٥٨۔ كِتَابُ السِّيَرِ ص ٧
[Machine] I came to the Prophet ﷺ while he was in the valley of Qura and I said, "What do you say about the spoils of war?" He said, "Its one-fifth is for Allah, and four-fifths are for the army." I said, "So, is there anyone more deserving of it than anyone else?" He replied, "No, even if you extract an arrow from your side, you are not more deserving of it than your Muslim brother."
أَتَيْتُ النَّبِيَّ ﷺ وَهُوَ بِوَادِي الْقُرَى فَقُلْتُ مَا تَقُولُ فِي الْغَنِيمَةِ؟ قَالَ لِلَّهِ خُمُسُهَا وَأَرْبَعَةُ أَخْمَاسٍ لِلْجَيْشِ قُلْتُ فَمَا أَحَدٌ أَوْلَى بِهِ مِنْ أَحَدٍ؟ قَالَ لَا وَلَا السَّهْمُ تَسْتَخْرِجُهُ مِنْ جَنْبِكَ لَيْسَ أَنْتَ أَحَقَّ بِهِ مِنْ أَخِيكَ الْمُسْلِمِ
58.55 [Machine] The license in its use in case of necessity.
٥٨۔٥٥ بَابُ الرُّخْصَةِ فِي اسْتِعْمَالِهِ فِي حَالِ الضَّرُورَةِ
[Machine] I approached Abu Jahl, who was lying on the ground, with an egg on top of him. He had a fine sword with him, while I had a severed sword. I placed my sword on his neck and recalled a time when he used to do the same to me in Makkah until his strength weakened. Then, I took his sword and raised his head. He asked, "Who's responsible for this? Was it for us or against us? Aren't you our shepherd in Makkah?" I replied by killing him. Then, I went to the Prophet ﷺ and informed him that I had killed Abu Jahl. The Prophet ﷺ said, "By Allah, did you kill him?" He swore by Allah three times and then went with me to see them and supplicated against them.
انْتَهَيْتُ إِلَى أَبِي جَهْلٍ وَهُوَ صَرِيعٌ وَعَلَيْهِ بَيْضَةٌ وَمَعَهُ سَيْفٌ جَيِّدٌ وَمَعِي سَيْفٌ رَدِيٌّ فَجَعَلْتُ أَنْقُفُ رَأْسَهُ بِسَيْفِي وَأَذْكُرُ نَقْفًا كَانَ يَنْقُفُ رَأْسِي بِمَكَّةَ حَتَّى ضَعُفَتْ يَدُهُ فَأَخَذْتُ سَيْفَهُ فَرَفَعَ رَأْسَهُ فَقَالَ عَلَى مَنْ كَانَتِ الدَّبَرَةُ؟ أَكَانَتْ لَنَا أَوْ عَلَيْنَا؟ أَلَسْتَ رُوَيْعِيَنَا بِمَكَّةَ؟ قَالَ فَقَتَلْتُهُ ثُمَّ أَتَيْتُ النَّبِيَّ ﷺ فَقُلْتُ قَتَلْتُ أَبَا جَهْلٍ قَالَ النَّبِيُّ ﷺ آللَّهِ الَّذِي لَا إِلَهَ إِلَّا هُوَ قَتَلْتَهُ؟ فَاسْتَحْلَفَنِي ثَلَاثَ مَرَّاتٍ ثُمَّ قَامَ مَعِي إِلَيْهِمْ فَدَعَا عَلَيْهِمْ
[Machine] I came across Abu Jahl who was lying dead and I had a worn-out sword with me. I started striking him with my sword, but it did not do anything. He looked at me and asked, "Are our people in Mecca doing well?" Then his sword fell, so I took it and struck him with it until I killed him. Then I went to the Prophet ﷺ and informed him. He asked, "Did you kill him?" I said, "Yes," so he asked me three times and I swore to him. Then he said, "Go and show me." So I went and showed him. He said, "This was Pharaoh of this nation." And Al-A'mash narrated it from Abu Ishaq similarly.
انْتَهَيْتُ إِلَى أَبِي جَهْلٍ وَهُوَ فِي الْقَتْلَى صَرِيعٌ وَمَعِي سَيْفٌ رَثٌّ فَجَعَلْتُ أَضْرِبُهُ بِسَيْفِي فَلَمْ يَعْمَلْ شَيْئًا قَالَ وَنَظَرَ إِلِيَّ فَقَالَ أَرُوَيْعِينَا بِمَكَّةَ؟ فَوَقَعَ سَيْفُهُ فَأَخَذْتُهُ فَضَرَبْتُهُ بِهِ حَتَّى قَتَلْتُهُ ثُمَّ جِئْتُ أَشْتَدُّ حَتَّى أَخْبَرْتُ النَّبِيَّ ﷺ فَقَالَ أَنْتَ قَتَلْتَهُ؟ قُلْتُ نَعَمْ حَتَّى اسْتَحْلَفَنِي ثَلَاثَ مَرَّاتٍ فَحَلَفْتُ لَهُ ثُمَّ قَالَ انْطَلِقْ فَأَرِنِيهِ فَانْطَلَقَ فَأَرَيْتُهُ إِيَّاهُ فَقَالَ كَانَ هَذَا فِرْعَوْنَ هَذِهِ الْأُمَّةِ وَرَوَاهُ الْأَعْمَشُ عَنْ أَبِي إِسْحَاقَ بِمَعْنَاهُ
[Machine] He is called the donkey of the dove, a muscular man with a white sword in his hand. I struck his legs and it seemed as if I had missed him, but he stumbled and fell on his back. I took his sword and sheathed mine. I struck him only once until it broke, then I threw it away and took my sword back.
يُقَالُ لَهُ حِمَارُ الْيَمَامَةِ رَجُلًا جَسِيمًا بِيَدِهِ سَيْفٌ أَبْيَضُ فَضَرَبْتُ رِجْلَيْهِ فَكَأَنَّمَا أَخْطَأَتْهُ فَانْقَعَرَ فَوَقَعَ عَلَى قَفَاهُ فَأَخَذْتُ سَيْفَهُ وَأَغْمَدْتُ سَيْفِي فَمَا ضَرَبْتُ بِهِ إِلَّا ضَرْبَةً حَتَّى انْقَطَعَ فَأَلْقَيْتُهُ وَأَخَذْتُ سَيْفِي
58.56 [Machine] When the Imam Appears Among a Group, He Stands with Them Three Times.
٥٨۔٥٦ بَابُ الْإِمَامِ إِذَا ظَهْرَ عَلَى قَوْمٍ أَقَامَ بِعَرْصَتِهِمْ ثَلَاثًا
[Machine] The Messenger of Allah, ﷺ , used to prefer to stay with a people for three nights if he overcame them.
كَانَ رَسُولُ اللهِ ﷺ إِذَا غَلَبَ عَلَى قَوْمٍ أَحَبَّ أَنْ يُقِيمَ بِعَرْصَتِهِمْ ثَلَاثًا
58.57 [Machine] What does he do with his offspring when they appear on him?
٥٨۔٥٧ بَابُ مَا يَفْعَلُهُ بِذَرَارِيِّ مَنْ ظَهَرَ عَلَيْهِ
Some people (i.e. the Jews of Bani bin Quraiza) agreed to accept the verdict of Saʿd bin Muʿadh so the Prophet ﷺ sent for him (i.e. Saʿd bin Muʿadh). He came riding a donkey, and when he approached the Mosque, the Prophet ﷺ said, "Get up for the best amongst you." or said, "Get up for your chief." Then the Prophet ﷺ said, "O Saʿd! These people have agreed to accept your verdict." Saʿd said, "I judge that their warriors should be killed and their children and women should be taken as captives." The Prophet said, "You have given a judgment similar to Allah's Judgment (or the King's judgment). (Using translation from Bukhārī 3804)
أَنَّ بَنِي قُرَيْظَةَ لَمَّا نَزَلُوا عَلَى حُكْمِ سَعْدِ بْنِ مُعَاذٍ ؓ أَرْسَلَ إِلَيْهِ رَسُولُ اللهِ ﷺ فَجَاءَ عَلَى حِمَارٍ فَلَمَّا كَانَ قَرِيبًا مِنَ الْمَسْجِدِ قَالَ رَسُولُ اللهِ ﷺ قُومُوا إِلَى سَيِّدِكُمْ أَوْ إِلَى خَيْرِكُمْ فَقَالَ إِنَّ هَؤُلَاءِ نَزَلُوا عَلَى حُكْمِكَ قَالَ فَإِنِّي أَحْكُمُ فِيهِمْ أَنْ يُقْتَلَ مُقَاتِلَتُهُمْ وَتُسْبَى ذَرَارِيُّهُمْ قَالَ فَقَالَ رَسُولُ اللهِ ﷺ حَكَمْتَ بِحُكْمِ الْمَلِكِ وَرُبَّمَا قَالَ حَكَمْتَ بِحُكْمِ اللهِ
[Machine] "And their wealth and offspring were distributed, and that was mentioned to the Messenger of Allah ﷺ , so he said, 'Verily, the judgment today was made upon them with the judgment of Allah, who rules with it over seven heavens.'"
وَأَنْ تُقَسَمَ أَمْوَالُهُمْ وَذَرَارِيُّهُمْ فَذُكِرَ ذَلِكَ لِرَسُولِ اللهِ ﷺ فَقَالَ لَقَدْ حَكَمَ الْيَوْمَ فِيهِمْ بِحُكْمِ اللهِ الَّذِي حَكَمَ بِهِ مِنْ فَوْقِ سَبْعِ سَمَاوَاتٍ
[Machine] I was among them, and whoever grew was killed, and whoever did not grow was left, so I was among those who did not grow.
كُنْتُ فِيهِمْ وَكَانَ مَنْ أَنْبَتَ قُتِلَ وَمَنْ لَمْ يُنْبِتْ تُرِكَ فَكُنْتُ فِيمَنْ لَمْ يُنْبِتْ
[Machine] I was among those whom Saad bin Muadh ruled over. The Messenger of Allah commanded that their fighters be killed and their children be taken as captives. They brought me and I could only see that they were going to kill me. They uncover my arm and found that it had not grown any hair. So they put me among the captives.
كُنْتُ فِيمَنْ حَكَمَ فِيهِمْ سَعْدُ بْنُ مُعَاذٍ ؓ فَأَمَرَ رَسُولُ اللهِ ﷺ أَنْ يُقْتَلَ مُقَاتِلَتُهُمْ وَتُسْبَى ذَرَارِيُّهُمْ قَالَ فَجَاءُوا بِي وَلَا أَرَانِي إِلَّا سَيَقْتُلُونَنِي فَكَشَفُوا عَانَتِي فَوَجَدُوهَا لَمْ تَنْبُتْ؛ فَجَعَلُونِي فِي السَّبْيِ
58.58 [Machine] What it does with adult males among them. Imam Ash-Shafi'i said: "The imam has several options: to kill them if the idolaters do not convert to Islam, to take the jizyah from the people of the Book, to be kind to them, to accept money from them or to take Muslim prisoners and release them, or to capture them as slaves. If he captures them or takes money from them, it is regarded as war spoils, and four-fifths of it goes to the spoils of war. If someone asks, 'How did you rule on wealth, children, and women with one ruling, and you ruled on men with separate rulings?' It is said, 'The Messenger of Allah ﷺ distributed the property of Banu Quraiza and Banu al-Mustaliq and took their land and dates as war spoils. He also took captive the children of Banu al-Mustaliq, including those of Hawazin, and their women, and divided them with a division similar to property.'" The Shaykh said: "As for what he said about Banu Quraiza, it is about the distribution of wealth.
٥٨۔٥٨ بَابُ مَا يَفْعَلُهُ بِالرِّجَالِ الْبَالِغِينَ مِنْهُمْ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: " الْإِمَامُ فِيهِمْ بِالْخِيَارِ بَيْنَ أَنْ يَقْتُلَهُمْ إِنْ لَمْ يُسْلِمْ أَهْلُ الْأَوْثَانِ، أَوْ يُعْطِيَ الْجِزْيَةَ أَهْلُ الْكِتَابِ، أَوْ يَمُنَّ عَلَيْهِمْ، أَوْ يُفَادِيَهِمْ بِمَالٍ يَأْخُذُهُ مِنْهُمْ أَوْ بِأَسْرَى مِنَ الْمُسْلِمِينَ يُطْلَقُونَ لَهُمْ، أَوْ يَسْتَرِقَّهُمْ فَإِنِ اسْتَرَقَّهُمْ أَوْ أَخَذَ مِنْهُمْ مَالًا فَسَبِيلُهُ سَبِيلُ الْغَنِيمَةِ، يُخْمَسُ وَيَكُونُ أَرْبَعَةُ أَخْمَاسِهَا لِأَهْلِ الْغَنِيمَةِ، فَإِنْ قَالَ قَائِلٌ: كَيْفَ حَكَمْتَ فِي الْمَالِ وَالْوِلْدَانِ وَالنِّسَاءِ حُكْمًا وَاحِدًا، وَحَكَمْتَ فِي الرِّجَالِ أَحْكَامًا مُتَفَرِّقَةً؟ قِيَلَ: ظَهَرَ رَسُولُ اللهِ ﷺ عَلَى قُرَيْظَةَ وَخَيْبَرَ، فَقَسَمَ عَقَارَهَا مِنَ الْأَرَضِينَ وَالنَّخْلِ قِسْمَةَ الْأَمْوَالِ، وَسَبَى وِلْدَانَ بَنِي الْمُصْطَلِقِ وَهَوَازِنَ وَنِسَاءَهُمْ، فَقَسَمَهُمْ قِسْمَةَ الْأَمْوَالِ ". قَالَ الشَّيْخُ: أَمَّا مَا قَالَ فِي قُرَيْظَةَ فَفِيمَا "
[Machine] The Jews of Banu Nadir and Quraiza fought against the Messenger of Allah ﷺ , so the Messenger of Allah ﷺ expelled Banu Nadir and took a pledge from Quraiza and those with them. Quraiza continued to fight after that, so their men were killed and their women, children, and wealth were divided among the Muslims, except for some who joined the Messenger of Allah ﷺ and were granted safety and embraced Islam. The Messenger of Allah ﷺ also expelled the Jews of Medina, Banu Qaynuqa, who were the people of Abdullah Ibn Salam, and the Jews of Banu Haritha, as well as all the Jews in Medina.
يَهُودَ بَنِي النَّضِيرِ وَقُرَيْظَةَ حَارَبُوا رَسُولَ اللهِ ﷺ فَأَجْلَى رَسُولُ اللهِ ﷺ بَنِي النَّضِيرِ وَأَقَرَّ قُرَيْظَةَ وَمَنْ عَلَيْهِمْ حَتَّى حَاربَتْ قُرَيْظَةُ بَعْدَ ذَلِكَ فَقَتَلَ رِجَالَهُمْ وَقَسَمَ نِسَاءَهُمْ وَأَوْلَادَهُمْ وَأَمْوَالَهُمْ بَيْنَ الْمُسْلِمِينَ إِلَّا بَعْضَهُمْ لَحِقُوا بِرَسُولِ اللهِ ﷺ فَأَمَّنَهُمْ وَأَسْلَمُوا وَأَجْلَى رَسُولُ اللهِ ﷺ يَهُودَ الْمَدِينَةِ بَنِي قَيْنُقَاعَ وَهُمْ قَوْمُ عَبْدِ اللهِ يَعْنِي ابْنَ سَلَامٍ وَيَهُودَ بَنِي حَارِثَةَ وَكُلَّ يَهُودِيٍّ بِالْمَدِينَةِ
[Machine] Only that supplication was made in the early days of Islam when the Messenger of Allah ﷺ became jealous of Banu Mustaliq, who had livestock that were watered. So he killed their fighters, captured their captives, and on that day, Juhayriyah bint al-Harith was affected by this. Abdullah bin Umar narrated this to me and he was in that army, and in the narration of Yazid, this was only after the supplication in the beginning of Islam, and the rest is the same.
إِنَّمَا كَانَ ذَلِكَ الدُّعَاءُ فِي أَصْلِ الْإِسْلَامِ قَدْ أَغَارَ رَسُولُ اللهِ ﷺ عَلَى بَنِي الْمُصْطَلِقِ وَهُمْ غَارُّونَ وَأَنْعَامُهُمْ تُسْقَى عَلَى الْمَاءِ فَقَتَلَ مُقَاتِلَتَهُمْ وَسَبَى سَبْيَهُمْ وَأَصَابَ يَوْمَئِذٍ جُوَيْرِيَةَ بِنْتَ الْحَارِثِ حَدَّثَنِي بِهَذَا عَبْدُ اللهِ بْنُ عُمَرَ وَكَانَ فِي ذَلِكَ الْجَيْشِ وَفِي رِوَايَةِ يَزِيدَ إِنَّمَا ذَلِكَ بَعْدَ الدُّعَاءِ فِي أَوَّلِ الْإِسْلَامِ وَالْبَاقِي سَوَاءٌ
When the delegates of the tribe of Hawazin after embracing Islam, came to Messenger of Allah ﷺ, he got up. They appealed to him to return their properties and their captives. Messenger of Allah ﷺ said to them, "The most beloved statement to me is the true one. So, you have the option of restoring your properties or your captives, for I have delayed distributing them." The narrator added, Messenger of Allah ﷺ c had been waiting for them for more than ten days on his return from Taif. When they realized that Allah's Apostle would return to them only one of two things, they said, "We choose our captives." So, Allah's Apostle got up in the gathering of the Muslims, praised Allah as He deserved, and said, "Then after! These brethren of yours have come to you with repentance and I see it proper to return their captives to them. So, whoever amongst you likes to do that as a favor, then he can do it, and whoever of you wants to stick to his share till we pay him from the very first booty which Allah will give us then he can do so." The people replied, "We agree to give up our shares willingly as a favor for Allah's Apostle." Then Messenger of Allah ﷺ said, "We don't know who amongst you has agreed and who hasn't. Go back and your chiefs may tell us your opinion." So, all of them returned and their chiefs discussed the matter with them and then they (i.e. their chiefs) came to Messenger of Allah ﷺ to tell him that they (i.e. the people) had given up their shares gladly and willingly. أَنَّ رَسُولَ اللهِ ﷺ قَامَ حِينَ جَاءَهُ وَفْدُ هَوَازِنَ مُسْلِمِينَ فَسَأَلُوهُ أَنْ يَرُدَّ إِلَيْهِمْ أَمْوَالَهُمْ وَسَبْيَهُمْ فَقَالَ لَهُمْ رَسُولُ اللهِ ﷺ مَعِي مَنْ تَرَوْنَ وَأَحَبُّ الْحَدِيثِ إِلِيَّ أَصْدَقُهُ فَاخْتَارُوا إِحْدَى الطَّائِفَتَيْنِ إِمَّا السَّبْيَ وَإِمَّا الْمَالَ وَقَدِ اسْتَأْنَيْتُ بِكُمْ وَكَانَ أَنْظَرَهُمْ رَسُولُ اللهِ ﷺ بِضْعَ عَشْرَةَ لَيْلَةً حِينَ قَفَلَ مِنَ الطَّائِفِ فَلَمَّا تَبَيَّنَ لَهُمْ أَنَّ رَسُولَ اللهِ ﷺ غَيْرُ رَادٍّ إِلَيْهِمْ إِلَّا إِحْدَى الطَّائِفَتَيْنِ قَالُوا فَإِنَّا نَخْتَارُ سَبْيَنَا فَقَامَ رَسُولُ اللهِ ﷺ فِي الْمُسْلِمِينَ فَأَثْنَى عَلَى اللهِ بِمَا هُوَ أَهْلُهُ ثُمَّ قَالَ أَمَّا بَعْدُ فَإِنَّ إِخْوَانَكُمْ قَدْ جَاءُونَا تَائِبِينَ وَإِنِّي قَدْ رَأَيْتُ أَنْ أَرُدَّ إِلَيْهِمْ سَبْيَهُمْ فَمَنْ أَحَبَّ مِنْكُمْ أَنْ يُطَيِّبَ ذَلِكَ فَلْيَفْعَلْ وَمَنْ أَحَبَّ مِنْكُمْ أَنْ يَكُونَ عَلَى حَظِّهِ حَتَّى نُعْطِيَهُ إِيَّاهُ مِنْ أَوَّلِ مَا يُفِيءُ اللهُ عَلَيْنَا فَقَالَ النَّاسُ قَدْ طَيَّبْنَا ذَلِكَ يَا رَسُولَ اللهِ فَقَالَ رَسُولُ اللهِ إِنَّا لَا نَدْرِي مَنْ أَذِنَ مِنْكُمْ مِمَّنْ لَمْ يَأْذَنْ فَارْجِعُوا حَتَّى يَرْفَعَ إِلَيْنَا عُرَفَاؤُكُمْ فَرَجَعَ النَّاسُ فَكَلَّمَهُمْ عُرَفَاؤُهُمْ فَرَجَعُوا إِلَى رَسُولِ اللهِ ﷺ فَأَخْبَرُوهُ أَنَّهُمْ قَدْ طَيَّبُوا وَأَذِنُوا هَذَا الَّذِي بَلَغَنِي عَنْ سَبْيِ هَوَازِنَ
[Machine] The following passage is a narration about the Prophet Muhammad ﷺ capturing and killing two individuals named Al-Nadr ibn al-Harith al-'Abdi and 'Uqbah ibn Abi Mu'ayt during the Battle of Badr. [Machine] The Messenger of Allah ﷺ commanded Asim ibn Thabit ibn Abi al-Aqlah to strike the neck of Uqbah ibn Abi Muayt when he arrived with the prisoners. Uqbah ibn Abi Muayt said, "Oh, disaster! Why will I be killed among these people?" The Messenger of Allah ﷺ said, "Because of your enmity towards Allah and His Messenger." Uqbah said, "O Muhammad, who will take care of my children if you kill me? Make me as one of your people. If you kill them, you kill me, and if you show kindness to them, you show kindness to me. If you take ransom from them, I will be like one of them." The Messenger of Allah ﷺ said, "O Asim ibn Thabit, bring him forward and strike his neck." Asim brought him forward and struck his neck.
أَنَّ رَسُولَ اللهِ ﷺ لَمَّا أَقْبَلَ بِالْأُسَارَى حَتَّى إِذَا كَانَ بِعِرْقِ الظُّبْيَةِ أَمَرَ عَاصِمَ بْنَ ثَابِتِ بْنِ أَبِي الْأَقْلَحِ أَنْ يَضْرِبَ عُنُقَ عُقْبَةَ بْنِ أَبِي مُعَيْطٍ فَجَعَلَ عُقْبَةُ بْنُ أَبِي مُعَيْطٍ يَقُولُ يَا وَيْلَاهُ عَلَامَ أُقْتَلُ مِنْ بَيْنِ هَؤُلَاءِ؟ فَقَالَ رَسُولُ اللهِ ﷺ بِعَدَاوَتِكَ لِلَّهِ وَلِرَسُولِهِ فَقَالَ يَا مُحَمَّدُ مَنُّكَ أَفْضَلُ فَاجْعَلْنِي كَرَجُلٍ مِنْ قَوْمِي إِنْ قَتَلْتَهُمْ قَتَلْتَنِي وَإِنْ مَنَنْتَ عَلَيْهِمْ مَنَنْتَ عَلَيَّ وَإِنْ أَخَذْتَ مِنْهُمُ الْفِدَاءَ كُنْتُ كَأَحَدِهِمْ يَا مُحَمَّدُ مَنْ لِلصِّبْيَةِ؟ فَقَالَ رَسُولُ اللهِ ﷺ النَّارُ يَا عَاصِمُ بْنَ ثَابِتٍ قَدِّمْهُ فَاضْرِبْ عُنُقَهُ فَقَدَّمَهُ فَضَرَبَ عُنُقَهُ
Ibrahim said: Ad-Dahhak ibn Qays intended to appoint Masruq as governor. Thereupon Umarah ibn Uqbah said to him: Are you appointing a man from the remnants of the murderers of Uthman? Masruq said to him: Ibn Mas'ud narrated to us, and he was trustworthy in respect of traditions, that when the Prophet ﷺ intended to kill your father, he said: Who will look after my children? He replied: Fire. I also like for you what the Messenger of Allah ﷺ liked for you. (Using translation from Abū Dāʾūd 2686)
أَنَّ رَسُولَ اللهِ ﷺ لَمَّا أَرَادَ قَتْلَ أَبِيكَ قَالَ مَنْ لِلصِّبْيَةِ؟ قَالَ النَّارُ قَدْ رَضِيتُ لَكَ مَا رَضِيَ لَكَ رَسُولُ اللهِ ﷺ
[Machine] Al-Shafi'i, may Allah have mercy on him, had an agreement with Abu Azza al-Jumahi that he would not fight him without a ransom. The Prophet ﷺ left him with his daughters and took an oath from him not to fight him. However, he deceived him and fought him on the day of Uhud. The Prophet ﷺ called for him not to be released, and no other disbeliever was captured except him. He said, "O Muhammad, spare me and allow me to take care of my daughters, and I will give you an oath not to fight you again." The Prophet ﷺ said, "Do not touch him, for he has deceived me twice in Makkah by saying that he had accepted Islam." Then he ordered him to be executed. Abu Sa'id bin Abi 'Amr narrated this to us, Abu al-'Abbas narrated it to us, and Al-Rabi' narrated it to us from Al-Shafi'i. We have also heard it from sources other than Al-Shafi'i in the book of Al-Qasam.
الشَّافِعِيُّ رَحِمَهُ اللهُ وَكَانَ الْمَمْنُونُ عَلَيْهِمْ بِلَا فِدْيَةٍ أَبَا عَزَّةَ الْجُمَحِيَّ تَرَكَهُ رَسُولُ اللهِ ﷺ لِبَنَاتِهِ وَأَخَذَ عَلَيْهِ عَهْدًا أَنْ لَا يُقَاتِلَهُ فَأَخْفَرَهُ وَقَاتَلَهُ يَوْمَ أُحُدٍ فَدَعَا رَسُولُ اللهِ ﷺ أَنْ لَا يُفْلِتَ فَمَا أُسِرَ مِنَ الْمُشْرِكِينَ رَجُلٌ غَيْرُهُ فَقَالَ يَا مُحَمَّدُ امْنُنْ عَلَيَّ وَدَعْنِي لِبَنَاتِي وَأُعْطِيَكَ عَهْدًا أَنْ لَا أَعُودَ لِقِتَالِكَ فَقَالَ النَّبِيُّ ﷺ لَا تَمْسَحُ عَلَى عَارِضَيْكَ بِمَكَّةَ تَقُولُ قَدْ خَدَعْتُ مُحَمَّدًا مَرَّتَيْنِ فَأَمَرَ بِهِ فَضُرِبَ عُنُقُهُ أَخْبَرَنَاهُ أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو ثنا أَبُو الْعَبَّاسِ أنبأ الرَّبِيعُ أَنْبَأَ الشَّافِعِيُّ فَذَكَرَهُ وَقَدْ رُوِّينَا فِي ذَلِكَ عَنْ غَيْرِ الشَّافِعِيِّ فِي كِتَابِ الْقَسْمِ
[Machine] Did the Messenger of Allah ﷺ free any captives on the Day of Badr? He freed Abu 'Azza, the son of 'Amr ibn 'Abd al-Jumahi, who was a poet. Abu 'Azza said to the Prophet ﷺ , "O Muhammad, I have five daughters who have nothing, so give me charity for them." The Prophet ﷺ did as he requested and Abu 'Azza said, "I will give you a guarantee that I will not fight against you nor harm you in any way." So the Messenger of Allah ﷺ sent him with this guarantee. When the people of Quraysh went out to Uhud, Safwan ibn Umayyah came to him and said, "Come out with us." Abu 'Azza replied, "I have given Muhammad a guarantee that I will not fight against him." So Safwan guaranteed that Abu 'Azza's daughters would be treated like his own if he was killed, and if he lived he would give him a lot of wealth. Abu 'Azza continued to support Quraysh until he went out with them on the day of Uhud and was captured. No one from Quraysh was captured except him. Abu 'Azza said to the Prophet ﷺ , "O Muhammad, I was forced to go with them and I have daughters, so be generous to me." The Messenger of Allah ﷺ replied, "Where is the guarantee and pledge that you gave me?" Abu 'Azza said, "By Allah, I did not wipe my face on the Kaaba and say that I had made Muhammad my enemy twice." Sa'id ibn al-Musayyib said that the Prophet ﷺ said, "A believer will not be stung from the same hole twice." Then he said, "O 'Asim ibn Thabit, bring him forward and strike his neck." 'Asim brought him forward and struck his neck. Shaykh (may Allah have mercy on him) said that the Messenger of Allah ﷺ also captured Thumamah ibn Uthal al-Hanafi after that, and he converted and his Islam was good.
أَمَّنَ رَسُولُ اللهِ ﷺ مِنَ الْأُسَارَى يَوْمَ بَدْرٍ أَبَا عَزَّةَ عَبْدَ اللهِ بْنَ عَمْرِو بْنِ عَبْدٍ الْجُمَحِيَّ وَكَانَ شَاعِرًا وَكَانَ قَالَ لِلنَّبِيِّ ﷺ يَا مُحَمَّدُ إِنَّ لِي خَمْسَ بَنَاتٍ لَيْسَ لَهُنَّ شَيْءٌ فَتَصَدَّقْ بِي عَلَيْهِنَّ فَفَعَلَ وَقَالَ أَبُو عَزَّةَ أُعْطِيكَ مَوْثِقًا أَنْ لَا أُقَاتِلَكَ وَلَا أُكْثِرَ عَلَيْكَ أَبَدًا فَأَرْسَلَهُ رَسُولُ اللهِ ﷺ فَلَمَّا خَرَجَتْ قُرَيْشٌ إِلَى أُحُدٍ جَاءَهُ صَفْوَانُ بْنُ أُمَيَّةَ فَقَالَ اخْرُجْ مَعَنَا فَقَالَ إِنِّي قَدْ أَعْطَيْتُ مُحَمَّدًا مَوْثِقًا أَنْ لَا أُقَاتِلَهُ فَضَمِنَ صَفْوَانُ أَنْ يَجْعَلَ بَنَاتِهِ مَعَ بَنَاتِهِ إِنْ قُتِلَ وَإِنْ عَاشَ أَعْطَاهُ مَالًا كَثِيرًا فَلَمْ يَزَلْ بِهِ حَتَّى خَرَجَ مَعَ قُرَيْشٍ يَوْمَ أُحُدٍ فَأُسِرَ وَلَمْ يُؤْسَرْ غَيْرُهُ مِنْ قُرَيْشٍ فَقَالَ يَا مُحَمَّدُ إِنَّمَا أُخْرِجْتُ كَرْهًا وَلِي بَنَاتٌ فَامْنُنْ عَلَيَّ فَقَالَ رَسُولُ اللهِ ﷺ أَيْنَ مَا أَعْطَيْتَنِي مِنَ الْعَهْدِ وَالْمِيثَاقِ؟ لَا وَاللهِ لَا تَمْسَحُ عَارِضَيْكَ بِمَكَّةَ تَقُولُ سَخِرْتُ بِمُحَمَّدٍ مَرَّتَيْنِ قَالَ سَعِيدُ بْنُ الْمُسَيِّبِ فَقَالَ النَّبِيُّ ﷺ إِنَّ الْمُؤْمِنَ لَا يُلْدَغُ مِنْ جُحْرٍ مَرَّتَيْنِ يَا عَاصِمُ بْنَ ثَابِتٍ قَدِّمْهُ فَاضْرِبْ عُنُقَهُ فَقَدَّمَهُ فَضَرَبَ عُنُقَهُ قَالَ الشَّيْخُ رَحِمَهُ اللهُ ثُمَّ أَسَرَ رَسُولُ اللهِ ﷺ ثُمَامَةَ بْنَ أُثَالٍ الْحَنَفِيَّ بَعْدُ فَمَنَّ عَلَيْهِ ثُمَّ عَادَ ثُمَامَةُ بْنُ أُثَالٍ بَعْدُ فَأَسْلَمَ وَحَسُنَ إِسْلَامُهُ
The Prophet ﷺ sent some cavalry towards Najd and they brought a man from the tribe of Banu Hanifa who was called Thumama bin Uthal. They fastened him to one of the pillars of the Mosque. The Prophet went to him and said, "What have you got, O Thumama?" He replied," I have got a good thought, O Muhammad! If you should kill me, you would kill a person who has already killed somebody, and if you should set me free, you would do a favor to one who is grateful, and if you want property, then ask me whatever wealth you want." He was left till the next day when the Prophet ﷺ said to him, "What have you got, Thumama? He said, "What I told you, i.e. if you set me free, you would do a favor to one who is grateful." The Prophet ﷺ left him till the day after, when he said, "What have you got, O Thumama?" He said, "I have got what I told you. "On that the Prophet ﷺ said, "Release Thumama." So he (i.e. Thumama) went to a garden of date-palm trees near to the Mosque, took a bath and then entered the Mosque and said, "I testify that None has the right to be worshipped except Allah, and also testify that Muhammad is His Apostle! By Allah, O Muhammad! There was no face on the surface of the earth most disliked by me than yours, but now your face has become the most beloved face to me. By Allah, there was no religion most disliked by me than yours, but now it is the most beloved religion to me. By Allah, there was no town most disliked by me than your town, but now it is the most beloved town to me. Your cavalry arrested me (at the time) when I was intending to perform the ʿUmra. And now what do you think?" The Prophet ﷺ gave him good tidings (congratulated him) and ordered him to perform the ʿUmra. So when he came to Mecca, someone said to him, "You have become a Sabian?" Thumama replied, "No! By Allah, I have embraced Islam with Muhammad, Apostle of Allah. No, by Allah! Not a single grain of wheat will come to you from Yamamah unless the Prophet gives his permission." (Using translation from Bukhārī 4372)
أَنَّهُ سَمِعَ أَبَا هُرَيْرَةَ ؓ يَقُولُ بَعَثَ رَسُولُ اللهِ ﷺ خَيْلًا نَحْوَ أَرْضِ نَجْدٍ فَجَاءَتْ بِرَجُلٍ يُقَالُ لَهُ ثُمَامَةُ بْنُ أُثَالٍ الْحَنَفِيُّ سَيِّدُ أَهْلِ الْيَمَامَةِ فَرَبَطُوهُ بِسَارِيَةٍ مِنْ سَوَارِي الْمَسْجِدِ فَخَرَجَ عَلَيْهِ رَسُولُ اللهِ ﷺ فَقَالَ مَا عِنْدَكَ يَا ثُمَامَةُ قَالَ عِنْدِي يَا مُحَمَّدُ خَيْرٌ إِنْ تَقْتُلْنِي تَقْتُلْ ذَا دَمٍ وَإِنْ تُنْعِمْ تُنْعِمْ عَلَى شَاكِرٍ وَإِنْ تُرِدِ الْمَالَ فَسَلْ تُعْطَ مِنْهُ مَا شِئْتَ فَتَرَكَهُ رَسُولُ اللهِ ﷺ حَتَّى إِذَا كَانَ مِنَ الْغَدِ ثُمَّ قَالَ مَا عِنْدَكَ يَا ثُمَامَةُ فَقَالَ عِنْدِي مَا قُلْتُ لَكَ فَرَدَّهَا عَلَيْهِ ثُمَّ أَتَاهُ الْيَوْمَ الثَّالِثَ فَرَدَّهَا عَلَيْهِ فَقَالَ رَسُولُ اللهِ ﷺ أَطْلِقُوا ثُمَامَةَ فَخَرَجَ ثُمَامَةُ إِلَى نَخْلٍ قَرِيبٍ مِنَ الْمَسْجِدِ فَاغْتَسَلَ مِنَ الْمَاءِ ثُمَّ دَخَلَ الْمَسْجِدَ فَقَالَ أَشْهَدُ أَنْ لَا إِلَهَ إِلَّا اللهُ وَأَشْهَدُ أَنَّ مُحَمَّدًا رَسُولُ اللهِ يَا مُحَمَّدُ وَاللهِ مَا كَانَ عَلَى وَجْهِ الْأَرْضِ وَجْهٌ أَبْغَضَ إِلِيَّ مِنْ وَجْهِكَ وَقَدْ أَصْبَحَ وَجْهُكَ أَحَبَّ الْوُجُوهِ إِلِيَّ وَاللهِ مَا كَانَ دِينٌ أَبْغَضَ إِلِيَّ مِنْ دِينِكَ وَقَدْ أَصْبَحَ دِينُكَ أَحَبَّ الْأَدْيَانِ إِلِيَّ وَوَاللهِ مَا كَانَ مِنْ بَلَدٍ أَبْغَضَ إِلِيَّ مِنْ بَلَدِكَ وَقَدْ أَصْبَحَ بَلَدُكَ أَحَبَّ الْبُلْدَانِ كُلِّهَا إِلِيَّ وَإِنَّ خَيْلَكَ أَخَذَتْنِي وَأَنَا أُرِيدُ الْعُمْرَةَ فَمَاذَا تَرَى؟ فَبَشَّرَهُ رَسُولُ اللهِ ﷺ وَأَمَرَهُ أَنْ يَعْتَمِرَ فَلَمَّا قَدِمَ قَالَ لَهُ رِجَالٌ بِمَكَّةَ أَصَبَوْتَ يَا ثُمَامَةُ؟ فَقَالَ لَا وَاللهِ مَا صَبَوْتُ وَلَكِنِّي أَسْلَمْتُ مَعَ رَسُولِ اللهِ ﷺ وَاللهِ لَا يَأْتِيكُمْ حَبَّةُ حِنْطَةٍ مِنَ الْيَمَامَةِ حَتَّى يَأْذَنَ فِيهَا رَسُولُ اللهِ ﷺ
[Machine] The Prophet ﷺ prayed to Allah when he saw what was being done to him, and asked Allah to enable him to have power over that person. This person was a polytheist and he intended to kill the Prophet ﷺ . Thumamah, a believer who was still practicing polytheism at the time, approached the Prophet ﷺ until they entered the city. Thumamah was confused about what to do in the city until he was captured and brought to the Prophet ﷺ . The Prophet ﷺ ordered him to be tied to one of the pillars of the mosque. The Prophet ﷺ came to him and asked him, "Thumamah, what do you think? Can Allah do whatever he wants with you?" Thumamah replied, "That is true, O Muhammad. If you kill, you will kill a man with blood, and if you forgive, you will forgive one who is grateful, and if you ask for wealth, you will give it to him." The Prophet ﷺ left him until the next day when he passed by him again and asked him what he thought. Thumamah replied with the same response, and the Prophet ﷺ said, "Release him, for I have forgiven you, O Thumamah." Thumamah left until he reached a wall of the city, where he performed ablution and purified himself and his clothes. Then he came to the Prophet ﷺ who was sitting in the mosque with his companions, and he said to him, "O Muhammad, by Allah, I have never seen a face more hated to me than yours, nor a religion more hated to me than yours, nor a city more hated to me than yours. But now, by Allah, I have never seen a face more beloved to me than yours, nor a religion more beloved to me than yours, nor a city more beloved to me than yours. And I bear witness that there is no god but Allah and that Muhammad is His servant and His Messenger. O Messenger of Allah, I had set out for Umrah while still following the religion of my people, so give me glad tidings of a reward from Allah for my Umrah." The Prophet ﷺ gave him the glad tidings and taught him, and Thumamah left as a believer. When he reached Makkah, the Quraysh heard him speaking about the matter of Muhammad and Islam, so they became angry with him. He said, "By Allah, I have not come to you to speak about anything, but I have embraced Islam and believed in Muhammad." The Quraysh were angered by his words, but he said, "By Allah, I have not spoken falsely, but I have embraced Islam and believed in Muhammad. I swear by the One in whose hand is the soul of Thumamah, not even a grain of wheat from the land of Al-Yamamah will reach you until Muhammad ﷺ gives permission." And Thumamah remained in Makkah until the call to prayer was made by Muhammad ﷺ , and he left for his homeland. The Quraysh prevented him from taking any food with him until they sent a letter to the Prophet ﷺ asking him, by the ties of kinship, to order Thumamah to let them have some of the food. The Prophet ﷺ complied with their request.
أَنَّ رَسُولَ اللهِ ﷺ دَعَا اللهَ حِينَ عَرَضَ لِرَسُولِ اللهِ ﷺ بِمَا عَرَضَ لَهُ أَنْ يُمَكِّنَهُ اللهُ مِنْهُ وَكَانَ عَرَضَ لَهُ وَهُوَ مُشْرِكٌ فَأَرَادَ قَتْلَهُ فَأَقْبَلَ ثُمَامَةُ مُعْتَمِرًا وَهُوَ عَلَى شِرْكِهِ حَتَّى دَخَلَ الْمَدِينَةَ فَتَحَيَّرَ فِيهَا حَتَّى أُخِذَ وَأُتِيَ بِهِ رَسُولُ اللهِ ﷺ فَأَمَرَ بِهِ فَرُبِطَ إِلَى عَمُودٍ مِنْ عُمُدِ الْمَسْجِدِ فَخَرَجَ عَلَيْهِ رَسُولُ اللهِ ﷺ فَقَالَ مَا لَكَ يَا ثُمَامَةُ هَلْ أَمْكَنَ اللهُ مِنْكَ؟ قَالَ وَقَدْ كَانَ ذَلِكَ يَا مُحَمَّدُ إِنْ تَقْتُلْ تَقْتُلْ ذَا دَمٍ وَإِنْ تَعْفُ تَعْفُ عَنْ شَاكِرٍ وَإِنْ تَسْأَلْ مَالًا تُعْطَهُ فَمَضَى رَسُولُ اللهِ ﷺ وَتَرَكَهُ حَتَّى إِذَا كَانَ الْغَدُ مَرَّ بِهِ فَقَالَ مَا لَكَ يَا ثُمَامَ؟ فَقَالَ خَيْرًا يَا مُحَمَّدُ إِنْ تَقْتُلْ تَقْتُلْ ذَا دَمٍ وَإِنْ تَعْفُ تَعْفُ عَنْ شَاكِرٍ وَإِنْ تَسْأَلْ مَالًا تُعْطَهُ ثُمَّ انْصَرَفَ عَنْهُ رَسُولُ اللهِ ﷺ قَالَ أَبُو هُرَيْرَةَ ؓ فَجَعَلْنَا الْمَسَاكِينَ نَقُولُ بَيْنَنَا مَا نَصْنَعُ بِدَمِ ثُمَامَةَ؟ وَاللهِ لَأَكْلَةٌ مِنْ جَزُورٍ سَمِينَةٍ مِنْ فِدَائِهِ أَحَبُّ إِلَيْنَا مِنْ دَمِ ثُمَامَةَ فَلَمَّا كَانَ الْغَدُ مَرَّ بِهِ رَسُولُ اللهِ ﷺ فَقَالَ مَا لَكَ يَا ثُمَامَ؟ فَقَالَ خَيْرًا يَا مُحَمَّدُ إِنْ تَقْتُلْ تَقْتُلْ ذَا دَمٍ وَإِنْ تَعْفُ تَعْفُ عَنْ شَاكِرٍ وَإِنْ تَسَألْ مَالًا تُعْطَهُ فَقَالَ رَسُولُ اللهِ ﷺ أَطْلِقُوهُ فَقَدْ عَفَوْتُ عَنْكَ يَا ثُمَامَ فَخَرَجَ ثُمَامَةُ حَتَّى أَتَى حَائِطًا مِنْ حِيطَانِ الْمَدِينَةِ فَاغْتَسَلَ فِيهِ وَتَطَهَّرَ وَطَهَّرَ ثِيَابَهُ ثُمَّ جَاءَ رَسُولَ اللهِ ﷺ وَهُوَ جَالِسٌ فِي الْمَسْجِدِ فِي أَصْحَابِهِ فَقَالَ يَا مُحَمَّدُ وَاللهِ لَقَدْ كُنْتَ وَمَا وَجْهٌ أَبْغَضَ إِلِيَّ مِنْ وَجْهِكَ وَلَا دِينَ أَبْغَضُ إِلِيَّ مِنْ دِينِكَ وَلَا بَلَدَ أَبْغَضُ إِلِيَّ مِنْ بَلَدِكَ ثُمَّ لَقَدْ أَصْبَحْتَ وَمَا وَجْهٌ أَحَبَّ إِلِيَّ مِنْ وَجْهِكَ وَلَا دِينَ أَحَبُّ إِلِيَّ مِنْ دِينِكَ وَلَا بَلَدَ أَحَبُّ إِلِيَّ مِنْ بَلَدِكَ وَإِنِّي أَشْهَدُ أَنْ لَا إِلَهَ إِلَّا اللهُ وَأَنَّ مُحَمَّدًا عَبْدُهُ وَرَسُولُهُ يَا رَسُولَ اللهِ إِنِّي كُنْتُ قَدْ خَرَجْتُ مُعْتَمِرًا وَأَنَا عَلَى دِينِ قَوْمِي فَبَشِّرْنِي صَلَّى الله عَلَيْكَ فِي عُمْرَتِي فَبَشَّرَهُ وَعَلَّمَهُ فَخَرَجَ مُعْتَمِرًا فَلَمَّا قَدِمَ مَكَّةَ وَسَمِعَتْهُ قُرَيْشٌ يَتَكَلَّمُ بِأَمْرِ مُحَمَّدٍ مِنَ الْإِسْلَامِ قَالُوا صَبَأَ ثُمَامَةُ فَأَغْضَبُوهُ فَقَالَ إِنِّي وَاللهِ مَا صَبَوْتُ وَلَكِنِّي أَسْلَمْتُ وَصَدَّقْتُ مُحَمَّدًا وَآمَنْتُ بِهِ وَايْمُ الَّذِي نَفْسُ ثُمَامَةَ بِيَدِهِ لَا يَأْتِيكُمْ حَبَّةٌ مِنَ الْيَمَامَةِ وَكَانَتْ رِيفَ مَكَّةَ مَا بَقِيتُ حَتَّى يَأْذَنَ فِيهَا مُحَمَّدٌ ﷺ وَانْصَرَفَ إِلَى بَلَدِهِ وَمَنَعَ الْحَمْلَ إِلَى مَكَّةَ حَتَّى جَهَدَتْ قُرَيْشٌ فَكَتَبُوا إِلَى رَسُولِ اللهِ ﷺ يَسْأَلُونَهُ بِأَرْحَامِهِمْ أَنْ يَكْتُبَ إِلَى ثُمَامَةَ يُخَلِّي إِلَيْهِمْ حَمْلَ الطَّعَامِ فَفَعَلَ رَسُولُ اللهِ ﷺ
[Machine] And Thabit ibn Qays ibn Shammās approached the Messenger of Allah ﷺ and said, "Grant me Zubayr al-Yahūdī and I will repay him for what he had given me on the day of the Battle of Badr." So he was given to him. Thabit continued until he reached Zubayr and said, "O Abu 'Abd al-Rahmān, do you recognize me?" He replied, "Yes, and does a man deny his brother?" Thabit said, "I intended to repay you today with a hand that I had with me on the day of the Battle of Badr." He said, "Do so, for indeed the noble one rewards the noble one." Zubayr said, "I have no leader and you have taken my wife and children." Thabit returned to Zubayr and said, "The Messenger of Allah ﷺ has returned your wife and children to you." Zubayr replied, "My reed canopy, in which I have my spear, is the only means of livelihood for me and my family." Thabit returned to the Messenger of Allah ﷺ and he granted it to him. Thabit went back to Zubayr and said, "The Messenger of Allah ﷺ has returned your family and wealth to you. So embrace Islam, and you will be safe." He said, "What have the two companions done?" And he mentioned the names of some men of his people. Thabit said, "They have been killed and none of them remains. Perhaps Allah, may He be blessed and exalted, has left you for something better." Zubayr said, "I ask you by Allah, O Thabit, and by the right of our upcoming dispute on the Day of Resurrection, have you joined them to me? For there is no good in life after them." Thabit mentioned this to the Messenger of Allah ﷺ and he ordered the killing of Zubayr. Muhammad ibn Ishaq ibn Yasār also mentioned it, narrating from al-Zuhrī, and he mentioned that it was Zubayr ibn Baṭā al-Qurazhī. Musa ibn 'Uqbah also mentioned it and he mentioned that Zubayr was blind on that day.
وَأَقْبَلَ ثَابِتُ بْنُ قَيْسِ بْنِ شَمَّاسٍ إِلَى رَسُولِ اللهِ ﷺ فَقَالَ هَبْ لِي الزُّبَيْرَ الْيَهُودِيَّ أَجْزِيهِ فَقَدْ كَانَتْ لَهُ عِنْدِي يَوْمَ بُعَاثٍ فَأَعْطَاهُ إِيَّاهُ فَأَقْبَلَ ثَابِتٌ حَتَّى أَتَاهُ فَقَالَ يَا أَبَا عَبْدِ الرَّحْمَنِ هَلْ تَعْرِفُنِي؟ فَقَالَ نَعَمْ وَهَلْ يُنْكِرُ الرَّجُلُ أَخَاهُ؟ قَالَ ثَابِتٌ أَرَدْتُ أَنْ أَجْزِيَكَ الْيَوْمَ بِيَدٍ لَكَ عِنْدِي يَوْمَ بُعَاثٍ قَالَ فَافْعَلْ فَإِنَّ الْكَرِيمَ يَجْزِي الْكَرِيمَ قَالَ قَدْ فَعَلْتُ قَدْ سَأَلْتُ رَسُولَ اللهِ ﷺ فَوَهَبَكَ لِي فَأَطْلَقَ عَنْهُ إِسَارَهُ فَقَالَ الزُّبَيْرُ لَيْسَ لِي قَائِدٌ وَقَدْ أَخَذْتُمُ امْرَأَتِي وَبَنِيَّ فَرَجَعَ ثَابِتٌ إِلَى الزُّبَيْرِ فَقَالَ رَدَّ إِلَيْكَ رَسُولُ اللهِ ﷺ امْرَأَتَكَ وَبَنِيكَ فَقَالَ الزُّبَيْرُ حَائِطٌ لِي فِيهِ أَعْذُقٌ لَيْسَ لِي وَلَا لِأَهْلِي عَيْشٌ إِلَّا بِهِ فَرَجَعَ ثَابِتٌ إِلَى رَسُولِ اللهِ ﷺ فَوَهَبَ لَهُ فَرَجَعَ ثَابِتٌ إِلَى الزُّبَيْرِ فَقَالَ قَدْ رَدَّ إِلَيْكَ رَسُولُ اللهِ ﷺ أَهْلَكَ وَمَالَكَ فَأَسْلِمْ تَسْلَمْ قَالَ مَا فَعَلَ الْجَلِيسَانِ وَذَكَرَ رِجَالَ قَوْمِهِ قَالَ ثَابِتٌ قَدْ قُتِلُوا وَفُرِغَ مِنْهُمْ وَلَعَلَّ اللهَ تَبَارَكَ وَتَعَالَى أَنْ يَكُونَ أَبْقَاكَ لَخَيْرٍ قَالَ الزُّبَيْرُ أَسْأَلُكَ بِاللهِ يَا ثَابِتُ وَبِيَدِي الْخَصِيمِ عِنْدَكَ يَوْمَ بُعَاثٍ إِلَّا أَلْحَقْتَنِي بِهِمْ فَلَيْسَ فِي الْعَيْشِ خَيْرٌ بَعْدَهُمْ فَذَكَرَ ذَلِكَ ثَابِتٌ لِرَسُولِ اللهِ ﷺ فَأَمَرَ بِالزُّبَيْرِ فَقُتِلَ وَذَكَرَهُ أَيْضًا مُحَمَّدُ بْنُ إِسْحَاقَ بْنِ يَسَارٍ عَنِ الزُّهْرِيِّ وَذَكَرَ أَنَّهُ الزُّبَيْرُ بْنُ بَاطَا الْقُرَظِيُّ وَذَكَرَهُ أَيْضًا مُوسَى بْنُ عُقْبَةَ وَذَكَرَ أَنَّهُ كَانَ يَوْمَئِذٍ كَبِيرًا أَعْمَى
[Machine] "That the Prophet ﷺ said to the prisoners of Badr: If Mu'tim ibn 'Adi was alive and he spoke to me about these people, I would have set them free for him."
أَنَّ النَّبِيَّ ﷺ قَالَ لِأُسَارَى بَدْرٍ لَوْ كَانَ مُطْعِمُ بْنُ عَدِيٍّ حَيًّا فَكَلَّمَنِي فِي هَؤُلَاءِ النَّتْنَى لَخَلَّيْتُهُمْ لَهُ
[Machine] Eighty men from the people of Makkah descended upon the Messenger of Allah ﷺ and his companions from the mountain of Tan’im during the Fajr prayer. The Messenger of Allah ﷺ captured them but forgave them. And the Quran was revealed: {It is He who withheld their hands from you and your hands from them within the area of Makkah after He caused you to overpower them} [Al-Fath, 24].
أَنَّ ثَمَانِينَ رَجُلًا مِنْ أَهْلِ مَكَّةَ هَبَطُوا عَلَى رَسُولِ اللهِ ﷺ وَأَصْحَابِهِ مِنْ جَبَلِ التَّنْعِيمِ عِنْدَ صَلَاةِ الْفَجْرِ فَأَخَذَهُمْ رَسُولُ اللهِ ﷺ فَعَفَا عَنْهُمْ قَالَ وَنَزَلَ الْقُرْآنُ {وَهُوَ الَّذِي كَفَّ أَيْدِيَهُمْ عَنْكُمْ وَأَيْدِيَكُمْ عَنْهُمْ بِبَطْنِ مَكَّةَ مِنْ بَعْدِ أَنْ أَظْفَرَكُمْ عَلَيْهِمْ} [الفتح 24]
[Machine] The Prophet ﷺ stayed in a certain place, and the people dispersed and sought shade under the trees. The people hung their weapons on a tree. Then, a Bedouin man came and took his sword and sheathed it. He then approached the Prophet ﷺ and said, "Who can prevent you from me?" The Prophet ﷺ said, "Allah does." So, the Bedouin man returned the sword. The Prophet ﷺ called his companions and informed them about the Bedouin's action. The Bedouin man was sitting nearby, and the Prophet ﷺ did not punish him.
أَنَّ النَّبِيَّ ﷺ نَزَلَ مَنْزِلًا وَتَفَرَّقَ النَّاسُ فِي الْعِضَاهِ يَسْتَظِلُّونَ تَحْتَهَا فَعَلَّقَ النَّاسُ سِلَاحَهُمْ فِي شَجَرَةٍ فَجَاءَ أَعْرَابِيٌّ إِلَى سَيْفِهِ فَأَخَذَهُ وَسَلَّهُ ثُمَّ أَقْبَلَ عَلَى النَّبِيِّ ﷺ فَقَالَ مَنْ يَمْنَعُكَ مِنِّي؟ وَالنَّبِيُّ ﷺ يَقُولُ اللهُ فَشَامَ الْأَعْرَابِيُّ السَّيْفَ فَدَعَا النَّبِيُّ ﷺ أَصْحَابَهُ وَأَخْبَرَهُمْ بِصَنِيعِ الْأَعْرَابِيِّ وَهُوَ جَالِسٌ إِلَى جَنْبِهِ لَمْ يُعَاقِبْهُ
[Machine] To capture the Prophet ﷺ , they sent this Bedouin man who recited the verse: "Remember Allah's favor upon you, when a people plotted against you."
أَنْ يَفْتِكُوا بِالنَّبِيِّ ﷺ فَأَرْسَلُوا هَذَا الْأَعْرَابِيَّ وَيَتْلُو {اذْكُرُوا نِعْمَةَ اللهِ عَلَيْكُمْ إِذْ هَمَّ قَوْمٌ} الْآيَةَ
[Machine] Thaqif tribe was an ally of the Banu Aqil. Thaqif tribe captured two companions of the Prophet Muhammad ﷺ , and the companions of the Prophet Muhammad ﷺ also captured a man, and they were all afflicted with scabies. The Prophet Muhammad ﷺ came to them while they were in confinement and said, "O Muhammad, O Muhammad!" So he ﷺ came to him and said, "What is your matter?" The man said, "Why did you take me and why did you take the leader of the pilgrimage?" So the Prophet ﷺ said, "Because you were captured with the clothes of your ally, Thaqif." Then he turned away from him. Then he called him again and said, "O Muhammad, O Muhammad!" The Prophet Muhammad ﷺ , who was compassionate and kind, returned to him and said, "What is your matter?" He said, "I am a Muslim." The Prophet ﷺ said, "If you had said it while you were in control, you would have succeeded greatly." Then he turned away from him. Then he called him again and said, "O Muhammad, O Muhammad!" So he ﷺ came to him and said, "What is your matter?" He said, "I am hungry, so feed me and I am thirsty, so give me drink." The Prophet ﷺ said, "This is your need." He said, "May my life be sacrificed for the two men."
كَانَتْ ثَقِيفٌ حُلَفَاءَ لِبَنِي عَقِيلٍ فَأَسَرَتْ ثَقِيفٌ رَجُلَيْنِ مِنْ أَصْحَابِ رَسُولِ اللهِ ﷺ وَأَسَرَ أَصْحَابُ رَسُولِ اللهِ ﷺ رَجُلًا وَأَصَابُوا مَعَهُ الْعَضْبَاءَ فَأَتَى عَلَيْهِ رَسُولُ اللهِ ﷺ وَهُوَ فِي الْوَثَاقِ فَقَالَ يَا مُحَمَّدُ يَا مُحَمَّدُ فَأَتَاهُ ﷺ فَقَالَ مَا شَأْنُكَ؟ فقَالَ بِمَ أَخَذْتَنِي وَبِمَ أَخَذْتَ سَابِقَ الْحَاجِّ؟ فَقَالَ إِعْظَامًا لِذَاكَ أُخِذْتَ بِجَرِيرَةِ حُلَفَائِكَ ثَقِيفٍ ثُمَّ انْصَرَفَ عَنْهُ فَنَادَاهُ فَقَالَ يَا مُحَمَّدُ يَا مُحَمَّدُ قَالَ وَكَانَ رَسُولُ اللهِ ﷺ رَحِيمًا رَفِيقًا فَرَجَعَ إِلَيْهِ فَقَالَ مَا شَأْنُكَ؟ فَقَالَ إِنِّي مُسْلِمٌ قَالَ لَوْ قُلْتَهَا وَأَنْتَ تَمْلِكُ أَمْرَكَ أَفْلَحْتَ كُلَّ الْفَلَاحِ ثُمَّ انْصَرَفَ عَنْهُ فَنَادَاهُ يَا مُحَمَّدُ يَا مُحَمَّدُ فَأَتَاهُ فَقَالَ مَا شَأْنُكَ؟ فَقَالَ إِنِّي جَائِعٌ فَأَطْعِمْنِي وَظَمْآنُ فَاسْقِنِي قَالَ هَذِهِ حَاجَتُكَ قَالَ فَفُدِيَ بِالرَّجُلَيْنِ
[Machine] That the Prophet ﷺ redeemed two Muslim men and gave to a polytheist man. Sufyan said, he means he took two Muslim men and gave to a polytheist man.
أَنَّ النَّبِيَّ ﷺ فَدَى رَجُلَيْنِ مِنَ الْمُسْلِمِينَ وَأَعْطَى رَجُلًا مِنَ الْمُشْرِكِينَ قَالَ سُفْيَانُ يَعْنِي أَخَذَ رَجُلَيْنِ مِنَ الْمُسْلِمِينَ وَأَعْطَى رَجُلًا مِنَ الْمُشْرِكِينَ
[Machine] On the day of the Battle of Badr, the Prophet ﷺ asked, "What do you think of these prisoners?" Abu Bakr replied, "O Prophet of Allah, they are the sons of our relatives, our clans, and our brothers, except for the fact that we took ransom from them to gain strength against the disbelievers. Perhaps Allah may guide them to Islam and they will become supporters for us." The Prophet asked, "What do you think, O Ibn Al-Khattab?" Umar replied, "O Prophet of Allah, I do not see what Abu Bakr sees, but they are the leaders of disbelief and their heads should be struck down. Thus, the Messenger of Allah inclined to what Abu Bakr said and did not pay attention to what I had said. He accepted ransom from them. The next morning, I went to the Messenger of Allah and found him and Abu Bakr sitting and weeping. I asked, "O Prophet of Allah, tell me why you and your companion are weeping. If I find a reason to weep, I will weep. Otherwise, I will pretend to weep because you both are weeping." The Prophet replied, "The Companions presented to me the option of your punishment, which is more severe than this tree and another close tree at that time. Allah revealed the verse, 'It is not for a Prophet to have captives of war...'" (Quran, Surah Al-Anfal: 67).
لَمَّا كَانَ يَوْمُ بَدْرٍ قَالَ مَا تَرَوْنَ فِي هَؤُلَاءِ الْأُسَارَى؟ فَقَالَ أَبُو بَكْرٍ ؓ يَا نَبِيَّ اللهِ بَنُو الْعَمِّ وَالْعَشِيرَةُ وَالْإِخْوَانُ غَيْرَ أَنَّا نَأْخُذُ مِنْهُمُ الْفِدَاءَ؛ لِيَكُونَ لَنَا قُوَّةً عَلَى الْمُشْرِكِينَ وَعَسَى الله ﷻ أَنْ يَهْدِيَهُمْ إِلَى الْإِسْلَامِ وَيَكُونُوا لَنَا عَضُدًا قَالَ فَمَاذَا تَرَى يَا ابْنَ الْخَطَّابِ؟ قُلْتُ يَا نَبِيَّ اللهِ مَا أَرَى الَّذِي رَأَى أَبُو بَكْرٍ وَلَكِنْ هَؤُلَاءِ أَئِمَّةُ الْكُفْرِ وَصَنَادِيدُهُمْ فَقَرِّبْهُمْ وَاضْرِبْ أَعْنَاقَهُمْ قَالَ فَهَوِيَ رَسُولُ اللهِ ﷺ مَا قَالَ أَبُو بَكْرٍ وَلَمْ يَهْوَ مَا قُلْتُ أَنَا فَأَخَذَ مِنْهُمُ الْفِدَاءَ فَلَمَّا أَصْبَحْتُ غَدَوْتُ عَلَى رَسُولِ اللهِ ﷺ وَإِذَا هُوَ وَأَبُو بَكْرٍ قَاعِدَانِ يَبْكِيَانِ فَقُلْتُ يَا نَبِيَّ اللهِ أَخْبِرْنِي مِنْ أِيِّ شَيْءٍ تَبْكِي أَنْتَ وَصَاحِبُكَ؟ فَإِنْ وَجَدْتُ بُكَاءً بَكَيْتُ وَإِلَّا تَبَاكَيْتُ لِبُكَائِكُمَا قَالَ الَّذِي عَرَضَ عَلَيَّ أَصْحَابُكَ لَقَدْ عُرِضَ عَلَيَّ عَذَابُكُمْ أَدْنَى مِنْ هَذِهِ الشَّجَرَةِ وَشَجَرَةٌ قُرَيْبَةٌ حِينَئِذٍ فَأَنْزَلَ اللهُ ﷻ {مَا كَانَ لِنَبِيٍّ أَنْ يَكُونَ لَهُ أَسْرَى حَتَّى يُثْخِنَ فِي الْأَرْضِ تُرِيدُونَ عَرَضَ الدُّنْيَا وَاللهُ يُرِيدُ الْآخِرَةَ} [الأنفال 67] الْآيَةَ
[Machine] The Messenger of Allah ﷺ said, concerning the prisoners of war on the day of the Battle of Badr, "If you wish, you may kill them, and if you wish, you may ransom them. And if you wish, you may enjoy the ransom, and some of you may be martyred while fighting them." Then, at the end of the seventy, Thabit ibn Qays was killed on the day of Yamama. Al-Burullusi added in his narration, "I repeated this to Azhar, but he insisted on saying that Ubaydah reported from Ali."
قَالَ رَسُولُ اللهِ ﷺ فِي الْأُسَارَى يَوْمَ بَدْرٍ إِنْ شِئْتُمْ قَتَلْتُمُوهُمْ وَإِنْ شِئْتُمْ فَادَيْتُمُوهُمْ وَاسْتَمْتَعْتُمْ بِالْفِدَاءِ وَاسْتُشْهِدَ مِنْكُمْ بِعُدَّتِهِمْ قَالَ فَكَانَ آخِرُ السَّبْعِينَ ثَابِتَ بْنَ قَيْسٍ قُتِلَ يَوْمَ الْيَمَامَةِ زَادَ الْبُرُلُّسِيُّ فِي رِوَايَتِهِ قَالَ ابْنُ عَرْعَرَةَ رَدَدْتُ هَذَا عَلَى أَزْهَرَ فَأَبَى إِلَّا أَنْ يَقُولَ عُبَيْدَةُ عَنْ عَلِيٍّ ؓ
The Prophet ﷺ fixed the ransom of the people of pre-Islamic Arabia at four hundred dirhams per head on the day of the battle of Badr. (Using translation from Abū Dāʾūd 2691)
جَعَلَ رَسُولُ اللهِ ﷺ فِي فِدَاءِ الْأُسَارَى أَهْلِ الْجَاهِلِيَّةِ أَرْبَعَمِائَةٍ
[Machine] Make his feet in place of his feet and clear his path until he is sent to you with his redemption. So clear the way for Suhail and confine Mikraz. He said, "By every people who has their prisoner, I will redeem them with what they are pleased." He said, "And the majority of captives on the Day of Badr were redeemed by Abbas ibn Abd al-Muttalib, because he was a generous man. He redeemed himself with a hundred ounces of gold."
اجْعَلُوا رِجْلِيَّ مَكَانَ رِجْلِهِ وَخَلُّوا سَبِيلَهُ حَتَّى يُبْعَثَ إِلَيْكَم بِفِدَائِهِ فَخَلَّوْا سَبِيلَ سُهَيْلٍ وَحَبَسُوا مِكْرَزًا قَالَ فَفَدَى كُلُّ قَوْمٍ أَسِيرَهُمْ بِمَا رَضُوا قَالَ وَكَانَ أَكْثَرُ الْأُسَارَى يَوْمَ بَدْرٍ فِدَاءً الْعَبَّاسَ بْنَ عَبْدِ الْمُطَّلِبِ وَذَلِكَ لَأَنَّهُ كَانَ رَجُلًا مُوسِرًا فَافْتَدَى نَفْسَهُ بِمِائَةِ أُوقِيَّةِ ذَهَبٍ
[Machine] Some men from the Ansar sought permission from the Messenger of Allah ﷺ and said, "Grant us permission to leave our share for the sake of our cousin, Abbas." He replied, "By Allah, you will not leave a single dirham."
أَنَّ رِجَالًا مِنَ الْأَنْصَارِ اسْتَأْذَنُوا رَسُولَ اللهِ ﷺ فَقَالُوا ائْذَنْ لَنَا فَلْنَتْرُكْ لِابْنِ أُخْتِنَا الْعَبَّاسِ فِدَاءَهُ فَقَالَ وَاللهِ لَا تَذَرُونَ دِرْهَمًا
58.59 [Machine] The killing of the polytheists after Al-Isar by decapitation without ransom.
٥٨۔٥٩ بَابُ قَتْلِ الْمُشْرِكِينَ بَعْدَ الْإِسَارِ بِضَرْبِ الْأَعْنَاقِ دُونَ الْمُثْلَةِ
There are two characteristics that I heard the Messenger of Allah ﷺ say: Allah has decreed that everything should be done in a good way, so when you kill use a good method. The version of the narrators other than Muslim says: "So kill in a good manner." And when you slaughter, you should use a good method, for one of you should sharpen his knife, and give the animal as little pain as possible. (Using translation from Abū Dāʾūd 2815)
عَنْ رَسُولِ اللهِ ﷺ قَالَ إِنَّ اللهَ كَتَبَ الْإِحْسَانَ عَلَى كُلِّ شَيْءٍ فَإِذَا قَتَلْتُمْ فَأَحْسِنُوا الْقِتْلَةَ وَإِذَا ذَبَحْتُمْ فَأَحْسِنُوا الذَّبْحَ وَلْيُحِدَّ أَحَدُكُمْ شَفْرَتَهُ وَلْيُرِحْ ذَبِيحَتَهُ
[Machine] The Messenger of Allah ﷺ prohibited dealing with interest and plundering.
نَهَى رَسُولُ اللهِ ﷺ عَنِ الْمُثْلَةِ وَالنُّهْبَةِ
[Machine] The Messenger of Allah ﷺ used to give instructions to the leader of an army or expedition for himself, advising him to fear Allah and to be good to the believers who were with him. Then he would say: "Fight in the name of Allah, and fight those who disbelieve in Allah. Go forth and do not be treacherous, deceitful, deceitful, or kill a child."
كَانَ رَسُولُ اللهِ ﷺ إِذَا بَعَثَ أَمِيرًا عَلَى جَيْشٍ أَوْ سَرِيَّةٍ أَمَرَهُ فِي خَاصَّةِ نَفْسِهِ بِتَقْوَى اللهِ وَمَنْ مَعَهُ مِنَ الْمُؤْمِنِينَ خَيْرًا ثُمَّ قَالَ اغْزُوا بِاسْمِ اللهِ فَقَاتِلُوا فِي سَبِيلِ اللهِ وَقَاتِلُوا مَنْ كَفَرَ بِاللهِ اغْزُوا وَلَا تَغُلُّوا وَلَا تَغْدِرُوا وَلَا تُمَثِّلُوا وَلَا تَقْتُلُوا وَلِيدًا
[Machine] That a worker for his father remained, so he made a vow to Allah that if he had the ability, he would cut off his hand. So when he was able to do so, he sent me to Imran ibn Husayn and I asked him. He said, "I heard the Prophet ﷺ urging in his sermon for charity and forbidding usury." He also sent me to Samurah and he said, "I heard the Prophet ﷺ urging for charity and forbidding usury." Imam Shafi'i may Allah have mercy on him said, "And if someone were to say that the hands of those who transgressed his limits were cut off and their feet amputated and their eyes cauterized, then it is narrated from Anas ibn Malik and another man that the Prophet ﷺ did not give a sermon after that without commanding charity and forbidding usury." Sheikh may Allah have mercy on him said.
أَنَّ عَامِلًا لِأَبِيهِ أَبَقَ فَجَعَلَ لِلَّهِ عَلَيْهِ إِنْ قَدِرَ عَلَيْهِ لَيَقْطَعَنَّ يَدَهُ فَلَمَّا قَدَرَ عَلَيْهِ بَعَثَنِي إِلَى عِمْرَانَ بْنِ حُصَيْنٍ ؓ فَسَأَلْتُهُ فَقَالَ إِنِّي سَمِعْتُ النَّبِيَّ ﷺ يَحُثُّ فِي خُطْبَتِهِ عَلَى الصَّدَقَةِ وَنَهَى عَنِ الْمُثْلَةِ قَالَ وَبَعَثَنِي إِلَى سَمُرَةَ فَقَالَ سَمِعْتُ النَّبِيَّ ﷺ يَحُثُّ عَلَى الصَّدَقَةِ وَيَنْهَى عَنِ الْمُثْلَةِ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ فَإِنْ قَالَ قَائِلٌ قَدْ قَطَّعَ أَيْدِيَ الَّذِينَ اسْتَاقُوا لِقَاحَهُ وَأَرْجُلَهُمْ وَسَمَلَ أَعْيُنَهُمْ فَإِنَّ أَنَسَ بْنَ مَالِكٍ وَرَجُلًا رَوَيَا هَذَا عَنِ النَّبِيِّ ﷺ رَوَيَا فِيهِ أَوْ أَحَدُهُمَا أَنَّ النَّبِيَّ ﷺ لَمْ يَخْطُبْ بَعْدَ ذَلِكَ خُطْبَةً إِلَّا أَمَرَ بِالصَّدَقَةِ وَنَهَى عَنِ الْمُثْلَةِ قَالَ الشَّيْخُ رَحِمَهُ اللهُ
If you so like, you may go to the camels of Sadaqa and drink their milk and urine. They did so and were all right. They then fell upon the shepherds and killed them and turned apostates from Islam and drove off the camels of the Prophet ﷺ. This news reached Allah's Apostle ﷺ and he sent (people) on their track and they were (brought) and handed over to him. He (the Holy Prophet) got their hands cut off, and their feet, and put out their eyes, and threw them on the stony ground until they died. (Using translation from Muslim 1671a)
أَنَّ نَاسًا مِنْ عُرَيْنَةَ قَدِمُوا عَلَى رَسُولِ اللهِ ﷺ فَاجْتَوَوْهَا وَقَالَ لَهُمْ رَسُولُ اللهِ ﷺ إِنْ شِئْتُمْ أَنْ تَخْرُجُوا إِلَى إِبِلِ الصَّدَقَةِ فَتَشْرَبُوا مِنْ أَلْبَانِهَا وَأَبْوَالِهَا فَفْعَلُوا فَصَحُّوا ثُمَّ مَالُوا عَلَى الرِّعَاءِ فَقَتَلُوهُمْ وَارْتَدُّوا عَنِ الْإِسْلَامِ وَاسْتَاقُوا ذَوْدَ رَسُولِ اللهِ ﷺ فَبَلَغَ ذَلِكَ النَّبِيَّ ﷺ فَبَعَثَ فِي أَثَرِهِمْ فَأُتِيَ بِهِمْ فَقَطَّعَ أَيْدِيَهُمْ وَأَرْجُلَهُمْ وَسَمَلَ أَعْيُنَهُمْ وَتَرَكَهُمْ فِي الْحَرَّةِ حَتَّى مَاتُوا لَفْظُ حَدِيثِ هُشَيْمٍ وَفِي رِوَايَةِ عَبْدِ الْوَهَّابِ عَنْ حُمَيْدٍ قَالَ لَا أَحْفَظُ اشْرَبُوا أَبْوَالَهَا
[Machine] About the Prophet ﷺ, with the meaning of the narration of Humaid, except that he said, a group of Ukhl said, then the Messenger of Allah ﷺ prohibited metaphor after that.
عَنِ النَّبِيِّ ﷺ بِمَعْنَى حَدِيثِ حُمَيْدٍ إِلَّا أَنَّهُ قَالَ نَفَرٌ مِنْ عُكْلٍ قَالَ فَنَهَى رَسُولُ اللهِ ﷺ عَنِ الْمُثْلَةِ بَعْدَ ذَلِكَ
All the traditions (on this subject) transmitted by 'Adi b. Thabit and A'mash on the authority of Habib and Ayyub al-'Ala, all of them are weak; none of them is sound. This tradition indicates the tradition reported by al-A'mash a a statement of Companion, i.e. 'Aishah. Hafs b. Ghayath has rejected the tradition transmitted by Habib as the statement (of the Prophet). And Asbat also reported it as a statement of 'Aishah. Abu Dawud said: Ibn Dawud has narrated the first part of this tradition as a statement (of the Prophet), and denied that there was any mention of performing ablution for every prayer. The weakness of the tradition reported by Habib is also indicated by the fact that the version transmuted by al-Zuhri from 'Urwah on the authority of 'Aishah says that she used to wash herself for every prayer; (these words occur) in the tradition about the woman who has a flow of blood. This tradition has been reported by Abu al-Yaqzan from 'Adi b. Thabit from his father from 'Ali, and narrated by 'Ammar, the freed salve of Banu Hashim, from Ibn 'Abbas, and transmitted by 'Abd al-Malik b. Maisarah, Bayan, al-Mughirah, Firas, on the authority of al-Sha'bi, from Qumair from 'Aishah, stating: You should perform ablution for every prayer. The version transmitted by Dawud, and 'Asim from al-Sha'bi from Qumair from 'Aishah has the words: She should take bath only once every day. The version reported by Hisham b. 'Urwah from his father has the words: The woman having a flow of blood should perform ablution for every prayer. All these traditions are weak except the tradition reported by Qumair and the tradition reported by 'Ammar, the freed slave of Banu Hashim, and the tradition narrated by Hisham b. 'Urwah on the authority of his father. What is commonly known from Ibn 'Abbas is bathing (for every prayer). (Using translation from Abū Dāʾūd 300)
عَنِ الْمُثْلَةِ
[Machine] That the Messenger of Allah ﷺ used to urge in his sermons for charity and prohibit adultery. Al-Shafi'i (may Allah have mercy on him) said, "May Allah have mercy on him." And Ali bin Al-Hussein used to reject the narration of Anas about the companions of Al-Liqa'.
أَنَّ رَسُولَ اللهِ ﷺ كَانَ يَحُثُّ فِي خُطْبَتِهِ بَعْدَ ذَلِكَ عَلَى الصَّدَقَةِ وَيَنْهَى عَنِ الْمُثْلَةِ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ وَكَانَ عَلِيُّ بْنُ الْحُسَيْنِ يُنْكِرُ حَدِيثَ أَنَسٍ فِي أَصْحَابِ اللِّقَاحِ
[Machine] No, by Allah, the Messenger of Allah ﷺ did not truncate the hands and feet of the people of Liqah, as said by Sheikh (may Allah have mercy on him). This is a narration from Anas, a Hadith that is authentic and supported by the narration of Ibn Umar. Both narrations confirm that the people of Liqah had their eyes plucked out. Therefore, there is no meaning to denying what has been denied, and the best understanding is that it is abrogated as reported by Abu Abdullah Al-Hafiz, who was narrated to by Abu Al-Abbas Muhammad Ibn Ya'qub, who was narrated to by Muhammad Ibn Ishaq, who was narrated to by Affan Ibn Muslim, who was narrated to by Hammam, from Qatadah, from Anas. He narrates that a group from Uraynah came to the Prophet ﷺ , and he mentioned the Hadith. Qatadah said: "And Ibn Sirin narrated to me that this happened before the implementation of the punishments." And in the narration of Hisham, from Qatadah, there is evidence of this or it gives the understanding that he did the same to them as they did to their shepherds.
لَا وَاللهِ مَا سَمَلَ رَسُولُ اللهِ ﷺ عَيْنًا وَلَا زَادَ أَهْلَ اللِّقَاحِ عَلَى قَطْعِ أَيْدِيهِمْ وَأَرْجُلِهِمْ قَالَ الشَّيْخُ رَحِمَهُ اللهُ حَدِيثُ أَنَسٍ حَدِيثٌ ثَابِتٌ صَحِيحٌ وَمَعَهُ رِوَايَةُ ابْنِ عُمَرَ وَفِيهِمَا جَمِيعًا أَنَّهُ سَمَلَ أَعْيُنَهُمْ فَلَا مَعْنَى لِإِنْكَارِ مَنْ أَنْكَرَ وَالْأَحْسَنُ حَمْلُهُ عَلَى النَّسْخِ 18053 كَمَا أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا مُحَمَّدُ بْنُ إِسْحَاقَ ثنا عَفَّانُ بْنُ مُسْلِمٍ ثنا هَمَّامٌ عَنْ قَتَادَةَ عَنْ أَنَسٍ ؓ أَنَّ رَهْطًا مِنْ عُرَيْنَةَ قَدِمُوا عَلَى النَّبِيِّ ﷺ فَذَكَرَ الْحَدِيثَ قَالَ قَتَادَةُ وَحَدَّثَنِي ابْنُ سِيرِينَ أَنَّ هَذَا قَبْلَ أَنْ تَنْزِلَ الْحُدُودُ وَفِي رِوَايَةِ هِشَامٍ عَنْ قَتَادَةَ مَا دَلَّ عَلَى هَذَا أَوْ حَمَلَهُ عَلَى أَنَّهُ فَعَلَ بِهِمْ مَا فَعَلُوا بِالرِّعَاءِ
[Machine] "That the Messenger of Allah ﷺ only made their eyes sleepy because they made the eyes of the shepherds sleepy due to their excessive mentioning of the story of Al-A'rj. And in the narration of Al-Marwazi, the Messenger of Allah ﷺ only made their eyes sleepy because they made the eyes of the shepherds sleepy."
أَنَّ رَسُولَ اللهِ ﷺ إِنَّمَا سَمَلَ أَعْيُنَ أُولَئِكَ لِأَنَّهُمْ سَمَلُوا أَعْيُنَ الرُّعَاةِ لَفْظُ حَدِيثِ الْأَعْرَجِ وَفِي رِوَايَةِ الْمَرْوَزِيِّ إِنَّمَا سَمَلَ رَسُولُ اللهِ ﷺ أَعْيُنَهُمْ؛ لِأَنَّهُمْ سَمَلُوا أَعْيُنَ الرُّعَاةِ
[Machine] That the Prophet ﷺ likened them; because they were likened to the shepherd.
أَنَّ النَّبِيَّ ﷺ إِنَّمَا مَثَّلَ بِهِمْ؛ لِأَنَّهُمْ مَثَّلُوا بِالرَّاعِي
58.60 [Machine] Prevention of inflicting suffering on the disbeliever after capture by making them as a means or target
٥٨۔٦٠ بَابُ الْمَنْعِ مِنْ صَبْرِ الْكَافِرِ بَعْدَ الْإِسَارِ بِأَنْ يُتَّخَذَ غَرَضًا
[Machine] The Prophet ﷺ said, "Do not take something in which the soul is taken as an object."
النَّبِيَّ ﷺ قَالَ لَا تَتَّخِذُوا شَيْئًا فِيهِ الرُّوحُ غَرَضًا
[Machine] Who did this? Indeed, the Messenger of Allah ﷺ cursed whoever imitated the animal. Bukhari mentioned it in the book of testimonies, and likewise.
مَنْ فَعَلَ هَذَا؟ إِنَّ رَسُولَ اللهِ ﷺ قَدْ لَعَنَ مَنْ مَثَّلَ بِالْحَيَوَانِ ذَكَرَهُ الْبُخَارِيُّ فِي الشَّوَاهِدِ وَكَذَلِكَ
[Machine] The one who did this, God! Indeed, the Messenger of Allah ﷺ cursed whoever takes something in it as a purpose.
اللهُ مَنْ فَعَلَ هَذَا إِنَّ رَسُولَ اللهِ ﷺ لَعَنَ مَنِ اتَّخَذَ شَيْئًا فِيهِ الرُّوحُ غَرَضًا
[Machine] "The Messenger of Allah ﷺ forbade the slaughtering of animals in a way that causes them pain. Abu Ayyub said, 'If it were a chicken, I would not have slaughtered it in such a manner.'"
أَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنْ صَبْرِ الدَّابَّةِ قَالَ أَبُو أَيُّوبَ لَوْ كَانَتْ دَجَاجَةً مَا صَبَرْتُهَا
[Machine] "And Abu Ayyub had built a mosque, so we would go and sit in it and he would lead us in prayer, and we would enjoy his conversation. He said, 'By Allah, one evening while we were with him, a man came and said, "The Amir has now brought four prisoners of war from the Romans and he ordered them to be patient and they were tortured until they were killed." Abu Ayyub got up in a panic until Abdullah bin Khalid came and said, "Did you release them? I have heard the Messenger of Allah ﷺ forbidding the torture of animals and I dislike for myself to have done such and such and I have tortured a chicken." So Abdullah bin Khalid called for his four slaves and he set them free in their place. Abu Zur'a Ubaidullah bin Ya'la from the people of Palestine said, 'His home is Asqalan." Amr bin Al-Harith also narrated it from Bukayr."
وَكَانَ أَبُو أَيُّوبَ قَدِ اتَّخَذَ مَسْجِدًا فَكُنَّا نَرُوحُ وَنَجْلِسُ إِلَيْهِ وَيُصَلِّي لَنَا وَنَسْتَمْتِعُ مِنْ حَدِيثِهِ قَالَ فَوَاللهِ إِنَّا لَعَشِيَّةً مَعَهُ إِذْ جَاءَ رَجُلٌ فَقَالَ أَتَى الْآنَ الْأَمِيرُ بِأَرْبَعَةِ أَعْلَاجٍ مِنَ الرُّومِ فَأَمَرَ بِهِمْ أَنْ يُصْبَرُوا فَرُمُوا بِالنَّبْلِ حَتَّى قُتِلُوا فَقَامَ أَبُو أَيُّوبَ فَزِعًا حَتَّى جَاءَ عَبْدَ الرَّحْمَنِ بْنَ خَالِدٍ فَقَالَ أَصَبَرْتَهُمْ؟ لَقَدْ سَمِعْتُ رَسُولَ اللهِ ﷺ يَنْهَى عَنْ صَبْرِ الدَّابَّةِ وَمَا أُحِبُّ أَنَّ لِي كَذَا وَكَذَا وَأَنِّي صَبَرْتُ دَجَاجَةً قَالَ فَدَعَا عَبْدُ الرَّحْمَنِ بْنُ خَالِدٍ بِغِلْمَانٍ لَهُ أَرْبَعَةٍ فَأَعْتَقَهُمْ مَكَانَهَمْ قَالَ أَبُو زُرْعَةُ عُبَيْدُ بْنُ يَعْلَى مِنْ أَهْلِ فِلَسْطِينَ مَنْزِلُهُ عَسْقَلَانُ وَرَوَاهُ أَيْضًا عَمْرُو بْنُ الْحَارِثِ عَنْ بُكَيْرٍ
The Prophet ﷺ said: The most merciful of the people in respect of killing are believers (in Allah). (Using translation from Abū Dāʾūd 2666)
قَالَ رَسُولُ اللهِ ﷺ أَعَفُّ النَّاسِ قِتْلَةً أَهْلُ الْإِيمَانِ
58.61 [Machine] Preventing the Burning of Polytheists with Fire after Isha Prayer
٥٨۔٦١ بَابُ الْمَنْعِ مِنْ إِحْرَاقِ الْمُشْرِكِينَ بِالنَّارِ بَعْدَ الْإِسَارِ
[Machine] "If I were they, I would not have burned them, because of the saying of the Messenger of Allah ﷺ : 'Do not punish people with the punishment of Allah.' And I would have killed them, because of the saying of the Messenger of Allah ﷺ : 'Whoever changes his religion, then kill him.' Ammar said: 'He did not burn them, but he dug trenches for them and connected them to each other, then he kindled fires over them until they died.' Amr said: 'The poet said: 'Throw at me wherever you want, if you don't throw at me in the two trenches when they kindle the fire there, then death is certain, except for the religion.'"

لَوْ كُنْتُ أَنَا مَا حَرَقْتُهُمْ؛ لِقَوْلِ رَسُولِ اللهِ ﷺ لَا تُعَذِّبُوا بِعَذَابِ اللهِ وَلَقَتَلْتُهُمْ لِقَوْلِ رَسُولِ اللهِ ﷺ مَنْ بَدَّلَ دِينَهُ فَاقْتُلُوهُ فَقَالَ عَمَّارٌ لَمْ يَحْرِقْهُمْ وَلَكِنْ حَفَرَ لَهُمْ حَفَائِرَ وَخَرَقَ بَعْضَهَا إِلَى بَعْضٍ ثُمَّ دَخَّنَ عَلَيْهِمْ حَتَّى مَاتُوا فَقَالَ عَمْرٌو قَالَ الشَّاعِرُ [البحر الوافر] لِتَرْمِ بِيَ الْمَنَايَا حَيْثُ شَاءَتْ إِذَا لَمْ تَرْمِ بِي فِي الْحُفْرَتَيْنِ إِذَا مَا أَجَّجُوا حَطَبًا وَنَارًا هُنَاكَ الْمَوْتُ نَقْدًا غَيْرَ دَيْنِ
[Machine] Bukayr informed me that Abu Amr Al-Adibi reported to me from Abu Bakr Al-Isma'iliy who informed me that Al-Hasan ibn Sufyan narrated that Qutaybah ibn Saeed narrated from Al-Laith who narrated from Bukayr who narrated from Sulaiman ibn Yassar who narrated from Abu Hurayrah that he said: The Messenger of Allah ﷺ sent us on a mission and said, "If you find so-and-so and so-and-so, two men from Quraysh, then burn them with fire." Then the Messenger of Allah ﷺ said, when we were about to depart, "I had commanded you to burn so-and-so and so-and-so with fire, and verily, only Allah punishes with the Fire. So, if you find them, then kill them, for their word is the same."
حَدَّثَنِي بُكَيْرٌ ح وَأنبأ أَبُو عَمْرٍو الْأَدِيبُ أنبأ أَبُو بَكْرٍ الْإِسْمَاعِيلِيُّ أَخْبَرَنِي الْحَسَنُ بْنُ سُفْيَانَ ثنا قُتَيْبَةُ بْنُ سَعِيدٍ ثنا اللَّيْثُ عَنْ بُكَيْرٍ عَنْ سُلَيْمَانَ بْنِ يَسَارٍ عَنْ أَبِي هُرَيْرَةَ ؓ أَنَّهُ قَالَ بَعَثَنَا رَسُولُ اللهِ ﷺ فِي بَعْثٍ وَقَالَ إِنْ وَجَدْتُمْ فُلَانًا وَفُلَانًا لِرَجُلَيْنِ مِنْ قُرَيْشٍ فَاحْرِقُوهُمَا بِالنَّارِ ثُمَّ قَالَ رَسُولُ اللهِ ﷺ حِينَ أَرَدْنَا الْخُرُوجَ إِنِّي كُنْتُ أَمَرْتُكُمْ أَنْ تَحْرِقُوا فُلَانًا وَفُلَانًا بِالنَّارِ وَإِنَّ النَّارَ لَا يُعَذِّبُ بِهَا إِلَّا اللهُ فَإِنْ وَجَدْتُمُوهُمَا فَاقْتُلُوهُمَا لَفْظُهُمَا سَوَاءٌ
