١٣۔ كِتَابُ الْبُيُوعِ ص ٦
[Machine] The Messenger of Allah ﷺ said, "Whoever buys food should not sell it until he has taken possession of it." Abu al-Hasan Ali ibn Muhammad al-Muqri informed us, I am al-Hasan ibn Muhammad ibn Ishaq, Yusuf ibn Ya'qub narrated to us, Abu al-Rabi' narrated to us, Ismail ibn Ja'far narrated from Abdullah ibn Dinar, and he mentioned it in a similar way.
قَالَ رَسُولُ اللهِ ﷺ مَنِ ابْتَاعَ طَعَامًا فَلَا يَبِعْهُ حَتَّى يَقْبِضَهُ 10674 وَأَخْبَرَنَا أَبُو الْحَسَنِ عَلِيُّ بْنُ مُحَمَّدٍ الْمُقْرِئُ أنا الْحَسَنُ بْنُ مُحَمَّدِ بْنِ إِسْحَاقَ ثنا يُوسُفُ بْنُ يَعْقُوبَ ثنا أَبُو الرَّبِيعِ ثنا إِسْمَاعِيلُ بْنُ جَعْفَرٍ عَنْ عَبْدِ اللهِ بْنِ دِينَارٍ فَذَكَرَهُ بِنَحْوِهِ
[Machine] The Messenger of Allah ﷺ forbade a man from selling food unless he has fully received it. Tawus said, "I said to Ibn Abbas, 'How is that?' He replied, 'That means exchanging dirhams for dirhams, and the food is deferred.'"
أَنَّ رَسُولَ اللهِ ﷺ نَهَى أَنْ يَبِيعَ الرَّجُلُ طَعَامًا حَتَّى يَسْتَوْفِيَهُ قَالَ طَاوُسٌ فَقُلْتُ لِابْنِ عَبَّاسٍ فَكَيْفَ ذَلِكَ؟ قَالَ ذَلِكَ دَرَاهِمُ بِدَرَاهِمَ وَالطَّعَامُ مُرْجَأٌ
The Messenger of Allah ﷺsaid: “Whoever buys foodstuff should not sell it until he takes possession of all of it.” (Using translation from Aḥmad 396)
قَالَ رَسُولُ اللهِ ﷺ مَنِ ابْتَاعَ طَعَامًا فَلَا يَبِعْهُ حَتَّى يَسْتَوْفِيَهُ
When you purchase foodgrains, do not sell them until you have taken possession of them. (Using translation from Muslim 1529)
أَنَّهُ سَمِعَ جَابِرَ بْنَ عَبْدِ اللهِ يَقُولُ كَانَ رَسُولُ اللهِ ﷺ يَقُولُ إِذَا ابْتَعْتَ طَعَامًا فَلَا تَبِعْهُ حَتَّى تَسْتَوْفِيَهُ
[Machine] "That the Prophet ﷺ said to him, 'Did I not inform you? Did I not tell you? Did it not reach me?' or as Allah wills, that you sell food?' I said, 'Yes.' He said, 'If you buy food, do not sell it until you have measured it.'"
أَنَّ النَّبِيَّ ﷺ قَالَ لَهُ أَلَمْ أُنَبَّأْ أَوْ أَلَمْ أُخْبَرْ أَوْ أَلَمْ يَبْلُغْنِي أَوْ كَمَا شَاءَ اللهُ أَنَّكَ تَبِيعُ الطَّعَامَ؟ قُلْتُ بَلَى قَالَ إِذَا ابْتَعْتَ طَعَامًا فَلَا تَبِعْهُ حَتَّى تَسْتَوْفِيَهُ مَعْنَاهُمَا وَاحِدٌ
[Machine] He said, "When you buy food, do not consume it until you receive it."
وَقَالَ إِذَا ابْتَعْتَ طَعَامًا فَلَا تَبِعْهُ حَتَّى تَقْبِضَهُ
13.50 [Machine] The prohibition of selling what has not been received, even if it is not food.
١٣۔٥٠ بَابُ النَّهْيِ عَنْ بَيْعِ مَا لَمْ يُقْبَضْ , وَإِنْ كَانَ غَيْرَ طَعَامٍ
[Machine] I heard Ibn Abbas say, "As for what the Messenger of Allah ﷺ prohibited, it is that food should not be sold until it is received." Ibn Abbas said, "And I do not consider anything unless its wording is similar to that of the hadith of Ali."
سَمِعْتُ ابْنَ عَبَّاسٍ يَقُولُ أَمَّا الَّذِي نَهَى عَنْهُ رَسُولُ اللهِ ﷺ فَهُوَ الطَّعَامُ أَنْ يُبَاعَ حَتَّى يُقْبَضَ قَالَ ابْنُ عَبَّاسٍ وَلَا أَحْسَبُ كُلَّ شَيْءٍ إِلَّا مِثْلَهُ لَفْظُ حَدِيثِ عَلِيٍّ
[Machine] The Prophet ﷺ reprimanded Attab ibn Asid in Mecca and said: "Verily, I have commanded you to adhere to the rights of Allah and none of them should eat from others' income unless it is guaranteed, and I forbid you from usury and selling two commodities for one in a single transaction, and from selling what you do not possess."
اسْتَعْمَلَ النَّبِيُّ ﷺ عَتَّابَ بْنَ أَسِيدٍ عَلَى مَكَّةَ فَقَالَ إِنِّي قَدْ أَمَّرْتُكَ عَلَى أَهْلِ اللهِ ﷻ بِتَقْوَى اللهِ ﷻ وَلَا يَأْكُلْ أَحَدٌ مِنْهُمْ مِنْ رِبْحِ مَا لَمْ يُضْمَنْ وَانْهَهُمْ عَنْ سَلَفٍ وَبَيْعٍ وَعَنِ الصَّفَقْتَيْنِ فِي الْبَيْعِ الْوَاحِدِ وَأَنْ يَبِيعَ أَحَدُهُمْ مَا لَيْسَ عِنْدَهُ
[Machine] The Messenger of Allah ﷺ said to 'Attab ibn Asid: "I have sent you to the people of Allah and the people of Mecca, so forbid them from selling what they do not possess or dealing in profits they have not guaranteed, and from lending on interest, and from engaging in double contracts in sales, and from buying and selling with deferred payment that is unique to Yahya ibn Salih Al-Aili, which is considered rejected by this narration."
قَالَ رَسُولُ اللهِ ﷺ لِعَتَّابِ بْنِ أَسِيدٍ إِنِّي قَدْ بَعَثْتُكَ إِلَى أَهْلِ اللهِ وَأَهْلُ مَكَّةَ فَانْهَهُمْ عَنْ بَيْعِ مَا لَمْ يَقْبِضُوا أَوْ رِبْحِ مَا لَمْ يَضْمَنُوا وَعَنْ قَرْضٍ وَبَيْعٍ وَعَنْ شَرْطَيْنِ فِي بَيْعٍ وَعَنْ بَيْعٍ وَسَلَفٍ تَفَرَّدَ بِهِ يَحْيَى بْنُ صَالِحٍ الْأَيْلِيُّ وَهُوَ مُنْكَرٌ بِهَذَا الْإِسْنَادِ
"The Messenger of Allah forbade lending on the condition of a sale, selling what you do not have, and profiting on what you do not possess. (Using translation from Nasāʾī 4631)
أَنَّ النَّبِيَّ ﷺ بَعَثَ عَتَّابَ بْنَ أَسِيدٍ فَنَهَاهُ عَنْ شَرْطَيْنِ فِي بَيْعٍ وَعَنْ سَلَفٍ وَبَيْعٍ وَعَنْ بَيْعِ مَا لَيْسَ عِنْدَكَ وَعَنْ رِبْحِ مَا لَمْ تَضْمَنْ
[Machine] He said, "I said, 'O Messenger of Allah, I am a man who engages in buying and selling. What is permissible and what is prohibited in it?' He said, 'O son of my brother, when you buy something, do not sell it until you have received it.' This narration was not heard by Yahya ibn Abi Kathir from Yusuf, but rather he heard it from Ya'la ibn Hakim who heard it from Yusuf."
قَالَ قُلْتُ يَا رَسُولَ اللهِ إِنِّي رَجُلٌ أَشْتَرِي بُيُوعًا فَمَا يَحِلُّ مِنْهَا وَمَا يَحْرُمُ؟ قَالَ يَا ابْنَ أَخِي إِذَا اشْتَرَيْتَ بَيْعًا فَلَا تَبِعْهُ حَتَّى تَقْبِضَهُ لَمْ يَسْمَعْهُ يَحْيَى بْنُ أَبِي كَثِيرٍ مِنْ يُوسُفَ إِنَّمَا سَمِعَهُ مِنْ يَعْلَى بْنِ حَكِيمٍ عَنْ يُوسُفَ
[Machine] I said, "O Messenger of Allah, I engage in these sales, so what is permissible for me and what is prohibited for me?" He said, "O nephew, do not sell anything until you receive it. This is a good continuous chain of narration." And likewise...
قُلْتُ يَا رَسُولَ اللهِ إِنِّي أَبْتَاعُ هَذِهِ الْبُيُوعَ فَمَا يَحِلُّ لِي مِنْهَا وَمَا يَحْرُمُ عَلَيَّ؟ قَالَ يَا ابْنَ أَخِي لَا تَبِيعَنَّ شَيْئًا حَتَّى تَقْبِضَهُ هَذَا إِسْنَادٌ حَسَنٌ مُتَّصِلٌ وَكَذَلِكَ
13.51 [Machine] Acquire What He Bought with a Great Deal.
١٣۔٥١ بَابُ قَبْضِ مَا ابْتَاعَهُ كَيْلًا بِالِاكْتِيَالِ
[Machine] On the authority of the Messenger of Allah ﷺ , he said: "Whoever buys food should not sell it until he measures it." So, I asked Ibn Abbas, why? He said: "Don't you see them trading gold while food is in abundance?"
عَنْ رَسُولِ اللهِ ﷺ قَالَ مَنِ ابْتَاعَ طَعَامًا فَلَا يَبِعْهُ حَتَّى يَكْتَالَهُ فَقُلْتُ لِابْنِ عَبَّاسٍ لِمَ؟ قَالَ أَلَا تَرَاهُمْ يَتَبَايَعُونَ الذَّهَبَ وَالطَّعَامُ مُرْجَأٌ؟
The Messenger of Allah ﷺ forbade to sell grain which one buys by measurement until one receives it in full. (Using translation from Abū Dāʾūd 3495)
أَنَّ رَسُولَ اللهِ ﷺ نَهَى أَنْ يَبِيعَ أَحَدٌ طَعَامًا اشْتَرَاهُ بِكَيْلٍ حَتَّى يَسْتَوْفِيَهُ
13.52 [Machine] The seizure of anything acquired excessively by transportation and transfer if its equivalent can be transported.
١٣۔٥٢ بَابُ قَبْضِ مَا ابْتَاعَهُ جُزَافًا بِالنَّقْلِ , وَالتَّحْوِيلِ إِذَا كَانَ مِثْلُهُ يُنْقَلُ
During the time of Messenger of Allah ﷺ we used to buy grain, and he sent a man to us who ordered us to move it from the spot where we had bought it to some other place, before we sold it without weighing or measuring it. (Using translation from Abū Dāʾūd 3493)
كُنَّا فِي زَمَانِ رَسُولِ اللهِ ﷺ نَبْتَاعُ الطَّعَامَ فَيَبْعَثُ عَلَيْنَا مَنْ يَأْمُرُنَا بِانْتِقَالِهِ مِنَ الْمَكَانِ الَّذِي ابْتَعْنَاهُ إِلَى مَكَانٍ سِوَاهُ قَبْلَ أَنْ نَبِيعَهُ
[Machine] The Messenger of Allah ﷺ said, "Whoever purchases food should not sell it until he receives it." He said, "We used to buy food from the caravans and the Prophet ﷺ prohibited us from selling it until we transported it from its place."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنِ اشْتَرَى طَعَامًا فَلَا يَبِعْهُ حَتَّى يَسْتَوْفِيَهُ قَالَ وَكُنَّا نَشْتَرِي الطَّعَامَ مِنَ الرُّكْبَانِ جُزَافًا فَنَهَانَا رَسُولُ اللهِ ﷺ أَنْ نَبِيعَهُ حَتَّى نَنْقُلَهُ مِنْ مَكَانِهِ
[Machine] I saw people in the time of the Messenger of Allah ﷺ when they exchanged food, they would strike a deal to sell their places until they found shelter in their tents.
رَأَيْتُ النَّاسَ فِي عَهْدِ رَسُولِ اللهِ ﷺ إِذَا تَبَايَعُوا الطَّعَامَ جُزَافًا يُضْرَبُونَ فِي أَنْ يَبِيعُوا مَكَانَهُمْ حَتَّى يُؤْوُوهُ إِلَى رِحَالِهِمْ
I bought olive oil in the market. When I became its owner, a man met me and offered good profit for it. I intended to settle the bargain with him, but a man caught hold of my hand from behind. When I turned I found that he was Zayd ibn Thabit. He said: Do not sell it on the spot where you have bought it until you take it to your house, for the Messenger of Allah ﷺ forbade to sell the goods where they are bought until the tradesmen take them to their houses. ابْتَعْتُ زَيْتًا فِي السُّوقِ فَلَمَّا اسْتَوْفَيْتُ لَقِيَنِي رَجُلٌ فَأَعْطَانِي رِبْحًا حَسَنًا فَأَرَدْتُ أَنْ أَضْرِبَ عَلَى يَدِهِ فَأَخَذَ رَجُلٌ بِرِدَائِي مِنْ خَلْفِي فَالْتَفَتُّ إِلَيْهِ فَإِذَا زَيْدُ بْنُ ثَابِتٍ فَقَالَ لَا تَبِعْهُ حَيْثُ ابْتَعْتَهُ حَتَّى تَحُوزَهُ إِلَى رَحْلِكَ؛ فَإِنَّ رَسُولَ اللهِ ﷺ نَهَى أَنْ تُبَاعَ السِّلْعَةُ حَيْثُ تَبْتَاعُ حَتَّى يَحُوزَهَا التُّجَّارُ إِلَى رِحَالِهِمْ
13.53 [Machine] Sale of the provisions extracted by the Sultan before taking hold of them.
١٣۔٥٣ بَابُ بَيْعِ الْأَرْزَاقِ الَّتِي يُخْرِجُهَا السُّلْطَانُ قَبْلَ قَبْضِهَا
[Machine] "He did not see any harm in selling provisions and he would say that the person who bought them cannot sell them until he receives them. The scholar said, and this is the intended meaning if Allah wills, based on what has been narrated about it from Umar."
أَنَّهُ لَمْ يَكُنْ يَرَى بَأْسًا بِبَيْعِ الرِّزْقِ وَيَقُولُ لَا يَبِيعُهُ الَّذِي اشْتَرَاهُ حَتَّى يَقْبِضَهُ قَالَ الشَّيْخُ وَهَذَا هُوَ الْمُرَادُ إِنْ شَاءَ اللهُ بِمَا رُوِيَ فِي ذَلِكَ عَنْ عُمَرَ ؓ
[Machine] "And he said, 'Do not consume the food you have bought until you have received it in full, for it is wise to do so.' He had purchased it from its owner, so he forbade him from selling it until he received it in full."
وَقَالَ لَا تَبِعْ طَعَامًا مَا ابْتَعْتَهُ حَتَّى تَسْتَوْفِيَهُ فَحَكِيمٌ كَانَ قَدِ اشْتَرَاهُ مِنْ صَاحِبِهِ فَنَهَاهُ عَنْ بَيْعِهِ حَتَّى يَسْتَوْفِيَهُ
13.54 [Machine] Compensation for the specified price in the agreement.
١٣۔٥٤ بَابُ أَخْذِ الْعِوَضِ عَنِ الثَّمَنِ الْمَوْصُوفِ فِي الذِّمَّةِ
I used to sell camels at al-Baqi for dinars and take dirhams for them, and sell for dirhams and take dinars for them. I would take these for these and give these for these. I went to the Messenger of Allah ﷺ who was in the house of Hafsah. I said: Messenger of Allah , take it easy, I shall ask you (a question): I sell camels at al-Baqi'. I sell (them) for dinars and take dirhams and I sell for dirhams and take dinars. I take these for these, and give these for these. The Messenger of Allah ﷺ then said: There is no harm in taking them at the current rate so long as you do not separate leaving something to be settled. (Using translation from Abū Dāʾūd 3354)
كُنْتُ أَبِيعُ الْإِبِلَ بِالْبَقِيعِ فَأَبِيعُ بِالدَّنَانِيرِ وَآخُذُ الدَّرَاهِمَ وَأَبِيعُ بِالدَّرَاهِمِ وَآخُذُ الدَّنَانِيرَ فَأَتَيْتُ رَسُولَ اللهِ ﷺ وَهُوَ يُرِيدُ أَنْ يَدْخُلَ بَيْتَ حَفْصَةَ فَقُلْتُ يَا رَسُولَ اللهِ إِنِّي أَبِيعُ الْإِبِلَ بِالْبَقِيعِ فَأَبِيعُ بِالدَّنَانِيرِ وَآخُذُ الدَّرَاهِمَ وَأَبِيعُ بِالدَّرَاهِمِ وَآخُذُ الدَّنَانِيرَ فَقَالَ رَسُولُ اللهِ ﷺ لَا بَأْسَ أَنْ تَأْخُذَهَا بِسِعْرِ يَوْمِهَا مَا لَمْ تَتَفَرَّقَا وَبَيْنَكُمَا شَيْءٌ
13.55 [Machine] The man buys food in bulk and does not sell it until he measures it for himself, and then he does not clear his debt until he measures it for his buyer. Al-Shafi'i said: And this is how Al-Hasan narrated it from the Prophet ﷺ , that he forbade selling food until it has been measured with two saa's, so it has its extra and its shortage. The scholar said: And this has been narrated connectedly from different angles, when some of it is added to another, which strengthens what has been mentioned in the established Hadith, from Ibn Umar and Ibn Abbas in this topic and others.
١٣۔٥٥ بَابُ الرَّجُلِ يَبْتَاعُ طَعَامًا كَيْلًا فَلَا يَبِيعُهُ حَتَّى يَكْتَالَهُ لِنَفْسِهِ , ثُمَّ لَا يَبْرَأُ حَتَّى يَكِيلَهُ عَلَى مُشْتَرِيهِ قَالَ الشَّافِعِيُّ: وَهَكَذَا رَوَاهُ الْحَسَنُ , عَنِ النَّبِيِّ ﷺ أَنَّهُ نَهَى عَنْ بَيْعِ الطَّعَامِ حَتَّى يَجْرِيَ فِيهِ الصَّاعَانِ فَيَكُونُ لَهُ زِيَادَتُهُ وَعَلَيْهِ نُقْصَانُهُ , قَالَ الشَّيْخُ: وَقَدْ رُوِيَ ذَلِكَ مَوْصُولًا مِنْ أَوْجُهٍ إِذَا ضُمَّ بَعْضُهَا إِلَى بَعْضٍ قَوِيَ مَعَ مَا سَبَقَ مِنَ الْحَدِيثِ الثَّابِتِ , عَنِ ابْنِ عُمَرَ وَابْنِ عَبَّاسٍ فِي هَذَا الْبَابِ وَغَيْرِهِمَا
[Machine] He heard Uthman ibn Affan saying on the pulpit, "I used to buy dates as a measure, then I bring them to Medina, carrying them myself along with my servant. This would be from a place near Medina, in the market of Qainqaa. I would make a profit of a sa' and two sa's. Then, I would measure my profit and distribute the remaining dates among them." The Messenger of Allah ﷺ was informed of this. Then, he asked Uthman, "Did you weigh the dates, O Uthman?" Uthman replied, "Yes, O Messenger of Allah." The Messenger of Allah ﷺ said, "When you buy, measure, and when you sell, weigh."
أَنَّهُ سَمِعَ عُثْمَانَ بْنَ عَفَّانَ ؓ يَقُولُ عَلَى الْمِنْبَرِ إِنِّي كُنْتُ أَشْتَرِي التَّمْرَ كَيْلًا فَأَقْدَمُ بِهِ إِلَى الْمَدِينَةِ أَحْمِلُهُ أَنَا وَغِلْمَانٌ وَذَلِكَ مِنْ مَكَانٍ قَرِيبٍ مِنَ الْمَدِينَةِ بِسُوقِ قَيْنُقَاعَ فَأَرْبَحُ الصَّاعَ وَالصَّاعَيْنِ فَأَكْتَالُ رِبْحِي ثُمَّ أُصُبُّ لَهُمْ مَا بَقِيَ مِنَ التَّمْرِ فَحُدِّثَ بِذَلِكَ رَسُولُ اللهِ ﷺ ثُمَّ إِنَّهُ سَأَلَ عُثْمَانَ ؓ قَالَ نَعَمْ يَا رَسُولَ اللهِ فَقَالَ رَسُولُ اللهِ ﷺ إِذَا اشْتَرَيْتَ يَا عُثْمَانُ فَاكْتَلْ وَإِذَا بِعْتَ فَكِلْ
[Machine] I used to buy fabric and take it to a certain marketplace, where they would take it from me and make a profit. I mentioned this to the Prophet ﷺ , and he said, "If you buy fabric by weight, then weigh it and if you sell fabric by weight, then measure it." This narration is from Munqidh, the slave of Suraqah, who narrated it from Uthman.
كُنْتُ أَشْتَرِي الْأَوْسَاقَ فَأَجِيءُ بِهَا إِلَى سُوقِ كَذَا فَيَأْخُذُونَهَا مِنِّي كَيْلًا وَيُرْبِحُونَنِي فَذَكَرْتُ ذَلِكَ لِلنَّبِيِّ ﷺ فَقَالَ إِذَا ابْتَعْتَ كَيْلًا فَاكْتَلْ وَإِذَا بِعْتَ كَيْلًا فَكِلْ وَرُوِي عَنْ مُنْقِذٍ مَوْلَى سُرَاقَةَ عَنْ عُثْمَانَ
[Machine] The Messenger of Allah ﷺ said to Uthman, "When you buy, weigh (the goods) and when you sell, give full measure." And it has also been narrated from other angles of the report that Uthman said this.
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لِعُثْمَانَ إِذَا ابْتَعْتَ فَاكْتَلْ وَإِذَا بِعْتَ فَكِلْ وَرُوِيَ مِنْ أَوْجُهٍ أُخَرَ مُرْسَلًا عَنْ عُثْمَانَ
[Machine] That Hakim ibn Hizam and Uthman ibn Affan used to bring food from the land of Qainuqa'a to the city and sell it by weight. Then the Messenger of Allah came to them and said, "What is this?" They said, "O Messenger of Allah, we bring it from the land of such and such and we sell it by weight." He said, "Do not do that. When you buy food, measure it, and when you sell it, weigh it." And it was narrated from Abu Zubair from Jabir.
أَنَّ حَكِيمَ بْنَ حِزَامٍ وَعُثْمَانَ بْنَ عَفَّانَ كَانَا يَجْلِبَانِ الطَّعَامَ مِنْ أَرْضِ قَيْنُقَاعَ إِلَى الْمَدِينَةِ فَيَبِيعَانِهِ بِكَيْلِهِ فَأَتَى عَلَيْهِمْ رَسُولُ اللهِ ﷺ فَقَالَ مَا هَذَا؟ فَقَالَا يَا رَسُولَ اللهِ جَلَبْنَاهُ مِنْ أَرْضِ كَذَا وَكَذَا وَنَبِيعُهُ بِكَيْلِهِ قَالَ لَا تَفْعَلَا ذَلِكَ إِذَا اشْتَرَيْتُمَا طَعَامًا فَاسْتَوْفِيَاهُ فَإِذَا بِعْتُمَاهُ فَكِيلَاهُ وَرُوِيَ عَنْ أَبِي الزُّبَيْرِ عَنْ جَابِرٍ
'The Messenger of Allah ﷺ forbade selling food bought by measure until two Sa' have been measured - the Sa' of the seller and the Sa' of the buyer."[1] (Using translation from Ibn Mājah 2228)
نَهَى رَسُولُ اللهِ ﷺ عَنْ بَيْعِ الطَّعَامِ حَتَّى يَجْرِيَ فِيهِ الصَّاعَانِ صَاعُ الْبَائِعِ وَصَاعُ الْمُشْتَرِي وَرُوِيَ مِنْ وَجْهٍ آخَرَ عَنْ أَبِي هُرَيْرَةَ
[Machine] The Prophet ﷺ prohibited selling food until the measurement has been made with two saa' [a specific unit of measurement], so that there would be a surplus for the seller and a deficit for the buyer.
نَهَى النَّبِيُّ ﷺ عَنْ بَيْعِ الطَّعَامِ حَتَّى يَجْرِيَ فِيهِ الصَّاعَانِ فَيَكُونَ لِلْبَائِعِ الزِّيَادَةُ وَعَلَيْهِ النُّقْصَانُ
13.56 [Machine] The translation of the heading into English is: "The sales gift from one who possesses it before receiving it from the seller.
١٣۔٥٦ بَابُ هِبَةِ الْمَبِيعِ مِمَّنْ هُوَ فِي يَدَيْهِ قَبْلَ قَبْضِهِ مِنْ بَائِعِهِ
We were accompanying the Prophet ﷺ on a journey and I was riding an unmanageable camel belonging to 'Umar (ra), and I could not bring it under my control. So, it used to go ahead of the party and 'Umar would check it and force it to retreat, and again it went ahead and again 'Umar forced it to retreat. The Prophet ﷺ asked 'Umar to sell that camel to him. 'Umar replied, "It is for you O Messenger of Allah !" Messenger of Allah ﷺ told 'Umar to sell that camel to him (not to give it as gift). So, 'Umar sold it to Messenger of Allah ﷺ. Then the Prophet ﷺ said to 'Abdullah bin 'Umar "This camel is for you O 'Abdullah (as a present) and you could do with it whatever you like." كُنَّا مَعَ النَّبِيِّ ﷺ فِي سَفَرٍ وَكُنْتُ عَلَى بَكْرٍ صَعْبٍ لِعُمَرَ فَكَانَ يَغْلِبُنِي فَيَتَقَدَّمُ أَمَامَ الْقَوْمِ فَيَزْجُرُهُ عُمَرُ وَيَرُدُّهُ ثُمَّ يَتَقَدَّمُ فَيَزْجُرُهُ عُمَرُ وَيَرُدُّهُ فَقَالَ النَّبِيُّ ﷺ لِعُمَرَ بِعْنِيهِ قَالَ هُوَ لَكَ يَا رَسُولَ اللهِ قَالَ بِعْنِيهِ فَبَاعَهُ مِنْ رَسُولِ اللهِ ﷺ فَقَالَ النَّبِيُّ ﷺ هُوَ لَكَ يَا عَبْدَ اللهِ بْنَ عُمَرَ فَاصْنَعْ بِهِ مَا شِئْتَ
13.57 [Machine] What is mentioned in the disapproval of bartering with samples?
١٣۔٥٧ بَابُ مَا وَرَدَ فِي كَرَاهِيَةِ التَّبَايُعِ بِالْعِينَةِ
[Machine] I heard the Messenger of Allah ﷺ saying: "When you engage in usury, hold onto the tails of cows, are content with farming, and give up jihad, Allah will afflict you with humiliation that will not be removed until you return to your religion." 10704 And Abu Ali informed us that Muhammad ibn Bakr narrated, who heard from Abu Dawood, who heard from Sulaiman ibn Dawood al-Mahri, who heard from Ibn Wahb, who informed me that Haywah ibn Shurayh narrated from Abu Abdur Rahman al-Khurasani, who narrated from Ata. It is narrated from two weak chains from Ata ibn Abi Rabah, from Ibn Umar, that he disapproved of such behavior and forbade a man from coming and saying, "Buy from me this and that, and I will buy it from you at this and that profit."
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ إِذَا تَبَايَعْتُمْ بِالْعِينَةِ وَأَخَذْتُمْ أَذْنَابَ الْبَقَرِ وَرَضِيتُمْ بِالزَّرْعِ وَتَرَكْتُمُ الْجِهَادَ سَلَّطَ اللهُ عَلَيْكُمْ ذُلًّا لَا يَنْزِعُهُ حَتَّى تَرْجِعُوا إِلَى دِينِكُمْ 10704 وَأَخْبَرَنَا أَبُو عَلِيٍّ أنا مُحَمَّدُ بْنُ بَكْرٍ ثنا أَبُو دَاوُدَ ثنا سُلَيْمَانُ بْنُ دَاوُدَ الْمَهْرِيُّ أنا ابْنُ وَهْبٍ أَخْبَرَنِي حَيْوَةُ بْنُ شُرَيْحٍ عَنْ أَبِي عَبْدِ الرَّحْمَنِ الْخُرَاسَانِيِّ عَنْ عَطَاءٍ فَذَكَرَهُ وَرُوِيَ ذَلِكَ مِنْ وَجْهَيْنِ ضَعِيفَيْنِ عَنْ عَطَاءِ بْنِ أَبِي رَبَاحٍ عَنِ ابْنِ عُمَرَ وَرُوِيَ عَنِ ابْنِ عُمَرَ مَوْقُوفًا أَنَّهُ كَرِهَ ذَلِكَ وَنَهَى أَنْ يَأْتِيَ الرَّجُلُ فَيَقُولُ اشْتَرِ كَذَا وَكَذَا وَأَنَا أَشْتَرِيهِ مِنْكَ بِرِبْحِ كَذَا وَكَذَا
"I asked the Prophet "O Messenger of Allah, a man may come to me and ask me to sell him something that I do not have. Can I sell it to him then go and buy it from the market?' He said: 'Do not sell what you do not have.''' (Using translation from Nasāʾī 4613)
قُلْتُ يَا رَسُولَ اللهِ يَأْتِينِي الرَّجُلُ يَسْأَلُنِي الْبَيْعَ لَيْسَ عِنْدِي أَبِيعُهُ مِنْهُ ثُمَّ أَتَكَلَّفُهُ لَهُ مِنَ السُّوقِ قَالَ لَا تَبِعْ مَا لَيْسَ عِنْدَكَ
13.58 [Machine] The prohibition of gambling
١٣۔٥٨ بَابُ النَّهْيِ عَنِ التَّصْرِيَةِ
[Machine] The Messenger of Allah ﷺ prohibited that a migrant sells to an Arab, that a woman asks for the divorce of her sister, that a man feels ashamed of bidding against his brother, and prohibited slander and cursing. This is the narration of Hafs bin 'Umar.
نَهَى رَسُولُ اللهِ ﷺ عَنِ التَّلَقِّي وَأَنْ يَبِيعَ مُهَاجِرٌ لِأَعْرَابِيٍّ وَأَنْ تَسْأَلَ الْمَرْأَةُ طَلَاقَ أُخْتِهَا وَأَنْ يَسْتَامَ الرَّجُلُ عَلَى سَوْمِ أَخِيهِ وَعَنِ التَّصْرِيَةِ وَالنَّجْشِ لَفْظُ حَدِيثِ حَفْصِ بْنِ عُمَرَ
That the Prophet ﷺ said: "Do not go out to meet the market (caravan), do not leave animals un-milked (to deceive the buyer), nor out-spend one another." (Using translation from Tirmidhī 1268)
قَالَ رَسُولُ اللهِ ﷺ لَا تَسْتَقْبِلُوا السُّوقَ وَلَا تَحْلِفُوا وَلَا يُنَفِّقْ بَعْضُكُمْ لِبَعْضٍ
[Machine] He said that selling gathering places is prohibited, and it is not permissible for a Muslim. Jabir al-Ju'fi reported this with this chain of narration from Ibn Mas'ud, and it was also narrated with a authentic chain of narration from Ibn Mas'ud standing.
أَنَّهُ قَالَ بَيْعَ الْمُحَفَّلَاتِ خِلَابَةٌ وَلَا تَحِلُّ خِلَابَةٌ لِمُسْلِمٍ رَفَعَهُ جَابِرٌ الْجُعْفِيُّ بِهَذَا الْإِسْنَادِ عَنِ ابْنِ مَسْعُودٍ وَرُوِيَ بِإِسْنَادٍ صَحِيحٍ عَنِ ابْنِ مَسْعُودٍ مَوْقُوفًا
[Machine] Abdullah said, "Beware of gatherings, as they are alluring and not permissible for a Muslim."
قَالَ عَبْدُ اللهِ إِيَّاكُمْ وَالْمُحَفَّلَاتِ فَإِنَّهَا خِلَابَةٌ وَلَا تَحِلُّ الْخِلَابَةُ لِمُسْلِمٍ
13.59 [Machine] The ruling on someone who bought a musharata
١٣۔٥٩ بَابُ الْحُكْمِ فِيمَنِ اشْتَرَى مُصَرَّاةً
[Machine] The Prophet ﷺ said, "Do not burden the camels or the sheep. Whoever buys them after that, he is the best of the two observers after milking them. If it pleases her, he keeps her, and if it angers her, he returns her and gives a measure of dates."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا تُصَرُّوا الْإِبِلَ وَلَا الْغَنَمَ فَمَنِ ابْتَاعَهَا بَعْدَ ذَلِكَ فَهُوَ بِخَيْرِ النَّظَرَيْنِ بَعْدَ أَنْ يَحْلُبَهَا فَإِنْ رَضِيَهَا أَمْسَكَهَا وَإِنْ سَخِطَهَا رَدَّهَا وَصَاعًا مِنْ تَمْرٍ
[Machine] The Messenger of Allah ﷺ said: "Whoever buys a pregnant sheep, he should keep it until it gives birth, then he should milk it. If the milk is sufficient, he should keep it, but if not, he should return it along with a measure of dates."
قَالَ رَسُولُ اللهِ ﷺ مَنِ اشْتَرَى شَاةً مُصَرَّاةً فَلْيَنْقَلِبْ بِهَا فَلْيَحْلُبْهَا فَإِنْ رَضِيَ حِلَابَهَا أَمْسَكَهَا وَإِلَّا رَدَّهَا وَمَعَهَا صَاعٌ مِنْ تَمْرٍ
Out of the ahadith which Abu Huraira (Allah be pleased with him) reported to us from Messenger of Allah ﷺ one is this that Messenger of Allah ﷺ said: If one among you buys a she-camel having its udder tied up he has the two options for him after milking it either (to retain it) or return it with a sa' of dates. (Using translation from Muslim 1524f)
وَقَالَ رَسُولُ اللهِ ﷺ إِذَا مَا أَحَدُكُمُ اشْتَرَى لِقْحَةً مُصَرَّاةً أَوْ شَاةً مُصَرَّاةً فَهُوَ بِخَيْرِ النَّظَرَيْنِ بَعْدَ أَنْ يَحْلُبَهَا إِمَّا هِيَ وَإِلَّا فَلْيَرُدَّهَا وَصَاعًا مِنْ تَمْرٍ
[Machine] The Messenger of Allah ﷺ said, "Whoever buys a fattened sheep, milks it, and is satisfied with it, then he should keep it. But if he is displeased with it, then there is a saa' of dates in its udder."
قَالَ رَسُولُ اللهِ ﷺ مَنِ اشْتَرَى غَنَمًا مُصَرَّاةً احْتَلَبَهَا فَإِنْ رَضِيَهَا أَمْسَكَهَا وَإِنْ سَخِطَهَا فَفِي حَلْبَتِهَا صَاعٌ مِنْ تَمْرٍ
[Machine] The Prophet ﷺ said, "Whoever buys a pregnant ewe and then returns it, let him also return a saa' of dates, not Samraa' dates." And Abu Abdullah Al-Hafiz informed us, stating that Abu Abdullah Muhammad bin Ya'qub narrated to him, stating that Ibrahim bin Abdullah narrated to him, stating that Yazid bin Harun mentioned it in a similar manner, except that he said 'pregnant ewe' instead of 'pregnant sheep', but the meaning is the same.
عَنِ النَّبِيِّ ﷺ قَالَ مَنِ اشْتَرَى شَاةً مُصَرَّاةً فَرَدَّهَا فَلْيَرُدَّ مَعَهَا صَاعًا مِنْ تَمْرٍ لَا سَمْرَاءَ 10718 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو عَبْدِ اللهِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا إِبْرَاهِيمُ بْنُ عَبْدِ اللهِ ثنا يَزِيدُ بْنُ هَارُونَ فَذَكَرَهُ بِمِثْلِهِ إِلَّا أَنَّهُ قَالَ شَاةً مُصَرَّاةً فَهُوَ بِالْخِيَارِ إنْ رَدَّهَا رَدَّ مَعَهَا صَاعًا مِنْ تَمْرٍ لَا سَمْرَاءَ وَبِمَعْنَاهُ
[Machine] The Messenger of Allah ﷺ said, "Whoever buys a pregnant sheep or goat and milks it, he has the choice of one of two options: either to return the animal or to give a sa' of food as compensation." Al-Bukhari said, "And some of them said, according to Ibn Sirin, it is three sa' of food as compensation." Al-Bukhari said, "May Allah have mercy on him. And the most abundant food mentioned here is dates." The Sheikh said, "And the intended food in this narration is dates, as he said, 'No other equal value alternative (to dates) should be given.'"
قَالَ رَسُولُ اللهِ ﷺ مَنِ اشْتَرَى لِقْحَةً مُصَرَّاةً أَوْ شَاةً مُصَرَّاةً فَحَلَبَهَا فَهُوَ بِأَحَدِ النَّظَرَيْنِ بِالْخِيَارِ إِنْ شَاءَ رَدَّهَا وَإِنَاءً مِنْ طَعَامٍ قَالَ الْبُخَارِيُّ وَقَالَ بَعْضُهُمْ عَنِ ابْنِ سِيرِينَ صَاعًا مِنْ طَعَامٍ وَهُوَ بِالْخِيَارِ ثَلَاثًا قَالَ الْبُخَارِيُّ رَحِمَهُ اللهُ وَالتَّمْرُ أَكْثَرُ قَالَ الشَّيْخُ وَالْمُرَادُ بِالطَّعَامِ فِي هَذَا الْخَبَرِ التَّمْرُ فَقَدْ قَالَ لَا سَمْرَاءَ
[Machine] The Messenger of Allah ﷺ said, "Whoever buys a fat sheep, he has the option of returning it within three days if he wishes, or (he can keep it) by giving a measure of food, not barley."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنِ اشْتَرَى شَاةً مُصَرَّاةً فَهُوَ بِالْخِيَارِ ثَلَاثَةَ أَيَّامٍ إِنْ شَاءَ رَدَّهَا وَصَاعًا مِنْ طَعَامٍ لَا سَمْرَاءَ وَكَذَلِكَ
[Machine] I heard Abdullah bin Umar say, "We used to wait for the Messenger of Allah ﷺ at the gate, and when he came out, we would follow him until he reached a hill outside the city. He sat down on it and said, 'O people, no one among you should undertake a transaction (buying or selling) until the migrants have an opportunity to do so with the Bedouins. And whoever sells a piece of land, he has the right to take it back within three days, and if he wants to return it, he should return it with an additional payment of similar value or he can return it as it is. The price of its milk and wheat should be fair.' All of Ibn Umar's sons acquired individual ownership of land through this narration." Al-Bukhari commented on this narration, "It is a subject of scrutiny."
سَمِعْتُ عَبْدَ اللهِ بْنَ عُمَرَ يَقُولُ كُنَّا عَلَى بَابِ رَسُولِ اللهِ ﷺ نَنْتَظِرُهُ فَخَرَجَ فَاتَّبَعْنَاهُ حَتَّى أَتَى عَقَبَةً مِنْ عِقَابِ الْمَدِينَةِ فَقَعَدَ عَلَيْهَا فَقَالَ يَا أَيُّهَا النَّاسُ لَا يَتَلَقَّيَنَّ أَحَدٌ مِنْكُمْ سُوقًا وَلَا يَبِيعَنَّ مُهَاجِرِيٌّ لِأَعْرَابِيٍّ وَمَنْ بَاعَ مُحَفَّلَةً فَهُوَ بِالْخِيَارِ ثَلَاثَةَ أَيَّامٍ فَإِنْ رَدَّهَا رَدَّ مَعَهَا مِثْلَ أَوْ قَالَ مِثْلَيْ لَبَنِهَا قَمْحًا تَفَرَّدَ بِهِ جُمَيْعُ بْنُ عُمَيْرٍ قَالَ الْبُخَارِيُّ فِيهِ نَظَرٌ
[Machine] The Prophet ﷺ said: "Whoever buys a defective animal or a pregnant animal, then he has one of two options: either return it and take back a container of food, or keep it. This is the preserved tradition, transmitted and documented."
أَنَّ النَّبِيَّ ﷺ قَالَ مَنِ اشْتَرَى مُصَرَّاةً أَوْ لِقْحَةً مُصَرَّاةً فَهُوَ بِأَحَدِ النَّظَرَيْنِ بَيْنَ أَنْ يَرُدَّهَا وَإِنَاءً مِنْ طَعَامٍ أَوْ يَأْخُذَهَا هَذَا هُوَ الْمَحْفُوظُ مُرْسَلٌ وَقَدْ
[Machine] The Messenger of Allah ﷺ said, "Whoever buys a pregnant sheep, then its owner has the right to milk it. If he accepts, then he should keep it, but if not, then he should return it and a sa' of dates."
قَالَ رَسُولُ اللهِ ﷺ مَنِ اشْتَرَى شَاةً مُحَفَّلَةً فَإِنَّ لِصَاحِبِهَا أَنْ يَحْتَلِبَهَا فَإِنْ رَضِيَهَا فَلْيُمْسِكْهَا وَإِلَّا فَلْيَرُدَّهَا وَصَاعًا مِنْ تَمْرٍ
[Machine] From a man of the companions of the Prophet ﷺ , from the Prophet ﷺ , that he forbade the recitation of the Al-Jalab and selling a present for a bad one. And whoever buys a Musrra (female camel that has given birth and started producing milk), then it is better to look at both of its eyes. If he milks it and is pleased with it, he keeps it. If he returns it, he returns with a Sa'a (a specific measure of food) of grain or a Sa'a of dates. The sheikh said, "It is possible that this is a doubt from some of the narrators." Then he said, "A Sa'a of this or a Sa'a of that, it is not from the choice." It is to be in accordance with the established hadiths in this topic. And Allah knows best.
عَنْ رَجُلٍ مِنْ أَصْحَابِ النَّبِيِّ ﷺ عَنِ النَّبِيِّ ﷺ أَنَّهُ نَهَى أَنْ يُتَلَقَّى الْأَجْلَابُ وَأَنْ يَبِيعَ حَاضِرٌ لِبَادٍ وَمَنِ اشْتَرَى مُصَرَّاةً فَهُوَ بِخَيْرِ النَّظَرَيْنِ فَإِنْ حَلَبَهَا وَرَضِيَهَا أَمْسَكَهَا وَإِنْ رَدَّهَا رَدَّ مَعَهَا صَاعًا مِنْ طَعَامٍ أَوْ صَاعًا مِنْ تَمْرٍ قَالَ الشَّيْخُ يُحْتَمَلُ أَنْ يَكُونَ هَذَا شَكًّا مِنْ بَعْضِ الرُّوَاةِ فَقَالَ صَاعًا مِنْ هَذَا أَوْ مِنْ ذَلِكَ لَا أَنَّهُ مِنْ وَجْهِ التَّخْيِيرِ؛ لِيَكُونَ مُوَافِقًا لِلْأَحَادِيثِ الثَّابِتَةِ فِي هَذَا الْبَابِ وَاللهُ أَعْلَمُ
وَنَهَى النَّبِيُّ ﷺ عَنْ تَلَقِّي الْبُيُوعِ
[Machine] Whoever buys a pregnant ewe and then returns it, he should return with it a sa'a of dates. Abu 'Amr Al-Adibi informed us, Abu Bakr Al-Isma'ili informed me, Abu Yahya Al-Ruwayani narrated to me, from Ibrahim, he mentioned it, he said: Al-Isma'ili narrated the hadith of the pregnant ewe from the saying of Abdullah, and Abu Khalid narrated it from Al-Taymi, 10729 Abu 'Amr informed us, I am Abu Bakr, Al-Qasim narrated to me, Abu Kurayb narrated to me, Abu Khalid mentioned it, and he did not say "of dates." Al-Isma'ili said: It was also narrated by Ibn Al-Mubarak, Yahya Ibn Said, Ibn Abi 'Adi, Yazid Ibn Zuray', Hushaim, Jarir, and others, attributed to Ibn Mas'ud, the hadith of the pregnant ewe.
مَنِ اشْتَرَى شَاةً مُحَفَّلَةً فَرَدَّهَا فَلْيَرُدَّ مَعَهَا صَاعًا مِنْ تَمْرٍ أَخْبَرَنَاهُ أَبُو عَمْرٍو الْأَدِيبُ أنا أَبُو بَكْرٍ الْإِسْمَاعِيلِيُّ أَخْبَرَنِي أَبُو يَحْيَى الرُّويَانِيُّ ثنا إِبْرَاهِيمُ فَذَكَرَهُ قَالَ الْإِسْمَاعِيلِيُّ حَدِيثُ الْمُحَفَّلَةِ مِنْ قَوْلِ عَبْدِ اللهِ وَقَدْ رَفَعَهُ أَبُو خَالِدٍ عَنِ التَّيْمِيِّ 10729 أَخْبَرَنَا أَبُو عَمْرٍو أنا أَبُو بَكْرٍ ثنا الْقَاسِمُ ثنا أَبُو كُرَيْبٍ ثنا أَبُو خَالِدٍ فَذَكَرَهُ وَلَمْ يَقُلْ مِنْ تَمْرٍ قَالَ الْإِسْمَاعِيلِيُّ وَرَوَاهُ ابْنُ الْمُبَارَكِ وَيَحْيَى بْنُ سَعِيدٍ وَابْنُ أَبِي عَدِيٍّ وَيَزِيدُ بْنُ زُرَيْعٍ وَهُشَيْمٌ وَجَرِيرٌ وَغَيْرُهُمْ مَوْقُوفًا عَلَى ابْنِ مَسْعُودٍ حَدِيثَ الْمُحَفَّلَةِ
13.60 [Machine] Duration of the Khiyar in Al-Musarata
١٣۔٦٠ بَابُ مُدَّةِ الْخِيَارِ فِي الْمُصَرَّاةِ
He who buys a goat with its udder tied up has the option to retain the goat if he so desires or return it within three days, and in case he returns it he should do so along with a sa' of dates. (Using translation from Muslim 1524b)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنِ ابْتَاعَ شَاةً مُصَرَّاةً فَهُوَ بِالْخِيَارِ ثَلَاثَةَ أَيَّامٍ إِنْ شَاءَ أَمْسَكَهَا وَإِنْ شَاءَ رَدَّهَا وَرَدَّ مَعَهَا صَاعًا مِنْ تَمْرٍ
[Machine] The Messenger of Allah ﷺ said, "Whoever buys a domestic camel has the choice for three days: if he returns it, he returns it and gives a measure of food, not red (meat)."
قَالَ رَسُولُ اللهِ ﷺ مَنِ اشْتَرَى مُصَرَّاةً فَهُوَ بِالْخِيَارِ ثَلَاثَةَ أَيَّامٍ فَإِنْ رَدَّهَا رَدَّهَا وَصَاعًا مِنْ طَعَامٍ لَا سَمْرَاءَ

١٣۔٦١ جُمَّاعُ أَبْوَابِ الْخَرَاجِ بِالضَّمَانِ وَالرَّدِ بِالْعُيُوبِ وَغَيْرِ ذَلِكَ
13.62 [Machine] What is mentioned about deceit and concealing defects in sales?
١٣۔٦٢ بَابُ مَا جَاءَ فِي التَّدْلِيسِ وَكِتْمَانِ الْعَيْبِ بِالْمَبِيعِ
The Messenger of Allah ﷺ passed a man who was selling grain. He asked him: How are you selling? He informed him. Revelation them came down to him saying: "Put your hand into it." So he put his hand into it, and felt that it was damp. The Messenger of Allah ﷺ then said: "He who deceives has nothing to do with us." (Using translation from Abū Dāʾūd 3452)
أَنَّ النَّبِيَّ ﷺ مَرَّ بِرَجُلٍ يَبِيعُ طَعَامًا فَقَالَ كَيْفَ تَبِيعُ؟ فَأَخْبَرَهُ فَأَوْحَى اللهُ إِلَيْهِ أَنْ أَدْخِلْ يَدَكَ فِيهِ فَأَدْخَلَ يَدَهُ فَإِذَا هُوَ مَبْلُولٌ فَقَالَ لَهُ رَسُولُ اللهِ ﷺ لَيْسَ مِنَّا مَنْ غَشَّ
