٥٨۔ كِتَابُ السِّيَرِ ص ١٠
[Machine] The Messenger of Allah ﷺ said, "The servant has nothing of the spoils except his share of the provisions and his safety is permissible if he has given the people safety."
قَالَ رَسُولُ اللهِ ﷺ لَيْسَ لِلْعَبْدِ مِنَ الْغَنِيمَةِ شَيْءٌ إِلَّا خُرْثِيَّ الْمَتَاعِ وَأَمَانُهُ جَائِزٌ إِذَا هُوَ أَعْطَى الْقَوْمَ الْأَمَانَ
58.79 [Machine] Safety of women
٥٨۔٧٩ بَابُ أَمَانِ الْمَرْأَةِ
(the freed slave of Um Hani) Um Hani, the daughter of Abi Talib said, "I went to Messenger of Allah ﷺ in the year of the conquest of Mecca and found him taking a bath and his daughter Fatima was screening him. I greeted him. He asked, 'Who is she?' I replied, 'I am Um Hani bint Abi Talib.' He said, 'Welcome! O Um Hani.' When he finished his bath he stood up and prayed eight rakʿat while wearing a single garment wrapped round his body and when he finished I said, 'O Messenger of Allah ﷺ ! My brother has told me that he will kill a person whom I gave shelter and that person is so and so the son of Hubaira.' The Prophet ﷺ said, 'We shelter the person whom you have sheltered.' " Um Hani added, "And that was before noon (Duha). (Using translation from Bukhārī 357)
هَانِئٍ بِنْتَ أَبِي طَالِبٍ ؓ تَقُولُ ذَهَبْتُ إِلَى رَسُولِ اللهِ ﷺ عَامَ الْفَتْحِ فَوَجَدْتُهُ يَغْتَسِلُ وَفَاطِمَةُ ابْنَتُهُ عَلَيْهَا السَّلَامُ تَسْتُرُهُ بِثَوْبٍ قَالَتْ فَسَلَّمْتُ فَقَالَ مَنْ هَذِهِ؟ فَقُلْتُ أُمُّ هَانِئٍ بِنْتُ أَبِي طَالِبٍ فَقَالَ مَرْحَبًا بِأُمِّ هَانِئٍ فَلَمَّا فَرَغَ مِنْ غُسْلِهِ قَامَ فَصَلَّى ثَمَانِيَ رَكَعَاتٍ مُلْتَحِفًا فِي ثَوْبٍ وَاحِدٍ فَلَمَّا انْصَرَفَ قُلْتُ يَا رَسُولَ اللهِ زَعَمَ ابْنُ أُمِّي عَلِيُّ بْنُ أَبِي طَالِبٍ أَنَّهُ قَاتِلٌ رَجُلًا أَجَرْتُهُ فُلَانَ بْنَ هُبَيْرَةَ قَالَ رَسُولُ اللهِ ﷺ قَدْ أَجَرْنَا مَنْ أَجَرْتِ يَا أُمَّ هَانِئٍ قَالَتْ أُمُّ هَانِئٍ وَذَلِكَ ضُحًى لَفْظُ حَدِيثِ يَحْيَى بْنِ يَحْيَى وَفِي حَدِيثِ الْقَعْنَبِيِّ ثُمَّ انْصَرَفَ فَقُلْتُ وَالْبَاقِي سَوَاءٌ
[Machine] They closed the door behind him and went to the Messenger of Allah ﷺ and informed him. He said, "That was not his doing, for we have granted safety to those you have granted safety and rewarded those you have rewarded."
أَغْلِقُوا دُونَهُ الْبَابَ وَذَهَبَتْ إِلَى رَسُولِ اللهِ ﷺ فَأَخْبَرَتْهُ فَقَالَ مَا كَانَ ذَلِكَ لَهُ وَقَدْ أَمَّنَّا مَنْ أَمَّنْتِ وَأَجَرْنَا مَنْ أَجَرْتِ
[Machine] "Abdullah, Abu Bakr, Abu Muhammad, and Abu Sadiq said: Abu al-Abbas narrated to us that Muhammad ibn Abdullah ibn Abd al-Hakam informed us that Ibn Wahb told me that Ayyad ibn Abdullah narrated to me from Makhrama ibn Sulaiman from Kurayb, the freed slave of Ibn Abbas, from Abdullah ibn Abbas that Umm Hanee bint Abi Talib spoke to him saying: 'The son of my mother, Ali, claims that he has killed someone I have hired.' So the Messenger of Allah ﷺ said: 'We have hired those who you have hired.'"
عَبْدِ اللهِ وَأَبُو بَكْرٍ وَأَبُو مُحَمَّدٍ وَأَبُو صَادِقٍ قَالُوا ثنا أَبُو الْعَبَّاسِ أنبأ مُحَمَّدُ بْنُ عَبْدِ اللهِ بْنِ عَبْدِ الْحَكَمِ أنبأ ابْنُ وَهْبٍ أَخْبَرَنِي عِيَاضُ بْنُ عَبْدِ اللهِ عَنْ مَخْرَمَةَ بْنِ سُلَيْمَانَ عَنْ كُرَيْبٍ مَوْلَى ابْنِ عَبَّاسٍ عَنْ عَبْدِ اللهِ بْنِ عَبَّاسٍ ؓ أَنَّ أُمَّ هَانِئٍ بِنْتَ أَبِي طَالِبٍ حَدَّثَتْهُ أَنَّهَا قَالَتْ لِرَسُولِ اللهِ ﷺ زَعَمَ ابْنُ أُمِّي عَلِيٌّ أَنَّهُ قَاتِلٌ مَنْ أَجَرْتُ فَقَالَ رَسُولُ اللهِ ﷺ قَدْ أَجَرْنَا مَنْ أَجَرْتِ
[Machine] If the woman is mistreating the Muslims, it is permissible for them to respond to her.
إِنْ كَانَتِ الْمَرْأَةُ لَتَأْخُذُ عَلَى الْمُسْلِمِينَ فَيُجَوِّزُونَ ذَلِكَ لَهَا
[Machine] About Umm Salamah, the wife of the Prophet ﷺ , she narrated that Zainab, the daughter of the Messenger of Allah ﷺ , sent her husband, Abu Al-As ibn Al-Rabi', to ask her father for a guaranteed safe conduct. Umm Salamah went out to talk, peeking her head from the door of her room while the Prophet ﷺ was praying the morning prayer with the people. She said, "O people, I am Zainab, the daughter of the Messenger of Allah ﷺ , and I have granted Abu Al-As safe conduct." When the Prophet ﷺ finished the prayer, he said, "O people, I did not know about this until you informed me. And indeed, he has granted safe conduct to the Muslims among them, even the lowest of them."
عَنْ أُمِّ سَلَمَةَ زَوْجِ النَّبِيِّ ﷺ أَنَّ زَيْنَبَ بِنْتَ رَسُولِ اللهِ ﷺ أَرْسَلَ إِلَيْهَا زَوْجُهَا أَبُو الْعَاصِ بْنُ الرَّبِيعِ أَنْ خُذِي لِي أَمَانًا مِنْ أَبِيكِ فَخَرَجَتْ فَأَطْلَعَتْ رَأْسَهَا مِنْ بَابِ حُجْرَتِهَا وَالنَّبِيُّ ﷺ فِي صَلَاةِ الصُّبْحِ يُصَلِّي بِالنَّاسِ فَقَالَتْ أَيُّهَا النَّاسُ أَنَا زَيْنَبُ بِنْتُ رَسُولِ اللهِ ﷺ وَإِنِّي قَدْ أَجَرْتُ أَبَا الْعَاصِ فَلَمَّا فَرَغَ النَّبِيُّ ﷺ مِنَ الصَّلَاةِ قَالَ أَيُّهَا النَّاسُ إِنِّي لَمْ أَعْلَمْ بِهَذَا حَتَّى سَمِعْتُمُوهُ أَلَا وَإِنَّهُ يُجِيرُ عَلَى الْمُسْلِمِينَ أَدْنَاهُمْ
[Machine] When Abu Al-As ibn Ar-Rabi' entered upon Zaynab bint Rasul Allah ﷺ seeking her protection, the Messenger of Allah ﷺ went out until morning. When he raised his voice in prayer, Zaynab shouted, "O people, I have given protection to Abu Al-As ibn Ar-Rabi'!" When the Messenger of Allah ﷺ finished his prayer, he said, "O people, have you heard what I heard?" They replied, "Yes." He said, "By the One in whose hand is the soul of Muhammad, I did not know anything about what occurred until I heard from him what you have heard. Indeed, he gives protection to the Muslims, starting with the closest to him." Then the Messenger of Allah ﷺ entered upon Zaynab and said, "O my dear daughter, honor his dwelling place and do not let him approach you, for you are not lawful for him and he is not lawful for you." This was reported to us in the Book of Maghazi (Battles) as a disconnected narration, and it was mentioned to us in the Book of Al-Mustadrak from Yazid ibn Ruman from Uruwah from Aisha, who said, Zaynab shouted and mentioned him.
لَمَّا دَخَلَ أَبُو الْعَاصِ بْنُ الرَّبِيعِ عَلَى زَيْنَبَ بِنْتِ رَسُولِ اللهِ ﷺ وَاسْتَجَارَ بِهَا خَرَجَ رَسُولُ اللهِ ﷺ إِلَى الصُّبْحِ فَلَمَّا كَبَّرَ فِي الصَّلَاةِ صَرَخَتْ زَيْنَبُ أَيُّهَا النَّاسُ إِنِّي قَدْ أَجَرْتُ أَبَا الْعَاصِ بْنَ الرَّبِيعِ فَلَمَّا سَلَّمَ رَسُولَ اللهِ ﷺ مِنْ صَلَاتِهِ قَالَ أَيُّهَا النَّاسُ هَلْ سَمِعْتُمْ مَا سَمِعْتُ؟ قَالُوا نَعَمْ قَالَ أَمَا وَالَّذِي نَفْسُ مُحَمَّدٍ بِيَدِهِ مَا عَلِمْتُ بِشَيْءٍ مِمَّا كَانَ حَتَّى سَمِعْتُ مِنْهُ مَا سَمِعْتُمْ إِنَّهُ يُجِيرُ عَلَى الْمُسْلِمِينَ أَدْنَاهُمْ ثُمَّ دَخَلَ رَسُولُ اللهِ ﷺ عَلَى زَيْنَبَ فَقَالَ أَيْ بُنَيَّةُ أَكْرِمِي مَثْوَاهُ وَلَا يَقْرَبَنَّكِ فَإِنَّكِ لَا تَحِلِّينَ لَهُ وَلَا يَحِلُّ لَكِ هَكَذَا أُخْبِرْنَا فِي كِتَابِ الْمَغَازِي مُنْقَطِعًا وَحُدِّثْنَا بِهِ فِي كِتَابِ الْمُسْتَدْرَكِ عَنْ يَزِيدَ بْنِ رُومَانَ عَنْ عُرْوَةَ عَنْ عَائِشَةَ قَالَتْ صَرَخَتْ زَيْنَبُ فَذَكَرَهُ
[Machine] For the Prophet ﷺ , Abu Al-As ibn Ar-Rabi' is either a close relative, then he is a cousin, or a distant relative, then he is a relative by marriage. Indeed, I have paid him a debt, so the Prophet ﷺ grants him permission. It is also said that Zainab said to the Prophet ﷺ while he was being sent...
لِلنَّبِيِّ ﷺ إِنَّ أَبَا الْعَاصِ بْنَ الرَّبِيعِ إِنْ قَرُبَ فَابْنُ عَمٍّ وَإِنْ بَعُدَ فَأَبُو وَلَدٍ وَإِنِّي قَدْ أَجَرْتُهُ فَأَجَازَهُ النَّبِيُّ ﷺ وَقِيلَ عَنْ عَبْدِ اللهِ أَنَّ زَيْنَبَ ؓ قَالَتْ لِلنَّبِيِّ ﷺ وَهُوَ مُرْسَلٌ
58.80 [Machine] How is the security?
٥٨۔٨٠ بَابُ كَيْفَ الْأَمَانُ
[Machine] A letter from Umar came to us, and when you besiege a fortress and they want you to judge by the judgment of Allah, do not judge them because you do not know the judgment of Allah in them, but judge them according to your judgment, and then decide what you wish. And when a man says to another man, "Do not fear, he has given him security." And when he says, "I am protected," he has given him security. And when he says to him, "I think he will not surrender," he has given him security, for Allah knows the tongues. The Thawri narrated it from Al-A'mash, and he said at the end, "And if he says, 'Do not be alarmed,' he has given him security, for Allah knows the tongues." Abu Nasr bin Qatada informed us, Abu Amr bin Matar reported to us, Abu Khalifa reported to us, Muhammad bin Kathir reported to us, Sufyan reported from Al-A'mash, from Abu Wail, who said, "A letter from Umar came to us while we were besieged in a fortress, and he mentioned it in its meaning."
جَاءَنَا كِتَابُ عُمَرَ ؓ وَإِذَا حَاصَرْتُمْ قَصْرًا فَأَرَادُوكُمْ أَنْ يَنْزِلُوا عَلَى حُكْمِ اللهِ فَلَا تُنْزِلُوهُمْ فَإِنَّكُمْ لَا تَدْرُونَ مَا حُكْمُ اللهِ فِيهِمْ وَلَكِنْ أَنْزِلُوهُمْ عَلَى حُكْمِكُمْ ثُمَّ اقْضُوا فِيهِمْ مَا أَحْبَبْتُمْ وَإِذَا قَالَ الرَّجُلُ لِلرَّجُلِ لَا تَخَفْ فَقَدْ أَمَّنَهُ وَإِذَا قَالَ مِتْرَسٌ فَقَدْ أَمَّنَهُ وَإِذَا قَالَ لَهُ أَظُنُّهُ لَا تَدْهَلْ فَقَدْ أَمَّنَهُ فَإِنَّ اللهَ يَعْلَمُ الْأَلْسِنَةَ وَرَوَاهُ الثَّوْرِيُّ عَنِ الْأَعْمَشِ فَقَالَ فِي آخِرِهِ وَإِنْ قَالَ لَا تَذْهَلْ فَقَدْ أَمَّنَهُ فَإِنَّ اللهَ يَعْلَمُ الْأَلْسِنَةَ 18181 أَخْبَرَنَاهُ أَبُو نَصْرِ بْنُ قَتَادَةَ أنبأ أَبُو عَمْرِو بْنُ مَطَرٍ ثنا أَبُو خَلِيفَةَ ثنا مُحَمَّدُ بْنُ كَثِيرٍ ثنا سُفْيَانُ عَنِ الْأَعْمَشِ عَنْ أَبِي وَائِلٍ قَالَ جَاءَ كِتَابُ عُمَرَ ؓ وَنَحْنُ مُحَاصِرُونَ قَصْرًا فَذَكَرَهُ بِمَعْنَاهُ
[Machine] Umar sent people from the outskirts of the cities to fight against the polytheists. While Umar was doing so, a man from the Ahwaz region, who was captured, was brought to him. Some people said to Hurmuzan, "Would you like to not be killed?" He said, "Yes, and who is he?" They said, "When they bring you close to the Amir al-Muminin (Commander of the Faithful), he will speak to you. Say that you prefer to speak to him. If he tells you not to leave, say 'I will not leave.' If he intends to kill you, say 'I am in protection.' You said 'do not leave.'" The man remembered and when he was brought to Umar, Umar asked him about some things he was investigating. The man said, "I prefer to speak." Umar said, "Do not leave!" The man said, "When you finished speaking, you asked me what Allah wanted. Then you told me 'I am your opponent.' Umar said, "So you have protected me!" The man said, "Woe to you! I did not protect you." Umar said, "You said 'do not leave.' He said, "You are right, either become Muslim or be killed." Umar said, "Yes, I will become Muslim." Then he mentioned the rest of the conversation at length.
بَعَثَ عُمَرُ ؓ النَّاسَ مِنْ أَفْنَاءِ الْأَمْصَارِ يُقَاتِلُونَ الْمُشْرِكِينَ قَالَ فَبَيْنَمَا عُمَرُ ؓ كَذَلِكَ إِذْ أُتِيَ بِرَجُلٍ مِنَ الْمُشْرِكِينَ مِنْ أَهْلِ الْأَهْوَازِ قَدْ أُسِرَ فَلَمَّا أُتِيَ بِهِ قَالَ بَعْضُ النَّاسِ لِلْهُرْمُزَانِ أَيَسُرُّكَ أَنْ لَا تُقْتَلَ؟ قَالَ نَعَمْ وَمَا هُوَ؟ قَالَ إِذَا قَرَّبُوكَ مِنْ أَمِيرِ الْمُؤْمِنِينَ فَكَلَّمَكَ فَقُلْ إِنِّي أَفْرَقُ أَنْ أُكَلِّمَكَ فَيَقُولُ لَا تَفْرَقْ فَإِنْ أَرَادَ قَتْلَكَ فَقُلْ إِنِّي فِي أَمَانٍ إِنَّكَ قُلْتَ لَا تَفْرَقْ قَالَ فَحَفِظَهَا الرَّجُلُ فَلَمَّا أُتِيَ بِهِ عُمَرُ ؓ قَالَ لَهُ فِي بَعْضِ مَا يُسَائِلُهُ عَنْهُ إِنِّي أَفْرَقُ يَعْنِي فَقَالَ لَا تَفْرَقْ قَالَ فَلَمَّا فَرَغَ مِنْ كَلَامِهِ سَاءَلَهُ عَمَّا شَاءَ اللهُ ثُمَّ قَالَ لَهُ إِنِّي قَاتِلُكَ قَالَ فَقَالَ فَقَدْ أَمَّنْتَنِي فَقَالَ وَيْحَكَ مَا أَمَّنْتُكَ قَالَ قُلْتَ لَا تَفْرَقْ قَالَ صَدَقَ إِمَّا لَا فَأَسْلِمْ قَالَ نَعَمْ فَأَسْلَمَ ثُمَّ ذَكَرَ الْحَدِيثَ بِطُولِهِ
[Machine] We besieged Tustar until the people of Hurmuzan surrendered. And they brought him to Umar for judgment. I presented him to Umar. When we finished talking to him, Umar asked him, "Speak, is it the words of a living person or the words of a dead person?" He replied, "Speak, there is no harm." Umar said, "Indeed, we, the Arab tribes, used to worship you, kill you, and confiscate your properties. But when Allah was with you, we had no power over you." Umar asked, "What do you say?" So I said, "O commander of the faithful, I have left behind many enemies and a severe thorn. If you kill him, the people will lose hope in life, and it will be even more difficult for them. " Umar said, "Do you not feel ashamed of killing Bara ibn Malik and Majza ibn Thawr?" So when I feared that he would kill him, I said, "There is no way to kill him, as you have said to him, 'Speak, there is no harm.' " Umar said, "You have taken a bribe and benefited from it." I said, "By Allah, I did not take a bribe, nor did I benefit from it." He said, "You will come to me with someone else's testimony, or I will start the punishment on you." I left and met Zubayr bin Al-Awam, and he testified with me, and Umar released him, meaning Hurmuzan, and imposed a tax on him.
حَاصَرْنَا تُسْتَرَ فَنَزَلَ الْهُرْمُزَانُ عَلَى حُكْمِ عُمَرَ ؓ فَقَدِمْتُ بِهِ عَلَى عُمَرَ ؓ فَلَمَّا انْتَهَيْنَا إِلَيْهِ قَالَ لَهُ عُمَرُ ؓ تَكَلَّمْ قَالَ كَلَامُ حَيٍّ أَوْ كَلَامُ مَيِّتٍ؟ قَالَ تَكَلَّمْ لَا بَأْسَ قَالَ إِنَّا وَإِيَّاكُمْ مَعَاشِرَ الْعَرَبِ مَا خَلَّى اللهُ بَيْنَنَا وَبَيْنَكُمْ كُنَّا نَتَعَبَّدُكُمْ وَنَقْتُلُكُمْ وَنَغْصِبُكُمْ فَلَمَّا كَانَ اللهُ مَعَكُمْ لَمْ يَكُنْ لَنَا يَدَانِ فَقَالَ عُمَرُ ؓ مَا تَقُولُ؟ فَقُلْتُ يَا أَمِيرَ الْمُؤْمِنِينَ تَرَكْتُ بَعْدِي عَدُوًّا كَثِيرًا وَشَوْكَةً شَدِيدَةً فَإِنْ قَتَلْتَهُ يَأْيَسِ الْقَوْمُ مِنَ الْحَيَاةِ وَيَكُونُ أَشَدَّ لِشَوْكَتِهِمْ فَقَالَ عُمَرُ ؓ أَسْتَحْيِي قَاتِلَ الْبَرَاءِ بْنِ مَالِكٍ وَمَجْزَأَةَ بْنِ ثَوْرٍ؟ فَلَمَّا خَشِيتُ أَنْ يَقْتُلَهُ قُلْتُ لَيْسَ إِلَى قَتْلِهِ سَبِيلٌ قَدْ قُلْتَ لَهُ تَكَلَّمْ لَا بَأْسَ فَقَالَ عُمَرُ ؓ ارْتَشَيْتَ وَأَصَبْتَ مِنْهُ فَقَالَ وَاللهِ مَا ارْتَشَيْتُ وَلَا أَصَبْتُ مِنْهُ قَالَ لَتَأْتِيَنِّي عَلَى مَا شَهِدْتَ بِهِ بِغَيْرِكَ أَوْ لَأَبْدَأَنَّ بِعُقُوبَتِكَ قَالَ فَخَرَجْتُ فَلَقِيتُ الزُّبَيْرَ بْنَ الْعَوَّامِ ؓ فَشَهِدَ مَعِي وَأَمْسَكَ عُمَرُ ؓ وَأَسْلَمَ يَعْنِي الْهُرْمُزَانَ وَفَرَضَ لَهُ
58.81 [Machine] The descent of the people of the fortress or some of them upon the command of the Imam or someone other than the Imam when the one descended upon his rule is safe.
٥٨۔٨١ بَابُ نُزُولِ أَهْلِ الْحِصْنِ أَوْ بَعْضهِمْ عَلَى حُكْمِ الْإِمَامِ أَوْ غَيْرِ الْإِمَامِ إِذَا كَانَ الْمَنْزُولُ عَلَى حُكْمِهِ مَأْمُونًا
[Machine] That the people of Quraysh descended upon Saad's ruling, so the Messenger of Allah ﷺ sent to him. Saad came and said, "Rise to your leader or your best." So he sat with the Messenger of Allah ﷺ and he said, "Indeed, these people have descended upon your ruling." He said, "Indeed, my ruling is that their fighters be killed."
أَنَّ أَهْلَ قُرَيْظَةَ نَزَلُوا عَلَى حُكْمِ سَعْدٍ فَأَرْسَلَ إِلَيْهِ رَسُولُ اللهِ ﷺ فَجَاءَ فَقَالَ قُومُوا إِلَى سَيِّدِكُمْ أَوْ خَيْرِكُمْ فَقَعَدَ عِنْدَ رَسُولِ اللهِ ﷺ فَقَالَ إِنَّ هَؤُلَاءِ قَدْ نَزَلُوا عَلَى حُكْمِكَ قَالَ فَإِنِّي أَحْكُمُ أَنْ تُقْتَلَ مُقَاتِلَتُهُمْ
[Machine] There was a man named Lahab ibn al-Arqam who threw a stone at the Prophet Muhammad ﷺ and struck him. The Prophet ﷺ ordered a tent to be set up in the mosque so that he could retaliate when he returned. When the Prophet ﷺ returned from the Khandaq (Trench) and put down his weapons and washed himself, Gabriel ﷺ came to him while shaking the dust off his head and said, "Have you put down your weapons? By Allah, we have not put them down yet. Go to them." The Prophet ﷺ asked, "Where?" Gabriel pointed towards the tribe of Qurayzah. So the Prophet ﷺ went to them, and they accepted his judgement. He handed down the judgement that those who fought should be killed, their women and children taken as captives, and their wealth divided. My father told me that the Prophet ﷺ said, "You have indeed passed judgement on them with the judgement of Allah."
لَهُ حَبَّانُ بْنُ الْعَرِقَةِ رَمَاهُ فِي الْأَكْحَلِ فَضَرَبَ عَلَيْهِ رَسُولُ اللهِ ﷺ خَيْمَةً فِي الْمَسْجِدِ لِيَعُودَهُ مِنْ قَرِيبٍ فَلَمَّا رَجَعَ رَسُولُ اللهِ ﷺ مِنَ الْخَنْدَقِ وَوَضَعَ السِّلَاحَ وَاغْتَسَلَ أَتَاهُ جِبْرِيلُ عَلَيْهِ السَّلَامُ وَهُوَ يَنْفُضُ رَأْسَهُ مِنَ الْغُبَارِ فَقَالَ قَدْ وَضَعْتَ السِّلَاحَ؟ وَاللهِ مَا وَضَعْنَاهَا اخْرُجْ إِلَيْهِمْ قَالَ رَسُولُ اللهِ ﷺ فَأَيْنَ؟ قَالَ هَهُنَا وَأَشَارَ إِلَى بَنِي قُرَيْظَةَ فَخَرَجَ رَسُولُ اللهِ ﷺ إِلَيْهِمْ فَنَزَلُوا عَلَى حُكْمِ رَسُولِ اللهِ ﷺ فَرَدَّ الْحُكْمَ فِيهِمْ إِلَى سَعْدٍ قَالَ فَإِنِّي أَحْكُمُ فِيهِمْ أَنْ تُقْتَلَ الْمُقَاتِلَةُ وَتُسْبَى الذُّرِّيَّةُ وَتُقْسَمَ أَمْوَالُهُمْ قَالَ أَبِي فَأُخْبِرْتُ أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَقَدْ حَكَمْتَ فِيهِمْ بِحُكْمِ اللهِ
[Machine] The Messenger of Allah ﷺ used to admonish the commander of an army to fear Allah in his personal life and in relation to the Muslims under his command. He mentioned in a hadith, "And when you besiege a fort, and they want you to judge by the judgment of Allah, do not judge by it, for you do not know if the judgment of Allah may befall or not. Waki' reported from Sufyan that they should instead be judged by your own judgment, and then you can decide what you wish." Abu Ali al-Rudhbari informed us that Abu Bakr ibn Dasa narrated to him, who narrated from Abu Dawud, who narrated from Muhammad ibn Sulaiman al-Anbari, who narrated from Waki' from Sufyan, who mentioned this.
كَانَ رَسُولُ اللهِ ﷺ إِذَا بَعَثَ أَمِيرًا عَلَى جَيْشٍ أَوْصَاهُ بِتَقْوَى اللهِ فِي خَاصَّةِ نَفْسِهِ وَبِمَنْ مَعَهُ مِنَ الْمُسْلِمِينَ خَيْرًا وَذَكَرَ الْحَدِيثَ قَالَ وَإِذَا حَاصَرْتَ أَهْلَ حِصْنٍ فَأَرَادُوكَ أَنْ تُنْزِلَهُمْ عَلَى حُكْمِ اللهِ فَلَا تُنْزِلْهُمْ فَإِنَّكَ لَا تَدْرِي أَتُصِيبُ حُكْمَ اللهِ أَمْ لَا زَادَ فِيهِ وَكِيعٌ عَنْ سُفْيَانَ وَلَكِنْ أَنْزِلُوهُمْ عَلَى حُكْمِكُمْ ثُمَّ اقْضُوا فِيهِمْ بَعْدُ مَا شِئْتُمْ 18187 أَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنبأ أَبُو بَكْرِ بْنُ دَاسَةَ ثنا أَبُو دَاوُدَ ثنا مُحَمَّدُ بْنُ سُلَيْمَانَ الْأَنْبَارِيُّ ثنا وَكِيعٌ عَنْ سُفْيَانَ فَذَكَرَهُ
58.82 [Machine] The unbelieving combatant kills a Muslim and then surrenders without being harmed
٥٨۔٨٢ بَابُ الْكَافِرِ الْحَرْبِيِّ يَقْتُلُ مُسْلِمًا ثُمَّ يُسْلِمُ لَمْ يَكُنْ عَلَيْهِ قَوَدٌ

عَنْ شَيْءٍ إِلَّا أَخْبَرَكُمَا وَإِنْ أَدْرَكْتُمَاهُ شَارِبًا فَلَا تَسْأَلَاهُ فَانْطَلَقْنَا حَتَّى انْتَهَيْنَا إِلَيْهِ قَدْ أُلْقِيَ لَهُ شَيْءٌ عَلَى بَابِهِ وَهُوَ جَالِسٌ صَاحٍ فَقَالَ ابْنُ الْخِيَارِ؟ قُلْتُ نَعَمْ قَالَ مَا رَأَيْتُكَ مُنْذُ حَمَلَتْكَ إِلِيَّ أُمُّكَ بِذِي طُوًى إِذْ وَضَعَتْكَ فَرَأَيْتُ قَدَمَيْكَ فَعَرَفْتُهُمَا قَالَ قُلْتُ جِئْنَاكَ نَسْأَلُكَ عَنْ قَتْلِ حَمْزَةَ قَالَ سَأُحَدِّثُكُمَا كَمَا حَدَّثْتُ رَسُولَ اللهِ ﷺ إِذْ سَأَلَنِي كُنْتُ عَبْدًا لِآلِ مُطْعِمٍ فَقَالَ لِي ابْنُ أَخِي مُطْعِمٍ إِنْ أَنْتَ قَتَلْتَ حَمْزَةَ بِعَمِّي فَأَنْتَ حُرٌّ فَانْطَلَقْتُ يَوْمَ أُحُدٍ مَعِي حَرْبَتِي وَأَنَا رَجُلٌ مِنَ الْحَبَشَةِ أَلْعَبُ بِهَا لَعِبَهُمْ فَخَرَجْتُ يَوْمَئِذٍ مَا أُرِيدُ أَنْ أَقْتُلَ أَحَدًا وَلَا أُقَاتِلَهُ إِلَّا حَمْزَةَ فَخَرَجْتُ فَإِذَا أَنَا بِحَمْزَةَ كَأَنَّهُ بَعِيرٌ أَوْرَقُ مَا يَرْفَعُ لَهُ أَحَدٌ إِلَّا قَمَعَهُ بِالسَّيْفِ فَهِبْتُهُ وَبَادَرَنِي إِلَيْهِ رَجُلٌ مِنْ بَنِي وَلَدِ سِبَاعٍ فَسَمِعْتُ حَمْزَةَ يَقُولُ إِلِيَّ يَا ابْنَ مُقَطِّعَةِ الْبُظُورِ فَشَدَّ عَلَيْهِ فَقَتَلَهُ وَجَعَلْتُ أَلُوذُ مِنْهُ فَلُذْتُ مِنْهُ بِشَجَرَةٍ وَمَعِي حَرْبَتِي حَتَّى إِذَا اسْتَمْكَنْتُ مِنْهُ هَزَزْتُ الْحَرْبَةَ حَتَّى رَضِيتُ مِنْهَا ثُمَّ أَرْسَلْتُهَا فَوَقَعَتْ بَيْنَ ثَنْدُوَتَيْهِ وَنَهَزَ لِيَقُومَ فَلَمْ يَسْتَطِعْ فَقَتَلْتُهُ ثُمَّ أَخَذْتُ حَرْبَتِي مَا قَتَلْتُ أَحَدًا وَلَا قَاتَلْتُهُ فَلَمَّا جِئْتُ عَتَقْتُ فَلَمَّا قَدِمَ رَسُولُ اللهِ ﷺ أَرَدْتُ الْهَرَبَ مِنْهُ أُرِيدُ الشَّامَ فَأَتَانِي رَجُلٌ فَقَالَ وَيْحَكَ يَا وَحْشِيُّ وَاللهِ مَا يَأْتِي مُحَمَّدًا أَحَدٌ يَشْهَدُ بِشَهَادَتِهِ إِلَّا خَلَّى عَنْهُ فَانْطَلَقْتُ فَمَا شَعَرَ بِي إِلَّا وَأَنَا وَاقِفٌ عَلَى رَأْسِهِ أَشْهَدُ بِشَهَادَةِ الْحَقِّ فَقَالَ أَوَحْشِيٌّ؟ قُلْتُ وَحْشِيٌّ قَالَ وَيْحَكَ حَدِّثْنِي عَنْ قَتْلِ حَمْزَةَ فَأَنْشَأْتُ أُحَدِّثُهُ كَمَا حَدَّثْتُكُمَا فَقَالَ وَيْحَكَ يَا وَحْشِيُّ غَيِّبْ عَنِّي وَجْهَكَ فَلَا أَرَاكَ فَكُنْتُ أَتَّقِي أَنْ يَرَانِي رَسُولُ اللهِ ﷺ فَقَبَضَ اللهُ نَبِيَّهُ ﷺ فَلَمَّا كَانَ مِنْ أَمْرِ مُسَيْلِمَةَ مَا كَانَ ثُمَّ انْبَعَثَ إِلَيْهِ الْبَعْثُ انْبَعَثْتُ مَعَهُ وَأَخَذْتُ حَرْبَتِي فَالْتَقَيْنَا فَبَادَرْتُهُ أَنَا وَرَجُلٌ مِنَ الْأَنْصَارِ فَرَبُّكَ أَعْلَمُ أَيُّنَا قَتَلَهُ فَإِنْ كُنْتُ أَنَا قَتَلْتُهُ فَقَدْ قَتَلْتُ خَيْرَ النَّاسِ وَشَرَّ النَّاسِ قَالَ سُلَيْمَانُ بْنُ يَسَارٍ سَمِعْتُ ابْنَ عُمَرَ يَقُولُ كُنْتُ فِي الْجَيْشِ يَوْمَئِذٍ فَسَمِعْتُ قَائِلًا يَقُولُ فِي مُسَيْلِمَةَ قَتَلَهُ الْعَبْدُ الْأَسْوَدُ لَفْظُ حَدِيثِ أَبِي دَاوُدَ وَحَدِيثِ حُجَيْنٍ بِمَعْنَاهُ يَزِيدُ وَيَنْقُصُ لَمْ يَذْكُرْ حَدِيثَ الشُّرْبِ وَلَا قَوْلَهُ إِنْ كُنْتُ قَتَلْتُهُ وَقَدْ
Some pagans who committed murders in great number and committed illegal sexual intercourse excessively, came to Muhammad and said, "O Muhammad! Whatever you say and invite people to, is good: but we wish if you could inform us whether we can make an expiration for our (past evil) deeds." So the Divine Verses came: 'Those who invoke not with Allah any other god, not kill such life as Allah has forbidden except for just cause, nor commit illegal sexual intercourse.' (25.68) And there was also revealed:-- 'Say: O My slaves who have transgressed against their souls! Despair not of the Mercy of Allah.' (39.53) (Using translation from Bukhārī 4810)
نَاسًا مِنْ أَهْلِ الشِّرْكِ قَتَلُوا فَأَكْثَرُوا وَزَنَوْا فَأَكْثَرُوا ثُمَّ أَتَوْا مُحَمَّدًا ﷺ فَقَالُوا إِنَّ الَّذِي تَقُولُ وَتَدْعُو إِلَيْهِ لَحَسَنٌ وَلَوْ تُخْبِرُنَا أَنَّ لِمَا عَمِلْنَا كَفَّارَةً فَنَزَلَتْ {وَالَّذِينَ لَا يَدْعُونَ مَعَ اللهِ إِلَهًا آخَرَ وَلَا يَقْتُلُونَ النَّفْسَ الَّتِي حَرَّمَ اللهُ إِلَّا بِالْحَقِّ وَلَا يَزْنُونَ} [الفرقان 68] وَنَزَلَتْ {يَا عِبَادِيَ الَّذِينَ أَسْرَفُوا عَلَى أَنْفُسِهِمْ لَا تَقْنَطُوا مِنْ رَحْمَةِ اللهِ} [الزمر 53] الْآيَةَ
[Machine] So I came to the Messenger of Allah ﷺ to pledge allegiance to him on Islam, and I said, "Extend your right hand so that I may pledge allegiance to you, O Messenger of Allah." So he extended his hand and I held my hand, and he said, "What is the matter, O 'Amr?" I said, "I wanted to make a condition." He said, "What condition?" I said, "I wanted to make a condition that my sins be forgiven." He said, "Do you not know, O 'Amr, that Islam wipes away what came before it?" And he mentioned the Hadith.
فَأَتَيْتُ رَسُولَ اللهِ ﷺ لِأُبَايِعَهُ عَلَى الْإِسْلَامِ فَقُلْتُ ابْسُطْ يَمِينَكَ أُبَايِعْكَ يَا رَسُولَ اللهِ فَبَسَطَ يَدَهُ فَقَبَضْتُ يَدِي فَقَالَ مَا لَكَ يَا عَمْرُو؟ قُلْتُ أَرَدْتُ أَنْ أَشْتَرِطَ قَالَ تَشْتَرِطُ مَاذَا؟ قُلْتُ أَشْتَرِطُ أَنْ يُغْفَرَ لِي قَالَ أَمَا عَلِمْتَ يَا عَمْرُو أَنَّ الْإِسْلَامَ يَهْدِمُ مَا كَانَ قَبْلَهُ وَذَكَرَ الْحَدِيثَ
[Machine] Abdullah, son of Abu Bakr, was hit by an arrow on the day of the Battle of Ta'if, and he died forty nights after the death of the Messenger of Allah ﷺ. He mentioned the story and said that a delegation from Thaqif came to him, and he still had that arrow with him. He took it out and asked them, "Does anyone of you recognize this arrow?" Sa'id ibn 'Ubayd, the brother of Banu Al-'Ajlan, said, "This is an arrow that I sharpened, polished, and fletched, and I shot it." Abu Bakr said, "Indeed, this is the arrow that killed Abdullah, son of Abu Bakr. Praise be to Allah who has honored you with his hand and did not disgrace you with it. Indeed, it is more spacious for both of you."
عَبْدُ اللهِ بْنُ أَبِي بَكْرٍ ؓ بِسَهْمٍ يَوْمَ الطَّائِفِ فَانْتَقَضَتْ بِهِ بَعْدَ وَفَاةِ رَسُولِ اللهِ ﷺ بِأَرْبَعِينَ لَيْلَةً فَمَاتَ فَذَكَرَ قِصَّتَهُ قَالَ فَقَدِمَ عَلَيْهِ وَفْدُ ثَقِيفٍ وَلَمْ يَزَلْ ذَلِكَ السَّهْمُ عِنْدَهُ فَأَخْرَجَ إِلَيْهِمْ فَقَالَ هَلْ يَعْرِفُ هَذَا السَّهْمَ مِنْكُمْ أَحَدٌ؟ فَقَالَ سَعِيدُ بْنُ عُبَيْدٍ أَخُو بَنِي الْعَجْلَانِ هَذَا سَهْمٌ أَنَا بَرَيْتُهُ وَرُشْتُهُ وَعَقَّبْتُهُ وَأَنَا رَمَيْتُ بِهِ فَقَالَ أَبُو بَكْرٍ ؓ فَإِنَّ هَذَا السَّهْمَ الَّذِي قَتَلَ عَبْدَ اللهِ بْنَ أَبِي بَكْرٍ فَالْحَمْدُ لِلَّهِ الَّذِي أَكْرَمَهُ بِيَدِكَ وَلَمْ يُهِنْكَ بِيَدِهِ فَإِنَّهُ أَوْسَعُ لَكُمَا
[Machine] Woe to you! You have killed my brother. The breeze did not blow except that I remembered him.
لَهُ وَيْحَكَ لَقَدْ قَتَلْتَ لِي أَخًا مَا هَبَّتِ الصَّبَا إِلَّا ذَكَرْتُهُ
[Machine] "O Anas, I feel ashamed that I killed Bara' bin Malik and Majza'ah bin Thawr. So, he accepted Islam and made amends for them."
عُمَرُ ؓ يَا أَنَسُ أَسْتَحْيِي قَاتِلَ الْبَرَاءِ بْنِ مَالِكٍ وَمَجْزَأَةَ بْنِ ثَوْرٍ؟ فَأَسْلَمَ وَفَرَضَ لَهُ
[Machine] In the end, after that, Abu Talha said to me, "Do you have any involvement in killing Haram (prohibited) animals?" I said, "What happened to him, Allah has done and will do." He said, "Do not do that, for he has embraced Islam."
فِي آخِرِهِ فَلَمَّا كَانَ بَعْدَ ذَلِكَ إِذَا أَبُو طَلْحَةَ يَقُولُ لِي هَلْ لَكَ فِي قَاتِلٍ لِحَرَامٍ؟ قُلْتُ مَا بَالُهُ فَعَلَ اللهُ بِهِ وَفَعَلَ قَالَ لَا تَفْعَلْ فَقَدْ أَسْلَمَ
58.83 [Machine] The individual and collective permission of men to engage in warfare in enemy territories as evidence of the permissibility of advancing on a group even if the majority believes it will result in their death.
٥٨۔٨٣ بَابُ جَوَازِ انْفِرَادِ الرَّجُلِ وَالرِّجَالِ بِالْغَزْوِ فِي بِلَادِ الْعَدُوِّ اسْتِدْلَالًا بِجَوَازِ التَّقَدُّمِ عَلَى الْجَمَاعَةِ وَإِنْ كَانَ الْأَغْلَبُ أَنَّهَا سَتَقْتُلُهُ
AbuImran said: We went out on an expedition from Medina with the intention of (attacking) Constantinople. AbdurRahman ibn Khalid ibn al-Walid was the leader of the company. The Romans were just keeping their backs to the walls of the city. A man (suddenly) attacked the enemy. Thereupon the people said: Stop! Stop! There is no god but Allah. He is putting himself into danger. AbuAyyub said: This verse was revealed about us, the group of the Ansar (the Helpers). When Allah helped His Prophet ﷺ and gave Islam dominance, we said (i.e. thought): Come on! Let us stay in our property and improve it. Thereupon Allah, the Exalted, revealed, "And spend of your substance in the cause of Allah, and make not your hands contribute to (your destruction)". To put oneself into danger means that we stay in our property and commit ourselves to its improvement, and abandon fighting (i.e. jihad). AbuImran said: AbuAyyub continued to strive in the cause of Allah until he (died and) was buried in Constantinople. (Using translation from Abū Dāʾūd 2512)
النَّاسُ مَهْ مَهْ لَا إِلَهَ إِلَّا اللهُ يُلْقِي بِيَدِهِ إِلَى التَّهْلُكَةِ فَقَالَ أَبُو أَيُّوبَ ؓ إِنَّمَا أُنْزِلَتْ هَذِهِ الْآيَةُ فِينَا مَعْشَرَ الْأَنْصَارِ لَمَّا نَصَرَ اللهُ نَبِيَّهُ وَأَظْهَرَ الْإِسْلَامَ قُلْنَا هَلُمَّ نُقِيمُ فِي أَمْوَالِنَا وَنُصْلِحُهَا فَأَنْزَلَ اللهُ تَعَالَى {وَأَنْفِقُوا فِي سَبِيلِ اللهِ وَلَا تُلْقُوا بِأَيْدِيكُمْ إِلَى التَّهْلُكَةِ} [البقرة 195] فَالْإِلْقَاءُ بِأَيْدِينَا إِلَى التَّهْلُكَةِ أَنْ نُقِيمَ فِي أَمْوَالِنَا وَنُصْلِحَهَا وَنَدَعَ الْجِهَادَ قَالَ أَبُو عِمْرَانَ فَلَمْ يَزَلْ أَبُو أَيُّوبَ يُجَاهِدُ فِي سَبِيلِ اللهِ حَتَّى دُفِنَ بِالْقُسْطَنْطِينِيَّةِ وَقَدْ مَضَى فِي هَذَا الْمَعْنَى أَحَادِيثُ
[Machine] "A man said to the Prophet ﷺ on the Day of Uhud, 'O Messenger of Allah, if I am killed, where will I be?' He ﷺ said, 'In Paradise.' He then threw some dates in his hand and fought until he was killed. And this is the narration of Ahmad ibn Shayban."
رَجُلٌ لِلنَّبِيِّ ﷺ يَوْمَ أُحُدٍ يَا رَسُولَ اللهِ إِنْ قُتِلْتُ فَأَيْنَ أَنَا؟ قَالَ فِي الْجَنَّةِ فَأَلْقَى تَمَرَاتٍ كُنَّ فِي يَدِهِ ثُمَّ قَاتَلَ حَتَّى قُتِلَ وَهَذَا لَفْظُ أَحْمَدَ بْنِ شَيْبَانَ
The Messenger of Allah ﷺ sent Busaisah as a scout to see what the caravan of Abu Sufyan was doing. He came (back and met the Prophet in his house) where there was nobody except myself and the Messenger of Allah. I do not remember whether he (Hadrat Anas) made an exception of some wives of the Prophet ﷺ or not and told him the news of the caravan. (Having heard the news), the Messenger of Allah ﷺ came out (hurriedly), spoke to the people and said: We are in need (of men) ; whoever has an animal to ride upon ready with him should ride with us. People began to ask him permission for bringing their riding animals which were grazing on the hillocks near Medina. He said: No. (I want) only those who have their riding animals ready. So the Messenger of Allah ﷺ and his Companions proceeded towards Badr and reached there forestalling the polytheists (of Mecca). When the polytheists (also) reached there, the Messenger of Allah ﷺ said: None of you should step forward to (do) anything unless I am ahead of him. The polytheists (now) advanced (towards us), and the Messenger of Allah ﷺ said. Get up to enter Paradise which is equal in width to the heavens and the earth. 'Umair b. al- Humam al-Ansari said: Messenger of Allah, is Paradise equal in extent to the heavens and the earth? He said: Yes. 'Umair said: My goodness! The Messenger of Allah ﷺ asked him: What prompted you to utter these words (i. e. my goodness! ')? He said: Messenger of Allah, nothing but the desire that I be among its residents. He said: Thou art (surely) amona its residents. He took out dates from his bag and began to eat them. Then he said: If I were to live until I have eaten all these dates of mine, it would be a long life. (The narrator said): He threw away all the dates he had with him. Then he fought the enemies until he was killed. (Using translation from Muslim 1901)
بَعَثَ رَسُولُ اللهِ ﷺ بُسَيْسَةَ عَيْنًا يَنْظُرُ مَا صَنَعَتْ عِيرُ أَبِي سُفْيَانَ فَجَاءَ وَمَا فِي الْبَيْتِ غَيْرِي وَغَيْرُ رَسُولِ اللهِ ﷺ فَقَالَ لَا أَدْرِي مَا اسْتَثْنَى بَعْضَ نِسَائِهِ فَحَدَّثَهُ الْحَدِيثَ قَالَ فَخَرَجَ رَسُولُ اللهِ ﷺ فَتَكَلَّمَ فَقَالَ إِنَّ لَنَا طِلْبَةً فَمَنْ كَانَ ظَهْرُهُ حَاضِرًا فَلْيَرْكَبْ مَعَنَا فَجَعَلَ رِجَالٌ يَسْتَأْذِنُونَ فِي ظُهْرَانِهِمْ فِي عُلْوِ الْمَدِينَةِ قَالَ لَا إِلَّا مَنْ كَانَ ظَهْرُهُ حَاضِرًا فَانْطَلَقَ رَسُولُ اللهِ ﷺ وَأَصْحَابُهُ حَتَّى سَبَقُوا الْمُشْرِكِينَ إِلَى بَدْرٍ وَجَاءَ الْمُشْرِكُونَ فَقَالَ رَسُولُ اللهِ ﷺ لَا يُقْدِمَنَّ أَحَدٌ مِنْكُمْ إِلَى شَيْءٍ حَتَّى أَكُونَ أَنَا أُوذِنُهُ فَدَنَا الْمُشْرِكُونَ فَقَالَ رَسُولُ اللهِ ﷺ قُومُوا إِلَى جَنَّةٍ عَرْضُهَا السَّمَاوَاتُ وَالْأَرْضُ قَالَ يَقُولُ عُمَيْرُ بْنُ الْحُمَامِ الْأَنْصَارِيُّ يَا رَسُولَ اللهِ جَنَّةٌ عَرْضُهَا السَّمَاوَاتُ وَالْأَرْضُ؟ قَالَ نَعَمْ قَالَ بَخٍ بَخٍ فَقَالَ رَسُولُ اللهِ ﷺ مَا حَمَلَكَ عَلَى قَوْلِكَ بَخٍ بَخٍ؟ قَالَ لَا وَاللهِ يَا رَسُولَ اللهِ إِلَّا رَجَاءَ أَنْ أَكُونَ مِنْ أَهْلِهَا قَالَ فَإِنَّكَ مِنْ أَهْلِهَا فَأَخْرَجَ تَمَرَاتٍ مِنْ قَرَنِهِ فَجَعَلَ يَأْكُلُ مِنْهُنَّ ثُمَّ قَالَ لَئِنْ أَنَا حَيِيتُ حَتَّى آكُلَ تَمَرَاتِي هَذِهِ إِنَّهَا لَحَيَاةٌ طَوِيلَةٌ قَالَ فَرَمَى بِمَا كَانَ مَعَهُ مِنَ التَّمْرِ ثُمَّ قَاتَلَهُمْ حَتَّى قُتِلَ
[Machine] Awf ibn 'Afrah ibn Al-Harith said, "O Messenger of Allah, what makes the Lord, blessed and exalted, laugh at his servant?" He (the Prophet) said, "When he sees him plunging his hand into battle, fighting furiously, so Awf removed his armor, then he moved forward and fought until he was killed."
عَوْفُ ابْنُ عَفْرَاءَ بْنِ الْحَارِثِ ؓ يَا رَسُولَ اللهِ مَا يُضْحِكُ الرَّبَّ تَبَارَكَ وَتَعَالَى مِنْ عَبْدِهِ؟ قَالَ أَنْ يَرَاهُ قَدْ غَمَسَ يَدَهُ فِي الْقِتَالِ يُقَاتِلُ حَاسِرًا فَنَزَعَ عَوْفٌ دِرْعَهُ ثُمَّ تَقَدَّمَ فَقَاتَلَ حَتَّى قُتِلَ
[Machine] The Prophet ﷺ sent Abdullah bin Mas'ood and Khabbab on a secret mission, and he sent Dihyah on a separate secret mission alone.
قَدْ بَعَثَ النَّبِيُّ ﷺ عَبْدَ اللهِ بْنَ مَسْعُودٍ وَخَبَّابًا سَرِيَّةً وَبَعَثَ دِحْيَةَ سَرِيَّةً وَحْدَهُ
[Machine] About the companions of the well of Ma'unah, they saw birds hovering over the remains of their companions. So, one of them said to 'Amr bin Umaiyah, "I will go forward to face these enemies, and they will kill me, but I will not abandon the scene where our companions were killed." He did so, and he was killed. Then 'Amr bin Umaiyah returned and narrated what had happened to the Prophet ﷺ . The Prophet ﷺ said a good statement about him, and it is said he said to 'Amr, "Why didn't you move forward and fight until you were killed?" Ash-Shafi'i (may Allah have mercy on him) said, "The Messenger of Allah ﷺ sent 'Amr bin Umaiyah Ad-Damri and a man from the Ansar on a separate mission, and he also sent 'Abdullah bin Unais on a separate mission, and we have mentioned their chains of narration in this book."
عَنْ أَصْحَابِ بِئْرِ مَعُونَةَ فَرَأَى الطَّيْرَ عُكُوفًا عَلَى مَقْتَلَةِ أَصْحَابِهِ فَقَالَ لِعَمْرِو بْنِ أُمَيَّةَ سَأَتَقَدَّمُ عَلَى هَؤُلَاءِ الْعَدُوِّ فَيَقْتُلُونَنِي وَلَا أَتَخَلَّفُ عَنْ مَشْهَدٍ قُتِلَ فِيهِ أَصْحَابُنَا فَفَعَلَ فَقُتِلَ فَرَجَعَ عَمْرُو بْنُ أُمَيَّةَ فَذَكَرَ ذَلِكَ لِلنَّبِيِّ ﷺ فَقَالَ فِيهِ قَوْلًا حَسَنًا وَيُقَالُ قَالَ لِعَمْرٍو فَهَلَّا تَقَدَّمْتَ فَقَاتَلْتَ حَتَّى تُقْتَلَ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ وَبَعَثَ رَسُولُ اللهِ ﷺ عَمْرَو بْنَ أُمَيَّةَ الضَّمْرِيَّ وَرَجُلًا مِنَ الْأَنْصَارِ سَرِيَّةً وَحْدَهُمَا وَبَعَثَ عَبْدَ اللهِ بْنَ أُنَيْسٍ سَرِيَّةً وَحْدَهُ وَقَدْ ذَكَرْنَا إِسْنَادَهُمَا فِي هَذَا الْكِتَابِ
58.84 [Machine] The man steals from the store and has arrived for the fight.
٥٨۔٨٤ بَابُ الرَّجُلِ يَسْرِقُ مِنَ الْمَغْنَمِ وَقَدْ حَضَرَ الْقِتَالَ
[Machine] A slave from the fifth of the spoils stole from the spoils, so he was brought to the Prophet ﷺ and he did not cut his hand. The Prophet ﷺ said: "Allah's wealth has stolen some of its wealth and this is a weak chain of narrators. And it has been narrated from another source that Maymun ibn Mihran narrated from the Prophet ﷺ as a continuation, and we have narrated from Ali ibn Abi Talib that a man stole a shield from the spoils and he did not cut his hand."
عَبْدًا مِنْ رَقِيقِ الْخُمُسِ سَرَقَ مِنَ الْخُمُسِ فَرُفِعَ إِلَى النَّبِيِّ ﷺ فَلَمْ يَقْطَعْهُ فَقَالَ مَالُ اللهِ سَرَقَ بَعْضُهُ بَعْضًا وَهَذَا إِسْنَادٌ فِيهِ ضَعْفٌ وَقَدْ رُوِيَ مِنْ وَجْهٍ آخَرَ عَنْ مَيْمُونِ بْنِ مِهْرَانَ عَنِ النَّبِيِّ ﷺ مُرْسَلًا وَرُوِّينَا عَنْ عَلِيِّ بْنِ أَبِي طَالِبٍ ؓ أَنَّ رَجُلًا سَرَقَ مِغْفَرًا مِنَ الْمَغْنَمِ فَلَمْ يَقْطَعْهُ
58.85 [Machine] The limited and excessive amounts of mascara are prohibited
٥٨۔٨٥ بَابُ الْغُلُولِ قَلِيلُهُ وَكَثِيرُهُ حَرَامٌ
[Machine] We went out with the Messenger of Allah ﷺ to Khaybar, but we did not attain any gold or silver, rather we only gained possessions and wealth. Then we turned towards the valley of the villages, and with the Messenger of Allah ﷺ was a slave who was given to him by Rifaa'ah ibn Badr, a man from the Banu Dhubayb tribe. While he was untying the camel of the Messenger of Allah ﷺ , a stray arrow struck him and he died. The people said, "Congratulations to him, for he has entered Paradise!" The Messenger of Allah ﷺ said, "No, by the One in whose hand is my soul. The cloak which he stole from the spoils of Khaybar, the sharers did not give it to him. It will burn him with fire." Then a man came to the Messenger of Allah ﷺ with two cloaks, and the Messenger of Allah ﷺ said, "A cloak from fire, or two cloaks from fire."
خَرَجْنَا مَعَ رَسُولِ اللهِ ﷺ إِلَى خَيْبَرَ فَلَمْ نَغْنَمْ ذَهَبًا وَلَا فِضَّةً إِنَّمَا غَنِمْنَا الْمَتَاعَ وَالْأَمْوَالَ ثُمَّ انْصَرَفْنَا نَحْوَ وَادِي الْقُرَى وَمَعَ رَسُولِ اللهِ ﷺ عَبْدٌ أَعْطَاهُ إِيَّاهُ رِفَاعَةُ بْنُ بَدْرٍ رَجُلٌ مِنْ بَنِي ضَبِيبٍ فَبَيْنَمَا هُوَ يَحُطُّ رَحْلَ رَسُولِ اللهِ ﷺ إِذْ أَتَاهُ سَهْمٌ عَائِرٌ فَأَصَابَهُ فَمَاتَ فَقَالَ لَهُ النَّاسُ هَنِيئًا لَهُ الْجَنَّةُ فَقَالَ رَسُولُ اللهِ ﷺ كَلَّا وَالَّذِي نَفْسِي بِيَدِهِ إِنَّ الشَّمْلَةَ الَّتِي غَلَّهَا يَوْمَ خَيْبَرَ مِنَ الْمَغَانِمِ لَمْ تُصِبْهَا الْمَقَاسِمُ لَتَشْتَعِلُ عَلَيْهِ نَارًا فَجَاءَ رَجُلٌ إِلَى رَسُولِ اللهِ ﷺ بِشِرَاكٍ أَوْ شِرَاكَيْنِ فَقَالَ رَسُولُ اللهِ ﷺ شِرَاكٌ مِنْ نَارٍ أَوْ شِرَاكَانِ مِنْ نَارٍ
“There was a man called Kirkah in charge of the goods of the Prophet ﷺ, who died. The Prophet ﷺ said: ‘He is in Hell.’ They went and looked, and found him wearing a garment or a cloak that he had stolen from the spoils of war.” (Using translation from Ibn Mājah 2849)
كَانَ عَلَى ثَقَلِ النَّبِيِّ ﷺ رَجُلٌ يُقَالُ لَهُ كِرْكِرَةُ فَمَاتَ فَقَالَ رَسُولُ اللهِ ﷺ هُوَ فِي النَّارِ فَذَهَبُوا يَنْظُرُونَ إِلَيْهِ فَوَجَدُوا عَلَيْهِ عَبَاءَةً قَدْ غَلَّهَا
Umar bin al-Khattab told me: On the day of Khaibar, a group of the companions of the Prophet ﷺ came and said: So and so has been martyred. So and so has been martyred, until they came to a man and said, So and so has been martyred, but the Messenger of Allah ﷺ said: “No, I saw him in the Fire because of a cloak or 'aba'ah that he stole from the war booty.” Then the Messenger of Allah ﷺ said: “O son of al-Khattab, go and call out to the people that no one will enter Paradise except the believers.” So I went out and called to them, saying: ʿNo one will enter Paradise except the believers.” (Using translation from Aḥmad 203)
لَمَّا كَانَ يَوْمُ حُنَيْنٍ قُتِلَ مِنْ أَصْحَابِ النَّبِيِّ ﷺ يَعْنِي نَاسًا فَقَالُوا فُلَانٌ شَهِيدٌ وَفُلَانٌ شَهِيدٌ حَتَّى مَرُّوا عَلَى رَجُلٍ فَقَالُوا فُلَانٌ شَهِيدٌ فَقَالَ رَسُولُ اللهِ ﷺ كَلَّا إِنِّي رَأَيْتُهُ فِي النَّارِ فِي عَبَاءَةٍ غَلَّهَا أَوْ بُرْدَةٍ غَلَّهَا ثُمَّ قَالَ رَسُولُ اللهِ ﷺ يَا ابْنَ الْخَطَّابِ اذْهَبْ فَنَادِ فِي النَّاسِ أَنَّهُ لَا يَدْخُلُ الْجَنَّةَ إِلَّا الْمُؤْمِنُونَ فَخَرَجْتُ فَنَادَيْتُ فِي النَّاسِ أَنَّهُ لَا يَدْخُلُ الْجَنَّةَ إِلَّا الْمُؤْمِنُونَ
[Machine] He said that a man passed away on the day of Khaybar, and they mentioned it to the Messenger of Allah ﷺ . He said to them, "Pray for your companion." Then the faces of the people changed due to this. He presumed that the Messenger of Allah ﷺ had said, "Indeed, your companion has strived in the way of Allah, so we opened his belongings and found beads of the Jews that are not worth two dirhams," the words of the narrator Ibn Wahb.
أَنَّهُ قَالَ تُوُفِّيَ رَجُلٌ يَوْمَ خَيْبَرَ وَأَنَّهُمْ ذَكَرُوا لِرَسُولِ اللهِ ﷺ فَقَالَ لَهُمْ صَلُّوا عَلَى صَاحِبِكُمْ فَتَغَيَّرَتْ وُجُوهُ النَّاسِ لِذَلِكَ فَزَعَمَ أَنَّ رَسُولَ اللهِ ﷺ قَالَ إِنَّ صَاحِبَكُمْ قَدْ غَلَّ فِي سَبِيلِ اللهِ فَفَتَحْنَا مَتَاعَهُ فَوَجَدْنَا خَرَزَاتٍ مِنْ خَرَزِ يَهُودَ مَا تُسَاوِي دِرْهَمَيْنِ لَفْظُ حَدِيثِ ابْنِ وَهْبٍ
One day the Messenger of Allah ﷺ stood among us (to deliver a sermon). He talked about the misappropriation of booty, and declared it to be a serious matter and a grave sin. Then he said: I shouldn't find that any of you should come on the Day of Judgment with a growling camel mounted on his neck, and should appeal to me for help saying:" Messenger of Allah, help me." and I should say: I have no authority to help you; I already communicated to you. I shouldn't find that any of you should come on the Day of Judgment with a bleating ewe mounted on his neck, and he should say to me:" Messenger of Allah, help me," and I should say: I have no authority to help you; I conveyed to you. I shouldn't find that one of you should come on the Day of Judgment with a Person crying loudly mounted on his neck, and he should say to me:" Messenger of Allah, help me," and I should say: I have no authority to help you; I conveyed to you. I shouldn't find that any one of you should come on the Day of Judgment with fluttering clothes wrapped round his neck and he should say to me:" Messenger of Allah, help me," and I should say: I have no authority to help you; I conveyed to you. I shouldn't find that any of you should come on the Day of Judgment with a heap of gold and silver placed on his neck and he should say to me:" Messenger of Allah, help me." and I should say: I have no authority to help you; I already conveyed to you (the warning from the Almighty). قَامَ فِينَا رَسُولُ اللهِ ﷺ يَوْمًا فَذَكَرَ الْغُلُولَ فَعَظَّمَهُ وَعَظَّمَ أَمْرَهُ فَقَالَ لَا أُلْفِيَنَّ أَحَدَكُمْ يَوْمَ الْقِيَامَةِ عَلَى رَقَبَتِهِ بَعِيرٌ لَهُ رُغَاءٌ يَقُولُ يَا رَسُولَ اللهِ أَغِثْنِي أَقُولُ لَا أَمْلِكُ لَكَ شَيْئًا قَدْ أَبْلَغْتُكَ لَا أُلْفِيَنَّ أَحَدَكُمْ يَجِيءُ يَوْمَ الْقِيَامَةِ عَلَى رَقَبَتِهِ شَاةٌ لَهَا ثُغَاءٌ يَقُولُ يَا رَسُولَ اللهِ أَغِثْنِي أَقُولُ لَا أَمْلِكُ لَكَ شَيْئًا قَدْ أَبْلَغْتُكَ لَا أُلْفِيَنَّ أَحَدَكُمْ يَجِيءُ يَوْمَ الْقِيَامَةِ عَلَى رَقَبَتِهِ فَرَسٌ لَهَا حَمْحَمَةٌ يَقُولُ يَا رَسُولَ اللهِ أَغِثْنِي فَأَقُولُ لَا أَمْلِكُ لَكَ شَيْئًا قَدْ أَبْلَغْتُكَ لَا أُلْفِيَنَّ أَحَدَكُمْ يَجِيءُ يَوْمَ الْقِيَامَةِ عَلَى رَقَبَتِهِ نَفْسٌ لَهَا صِيَاحٌ يَقُولُ يَا رَسُولَ اللهِ أَغِثْنِي أَقُولُ لَا أَمْلِكُ لَكَ شَيْئًا قَدْ أَبْلَغْتُكَ لَا أُلْفِيَنَّ أَحَدَكُمْ يَوْمَ الْقِيَامَةِ عَلَى رَقَبَتِهِ صَامِتٌ يَقُولُ يَا رَسُولَ اللهِ أَغِثْنِي أَقُولُ لَا أَمْلِكُ لَكَ شَيْئًا قَدْ أَبْلَغْتُكَ لَا أُلْفِيَنَّ أَحَدَكُمْ يَجِيءُ يَوْمَ الْقِيَامَةِ عَلَى رَقَبَتِهِ رِقَاعٌ تَخْفِقُ يَقُولُ يَا رَسُولَ اللهِ أَغِثْنِي أَقُولُ لَا أَمْلِكُ لَكَ شَيْئًا قَدْ أَبْلَغْتُكَ
[Machine] The Messenger of Allah, ﷺ , mentioned theft and considered it a serious crime. Then he said, "Beware that none of you would come on the Day of Judgment with a camel on his neck, and say, 'O Muhammad, help me!' I would say, 'I cannot help you, I have already delivered the Message.' Then a man would come with a horse on his neck, covered with sweat, and he would say, 'O Muhammad, help me!' I would say, 'I cannot help you, I have already delivered the Message.' And then a man would come with patches on his neck, and he would say, 'O Muhammad, help me!' I would say, 'I cannot help you, I have already delivered the Message.'" Hammad said: And I have heard it from Yahya bin Sa'id, who narrated it in a similar wording from Abu Abdullah As-Saffar.
ذَكَرَ رَسُولُ اللهِ ﷺ الْغُلُولَ فَعَظَّمَهُ ثُمَّ قَالَ لِيَحْذَرْ أَحَدُكُمْ أَنْ يَجِيءَ يَوْمَ الْقِيَامَةِ بِبَعِيرٍ عَلَى عُنُقِهِ فَيَقُولَ يَا مُحَمَّدُ أَغِثْنِي فَأَقُولَ إِنِّي لَا أُغْنِي عَنْكَ شَيْئًا إِنِّي قَدْ بَلَّغْتُ وَيَجِيءُ رَجُلٌ عَلَى عُنُقِهِ فَرَسٌ لَهُ حَمْحَمَةٌ فَيَقُولُ يَا مُحَمَّدُ أَغِثْنِي فَأَقُولُ إِنِّي لَا أُغْنِي عَنْكَ شَيْئًا إِنِّي قَدْ بَلَّغْتُ وَيَجِيءُ الرَّجُلُ عَلَى عُنُقِهِ رِقَاعٌ فَيَقُولُ يَا مُحَمَّدُ أَغِثْنِي فَأَقُولُ لَا أُغْنِي عَنْكَ شَيْئًا قَدْ بَلَّغْتُ قَالَ حَمَّادٌ وَقَدْ سَمِعْتُهُ مِنْ يَحْيَى بْنِ سَعِيدٍ فَجَاءَ بِهِ نَحْوًا مِنْ هَذَا لَفْظُ حَدِيثِ أَبِي عَبْدِ اللهِ الصَّفَّارِ
[Machine] The Messenger of Allah ﷺ said, "Whoever dies while innocent of three things: arrogance, stealing, and debt, will enter Paradise." Abu 'Isa said, Sa'id reported it from Qatadah, and Al-Kanz said, "He replaced arrogance."
قَالَ رَسُولُ اللهِ ﷺ مَنْ مَاتَ وَهُوَ بَرِيءٌ مِنْ ثَلَاثٍ مِنَ الْكِبْرِ وَالْغُلُولِ وَالدَّيْنِ دَخَلَ الْجَنَّةَ قَالَ أَبُو عِيسَى ورَوَاهُ سَعِيدٌ عَنْ قَتَادَةَ وَقَالَ الْكَنْزَ بَدَلَ الْكِبْرِ
58.86 [Machine] The translation of the heading into English is as follows: "The one who becomes jealous over spoils will not be deprived, and his belongings will not be burned. And the one who says they will be burned.
٥٨۔٨٦ بَابُ لَا يُقْطَعُ مَنْ غَلَّ فِي الْغَنِيمَةِ وَلَا يُحْرَقُ مَتَاعُهُ، وَمَنْ قَالَ يُحْرَقُ
[Machine] The Prophet, ﷺ , was returning from the Battle of Hunayn when people continuously asked him for something. His she-camel stumbled and snatched his cloak, causing it to be caught on a tree. He said, "Return my cloak to me! Are you afraid that I am being stingy with it? By Allah, if Allah were to give you blessings equal to the mountains of Samur and I were to distribute them among you, you would still not find me to be stingy, cowardly, or a liar." Then he took a handful of barley from the load of a camel, lifted it up and said, "I have nothing from what Allah has given you nor anything like it except one-fifth. And one-fifth, I am returning it back to you. Then, you will not find me stingy, cowardly, or a liar." When it reached the share of the fifth, a man came and claimed it, saying that it belonged to him as a seamstress or tailor. He said, "Return the seamstress and the tailor, as the portion that was taken without right is a disgrace, fire, and burden on the Day of Judgment."
أَنَّ النَّبِيَّ ﷺ لَمَّا قَفَلَ مِنْ غَزْوَةِ حُنَيْنٍ رَهِقَهُ النَّاسُ يَسْأَلُونَهُ فَحَاصَتْ بِهِ النَّاقَةُ فَخَطِفَتْ رِدَاءَهُ شَجَرَةٌ فَقَالَ رُدُّوا عَلَيَّ رِدَائِي أَتَخْشَوْنَ عَلَيَّ الْبُخْلَ؟ وَاللهِ لَوْ أَفَاءَ اللهُ عَلَيْكُمْ نَعَمًا مِثْلَ سَمُرِ تِهَامَةَ لَقَسَمْتُهَا بَيْنَكُمْ ثُمَّ لَا تَجِدُونَنِي بَخِيلًا وَلَا جَبَانًا وَلَا كَذَّابًا ثُمَّ أَخَذَ وَبَرَةً مِنْ وَبَرِ سَنَامِ الْبَعِيرِ فَرَفَعَهَا وَقَالَ مَا لِي مِمَّا أَفَاءَ اللهُ عَلَيْكُمْ وَلَا مِثْلُ هَذِهِ إِلَّا الْخُمُسُ وَالْخُمُسُ مَرْدُودٌ عَلَيْكُمْ فَلَمَّا كَانَ عِنْدَ قَسْمِ الْخُمُسِ أَتَاهُ رَجُلٌ يَسْتَحِلُّهُ خِيَاطًا أَوْ مِخْيَطًا فَقَالَ رُدُّوا الْخِيَاطَ وَالْمِخْيَطَ فَإِنَّ الْغُلُولَ عَارٌ وَنَارٌ وَشَنَارٌ يَوْمَ الْقِيَامَةِ
When the Messenger of Allah ﷺ gained booty he ordered Bilal to make a public announcement. He made a public announcement, and when the people brought their booty, he would take a fifth and divide it. Thereafter a man brought a halter of hair and said: Messenger of Allah, this is a part of the booty we got. He asked: Have you heard Bilal making announcement three times? He replied: Yes. He asked: What did prevent you from bringing it? He made some excuse, to which he said: Be (as you are), you may bring it on the Day of Judgment, for I shall not accept it from you. كَانَ رَسُولُ اللهِ ﷺ إِذَا أَصَابَ غَنِيمَةً أَمَرَ بِلَالًا فَنَادَى فِي النَّاسِ فَيَجِيئُونَ بِغَنَائِمِهِمْ فَيَخْمُسُهَا وَيَقْسِمُهَا فَجَاءَ رَجُلٌ بَعْدَ ذَلِكَ بِزِمَامٍ مِنْ شَعْرٍ فَقَالَ يَا رَسُولَ اللهِ هَذَا فِيمَا كُنَّا أَصَبْنَاهُ مِنَ الْغَنِيمَةِ قَالَ أَسَمِعْتَ بِلَالًا نَادَى ثَلَاثًا؟ قَالَ نَعَمْ قَالَ فَمَا مَنَعَكَ أَنْ تَجِيءَ بِهِ؟ قَالَ فَاعْتَذَرَ قَالَ كُنْ أَنْتَ تَجِيءُ بِهِ يَوْمَ الْقِيَامَةِ فَلَنْ أَقْبَلَهُ مِنْكَ وَقَدْ مَضَى فِي الْبَابِ قَبْلَهُ حَدِيثُ عَبْدِ اللهِ بْنِ عَمْرٍو فِي كِرْكِرَةَ وَلَمْ يُذْكَرْ فِي شَيْءٍ مِنْ هَذِهِ الرِّوَايَاتِ أَنَّ النَّبِيَّ ﷺ أَمَرَ بِتَحْرِيقِ مَتَاعِ الْغَالِّ
[Machine] "Allah, ﷺ , and Abu Bakr and Umar, burned the property of the usurper, prevented his arrow, and struck him like this."
اللهِ ﷺ وَأَبَا بَكْرٍ وَعُمَرَ ؓ أَحْرَقُوا مَتَاعَ الْغَالِّ وَمَنَعُوهُ سَهْمَهُ وَضَرَبُوهُ هَكَذَا
[Machine] On the authority of the Prophet ﷺ , he said: "If you find a man who has gone astray, destroy his belongings and strike him." He said: "So we found in his belongings a copy of the Quran, and Salim was asked about it. He said, 'Sell it and give its price in charity.' The wording of the Hadith is weak, narrated by Sa'id."
عَنِ النَّبِيِّ ﷺ قَالَ إِذَا وَجَدْتُمُ الرَّجُلَ قَدْ غَلَّ فَأَحْرِقُوا مَتَاعَهُ وَاضْرِبُوهُ قَالَ فَوَجَدْنَا فِي مَتَاعِهِ مُصْحَفًا فَسُئِلَ سَالِمٌ عَنْهُ فَقَالَ بِعْهُ وَتَصَدَّقْ بِثَمَنِهِ لَفْظُ حَدِيثِ سَعِيدٍ فَهَذَا ضَعِيفٌ
[Machine] Narrated from the Prophet ﷺ about spoils of war that were not burned. Al-Bukhari said, "Our companions use this hadith as evidence regarding spoils of war, but it is false and not based on anything." Abu Abdullah Al-Hafiz reported to us, Abu Al-Abbas Muhammad bin Ya'qub narrated to us, Al-Abbas bin Muhammad said, "I heard Yahya bin Ma'een say, 'The hadith of Saleh bin Muhammad bin Zaidah is not reliable for that.'"
عَنِ النَّبِيِّ ﷺ فِي الْغُلُولِ وَلَمْ يَحْرِقْ قَالَ الْبُخَارِيُّ وَعَلَيْهِ أَصْحَابُنَا يَحْتَجُّونَ بِهَذَا فِي الْغُلُولِ وَهَذَا بَاطِلٌ لَيْسَ بِشَيْءٍ 18216 أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا الْعَبَّاسُ بْنُ مُحَمَّدٍ قَالَ سَمِعْتُ يَحْيَى بْنَ مَعِينٍ يَقُولُ صَالِحُ بْنُ مُحَمَّدِ بْنِ زَائِدَةَ لَيْسَ حَدِيثُهُ بِذَاكَ
58.87 [Machine] The Establishment of Borders in the Land of War Imam Al-Shafi'i (may Allah have mercy on him) said: The Messenger of Allah ﷺ established the boundary in Al-Madinah, and polytheism is nearby, and there were many polytheists among them. He fought the tribe of Hawazin in the Battle of Hunayn, and polytheism is nearby.
٥٨۔٨٧ بَابُ إِقَامَةِ الْحُدُودِ فِي أَرْضِ الْحَرْبِ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: قَدْ أَقَامَ رَسُولُ اللهِ ﷺ الْحَدَّ بِالْمَدِينَةِ , وَالشِّرْكُ قَرِيبٌ مِنْهَا وَفِيهَا شِرْكٌ كَثِيرٌ مُوَادِعُونَ , وَضَرَبَ الشَّارِبَ بِحُنَيْنٍ وَالشِّرْكُ قَرِيبٌ مِنْهُ.
[Machine] I saw the Messenger of Allah ﷺ on the day of Hunayn, walking among the people, asking about the whereabouts of Khalid ibn al-Walid. He was brought a drunk person, and the Messenger of Allah ﷺ commanded those who were with him to beat the drunk with whatever they had in their hands. The Messenger of Allah ﷺ then threw dirt on him and mentioned the incident.
رَأَيْتُ رَسُولَ اللهِ ﷺ يَوْمَ حُنَيْنٍ يَتَخَلَّلُ النَّاسَ يَسْأَلُ عَنْ مَنْزِلِ خَالِدِ بْنِ الْوَلِيدِ وَأُتِيَ بِسَكْرَانَ فَأَمَرَ مَنْ كَانَ عِنْدَهُ فَضَرَبُوهُ بِمَا كَانَ فِي أَيْدِيهِمْ وَحَثَا رَسُولُ اللهِ ﷺ عَلَيْهِ مِنَ التُّرَابِ وَذَكَرَ الْحَدِيثَ
[Machine] And a jug of wine was poured and a man from the Muslims came and drank from that wine. It was raised to the Prophet ﷺ and he disliked it when it was raised to him, so he hit it with his sandal. He ordered those who were present to hit him with their sandals as well. He was called Abdullah Al-Himar and he was a man who could not resist drinking. The Messenger of Allah ﷺ hit him repeatedly and Umar said, "O Allah, curse him. He is repeatedly hit." The Messenger of Allah ﷺ said, "Do not do that, O Umar, for indeed he loves Allah and His Messenger."
وَزُقَاقُ خَمْرٍ فَأُهْرِيقَتْ وَعَمَدَ يَوْمَئِذٍ رَجُلٌ مِنَ الْمُسْلِمِينَ فَشَرِبَ مِنْ ذَلِكَ الْخَمْرِ فَرُفِعَ ذَلِكَ إِلَى النَّبِيِّ ﷺ فَكَرِهَ حِينَ رُفِعَ إِلَيْهِ فَخَفَقَهُ بِنَعْلِهِ وَأَمَرَ مَنْ حَضَرَهُ فَخَفَقُوهُ بِنِعَالِهِمْ وَكَانَ يُقَالُ لَهُ عَبْدُ اللهِ الْحِمَارُ كَانَ رَجُلًا لَا يَصْبِرُ عَنِ الشُّرْبِ فَضَرَبَهُ رَسُولُ اللهِ ﷺ مِرَارًا فَقَالَ عُمَرُ ؓ اللهُمَّ الْعَنْهُ مَا أَكْثَرَ مَا يُضْرَبُ فَقَالَ رَسُولُ اللهِ ﷺ لَا تَفْعَلْ يَا عُمَرُ فَإِنَّهُ يُحِبُّ اللهَ وَرَسُولَهُ
[Machine] The Prophet ﷺ performed Salah (prayer) on a camel from the Muhassam tribe. When he finished his prayer, he took a baby monkey between his two fingers, and it was in a playful mood. He said, "Indeed, this is from your spoils of war, and nothing from it except one-fifth is yours, and that one-fifth is to be returned to you. So, give the thread and the needle, and anything smaller or larger, for looting is a disgrace upon its people in this world and the Hereafter. Strive in the cause of Allah against people near and far, and do not be blamed for anything in the cause of Allah. Establish the boundaries of Allah during travel and residency, and engage in Jihad, for it is a great gateway to Paradise through which Allah saves you from worries and distress." 18220.
النَّبِيَّ ﷺ صَلَّى إِلَى بَعِيرٍ مِنَ الْمُقَسَّمِ فَلَمَّا فَرَغَ مِنْ صَلَاتِهِ أَخَذَ مِنْهُ قَرَدَةً بَيْنَ إِصْبَعَيْهِ وَهِيَ فِي وَبَرَةٍ فَقَالَ أَلَا إِنَّ هَذَا مِنْ غَنَائِمِكُمْ وَلَيْسَ مِنْهُ إِلَّا الْخُمُسُ وَالْخُمُسُ مَرْدُودٌ عَلَيْكُمْ فَأَدُّوا الْخَيْطَ وَالْمِخْيَطَ وَأَصْغَرَ مِنْ ذَلِكَ وَأَكْبَرَ فَإِنَّ الْغُلُولَ عَارٌ عَلَى أَهْلِهِ فِي الدُّنْيَا وَالْآخِرَةِ وَجَاهِدُوا النَّاسَ فِي اللهِ الْقَرِيبَ مِنْهُمْ وَالْبَعِيدَ وَلَا يَأْخُذْكُمْ فِي اللهِ لَوْمَةُ لَائِمٍ وَأَقِيمُوا حُدُودَ اللهِ فِي السَّفَرِ وَالْحَضَرِ وَعَلَيْكُمْ بِالْجِهَادِ فَإِنَّهُ بَابٌ مِنْ أَبْوَابِ الْجَنَّةِ عَظِيمٌ يُنَجِّي اللهُ بِهِ مِنَ الْهَمِّ وَالْغَمِّ 18220
[Machine] The Messenger of Allah ﷺ said, "Establish the prescribed punishments for both the residents and the travelers, whether near or far. And do not concern yourselves with the blame of the blamers in the sight of Allah." Abu Bakr ibn Muhammad informed us that Abu al-Husayn al-Fasawi narrated to him, who narrated from Abu Ali al-Lu'lu'i, who narrated from Abu Dawud, who mentioned it. This was also narrated by Ata ibn Abi Rabah from 'Ubadah ibn al-Samit.
قَالَ رَسُولُ اللهِ ﷺ وَأَقِيمُوا الْحُدُودَ فِي الْحَضَرِ وَالسَّفَرِ عَلَى الْقَرِيبِ وَالْبَعِيدِ وَلَا تُبَالُوا فِي اللهِ لَوْمَةَ لَائِمٍ أَخْبَرَنَا أَبُو بَكْرِ بْنُ مُحَمَّدٍ أَنْبَأَ أَبُو الْحُسَيْنِ الْفَسَوِيُّ ثنا أَبُو عَلِيٍّ اللُّؤْلُؤِيُّ ثنا أَبُو دَاوُدَ فَذَكَرَهُ وَرُوِي ذَلِكَ أَيْضًا عَنْ عَطَاءِ بْنِ أَبِي رَبَاحٍ عَنْ عُبَادَةَ بْنِ الصَّامِتِ
[Machine] "God would never let Dhirar ibn al-Azwar be humiliated."
مَا كَانَ اللهُ لِيُخْزِيَ ضِرَارَ بْنَ الْأَزْوَرِ
58.88 [Machine] Whoever claims that the hudud are not applied in the land of war until he returns
٥٨۔٨٨ بَابُ مَنْ زَعَمَ لَا تُقَامُ الْحُدُودُ فِي أَرْضِ الْحَرْبِ حَتَّى يَرْجِعَ
[Machine] I heard the Messenger of Allah ﷺ saying, "Do not cut off the hands in travel; and if not for that, I would have cut it off." This is a chain of narration from Sham. Yahya ibn Ma'in said, "The people of Madinah deny that Busrah ibn Arta'ah heard from the Prophet ﷺ . And Yahya ibn Ma'in said, "Busrah ibn Arta'ah is a man of evil." 18224 Abu Abdullah al-Hafiz informed us about this. Abu al-Abbas narrated to us from Abbas al-Duri from Yahya ibn Ma'in who said, "The Sheikh (Yahya ibn Ma'in) only said this about him (Busrah ibn Arta'ah) because of the evil deeds he showed in fighting the people of Harrah and others." And Allah knows best.
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ لَا تُقْطَعُ الْأَيْدِي فِي السَّفَرِ ؛ وَلَوْلَا ذَلِكَ لَقَطَعْتُهُ هَذَا إِسْنَادٌ شَامِيٌّ وَكَانَ يَحْيَى بْنُ مَعِينٍ يَقُولُ أَهْلُ الْمَدِينَةِ يُنْكِرُونَ أَنْ يَكُونَ بُسْرُ بْنُ أَرْطَاةَ سَمِعَ مِنَ النَّبِيِّ ﷺ وَقَالَ يَحْيَى بُسْرُ بْنُ أَرْطَاةَ رَجُلُ سَوْءٍ 18224 أَخْبَرَنَا بِذَلِكَ أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو الْعَبَّاسِ ثنا الْعَبَّاسُ الدُّورِيُّ عَنْ يَحْيَى بْنِ مَعِينٍ قَالَ الشَّيْخُ وَإِنَّمَا قَالَ ذَلِكَ يَحْيَى لِمَا ظَهَرَ مِنْ سُوءِ فِعْلِهِ فِي قِتَالِ أَهْلِ الْحَرَّةِ وَغَيْرِهِ وَاللهُ أَعْلَمُ
أَنْ يَلْحَقَ أَهْلُهَا بِالْعَدُوِّ
[Machine] That they should not impose a punishment on any of the Muslims in enemy territory until they leave for the territory of reconciliation. Al-Shafi'i said: It has been narrated from Umar ibn al-Khattab, and this is disapproved, as he criticized the use of an unconfirmed hadith and said, "Tell us the name of the sheikh." He also said, "Makhul narrated from Zaid ibn Thabit, but Makhul did not see Zaid ibn Thabit." Al-Shafi'i said: His saying "Accompanying the polytheists" means that if one follows them, then it is worse for him. And whoever abandons the punishment out of fear that the limited punishment will enter the land of the polytheists, then he should leave it on the coasts of the Muslims along with their weapons, which are connected to the land of the enemy.
أَنْ لَا يُقِيمُوا حَدًّا عَلَى أَحَدٍ مِنَ الْمُسْلِمِينَ فِي أَرْضِ الْحَرْبِ حَتَّى يَخْرُجُوا إِلَى أَرْضِ الْمُصَالَحَةِ قَالَ الشَّافِعِيُّ مَا رُوِيَ عَنْ عُمَرَ بْنِ الْخَطَّابِ ؓ مُسْتَنْكَرٌ وَهُوَ يَعِيبُ أَنْ يُحْتَجَّ بِحَدِيثٍ غَيْرِ ثَابِتٍ وَيَقُولُ حَدَّثَنَا شَيْخٌ وَمَنْ هَذَا الشَّيْخُ؟ وَيَقُولُ مَكْحُولٌ عَنْ زَيْدِ بْنِ ثَابِتٍ وَمَكْحُولٌ لَمْ يَرَ زَيْدَ بْنَ ثَابِتٍ قَالَ الشَّافِعِيُّ وَقَوْلُهُ يَلْحَقُ بِالْمُشْرِكِينَ فَإِنْ لَحِقَ بِهِمْ فَهُوَ أَشْقَى لَهُ وَمَنْ تَرَكَ الْحَدَّ خَوْفَ أَنْ يَلْحَقَ الْمَحْدُودُ بِبِلَادِ الْمُشْرِكِينَ تَرَكَهُ فِي سَوَاحِلِ الْمُسْلِمِينَ وَمَسَالِحِهِمُ الَّتِي تَتَّصِلُ بِبِلَادِ الْحَرْبِ
[Machine] "Those who believe and do righteous deeds will have no blame upon them for whatever they have eaten [in the past] if they [now] fear Allah and believe and do righteous deeds" [Al-Maida 93]. Abu Ubaydah wrote to Umar, by their order, and said, "Abd bin Al-Azwar has informed us that our enemy has arrived. If you think it is best to delay us until we meet our enemy tomorrow, then Allah has honored us with martyrdom, and it would be sufficient for you. But if we return, look into the matter that your companion had ordered, and I will fulfill it." Abu Ubaydah said, "Excellent!" When the people met, Abd bin Al-Azwar was killed as a martyr. The letter was returned, Umar's letter to Abu Ubaydah, that what was imposed on Abu Jandal in terms of punishment had been justified by evidence. And when my letter comes to you, execute their punishment and peace be upon you." So Abu Ubaydah called them, and he executed their punishment, and Abu Jandal had a high rank, and his father also did. He used to talk to himself until it was said that he was influenced by whispers. Abu Ubaydah wrote to Umar, "After that, I have punished Abu Jandal, and he has been talking to himself to the extent that we feared for his life." Umar wrote to Abu Jandal, "What has caused you to commit this sin, repentance has been stored for you. In the name of Allah, the Most Gracious, the Most Merciful. "Ha, Meem. The revelation of the Book is from Allah, the Exalted in Might, the Knowing. The One who forgives sin, accepts repentance, severe in punishment, owner of abundance. There is no deity except Him; to Him is the destination." [Ghafir 2]. When Umar read the letter, what was with him disappeared, as if he had been released from shackles.
{لَيْسَ عَلَى الَّذِينَ آمَنُوا وَعَمِلُوا الصَّالِحَاتِ جُنَاحٌ فِيمَا طَعِمُوا إِذَا مَا اتَّقَوْا وَآمَنُوا وَعَمِلُوا الصَّالِحَاتِ} [المائدة 93] فَكَتَبَ أَبُو عُبَيْدَةَ إِلَى عُمَرَ ؓ بِأَمْرِهِمْ فَقَالَ عَبْدُ بْنُ الْأَزْوَرِ إِنَّهُ قَدْ حَضَرَ لَنَا عَدُوُّنَا فَإِنْ رَأَيْتَ أَنْ تُؤَخِّرَنَا إِلَى أَنْ نَلْقَى عَدُوَّنَا غَدًا فَإِنِ اللهُ أَكْرَمَنَا بِالشَّهَادَةِ كَفَاكَ ذَاكَ وَلَمْ تُقِمْنَا عَلَى خَزَايَةٍ وَإِنْ نَرْجِعْ نَظَرْتَ إِلَى مَا أَمَرَكَ بِهِ صَاحِبُكَ فَأَمْضَيْتَهُ قَالَ أَبُو عُبَيْدَةَ ؓ فَنَعَمْ فَلَمَّا الْتَقَى النَّاسُ قُتِلَ عَبْدُ بْنُ الْأَزْوَرِ شَهِيدًا فَرَجَعَ الْكِتَابُ كِتَابُ عُمَرَ ؓ أَنَّ الَّذِي أَوْقَعَ أَبَا جَنْدَلٍ فِي الْخَطِيئَةِ قَدْ تَهَيَّأَ لَهُ فِيهَا بِالْحُجَّةِ وَإِذَا أَتَاكَ كِتَابِي هَذَا فَأَقِمْ عَلَيْهِمْ حَدَّهُمْ وَالسَّلَامُ فَدَعَاهُمَا أَبُو عُبَيْدَةُ ؓ فَحَدَّهُمَا وَأَبُو جَنْدَلٍ لَهُ شَرَفٌ وَلِأَبِيهِ فَكَانَ يُحَدِّثُ نَفْسَهُ حَتَّى قِيلَ إِنَّهُ قَدْ وُسْوِسَ فَكَتَبَ أَبُو عُبَيْدَةَ إِلَى عُمَرَ ؓ أَمَّا بَعْدُ فَإِنِّي قَدْ ضَرَبْتُ أَبَا جَنْدَلٍ حَدَّهُ وَإِنَّهُ قَدْ حَدَّثَ نَفْسَهُ حَتَّى قَدْ خَشِينَا عَلَيْهِ أَنَّهُ قَدْ هَلَكَ فَكَتَبَ عُمَرُ ؓ إِلَى أَبِي جَنْدَلٍ أَمَّا بَعْدُ فَإِنَّ الَّذِي أَوْقَعَكَ فِي الْخَطِيئَةِ قَدْ خَزَنَ عَلَيْكَ التَّوْبَةَ بِسْمِ اللهِ الرَّحْمَنِ الرَّحِيمِ {حم تَنْزِيلُ الْكِتَابِ مِنَ اللهِ الْعَزِيزِ الْعَلِيمِ غَافِرِ الذَّنْبِ وَقَابِلِ التَّوْبِ شَدِيدِ الْعِقَابِ ذِي الطَّوْلِ لَا إِلَهَ إِلَّا هُوَ إِلَيْهِ الْمَصِيرُ} [غافر 2] فَلَمَّا قَرَأَ كِتَابَ عُمَرَ ؓ ذَهَبَ عَنْهُ مَا كَانَ بِهِ كَأَنَّمَا أُنْشِطَ مِنْ عِقَالٍ
[Machine] Because Allah says, "And whoever Allah wants to put in hardship, you will never possess any power to soften it for him." [Quran 5:41]
لَأَنَّ اللهَ ﷻ يَقُولُ {وَمَنْ يُرِدِ اللهُ فِتْنَتَهُ فَلَنْ تَمْلِكَ لَهُ مِنَ اللهِ شَيْئًا} [المائدة 41]
