١٣۔ كِتَابُ الْبُيُوعِ ص ١٤
[Machine] On the authority of Abu Al-Yasar, the companion of the Prophet ﷺ , who said: The Messenger of Allah ﷺ said, "Whoever wishes to be shaded by Allah in His shade, let him look after someone in difficulty or feed a person in need." This hadith has also been narrated by Abu Qatadah through the Prophet ﷺ , who said, "Whoever seeks Allah's help and protection from distress on the Day of Resurrection, let him look after someone in difficulty or relieve him of his burden."
عَنْ أَبِي الْيَسَرِ صَاحِبِ النَّبِيِّ ﷺ قَالَ قَالَ رَسُولُ اللهِ ﷺ مَنْ أَحَبَّ أَنْ يُظِلَّهُ اللهُ فِي ظِلِّهِ فَلْيُنْظِرْ مُعْسِرًا أَوْ لِيَضَعْ لَهُ وَقَدْ مَضَى فِي الْحَدِيثِ الثَّابِتِ عَنْ أَبِي قَتَادَةَ عَنِ النَّبِيِّ ﷺ مَنْ سَرَّهُ أَنْ يُنَجِّيَهُ اللهُ مِنْ كُرَبِ يَوْمِ الْقِيَامَةِ فَلْيُنْظِرْ مُعْسِرًا أَوْ لِيَضَعْ عَنْهُ
[Machine] To say "I hurry for you and you put off me" while there is a weak hadith narrated in its chain of transmission.
أَنْ يَقُولَ أُعَجِّلُ لَكَ وَتَضَعُ عَنِّي وَقَدْ رُوِيَ فِيهِ حَدِيثٌ مُسْنَدٌ فِي إِسْنَادِهِ ضَعْفٌ
[Machine] When the Prophet ﷺ ordered the expulsion of the Banu Nadir from the city, some people from among them came to him and said, "O Messenger of Allah, you have ordered their expulsion, and they have debts with people that have not been settled." The Prophet ﷺ said, "Let them go and hasten." This narration was reported by Al-Waqidi in his book Siyar, from Ibn Abi Al-Zuhri, from Al-Zuhri, from Urwah ibn Al-Zubayr.
لَمَّا أَمَرَ النَّبِيُّ ﷺ بِإِخْرَاجِ بَنِي النَّضِيرِ مِنَ الْمَدِينَةِ جَاءَهُ نَاسٌ مِنْهُمْ فَقَالُوا يَا رَسُولَ اللهِ إِنَّكَ أَمَرْتَ بإخْرَاجِهِمْ وَلَهُمْ عَلَى النَّاسِ دُيُونٌ لَمْ تَحِلَّ فَقَالَ النَّبِيُّ ﷺ ضَعُوا وَتَعَجَّلُوا أَوْ قَالَ وَتَعَاجَلُوا وَرَوَاهُ الْوَاقِدِيُّ فِي سِيَرِهِ عَنِ ابْنِ أَبِي الزُّهْرِيِّ عَنِ الزُّهْرِيِّ عَنْ عُرْوَةَ بْنِ الزُّبَيْرِ
13.148 [Machine] There is no good in rushing it, provided that he puts it aside.
١٣۔١٤٨ بَابُ لَا خَيْرَ فِي أَنْ يُعَجِّلَهُ بِشَرْطِ أَنْ يَضَعَ عَنْهُ
[Machine] He said, "I sent a letter to the people of the market for a period, then I wanted to go out to Kufa, so they offered me to waive my rights and they would compensate me. So I asked Zaid bin Thabit about it, and he said, 'I do not command you to eat this and not eat it.'"
أَنَّهُ قَالَ بِعْتُ بُرًّا مِنْ أَهْلِ السُّوقِ إِلَى أَجَلٍ ثُمَّ أَرَدْتُ الْخُرُوجَ إِلَى الْكُوفَةِ فَعَرَضُوا عَلَيَّ أَنْ أَضَعَ عَنْهُمْ وَيَنْقُدُونِي فَسَأَلْتُ عَنْ ذَلِكَ زَيْدَ بْنَ ثَابِتٍ ؓ فَقَالَ لَا آمُرُكَ أَنْ تَأْكُلَ هَذَا وَلَا تُؤْكِلَهُ
[Machine] About a man who has a debt to another man for a period of time, and the creditor forgives him while the debtor rushes to pay it off. Ibn Umar disapproved of that and prohibited it.
عَنْ رَجُلٍ يَكُونُ لَهُ الدَّيْنُ عَلَى رَجُلٍ إِلَى أَجَلٍ فَيَضَعُ عَنْهُ صَاحِبُهُ وَيُعَجِّلُ لَهُ الْآخَرُ قَالَ فَكَرِهَ ابْنُ عُمَرَ ذَلِكَ وَنَهَى عَنْهُ
[Machine] To sell the eye for debt is prohibited, and it has been narrated in a hadith with a weak chain of narration.
أَنْ نَبِيعَ الْعَيْنَ بِالدَّيْنِ وَرُوِيَ فِيهِ حَدِيثٌ مُسْنَدٌ فِي إِسْنَادِهِ ضَعْفٌ
[Machine] I advanced a man one hundred dinars, then he went on a journey. Upon his return, the Messenger of Allah ﷺ sent him a gift. I said to him, "Give me back ninety dinars and keep ten dinars for yourself." He agreed to the arrangement. I mentioned this to the Messenger of Allah ﷺ , and he said, "O Muqaddad, have you engaged in usury and fed it to others?"
أَسْلَفْتُ رَجُلًا مِائَةَ دِينَارٍ ثُمَّ خَرَجَ سَهْمِي فِي بَعَثٍ بَعَثَهُ رَسُولُ اللهِ ﷺ فَقُلْتُ لَهُ عَجِّلْ لِي تِسْعِينَ دِينَارًا وَأَحُطُّ عَشَرَةَ دَنَانِيرَ فَقَالَ نَعَمْ فَذَكَرَ ذَلِكَ لِرَسُولِ اللهِ ﷺ فَقَالَ أَكَلْتَ رِبًا يَا مِقْدَادُ وَأَطْعَمْتَهُ
13.149 [Machine] Whoever dislikes saying, "I converted to Islam with so-and-so," should say, "I followed the Salaf.
١٣۔١٤٩ بَابُ مَنْ كَرِهَ أَنْ يَقُولَ: أَسْلَمْتُ عِنْدَ فُلَانٍ فِي كَذَا، وَلْيَقُلْ: سَلَّفْتُ
[Machine] He used to dislike this phrase "Submit" or "Surrender" and would say, "Verily, Islam is only for Allah, the Lord of all the worlds."
أَنَّهُ كَانَ يَكْرَهُ هَذِهِ الْكَلِمَةَ أَسْلَمَ كَذَا وَكَذَا وَيَقُولُ إِنَّمَا الْإِسْلَامُ لِلَّهِ رَبِّ الْعَالَمِينَ
13.150 [Machine] Pricing
١٣۔١٥٠ بَابُ التَّسْعِيرِ
[Machine] A man came to the Messenger of Allah ﷺ and said, "O Messenger of Allah, set a price." He replied, "No, rather ask Allah." Then, another man came to him and said, "O Messenger of Allah, set a price." He replied, "No, Allah is the one who raises and lowers. And I hope to meet Allah while there is no injustice on my part towards anyone." Abu Dawood narrated it in his Sunan from Muhammad ibn Uthman al-Dimashqi from Sulayman ibn Bilal. Ismail ibn Ja'far also narrated it from al-Ala'.
أَنَّ رَجُلًا جَاءَ إِلَى رَسُولِ اللهِ ﷺ فَقَالَ يَا رَسُولَ اللهِ سَعِّرْ قَالَ بَلِ ادْعُ اللهَ ثُمَّ جَاءَهُ رَجُلٌ فَقَالَ يَا رَسُولَ اللهِ سَعِّرْ قَالَ بَلِ اللهُ يَرْفَعُ وَيَخْفِضُ وَإِنِّي لَأَرْجُو أَنْ أَلْقَى اللهَ وَلَيْسَتْ لِأَحَدٍ عِنْدِي مَظْلِمَةٌ وَرَوَاهُ أَبُو دَاوُدَ فِي كِتَابِ السُّنَنِ عَنْ مُحَمَّدِ بْنِ عُثْمَانَ الدِّمَشْقِيِّ عَنْ سُلَيْمَانَ بْنِ بِلَالٍ وَرَوَاهُ أَيْضًا إِسْمَاعِيلُ بْنُ جَعْفَرٍ عَنِ الْعَلَاءِ
[Machine] The price has increased during the time of the Messenger of Allah ﷺ , so they said, "O Messenger of Allah, the price has increased, so set a price for us." He said, "Verily, Allah is the One who sets prices, the One who withholds and extends provision. And indeed, I hope to meet my Lord, and there is none among you seeking compensation for blood or wealth. Abu Al-Khair Jaami' ibn Ahmad ibn Muhammad Al-Wakeel Al-Muhammadabadi informed us that Abu Tahir Muhammad ibn Al-Hasan Al-Muhammadabadhi narrated to us that Uthman ibn Sa'id Al-Darimi narrated to us that Musa ibn Ismail narrated to us that Hammad mentioned it in a similar manner, except that he said, "Verily, Allah is the Creator, the One who withholds and extends provision, the Provider who sets prices."
قَدْ غَلَا السِّعْرُ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ فَقَالُوا يَا رَسُولَ اللهِ قَدْ غَلَا السِّعْرُ فَسَعِّرْ لَنَا فَقَالَ إِنَّ اللهَ هُوَ الْمُسَعِّرُ الْقَابِضُ الْبَاسِطُ الرَّزَّاقُ وَإِنِّي لَأَرْجُو أَنْ أَلْقَى رَبِّي وَلَيْسَ أَحَدٌ مِنْكُمْ يَطْلُبُنِي بِمَظْلِمَةٍ فِي دَمٍ وَلَا مَالٍ 11145 وَأَخْبَرَنَا أَبُو الْخَيْرِ جَامِعُ بْنُ أَحْمَدَ بْنِ مُحَمَّدٍ الْوَكِيلُ الْمُحَمَّدْآبَاذِيُّ أنبأ أَبُو طَاهِرٍ مُحَمَّدُ بْنُ الْحَسَنِ الْمُحَمَّدْآبَاذِيُّ ثنا عُثْمَانُ بْنُ سَعِيدٍ الدَّارِمِيُّ ثنا مُوسَى بْنُ إِسْمَاعِيلَ ثنا حَمَّادٌ فَذَكَرَهُ بِنَحْوِهِ إِلَّا أَنَّهُ قَالَ إِنَّ اللهَ ﷻ هُوَ الْخَالِقُ الْقَابِضُ الْبَاسِطُ الرَّازِقُ الْمُسَعِّرُ
[Machine] "To raise the price of our market, this is a summary and its completeness in what Al-Shafi'i narrated from Al-Daraawardi from Dawood ibn Saleh Al-Tammari from Al-Qasim ibn Muhammad from Umar. He passed by a guy in the marketplace of Al-Musalla and in front of him were two sacks containing raisins. He asked about their price and he priced them for him at a high price per dirham. Umar said to him, 'I was informed of a she-camel coming from Ta'if carrying raisins and they consider your price. So either you increase the price or you bring your raisins back home and sell them as you wish.' When Umar returned, he calculated himself and then went to the guy in his house and said to him, 'What I said was not an intention or decision from me, but it was something I wanted for the good of the people of the city. So wherever you want, sell, and however you want, sell.' And this is what Abu Nu'aym wrote to me, Abdullah ibn Al-Malik ibn Al-Hasan Al-Isfiraayeeni, that Abu Awanah informed them. He said, Thabit Al-Muzani narrated from Al-Shafi'i and mentioned it."
أَنْ تَرْفَعَ مِنْ سُوقِنَا فَهَذَا مُخْتَصَرٌ وَتَمَامُهُ فِيمَا رَوَى الشَّافِعِيُّ عَنِ الدَّرَاوَرْدِيِّ عَنْ دَاوُدَ بْنِ صَالِحٍ التَّمَّارِ عَنِ الْقَاسِمِ بْنِ مُحَمَّدٍ عَنْ عُمَرَ ؓ أَنَّهُ مَرَّ بِحَاطِبٍ بِسُوقِ الْمُصَلَّى وَبَيْنَ يَدَيْهِ غَرَارَتَانِ فِيهِمَا زَبِيبٌ فَسَأَلَهُ عَنْ سِعْرِهِمَا فَسَعَّرَ لَهُ مُدَّيْنِ لِكُلِّ دِرْهَمٍ فَقَالَ لَهُ عُمَرُ ؓ قَدْ حُدِّثْتُ بِعِيرٍ مُقْبِلَةٍ مِنَ الطَّائِفِ تَحْمِلُ زَبِيبًا وَهُمْ يَعْتَبِرُونَ بِسِعْرِكَ فَإِمَّا أَنْ تَرْفَعَ فِي السِّعْرِ وَإِمَّا أَنْ تُدْخِلَ زَبِيبَكَ الْبَيْتَ فَتَبِيعَهُ كَيْفَ شِئْتَ فَلَمَّا رَجَعَ عُمَرُ حَاسَبَ نَفْسَهُ ثُمَّ أَتَى حَاطِبًا فِي دَارِهِ فَقَالَ لَهُ إِنَّ الَّذِي قُلْتُ لَيْسَ بِعَزْمَةٍ مِنِّي وَلَا قَضَاءٍ إِنَّمَا هُوَ شَيْءٌ أَرَدْتُ بِهِ الْخَيْرَ لِأَهْلِ الْبَلَدِ فَحَيْثُ شِئْتَ فَبِعْ وَكَيْفَ شِئْتَ فَبِعْ وَهَذَا فِيمَا كَتَبَ إِلِيَّ أَبُو نُعَيْمٍ عَبْدُ الْمَلِكِ بْنُ الْحَسَنِ الْإِسْفِرَايِينِيُّ أَنَّ أَبَا عَوَانَةَ أَخْبَرَهُمْ قَالَ ثنا الْمُزَنِيُّ ثنا الشَّافِعِيُّ فَذَكَرَهُ
13.151 [Machine] What is mentioned in the contract?
١٣۔١٥١ بَابُ مَا جَاءَ فِي الِاحْتِكَارِ
He who hoards is a sinner. It was said to Saʿid (b. al-Musayyib): You also hoard. Saʿid said: Maʿmar who narrated this hadith also hoarded. (Using translation from Muslim 1605a)
قَالَ رَسُولُ اللهِ ﷺ مَنِ احْتَكَرَ فَهُوَ خَاطِئٌ فَقَالَ إِنْسَانٌ لِسَعِيدٍ فَإِنَّكَ تَحْتَكِرُ فَقَالَ سَعِيدٌ مَعْمَرٌ الَّذِي كَانَ يُحَدِّثُ هَذَا الْحَدِيثَ كَانَ يَحْتَكِرُ
[Machine] The Messenger of Allah ﷺ said, "No one hoards except a sinner." So, I said to Sa'id, "Indeed, you hoard." He said, "And Ma'mar used to hoard the wording of the hadith of Abu Abdullah, but there is no reporting of Ibn Abdan by the sons of Adi ibn Ka'b." And he added at the end, "Amr said, 'Sa'id used to hoard oil.'"
قَالَ رَسُولُ اللهِ ﷺ لَا يَحْتَكِرُ إِلَّا خَاطِئٌ فَقُلْتُ لِسَعِيدٍ فَإِنَّكَ تَحْتَكِرُ قَالَ وَمَعْمَرٌ كَانَ يَحْتَكِرُ لَفْظُ حَدِيثِ أَبِي عَبْدِ اللهِ وَلَيْسَ فِي رِوَايَةِ ابْنِ عَبْدَانَ أَحَدِ بَنِي عَدِيِّ بْنِ كَعْبٍ وَزَادَ فِي آخِرِهِ قَالَ عَمْرٌو كَانَ سَعِيدٌ يَحْتَكِرُ الزَّيْتَ
[Machine] The Messenger of Allah ﷺ said: "Whoever hoards intending to overcharge the Muslims, he is in error and has been discharged from the protection of Allah."
قَالَ رَسُولُ اللهِ ﷺ مَنِ احْتَكَرَ يُرِيدُ أَنْ يُغَالِيَ بِهَا عَلَى الْمُسْلِمِينَ فَهُوَ خَاطِئٌ وَقَدْ بَرِئَتْ مِنْهُ ذِمَّةُ اللهِ
[Machine] I heard the Messenger of Allah ﷺ saying, "Whoever enters into the prices of the Muslims, intending to exploit them, it is obligatory upon Allah to throw him into a portion of Hellfire on the Day of Resurrection."
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَنْ دَخَلَ فِي شَيْءٍ مِنْ أَسْعَارِ الْمُسْلِمِينَ لِيُغْلِيَهُ عَلَيْهِمْ كَانَ حَقًّا عَلَى اللهِ أَنْ يَقْذِفَهُ فِي مُعْظَمٍ مِنَ النَّارِ يَوْمَ الْقِيَامَةِ
[Machine] The Messenger of Allah ﷺ said, "The one who brings goods and resources is blessed, while the one who hoards and monopolizes is cursed." Ali ibn Salim narrated this from Ali ibn Zaid. Al-Bukhari said, "His narration is not considered reliable."
قَالَ رَسُولُ اللهِ ﷺ الْجَالِبُ مَرْزُوقٌ وَالْمُحْتَكِرُ مَلْعُونٌ تَفَرَّدَ بِهِ عَلِيُّ بْنُ سَالِمٍ عَنْ عَلِيِّ بْنِ زَيْدٍ قَالَ الْبُخَارِيُّ لَا يُتَابَعُ فِي حَدِيثِهِ
[Machine] "Omar, may Allah be pleased with him, said: Neither long life nor abundant blessings come to us from Allah except when people flourish through their earnings. But when groups come and monopolize trade, they divert themselves from helping widows and the poor. Whenever profits are made, they sell as they please, with no restrictions. However, whatever goods are brought carrying the burden on their back in summer and winter until they are sold in our market, is a provision for Omar. So, let him sell as he pleases by the will of Allah and let him restrain as he pleases by the will of Allah. Malik mentioned this in Al-Muwatta, narrated from Omar ibn Al-Khattab."
عُمَرُ لَا وَلَا نِعْمَةَ عَيْنٍ يَأْتِينَا اللهُ ﷻ بِالرِّزْقِ حَتَّى إِذَا نَزَلَ بِسُوقِنَا قَامَ أَقْوَامٌ فَاحْتَكَرُوا بِفَضْلِ أَذْهَابِهِمْ عَنِ الْأَرْمَلَةِ وَالْمِسْكِينِ إِذَا خَرَجَ الْجُلَّابُ بَاعُوا عَلَى نَحْوِ مَا يُرِيدُونَ مِنَ التَّحَكُّمِ وَلَكِنْ أَيُّمَا جَالِبٍ جَلَبَ يَحْمِلُهُ عَلَى عَمُودِ كَبِدِهِ فِي الشِّتَاءِ وَالصَّيْفِ حَتَّى يَنْزِلَ سُوقَنَا فَذَلِكَ ضَيْفٌ لِعُمَرَ فَلْيَبِعْ كَيْفَ شَاءَ اللهُ وَلْيُمْسِكْ كَيْفَ شَاءَ اللهُ وَذَكَرَهُ مَالِكٌ فِي الْمُوَطَّأِ مُرْسَلًا عَنْ عُمَرَ بْنِ الْخَطَّابِ ؓ
13.152 [Machine] Whoever lends something, should not give it to someone else or sell it until they retrieve it.
١٣۔١٥٢ بَابُ مَنْ سَلَّفَ فِي شَيْءٍ فَلَا يَصْرِفْهُ إِلَى غَيْرِهِ وَلَا يَبِعْهُ حَتَّى يَقْبِضَهُ
[Machine] The Messenger of Allah ﷺ said, "When you lend something, do not redirect it to someone else." In another narration of the Rawd Al-Barry, he said, "Whoever lends something should not redirect it to someone else." Relying on the narration that prohibits selling food before it is received in full. Surely, the gift of Awwfi should not be used as evidence.
قَالَ رَسُولُ اللهِ ﷺ إِذَا أَسْلَفْتَ فِي شَيْءٍ فَلَا تَصْرِفْهُ إِلَى غَيْرِهِ وَفِي رِوَايَةِ الرُّوذْبَارِيِّ مَنْ أَسْلَفَ فِي شَيْءٍ فَلَا يَصْرِفْهُ إِلَى غَيْرِهِ وَالِاعْتِمَادُ عَلَى حَدِيثِ النَّهْيِ عَنْ بَيْعِ الطَّعَامِ قَبْلَ أَنْ يَسْتَوْفِيَ؛ فَإِنَّ عَطِيَّةَ الْعَوْفِيَّ لَا يُحْتَجُّ بِهِ
[Machine] About the predecessors, I said, "Indeed, we lend, and we say: If you give us a big favor, then it is like this. And if you give us a small favor, then it is like this." He said, "Submit in every categorized leaf, known, if He gives it to you. If not, take the capital of your wealth and do not return it in another commodity."
عَنِ السَّلَفِ قُلْتُ إِنَّا نُسْلِفُ فَنَقُولُ إِنْ أَعْطَيْتَنَا بُرًّا فَبِكَذَا وَإِنْ أَعْطَيْتَنَا تَمْرًا فَبِكَذَا قَالَ أَسْلِمْ فِي كُلِّ صِنْفٍ وَرِقًا مَعْلُومَةً فَإِنْ أَعْطَاكَهُ وَإِلَّا فَخُذْ رَأْسَ مَالِكَ وَلَا تَرُدَّهُ فِي سِلْعَةٍ أُخْرَى
[Machine] Abu Hurayrah, have you allowed the riba in the sale of food before it is received in full? I bear witness that I heard the Messenger of Allah ﷺ saying: "Whoever buys food should not sell it until he has received it." Then Marwan ibn Al-Hakam repeated that sale.
لَهُ أَبُو هُرَيْرَةَ ؓ أَحْلَلْتَ الرِّبَا بَيْعَ الطَّعَامِ قَبْلَ أَنْ يَسْتَوْفِيَ وَأَشْهَدُ لَسَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَنِ ابْتَاعَ طَعَامًا فَلَا يَبِعْهُ حَتَّى يَسْتَوْفِيَهُ فَرَدَّ مَرْوَانُ بْنُ الْحَكَمِ ذَلِكَ الْبَيْعَ
[Machine] He said to Marwan, "Have you permitted the sale of the sikaak, while the Messenger of Allah ﷺ had forbidden the sale of food before it is fully obtained?" Marwan then delivered a sermon and prohibited its sale. Sulayman ibn Yasar said, "I saw the guards taking it from the hands of the people."
أَنَّهُ قَالَ لِمَرْوَانَ أَحْلَلْتَ بَيْعَ الصِّكَاكِ وَقَدْ نَهَى رَسُولُ اللهِ ﷺ عَنْ بَيْعِ الطَّعَامِ قَبْلَ أَنْ يَسْتَوْفِيَ قَالَ فَخَطَبَ مَرْوَانُ وَنَهَى عَنْ بَيْعِهَا قَالَ سُلَيْمَانُ بْنُ يَسَارٍ فَرَأَيْتُ الْحَرَسَ يَأْخُذُونَهَا مِنْ أَيْدِي النَّاسِ
13.153 [Machine] How to weigh something if it has been weighed before?-
١٣۔١٥٣ بَابُ كَيْفِيَّةِ الْكَيْلِ إِذَا كَانَ قَدْ سَلَّفَ فِي شَيْءٍ بِكَيْلٍ
[Machine] Ibn Umar sent your hand and do not touch his head; because only what the measure takes is mine
ابْنُ عُمَرَ أَرْسِلْ يَدَكَ وَلَا تُمْسِكْ عَلَى رَأْسِهِ؛ فَإِنَّمَا لِي مَا أَخَذَ الْمِكْيَالُ
[Machine] He said, "There is no ringing, no noise, and no shaking."
أَنَّهُ قَالَ لَا دَقَّ وَلَا رَزَمَ وَلَا زَلْزَلَةَ
13.154 [Machine] The origin of weight and measurement in the Hijaz, and this is from the issues of usury when selling the same type to each other.
١٣۔١٥٤ بَابُ أَصْلِ الْوَزْنِ وَالْكَيْلِ بِالْحِجَازِ، وَهَذَا مِنْ مَسَائِلِ الرِّبَا إِذَا بِيعَ الْجِنْسُ الْوَاحِدُ بَعْضُهُ بِبَعْضٍ
The Prophet ﷺ said: (The standard) weight is the weight of the people of Mecca, and the (standard) measure is the measure of the people of Medina. Abu Dawud said: Al-Firyabi and Abu Ahmad have also transmitted from Sufyan in a similar way, and he (Ibn Dukain) agreed with them on the text. The version of Abu Ahmad has: "from Ibn 'Abbas" instead of Ibn 'Umar. It has also been transmitted by al-Walid b. Muslim from Hanzalah. This version has: "the weight of Medina and the measure of Mecca." Abu Dawud said: There is a variation in the text of the version of this tradition narrated by Malik b. Dinar from 'Ata' from the Prophet ﷺ. (Using translation from Abū Dāʾūd 3340)
قَالَ رَسُولُ اللهِ ﷺ الْمِكْيَالُ مِكْيَالُ أَهْلِ الْمَدِينَةِ وَالْوَزْنُ وَزْنُ أَهْلِ مَكَّةَ
[Machine] The Prophet ﷺ said: "The Measuring cup is the measuring cup of the people of Makkah, and the Scale is the scale of the people of Madinah." Sulaiman said: "Like this."
قَالَ النَّبِيُّ ﷺ الْمِكْيَالُ مِكْيَالُ أَهْلِ مَكَّةَ وَالْمِيزَانُ مِيزَانُ أَهْلِ الْمَدِينَةِ قَالَ سُلَيْمَانُ هَكَذَا
13.155 [Machine] What is mentioned in seeking blessings from the measure of food
١٣۔١٥٥ بَابُ مَا جَاءَ فِي ابْتِغَاءِ الْبَرَكَةِ مِنْ كَيْلِ الطَّعَامِ
[Machine] The Messenger of Allah ﷺ said, "Measure your food, and it will be blessed for you, and likewise..."
قَالَ رَسُولُ اللهِ ﷺ كِيلُوا طَعَامَكُمْ يُبَارَكْ لَكُمْ وَكَذَلِكَ
[Machine] Narrated by Abu Al-Qasim Abdur-Rahman bin Ubaydullah Al-Hurfi in Baghdad, that the Prophet ﷺ said, "Measure your food, it will be a blessing for you." This was reported to us by Ahmad bin Salman, who was reported to by Ubaid bin Abdul-Wahid Al-Bazzaz, who was reported to by Amr bin Uthman.
عَنِ النَّبِيِّ ﷺ قَالَ كِيلُوا طَعَامَكُمْ يُبَارَكْ لَكُمْ فِيهِ أَخْبَرَنَاهُ أَبُو الْقَاسِمِ عَبْدُ الرَّحْمَنِ بْنُ عُبَيْدِ اللهِ الْحُرْفِيُّ بِبَغْدَادَ ثنا أَحْمَدُ بْنُ سَلْمَانَ ثنا عُبَيْدُ بْنُ عَبْدِ الْوَاحِدِ الْبَزَّازُ ثنا عَمْرُو بْنُ عُثْمَانَ ثنا بَقِيَّةُ فَذَكَرَهُ
13.156 [Machine] Abandoning Containment in the Kiln
١٣۔١٥٦ بَابُ تَرْكِ التَّطْفِيفِ فِي الْكَيْلِ
"When the Prophet ﷺ came to Al-Madinah, they were the worst people in weights and measures. Then Allah, Glorious is He revealed: "Woe to the Mutaffifun (those who give less in measure and weight)",[1] and they were fair in weights and measures after that. (Using translation from Ibn Mājah 2223)
لَمَّا قَدِمَ النَّبِيُّ ﷺ الْمَدِينَةَ كَانُوا مِنْ أَخْبَثِ النَّاسِ كَيْلًا فَأَنْزَلَ اللهُ ﷻ {وَيْلٌ لِلْمُطَفِّفِينَ} [المطففين 1] فَأَحْسَنُوا الْكَيْلَ بَعْدَ ذَلِكَ
[Machine] The Messenger of Allah ﷺ said: "O merchants, you have been entrusted with a matter in which previous nations have perished - the measure and the balance. This was established by Abu Ali Hanash, and others have narrated it from another aspect by Ibn Abbas."
قَالَ رَسُولُ اللهِ ﷺ يَا مَعْشَرَ التُّجَّارِ إِنَّكُمْ قَدْ وُلِّيتُمْ أَمْرًا هَلَكَتْ فِيهِ الْأُمَمُ السَّالِفَةُ الْمِكْيَالَ وَالْمِيزَانَ أَسْنَدَهُ أَبُو عَلِيٍّ حَنَشٌ وَوَقَفَهُ غَيْرُهُ مِنْ وَجْهٍ آخَرَ عَنِ ابْنِ عَبَّاسٍ
[Machine] Ibn Abbas said, "O people of the non-Arabs, indeed Allah has entrusted you with two matters by which previous generations before you were destroyed: the measure and the balance."
ابْنُ عَبَّاسٍ يَا مَعْشَرَ الْأَعَاجِمِ إِنَّ اللهَ قَدْ وَلَّاكُمْ أَمْرَيْنِ أُهْلِكَ بِهِمَا الْقُرُونُ مِنْ قَبْلِكُمُ الْمِكْيَالَ وَالْمِيزَانَ
13.157 [Machine] The giver outweighs, and the scale weighs with reward
١٣۔١٥٧ بَابُ الْمُعْطِي يُرَجِّحُ فِي الْوَزْنِ، وَالْوَزَّانِ يَزِنُ بِالْأَجْرِ
[Machine] The Prophet Muhammad ﷺ bought a camel from me and allowed me to ride on it. I kept those coins with me until the day of the Battle of Harrah, when they mentioned it in the authentic narration from the hadith of Shu'bah.
اشْتَرَى مِنِّي رَسُولُ اللهِ ﷺ بَعِيرًا فَأَرَجَحَ لِي فَلَمْ تَزَلْ تِلْكَ الدَّرَاهِمُ مَعِي حَتَّى أُصِيبَتْ يَوْمَ الْحَرَّةِ أَخْرَجَاهُ فِي الصَّحِيحِ مِنْ حَدِيثِ شُعْبَةَ
[Machine] I and Makhratah Al-Abdi brought a cloth from either Hijr or Bahrain. When we reached Mina, the Messenger of Allah ﷺ came to us and purchased trousers from me. He said, "There is a weight that weighs with rewards." So Messenger of Allah ﷺ handed over the price to him and said, "Weigh and adjust." And so on.
جَلَبْتُ أَنَا وَمَخْرَفَةُ الْعَبْدِيُّ بَزًّا مِنْ هَجَرَ أَوِ الْبَحْرَيْنِ فَلَمَّا كُنَّا بِمِنًى أَتَانَا رَسُولُ اللهِ ﷺ فَاشْتَرَى مِنِّي سَرَاوِيلَ قَالَ وَثَمَّ وَزَّانٌ يَزِنُ بِالْأَجْرِ فَدَفَعَ إِلَيْهِ رَسُولُ اللهِ ﷺ الثَّمَنَ ثُمَّ قَالَ لَهُ زِنْ وَأَرْجِحْ وَكَذَلِكَ
[Machine] I heard Abu Safwan Malik ibn 'Amirah saying: "I bought a pair of pants from the Prophet ﷺ before the migration for three dirhams, and he weighed it and adjusted it for me."
سَمِعْتُ أَبَا صَفْوَانَ مَالِكَ بْنَ عَمِيرَةَ يَقُولُ بِعْتُ مِنَ النَّبِيِّ ﷺ رِجْلَ سَرَاوِيلَ قَبْلَ الْهِجْرَةِ بِثَلَاثَةِ دَرَاهِمَ فَوَزَنَ لِي فَأَرْجَحَ لِي
[Machine] I came to the Messenger of Allah ﷺ in Makkah before he migrated, and I sent him some clothes. He weighed them and they were heavier. Abu Dawood said, and it was also narrated by Qais, as Sufyan said, and the correct view is that of Sufyan. Abu Dawood said, Ahmad ibn Hanbal narrated to us, from Wakii, from Shu'bah, who said: Sufyan was more knowledgeable than me.
أَتَيْتُ رَسُولَ اللهِ ﷺ بِمَكَّةَ قَبْلَ أَنْ يُهَاجِرَ وَبِعْتُهُ سَرَاوِيلَ فَوَزَنَ فَأَرْجَحَ قَالَ أَبُو دَاوُدَ وَرَوَاهُ قَيْسٌ كَمَا قَالَ سُفْيَانُ وَالْقَوْلُ قَوْلُ سُفْيَانَ قَالَ أَبُو دَاوُدَ ثنا أَحْمَدُ بْنُ حَنْبَلٍ ثنا وَكِيعٌ عَنْ شُعْبَةَ قَالَ كَانَ سُفْيَانُ أَحْفَظَ مِنِّي
13.158 [Machine] What is forbidden concerning breaking the dirhams and dinars
١٣۔١٥٨ بَابُ مَا جَاءَ فِي النَّهْيِ عَنْ كَسْرِ الدَّرَاهِمِ وَالدَّنَانِيرِ
[Machine] The Messenger of Allah, ﷺ , forbade the breaking of the Muslims' monetary exchange unless it is necessary to break a dirham, in which case it should be replaced with silver, or to break a dinar, in which case it should be replaced with gold.
أَنَّ رَسُولَ اللهِ ﷺ نَهَى أَنْ تُكْسَرَ سِكَّةُ الْمُسْلِمِينَ الْجَائِزَةُ بَيْنَهُمْ إِلَّا مِنْ بَأْسٍ أَنْ يُكْسَرَ دِرْهَمٌ فَيُجْعَلَ فِضَّةً أَوْ يُكْسَرَ الدِّينَارُ فَيُجْعَلَ ذَهَبًا
13.159 [Machine] What is included in the sale of the property?
١٣۔١٥٩ بَابُ مَا جَاءَ فِي بَيْعِ الْعَقَارِ
[Machine] That the Prophet ﷺ said, "Whoever sells a house without buying another with its price, he will not be blessed in it or in anything from its price."
أَنَّ النَّبِيَّ ﷺ قَالَ مَنْ بَاعَ دَارًا وَلَمْ يَشْتَرِ بِثَمَنِهَا دَارًا لَمْ يُبَارَكْ لَهُ فِيهَا أَوْ فِي شَيْءٍ مِنْ ثَمَنِهَا
[Machine] The Prophet, ﷺ , said: "Whoever sells a house or land and does not use its price to buy something equivalent, he will not be blessed in it."
أَنَّ النَّبِيَّ ﷺ قَالَ مَنْ بَاعَ دَارًا أَوْ عَقَارًا فَلَمْ يَجْعَلْ ثَمَنَهُ فِي مِثْلِهَا لَمْ يُبَارَكْ لَهُ فِيهَا
[Machine] The Messenger of Allah ﷺ said: "Whoever sells a house or property, let him know that he has lost out, as it will not be blessed for him unless he puts it in its equivalent."
قَالَ رَسُولُ اللهِ ﷺ مَنْ بَاعَ دَارًا أَوْ عَقَارًا فَلْيَعْلَمْ أَنَّهُ قَمِنٌ أَنْ لَا يُبَارَكَ لَهُ فِيهِ إِلَّا أَنْ يَجْعَلَهُ فِي مِثْلِهِ
[Machine] In the interpretation of this hadith, whoever sells a house and does not buy a house with its price, he will not be blessed in its price. Sufyan said: Indeed, Allah says, "And blessed it and determined therein its [creatures'] sustenance" [Fussilat 10]. He says, so when he exits from the blessing and does not return it in its likeness, he will not be blessed.
فِي تَفْسِيرِ هَذَا الْحَدِيثِ مَنْ بَاعَ دَارًا وَلَمْ يَشْتَرِ مِنْ ثَمَنِهَا دَارًا لَمْ يُبَارَكْ لَهُ فِي ثَمَنِهَا قَالَ سُفْيَانُ إِنَّ اللهَ يَقُولُ {وَبَارَكَ فِيهَا وَقَدَّرَ فِيهَا أَقْوَاتَهَا} [فصلت 10] يَقُولُ فَلَمَّا خَرَجَ مِنَ الْبَرَكَةِ ثُمَّ لَمْ يُعِدْهَا فِي مِثْلِهَا لَمْ يُبَارَكْ لَهُ
13.160 [Machine] What is mentioned in the sale of houses in Makkah, their rent, and the inheritance laws related to them
١٣۔١٦٠ بَابُ مَا جَاءَ فِي بَيْعِ دُورِ مَكَّةَ وَكِرَائِهَا وَجَرَيَانِ الْإِرْثِ فِيهَا
[Machine] He said, "O Messenger of Allah, do you descend in your house in Mecca?" He replied, "Do we have a cousin from a Dar or a Durr?" He said, "Aqil inherited Abu Talib, him and Talib, and they were not inherited by Ja'far or Ali; because they were Muslims and Aqil and Talib were disbelievers because of that. That is why Umar ibn al-Khattab used to say, 'The believer does not inherit the disbeliever', the words of Abu Amr's hadith."
أَنَّهُ قَالَ يَا رَسُولَ اللهِ تَنْزِلُ فِي دَارِكَ بِمَكَّةَ قَالَ وَهَلْ تَرَكَ لَنَا عَقِيلٌ مِنْ دَارٍ أَوْ دُورٍ؟ قَالَ وَكَانَ عَقِيلٌ وَرِثَ أَبَا طَالِبٍ هُوَ وَطَالِبٌ وَلَمْ يَرِثْهُ جَعْفَرٌ وَلَا عَلِيٌّ؛ لِأَنَّهُمَا كَانَا مُسْلِمَيْنِ وَكَانَ عَقِيلٌ وَطَالِبٌ كَافِرَيْنِ مِنْ أَجْلِ ذَلِكَ كَانَ عُمَرُ بْنُ الْخَطَّابِ ؓ يَقُولُ لَا يَرِثُ الْمُؤْمِنُ الْكَافِرَ لَفْظُ حَدِيثِ أَبِي عَمْرٍو
[Machine] "O Messenger of Allah, the fields of Quraysh have been destroyed, there is no more Quraysh after today." So he said, "Whoever enters the house of Abu Sufyan is safe, and whoever throws down his weapon is safe, and whoever shuts his door is safe."
يَا رَسُولَ اللهِ أُبِيدَتْ خَضْرَاءُ قُرَيْشٍ لَا قُرَيْشَ بَعْدَ الْيَوْمِ فَقَالَ مَنْ دَخَلَ دَارَ أَبِي سُفْيَانَ فَهُوَ آمِنٌ وَمَنْ أَلْقَى سِلَاحَهُ فَهُوَ آمِنٌ وَمَنْ أَغْلَقَ بَابَهُ فَهُوَ آمِنٌ
[Machine] There is nothing wrong with renting, it is similar to buying. Umar ibn al-Khattab purchased a house from Safwan ibn Umayyah for four thousand dirhams.
لَا بَأْسَ بِهِ الْكِرَاءُ مِثْلُ الشِّرَاءِ قَدِ اشْتَرَى عُمَرُ بْنُ الْخَطَّابِ ؓ مِنْ صَفْوَانَ بْنِ أُمَيَّةَ دَارًا بِأَرْبَعَةِ آلَافِ دِرْهَمٍ
[Machine] Ibn Urwah and Abdullah bin Zubair were living in Makkah and carried out activities that no one else among the people of Makkah engaged in. Aisha advised him to stay in her chamber and he bought a dark chamber.
بْنُ عُرْوَةَ وَكَانَ عَبْدُ اللهِ بْنُ الزُّبَيْرِ يَعْتَدُّ بِمَكَّةَ مَا لَا يَعْتَدُّ بِهَا أَحَدٌ مِنَ النَّاسِ أَوْصَتْ لَهُ عَائِشَةُ ؓ بِحُجْرَتِهَا وَاشْتَرَى حُجْرَةَ سَوْدَةَ
[Machine] It means "She is in the way of Allah, blessed and exalted, meaning the Dirhams."
أَنَّهَا فِي سَبِيلِ اللهِ تَبَارَكَ وَتَعَالَى يَعْنِي الدَّرَاهِمَ
[Machine] The Messenger of Allah ﷺ said, "Makkah is a sanctuary, its land cannot be sold and its houses cannot be rented. Isma'il ibn Ibrahim ibn Mu'hajir is weak, and his father is not strong. There is disagreement about him, but it has been narrated from him like this, and it has been narrated from him from his father from Mujahid from Abdullah ibn Amr in a raised (meaning authoritative) manner, with some of its meanings."
قَالَ رَسُولُ اللهِ ﷺ مَكَّةُ مُنَاخٌ لَا يُبَاعُ رِبَاعُهَا وَلَا تُؤَاجَرُ بُيُوتُهَا إِسْمَاعِيلُ بْنُ إِبْرَاهِيمَ بْنِ مُهَاجِرٍ ضَعِيفٌ وَأَبُوهُ غَيْرُ قَوِيٍّ وَاخْتُلِفَ عَلَيْهِ فَرُوِيَ عَنْهُ هَكَذَا وَرُوِيَ عَنْهُ عَنْ أَبِيهِ عَنْ مُجَاهِدٍ عَنْ عَبْدِ اللهِ بْنِ عَمْرٍو مَرْفُوعًا بِبَعْضِ مَعْنَاهُ
[Machine] The Prophet ﷺ said, "Makkah is sacred and the sale of its animals is forbidden. The renting of its houses is also forbidden." This has been narrated as a Marfu' hadith (elevated chain of narration) and its elevation is doubtful. The correct narration is that it is Mawquf (stopped at the level of the Companion). Abu Abdur-Rahman As-Sulami narrated it from Abu-l-Hasan Ad-Daraqutni.
قَالَ النَّبِيُّ ﷺ مَكَّةُ حَرَامٌ وَحَرَامٌ بَيْعُ رِبَاعِهَا وَحَرَامٌ أَجْرُ بُيُوتِهَا كَذَا رُوِيَ مَرْفُوعًا وَرَفْعُهُ وَهْمٌ وَالصَّحِيحُ أَنَّهُ مَوْقُوفٌ قَالَهُ لِي أَبُو عَبْدِ الرَّحْمَنِ السُّلَمِيُّ عَنْ أَبِي الْحَسَنِ الدَّارَقُطْنِيِّ
[Machine] About Ubaidullah bin Abi Ziyad, it is reported in this wording, attributed to Abdullah bin Amr.
عَنْ عُبَيْدِ اللهِ بْنِ أَبِي زِيَادٍ بِهَذَا اللَّفْظِ مَوْقُوفًا عَلَى عَبْدِ اللهِ بْنِ عَمْرٍو
[Machine] The houses of Mecca were called "Al-Sawā'ib". Their rent was not paid during the time of the Prophet Muhammad ﷺ , nor during the time of Abu Bakr or Umar. Whoever needed a place to live was provided a house, and those who were self-sufficient would also be provided a place to live. This was a custom that highlights their generosity in providing homes for those in need, even if they had to give up their own homes. Those who were knowledgeable about the situation in Mecca knew about the inheritance and sale practices that occurred there. And Allah knows best.
كَانَتْ بُيُوتُ مَكَّةَ تُدْعَى السَّوَائِبَ لَمْ تُبَعْ رِبَاعُهَا فِي زَمَنِ رَسُولِ اللهِ ﷺ وَلَا أَبِي بَكْرٍ وَلَا عُمَرَ مَنِ احْتَاجَ سَكَنَ وَمَنِ اسْتَغْنَى أَسْكَنَ هَذَا مُنْقَطِعٌ وَفِيهِ أَخْبَارٌ عَنْ عَادَتِهِمُ الْكَرِيمَةِ فِي إسْكَانِهِمْ مَا اسْتَغْنَوْا عَنْهُ مِنْ بُيُوتِهِمْ وَقَدْ أَخْبَرَ مَنْ كَانَ أَعْلَمَ بِشَأْنِ مَكَّةَ مِنْهُ عَنْ جَرَيَانِ الْإِرْثِ وَالْبَيْعِ فِيهَا وَاللهُ أَعْلَمُ
13.161 [Machine] What came in Al-istiyaam and Al-mumasaahah?
١٣۔١٦١ بَابُ مَا جَاءَ فِي الِاسْتِيَامِ وَالْمُمَاسَحَةِ
[Machine] The Messenger of Allah ﷺ said, "The best of possessions deserves to be respected."
قَالَ رَسُولُ اللهِ ﷺ سَيِّدُ السِّلْعَةِ أَحَقُّ أَنْ يَسْتَامَ
[Machine] The Prophet (PBUH) passed by a Bedouin man who was selling something, and he said to him, "Take the first offer or the first bid, for the profits come with tolerance."
مَرَّ النَّبِيُّ ﷺ عَلَى أَعْرَابِيٍّ يَبِيعُ شَيْئًا فَقَالَ عَلَيْكَ بِأَوَّلِ سَوْمٍ أَوْ أَوَّلِ السَّوْمِ؛ فَإِنَّ الْأَرْبَاحَ مَعَ السَّمَاحِ
