58. Expeditions
٥٨۔ كِتَابُ السِّيَرِ
[Machine] That a man named Yazid ibn Abdullah ibn Zam'ah came on the Day of Harrah to kill himself, so he divorced his wife and did not consummate the marriage. They asked the people of knowledge, and they said she is entitled to half of the dowry, but she does not inherit from him.
أَنَّ مُسْرِفًا قَدَّمَ يَزِيدَ بْنَ عَبْدِ اللهِ بْنِ زَمْعَةَ يَوْمَ الْحَرَّةِ لِيَضْرِبَ عُنُقَهُ فَطَلَّقَ امْرَأَتَهُ وَلَمْ يَدْخُلْ بِهَا فَسَأَلُوا أَهْلَ الْعِلْمِ فَقَالُوا لَهَا نِصْفُ الصَّدَاقِ وَلَا مِيرَاثَ لَهَا
[Machine] That the majority of the charity of Zubayr, he would donate it and do good actions while he was on the back of his horse on the day of the Battle of the Camel. Al-Shafi'i said, and it was narrated from Umar ibn Abdul Aziz and Ibn Musayyib that they said: If a man fights while on the back of his horse, whatever he does is permissible. And it was narrated from Umar ibn Abdul Aziz that the charity of Hubla is permissible until she sits between the ropes. Al-Qasim ibn Muhammad and Ibn Musayyib said: The charity of the pregnant woman is permissible. Al-Shafi'i said: With all of this, we say that the hadith of Zubayr has been narrated in the book of Al-Wasaya in its entirety.
أَنَّ عَامَّةَ صَدَقَاتِ الزُّبَيْرِ ؓ تَصَدَّقَ بِهَا وَفَعَلَ أُمُورًا وَهُوَ وَاقِفٌ عَلَى ظَهْرِ فَرَسِهِ يَوْمَ الْجَمَلِ قَالَ الشَّافِعِيُّ ؓ وَرُوِيَ عَنْ عُمَرَ بْنِ عَبْدِ الْعَزِيزِ رَحِمَهُ اللهُ وَابْنِ الْمُسَيِّبِ رَحِمَهُ اللهُ أَنَّهُمَا قَالَا إِذَا كَانَ الرَّجُلُ عَلَى ظَهْرِ فَرَسِهِ يُقَاتِلُ فَمَا صَنَعَ فَهُوَ جَائِزٌ وَرُوِي عَنْ عُمَرَ بْنِ عَبْدِ الْعَزِيزِ رَحِمَهُ اللهُ عَطِيَّةُ الْحُبْلَى جَائِزَةٌ حَتَّى تَجْلِسَ بَيْنَ الْقَوَابِلِ وَقَالَ الْقَاسِمُ بْنُ مُحَمَّدٍ وَابْنُ الْمُسَيِّبِ عَطِيَّةُ الْحَامِلِ جَائِزَةٌ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ وَبِهَذَا كُلِّهِ نَقُولُ قَالَ الشَّيْخُ حَدِيثُ الزُّبَيْرِ ؓ قَدْ رَوَيْنَاهُ فِي كِتَابِ الْوَصَايَا بِطُولِهِ
