58.53 [Machine] Prohibition of food plunder.

٥٨۔٥٣ بَابُ النَّهْيِ عَنْ نَهْبِ الطَّعَامِ

[Machine] We were with the Messenger of Allah ﷺ in Thul-Hulayfah when the people were struck with hunger. So we obtained camels and sheep. The Messenger of Allah ﷺ was among the last ones, so the people hurried, slaughtered, and set up the cooking pots. The Messenger of Allah ﷺ sent for the pots and they were brought to him. He ordered them to be filled and then he distributed them, giving one camel's portion to a group of ten people.  

البيهقي:١٨٠٠٩أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أَخْبَرَنِي أَبُو عَلِيٍّ الْحُسَيْنُ بْنُ عَلِيٍّ الْحَافِظُ أنبأ أَبُو خَلِيفَةَ ثنا مُسَدَّدٌ ثنا أَبُو عَوَانَةَ عَنْ سَعِيدِ بْنِ مَسْرُوقٍ عَنْ عَبَايَةَ بْنِ رِفَاعَةَ بْنِ رَافِعِ بْنِ خَدِيجٍ عَنْ جَدِّهِ رَافِعِ بْنِ خَدِيجٍ ؓ قَالَ

كُنَّا مَعَ رَسُولِ اللهِ ﷺ بِذِي الْحُلَيْفَةِ فَأَصَابَ النَّاسَ جُوعٌ فَأَصَبْنَا إِبِلًا وَغَنَمًا وَكَانَ رَسُولُ اللهِ ﷺ فِي أُخْرَيَاتِ النَّاسِ فَعَجِلُوا وَذَبَحُوا وَنَصَبُوا الْقُدُورَ فَدَفَعَ إِلَيْهِمْ رَسُولُ اللهِ ﷺ فَأَمَرَ بِالْقُدُورِ فَأُكْفِئَتْ ثُمَّ قَسَمَ فَعَدَلَ عَشْرًا مِنَ الْغَنَمِ بِبَعِيرٍ

Kulayb reported from a man of the Ansar. He said: We went out with the Messenger of Allah ﷺ on a journey. The people suffered from intense need and strain. They gained booty and then plundered it. While our pots were boiling the Messenger of Allah ﷺ came walking with his bow touching the ground. He turned over our pots with his bow and smeared the meat with the soil, and said: "Plunder is more unlawful than carrion," or he said: "Carrion is more unlawful than plunder." The narrator Hannad was doubtful. (Using translation from Abū Dāʾūd 2705)   

البيهقي:١٨٠١٠وَأَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنبأ مُحَمَّدُ بْنُ بَكْرٍ ثنا أَبُو دَاوُدَ ثنا هَنَّادُ بْنُ السَّرِيِّ ثنا أَبُو الْأَحْوَصِ عَنْ عَاصِمِ بْنِ كُلَيْبٍ عَنْ أَبِيهِ عَنْ رَجُلٍ مِنَ الْأَنْصَارِ قَالَ

خَرَجْنَا مَعَ رَسُولِ اللهِ ﷺ فِي سَفَرٍ فَأَصَابَ النَّاسَ حَاجَةٌ شَدِيدَةٌ وَجَهْدٌ فَأَصَابُوا غَنَمًا فَانْتَهَبُوهَا وَإِنَّ قُدُورَنَا لَتَغْلِي إِذْ جَاءَ رَسُولُ اللهِ ﷺ يَمْشِي عَلَى فَرَسِهِ فَأَكْفَأَ قُدُورَنَا بِقَوْسِهِ ثُمَّ جَعَلَ يُرَمِّلُ اللَّحْمَ بِالتُّرَابِ ثُمَّ قَالَ إِنَّ النُّهْبَةَ لَيْسَ بِأَحَلَّ مِنَ الْمَيْتَةِ أَوْ إِنَّ الْمَيْتَةَ لَيْسَتْ بِأَحَلَّ مِنَ النُّهْبَةِ الشَّكُّ مِنْ هَنَّادٍ
