كَذَّابٌ فَقُلْتُ مَنْ هَذَا؟ فَقِيلَ هَذَا غُلَامٌ مِنْ بَنِي عَبْدِ الْمُطَّلِبِ فَقُلْتُ فَمَنْ هَذَا يَرْمِيهِ بِالْحِجَارَةِ؟ قِيلَ عَمُّهُ عَبْدُ الْعُزَّى أَبُو لَهَبِ بْنُ عَبْدِ الْمُطَّلِبِ فَلَمَّا أَظْهَرَ اللهُ الْإِسْلَامَ خَرَجْنَا مِنَ الرَّبَذَةِ وَمَعَنَا ظَعِينَةٌ حَتَّى نَزَلْنَا قَرِيبًا مِنَ الْمَدِينَةِ فَبَيْنَا نَحْنُ قُعُودٌ إِذْ أَتَانَا رَجُلٌ عَلَيْهِ ثَوْبَانِ فَسَلَّمَ عَلَيْنَا فَقَالَ مِنْ أِيِّ الْقَوْمِ؟ فَقُلْنَا مِنَ الرَّبَذَةِ وَمَعَنَا جَمَلٌ أَحْمَرُ فَقَالَ تَبِيعُونِي الْجَمَلَ؟ قُلْنَا نَعَمْ فَقَالَ بِكَمْ؟ فَقُلْنَا بِكَذَا وَكَذَا صَاعًا مِنْ تَمْرٍ قَالَ قَدْ أَخَذْتُهُ وَمَا اسْتَقْصَى فَأَخَذَ بِخِطَامِ الْجَمَلِ فَذَهَبَ بِهِ حَتَّى تَوَارَى فِي حِيطَانِ الْمَدِينَةِ فَقَالَ بَعْضُنَا لِبَعْضٍ تَعْرِفُونَ الرَّجُلَ؟ فَلَمْ يَكُنْ مِنَّا أَحَدٌ يَعْرِفُهُ فَلَامَ الْقَوْمُ بَعْضُهُمْ بَعْضًا فَقَالُوا تُعْطُونَ جَمَلَكُمْ مَنْ لَا تَعْرِفُونَ فَقَالَتِ الظَّعِينَةُ فَلَا تَلَاوَمُوا فَلَقَدْ رَأَيْنَا رَجُلًا لَا يَغْدِرُ بِكُمْ مَا رَأَيْتُ شَيْئًا أَشْبَهَ بِالْقَمِرِ لَيْلَةَ الْبَدْرِ مِنْ وَجْهِهِ فَلَمَّا كَانَ الْعَشِيُّ أَتَانَا رَجُلٌ فَقَالَ السَّلَامُ عَلَيْكُمْ وَرَحْمَةُ اللهِ أَأَنْتُمُ الَّذِينَ جِئْتُمْ مِنَ الرَّبَذَةِ؟ قُلْنَا نَعَمْ قَالَ أَنَا رَسُولُ رَسُولِ اللهِ ﷺ وَهُوَ يَأْمُرُكُمْ أَنْ تَأْكُلُوا مِنْ هَذَا التَّمْرِ حَتَّى تَشْبَعُوا وَتَكْتَالُوا حَتَّى تَسْتَوْفُوا فَأَكَلْنَا مِنَ التَّمْرِ حَتَّى شَبِعْنَا وَاكْتَلْنَا حَتَّى اسْتَوْفَيْنَا ثُمَّ قَدِمْنَا الْمَدِينَةَ مِنَ الْغَدِ فَإِذَا رَسُولُ اللهِ ﷺ قَائِمٌ يَخْطُبُ النَّاسَ عَلَى الْمِنْبَرِ فَسَمِعْتُهُ يَقُولُ يَدُ الْمُعْطِي الْعُلْيَا وَابْدَأْ بِمَنْ تَعُولُ أُمَّكَ وَأَبَاكَ وَأُخْتَكَ وَأَخَاكَ وَأَدْنَاكَ أَدْنَاكَ وَثَمَّ رَجُلٌ مِنَ الْأَنْصَارِ فَقَالَ يَا رَسُولَ اللهِ هَؤُلَاءِ بَنُو ثَعْلَبَةَ بْنِ يَرْبُوعٍ الَّذِينَ قَتَلُوا فُلَانًا فِي الْجَاهِلِيَّةِ فَخُذْ لَنَا بِثَأْرِنَا فَرَفَعَ رَسُولُ اللهِ ﷺ يَدَيْهِ حَتَّى رَأَيْتُ بَيَاضَ إِبْطَيْهِ فَقَالَ لَا تَجْنِي أُمٌّ عَلَى وَلَدٍ لَا تَجْنِي أُمٌّ عَلَى وَلَدٍ وَذَكَرَ الْحَدِيثَ وَرَوَاهُ أَيْضًا أَبُو جَنَابٍ الْكَلْبِيُّ عَنْ جَامِعِ بْنِ شَدَّادٍ
13.138 [Machine] Who allowed hunting animals with a specific age, description, and known time limit, and who disliked it
١٣۔١٣٨ بَابُ مَنْ أَجَازَ السَّلَمَ فِي الْحَيَوَانِ بِسِنٍّ وَصِفَةٍ وَأَجَلٍ مَعْلُومٍ إِنْ كَانَ إِلَى أَجَلٍ، وَمَنْ كَرِهَهُ
The Messenger of Allah ﷺ borrowed a young camel, and when the camels of the sadaqah (alms) came to him, he ordered me to pay the man his young camel. I said: I find only an excellent camel in its seventh year. So the Prophet ﷺ said: Give it to him, for the best person is he who discharges his debt in the best manner. (Using translation from Abū Dāʾūd 3346)
اسْتَسْلَفَ رَسُولُ اللهِ ﷺ بَكْرًا فَجَاءَتْهُ إِبِلٌ مِنَ الصَّدَقَةِ فَأَمَرَنِي أَنْ أَقْضِيَ الرَّجُلَ بَكْرَهُ فَقُلْتُ لَمْ أَجِدْ فِي الْإِبِلِ إِلَّا جَمَلًا خِيَارًا رَبَاعِيًّا فَقَالَ النَّبِيُّ ﷺ أَعْطِهِ إِيَّاهُ؛ فَإِنَّ خِيَارَ النَّاسِ أَحْسَنُهُمْ قَضَاءً
[Machine] There was a man who had a camel's age with the Prophet ﷺ , and he came to claim it. They searched for it but could only find a camel's age above his. The Prophet ﷺ said, "Give it to him." The man replied, "You have compensated me well. May Allah compensate you." The Messenger of Allah ﷺ said, "Indeed, the best of you is the one who fulfills his obligations."
كَانَ لِرَجُلٍ عَلَى النَّبِيِّ ﷺ سِنٌّ مِنَ الْإِبِلِ فَجَاءَ يَتَقَاضَاهُ فَقَالَ أَعْطُوهُ فَطَلَبُوا فَلَمْ يَجِدُوا إِلَّا سِنًّا فَوْقَ سِنِّهِ فَقَالَ أَعْطُوهُ فَقَالَ أَوْفَيْتَنِي أَوْفَاكَ اللهُ فَقَالَ رَسُولُ اللهِ ﷺ إِنَّ خِيَارَكُمْ أَحْسَنُكُمْ قَضَاءً
أَنَّهُ كَانَ يَقُولُ لَا رِبًا فِي الْحَيَوَانِ
[Machine] "It was not seen as a problem to borrow money in the past."
أَنَّهُ كَانَ لَا يَرَى بَأْسًا بِالسَّلَفِ فِي الْحَيَوَانِ
[Machine] That he saw no harm in borrowing money if it is a known amount with a known date of repayment.
أَنَّهُ كَانَ لَا يَرَى بَأْسًا بِالسَّلَفِ فِي الْحَيَوَانِ إِذَا كَانَ سِنًّا مَعْلُومًا إِلَى أَجَلٍ مَعْلُومٍ
عَنِ ابْنِ مَسْعُودٍ
[Machine] "That Ibn Mas'ud did not see any harm in peace in every matter until a designated time, except for living creatures."
أَنَّ ابْنَ مَسْعُودٍ كَانَ لَا يَرَى بَأْسًا بِالسَّلَمِ فِي كُلِّ شَيْءٍ إِلَى أَجَلٍ مُسَمًّى مَا خَلَا الْحَيَوَانَ
[Machine] The Shafi'i, who is antithetical to him, and the Sha'bi, who is larger than the one who narrated from him, claims that if he had only mentioned it in regards to the mating of camels, this would be detestable to us and to everyone. This is the sale of vaccines or guarantees, or so the sheikh says, implying the Shafi'i in the narration of those.
الشَّافِعِيُّ وَهُوَ مُنْقَطِعٌ عَنْهُ وَيَزْعُمُ الشَّعْبِيُّ الَّذِي هُوَ أَكْبَرُ مِنَ الَّذِي رَوَى عَنْهُ كَرَاهِيَتَهُ أَنَّهُ إِنَّمَا أَسْلَفَ لَهُ فِي لِقَاحِ فَحْلِ إِبِلٍ بِعَيْنِهِ وَهَذَا مَكْرُوهٌ عِنْدَنَا وَعِنْدَ كُلِّ أَحَدٍ هَذَا بَيْعُ الْمَلَاقِيحِ أَوِ الْمَضَامِينِ أَوْ هُمَا قَالَ الشَّيْخُ يُرِيدُ الشَّافِعِيُّ بِرِوَايَةِ مَنْ
13.139 [Machine] What indicates that the animal is controlled by characteristics?
١٣۔١٣٩ بَابُ مَا يُسْتَدَلُّ بِهِ عَلَى أَنَّ الْحَيَوَانَ يُضْبَطُ بِالصِّفَةِ
[Machine] The Messenger of Allah ﷺ said, "A woman should not have a private conversation with another woman, and then speak ill of her to her husband as if he is looking at her." This is narrated in Sahih Al-Bukhari from the Hadith of Al-A'mash.
قَالَ رَسُولُ اللهِ ﷺ لَا تُبَاشِرُ الْمَرْأَةُ الْمَرْأَةَ ثُمَّ تَنْعَتُهَا لِزَوْجِهَا كَأَنَّهُ يَنْظُرُ إِلَيْهَا أَخْرَجَاهُ فِي الصَّحِيحِ مِنْ حَدِيثِ الْأَعْمَشِ
13.140 [Machine] It is not permissible for the lender until the borrower repays the amount borrowed. The loan should be of a known weight or measure. Ash-Shafi'i said: Because the Prophet said, "Whoever lends, let him lend." He only said, "Let him give." The term "lending" does not apply until he gives what he has lent before parting with the borrower.
١٣۔١٤٠ بَابُ لَا يَجُوزُ السَّلَفُ حَتَّى يَدْفَعَ الْمُسَلَّفُ ثَمَنَ مَا سُلِّفَ فِيهِ يَكُونُ السَّلَفُ بِكَيْلٍ مَعْلُومٍ أَوْ وَزْنٍ مَعْلُومٍ قَالَ الشَّافِعِيُّ: لِأَنَّ قَوْلَ النَّبِيِّ ﷺ " مَنْ سَلَّفَ فَلْيُسْلِفْ "، إِنَّمَا قَالَ: " فَلْيُعْطِ "، لَا يَقَعُ اسْمُ التَّسْلِيفِ فِيهِ حَتَّى يُعْطِيَهُ مَا سَلَّفَهُ قَبْلَ أَنْ يُفَارِقَ مَنْ سَلَّفَهُ
[Machine] The Prophet ﷺ arrived in Medina while they were trading in dates for two or three years. He said, "Whoever has borrowed date fruits should repay them with a known measure and weight, within a known period."
قَدِمَ النَّبِيُّ ﷺ الْمَدِينَةَ وَهُمْ يُسْلِفُونَ فِي التَّمْرِ السَّنَتَيْنِ وَالثَّلَاثَ فَقَالَ مَنْ سَلَّفَ فِي تَمْرٍ فَلْيُسْلِفْ فِي كَيْلٍ مَعْلُومٍ وَوَزْنٍ مَعْلُومٍ إِلَى أَجَلٍ مَعْلُومٍ
13.141 [Machine] It is not permissible for a predecessor until it is in a known manner unrelated to a specific matter
١٣۔١٤١ بَابُ لَا يَجُوزُ السَّلَفُ حَتَّى يَكُونَ بِصِفَةٍ مَعْلُومَةٍ لَا تَتَعَلَّقُ بِعَيْنٍ
[Machine] The Messenger of Allah ﷺ has prohibited the sale of palm trees until their goodness becomes evident. I asked Ibn Abbas and he said that the Messenger of Allah ﷺ has prohibited the sale of palm trees until they are ripe enough to be eaten or until they can be eaten by others, and until they are weighed. Shu'bah said, "So I asked a man in the gathering, what is meant by 'weighed'?" He said, "It means estimated."
نَهَى رَسُولُ اللهِ ﷺ عَنْ بَيْعِ النَّخْلِ حَتَّى يَبْدُوَ صَلَاحُهُ 11110 قَالَ فَسَأَلْتُ ابْنَ عَبَّاسٍ قَالَ نَهَى رَسُولُ اللهِ ﷺ عَنْ بَيْعِ النَّخْلِ حَتَّى يَأْكُلَ مِنْهُ أَوْ يُؤْكَلَ وَحَتَّى يُوزَنَ قَالَ شُعْبَةُ فَقُلْتُ لِرَجُلٍ فِي الْحَلْقَةِ مَا يُوزَنُ؟ قَالَ يُحْزَرُ
[Machine] Umar forbade the sale of dates until they ripen, and he forbade using gold to cover paper with a poor design. He asked about interpretation and said, "What should be weighed?" A man replied, "Something until it is achieved."
نَهَى عُمَرُ عَنْ بَيْعِ التَّمْرِ حَتَّى يَصْلُحَ وَنَهَى عَنِ الْوَرِقِ بِالذَّهَبِ نَسِيئًا بِنَاجِزٍ وَقَالَ فِي التَّفْسِيرِ قُلْتُ مَا يُوزَنُ؟ قَالَ رَجُلٌ عِنْدَهُ حَتَّى يُحْرَزَ
[Machine] I heard a man from the people of Najran say, "I said to Ibn Umar, 'I ask you about the date palm's ladder.' He replied, 'Regarding the date palm's ladder, if a man embraces Islam on a date palm and it bears fruits that year, then he mentioned that to the Prophet ﷺ who asked, 'How will he eat its fruits?' So the Prophet ﷺ ordered him to return it, then he prohibited the use of the ladder on the date palm until its fruits become visible."
سَمِعْتُ رَجُلًا مِنْ أَهْلِ نَجْرَانَ يَقُولُ قُلْتُ لِابْنِ عُمَرَ أَسْأَلُكَ عَنِ السَّلَمِ فِي النَّخْلِ فَقَالَ أَمَّا السَّلَمُ فِي النَّخْلِ فَإِنَّ رَجُلًا أَسْلَمَ فِي نَخْلٍ لِرَجُلٍ فَلَمْ يَحْمِلْ ذَلِكَ الْعَامَ فَذَكَرَ ذَلِكَ لِلنَّبِيِّ ﷺ فَقَالَ بِمَ تَأْكُلُ مَالَهُ؟ فَأَمَرَهُ فَرَدَّ عَلَيْهِ ثُمَّ نَهَى عَنِ السَّلَمِ فِي النَّخْلِ حَتَّى يَبْدُوَ صَلَاحُهُ
A man paid in advance for a palm-tree. It did not bear fruit that year. They brought their case for decision to the Prophet ﷺ. He said: for which do you make his property lawful? He then said: Do not pay in advance for a palm-tree till they (the fruits) were clearly in good condition. (Using translation from Abū Dāʾūd 3467)
أَنَّ رَجُلًا أَسْلَفَ رَجُلًا فِي نَخْلٍ فَلَمْ يُخْرِجْ تِلْكَ السَّنَةَ شَيْئًا فَاخْتَصَمَا إِلَى رَسُولِ اللهِ ﷺ فَقَالَ بِمَ تَسْتَحِلُّ مَالَهُ؟ ارْدُدْ عَلَيْهِ قَالَ ثُمَّ قَالَ لَا تُسْلِفُوا فِي النَّخْلِ حَتَّى يَبْدُوَ صَلَاحُهُ
[Machine] "Would you sell me a known amount of dates for a known period of time from the wall of the tribe of Fulan?" He said, "No, O Jew, but I will sell you a known amount of dates for such and such period, and I will not specify the wall of the tribe of Fulan." So I said, "Yes," and he made a contract with me. I released my debt and gave him eighty dinars for a known amount of dates for such and such period.
أَنْ تَبِيعَنِي تَمْرًا مَعْلُومًا إِلَى أَجَلٍ مَعْلُومٍ مِنْ حَائِطِ بَنِي فُلَانٍ؟ قَالَ لَا يَا يَهُودِيُّ وَلَكِنِّي أَبِيعُكَ تَمْرًا مَعْلُومًا إِلَى كَذَا وَكَذَا مِنَ الْأَجَلِ وَلَا أُسَمِّي مِنْ حَائِطِ بَنِي فُلَانٍ فَقُلْتُ نَعَمْ فَبَايَعَنِي فَأَطْلَقْتُ هِمْيَانِي وَأَعْطَيْتُهُ ثَمَانِينَ دِينَارًا فِي تَمْرٍ مَعْلُومٍ إِلَى كَذَا وَكَذَا مِنَ الْأَجَلِ
13.142 [Machine] It is not permissible for a loan to be made until it is for a known price in a known measure or weight, with a specified term, and it does not differ if it is for a known term, as stated by the Prophet ﷺ : "in a known measure, and a known weight, for a known term." And his prohibition of selling goods that contain deception.
١٣۔١٤٢ بَابُ لَا يَجُوزُ السَّلَفُ حَتَّى يَكُونَ بِثَمَنٍ مَعْلُومٍ فِي كَيْلٍ مَعْلُومٍ أَوْ وَزْنٍ مَعْلُومٍ إِلَى أَجَلٍ وَلَا يَخْتَلِفُ إِنْ كَانَ إِلَى أَجَلٍ مَعْلُومٍ لِقَوْلِهِ ﷺ: " فِي كَيْلٍ مَعْلُومٍ، وَوَزْنٍ مَعْلُومٍ، إِلَى أَجَلٍ مَعْلُومٍ "، وَنَهْيِهِ عَنْ بَيْعِ الْغَرَرِ
[Machine] There is no predecessor to giving, nor to harvesting, nor to rarity, nor to juice; set for it a time.
لَا سَلَفَ إِلَى الْعَطَاءِ وَلَا إِلَى الْحَصَادِ وَلَا إِلَى الْأَنْدَرِ وَلَا إِلَى الْعَصِيرِ وَاضْرِبْ لَهُ أَجَلًا
[Machine] He hated peace until the harvest, the cutting, and the threshing, but then he called it a month.
أَنَّهُ كَرِهَ السَّلَمَ إِلَى الْحَصَادِ وَالْقَصِيلِ وَالْبَيْدَرِ وَلَكِنْ سَمِّهِ شَهْرًا
[Machine] Peace is like interest, but with a known measure and a known term. So, take as much as you can, and according to the narration of Abdul Razzaq, take what you can from it within a known measure and a known term, and take as much as you can from it.
السَّلَمُ كَمَا يَقُومُ السِّعْرُ رِبًا وَلَكِنْ كَيْلٌ مَعْلُومٌ إِلَىْ أَجَلٍ مَعْلُومٍ وَاسْتَكْثِرْ مَا اسْتَطَعْتَ وَفِي رِوَايَةِ عَبْدِ الرَّزَّاقِ أَسْلِفْ فِي كَيْلٍ مَعْلُومٍ إِلَى أَجَلٍ مَعْلُومٍ وَاسْتَكْثِرْ مِنْهُ مَا اسْتَطَعْتَ
[Machine] Regarding selling food at the price of the market value.
عَنْ بَيْعِ الطَّعَامِ بِسِعْرِ الْبَيْدَرِ
أَنْ يَشْتَرِيَ إِلَى يُسْرِهِ
[Machine] I said to Ibn Umar, "I had some money from a man, so I went to collect it from him." He replied, "I don't have it, but write it on a piece of food until the harvest." I said, "That is not reasonable."
قُلْتُ لِابْنِ عُمَرَ كَانَتْ لِي عَلَى رَجُلٍ دَرَاهِمُ فَأَتَيْتُهُ أَتَقَاضَاهُ فَقَالَ لَيْسَ عِنْدِي وَلَكِنِ اكْتُبْهَا عَلَى طَعَامٍ إِلَى الْحَصَادِ قَالَ لَا يَصْلُحُ
[Machine] Aisha came with a merchant carrying merchandise, so I said, "O Messenger of Allah, if you give me these two heavy garments, and send the merchant to Fulan to sell them, he will sell them for a good price." So the Prophet ﷺ sent a message to me to send two garments to Fulan to be sold. Fulan said, "Indeed, Muhammad wants to take my wealth." The Messenger of Allah ﷺ said, "By Allah, they know that I entrusted them with it and fear Allah. It is understood that he called for the sale to be conducted in Ma'sarah, not that he made a contract for it. If he had agreed to that, it would have been more likely that he would set a specific time or conduct the sale freely, and then settle it whenever it was easier. And Allah knows best."
عَائِشَةُ قَدِمَ تَاجِرٌ بِمَتَاعٍ فَقُلْتُ يَا رَسُولَ اللهِ لَوْ أَلْقَيْتَ هَذَيْنِ الثَّوْبَيْنِ الْغَلِيظَيْنِ عَنْكَ وَأَرْسَلْتَ إِلَى فُلَانٍ التَّاجِرِ فَبَاعَكَ ثَوْبَيْنِ إِلَى الْمَيْسَرَةِ فَبَعَثَ النَّبِيُّ ﷺ أَنْ أَرْسِلْ إِلِيَّ ثَوْبَيْنِ إِلَى الْمَيْسَرَةِ فَقَالَ إِنَّ مُحَمَّدًا يُرِيدُ أَنْ يَذْهَبَ بِمَالِي فَقَالَ رَسُولُ اللهِ ﷺ وَاللهِ لَقَدْ عَلِمُوا أَنِّي أَدَّاهُمْ لِلْأَمَانَةِ وَأَخْشَاهُمْ لِلَّهِ وَنَحْوُ هَذَا فَهَذَا مَحْمُولٌ عَلَى أَنَّهُ اسْتَدْعَى الْبَيْعَ إِلَى الْمَيْسَرَةِ لَا أَنَّهُ عَقَدَ إِلَيْهَا بَيْعًا ثُمَّ لَوْ أَجَابَهُ إِلَى ذَلِكَ أَشْبَهَ أَنْ يُوَقِّتَ وَقْتًا مَعْلُومًا أَوْ يَعْقِدَ الْبَيْعَ مُطْلَقًا ثُمَّ يَقْضِيَهُ مَتَى مَا أَيْسَرَ وَاللهُ أَعْلَمُ
13.143 [Machine] Predecessors in Wheat, Barley, Raisins, Oil, Clothing, and all things that are regulated by description.
١٣۔١٤٣ بَابُ السَّلَفِ فِي الْحِنْطَةِ وَالشَّعِيرِ وَالزَّبِيبِ وَالزَّيْتِ وَالثِّيَابِ وَجَمِيعِ مَا يُضْبَطُ بِالصِّفَةِ
[Machine] Abu Burdah and Abdullah ibn Shaddad sent me to Abdullah ibn Abi Awfa to ask him, "Did you used to pay tribute to the Messenger of Allah ﷺ with wheat, barley, and raisins?" So, I asked him and he said, "We used to pay tribute to the people of Sham with wheat, barley, and raisins in a known measure for a known time." I asked him, "Was there anyone among you who had crops?" He said, "We did not ask them about that." He also sent me to Abdul Rahman ibn Abza and asked him, "Ask him if the companions of the Messenger of Allah ﷺ used to pay tribute with wheat, barley, and raisins during the time of the Messenger of Allah ﷺ?" He replied, "The companions of the Messenger of Allah ﷺ used to pay tribute with wheat, barley, and raisins to the people of Sham in a known measure for a known time. They did not ask you whether you had crops or not."
بَعَثَنِي أَبُو بُرْدَةَ وَعَبْدُ اللهِ بْنُ شَدَّادٍ إِلَى عَبْدِ اللهِ بْنِ أَبِي أَوْفَى أَسْأَلُهُ أَكُنْتُمْ تُسْلِمُونَ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ فِي الْحِنْطَةِ وَالشَّعِيرِ وَالزَّبِيبِ؟ فَسَأَلْتُهُ فَقَالَ كُنَّا نُسْلِمُ إِلَى نَبِيطِ الشَّامِ فِي الْحِنْطَةِ وَالشَّعِيرِ وَالزَّبِيبِ فِي كَيْلٍ مَعْلُومٍ إِلَى أَجَلٍ مَعْلُومٍ قُلْتُ إِلَى مَنْ كَانَ لَهُ زَرْعٌ؟ قَالَ مَا كُنَّا نَسْأَلُهُمْ عَنْ ذَلِكَ قَالَ وَبَعَثَانِي إِلَى عَبْدِ الرَّحْمَنِ بْنِ أَبْزَى فَقَالَا سَلْهُ هَلْ كَانَ أَصْحَابُ رَسُولِ اللهِ ﷺ يُسْلِمُونَ فِي عَهْدِ رَسُولِ اللهِ ﷺ فِي الْحِنْطَةِ وَالشَّعِيرِ وَالزَّبِيبِ؟ فَقَالَ كَانَ أَصْحَابُ رَسُولِ اللهِ ﷺ يُسْلِمُونَ فِي الْحِنْطَةِ وَالشَّعِيرِ وَالزَّبِيبِ إِلَى نَبِيطِ الشَّامِ فِي كَيْلٍ مَعْلُومٍ إِلَى أَجَلٍ مَعْلُومٍ وَمَا كَانُوا يَسْأَلُونَ أَلَكُمْ حَرْثٌ أَمْ لَا؟
[Machine] If there is a known time for a known crop, then there is no problem.
إِذَا كَانَ زَرْعٌ مَعْلُومٌ إِلَى أَجَلٍ مَعْلُومٍ فَلَا بَأْسَ
أَنْ يُسْلِمَ فِي اللَّحْمِ
13.144 [Machine] The Predecessors in What is Sold by Weight, such as Ghee and Honey, and the like.
١٣۔١٤٤ بَابُ السَّلَفِ فِيمَا يُبَاعُ كَيْلًا فِي الْوَزْنِ مِثْلِ السَّمْنِ وَالْعَسَلِ وَمَا أَشْبَهَهُ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: فَإِنْ قَالَ قَائِلٌ: فَكَيْفَ كَانَ يُبَاعُ فِي عَهْدِ النَّبِيِّ ﷺ؟ قُلْنَا: اللهُ أَعْلَمُ، أَمَا الَّذِي أَدْرَكْنَا الْمُتَبَايِعِينَ عَلَيْهِ بِمَا قَلَّ مِنْهُ يُبَاعُ كَيْلًا، وَالْجُمْلَةُ الْكَثِيرَةُ تُبَاعُ وَزْنًا، وَدِلَالَةُ الْأَخْبَارِ عَلَى مِثْلِ مَا أَدْرَكْنَا النَّاسَ عَلَيْهِ، قَالَ عُمَرُ بْنُ الْخَطَّابِ : لَا آكُلُ السَّمْنَ مَا دَامَ السَّمْنُ يُبَاعُ بِالْأَوَاقِ، وَتُشْبِهُ الْأَوَاقِ أَنْ تَكُونَ كَيْلًا
[Machine] By Allah, O stomach, you will surely pass over bread and oil as long as ghee is sold by the ounce.
أَمَا وَاللهِ لَتَمُرَّنَنَّ أَيُّهَا الْبَطْنُ عَلَى الْخُبْزِ وَالزَّيْتِ مَا دَامَ السَّمْنُ يُبَاعُ بِالْأَوَاقِ
13.145 [Machine] Pure musk is permissible to be sold, bought, and used as an advance payment.
١٣۔١٤٥ بَابُ الْمِسْكُ طَاهِرٌ يَحِلُّ بَيْعُهُ وَشِرَاؤُهُ وَالسَّلَفُ فِيهِ
[Machine] He ﷺ said: "The example of a good company and a bad company is like that of the carrier of musk and the blacksmith. The carrier of musk, either he will give you some perfume, or you buy from him, or you will find a pleasant fragrance from him. As for the blacksmith, either he will burn your clothes, or you will find a foul smell from him."
ﷺ أَنَّهُ قَالَ إِنَّمَا مَثَلُ جَلِيسِ الصَّالِحِ وَجَلِيسِ السُّوءِ كَحَامِلِ الْمِسْكِ وَنَافِخِ الْكِيرِ حَامِلُ الْمِسْكِ إِمَّا أَنْ يُحْذِيَكَ وَإِمَّا أَنْ تَبْتَاعَ مِنْهُ وَإِمَّا أَنْ تَجِدَ مِنْهُ رِيحًا طَيِّبَةً وَنَافِخُ الْكِيرِ إِمَّا أَنْ يَحْرِقَ ثِيَابَكَ وَإِمَّا أَنْ تَجِدَ رِيحًا خَبِيثَةً
[Machine] The Messenger of Allah ﷺ said to Umm Salamah: "I have gifted some musk and jewelry to the Negus. However, I do not see him alive anymore, and I do not see the gift I sent him. If it is returned to me, then it is for you or for you all." He said this because the Negus had died. When the gift was returned to him, he gave each of his wives a necklace made of musk and gave the rest to Umm Salamah and all of them. He also gave her the jewelry. In another narration by Musaddad, he said: "If it is returned to me, then I think I will distribute it among you all or it is for you." He said this and it was as he said ﷺ.
رَسُولُ اللهِ ﷺ أُمَّ سَلَمَةَ ؓ قَالَ لَهَا إِنِّي قَدْ أَهْدَيْتُ إِلَى النَّجَاشِيِّ أَوَاقٍ مِنْ مِسْكٍ وَحُلَّةً وَإِنِّي لَا أُرَاهُ إِلَّا قَدْ مَاتَ وَلَا أَرَى الْهَدِيَّةَ الَّتِي أَهْدَيْتُ إِلَيْهِ إِلَّا سَتُرَدُّ فَإِذَا رُدَّتْ إِلِيَّ فَهِيَ لَكِ أَوْ لَكُنَّ فَكَانَ كَمَا قَالَ هَلَكَ النَّجَاشِيُّ ؓ فَلَمَّا رُدَّتْ إِلَيْهِ الْهَدِيَّةُ أَعْطَى كُلَّ امْرَأَةٍ مِنْ نِسَائِهِ أُوقِيَّةً مِنْ ذَلِكَ الْمِسْكِ وَأَعْطَى سَائِرَهُ أُمَّ سَلَمَةَ ؓ وَعَنْهُنَّ أَجْمَعِينَ وَأَعْطَاهَا الْحُلَّةَ وَفِي رِوَايَةِ مُسَدَّدٍ إِلَّا سَتُرَدُّ عَلَيَّ فَإِنْ رُدَّتْ عَلَيَّ أَظُنُّهُ قَالَ قَسَمْتُهَا بَيْنَكُنَّ أَوْ فَهِيَ لَكِ قَالَ فَكَانَ كَمَا قَالَ ﷺ
13.146 [Machine] Who should the Muslim give some of the greeting and take some of it?
١٣۔١٤٦ بَابُ مَنْ أَقَالَ الْمُسْلَمَ إِلَيْهِ بَعْضَ السَّلَمِ وَقَبَضَ بَعْضًا
[Machine] The Messenger of Allah ﷺ said, "Whoever disgraces a Muslim, Allah will disgrace him. And in another narration from Al-Misri, "Whoever disgraces someone and then regrets it, Allah will disgrace him."
قَالَ رَسُولُ اللهِ ﷺ مَنْ أَقَالَ مُسْلَمًا أَقَالَهُ اللهُ عَثْرَتَهُ وَفِي رِوَايَةِ الْمِصْرِيِّ مَنْ أَقَالَ نَادِمًا أَقَالَهُ اللهُ
[Machine] The Messenger of Allah ﷺ said, "Whosoever causes remorse in someone, Allah will cause remorse in him on the Day of Resurrection." Narrated by Abu Al-Husayn Ibn Bishran, who narrated from Abu Al-Hasan Ali Ibn Muhammad Al-Misri, who narrated from Ali Ibn Abdul Aziz, who dictated it in Makkah, narrated by Ishaq Al-Farwi, who mentioned it in a similar manner.
أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنْ أَقَالَ نَادِمًا أَقَالَهُ اللهُ تَعَالَى يَوْمَ الْقِيَامَةِ 11130 وَأَخْبَرَنَا أَبُو الْحُسَيْنِ بْنُ بِشْرَانَ أنبأ أَبُو الْحَسَنِ عَلِيُّ بْنُ مُحَمَّدٍ الْمِصْرِيُّ ثنا عَلِيُّ بْنُ عَبْدِ الْعَزِيزِ إِمْلَاءً بِمَكَّةَ ثنا إِسْحَاقُ الْفَرْوِيُّ فَذَكَرَهُ بِنَحْوِهِ
[Machine] The Messenger of Allah ﷺ said, "Whoever mentions a Muslim's shortcomings, Allah will mention his shortcomings on the Day of Judgment." Abu al-Abbas said, "Isaak used to narrate this hadith from Malik, from Sumayy, who narrated it from his original book, from Suhail. The sheikh said, 'This text is not the text of Sumayy's hadith, and Allah knows best.' It was also narrated from Muhammad ibn Wasi' from Abu Salih."
قَالَ رَسُولُ اللهِ ﷺ مَنْ أَقَالَ مُسْلِمًا عَثْرَتَهُ أَقَالَهُ اللهُ تَعَالَى يَوْمَ الْقِيَامَةِ قَالَ أَبُو الْعَبَّاسِ كَانَ إِسْحَاقُ يُحَدِّثُ بِهَذَا الْحَدِيثِ عَنْ مَالِكٍ عَنْ سُمَيٍّ فَحَدَّثَنَا بِهِ مِنْ أَصْلِ كِتَابِهِ عَنْ سُهَيْلٍ قَالَ الشَّيْخُ هَذَا الْمَتْنُ غَيْرُ مَتْنِ حَدِيثِ سُمَيٍّ وَاللهُ أَعْلَمُ وَرُوِيَ عَنْ مُحَمَّدِ بْنِ وَاسِعٍ عَنْ أَبِي صَالِحٍ
[Machine] The Messenger of Allah ﷺ said, "Whoever causes someone regret, Allah will cause him regret on the Day of Resurrection, and he mentioned the narration."
قَالَ رَسُولُ اللهِ ﷺ مَنْ أَقَالَ نَادِمًا أَقَالَهُ اللهُ نَفْسَهُ يَوْمَ الْقِيَامَةِ وَذَكَرَ الْحَدِيثَ
[Machine] Some of your wealth is charity, and some is capital. This is known. Jabir al-Ju'fi narrated from Nafi' from Ibn 'Umar the meaning of Ibn 'Abbas' statement, which is well known from Ibn 'Umar, that he disliked that. And we were narrated from 'Ata' ibn Abi Rabah and 'Amr ibn Dinar the meaning of Ibn 'Abbas' statement.
بَعْضَ سَلَمِكَ وَبَعْضَ رَأْسِ مَالِكَ فَذَلِكَ الْمَعْرُوفُ وَرَوَى جَابِرٌ الْجُعْفِيُّ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ مَعْنَى قَوْلِ ابْنِ عَبَّاسٍ وَالْمَشْهُورُ عَنِ ابْنِ عُمَرَ ؓ أَنَّهُ كَرِهَ ذَلِكَ وَرُوِّينَا عَنْ عَطَاءِ بْنِ أَبِي رَبَاحٍ وَعَمْرِو بْنِ دِينَارٍ مَعْنَى قَوْلِ ابْنِ عَبَّاسٍ
[Machine] To buy a sale and then return it, and to return with its dirhams, indicates that aikalah is invalid except with capital. As for tawliyah, it is a sale, as mentioned by Al-Hasan, Muhammad bin Sireen, and Ata' bin Abi Rabah. Similarly, partnership is not permissible among us before the commodity is acquired, due to what has been mentioned about the prohibition of selling food before acquisition.
أَنْ يَبْتَاعَ الْبَيْعَ ثُمَّ يَرُدَّهُ وَيَرُدَّ مَعَهُ دَرَاهِمَ وَفِي هَذَا دَلَالَةٌ عَلَى أَنَّ الْإِقَالَةَ فَسْخٌ فَلَا تَجُوزُ إِلَّا بِرَأْسِ الْمَالِ وَأَمَّا التَّوْلِيَةُ فَهِيَ بَيْعٌ قَالَهُ الْحَسَنُ وَمُحَمَّدُ بْنُ سِيرِينَ وَعَطَاءُ بْنُ أَبِي رَبَاحٍ وَكَذَلِكَ الشَّرِكَةُ عِنْدَنَا فَلَا تَجُوزَانِ فِي السَّلَمِ قَبْلَ الْقَبْضِ؛ لِمَا مَضَى فِي النَّهْيِ عَنْ بَيْعِ الطَّعَامِ قَبْلَ الْقَبْضِ
