58. Expeditions (14/18)
٥٨۔ كِتَابُ السِّيَرِ ص ١٤
[Machine] I read this verse {Fight those who do not believe in Allah or in the Last Day} [al-Tawbah 29] as {Until they give the Jizyah} [al-Tawbah 29] with my own hands and they are young, do not remove the young ones from their necks, lest they be placed on your neck.
نَفْسِي فَقَرَأَ هَذِهِ الْآيَةَ {قَاتِلُوا الَّذِينَ لَا يُؤْمِنُونَ بِاللهِ وَلَا بِالْيَوْمِ الْآخِرِ} [التوبة 29] إِلَى {حَتَّى يُعْطُوا الْجِزْيَةَ} [التوبة 29] عَنْ يَدٍ وَهُمْ صَاغِرُونَ لَا تَنْزِعِ الصَّغَارَ مِنْ أَعْنَاقِهِمْ فَتَجْعَلَهُ فِي عُنُقِكَ
[Machine] The man of Islam takes the land from the people of the covenant with what is due from it in terms of taxes. He says it is not permissible for a Muslim or it is not appropriate for a Muslim to subject himself to humiliation and insignificance.
الرَّجُلِ مِنْ أَهْلِ الْإِسْلَامِ يَأْخُذُ الْأَرْضَ مِنْ أَهْلِ الذِّمَّةِ بِمَا عَلَيْهَا مِنَ الْخَرَاجِ يَقُولُ لَا يَحِلُّ لِمُسْلِمٍ أَوْ لَا يَنْبَغِي لِمُسْلِمٍ أَنْ يَكْتُبَ عَلَى نَفْسِهِ الذُّلَّ وَالصَّغَارَ
[Machine] The entire land is mine for a rent of five dirhams, which I accept from the small ones for myself.
الْأَرْضَ كُلَّهَا لِي بِجِزْيَةٍ خَمْسَةِ دَرَاهِمَ أُقِرُّ فِيهَا بِالصَّغَارِ عَلَى نَفْسِي
مَنْ أَقَرَّ بِالطَّسْقِ فَقَدْ أَقَرَّ بِالصَّغَارِ
58.120 [Machine] Who disliked buying land for tithe?
٥٨۔١٢٠ بَابُ مَنْ كَرِهَ شِرَاءَ أَرْضِ الْخَرَاجِ
[Machine] "Do not buy the slaves of the Ahl al-Dhimmah, for they are the inhabitants of the tax land (kharaaj) that they pay from one another, and they please them. So, do not purchase them. And do not marry any of you with the minors after Allah saved him from it. Abu 'Ubayd said: What we see is that when he has slaves, land, and visible wealth, his jizyah would be more, and it was the practice of 'Umar with them that he would impose the jizyah in proportion to their ease and difficulty. So, for this reason, he disliked that their slaves be bought. As for the purchase of land, it goes towards kharaaj and he disliked that this should be on the Muslims. Don't you see him saying, 'And do not marry any of you with the minors after Allah saved him from it?' Abu 'Ubayd said: And he permitted it, after 'Umar, for certain men among the senior Companions of Muhammad ﷺ, including Abdullah bin Mas'ud, who owned land in Ratha'an, and Hubbab bin al-Aratt, and others."
لَا تَشْتَرُوا رَقِيقَ أَهْلِ الذِّمَّةِ فَإِنَّهُمْ أَهْلُ خَرَاجٍ يُؤَدِّي بَعْضُهُمْ عَنْ بَعْضٍ وَأَرْضِيهِمْ فَلَا تَبْتَاعُوهَا وَلَا يُقِرَّنَّ أَحَدُكُمْ بِالصَّغَارِ بَعْدَ إِذْ نَجَّاهُ اللهُ مِنْهُ قَالَ أَبُو عُبَيْدٍ أَرَادَ فِيمَا نَرَى أَنَّهُ إِذَا كَانَتْ لَهُ مَمَالِيكُ وَأَرْضٌ وَأَمْوَالٌ ظَاهِرَةٌ كَانَتْ أَكْثَرَ لِجِزْيَتِهِ وَكَانَتْ سُنَّةُ عُمَرَ ؓ فِيهِمْ إِنَّمَا كَانَتْ يَضَعُ الْجِزْيَةَ عَلَى قَدْرِ الْيَسَارِ وَالْعُسْرِ فَلِهَذَا كَرِهَ أَنْ يُشْتَرَى رَقِيقُهُمْ وَأَمَّا شِرَاءُ الْأَرْضِ فَإِنَّهُ ذَهَبَ فِيهِ إِلَى الْخَرَاجِ كَرِهَ أَنْ يَكُونَ ذَلِكَ عَلَى الْمُسْلِمِينَ أَلَا تَرَاهُ يَقُولُ وَلَا يُقِرَّنَّ أَحَدُكُمْ بِالصَّغَارِ بَعْدَ إِذْ نَجَّاهُ اللهُ مِنْهُ قَالَ أَبُو عُبَيْدٍ وَقَدْ رَخَّصَ فِي ذَلِكَ بَعْدَ عُمَرَ رِجَالٌ مِنْ أَكَابِرِ أَصْحَابِ مُحَمَّدٍ ﷺ مِنْهُمْ عَبْدُ اللهِ بْنُ مَسْعُودٍ وَكَانَتْ لَهُ أَرْضٌ بِرَاذَانَ وَخَبَّابُ بْنُ الْأَرَتِّ وَغَيْرُهُمَا
[Machine] "To purchase something from the land subject to the non-Muslim tax (Jizyah) and to claim that it is the tax paid by Muslims."
أَنْ يَشْتَرِيَ مِنْ أَرْضِ الْخَرَاجِ شَيْئًا وَيَقُولُ عَلَيْهَا خَرَاجُ الْمُسْلِمِينَ
[Machine] I said, "Indeed, I will give from every crop a drachma and a qafiz of food." He said, "And do not put on your neck [a burden] beyond your capacity."
قُلْتُ فَإِنِّي أُعْطِي مِنْ كُلِّ جَرِيبِ أَرْضٍ دِرْهَمًا وَقَفِيزًا مِنْ طَعَامٍ قَالَ وَلَا تَجْعَلْ فِي عُنُقِكَ صَغَارًا
58.121 [Machine] Who granted permission to purchase the Kharaj land?
٥٨۔١٢١ بَابُ مَنْ رَخَّصَ فِي شِرَاءِ أَرْضِ الْخَرَاجِ
[Machine] Its owner, meaning its farmer, says to it, "I will suffice you by paying its rent and taking care of it."
لَهُ صَاحِبُهَا يَعْنِي دُهْقَانَهَا أَنَا أَكْفِيكَ إِعْطَاءَ خَرَاجِهَا وَالْقِيَامَ عَلَيْهَا
أَنْ يَكْفِيَهُ خَرَاجَهَا
[Machine] Umar responded to them, affirmed their land, and agreed to the tax that he imposed on them.
قَدْ رَدَّ إِلَيْهِمْ عُمَرُ ؓ أَرْضَهُمْ وَصَالَحَهُمْ عَلَى الْخَرَاجِ الَّذِي وَضَعَهُ عَلَيْهِمْ
وَالْحُسَيْنَ ؓ اشْتَرَيَا قِطْعَةً مِنْ أَرْضِ الْخَرَاجِ
[Machine] That Hudhaifah bought a piece of land from the Kharaj land.
أَنَّ حُذَيْفَةَ ؓ اشْتَرَى قِطْعَةً مِنْ أَرْضِ الْخَرَاجِ
[Machine] And the judge said, "And they used to allow the purchase of land in Hijrah because they were reconciled." Yahya said, "I asked Hassan ibn Salih, and he disliked the purchase of land with taxation that was taken by force, but if the taxation was imposed on it later, he did not see any harm in the purchase of land by the people of reconciliation."
وَقَالَ الْحَكَمُ وَكَانُوا يُرَخِّصُونَ فِي شِرَاءِ أَرْضِ الْحِيرَةِ مِنْ أَجْلِ أَنَّهُمْ صُلْحٌ قَالَ يَحْيَى وَسَأَلْتُ حَسَنَ بْنَ صَالِحٍ فَكَرِهَ شِرَاءَ أَرْضِ الْخَرَاجِ الَّتِي أُخِذَتْ عَنْوَةً فَوُضِعَ عَلَيْهَا الْخَرَاجُ فَلَمْ يَرَ بَأْسًا بِشِرَاءِ أَرْضِ أَهْلِ الصُّلْحِ
58.122 [Machine] Whoever from the people of reconciliation embraces Islam, tax will be exempted from his land.
٥٨۔١٢٢ بَابُ مَنْ أَسْلَمَ مِنْ أَهْلِ الصُّلْحِ سَقَطَ الْخَرَاجُ عَنْ أَرْضِهِ
[Machine] In it, there is no tax on those who convert from the people of the land and we have narrated in it a hadith that is not obligatory on them except for charity, and that has already been mentioned with others in the book of Zakah.
فِيهِ وَلَا خَرَاجَ عَلَى مَنْ أَسْلَمَ مِنْ أَهْلِ الْأَرْضِ وَقَدْ رُوِّينَا فِيهِ حَدِيثًا مُسْنَدًا لَيْسَ عَلَيْهِمْ فِيهِ إِلَّا صَدَقَةٌ وَقَدْ مَضَى ذَلِكَ مَعَ غَيْرِهِ فِي كِتَابِ الزَّكَاةِ
58.123 [Machine] When the land is taken by force, it is to be preserved for the Muslims by the consent and satisfaction of the winners. Its sale is not permissible if it is in the possession of a Muslim, and its tax is not waived.
٥٨۔١٢٣ بَابُ الْأَرْضِ إِذَا أُخِذَتْ عَنْوَةً فَوُقِفَتْ لِلْمُسْلِمِينَ بِطِيبِ أَنْفُسِ الْغَانِمِينَ لَمْ يَجُزْ بَيْعُهَا إِذَا أَسْلَمَ مَنْ هِيَ فِي يَدِهِ لَمْ يَسْقُطْ خَرَاجُهَا
اذْهَبْ فَاطْلُبْ مَالَكَ
[Machine] I bought ten experiments from the Black Land on the banks of the Euphrates to train animals. It was mentioned to Umar. He asked, "Did you buy them from their owners?" I said, "Yes." He said, "Go ahead." I was happy about it, so I went to him. He said, "Did you send them anything?" They said, "No." He said, "Seek your wealth wherever you have placed it."
اشْتَرَيْتُ عَشَرَةَ أَجْرِبَةٍ مِنْ أَرْضِ السَّوَادِ عَلَى شَاطِئِ الْفُرَاتِ لِقَضْبِ دَوَابَّ فَذُكِرَ ذَلِكَ لِعُمَرَ ؓ قَالَ اشْتَرَيْتَهَا مِنْ أَصْحَابِهَا؟ قَالَ قُلْتُ نَعَمْ قَالَ رُحْ إِلِيَّ قَالَ فَرُحْتُ إِلَيْهِ فَقَالَ يَا هَؤُلَاءِ أَبِعْتُمُوهُ شَيْئًا؟ قَالُوا لَا قَالَ ابْتَغِ مَالَكَ حَيْثُ وَضَعْتَهُ
[Machine] Umar or someone named Umar, if they choose their land and fulfill what is required of their land, then leave them alone with their land. Otherwise, remove the Muslims from their lands.
عُمَرُ أَوْ كَتَبَ عُمَرُ ؓ إِنِ اخْتَارَتْ أَرْضَهَا وَأَدَّتْ مَا عَلَى أَرْضِهَا فَخَلُّوا بَيْنَهَا وَبَيْنَ أَرْضِهَا وَإِلَّا خَلُّوا بَيْنَ الْمُسْلِمِينَ وَبَيْنَ أَرَضِيهِمْ
[Machine] Umar and Ali, when a man from the people of As-Sawad embraces Islam, they let him collect his tribute in his land.
عُمَرُ وَعَلِيٌّ ؓ إِذَا أَسْلَمَ الرَّجُلُ مِنْ أَهْلِ السَّوَادِ تَرَكَاهُ يَقُومُ بِخَرَاجِهِ فِي أَرْضِهِ
[Machine] Al-Raqil embraced Islam, so Umar gave him his land with its taxes and imposed upon him two thousand (dirhams).
أَسْلَمَ الرَّقِيلُ فَأَعْطَاهُ عُمَرُ ؓ أَرْضَهُ بِخَرَاجِهَا وَفَرَضَ لَهُ أَلْفَيْنِ
[Machine] So he wrote to Saad, responding to him, and then invited him to Islam, so he converted and Umar imposed upon him 700 dirhams and placed his tribute in Khatham. He said, "If you establish yourself in your land, you will pay from it what you used to pay." And this is a weak narration in its chain, but if it is proven, then his statement was, "And your land is yours, and you have the right to it as you intended. And your land is the one you used to cultivate and pay its taxes." And that was taken by force, except that he left it, and its taxes did not fall from him when he converted. And in the peace treaty, its taxes fall.
فَكَتَبَ إِلَى سَعْدٍ رُدَّ عَلَيْهِ أَرْضَهُ ثُمَّ دَعَاهُ إِلَى الْإِسْلَامِ فَأَسْلَمَ فَفَرَضَ لَهُ عُمَرُ ؓ سَبْعَمِائَةٍ وَجَعَلَ عَطَاءَهُ فِي خَثْعَمٍ وَقَالَ إِنْ أَقَمْتَ فِي أَرْضِكَ أَدَّيْتَ عَنْهَا مَا كُنْتَ تُؤَدِّي وَهَذَا فِي إِسْنَادِهِ ضِعْفٌ فَإِنْ ثَبَتَ كَانَ قَوْلُهُ وَلَكُمْ أَرْضُكُمْ مَحْمُولًا عَلَى أَنَّهُ أَرَادَ وَلَكُمْ أَرْضُكُمُ الَّتِي كَانَتْ لَكُمْ تَزْرَعُونَهَا وَتُعْطُونَ خَرَاجَهَا وَذَلِكَ فِيمَا أُخِذَ عَنْوَةً إِلَّا تَرَكَهُ لَمْ يَسْقُطْ عَنْهُ خَرَاجُهَا حِينَ أَسْلَمَ وَفِي الصُّلْحِ يَسْقُطُ
[Machine] Indeed, the land of so and so can endure more taxes than what is imposed on them so he said there is no way to reach them, we have only reconciled with them with reconciliation.
إِنَّ أَرْضَ كَذَا وَكَذَا يُطِيقُونَ مِنَ الْخَرَاجِ أَكْثَرَ مِمَّا عَلَيْهِمْ فَقَالَ لَا سَبِيلَ إِلَيْهِمْ إِنَّمَا صَالَحْنَاهُمْ صُلْحًا
[Machine] A farmer from the people of Aswad during the time of Ali, may Allah be pleased with him, converted to Islam. Ali said to him, "If you remain in your land, we will lift the tax from you and take from your land. But if you abandon it, then we are more entitled to it."
أَسْلَمَ دُهْقَانٌ مِنْ أَهْلِ السَّوَادِ فِي عَهْدِ عَلِيٍّ ؓ فَقَالَ لَهُ عَلِيٌّ ؓ إِنْ أَقَمْتَ فِي أَرْضِكَ رَفَعْنَا الْجِزْيَةَ عَنْ رَأْسِكَ وَأَخَذْنَا مِنْ أَرْضِكَ وَإِنْ تَحَوَّلْتَ عَنْهَا فَنَحْنُ أَحَقُّ بِهَا
[Machine] Ali owns you. As for the compensation for your head, we will waive it. And as for your land, it belongs to the Muslims. If you want, we will make an agreement with you. And if you want, we will make you a champion for us. Whatever Allah has taken out of it [the land], you have brought it to us.
لَهُ عَلِيٌّ ؓ أَمَّا جِزْيَةُ رَأْسِكَ فَنَرْفَعُهَا وَأَمَّا أَرْضُكَ فَلِلْمُسْلِمِينَ فَإِنْ شِئْتَ فَرَضْنَا لَكَ وَإِنْ شِئْتَ جَعَلْنَاكَ قَهْرَمَانًا لَنَا فَمَا أَخْرَجَ اللهُ مِنْهَا مِنْ شَيْءٍ أَتَيْتَنَا بِهِ
58.124 [Machine] The captive is bound by a covenant not to escape
٥٨۔١٢٤ بَابُ الْأَسِيرِ يُؤْخَذُ عَلَيْهِ الْعَهْدُ أَنْ لَا يَهْرُبَ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: فَمَتَى قَدَرَ عَلَى الْخُرُوجِ مِنْهَا فَلْيَخْرُجْ؛ لِأَنَّ يَمِينَهُ يَمِينُ مُكْرَهٍ. قَالَ: وَلَعَلَّهُ لَيْسَ بِوَاسِعٍ لَهُ أَنْ يُقِيمَ مَعَهُمْ إِذَا قَدَرَ عَلَى التَّنَحِّي عَنْهُمْ.
The Messenger of Allah ﷺ sent an expedition to Khath'am. Some people sought protection by having recourse to prostration, and were hastily killed. When the Prophet ﷺ heard that, he ordered half the blood-wit to be paid for them, saying: I am not responsible for any Muslim who stays among polytheists. They asked: Why, Messenger of Allah? He said: Their fires should not be visible to one another. Abu Dawud said: Hushaim, Ma'mar, Khalid b. al-Wasiti and a group of narrators have also narrated it, but did not mention Jarir. بَعَثَ رَسُولُ اللهِ ﷺ سَرِيَّةً إِلَى خَثْعَمٍ فَاعْتَصَمَ نَاسٌ مِنْهُمْ بِالسُّجُودِ وَأَسْرَعَ فِيهِمُ الْقَتْلُ فَبَلَغَ ذَلِكَ النَّبِيَّ ﷺ فَأَمَرَ لَهُمْ بِنِصْفِ الْعَقْلِ وَقَالَ أَنَا بَرِيءٌ مِنْ كُلِّ مُسْلِمٍ مُقِيمٍ بَيْنَ أَظْهُرِ الْمُشْرِكِينَ قَالُوا يَا رَسُولَ اللهِ وَلِمَ؟ قَالَ لَا تَرَايَا نَارَاهُمَا
[Machine] On the authority of the Prophet ﷺ , he said: "Do not reside with the polytheists nor have intimate relations with them. Whosoever resides among them or has intimate relations with them is not one of us."
عَنِ النَّبِيِّ ﷺ قَالَ لَا تُسَاكِنُوا الْمُشْرِكِينَ وَلَا تُجَامِعُوهُمْ فَمَنْ سَاكَنَهُمْ أَوْ جَامَعَهُمْ فَلَيْسَ مِنَّا
58.125 [Machine] The captive is safe so they cannot be harmed in their wealth and themselves. Imam Shafi (may Allah have mercy on him) said: Because when they are given security, they are safe from him.
٥٨۔١٢٥ بَابُ الْأَسِيرِ يُؤَمَّنُ فَلَا يَكُونُ لَهُ أَنْ يَغْتَالَهُمْ فِي أَمْوَالِهِمْ وَأَنْفُسِهِمْ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: لِأَنَّهُمْ إِذَا أَمَّنُوهُ فَهُمْ فِي أَمَانٍ مِنْهُ.
[Machine] About the Prophet ﷺ , he said: Every betrayer will have a flag on the Day of Judgment and it will be said, "This is the treachery of so and so who betrayed him." This is mentioned in the sahih hadith of Shu'bah.
عَنِ النَّبِيِّ ﷺ قَالَ لِكُلِّ غَادِرٍ لِوَاءٌ يَوْمَ الْقِيَامَةِ يُقَالُ هَذِهِ غَدْرَةُ فُلَانٍ أَخْرَجَاهُ فِي الصَّحِيحِ مِنْ حَدِيثِ شُعْبَةَ
[Machine] That the Messenger of Allah ﷺ said: "If a person offers security to another person and then kills him, then I am innocent of the killer, even if the one killed was a disbeliever."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ إِذَا أَمَّنَ الرَّجُلُ الرَّجُلَ عَلَى نَفْسِهِ ثُمَّ قَتَلَهُ فَأَنَا بَرِيءٌ مِنَ الْقَاتِلِ وَإِنْ كَانَ الْمَقْتُولُ كَافِرًا
[Machine] That the Prophet ﷺ said: "When a man guarantees the life of another man, then kills him, he will be raised on the Day of Judgment carrying the banner of treachery, and I refrain from speaking about him."
أَنَّ النَّبِيَّ ﷺ قَالَ إِذَا أَمَّنَ الرَّجُلُ الرَّجُلَ عَلَى دَمِهِ ثُمَّ قَتَلَهُ رُفِعَ لَهُ لِوَاءُ الْغَدْرِ يَوْمَ الْقِيَامَةِ فَكَفَفْتُ عَنْهُ
[Machine] We were with the Messenger of Allah ﷺ during the Battle of Khaybar when a small group went out and captured a man who was herding sheep. They brought him to the Messenger of Allah ﷺ , and he spoke to him by the will of Allah. The man said to him, "I have believed in you and in what you have brought. But what about the sheep, O Messenger of Allah? They belong to the people, and there are ewes and pregnant sheep among them, and more than that." The Messenger of Allah ﷺ said, "Count their faces and let them return to their owners." So he took a handful of pebbles or soil, threw it on their faces, and they all returned to their owners. Then he moved forward towards the battle, and an arrow hit him, causing his death. He never prostrated to Allah. The Messenger of Allah ﷺ said, "Take him to the hiding place." So he was taken to the hiding place of the Messenger of Allah ﷺ . When the Messenger of Allah ﷺ finished, he came to him and said, "The Islam of your companion is good. I entered upon him, and he has two wives from the celestial ones, and I did not write it except from the narration of Shurahbil ibn Saad, and they have spoken about it. It has also been narrated from Muhammad ibn Ishaq ibn Yasar from his father as a mursal narration, and it has also been narrated from Abu Al-Aas ibn Ar-Rabi' with a similar story, but with a mursal chain.
كُنَّا مَعَ رَسُولِ اللهِ ﷺ فِي غَزْوَةِ خَيْبَرَ خَرَجَتْ سَرِيَّةٌ فَأَخَذُوا إِنْسَانًا مَعَهُ غَنَمٌ يَرْعَاهَا فَجَاؤُوا بِهِ إِلَى رَسُولِ اللهِ ﷺ فَكَلَّمَهُ النَّبِيُّ ﷺ مَا شَاءَ اللهُ أَنْ يُكَلِّمَهُ بِهِ فَقَالَ لَهُ الرَّجُلُ إِنِّي قَدْ آمَنْتُ بِكَ وَبِمَا جِئْتَ بِهِ فَكَيْفَ بِالْغَنَمِ يَا رَسُولَ اللهِ؟ فَإِنَّهَا أَمَانَةٌ وَهِيَ لِلنَّاسِ الشَّاةُ وَالشَّاتَانِ وَأَكْثَرُ مِنْ ذَلِكَ قَالَ احْصِبْ وُجُوهَهَا تَرْجِعْ إِلَى أَهْلِهَا فَأَخَذَ قَبْضَةً مِنْ حَصْبَاءَ أَوْ تُرَابٍ فَرَمَى بِهِ وَجُوهِهَا فَخَرَجَتْ تَشْتَدُّ حَتَّى دَخَلَتْ كُلُّ شَاةٍ إِلَى أَهْلِهَا ثُمَّ تَقَدَّمَ إِلَى الصَّفِّ فَأَصَابَهُ سَهْمٌ فَقَتَلَهُ وَلَمْ يُصَلِّ لِلَّهِ سَجْدَةً قَطُّ قَالَ رَسُولُ اللهِ ﷺ أَدْخِلُوهُ الْخِبَاءَ فَأُدْخِلَ خِبَاءَ رَسُولِ اللهِ ﷺ حَتَّى إِذَا فَرَغَ رَسُولُ اللهِ ﷺ دَخَلَ عَلَيْهِ ثُمَّ خَرَجَ فَقَالَ لَقَدْ حَسُنَ إِسْلَامُ صَاحِبِكُمْ لَقَدْ دَخَلْتُ عَلَيْهِ وَإِنَّ عِنْدَهُ لَزَوْجَتَيْنِ لَهُ مِنَ الْحُورِ الْعِينِ لَمْ أَكْتُبْهُ مَوْصُولًا إِلَّا مِنْ حَدِيثِ شُرَحْبِيلَ بْنِ سَعْدٍ وَقَدْ تَكَلَّمُوا فِيهِ ورُوِيَ عَنْ مُحَمَّدِ بْنِ إِسْحَاقَ بْنِ يَسَارٍ عَنْ أَبِيهِ مُرْسَلًا وَرُوِي عَنْ أَبِي الْعَاصِ بْنِ الرَّبِيعِ فِيهِ قِصَّةٌ شَبِيهَةٌ بِهَذِهِ إِلَّا أَنَّهَا بِإِسْنَادٍ مُرْسَلٍ
[Machine] Abu Al-As ibn Ar-Rabi' was a trader who used to go to Sham (Syria). He was a trustworthy man and he had merchandise for the Quraysh with him. A caravan came his way and it was intercepted secretly by a group of the Messenger of Allah's ﷺ Companions. They took away his goods and brought them to the Messenger of Allah ﷺ who distributed them among themselves. Abu Al-As went on until he reached Zainab (his wife), seeking her protection and asked her to intercede with the Messenger of Allah ﷺ to return his money to him and what he had of other people's goods. The Messenger of Allah ﷺ called those who intercepted the caravan and they answered him. Then he went out until he reached Makkah and he distributed among the people what he had of their goods. When he finished he said: "O assembly of Quraysh! Is there anyone among you to whom I owe anything which I have not returned?" They answered: "No, may Allah reward you with the best. You have been found trustworthy and generous." Abu Al-As said: "By Allah! I was not prevented from accepting Islam before I joined you except that I feared that you would think that I embraced Islam in order to take away your possessions. But I asseverate that there is no god but Allah and Muhammad is His slave and His Apostle." Ash-Shafi'i said in Al-Musnad: "If they secretly took hold of a person and did not feel secure about him nor recover anything from him, they are allowed to take from him the amount equal to the goods they had. They can cause corruption to his wealth and run away from him." The Shaykh said: "We have already reported the Hadith of Imran ibn Husain regarding the Muslim woman who took the she-camel and fled on it."
أَبُو الْعَاصِ بْنُ الرَّبِيعِ تَاجِرًا إِلَى الشَّامِ وَكَانَ رَجُلًا مَأْمُونًا وَكَانَتْ مَعَهُ بَضَائِعُ لِقُرَيْشٍ فَأَقْبَلَ قَافِلًا فَلَقِيَهُ سَرِيَّةٌ لِرَسُولِ اللهِ ﷺ فَاسْتَاقُوا عِيرَهُ وَأَفْلَتَ وَقَدِمُوا عَلَى رَسُولِ اللهِ ﷺ بِمَا أَصَابُوا فَقَسَمَهُ بَيْنَهُمْ وَأَتَى أَبُو الْعَاصِ حَتَّى دَخَلَ عَلَى زَيْنَبَ ؓ فَاسْتَجَارَ بِهَا وَسَأَلَهَا أَنْ تَطْلُبَ لَهُ مِنْ رَسُولِ اللهِ ﷺ رَدَّ مَالِهِ عَلَيْهِ وَمَا كَانَ مَعَهُ مِنْ أَمْوَالِ النَّاسِ فَدَعَا رَسُولُ اللهِ ﷺ السَّرِيَّةَ فَسَأَلَهُمْ فَرَدُّوا عَلَيْهِ ثُمَّ خَرَجَ حَتَّى قَدِمَ مَكَّةَ فَأَدَّى عَلَى النَّاسِ مَا كَانَ مَعَهُ مِنْ بَضَائِعِهِمْ حَتَّى إِذَا فَرَغَ قَالَ يَا مَعْشَرَ قُرَيْشٍ هَلْ بَقِيَ لِأَحَدٍ مِنْكُمْ مَعِي مَالٌ لَمْ أَرُدَّهُ عَلَيْهِ؟ قَالُوا لَا فَجَزَاكَ اللهُ خَيْرًا قَدْ وَجَدْنَاكَ وَفِيًّا كَرِيمًا فَقَالَ أَمَا وَاللهِ مَا مَنَعَنِي أَنْ أُسْلِمَ قَبْلَ أَنْ أَقْدَمَ عَلَيْكُمْ إِلَّا تَخَوُّفًا أَنْ تَظُنُّوا أَنِّي إِنَّمَا أَسْلَمْتُ لِأَذْهَبَ بِأَمْوَالِكُمْ فَإِنِّي أَشْهَدُ أَنْ لَا إِلَهَ إِلَّا اللهُ وَأَنَّ مُحَمَّدًا عَبْدُهُ وَرَسُولُهُ قَالَ الشَّافِعِيُّ فِي الْمُسْلِمِ إِذَا أُسِرَ وَلَمْ يُؤَمِّنُوهُ وَلَمْ يَأْخُذُوا عَلَيْهِ أَنَّهُمْ آمِنُونَ مِنْهُ فَلَهُ أَخْذُ مَا قَدَرَ عَلَيْهِ مِنْ أَمْوَالِهِمْ وَإِفْسَادُهُ وَالْهَرَبُ مِنْهُمْ قَالَ الشَّيْخُ قَدْ رَوَيْنَا حَدِيثَ عِمْرَانَ بْنِ حُصَيْنٍ ؓ فِي الْمَرْأَةِ الْمُسْلِمَةِ الَّتِي أَخَذَتِ النَّاقَةَ وَهَرَبَتْ عَلَيْهَا
58.126 [Machine] The captives seek help from the polytheists to fight against the polytheists. Al-Shafi'i, may Allah have mercy on him, said: It has been said that they were fought by Zubayr and his companions in the land of Abyssinia, polytheists fighting against polytheists. If someone were to say that he refrains from fighting them for certain reasons mentioned by Al-Shafi'i, it would be a valid viewpoint. We do not know if the news of Zubayr is substantiated. Even if it were substantiated, Al-Najashi, being a Muslim, would have believed in the Messenger of Allah ﷺ and prayed for him.
٥٨۔١٢٦ بَابُ الْأَسِيرِ يَسْتَعِينُ بِهِ الْمُشْرِكُونَ عَلَى قِتَالِ الْمُشْرِكِينَ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: قَدْ قِيلَ يُقَاتِلُهُمْ، قَدْ قَاتَلَ الزُّبَيْرُ وَأَصْحَابٌ لَهُ بِبِلَادِ الْحَبَشَةِ مُشْرِكِينَ عَنْ مُشْرِكِينَ , وَلَوْ قَالَ قَائِلٌ: يَمْتَنِعُ عَنْ قِتَالِهِمْ لِمَعَانٍ ذَكَرَهَا الشَّافِعِيُّ كَانَ مَذْهَبًا , وَلَا نَعْلَمُ خَبَرَ الزُّبَيْرِ يَثْبُتُ , وَلَوْ ثَبَتَ كَانَ النَّجَاشِيُّ مُسْلِمًا كَانَ آمَنَ بِرَسُولِ اللهِ ﷺ وَصَلَّى عَلَيْهِ النَّبِيُّ ﷺ.
[Machine] The Prophet's wife said when Mecca became too narrow for us, she mentioned the story of their migration to the land of Abyssinia and how Quraish sent 'Amr ibn Al-Aas and 'Abdullah ibn Abu Rabiah to Negus to have them expelled from his land and handed over to them. She also mentioned the story of Ja'far ibn Abi Talib and his companions seeking refuge with Negus. Negus asked them if they had anything from the Quran with them, and Ja'far read a portion of Surah Maryam to him. Negus and his bishops were moved to tears by the recitation. Then Negus said, "Indeed, this speech originates from the same source as that which was brought by Moses. You are free to go, guided." She then mentioned the story of their encounter with the Christians from Najran who came to argue with the Prophet about Jesus. When they came to argue, the Prophet asked them what they said about Jesus, and Ja'far replied, "We say that he is the servant of Allah, His Messenger, His Word which He bestowed on Maryam and a spirit from Him." Negus became so moved by his words that he took a stick and traced a line on the ground, saying, "By Allah, Jesus son of Mary did not go beyond what you have said." She went on to mention that while they were in Abyssinia, a man from Abyssinia challenged their leader in authority, and they sought the help of Allah and asked for His support against him. The man was defeated, killed, and Negus was victorious. The wife of the Prophet said that when the news reached them, Zubair, who was one of the youngest companions, blew on a knot in his garment, tied it to his chest, and entered the Nile, swimming until he reached the other side where the people had gathered. He then untied the knot and said, "Rejoice, for Allah has granted victory to Negus!" She concluded that they were never happier about anything as they were happy about the victory of Negus.
ؓ زَوْجِ النَّبِيِّ ﷺ أَنَّهَا قَالَتْ لَمَّا ضَاقَتْ عَلَيْنَا مَكَّةُ فَذَكَرَتِ الْحَدِيثَ فِي هِجْرَتِهِمْ إِلَى أَرْضِ الْحَبَشَةِ وَمَا كَانَ مِنْ بِعْثَةِ قُرَيْشٍ عَمْرَو بْنَ الْعَاصِ وَعَبْدَ اللهِ بْنَ أَبِي رَبِيعَةَ إِلَى النَّجَاشِيِّ لِيُخْرِجَهُمْ مِنْ بِلَادِهِ وَيَرُدَّهُمْ عَلَيْهِمْ وَمَا كَانَ مِنْ دُخُولِ جَعْفَرِ بْنِ أَبِي طَالِبٍ وَأَصْحَابِهِ ؓ عَلَى النَّجَاشِيِّ قَالَ فَقَالَ النَّجَاشِيُّ هَلْ مَعَكُمْ شَيْءٌ مِمَّا جَاءَ بِهِ؟ فَقَالَ لَهُ جَعْفَرٌ نَعَمْ فَقَرَأَ عَلَيْهِ صَدْرًا مِنْ كهيعص فَبَكَى وَاللهِ النَّجَاشِيُّ حَتَّى أَخْضَلَ لِحْيَتَهُ وَبَكَتْ أَسَاقِفَتُهُ حَتَّى أَخْضَلُوا مَضَاجِعَهُمْ ثُمَّ قَالَ إِنَّ هَذَا الْكَلَامَ لَيَخْرُجُ مِنَ الْمِشْكَاةِ الَّتِي جَاءَ بِهِ مُوسَى انْطَلِقُوا رَاشِدِينَ ثُمَّ ذَكَرَ الْحَدِيثَ فِي تَصْوِيرِهِمَا لَهُ أَنَّهُمْ يَقُولُونَ فِي عِيسَى ابْنِ مَرْيَمَ عَلَيْهِ السَّلَامُ أَنَّهُ عَبْدٌ فَدَخَلُوا عَلَيْهِ وَعِنْدَهُ بَطَارِقَتُهُ فَقَالَ مَا تَقُولُونَ فِي عِيسَى ابْنِ مَرْيَمَ عَلَيْهِ السَّلَامُ؟ فَقَالَ لَهُ جَعْفَرٌ نَقُولُ هُوَ عَبْدُ اللهِ وَرَسُولُهُ وَكَلِمَتُهُ وَرُوحُهُ أَلْقَاهَا إِلَى مَرْيَمَ الْعَذْرَاءِ الْبَتُولِ فَدَلَّى النَّجَاشِيُّ يَدَهُ إِلَى الْأَرْضِ فَأَخَذَ عُوَيْدًا بَيْنَ أُصْبُعَيْهِ فَقَالَ مَا عَدَا عِيسَى ابْنُ مَرْيَمَ مَا قُلْتَ هَذَا الْعُوَيْدَ ثُمَّ ذَكَرَ الْحَدِيثَ قَالَتْ فَلَمْ يَنْشَبْ أَنْ خَرَجَ عَلَيْهِ رَجُلٌ مِنَ الْحَبَشَةِ يُنَازِعُهُ فِي مُلْكِهِ فَوَاللهِ مَا عَلِمْتُنَا حَزِنَّا حُزْنًا قَطُّ كَانَ أَشَدَّ مِنْهُ فَرَقًا مِنْ أَنْ يَظْهَرَ ذَلِكَ الْمَلِكُ عَلَيْهِ فَيَأْتِي مَلِكٌ لَا يَعْرِفُ مِنْ حَقِّنَا مَا كَانَ يَعْرِفُ فَجَعَلْنَا نَدْعُو اللهَ وَنَسْتَنْصِرُهُ لِلنَّجَاشِيِّ فَخَرَجَ إِلَيْهِ سَائِرًا فَقَالَ أَصْحَابُ رَسُولِ اللهِ ﷺ بَعْضُهُمْ لِبَعْضٍ مَنْ رَجُلٌ يَخْرُجُ فَيَحْضُرُ الْوَقْعَةَ حَتَّى يَنْظُرَ عَلَى مَنْ تَكُونُ؟ فَقَالَ الزُّبَيْرُ ؓ وَكَانَ مِنْ أَحْدَثِهِمْ سِنًّا أَنَا فَنَفَخُوا لَهُ قِرْبَةً فَجَعَلَهَا فِي صَدْرِهِ ثُمَّ خَرَجَ يَسْبَحُ عَلَيْهَا فِي النِّيلِ حَتَّى خَرَجَ مِنَ الشِّقَّةِ الْأُخْرَى إِلَى حَيْثُ الْتَقَى النَّاسُ فَحَضَرَ الْوَقْعَةَ وَهَزَمَ اللهُ ذَلِكَ الْمَلِكَ وَقَتْلَهُ وَظَهَرَ النَّجَاشِيُّ عَلَيْهِ فَجَاءَنَا الزُّبَيْرُ ؓ فَجَعَلَ يُلِيحُ إِلَيْنَا بِرِدَائِهِ وَيَقُولُ أَلَا أَبْشِرُوا فَقَدْ أَظْهَرَ اللهُ النَّجَاشِيَّ فَوَاللهِ مَا فَرِحْنَا بِشَيْءٍ فَرَحَنَا بِظُهُورِ النَّجَاشِيِّ
58.127 [Machine] The prisoner is required to send them a ransom and return in their ransom. Al-Shafi'i, may Allah have mercy on him, said: It was narrated from Al-Awza'i: He should return in their ransom if they do not give him money. He said: And whoever adopts the approach of Al-Awza'i and says with his statement, he only argues with what I see based on what was narrated from some of them that it was narrated that the Prophet ﷺ permitted the people of Hudaybiyah to reject those who came to them from them after the peace treaty, except as Muslims. Abu Jandal came to him so he returned him to his father, and Abu Basir came to him so he returned him, and Abu Basir killed the returned one along with him. Then the Prophet ﷺ came and said: I have fulfilled my promise to them and Allah saved me from them. The Prophet ﷺ did not return him and did not blame him for it, and he left it. So he was on his way to Sham and was cutting off all property of the Quraysh until they asked the Messenger of Allah ﷺ to include him with them for what they suffered from him causing harm. Al-Shafi'i said: And this is a hadith that has been narrated by some of the people of Maghazi as I have described, and I do not remember mentioning its chain of narration. 18427 - The Shaykh said, Abu Abdullah Al-Hafiz informed us, Ahmed Ibn Ja'far Al-Qatti'i reported to us, Abdullah Ibn Ahmad Ibn Hanbal told me, my father narrated to me, Abdul Razzaq reported to me, from Ma'mar, Al-Zuhri said: Urwah Ibn Al-Zubair informed me, from Al-Miswar Ibn Makhramah and Marwan Ibn Al-Hakam, they mentioned the story of the peace treaty of Hudaybiyah, and they mentioned the story of Abu Jandal and Abu Basir in a similar manner to this, and he completed it from it. The Shaykh said: Indeed, the Prophet ﷺ only returned Abu Jandal to them because he did not fear for him in returning him to the place of his father, and likewise he indicated to Abu Basir to return to them in the beginning because of that. Allah knows best, and the words of Al-Shafi'i will be mentioned, if Allah wills, in his book on jizyah.
٥٨۔١٢٧ بَابُ الْأَسِيرِ يُؤْخَذُ عَلَيْهِ أَنْ يَبْعَثَ إِلَيْهِمْ بِفِدَاءٍ وَيَعُودَ فِي إِسَارِهِمْ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: رُوِيَ عَنِ الْأَوْزَاعِيِّ: يَعُودُ فِي إِسَارِهِمْ إِنْ لَمْ يُعْطِهِمُ الْمَالَ. قَالَ: وَمَنْ ذَهَبَ مَذْهَبَ الْأَوْزَاعِيِّ وَمَنْ قَالَ بِقَوْلِهِ فَإِنَّمَا يَحْتَجُّ فِيمَا أَرَاهُ بِمَا رُوِيَ عَنْ بَعْضِهِمْ أَنَّهُ رُوِيَ أَنَّ النَّبِيَّ ﷺ صَالَحَ أَهْلَ الْحُدَيْبِيَةِ أَنْ يَرُدَّ مَنْ جَاءَهُ مِنْهُمْ بَعْدَ الصُّلْحِ مُسْلِمًا , فَجَاءَهُ أَبُو جَنْدَلٍ فَرَدَّهُ إِلَى أَبِيهِ , وَأَبُو بَصِيرٍ فَرَدَّهُ فَقَتَلَ أَبُو بَصِيرٍ الْمَرْدُودَ مَعَهُ , ثُمَّ جَاءَ النَّبِيَّ ﷺ فَقَالَ: قَدْ وَفَّيْتُ لَهُمْ وَنَجَّانِي اللهُ مِنْهُمْ , فَلَمْ يَرُدَّهُ النَّبِيُّ ﷺ وَلَمْ يَعِبْ ذَلِكَ عَلَيْهِ وَتَرَكَهُ , فَكَانَ بِطَرِيقِ الشَّامِ يَقْطَعُ عَلَى كُلِّ مَالٍ لِقُرَيْشٍ حَتَّى سَأَلُوا رَسُولَ اللهِ ﷺ أَنْ يَضُمَّهُ إِلَيْهِ لِمَا نَالَهُمْ مِنْ أَذَاهُ. قَالَ الشَّافِعِيُّ: وَهَذَا حَدِيثٌ قَدْ رَوَاهُ بَعْضُ أَهْلِ الْمَغَازِي كَمَا وَصَفْتُ , وَلَا يَحْضُرُنِي ذِكْرُ إِسْنَادِهِ. 18427 - قَالَ الشَّيْخُ، أَخْبَرَنَاهُ أَبُو عَبْدِ اللهِ الْحَافِظُ، أَنْبَأَ أَحْمَدُ بْنُ جَعْفَرٍ الْقَطِيعِيُّ، ثنا عَبْدُ اللهِ بْنُ أَحْمَدَ بْنِ حَنْبَلٍ، حَدَّثَنِي أَبِي، ثنا عَبْدُ الرَّزَّاقِ، عَنْ مَعْمَرٍ، قَالَ الزُّهْرِيُّ: أَخْبَرَنِي عُرْوَةُ بْنُ الزُّبَيْرِ، عَنِ الْمِسْوَرِ بْنِ مَخْرَمَةَ، وَمَرْوَانَ بْنِ الْحَكَمِ، فَذَكَرَ حَدِيثَ صُلْحِ الْحُدَيْبِيَةِ , وَذَكَرَ فِيهِ قِصَّةَ أَبِي جَنْدَلٍ وَأَبِي بَصِيرٍ بِنَحْوٍ مِنْ هَذَا وَأَتَمَّ مِنْهُ -[244]- قَالَ الشَّيْخُ: وَإِنَّمَا رَدَّ النَّبِيُّ ﷺ أَبَا جَنْدَلٍ إِلَيْهِمْ؛ لَأَنَّهُ كَانَ لَا يَخَافُ عَلَيْهِ فِي الرَّدِّ لِمَكَانِ أَبِيهِ , وَكَذَلِكَ أَشَارَ عَلَى أَبِي بَصِيرٍ بِالرُّجُوعِ إِلَيْهِمْ فِي الِابْتِدَاءِ لِذَلِكَ وَاللهُ أَعْلَمُ وَسَيَرِدُ كَلَامُ الشَّافِعِيِّ إِنْ شَاءَ اللهُ عَلَيْهِ فِي كِتَابِ الْجِزْيَةِ
The Quraysh sent me to the Messenger of Allah ﷺ, and when I saw the Messenger of Allah ﷺ, Islam was cast into my heart, so I said: Messenger of Allah, I swear by Allah, I shall never return to them. The Messenger of Allah ﷺ replied: I do not break a covenant or imprison messengers, but return, and if you feel the same as you do just now, come back. So I went away, and then came to the Prophet ﷺ and accepted Islam. The narrator Bukair said: He informed me that Abu Rafi' was a Copt. Abu Dawud said: This was valid in those days, but today it is not valid. (Using translation from Abū Dāʾūd 2758)
أَخْبَرَهُ أَنَّهُ أَقْبَلَ بِكِتَابٍ مِنْ قُرَيْشٍ إِلَى رَسُولِ اللهِ ﷺ قَالَ فَلَمَّا رَأَيْتُ رَسُولَ اللهِ ﷺ أُلْقِيَ فِي قَلْبِي الْإِسْلَامُ فَقُلْتُ يَا رَسُولَ اللهِ إِنِّي وَاللهِ لَا أَرْجِعُ إِلَيْهِ أَبَدًا فَقَالَ رَسُولُ اللهِ ﷺ إِنِّي لَا أَخِيسُ بِالْعَهْدِ وَلَا أَحْبِسُ الْبُرُدَ وَلَكِنِ ارْجِعْ فَإِنْ كَانَ فِي قَلْبِكَ الَّذِي فِي قَلْبِكَ الْآنَ فَارْجِعْ قَالَ فَرَجَعْتُ إِلَيْهِمْ ثُمَّ أَقْبَلْتُ إِلَى النَّبِيِّ ﷺ فَأَسْلَمْتُ قَالَ بُكَيْرٌ وَأَخْبَرَنِي أَنَّ أَبَا رَافِعٍ كَانَ قِبْطِيًّا
[Machine] "So, we captured the disbelievers of Quraysh, and they said, 'You want Muhammad!' We replied, 'We do not want him, we only want the city.' So, they made a covenant with us in the name of Allah to let us go to the city and not fight with him. We went to the Prophet ﷺ and informed him of the news. He said, 'Go, fulfill their covenant, and seek Allah's help against them.'"
فَأَخَذَنَا كُفَّارُ قُرَيْشٍ فَقَالُوا إِنَّكُمْ تُرِيدُونَ مُحَمَّدًا فَقُلْنَا مَا نُرِيدُهُ مَا نُرِيدُ إِلَّا الْمَدِينَةَ فَأَخَذُوا عَلَيْنَا عَهْدَ اللهِ وَمِيثَاقَهُ لَنَنْصَرِفَنَّ إِلَى الْمَدِينَةِ وَلَا نُقَاتِلُ مَعَهُ فَأَتَيْنَا النَّبِيَّ ﷺ فَأَخْبَرْنَاهُ الْخَبَرَ فَقَالَ انْصَرِفَا نَفِي لَهُمْ بِعَهْدِهِمْ وَنَسْتَعِينُ بِاللهِ عَلَيْهِمْ
58.128 [Machine] What is permissible for the captive or the one who is brought to be killed, while the man is between the two rows in his property?
٥٨۔١٢٨ بَابُ مَا يَجُوزُ لِلْأَسِيرِ أَوْ مَنْ قُدِّمَ لِيُقْتَلَ وَالرَّجُلِ بَيْنَ الصَّفَّيْنِ فِي مَالِهِ
[Machine] That a man named Yazid ibn Abdullah ibn Zam'ah came on the Day of Harrah to kill himself, so he divorced his wife and did not consummate the marriage. They asked the people of knowledge, and they said she is entitled to half of the dowry, but she does not inherit from him.
أَنَّ مُسْرِفًا قَدَّمَ يَزِيدَ بْنَ عَبْدِ اللهِ بْنِ زَمْعَةَ يَوْمَ الْحَرَّةِ لِيَضْرِبَ عُنُقَهُ فَطَلَّقَ امْرَأَتَهُ وَلَمْ يَدْخُلْ بِهَا فَسَأَلُوا أَهْلَ الْعِلْمِ فَقَالُوا لَهَا نِصْفُ الصَّدَاقِ وَلَا مِيرَاثَ لَهَا
[Machine] That the majority of the charity of Zubayr, he would donate it and do good actions while he was on the back of his horse on the day of the Battle of the Camel. Al-Shafi'i said, and it was narrated from Umar ibn Abdul Aziz and Ibn Musayyib that they said: If a man fights while on the back of his horse, whatever he does is permissible. And it was narrated from Umar ibn Abdul Aziz that the charity of Hubla is permissible until she sits between the ropes. Al-Qasim ibn Muhammad and Ibn Musayyib said: The charity of the pregnant woman is permissible. Al-Shafi'i said: With all of this, we say that the hadith of Zubayr has been narrated in the book of Al-Wasaya in its entirety.
أَنَّ عَامَّةَ صَدَقَاتِ الزُّبَيْرِ ؓ تَصَدَّقَ بِهَا وَفَعَلَ أُمُورًا وَهُوَ وَاقِفٌ عَلَى ظَهْرِ فَرَسِهِ يَوْمَ الْجَمَلِ قَالَ الشَّافِعِيُّ ؓ وَرُوِيَ عَنْ عُمَرَ بْنِ عَبْدِ الْعَزِيزِ رَحِمَهُ اللهُ وَابْنِ الْمُسَيِّبِ رَحِمَهُ اللهُ أَنَّهُمَا قَالَا إِذَا كَانَ الرَّجُلُ عَلَى ظَهْرِ فَرَسِهِ يُقَاتِلُ فَمَا صَنَعَ فَهُوَ جَائِزٌ وَرُوِي عَنْ عُمَرَ بْنِ عَبْدِ الْعَزِيزِ رَحِمَهُ اللهُ عَطِيَّةُ الْحُبْلَى جَائِزَةٌ حَتَّى تَجْلِسَ بَيْنَ الْقَوَابِلِ وَقَالَ الْقَاسِمُ بْنُ مُحَمَّدٍ وَابْنُ الْمُسَيِّبِ عَطِيَّةُ الْحَامِلِ جَائِزَةٌ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ وَبِهَذَا كُلِّهِ نَقُولُ قَالَ الشَّيْخُ حَدِيثُ الزُّبَيْرِ ؓ قَدْ رَوَيْنَاهُ فِي كِتَابِ الْوَصَايَا بِطُولِهِ
58.129 [Machine] The prayer of the prisoner when he is brought to be killed
٥٨۔١٢٩ بَابُ صَلَاةِ الْأَسِيرِ إِذَا قُدِّمَ لِيُقْتَلَ
Messenger of Allah ﷺ sent a Sariya of ten men as spies under the leadership of ʿAsim bin Thabit al-Ansari, the grandfather of ʿAsim bin ʿUmar Al-Khattab. They proceeded till they reached Hadaa, a place between 'Usfan, and Mecca, and their news reached a branch of the tribe of Hudhail called Bani Lihyan. About two-hundred men, who were all archers, hurried to follow their tracks till they found the place where they had eaten dates they had brought with them from Medina. They said, "These are the dates of Yathrib (i.e. Medina), "and continued following their tracks When ʿAsim and his companions saw their pursuers, they went up a high place and the infidels circled them. The infidels said to them, "Come down and surrender, and we promise and guarantee you that we will not kill any one of you" ʿAsim bin Thabit; the leader of the Sariya said, "By Allah! I will not come down to be under the protection of infidels. O Allah! Convey our news to Your Prophet. Then the infidels threw arrows at them till they martyred ʿAsim along with six other men, and three men came down accepting their promise and convention, and they were Khubaib-al-Ansari and Ibn Dathina and another man So, when the infidels captured them, they undid the strings of their bows and tied them. Then the third (of the captives) said, "This is the first betrayal. By Allah! I will not go with you. No doubt these, namely the martyred, have set a good example to us." So, they dragged him and tried to compel him to accompany them, but as he refused, they killed him. They took Khubaid and Ibn Dathina with them and sold them (as slaves) in Mecca (and all that took place) after the battle of Badr. Khubaib was bought by the sons of Al-Harith bin 'Amir bin Naufal bin ʿAbd Manaf. It was Khubaib who had killed Al-Harith bin 'Amir on the day (of the battle of) Badr. So, Khubaib remained a prisoner with those people. Narrated Az-Zuhri: 'Ubaidullah bin 'Iyyad said that the daughter of Al-Harith had told him, "When those people gathered (to kill Khubaib) he borrowed a razor from me to shave his pubes and I gave it to him. Then he took a son of mine while I was unaware when he came upon him. I saw him placing my son on his thigh and the razor was in his hand. I got scared so much that Khubaib noticed the agitation on my face and said, 'Are you afraid that I will kill him? No, I will never do so.' By Allah, I never saw a prisoner better than Khubaib. By Allah, one day I saw him eating of a bunch of grapes in his hand while he was chained in irons, and there was no fruit at that time in Mecca." The daughter of Al-Harith used to say, "It was a boon Allah bestowed upon Khubaib." When they took him out of the Sanctuary (of Mecca) to kill him outside its boundaries, Khubaib requested them to let him offer two rakʿat (prayer). They allowed him and he offered Two rakʿat and then said, "Hadn't I been afraid that you would think that I was afraid (of being killed), I would have prolonged the prayer. O Allah, kill them all with no exception." (He then recited the poetic verse):-- "I being martyred as a Muslim, Do not mind how I am killed in Allah's Cause, For my killing is for Allah's Sake, And if Allah wishes, He will bless the amputated parts of a torn body" Then the son of Al Harith killed him. So, it was Khubaib who set the tradition for any Muslim sentenced to death in captivity, to offer a two-rakʿat prayer (before being killed). Allah fulfilled the invocation of ʿAsim bin Thabit on that very day on which he was martyred. The Prophet ﷺ informed his companions of their news and what had happened to them. Later on when some infidels from Quraish were informed that ʿAsim had been killed, they sent some people to fetch a part of his body (i.e. his head) by which he would be recognized. (That was because) ʿAsim had killed one of their chiefs on the day (of the battle) of Badr. So, a swarm of wasps, resembling a shady cloud, were sent to hover over ʿAsim and protect him from their messenger and thus they could not cut off anything from his flesh. رَسُولُ اللهِ ﷺ عَشَرَةَ رَهْطٍ عَلَيْنَا وَأَمَّرَ عَلَيْهِمْ عَاصِمَ بْنَ ثَابِتِ بْنِ أَبِي الْأَقْلَحِ وَهُوَ جَدُّ عَاصِمٍ يَعْنِي ابْنَ عُمَرَ بْنِ الْخَطَّابِ ؓ فَانْطَلَقُوا حَتَّى إِذَا كَانُوا بِالْهَدَةِ بَيْنَ عُسْفَانَ وَمَكَّةَ ذُكِرُوا لِحَيٍّ مِنْ هُذَيْلٍ يُقَالُ لَهُمْ بَنُو لِحْيَانَ فَنَفَرُوا لَهُمْ بِمِائَةِ رَجُلٍ رَامٍ فَاتَّبَعُوا آثَارَهُمْ حَتَّى وَجَدُوا مَأْكَلَهُمُ التَّمْرَ فَقَالُوا هَذَا تَمْرُ يَثْرِبَ فَلَمَّا أَحَسَّ بِهِمْ عَاصِمٌ وَأَصْحَابُهُ ؓ لَجَؤُوا إِلَى قَرْدَدٍ يَعْنِي فَأَحَاطَ بِهِمُ الْقَوْمُ فَقَالُوا انْزِلُوا وَلَكُمُ الْعَهْدُ وَالْمِيثَاقُ أَنْ لَا يُقْتَلَ مِنْكُمْ أَحَدٌ فَقَالَ عَاصِمٌ أَمَّا أَنَا فَوَاللهِ لَا أَنْزِلُ فِي ذِمَّةِ كَافِرٍ الْيَوْمَ اللهُمَّ بَلِّغْ عَنَّا نَبِيِّكَ السَّلَامَ فَقَاتَلُوهُمْ فَقُتِلَ مِنْهُمْ سَبْعَةٌ وَنَزَلَ ثَلَاثَةٌ عَلَى الْعَهْدِ وَالْمِيثَاقِ فَلَمَّا اسْتَمْكَنُوا مِنْهُمْ حَلُّوا أَوْتَارَ قِسِيِّهِمْ وَكَتَّفُوهُمْ فَلَمَّا رَأَى ذَلِكَ مِنْهُمْ أَحَدُ الثَّلَاثَةِ قَالَ هُوَ وَاللهِ أَوَّلُ الْغَدْرِ فَعَالَجُوهُ فَقَتَلُوهُ وَانْطَلَقُوا بِخُبَيْبِ بْنِ عَدِيٍّ وَزَيْدِ بْنِ الدَّثِنَةِ فَانْطَلَقُوا بِهِمَا إِلَى مَكَّةَ فَبَاعُوهُمَا وَذَلِكَ بَعْدَ وَقْعَةِ بَدْرٍ فَاشْتَرَى بَنُو الْحَارِثِ خُبَيْبًا وَكَانَ قَتَلَ الْحَارِثَ يَوْمَ بَدْرٍ قَالَتِ ابْنَةُ الْحَارِثِ وَكَانَ خُبَيْبٌ أَسِيرًا عِنْدَنَا فَوَاللهِ إِنْ رَأَيْتُ أَسِيرًا قَطُّ كَانَ خَيْرًا مِنْ خُبَيْبٍ وَاللهِ لَقَدْ رَأَيْتُهُ يَأْكُلُ قِطْفًا مِنْ عِنَبٍ وَمَا بِمَكَّةَ يَوْمَئِذٍ مِنْ ثَمَرَةٍ وَإِنْ هُوَ إِلَّا رِزْقٌ رَزَقَهُ اللهُ خُبَيْبًا قَالَتْ فَاسْتَعَارَ مِنِّي مُوسًى يَسْتَحِدُّ بِهِ لِلْقَتْلِ قَالَتْ فَأَعَرْتُهُ إِيَّاهُ وَدَرَجَ بُنَيٌّ لِي وَأَنَا غَافِلَةٌ فَرَأَيْتُهُ مُجْلِسَهُ عَلَى صَدْرِهِ قَالَتْ فَفَزِعْتُ فَزْعَةً عَرَفَهَا خُبَيْبٌ قَالَتْ فَفَطِنَ بِي فَقَالَ أَتَحْسَبِينَنِي أَنِّي قَاتِلُهُ؟ مَا كُنْتُ لِأَفْعَلَهُ قَالَتْ فَلَمَّا أَجْمَعُوا عَلَى قَتْلِهِ قَالَ لَهُمْ دَعُونِي أُصَلِّي رَكْعَتَيْنِ قَالَتْ فَصَلَّى رَكْعَتَيْنِ فَقَالَ لَوْلَا أَنْ تَحْسَبُوا أَنَّ بِي جَزَعًا لَزِدْتُ قَالَ فَكَانَ خُبَيْبٌ أَوَّلَ مَنْ سَنَّ الصَّلَاةَ لِمَنْ قُتِلَ صَبْرًا ثُمَّ قَالَ اللهُمَّ أَحْصِهِمْ عَدَدًا وَاقْتُلْهُمْ بَدَدًا وَلَا تُبْقِ مِنْهُمْ أَحَدًا وَأَنْشَأَ يَقُولُ [البحر الطويل] فَلَسْتُ أُبَالِي حِينَ أُقْتَلُ مُسْلِمًا عَلَى أِيِّ حَالٍ كَانَ فِي اللهِ مَصْرَعِي وَذَلِكَ فِي جَنْبِ الْإِلَهِ وَإِنْ يَشَأْ يُبَارِكْ عَلَى أَوْصَالِ شِلْوٍ مُمَزَّعِ قَالَ وَبَعَثَ الْمُشْرِكُونَ إِلَى عَاصِمِ بْنِ ثَابِتٍ لِيُؤْتَوْا مِنْ لَحْمِهِ بِشَيْءٍ وَكَانَ قَتَلَ رَجُلًا مِنْ عُظَمَائِهِمْ فَبَعَثَ اللهُ مِثْلَ الظُّلَّةِ مِنَ الدَّبْرِ فَحَمَتْهُ مِنْ رُسُلِهِمْ فَلَمْ يَسْتَطِيعُوا أَنْ يَأْخُذُوا مِنْ لَحْمِهِ شَيْئًا 18433 أَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنبأ مُحَمَّدُ بْنُ بَكْرٍ ثنا أَبُو دَاوُدَ ثنا مُوسَى بْنُ إِسْمَاعِيلَ ثنا إِبْرَاهِيمُ يَعْنِي ابْنَ سَعْدٍ أنبأ ابْنُ شِهَابٍ أَخْبَرَنِي عَمْرُو بْنُ جَارِيَةَ الثَّقَفِيُّ حَلِيفُ بَنِي زُهْرَةَ عَنْ أَبِي هُرَيْرَةَ ؓ فَذَكَرَهُ بِمَعْنَاهُ مُخْتَصَرًا دُونَ الشِّعْرِ وَدُونَ قِصَّةِ عَاصِمٍ فِي آخِرِهِ
58.130 [Machine] The Muslim guides the polytheists to the flaws of the Muslims.
٥٨۔١٣٠ بَابُ الْمُسْلِمِ يَدُلُّ الْمُشْرِكِينَ عَلَى عَوْرَةِ الْمُسْلِمِينَ
I heard ‘Ali ؓ say: The Messenger of Allah ﷺ sent me, az-Zubair and al-Miqdad, and he said: “Go to the garden of Khakh, where you will find a woman riding a camel with whom there is a letter, and take it from her.” We set out with our horses galloping, until we reached that garden, and there we found the woman. We said: Give us the letter. She said: I do not have any letter. We said: Either you give us the letter or we will remove your clothes. So she brought it out from her braided hair, and we took it and brought it to the Messenger of Allah ﷺ and in it (was written): From Hatib bin Abi Baltaʿah to some of the mushrikeen of Makkah, telling them about some of the plans of the Messenger of Allah ﷺ, The Messenger of Allah ﷺ said: ʿO Hatib, what is this?ʿ He said: Do not be hasty in judging me, O Messenger of Allah ﷺ. I am a man who was attached to Quraish but I was one of them. The Muhajireen who are with you have relatives who will protect their families in Makkah, and I wanted, as i have no blood ties among them, to do them a favour so that they would protect my family. I did not do it out of kufr or because I apostatized from my religion, or because I approved of Kufr after becoming Muslim. The Messenger of Allah ﷺ said: ʿHe has told you the truth.ʿ ʿUmar ؓ said: O Messenger of Allah ﷺ, let me strike the neck of this hypocrite. He said: “He was present at Badr, and you do not know, perhaps Allah looked upon the people of Badr and said: ʿDo what you wish, for I have forgiven you.ʿ (Using translation from Aḥmad 600)
بَعَثَنَا رَسُولُ اللهِ ﷺ أَنَا وَالزُّبَيْرَ وَالْمِقْدَادَ فَقَالَ انْطَلِقُوا حَتَّى تَأْتُوا رَوْضَةَ خَاخٍ فَإِنَّ بِهَا ظَعِينَةً مَعَهَا كِتَابٌ فَخَرَجْنَا تَعَادَى بِنَا خَيْلُنَا فَإِذَا نَحْنُ بِظَعِينَةٍ فَقُلْنَا أَخْرِجِي الْكِتَابَ فَقَالَتْ مَا مَعِي كِتَابٌ فَقُلْنَا لَهَا لَتُخْرِجِنَّ الْكِتَابَ أَوْ لَتُلْقِينَّ الثِّيَابَ فَأَخْرَجَتْهُ مِنْ عِقَاصِهَا فَأَتَيْنَا بِهِ رَسُولَ اللهِ ﷺ فَإِذَا فِيهِ مِنْ حَاطِبِ بْنِ أَبِي بَلْتَعَةَ إِلَى أُنَاسٍ مِنَ الْمُشْرِكِينَ مِمَّنْ بِمَكَّةَ يُخْبِرُ بِبَعْضِ أَمْرِ النَّبِيِّ ﷺ فَقَالَ مَا هَذَا يَا حَاطِبُ ؟ قَالَ لَا تَعْجَلْ عَلَيَّ إِنِّي كُنْتُ امْرَأً مُلْصَقًا فِي قُرَيْشٍ وَلَمْ أَكُنْ مِنْ أَنْفُسِهَا وَكَانَ مَنْ مَعَكَ مِنَ الْمُهَاجِرِينَ لَهُمْ قَرَابَاتٌ يَحْمُونَ بِهَا قَرَابَاتِهِمْ وَلَمْ يَكُنْ لِي بِمَكَّةَ قَرَابَةٌ فَأَحْبَبْتُ إِذْ فَاتَنِي ذَلِكَ أَنْ أَتَّخِذَ عِنْدَهُمْ يَدًا وَاللهِ مَا فَعَلْتُهُ شَكًّا فِي دِينِي وَلَا رِضًا بِالْكُفْرِ بَعْدَ الْإِسْلَامِ فَقَالَ رَسُولُ اللهِ ﷺ إِنَّهُ قَدْ صَدَقَ فَقَالَ عُمَرُ ؓ يَا رَسُولَ اللهِ دَعْنِي أَضْرِبْ عُنُقَ هَذَا الْمُنَافِقِ فَقَالَ النَّبِيُّ ﷺ إِنَّهُ قَدْ شَهِدَ بَدْرًا وَمَا يُدْرِيكَ لَعَلَّ اللهَ اطَّلَعَ عَلَى أَهْلِ بَدْرٍ فَقَالَ اعْمَلُوا مَا شِئْتُمْ فَقَدْ غَفَرْتُ لَكُمْ وَنَزَلَتْ {يَا أَيُّهَا الَّذِينَ آمَنُوا لَا تَتَّخِذُوا عَدُوِّي وَعَدُوَّكُمْ أَوْلِيَاءَ تُلْقُونَ إِلَيْهِمْ بِالْمَوَدَّةِ} [الممتحنة 1]
[Machine] Abu Abdurrahman, I heard him saying that Ali said: Hattab ibn Abi Balta'ah wrote to Mecca, saying: "Indeed, Muhammad intends to attack you with his companions, so be cautious." He sent his letter to a woman known as Sara, who placed it in her garment or in one of its folds, and then she set off. Allah informed the Messenger of Allah ﷺ about that. Ali said: "So the Messenger of Allah ﷺ sent me with Zubair ibn Al-Awam and Abu Marthad Al-Ghanawi, and all of us were horsemen. He said: Set out, as you will meet her in Rawdah, such and such, so search her, as she carries a letter to the people of Mecca from Hattab." So we set out and met her. We said: Hand over the letter you have to the people of Mecca. She replied: I don't have any letter with me. I said: By Allah, neither did I lie nor forge it. Either she would produce it or I would strip her. When she knew that I was serious, she brought out the letter. So we took it and set off with it to the Messenger of Allah ﷺ , who opened it and read it. It contained the letter of Hattab to the people of Mecca saying: "After this, Muhammad intends to attack you, so be cautious and prepared." When the Messenger of Allah ﷺ finished reading the letter, he sent for Hattab and asked him: "Did you write this letter?" He replied: "Yes." The Messenger of Allah ﷺ asked: "What prompted you to do so?" He said: "By Allah, I have never disbelieved since I embraced Islam. I believe in Allah and His Messenger. I only did this because there is no one among your companions in Mecca who protects his family and property, while I have no one there who protects my family and property, so I wanted to have someone to rely on among the people. Indeed, I know that Allah will support His Messenger." The Messenger of Allah ﷺ believed him and accepted his statement. Umar ibn Al-Khattab (May Allah be pleased with him) got up and said: "O Messenger of Allah! Let me kill him, for he has betrayed Allah and the believers." The Messenger of Allah ﷺ replied: "O Umar! He is from the people of Badr, and who knows, perhaps Allah has looked at them and said: 'Do as you like, for I have forgiven you."
أَبُو عَبْدِ الرَّحْمَنِ سَمِعْتُهُ يُحَدِّثُ يَعْنِي عَلِيًّا ؓ قَالَ كَتَبَ حَاطِبُ بْنُ أَبِي بَلْتَعَةَ إِلَى مَكَّةَ إِنَّ مُحَمَّدًا يُرِيدُ أَنْ يَغْزُوَكُمْ بِأَصْحَابِهِ فَخُذُوا حِذْرَكُمْ وَدَفَعَ كِتَابَهُ إِلَى امْرَأَةٍ يُقَالُ لَهَا سَارَّةُ فَجَعَلَتْهُ فِي إِزَارِهَا أَوْ فِي ذُؤَابَةٍ مِنْ ذَوَائِبِهَا فَانْطَلَقَتْ فَأَطْلَعَ اللهُ رَسُولَ اللهِ ﷺ عَلَى ذَلِكَ قَالَ عَلِيٌّ فَبَعَثَنِي وَمَعِيَ الزُّبَيْرُ بْنُ الْعَوَّامِ وَأَبُو مَرْثَدٍ الْغَنَوِيُّ وَكُلُّنَا فَارِسٌ قَالَ انْطَلِقُوا فَإِنَّكُمْ سَتَلْقَوْنَهَا بِرَوْضَةِ كَذَا وَكَذَا فَفَتِّشُوهَا فَإِنَّ مَعَهَا كِتَابًا إِلَى أَهْلِ مَكَّةَ مِنْ حَاطِبٍ فَانْطَلَقْنَا فَوَافَقْنَاهَا فَقُلْنَا هَاتِي الْكِتَابَ الَّذِي مَعَكِ إِلَى أَهْلِ مَكَّةَ فَقَالَتْ مَا مَعِي كِتَابٌ قَالَ قُلْتُ مَا كَذَبْتُ وَلَا كُذِبْتُ لَتُخْرِجِنَّهُ أَوْ لَأُجَرِّدَنَّكِ فَلَمَّا عَرَفَتْ أَنِّي فَاعِلٌ أَخْرَجَتِ الْكِتَابَ فَأَخَذْنَاهُ فَانْطَلَقْنَا بِهِ إِلَى رَسُولِ اللهِ ﷺ فَفَتَحَهُ فَقَرَأَهُ فَإِذَا فِيهِ مِنْ حَاطِبٍ إِلَى أَهْلِ مَكَّةَ أَمَّا بَعْدُ فَإِنَّ مُحَمَّدًا يُرِيدُكُمْ فَخُذُوا حِذْرَكُمْ وَتَأَهَّبُوا أَوْ كَمَا قَالَ فَلَمَّا قَرَأَ الْكِتَابَ أَرْسَلَ إِلَى حَاطِبٍ فَقَالَ لَهُ أَكَتَبْتَ هَذَا الْكِتَابَ؟ قَالَ نَعَمْ قَالَ فَمَا حَمَلَكَ عَلَى ذَلِكَ؟ قَالَ يَا رَسُولَ اللهِ أَمَا وَاللهِ مَا كَفَرْتُ مُنْذُ أَسْلَمْتُ وَإِنِّي لِمُؤْمِنٌ بِاللهِ وَرَسُولِهِ وَمَا حَمَلَنِي عَلَى مَا صَنَعْتُ مِنْ كِتَابِي إِلَى أَهْلِ مَكَّةَ إِلَّا أَنَّهُ لَمْ يَكُنْ أَحَدٌ مِنْ أَصْحَابِكَ إِلَّا وَلَهُ هُنَاكَ بِمَكَّةَ مَنْ يَدْفَعُ عَنْ أَهْلِهِ وَمَالِهِ وَلَمْ يَكُنْ لِي هُنَاكَ أَحَدٌ يَدْفَعُ عَنْ أَهْلِي وَمَالِي فَأَحْبَبْتُ أَنْ أَتَّخِذَ عِنْدَ الْقَوْمِ يَدًا وَإِنِّي لَأَعْلَمُ أَنَّ اللهَ سَيُظْهِرُ رَسُولَهُ عَلَيْهِمْ قَالَ فَصَدَّقَهُ رَسُولُ اللهِ ﷺ وَقَبِلَ قَوْلَهُ قَالَ فَقَامَ عُمَرُ بْنُ الْخَطَّابِ ؓ فَقَالَ يَا رَسُولَ اللهِ دَعْنِي فَأَضْرِبَ عُنُقَهُ؛ فَإِنَّهُ قَدْ خَانَ اللهَ وَالْمُؤْمِنِينَ فَقَالَ رَسُولُ اللهِ ﷺ يَا عُمَرُ إِنَّهُ مِنْ أَهْلِ بَدْرٍ وَمَا يُدْرِيكَ لَعَلَّ اللهَ اطَّلَعَ عَلَيْهِمْ فَقَالَ اعْمَلُوا مَا شِئْتُمْ فَقَدْ غَفَرْتُ لَكُمْ
58.131 [Machine] The spy from the people of war.
٥٨۔١٣١ بَابُ الْجَاسُوسِ مِنْ أَهْلِ الْحَرْبِ
Ibn Salamah bin Al Akwa’ repoted on the authority of his father. A spy of the polytheists came to the Prophet ﷺ when he was on a journey. He sat near his Companions and then slipped away. The Prophet ﷺ said “look for him and kill him”. He said “I raced to him and killed him. I took his belongings which he (the Prophet) gave me. (Using translation from Abū Dāʾūd 2653)
أَتَى رَسُولَ اللهِ ﷺ عَيْنٌ مِنَ الْمُشْرِكِينَ وَهُوَ فِي سَفَرٍ قَالَ فَجَلَسَ فَتَحَدَّثَ عِنْدَ أَصْحَابِهِ ثُمَّ انْسَلَّ فَقَالَ النَّبِيُّ ﷺ اطْلُبُوهُ فَاقْتُلُوهُ قَالَ فَسَبَقْتُهُمْ إِلَيْهِ فَقَتَلْتُهُ وَأَخَذْتُ سَلَبَهُ
The Messenger of Allah ﷺ commanded to kill him: he was a spy of AbuSufyan and an ally of a man of the Ansar. He passed a circle of the Ansar and said: I am a Muslim. A man from the Ansar said, Messenger of Allah, he is saying that he is a Muslim. The Messenger of Allah ﷺ said: There are people among you in whose faith we trust. Furat ibn Hayyan is one of them. عَنِ الْفُرَاتِ بْنِ حَيَّانَ وَكَانَ رَسُولُ اللهِ ﷺ قَدْ أَمَرَ بِقَتْلِهِ وَكَانَ عَيْنًا لِأَبِي سُفْيَانَ وَحَلِيفًا أَظُنُّهُ قَالَ لِرَجُلٍ مِنَ الْأَنْصَارِ فَمَرَّ عَلَى حَلْقَةٍ مِنَ الْأَنْصَارِ فَقَالَ إِنِّي مُسْلِمٌ فَقَامَ رَجُلٌ مِنْهُمْ فَقَالَ يَا رَسُولَ اللهِ يَقُولُ إِنِّي مُسْلِمٌ فَقَالَ رَسُولُ اللهِ ﷺ إِنَّ مِنْهُمْ رِجَالًا نَكِلُهُمْ إِلَى إِيمَانِهِمْ مِنْهُمُ الْفُرَاتُ بْنُ حَيَّانَ
58.132 [Machine] The answer to "الْأَسِيرِ يُسْتَطْلَعُ مِنْهُ خَبَرُ الْمُشْرِكِينَ" in English is: "The prisoner is interrogated about the disbelievers.
٥٨۔١٣٢ بَابُ الْأَسِيرِ يُسْتَطْلَعُ مِنْهُ خَبَرُ الْمُشْرِكِينَ
Anas said “The Apostle of Allaah ﷺ called on his Companions and they proceeded towards Badr. Suddenly they found the watering Camels of the Quraish, there was among them a black slave of Banu Al Hajjaj. The Companions of the Apostle of Allaah ﷺ seized him and began to ask “Where is Abu Sufyan?” He said “I swear by Allaah, I do not know anything about him, but this is the Quraish who have come here, among them are Abu Jahl, ‘Utbah, Shaibah the two sons of Rabi’ah and Umayyah bin Khalaf. When he aid this to them, they beat him and he began to say “Leave me, leave me. I shall tell you. When they left him he said “I know nothing about Abu Sufyan, but this is the Quraish who have come (here), among them are Abu Jahl, ‘Utbah, Shaibah the two sons of Rab’iah and Umayyah bin Khalaf who have come here. The Prophet ﷺ was praying and hearing all that (dialogue). When he finished, he said “By Him in Whose hand my soul is, you beat him when he speaks the truth to you and you leave him when he tells a lie. This is the Quraish who have come here to defend Abu Sufyan. Anas said, The Apostle of Allaah ﷺ said “This will be the place of falling of so and so tomorrow and he placed his hand on the ground. This will be the place of falling of so and so tomorrow and he put his hand on the ground. And this will be the place of falling of so and so tomorrow and he put his hand on the ground. He (Ansas) said “By Him in Whose hand my soul is, no one fell beyond the place of the hand of the Apostle of Allaah ﷺ, The Apostle of Allaah ﷺ ordered for them, and they were caught by their feet and dragged and thrown in a well at Badr. أَنَّ رَسُولَ اللهِ ﷺ نَدَبَ أَصْحَابَهُ فَانْطَلَقَ إِلَى بَدْرٍ فَإِذَا هُمْ بِرَوَايَا قُرَيْشٍ فِيهَا عَبْدٌ أَسْوَدُ لِبَنِي الْحَجَّاجِ فَأَخَذَهُ أَصْحَابُ النَّبِيِّ ﷺ فَجَعَلُوا يَسْأَلُونَهُ أَيْنَ أَبُو سُفْيَانَ؟ فَيَقُولُ وَاللهِ وَاللهِ مَا لِي بِشَيْءٍ مِنْ أَمْرِهِ عِلْمٌ وَلَكِنْ هَذِهِ قُرَيْشٌ قَدْ جَاءَتْ فِيهِمْ أَبُو جَهْلٍ وَعُتْبَةُ وَشَيْبَةُ ابْنَا رَبِيعَةَ وَأُمَيَّةُ بْنُ خَلَفٍ فَإِذَا قَالَ لَهُمْ ذَلِكَ ضَرَبُوهُ فَيَقُولُ دَعُونِي دَعُونِي أُخْبِرْكُمْ فَإِذَا تَرَكُوهُ قَالَ وَاللهِ مَا لِي بِأَبِي سُفْيَانَ مِنْ عِلْمٍ وَلَكِنْ هَذِهِ قُرَيْشٌ قَدْ أَقْبَلَتْ فِيهِمْ أَبُو جَهْلٍ وَعُتْبَةُ وَشَيْبَةُ ابْنَا رَبِيعَةَ وَأُمَيَّةُ بْنُ خَلَفٍ قَدْ أَقْبَلُوا وَالنَّبِيُّ ﷺ يُصَلِّي وَهُوَ يَسْمَعُ ذَلِكَ فَلَمَّا انْصَرَفَ قَالَ وَالَّذِي نَفْسِي بِيَدِهِ إِنَّكُمْ لَتَضْرِبُونَهُ إِذَا صَدَقَكُمْ وَتَدَعُونَهُ إِذَا كَذَبَكُمْ هَذِهِ قُرَيْشٌ قَدْ أَقْبَلَتْ لِتَمْنَعَ أَبَا سُفْيَانَ قَالَ أَنَسٌ ؓ قَالَ رَسُولُ اللهِ ﷺ هَذَا مَصْرَعُ فُلَانٍ غَدًا وَوَضَعَ يَدَهُ عَلَى الْأَرْضِ وَهَذَا مَصْرَعُ فُلَانٍ غَدًا وَوَضَعَ يَدَهُ عَلَى الْأَرْضِ وهَذَا مَصْرَعُ فُلَانٍ غَدًا وَوَضَعَ يَدَهُ عَلَى الْأَرْضِ فَقَالَ وَالَّذِي نَفْسِي بِيَدِهِ مَا جَاوَزَ أَحَدٌ مِنْهُمْ عَنْ مَوْضِعِ يَدِ رَسُولِ اللهِ ﷺ وَأَمَرَ بِهِمْ رَسُولُ اللهِ ﷺ فَأَخَذَ بِأَرْجُلِهِمْ فَسُحِبُوا فَأُلْقُوا فِي قَلِيبِ بَدْرٍ
58.133 [Machine] Sending the eyes and vanguard of the Muslims.
٥٨۔١٣٣ بَابُ بَعْثِ الْعُيُونِ وَالطَّلَائِعِ مِنَ الْمُسْلِمِينَ
[Machine] The Messenger of Allah ﷺ sent Buseyta to see what Abu Sufyan's camel did. So he came, and there was no one in the house except me and the Messenger of Allah ﷺ. So he narrated the hadith to him.
بَعَثَ رَسُولُ اللهِ ﷺ بُسَيْسَةَ عَيْنًا يَنْظُرُ مَا صَنَعَ عِيرُ أَبِي سُفْيَانَ قَالَ فَجَاءَ وَمَا فِي الْبَيْتِ أَحَدٌ غَيْرِي وَغَيْرُ رَسُولِ اللهِ ﷺ فَحَدَّثَهُ الْحَدِيثَ
On the day of Al-Ahzab (i.e. clans), Messenger of Allah ﷺ said, 'Who will bring us the news of the people (i.e. the clans of Quraish infidels)?" Az-Zubair said, "I." The Prophet ﷺ again said, "Who will bring us the news of the people?" AzZubair said, "I." The Prophet ﷺ again said, "Who will bring us the news of the people?" Az-Zubair said, "I." The Prophet ﷺ then said, "Every prophet has his Hawari (i.e. disciplespecial helper); my disciple is Az-Zubair. (Using translation from Bukhārī 4113)
قَالَ رَسُولُ اللهِ ﷺ يَوْمَ الْأَحْزَابِ مَنْ يَأْتِينِي بِخَبَرِ الْقَوْمِ؟ فَقَالَ الزُّبَيْرُ أَنَا ثُمَّ قَالَ مَنْ يَأْتِينِي بِخَبَرِ الْقَوْمِ؟ فَقَالَ الزُّبَيْرُ أَنَا ثُمَّ قَالَ مَنْ يَأْتِينِي بِخَبَرِ الْقَوْمِ؟ فَقَالَ الزُّبَيْرُ أَنَا فَقَالَ النَّبِيُّ ﷺ إِنَّ لِكُلِّ نَبِيٍّ حَوَارِيًّا وَحَوَارِيَّ الزُّبَيْرُ
[Machine] I heard Jaabir ibn Abdullah say that the Messenger of Allah ﷺ called upon the people on the day of the trench, then he called upon Zubair and then he called upon him again, and then he called upon Zubair. The Prophet ﷺ said, "Every prophet has disciples, and my disciple is Zubair." Sufyan said that Hisham ibn Urwah added, "And the disciples of Zubair are Ibn Ammatai."
سَمِعْتُ جَابِرَ بْنَ عَبْدِ اللهِ ؓ يَقُولُ نَدَبَ رَسُولُ اللهِ ﷺ النَّاسَ يَوْمَ الْخَنْدَقِ فَانْتَدَبَ الزُّبَيْرُ ثُمَّ نَدَبَهُمْ فَانْتَدَبَ الزُّبَيْرُ ثُمَّ نَدَبَهُمْ فَانْتَدَبَ الزُّبَيْرُ فَقَالَ النَّبِيُّ ﷺ لِكُلِّ نَبِيٍّ حَوَارِيٌّ وَحَوَارِيَّ الزُّبَيْرُ قَالَ سُفْيَانُ وَزَادَ فِيهِ هِشَامُ بْنُ عُرْوَةَ وَحَوَارِيَّ الزُّبَيْرُ وَابْنُ عَمَّتِي
We were sitting in the company of Hudhaifa. A man said: If I were in the time of the Messenger of Allah ﷺ, I would have fought by his side and would have striven hard for his causes. Hudhaifa said: You might have done that, (but you should not make a flourish of your enthusiasm). I was with the Messenger of Allah ﷺ on the night of the Battle of Abzib and we were gripped by a violent wind and severe cold. The Messenger of Allah (may peace be him) said: Hark, the man who (goes reconnoitring and) brings me the news of the enemy shall be ranked with me on the Day of Judgment by Allah (the Glorious and Exalted). We all kept quiet and none of us responed to him. (Again) he said: Hark, a man who (goes reconnoitring and) brings me the news of the enemy shall be ranked with me on the Day of Judgment by Allah (the Glorious and Exalted). We kept quiet and none of us responded to him. He again said: Hark, a man who (goes reconnoitring and) brings me the news of the enemy shall be ranked with me on the Day of Judgtuent by Allah (the Glorious and Exalted) Then he said: Get up Hudhaifa, bring me the news of the enemy. When he called me by name I had no alternative but to get up. He said: Go and bring me information about the enemy, and do nothing that may provoke them against me. When I left him, I felt warm as if I were walking in a heated bath untill I reached them. I saw Abu Sufyan warming his back against fire I put an arrow in the middle of the bow. intending to shoot at him, when I recalled the words of the Messenger of Allah ﷺ" Do not provoke them against me." Had I shot at him, I would have hit him. But I returned and (felt warm as if) I were walking in a heated bath (hammam). Presenting myself before him, I gave him information about the enemy. When I had done so, I began to feel cold, so the Messenger of Allah ﷺ wrapped me in a blanket that he had in excess to his own requirement and with which he used to cover himself while saying his prayers. So I continued to sleep until it was morning. When it was morning he said: Get up, O heavy sleeper. (Using translation from Muslim 1788)
رَجُلٌ لَوْ أَدْرَكْتُ رَسُولَ اللهِ ﷺ قَاتَلْتُ مَعَهُ أَوْ أَبْلَيْتُ فَقَالَ لَهُ حُذَيْفَةُ أَنْتَ كُنْتَ تَفْعَلُ ذَاكَ؟ لَقَدْ رَأَيْتُنَا مَعَ رَسُولِ اللهِ ﷺ لَيْلَةَ الْأَحْزَابِ فِي لَيْلَةٍ ذَاتِ رِيحٍ شَدِيدَةٍ وَقَرٍّ فَقَالَ رَسُولُ اللهِ ﷺ أَلَا رَجُلٌ يَأْتِينِي بِخَبَرِ الْقَوْمِ يَكُونُ مَعِي يَوْمَ الْقِيَامَةِ؟ فَلَمْ يُجِبْهُ مِنَّا أَحَدٌ ثُمَّ الثَّانِيَةَ مِثْلَهُ ثُمَّ قَالَ يَا حُذَيْفَةُ قُمْ فَأْتِنَا بِخَبَرِ الْقَوْمِ فَلَمْ أَجِدْ بُدًّا إِذْ دَعَانِي بِاسْمِي أَنْ أَقُومَ فَقَالَ ائْتِنِي بِخَبَرِ الْقَوْمِ وَلَا تُذْعِرْهُمْ عَلَيَّ قَالَ فَمَضَيْتُ كَأَنَّمَا أَمْشِي فِي حَمَّامٍ حَتَّى أَتَيْتُهُمْ فَإِذَا أَبُو سُفْيَانَ يُصْلِي ظَهْرَهُ بِالنَّارِ فَوَضَعْتُ سَهْمِي فِي كَبِدِ قَوْسِي وَأَرَدْتُ أَنْ أَرْمِيَهُ ثُمَّ ذَكَرْتُ قَوْلَ رَسُولِ اللهِ ﷺ لَا تُذْعِرْهُمْ عَلَيَّ وَلَوْ رَمَيْتُ لَأَصَبْتُهُ قَالَ فَرَجَعْتُ كَأَنَّمَا أَمْشِي فِي حَمَّامٍ فَأَتَيْتُ رَسُولَ اللهِ ﷺ ثُمَّ أَصَابَنِي الْبَرْدُ حِينَ فَرَغْتُ وَقُرِرْتُ فَأَخْبَرْتُ رَسُولَ اللهِ ﷺ فَأَلْبَسَنِي رَسُولُ ﷺ مِنْ فَضْلِ عَبَاءَةٍ كَانَتْ عَلَيْهِ يُصَلِّي فِيهَا فَلَمْ أَزَلْ نَائِمًا حَتَّى الصُّبْحِ فَلَمَّا أَنْ أَصْبَحْتُ قَالَ رَسُولُ اللهِ ﷺ قُمْ يَا نَوْمَانُ
58.134 [Machine] The Excellence of the Guardians in the Path of Allah
٥٨۔١٣٤ بَابُ فَضْلِ الْحَرْسِ فِي سَبِيلِ اللهِ
On the day of Hunayn we travelled with the Messenger of Allah ﷺ and we journeyed for a long time until the evening came. I attended the prayer along with the Messenger of Allah ﷺ. A horseman came and said: Messenger of Allah, I went before you and climbed a certain mountain where saw Hawazin all together with their women, cattle, and sheep, having gathered at Hunayn. The Messenger of Allah ﷺ smiled and said: That will be the booty of the Muslims tomorrow if Allah wills. He then asked: Who will be on guard tonight? Anas ibn AbuMarthad al-Ghanawi said: I shall , Messenger of Allah. He said: Then mount your horse. He then mounted his horse, and came to the Messenger of Allah ﷺ. The Messenger of Allah said to him: Go forward to this ravine till you get to the top of it. We should not be exposed to danger from your side. In the morning the Apostle of of Allah ﷺ came out to his place of prayer, and offered two rak'ahs. He then said: Have you seen any sign of your horseman? They said: We have not, Messenger of Allah. The announcement of the time for prayer was then made, and while the Messenger of Allah ﷺ was saying the prayer, he began to glance towards the ravine. When he finished his prayer and uttered salutation, he said: Cheer up, for your horseman has come. We therefore began to look between the trees in the ravine, and sure enough he had come. He stood beside the Messenger of Allah ﷺ, saluted him and said: I continued till I reached the top of this ravine where the Messenger of Allah ﷺ commanded me, and in the morning I looked down into both ravines but saw no one. The Messenger of Allah ﷺ asked him: Did you dismount during the night? He replied: No, except to pray or to relieve myself. The Messenger of Allah ﷺ said: You have ensured your entry to (Paradise). No blame will be attached to you supposing you do not work after it. (Using translation from Abū Dāʾūd 2501)
أَنَّهُ سَمِعَ سَهْلَ بْنَ الْحَنْظَلِيَّةِ ؓ يَذْكُرُ أَنَّهُمْ سَارُوا مَعَ رَسُولِ اللهِ ﷺ يَوْمَ حُنَيْنٍ فَأَطْنَبُوا السَّيْرَ حَتَّى كَانَ عَشِيَّةً فَحَضَرَتِ الصَّلَاةُ عِنْدَ رَسُولِ اللهِ ﷺ فَجَاءَ رَجُلٌ فَارِسٌ فَقَالَ يَا رَسُولَ اللهِ إِنِّي انْطَلَقْتُ بَيْنَ أَيْدِيكُمْ حَتَّى طَلَعْتُ جَبَلَ كَذَا وَكَذَا فَإِذَا أَنَا بِهَوَازِنَ عَلَى بَكْرَةِ أَبِيهِمْ بِظُعُنِهِمْ وَنَعَمِهِمْ وَشَائِهِمْ فَاجْتَمَعُوا إِلَى حُنَيْنٍ فَتَبَسَّمَ رَسُولُ اللهِ ﷺ فَقَالَ تِلْكَ غَنِيمَةٌ لِلْمُسْلِمِينَ غَدًا إِنْ شَاءَ اللهُ ثُمَّ قَالَ مَنْ يَحْرُسُنَا اللَّيْلَةَ؟ فَقَالَ أَنَسُ بْنُ أَبِي مَرْثَدٍ الْغَنَوِيُّ ؓ أَنَا يَا رَسُولَ اللهِ فَقَالَ ارْكَبْ فَرَكِبَ فَرَسًا لَهُ فَجَاءَ إِلَى رَسُولِ اللهِ ﷺ فَقَالَ لَهُ رَسُولُ اللهِ ﷺ اسْتَقْبِلْ هَذَا الشِّعْبِ حَتَّى تَكُونَ فِي أَعْلَاهُ وَلَا نُغَرَّنَّ مِنْ قِبَلِكَ اللَّيْلَةَ فَلَمَّا أَصْبَحْنَا خَرَجَ رَسُولُ اللهِ ﷺ إِلَى مُصَلَّاهُ فَرَكَعَ رَكْعَتَيْنِ ثُمَّ قَالَ هَلْ حَسَسْتُمْ فَارِسَكُمْ؟ فَقَالَ رَجُلٌ مَا حَسَسْنَا فَثَوَّبَ بِالصَّلَاةِ فَجَعَلَ رَسُولُ اللهِ ﷺ يَلْتَفِتُ إِلَى الشِّعْبِ حَتَّى قَضَى صَلَاتَهُ وَسَلَّمَ فَقَالَ أَبْشِرُوا فَقَدْ جَاءَ فَارِسُكُمْ قَالَ فَجَعَلْنَا نَنْظُرُ إِلَى خِلَالِ الشَّجَرِ فِي الشِّعْبِ فَإِذَا هُوَ قَدْ جَاءَ حَتَّى وَقَفَ عَلَى رَسُولِ اللهِ ﷺ فَسَلَّمَ فَقَالَ إِنِّي انْطَلَقْتُ حَتَّى كُنْتُ فِي أَعْلَى هَذَا الشِّعْبِ حَيْثُ أَمَرَنِي رَسُولُ اللهِ ﷺ فَلَمَّا أَصْبَحْنَا طَلَعْتُ عَلَى الشِّعْبَيْنِ فَنَظَرْتُ فَلَمْ أَرَ أَحَدًا فَقَالَ لَهُ رَسُولُ اللهِ ﷺ نَزَلْتَ اللَّيْلَةَ؟ قَالَ لَا إِلَّا مُصَلِّيًا أَوْ قَاضِيَ حَاجَةٍ فَقَالَ لَهُ رَسُولُ اللهِ ﷺ قَدْ أَوْجَبْتَ فَلَا عَلَيْكَ أَنْ لَا تَعْمَلَ بَعْدَهَا
[Machine] The Prophet ﷺ said: "Shall I not inform you of a night that is better than a thousand months? It is a night in which a guard stands in a land of fear, hoping not to return to his family. Yahya Al-Qattan raised his hand and Waki' stood up."
النَّبِيَّ ﷺ قَالَ أَلَا أُنَبِّئُكُمْ بِلَيْلَةٍ أَفْضَلَ مِنْ لَيْلَةِ الْقَدْرِ؟ حَارِسٌ حَرَسَ فِي أَرْضِ خَوْفٍ لَعَلَّهُ أَنْ لَا يَرْجِعَ إِلَى أَهْلِهِ رَفَعَهُ يَحْيَى الْقَطَّانُ وَوَقَفَهُ وَكِيعٌ
[Machine] We went out with the Messenger of Allah in a battle, and he fulfilled his promise to us by camping on a high ground. We were struck by severe cold to the point that when one of us dug a trench and entered into it, covering himself with his shield, the Messenger of Allah saw that among the people and said, "Is there not a man who would protect us tonight and supplicate to Allah for us with a supplication through which Allah would grant us favor?" So a man from the Ansar stood up and said, "I will do it, O Messenger of Allah." The Messenger of Allah made supplication for him and the narrator said, "I thought of saying, 'I will do it,' so that he would make supplication for me with the same supplication that he made for the Ansari, but then I remembered that he had made supplication for him specifically. Then the Messenger of Allah said, 'Hellfire is forbidden to touch three types of people: an eye that weeps out of fear of Allah, an eye that stayed awake guarding in the cause of Allah,' and I forgot the third one." Abu Hurairah said, "It is an eye that looked but restrained itself from looking at what Allah had forbidden."
خَرَجْنَا مَعَ رَسُولِ اللهِ ﷺ فِي غَزْوَةٍ فَأَوْفَى بِنَا عَلَى شَرَفٍ فَأَصَابَنَا بَرْدٌ شَدِيدٌ حَتَّى إِذَا كَانَ أَحَدُنَا يَحْفِرُ الْحَفِيرَ ثُمَّ يَدْخُلُ فِيهِ وَيُغَطِّي عَلَيْهِ بِحَجْفَتِهِ فَلَمَّا رَأَى رَسُولُ اللهِ ﷺ ذَلِكَ مِنَ النَّاسِ قَالَ أَلَا رَجُلٌ يَحْرُسُنَا اللَّيْلَةَ أَدْعُو اللهَ لَهُ بِدُعَاءٍ يُصِيبُ بِهِ فَضْلًا؟ فَقَامَ رَجُلٌ مِنَ الْأَنْصَارِ فَقَالَ أَنَا يَا رَسُولَ اللهِ فَدَعَا لَهُ قَالَ أَبُو رَيْحَانَةَ ؓ فَقُلْتُ أَنَا فَدَعَا لِي بِدُعَاءٍ هُوَ دُونَ مَا دَعَا بِهِ لِلْأَنْصَارِيِّ ثُمَّ قَالَ رَسُولُ اللهِ ﷺ حُرِّمَتِ النَّارُ عَلَى عَيْنٍ دَمَعَتْ مِنْ خَشْيَةِ اللهِ حُرِّمَتِ النَّارُ عَلَى عَيْنٍ سَهِرَتْ فِي سَبِيلِ اللهِ قَالَ وَنَسِيتُ الثَّالِثَةَ قَالَ أَبُو شُرَيْح /63ٍ وَهُوَ عَبْدُ الرَّحْمَنِ بْنُ شُرَيْحٍ وَسَمِعْتُهُ بَعْدُ أَنَّهُ قَالَ حُرِّمَتِ النَّارُ عَلَى عَيْنٍ غَضَّتْ عَنْ مَحَارِمِ اللهِ أَوْ عَيْنٍ فُقِئَتْ فِي سَبِيلِ اللهِ
[Machine] "He informed him that the Messenger of Allah ﷺ said: May Allah have mercy on the guard of the guard. It was narrated from Al-Darawardi, from Salih, from Umar, from Uqbah ibn Amr, from the Prophet ﷺ . And Ali ibn Ahmad ibn Abdan informed us that Ahmad ibn Ubayd narrated to us, and Sa'id ibn Uthman al-Ahwazi narrated, and Ali ibn Bahar narrated from Al-Darawardi, and mentioned him."
أَنَّهُ أَخْبَرَهُ أَنَّ رَسُولَ اللهِ ﷺ قَالَ رَحِمَ اللهُ حَارِسَ الْحَرَسِ 18447 وَرُوِيَ عَنِ الدَّرَاوَرْدِيِّ عَنْ صَالِحٍ عَنْ عُمَرَ عَنْ عُقْبَةَ بْنِ عَامِرٍ عَنِ النَّبِيِّ ﷺ وَأَخْبَرَنَاهُ عَلِيُّ بْنُ أَحْمَدَ بْنِ عَبْدَانَ أنبأ أَحْمَدُ بْنُ عُبَيْدٍ ثنا سَعِيدُ بْنُ عُثْمَانَ الْأَهْوَازِيُّ ثنا عَلِيُّ بْنُ بَحْرٍ ثنا الدَّرَاوَرْدِيُّ فَذَكَرَهُ
58.135 [Machine] Prayer of the Guard
٥٨۔١٣٥ بَابُ صَلَاةِ الْحَرَسِ
[Machine] We went with the Messenger of Allah ﷺ in the Battle of Dhat al-Riqa' from a date palm. He mentioned the hadith and then the Messenger of Allah ﷺ descended to a place and said, "Who will guard us tonight?" So, a man from the Muhajireen and a man from the Ansar volunteered. They said, "We will, O Messenger of Allah." He said, "Then join in guarding the pass." When they reached the pass, the Ansari said to the Muhajir, "Which part of the night do you prefer me to guard first or last?" The Muhajir said, "No, let me guard first." So, the Muhajir laid down to sleep while the Ansari prayed. He then mentioned the hadith.
خَرَجْنَا مَعَ رَسُولِ اللهِ ﷺ فِي غَزْوَةِ ذَاتِ الرِّقَاعِ مِنْ نَخْلٍ فَذَكَرَ الْحَدِيثَ قَالَ فَنَزَلَ رَسُولُ اللهِ ﷺ مَنْزِلًا فَقَالَ مَنْ رَجُلٌ يَكْلَؤُنَا لَيْلَتَنَا هَذِهِ؟ فَانْتَدَبَ رَجُلٌ مِنَ الْمُهَاجِرِينَ وَرَجُلٌ مِنَ الْأَنْصَارِ فَقَالَا نَحْنُ يَا رَسُولَ اللهِ قَالَ فَكُونَا بِفَمِ الشِّعْبِ فَلَمَّا أَنْ خَرَجَا إِلَى فَمِ الشِّعْبِ قَالَ الْأَنْصَارِيُّ لِلْمُهَاجِرِيِّ أِيُّ اللَّيْلِ أَحَبُّ إِلَيْكَ أَنْ أَكْفِيَكَ أَوَّلَهُ أَوْ آخِرَهُ؟ قَالَ بَلِ اكْفِنِي أَوَّلَهُ فَاضْطَجَعَ الْمُهَاجِرِيُّ فَنَامَ وَقَامَ الْأَنْصَارِيُّ يُصَلِّي فَذَكَرَ الْحَدِيثَ
