[Machine] Abu Al-As ibn Ar-Rabi' was a trader who used to go to Sham (Syria). He was a trustworthy man and he had merchandise for the Quraysh with him. A caravan came his way and it was intercepted secretly by a group of the Messenger of Allah's ﷺ Companions. They took away his goods and brought them to the Messenger of Allah ﷺ who distributed them among themselves. Abu Al-As went on until he reached Zainab (his wife), seeking her protection and asked her to intercede with the Messenger of Allah ﷺ to return his money to him and what he had of other people's goods. The Messenger of Allah ﷺ called those who intercepted the caravan and they answered him. Then he went out until he reached Makkah and he distributed among the people what he had of their goods. When he finished he said: "O assembly of Quraysh! Is there anyone among you to whom I owe anything which I have not returned?" They answered: "No, may Allah reward you with the best. You have been found trustworthy and generous." Abu Al-As said: "By Allah! I was not prevented from accepting Islam before I joined you except that I feared that you would think that I embraced Islam in order to take away your possessions. But I asseverate that there is no god but Allah and Muhammad is His slave and His Apostle." Ash-Shafi'i said in Al-Musnad: "If they secretly took hold of a person and did not feel secure about him nor recover anything from him, they are allowed to take from him the amount equal to the goods they had. They can cause corruption to his wealth and run away from him." The Shaykh said: "We have already reported the Hadith of Imran ibn Husain regarding the Muslim woman who took the she-camel and fled on it."

أَبُو الْعَاصِ بْنُ الرَّبِيعِ تَاجِرًا إِلَى الشَّامِ وَكَانَ رَجُلًا مَأْمُونًا وَكَانَتْ مَعَهُ بَضَائِعُ لِقُرَيْشٍ فَأَقْبَلَ قَافِلًا فَلَقِيَهُ سَرِيَّةٌ لِرَسُولِ اللهِ ﷺ فَاسْتَاقُوا عِيرَهُ وَأَفْلَتَ وَقَدِمُوا عَلَى رَسُولِ اللهِ ﷺ بِمَا أَصَابُوا فَقَسَمَهُ بَيْنَهُمْ وَأَتَى أَبُو الْعَاصِ حَتَّى دَخَلَ عَلَى زَيْنَبَ ؓ فَاسْتَجَارَ بِهَا وَسَأَلَهَا أَنْ تَطْلُبَ لَهُ مِنْ رَسُولِ اللهِ ﷺ رَدَّ مَالِهِ عَلَيْهِ وَمَا كَانَ مَعَهُ مِنْ أَمْوَالِ النَّاسِ فَدَعَا رَسُولُ اللهِ ﷺ السَّرِيَّةَ فَسَأَلَهُمْ فَرَدُّوا عَلَيْهِ ثُمَّ خَرَجَ حَتَّى قَدِمَ مَكَّةَ فَأَدَّى عَلَى النَّاسِ مَا كَانَ مَعَهُ مِنْ بَضَائِعِهِمْ حَتَّى إِذَا فَرَغَ قَالَ يَا مَعْشَرَ قُرَيْشٍ هَلْ بَقِيَ لِأَحَدٍ مِنْكُمْ مَعِي مَالٌ لَمْ أَرُدَّهُ عَلَيْهِ؟ قَالُوا لَا فَجَزَاكَ اللهُ خَيْرًا قَدْ وَجَدْنَاكَ وَفِيًّا كَرِيمًا فَقَالَ أَمَا وَاللهِ مَا مَنَعَنِي أَنْ أُسْلِمَ قَبْلَ أَنْ أَقْدَمَ عَلَيْكُمْ إِلَّا تَخَوُّفًا أَنْ تَظُنُّوا أَنِّي إِنَّمَا أَسْلَمْتُ لِأَذْهَبَ بِأَمْوَالِكُمْ فَإِنِّي أَشْهَدُ أَنْ لَا إِلَهَ إِلَّا اللهُ وَأَنَّ مُحَمَّدًا عَبْدُهُ وَرَسُولُهُ قَالَ الشَّافِعِيُّ فِي الْمُسْلِمِ إِذَا أُسِرَ وَلَمْ يُؤَمِّنُوهُ وَلَمْ يَأْخُذُوا عَلَيْهِ أَنَّهُمْ آمِنُونَ مِنْهُ فَلَهُ أَخْذُ مَا قَدَرَ عَلَيْهِ مِنْ أَمْوَالِهِمْ وَإِفْسَادُهُ وَالْهَرَبُ مِنْهُمْ قَالَ الشَّيْخُ قَدْ رَوَيْنَا حَدِيثَ عِمْرَانَ بْنِ حُصَيْنٍ ؓ فِي الْمَرْأَةِ الْمُسْلِمَةِ الَّتِي أَخَذَتِ النَّاقَةَ وَهَرَبَتْ عَلَيْهَا

I saw ʿUmar bin Al-Khattab (when he was stabbed) saying, "O ʿAbdullah bin ʿUmar! Go to the mother of the believers Aisha and say, ʿUmar bin Al-Khattab sends his greetings to you,' and request her to allow me to be buried with my companions." (So, Ibn ʿUmar conveyed the message to ʿAisha.) She said, "I had the idea of having this place for myself but today I prefer him (ʿUmar) to myself (and allow him to be buried there)." When ʿAbdullah bin ʿUmar returned, ʿUmar asked him, "What (news) do you have?" He replied, "O chief of the believers! She has allowed you (to be buried there)." On that ʿUmar said, "Nothing was more important to me than to be buried in that (sacred) place. So, when I expire, carry me there and pay my greetings to her (ʿAisha ) and say, ʿUmar bin Al-Khattab asks permission; and if she gives permission, then bury me (there) and if she does not, then take me to the graveyard of the Muslims. I do not think any person has more right for the caliphate than those with whom Messenger of Allah ﷺ was always pleased till his death. And whoever is chosen by the people after me will be the caliph, and you people must listen to him and obey him," and then he mentioned the name of ʿUthman, ʿAli, Talha, Az-Zubair, ʿAbdur-Rahman bin ʿAuf and Saʿd bin Abi Waqqas. By this time a young man from Ansar came and said, "O chief of the believers! Be happy with Allah's glad tidings. The grade which you have in Islam is known to you, then you became the caliph and you ruled with justice and then you have been awarded martyrdom after all this." ʿUmar replied, "O son of my brother! Would that all that privileges will counterbalance (my short comings), so that I neither lose nor gain anything. I recommend my successor to be good to the early emigrants and realize their rights and to protect their honor and sacred things. And I also recommend him to be good to the Ansar who before them, had homes (in Medina) and had adopted the Faith. He should accept the good of the righteous among them and should excuse their wrongdoers. I recommend him to abide by the rules and regulations concerning the Dhimmis (protectees) of Allah and His Apostle, to fulfill their contracts completely and fight for them and not to tax (overburden) them beyond their capabilities."

[AI] We were with Ibn Umar at Mina when a young man from the people of Basrah came to him and asked him about something. He said: I will inform you about that. He said: I was with the Messenger of Allah ﷺ, one of ten, in the mosque of the Messenger of Allah ﷺ: Abu Bakr, Umar, Uthman, Ali, Ibn Masud, Muadh, Hudhayfah, Abu Said al-Khudri, another man whom he named, and me. A young man from the Ansar came, greeted the Messenger of Allah ﷺ, then sat down and said: O Messenger of Allah, which of the believers is best? He said: "The best of them in character." He said: Then which of the believers is most astute? He said: "Those who remember death most often and are best prepared for it before it descends upon them—or he said, upon him; those are the astute."

Then the young man fell silent, and the Prophet ﷺ turned toward us and said: "Never does indecency appear among a people but that plague and illnesses which had not passed among their forefathers appear among them. They do not diminish the measure and the scale but that they are seized by years of drought, severe hardship in provision, and the ruler’s oppression over them. They do not withhold the zakah of their wealth but that rain from the sky is withheld from them, and were it not for the beasts, they would not be given rain. They do not break the covenant of Allah ﷻ and the covenant of His Messenger but that Allah ﷻ empowers their enemy over them, and they take some of what was in their hands. And when their leaders do not rule by the Book of Allah ﷻ, Allah ﷻ causes their violence to be among themselves."

He said: Then he ordered Abd al-Rahman ibn Awf to prepare for a detachment over which he appointed him. In the morning he had wrapped himself in a black cotton-cloth turban, so the Prophet ﷺ called him, untied it, wrapped the turban on him, and let four fingers’ length hang behind him. Then he said: "Like this, O Ibn Awf, wrap the turban, for it is more Arab in style and better."

Then the Prophet ﷺ ordered Bilal to hand the banner to him. He praised Allah ﷻ, then said: "Go forth all together in the path of Allah ﷻ, and fight those who disbelieve in Allah ﷻ. Do not steal from the spoils, do not betray, do not mutilate, and do not kill a child. This is the covenant of the Messenger of Allah ﷺ and his Sunnah among you."

البزّار:٥٥٣٦حَدَّثَنَا جَعْفَرُ بْنُ مُحَمَّدِ بْنِ الْفُضَيْلِ حَدَّثَنَا مُحَمَّدُ بْنُ عُثْمَانَ الدِّمَشْقِيُّ حَدَّثَنِي الْهَيْثَمُ بْنُ حُمَيْدٍ حَدَّثَنِي حَفْصُ بْنُ غَيْلانَ عَنْ عَطَاءِ بْنِ أَبِي رَبَاحٍ قَالَ، عَبْدُ اللَّهِ بْنُ مُرَّةَ عَن ابْنِ عُمَرَ

كُنَّا مَعَ ابْنِ عُمَرَ بِمِنًى، فَجَاءَهُ فَتًى مِنْ أَهْلِ الْبَصْرَةِ فَسَأَلَهُ عَنْ شَيْءٍ، فَقَالَ: سَأُخْبِرُكَ عَنْ ذَلِكَ. قَالَ: كُنْتُ عِنْدَ رَسُولِ اللهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَاشِرَ عَشَرَةٍ فِي مَسْجِدِ رَسُولِ اللهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: أَبُو بَكْرٍ وَعُمَرُ وَعُثْمَانُ وَعَلِيٌّ وَابْنُ مَسْعُودٍ وَمُعَاذٌ وَحُذَيْفَةُ وَأَبُو سَعِيدٍ الْخُدْرِيُّ وَرَجُلٌ آخَرُ سَمَّاهُ وَأَنَا، فَجَاءَ فَتًى مِنَ الأَنْصَارِ فَسَلَّمَ عَلَى رَسُولِ اللهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، ثُمَّ جَلَسَ فَقَالَ: يَا رَسُولَ اللهِ، أَيُّ الْمُؤْمِنِينَ أَفْضَلُ؟ قَالَ: «أَحْسَنُهُمْ خُلُقًا». قَالَ: فَأَيُّ الْمُؤْمِنِينَ أَكْيَسُ؟ قَالَ: «أَكْثَرُهُمْ لِلْمَوْتِ ذِكْرًا، وَأَحْسَنُهُمْ لَهُ اسْتِعْدَادًا قَبْلَ أَنْ يَنْزِلَ بِهِمْ، أَوْ قَالَ بِهِ، أُولَئِكَ الأَكْيَاسُ».

ثُمَّ سَكَتَ الْفَتَى، وَأَقْبَلَ عَلَيْنَا النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ: «لَمْ تَظْهَرِ الْفَاحِشَةُ فِي قَوْمٍ قَطُّ إِلاَّ ظَهَرَ فِيهِمُ الطَّاعُونُ وَالأَوْجَاعُ الَّتِي لَمْ تَكُنْ مَضَتْ فِي أَسْلافِهِمْ، وَلا نَقَصُوا الْمِكْيَالَ وَالْمِيزَانَ إِلاَّ أُخِذُوا بِالسِّنِينَ وَشِدَّةِ الْمُؤْنَةِ وَجَوْرِ السُّلْطَانِ عَلَيْهِمْ، وَلَمْ يَمْنَعُوا زَكَاةَ أَمْوَالِهِمْ إِلاَّ مُنِعُوا الْقَطْرَ مِنَ السَّمَاءِ، وَلَوْلا الْبَهَائِمُ لَمْ يُمْطَرُوا، وَلَمْ يَنْقُضُوا عَهْدَ اللهِ وَعَهْدَ رَسُولِهِ إِلاَّ سَلَّطَ اللَّهُ عَلَيْهِمْ عَدُوَّهُمْ وَأَخَذُوا بَعْضَ مَا كَانَ فِي أَيْدِيهِمْ، وَإذا لَمْ يُحْكَمْ أَئِمَّتُهُمْ بِكِتَابِ اللهِ جَعَلَ اللَّهُ بَأْسَهُمْ بَيْنَهُمْ».

قَالَ: ثُمَّ أَمَرَ عَبْدَ الرَّحْمَنِ بْنَ عَوْفٍ أَنْ يَتَجَهَّزَ لِسَرِيَّةٍ أَمَّرَهُ عَلَيْهَا، فَأَصْبَحَ قَدِ اعْتَمَّ بِعِمَامَةِ كَرَابِيسَ سَوْدَاءَ، فَدَعَاهُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَنَقَضَهَا فَعَمَّمَهُ، وَأَرْسَلَ مِنْ خَلْفِهِ أَرْبَعَ أَصَابِعَ، ثُمَّ قَالَ: «هَكَذَا يَابْنَ عَوْفٍ فَاعْتَمَّ، فَإِنَّهُ أَعْرَبُ وَأَحْسَنُ».

ثُمَّ أَمَرَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِلالا أَنْ يَدْفَعَ إِلَيْهِ اللِّوَاءَ، فَحَمِدَ اللَّهَ ثُمَّ قَالَ: «اغْزُوا جَمِيعًا فِي سَبِيلِ اللهِ، فَقَاتِلُوا مَنْ كَفَرَ بِاللهِ، لا تَغُلُّوا وَلا تَغْدِرُوا وَلا تُمَثِّلُوا وَلا تَقْتُلُوا وَلِيدًا، فَهَذَا عَهْدُ رَسُولِ اللهِ صَلَّى الله عَلَيْهِ وَسَلَّمَ وَسُنَّتُهُ فِيكُمْ».
