[Machine] So he wrote to Saad, responding to him, and then invited him to Islam, so he converted and Umar imposed upon him 700 dirhams and placed his tribute in Khatham. He said, "If you establish yourself in your land, you will pay from it what you used to pay." And this is a weak narration in its chain, but if it is proven, then his statement was, "And your land is yours, and you have the right to it as you intended. And your land is the one you used to cultivate and pay its taxes." And that was taken by force, except that he left it, and its taxes did not fall from him when he converted. And in the peace treaty, its taxes fall.
فَكَتَبَ إِلَى سَعْدٍ رُدَّ عَلَيْهِ أَرْضَهُ ثُمَّ دَعَاهُ إِلَى الْإِسْلَامِ فَأَسْلَمَ فَفَرَضَ لَهُ عُمَرُ ؓ سَبْعَمِائَةٍ وَجَعَلَ عَطَاءَهُ فِي خَثْعَمٍ وَقَالَ إِنْ أَقَمْتَ فِي أَرْضِكَ أَدَّيْتَ عَنْهَا مَا كُنْتَ تُؤَدِّي وَهَذَا فِي إِسْنَادِهِ ضِعْفٌ فَإِنْ ثَبَتَ كَانَ قَوْلُهُ وَلَكُمْ أَرْضُكُمْ مَحْمُولًا عَلَى أَنَّهُ أَرَادَ وَلَكُمْ أَرْضُكُمُ الَّتِي كَانَتْ لَكُمْ تَزْرَعُونَهَا وَتُعْطُونَ خَرَاجَهَا وَذَلِكَ فِيمَا أُخِذَ عَنْوَةً إِلَّا تَرَكَهُ لَمْ يَسْقُطْ عَنْهُ خَرَاجُهَا حِينَ أَسْلَمَ وَفِي الصُّلْحِ يَسْقُطُ
