58.61 [Machine] Preventing the Burning of Polytheists with Fire after Isha Prayer

٥٨۔٦١ بَابُ الْمَنْعِ مِنْ إِحْرَاقِ الْمُشْرِكِينَ بِالنَّارِ بَعْدَ الْإِسَارِ

[Machine] "If I were they, I would not have burned them, because of the saying of the Messenger of Allah ﷺ : 'Do not punish people with the punishment of Allah.' And I would have killed them, because of the saying of the Messenger of Allah ﷺ : 'Whoever changes his religion, then kill him.' Ammar said: 'He did not burn them, but he dug trenches for them and connected them to each other, then he kindled fires over them until they died.' Amr said: 'The poet said: 'Throw at me wherever you want, if you don't throw at me in the two trenches when they kindle the fire there, then death is certain, except for the religion.'"

البيهقي:١٨٠٦٢أَخْبَرَنَا أَبُو عَمْرٍو مُحَمَّدُ بْنُ عَبْدِ اللهِ الْبِسْطَامِيُّ أنبأ أَبُو بَكْرٍ الْإِسْمَاعِيلِيُّ ثنا إِبْرَاهِيمُ بْنُ هَاشِمٍ الْبَغَوِيُّ ثنا مُحَمَّدُ بْنُ عَبَّادٍ ثنا سُفْيَانُ قَالَ رَأَيْتُ عَمْرَو بْنَ دِينَارٍ وَأَيُّوبَ وَعَمَّارًا الدُّهْنِيَّ اجْتَمَعُوا فَتَذَاكَرُوا الَّذِينَ حَرَقَهُمْ عَلِيٌّ ؓ فَحَدَّثَ أَيُّوبُ عَنْ عِكْرِمَةَ عَنِ ابْنِ عَبَّاسٍ ؓ أَنَّهُ بَلَغَهُ قَالَ

لَوْ كُنْتُ أَنَا مَا حَرَقْتُهُمْ؛ لِقَوْلِ رَسُولِ اللهِ ﷺ لَا تُعَذِّبُوا بِعَذَابِ اللهِ وَلَقَتَلْتُهُمْ لِقَوْلِ رَسُولِ اللهِ ﷺ مَنْ بَدَّلَ دِينَهُ فَاقْتُلُوهُ فَقَالَ عَمَّارٌ لَمْ يَحْرِقْهُمْ وَلَكِنْ حَفَرَ لَهُمْ حَفَائِرَ وَخَرَقَ بَعْضَهَا إِلَى بَعْضٍ ثُمَّ دَخَّنَ عَلَيْهِمْ حَتَّى مَاتُوا فَقَالَ عَمْرٌو قَالَ الشَّاعِرُ [البحر الوافر] لِتَرْمِ بِيَ الْمَنَايَا حَيْثُ شَاءَتْ إِذَا لَمْ تَرْمِ بِي فِي الْحُفْرَتَيْنِ إِذَا مَا أَجَّجُوا حَطَبًا وَنَارًا هُنَاكَ الْمَوْتُ نَقْدًا غَيْرَ دَيْنِ

[Machine] Bukayr informed me that Abu Amr Al-Adibi reported to me from Abu Bakr Al-Isma'iliy who informed me that Al-Hasan ibn Sufyan narrated that Qutaybah ibn Saeed narrated from Al-Laith who narrated from Bukayr who narrated from Sulaiman ibn Yassar who narrated from Abu Hurayrah that he said: The Messenger of Allah ﷺ sent us on a mission and said, "If you find so-and-so and so-and-so, two men from Quraysh, then burn them with fire." Then the Messenger of Allah ﷺ said, when we were about to depart, "I had commanded you to burn so-and-so and so-and-so with fire, and verily, only Allah punishes with the Fire. So, if you find them, then kill them, for their word is the same."  

البيهقي:١٨٠٦٣أَخْبَرَنَا أَبُو الْقَاسِمِ عَلِيُّ بْنُ مُحَمَّدٍ الْإِيَادِيُّ بِبَغْدَادَ أنبأ أَحْمَدُ بْنُ يُوسُفَ النَّصِيبِيُّ ثنا الْحَارِثُ بْنُ أَبِي أُسَامَةَ ثنا أَبُو النَّضْرِ ثنا اللَّيْثُ

حَدَّثَنِي بُكَيْرٌ ح وَأنبأ أَبُو عَمْرٍو الْأَدِيبُ أنبأ أَبُو بَكْرٍ الْإِسْمَاعِيلِيُّ أَخْبَرَنِي الْحَسَنُ بْنُ سُفْيَانَ ثنا قُتَيْبَةُ بْنُ سَعِيدٍ ثنا اللَّيْثُ عَنْ بُكَيْرٍ عَنْ سُلَيْمَانَ بْنِ يَسَارٍ عَنْ أَبِي هُرَيْرَةَ ؓ أَنَّهُ قَالَ بَعَثَنَا رَسُولُ اللهِ ﷺ فِي بَعْثٍ وَقَالَ إِنْ وَجَدْتُمْ فُلَانًا وَفُلَانًا لِرَجُلَيْنِ مِنْ قُرَيْشٍ فَاحْرِقُوهُمَا بِالنَّارِ ثُمَّ قَالَ رَسُولُ اللهِ ﷺ حِينَ أَرَدْنَا الْخُرُوجَ إِنِّي كُنْتُ أَمَرْتُكُمْ أَنْ تَحْرِقُوا فُلَانًا وَفُلَانًا بِالنَّارِ وَإِنَّ النَّارَ لَا يُعَذِّبُ بِهَا إِلَّا اللهُ فَإِنْ وَجَدْتُمُوهُمَا فَاقْتُلُوهُمَا لَفْظُهُمَا سَوَاءٌ

[Machine] The Messenger of Allah ﷺ sent a man and said, "If you find so and so or so and so, then burn them with fire." When he returned, he called him and said, "No one punishes with fire except their Lord." And it was narrated by Mooghira ibn Abdulrahman from Abu Zinad.  

البيهقي:١٨٠٦٤أَخْبَرَنَا أَبُو الْحُسَيْنِ بْنُ بِشْرَانَ بِبَغْدَادَ ثنا أَبُو جَعْفَرٍ مُحَمَّدُ بْنُ عَمْرٍو الرَّزَّازُ ثنا يَحْيَى بْنُ جَعْفَرٍ أنبأ الضَّحَّاكُ بْنُ مَخْلَدٍ ثنا ابْنُ جُرَيْجٍ أَنَّ زِيَادَ بْنَ سَعْدٍ أَخْبَرَهُ أَنَّ أَبَا الزِّنَادِ أَخْبَرَهُ أَنَّ حَنْظَلَةَ بْنَ عَلِيٍّ أَخْبَرَهُ عَنْ حَمْزَةَ بْنِ عَمْرٍو الْأَسْلَمِيِّ

أَنَّ رَسُولَ اللهِ ﷺ بَعَثَ رَجُلًا فَقَالَ إِنْ أَصَبْتَ فُلَانًا أَوْ فُلَانًا فَأَحْرِقُوهُ بِالنَّارِ فَلَمَّا وَلَّى دَعَاهُ فَقَالَ إِنَّهُ لَا يُعَذِّبُ بِالنَّارِ إِلَّا رَبُّهَا وَرَوَاهُ مُغِيرَةُ بْنُ عَبْدِ الرَّحْمَنِ عَنْ أَبِي الزِّنَادِ

[Machine] The Messenger of Allah ﷺ commanded him to lead a military expedition, so he went out with it. He said, "If you find so-and-so, then burn him with fire." So he (the narrator) turned around, but then he (the Messenger) called him back. He said, "If you find so-and-so, then kill him, but do not burn him, for only the Lord of the Fire punishes with fire." As for the hadith of Usamah ibn Zaid, where the Messenger of Allah ﷺ commanded him to set fire to the enemy's children, it is not inconsistent with what we have said, as it only pertains to fighting against the polytheists who were unyielding. And as for what has been narrated regarding the use of siege engines against the people of Ta'if, it is not contrary to what we have stated, as it only applies to fighting against the polytheists who were resistant. Ash-Shafi'i, may Allah have mercy on him, likened it to hunting, as long as they are resisting. Then there is a prohibition against throwing a chicken, which is not resistant. And with Allah is the success.  

البيهقي:١٨٠٦٥كَمَا أَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنبأ مُحَمَّدُ بْنُ بَكْرٍ ثنا أَبُو دَاوُدَ ثنا سَعِيدُ بْنُ مَنْصُورٍ ثنا مُغِيرَةُ بْنُ عَبْدِ الرَّحْمَنِ الْحِزَامِيُّ عَنْ أَبِي الزِّنَادِ قَالَ وَحَدَّثَنِي مُحَمَّدُ بْنُ حَمْزَةَ الْأَسْلَمِيُّ عَنْ أَبِيهِ

أَنَّ رَسُولَ اللهِ ﷺ أَمَّرَهُ عَلَى سَرِيَّةٍ قَالَ فَخَرَجْتُ فِيهَا وَقَالَ إِنْ وَجَدْتُمْ فُلَانًا فَأَحْرِقُوهُ بِالنَّارِ فَوَلَّيْتُ فَنَادَانِي فَرَجَعْتُ إِلَيْهِ فَقَالَ إِنْ وَجَدْتُمْ فُلَانًا فَاقْتُلُوهُ وَلَا تَحْرِقُوهُ؛ فَإِنَّهُ لَا يُعَذِّبُ بِالنَّارِ إِلَّا رَبُّ النَّارِ وَأَمَّا حَدِيثُ أُسَامَةَ بْنِ زَيْدٍ حَيْثُ أَمَرَهُ رَسُولُ اللهِ ﷺ أَنْ يَحْرِقَ عَلَى أُبْنَى وَمَا رُوِيَ فِي نَصْبِ الْمَنْجَنِيقِ عَلَى الطَّائِفِ فَغَيْرُ مُخَالِفٍ لِمَا قُلْنَا إِنَّمَا هُوَ فِي قِتَالِ الْمُشْرِكِينَ مَا كَانُوا مُمْتَنِعِينَ وَمَا رُوِيَ مِنَ النَّهْيِ فِي الْمُشْرِكِينَ إِذَا كَانُوا مَأْسُورِينَ وَشَبَّهَهُ الشَّافِعِيُّ رَحِمَهُ اللهُ بِرَمْيِ الصَّيْدِ مَا دَامَ عَلَى الِامْتِنَاعِ ثُمَّ النَّهْيِ عَنْ رَمْيِ الدَّجَاجَةِ الَّتِي لَيْسَتْ بِمُمْتَنِعَةٍ وَبِاللهِ التَّوْفِيقُ
