10. Zakāh (Prescribed Charity) (3/13)
١٠۔ كِتَابُ الزَّكَاةِ ص ٣
[Machine] God Almighty said, "And they were not commanded except to worship Allah, [being] sincere to Him in religion, inclining to truth, and to establish prayer and to give zakah. And that is the correct religion." [Al-Bayyinah: 5]
قَالَ اللهُ ﷻ {وَمَا أُمِرُوا إِلَّا لِيَعْبُدُوا اللهَ مُخْلِصِينَ لَهُ الدِّينَ حُنَفَاءَ وَيُقِيمُوا الصَّلَاةَ وَيُؤْتُوا الزَّكَاةَ وَذَلِكَ دِينُ الْقَيِّمَةِ} [البينة: 5]
[Machine] The Prophet ﷺ said, "Less than five handfuls of dates, leaves, or locusts is not considered as charity."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَيْسَ فِيمَا دُونَ خَمْسِ أَوَاقٍ مِنَ الْوَرِقِ صَدَقَةٌ وَلَيْسَ فِيمَا دُونَ خَمْسِ أَوْسُقٍ مِنَ التَّمْرِ صَدَقَةٌ وَلَيْسَ فِيمَا دُونَ خَمْسِ ذَوْدٍ مِنَ الْإِبِلِ صَدَقَةٌ
[Machine] Allah ﷺ said, "Seek from the wealth of the orphan, or from the wealth of the orphans, do not let charity dissipate it or consume it." This is a statement and has been affirmed by Al-Shafi'i, may Allah have mercy on him, based on the evidence of the first report and what has been narrated from the Companions in that regard. It has also been narrated from 'Amr ibn Shu'ayb from his father from his grandfather in a raised report.
اللهِ ﷺ قَالَ ابْتَغُوا فِي مَالِ الْيَتِيمِ أَوْ فِي أَمْوَالِ الْيَتَامَى لَا تُذْهِبُهَا أَوْ لَا تَسْتَهْلِكُهَا الصَّدَقَةُ وَهَذَا مُرْسَلٌ إِلَّا أَنَّ الشَّافِعِيَّ رَحِمَهُ اللهُ أكَّدَهُ بِالِاسْتِدْلَالِ بِالْخَبَرِ الْأَوَّلِ وَبِمَا رُوِيَ عَنِ الصَّحَابَةِ ؓ فِي ذَلِكَ وَقَدْ رُوِيَ عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ مَرْفُوعًا
[Machine] Narrated by Mandul ibn Ali, from Abu Ishaq ash-Shaibani, from 'Amr, in a similar meaning with the addition of Mandul, other than two narrators that are weak.

أَنَّ رَسُولَ اللهِ ﷺ قَالَ أَلَا مَنْ وَلِيَ يَتِيمًا لَهُ مَالٌ فَلْيَتَّجِرْ لَهُ فِيهِ وَلَا يَتْرُكْهُ تَأْكُلُهُ الزَّكَاةُ وَرُوِيَ عَنْ مِنْدَلِ بْنِ عَلِيٍّ عَنْ أَبِي إِسْحَاقَ الشَّيْبَانِيِّ عَنْ عَمْرٍو بِمَعْنَاهُ وَالْمُثَنَّى وَمَنْدَلٌ غَيْرُ قَوِيَّيْنِ
[Machine] Seek in the wealth of orphans that which charity cannot consume. This is a sound narration and it has evidence from Umar.
ابْتَغُوا فِي أَمْوَالِ الْيَتَامَى لَا تَأْكُلُهَا الصَّدَقَةُ هَذَا إِسْنَادٌ صَحِيحٌ وَلَهُ شَوَاهِدُ عَنْ عُمَرَ ؓ
[Machine] He said to him: "How did you trade your land? For I have some orphan's wealth that Zakat almost ruined." He said to him: "So he gave it to him in this narration," and Muawiyah ibn Qurrah narrated it from al-Hakam ibn Abi al-As, from Umar, and both of them are reliable. And Ash-Shafi'i narrated it from the hadith of Amr ibn Dinar and Ibn Sirin, from Umar, as a Mursal narration.
لَهُ عُمَرُ ؓ كَيْفَ مَتْجَرُ أَرْضِكَ فَإِنَّ عِنْدِي مَالَ يَتِيمٍ قَدْ كَادَتِ الزَّكَاةُ أَنْ تُفْنِيَهُ قَالَ فَدَفَعَهُ إِلَيْهِ كَذَا فِي هَذِهِ الرِّوَايَةِ وَرَوَاهُ مُعَاوِيَةُ بْنُ قُرَّةَ عَنِ الْحَكَمِ بْنِ أَبِي الْعَاصِ عَنْ عُمَرَ وَكِلَاهُمَا مَحْفُوظٌ وَرَوَاهُ الشَّافِعِيُّ مِنْ حَدِيثِ عَمْرِو بْنِ دِينَارٍ وَابْنِ سِيرِينَ عَنْ عُمَرَ مُرْسَلًا
[Machine] Ali used to purify our wealth while we were orphans.
كَانَ عَلِيٌّ ؓ يُزَكِّي أَمْوَالَنَا وَنَحْنُ يَتَامَى
[Machine] That the Messenger of Allah ﷺ granted Abu Rafi' a piece of land. When Abu Rafi' died, Umar sold it for eighty thousand. He then gave it to Ali ibn Abi Talib, who used to purify it. When the son of Abu Rafi' inherited it, they assessed their wealth and found it to be incomplete. So they went to Ali and informed him. He said, "Did you think it was his zakat?" They replied, "No." He said, "Then they should have counted its zakat." They found it to be equal (after recalculating). Ali said, "Did you think that I would have wealth that I would not pay its zakat?"
أَنَّ رَسُولَ اللهِ ﷺ كَانَ أَقْطَعَ أَبَا رَافِعٍ أَرْضًا فَلَمَّا مَاتَ أَبُو رَافِعٍ بَاعَهَا عُمَرُ ؓ بِثَمَانِينَ أَلْفًا فَدَفَعَهَا إِلَى عَلِيِّ بْنِ أَبِي طَالِبٍ ؓ فَكَانَ يُزَكِّيهَا فَلَمَّا قَبَضَهَا وَلَدُ أَبِي رَافِعٍ عَدُّوا مَالَهَمْ فَوَجَدُوهَا نَاقِصَةً فَأَتَوْا عَلِيًّا ؓ فَأَخْبَرُوهُ فَقَالَ أَحَسَبْتُمْ زَكَاتَهَا؟ قَالُوا لَا قَالَ فَحَسَبُوا زَكَاتَهَا فَوَجَدُوهَا سَوَاءً فَقَالَ عَلِيٌّ ؓ أَكُنْتُمْ تَرَوْنَ يَكُونُ عِنْدِي مَالٌ لَا أُؤَدِّي زَكَاتَهُ
[Machine] That Ali purified the wealth of the sons of Abi Rafi. He said, "When he handed it over to them, they found it deficient. They said, 'We found it deficient.' Ali said, 'Do you think that I have any wealth that I do not purify?'"
أَنَّ عَلِيًّا ؓ زَكَّى أَمْوَالَ بَنِي أَبِي رَافِعٍ قَالَ فَلَمَّا دَفَعَهَا إِلَيْهِمْ وَجَدُوهَا بِنَقْصٍ فَقَالُوا إِنَّا وَجَدْنَاهَا بِنَقْصٍ فَقَالَ عَلِيٌّ ؓ أَتَرَوْنَ أَنَّهُ يَكُونُ عِنْدِي مَالٌ لَا أُزَكِّيهِ
[Machine] Aisha used to regularly give charity from our wealth, and she would give support to an orphan who lived in her house.
عَائِشَةُ ؓ تَلِينِي وَأَخًا لِي يَتِيمٌ فِي حِجْرِهَا وَكَانَتْ تُخْرِجُ مِنَ أَمْوَالِنَا الزَّكَاةَ

[Machine] Whoever takes charge of the wealth of an orphan should carefully examine it for several years. 10.28 [Machine] Whoever Says There Is No Zakat in the Slave's Wealth
١٠۔٢٨ بَابُ مَنْ قَالَ لَيْسَ فِي مَالِ الْعَبْدِ زَكَاةٌ
عَنْ جَابِرِ بْنِ عَبْدِ اللهِ ؓ
10.29 [Machine] Who said that the zakat of his wealth belongs to its owner and that a slave does not possess it?
١٠۔٢٩ بَابُ مَنْ قَالَ زَكَاةُ مَالِهِ عَلَى مَالِكِهِ وَأَنَّ الْعَبْدَ لَا يَمْلِكُ
[Machine] I heard the Messenger of Allah ﷺ say: "Whoever buys a slave, his possession belongs to the one who sold him, except if the buyer specifies conditions."
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَنِ ابْتَاعَ عَبْدًا فَمَالُهُ لِلَّذِي بَاعَهُ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ
[Machine] In the wealth of every Muslim, there is a charity (Zakat) of two and a half percent. And whatever is in excess is to be taken into account.
فِي مَالِ كُلِّ مُسْلِمٍ زَكَاةٌ فِي مِائَتَيْنِ خَمْسَةٌ فَمَا زَادَ فَبِالْحِسَابِ
10.30 [Machine] There is no zakat in the wealth of offices. This was narrated by Nafi' from Ibn 'Umar and from Abu Zubair from Jabir.
١٠۔٣٠ بَابُ لَيْسَ فِي مَالِ الْمُكَاتَبِ زَكَاةٌ رُوِيَ ذَلِكَ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ وَعَنْ أَبِي الزُّبَيْرِ عَنْ جَابِرٍ.
[Machine] Zakat is not in the wealth of the slave nor the properties.
لَيْسَ فِي مَالِ الْعَبْدِ وَلَا الْمُكَاتَبِ زَكَاةٌ
[Machine] There is no obligation to pay zakat from the wealth of employees or slaves until they are set free. This was narrated in the context of employees from Abdullah ibn Bazīʿ, from Ibn Jurayj, as a raised narration, but he is weak. The authentic narration is attributed to Masruq, Sa'id ibn al-Musayyib, Sa'id ibn Jubayr, 'Ata', and Mak'hool.
لَيْسَ فِي مَالِ الْمُكَاتَبِ وَلَا الْعَبْدِ زَكَاةٌ حَتَّى يُعْتَقَ وَرُوِيَ ذَلِكَ فِي الْمُكَاتَبِ عَنْ عَبْدِ اللهِ بْنِ بَزِيعٍ عَنِ ابْنِ جُرَيْجٍ مَرْفُوعًا وَهُوَ ضَعِيفٌ وَالصَّحِيحُ مَوْقُوفٌ وَهُوَ قَوْلُ مَسْرُوقٍ وَسَعِيدِ بْنِ الْمُسَيِّبِ وَسَعِيدِ بْنِ جُبَيْرٍ وَعَطَاءٍ وَمَكْحُولٍ
10.31 [Machine] The time when charity is obligatory has passed, and the statement of Asim bin Damrah and Harith from Ali from the Prophet ﷺ "There is no Zakat on wealth until a year passes over it" and the statement of Abdullah bin Muawiya al-Ghadiri from the Prophet ﷺ "There are three things, whoever does them has tasted the flavor of faith: mentioning Allah abundantly, giving his wealth in a good way that satisfies his soul, and being constant in doing good every year
١٠۔٣١ بَابُ الْوَقْتِ الَّذِي تَجِبُ فِيهِ الصَّدَقَةُ قَدْ مَضَى حَدِيثُ عَاصِمِ بْنِ ضَمْرَةَ , وَالْحَارِثِ عَنْ عَلِيٍّ عَنِ النَّبِيِّ ﷺ " لَيْسَ فِي مَالٍ زَكَاةٌ حَتَّى يَحُولَ عَلَيْهِ الْحَوْلُ " وَحَدِيثُ عَبْدِ اللهِ بْنِ مُعَاوِيَةَ الْغَاضِرِيِّ عَنِ النَّبِيِّ ﷺ " ثَلَاثٌ مَنْ فَعَلَهُنَّ فَقَدْ طَعِمَ طَعْمَ الْإِيمَانِ فَذَكَرَ مِنْهُنَّ وَأَعْطَى زَكَاةَ مَالِهِ طَيِّبَةً بِهَا نَفْسُهُ رَافِدَةً عَلَيْهِ فِي كُلِّ عَامٍ ".
Jabir bin ʿAbdullah said, "When the Prophet ﷺ died, Abu Bakr received some property from Al-ʿAla bin Al-Hadrami. Abu Bakr said to the people, "Whoever has a money claim on the Prophet, or was promised something by him, should come to us (so that we may pay him his right)." Jabir added, "I said (to Abu Bakr), Messenger of Allah ﷺ promised me that he would give me this much, and this much, and this much (spreading his hands three times)." Jabir added, "Abu Bakr counted for me and handed me five-hundred (gold pieces), and then five-hundred, and then five-hundred." (Using translation from Bukhārī 2683)
لَمَّا مَاتَ النَّبِيُّ ﷺ جَاءَ أَبَا بَكْرٍ ؓ مَالٌ مِنْ قِبَلِ ابْنِ الْحَضْرَمِيِّ فَقَالَ أَبُو بَكْرٍ مَنْ كَانَ لَهُ عَلَى النَّبِيِّ ﷺ دَيْنٌ أَوْ كَانَتْ لَهُ قَبْلَهُ عِدَةٌ فَلْيَأْتِنَا قَالَ جَابِرٌ فَقُلْتُ وَعَدَنِي رَسُولُ اللهِ ﷺ يُعْطِينِي هَكَذَا وَهَكَذَا فَبَسَطَ يَدَيْهِ ثَلَاثَ مَرَّاتٍ أَظُنُّهُ قَالَ خُذْ فَحَثَوْتُ فَإِذَا هِيَ خَمْسُمِائَةٍ قَالَ جَابِرٌ فَعَدَّ فِي يَدِيَّ خَمْسَمِائَةٍ ثُمَّ خَمْسَمِائَةٍ قَالَ وَزَادَ عَلَيْهِ غَيْرُهُ فِي الْحَدِيثِ أَنَّهُ قَالَ لِجَابِرٍ لَيْسَ عَلَيْكَ فِيهِ صَدَقَةٌ حَتَّى يَحُولَ عَلَيْهِ الْحَوْلُ
[Machine] Does he have to pay Zakat on the enormous amount of money he received from his offices? Al-Qasim bin Muhammad said, "Abu Bakr As-Siddiq did not take Zakat from his wealth until a full year had passed." Al-Qasim continued, "When Abu Bakr gave people their due, he would ask them, 'Do you have any money on which Zakat is obligatory?' If the person replied yes, he would take the Zakat from their wealth. And if the person replied no, he would return their due without taking anything from them."
عَنْ مُكَاتَبٍ لَهُ قَاطَعَهُ بِمَالٍ عَظِيمٍ هَلْ عَلَيْهِ فِيهِ زَكَاةٌ؟ فَقَالَ الْقَاسِمُ بْنُ مُحَمَّدٍ إِنَّ أَبَا بَكْرٍ الصِّدِّيقَ ؓ لَمْ يَكُنْ يَأْخُذُ مِنْ مَالٍ زَكَاةً حَتَّى يَحُولَ عَلَيْهِ الْحَوْلُ قَالَ الْقَاسِمُ وَكَانَ أَبُو بَكْرٍ إِذَا أَعْطَى النَّاسَ أُعْطِيَاتِهِمْ سَأَلَ الرَّجُلَ هَلْ عِنْدَكَ مِنْ مَالٍ وَجَبَتْ عَلَيْكَ فِيهِ الزَّكَاةُ؟ فَإِنْ قَالَ نَعَمْ أَخَذَ مِنْ عَطَائِهِ زَكَاةَ مَالِهِ ذَلِكَ وَإِنْ قَالَ لَا سَلَّمَ إِلَيْهِ عَطَاءَهُ وَلَمْ يَأْخُذْ مِنْهُ شَيْئًا
[Machine] He said, "Even if I don't greet him, my gifts will still be accepted and he won't take anything from it."
أَنَّهُ قَالَ وَإِنْ قُلْتُ لَا سَلَّمَ إِلَيَّ عَطَائِي وَلَمْ يَأْخُذْ مِنْهُ شَيْئًا
No zakah is due on wealth until one year has passed. (Using translation from Aḥmad 1265)
لَا تَجِبُ فِي مَالٍ زَكَاةٌ حَتَّى يَحُولَ عَلَيْهِ الْحَوْلُ
[Machine] Al-Shafi'i and Al-Ata' are beneficial, there is no zakat in it until it comes to him.
الشَّافِعِيُّ وَالْعَطَاءُ فَائِدَةٌ وَلَا زَكَاةَ فِيهِ حَتَّى يَحُولَ عَلَيْهِ الْحَوْلُ
10.32 [Machine] What is the duty of the imam in sending messengers for charity
١٠۔٣٢ بَابُ مَا عَلَى الْإِمَامِ مِنْ بَعْثِ السُّعَاةِ عَلَى الصَّدَقَةِ
[Machine] The Messenger of Allah ﷺ sent Umar for charity and mentioned the narration he mentioned in the authentic (source) and it has been confirmed from Abu Humayd Al-Sa'idi who said: The Messenger of Allah ﷺ employed a man for the charity of Bani Sulaim named Ibn Al-Lutbiyyah, so when he returned, he questioned him and he had many news (to share).
بَعَثَ رَسُولُ اللهِ ﷺ عُمَرَ عَلَى الصَّدَقَةِ وَذَكَرَ الْحَدِيثَ أَخْرَجَاهُ فِي الصَّحِيحِ وَثَبَتَ عَنْ أَبِي حُمَيْدٍ السَّاعِدِيِّ قَالَ اسْتَعْمَلَ رَسُولُ اللهِ ﷺ رَجُلًا عَلَى صَدَقَاتِ بَنِي سُلَيْمٍ يُدْعَى ابْنَ اللُّتْبِيَّةِ فَلَمَّا جَاءَ حَاسَبَهُ وَفِيهِ أَخْبَارٌ كَثِيرَةٌ
[Machine] Bakr and Umar used to not take charity twice, but they would send it in the form of dates, grain, and fat in the drought, fertility, and lean years. This is because taking it from the Messenger of Allah ﷺ every year is a sunnah, as narrated in the past from Ibrahim. They increased in it, and they did not include its rightful owners nor did they delay taking it every year.
بَكْرٍ وَعُمَرَ ؓ لَمْ يَكُونَا يَأْخُذَانِ الصَّدَقَةَ مُثَنَّاةً وَلَكِنْ يَبْعَثَانِ عَلَيْهَا فِي الْجَدْبِ وَالْخَصْبِ وَالسِّمَنِ وَالْعَجْبِ؛ لِأَنَّ أَخْذَهَا فِي كُلِّ عَامٍ مِنْ رَسُولِ اللهِ ﷺ سُنَّةٌ وَرَوَاهُ فِي الْقَدِيمِ عَنْ إِبْرَاهِيمَ وَزَادَ فِيهِ وَلَا يُضَمِّنُونَهَا أَهْلَهَا وَلَا يُؤَخِّرُونَ أَخْذَهَا عَنْ كُلِّ عَامٍ
10.33 [Machine] Where is the charity of walking taken?
١٠۔٣٣ بَابُ أَيْنَ تُؤْخَذُ صَدَقَةُ الْمَاشِيَةِ
[Machine] The Messenger of Allah ﷺ addressed the people during the year of conquest and mentioned the saying in it: "Neither jallabah (a type of garment), nor janaabah (state of impurity after sexual intercourse), and their charity is not taken except in their own homes."
خَطَبَ رَسُولُ اللهِ ﷺ النَّاسَ عَامَ الْفَتْحِ فَذَكَرَ الْحَدِيثَ وَفِيهِ قَالَ لَا جَلَبَ وَلَا جَنَبَ وَلَا تُؤْخَذُ صَدَقَاتُهُمْ إِلَّا فِي دُورِهِمْ
Explaining the meaning of Jalab and janab Muhammad bin Ishaq said The meaning of jalab said is that the zakat of animals should be collected at their places (dwellings), and they (animals) should not be pulled to the collector of zakat. The meaning of janab is that the animals are removed at a distance (from the collector). The owners of the animals should do so. The collector of zakat should not stay at a distance from the places of the people who bring their animals to him. The zakat should be collected in its place. (Using translation from Abū Dāʾūd 1592)
فِي قَوْلِهِ لَا جَلَبَ وَلَا جَنَبَ قَالَ أَنْ تُصْدَقَ الْمَاشِيَةُ فِي مَوَاضِعِهَا وَلَا تُجْلَبُ إِلَى الْمُصَدِّقِ وَالْجَنَبُ عَنْ هَذِهِ الطَّرِيقَةِ أَيْضًا لَا تَجَنُّبُ أَصْحَابِهَا يَقُولُ وَلَا يَكُونُ الرَّجُلُ بِأَقْصَى مَوَاضِعِ أَصْحَابِ الصَّدَقَةِ فَتُجْنَبُ إِلَيْهِ وَلَكِنْ تُؤْخَذُ فِي مَوْضِعِهِ
[Machine] That the Messenger of Allah ﷺ said: "The charities of the Muslims are taken from their water sources or from their wealth, as recorded by Abu Dawood."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ تُؤْخَذُ صَدَقَاتُ الْمُسْلِمِينَ عِنْدَ مِيَاهِهِمْ أَوْ عِنْدَ أَفْنِيَتِهِمْ شَكَّ أَبُو دَاوُدَ
[Machine] The Messenger of Allah ﷺ said: "The zakat (charitable donations) of the inhabitants of the desert is collected from their water sources and their grazing lands." This is the wording of the hadith of Abdullah bin Salih. And in the narration of Abdullah bin Aziz, it is mentioned: "The zakat of the Muslims is collected from their wealth, their water sources, and their grazing lands." And he (the Messenger of Allah) said about Abdullah bin Abu Bakr bin Muhammad bin Umar bin Hazm: [No translation given for this part of the passage].
قَالَ رَسُولُ اللهِ ﷺ تُؤْخَذُ صَدَقَاتُ أَهْلِ الْبَادِيَةِ عَلَى مِيَاهِهِمْ بِأَفْنِيَتِهِمْ لَفْظُ حَدِيثِ عَبْدِ اللهِ بْنِ صَالِحٍ وَفِي رِوَايَةِ عَبْدِ الْعَزِيزِ تُؤْخَذُ صَدَقَاتُ الْمُسْلِمِينَ مِنْ أَمْوَالِهِمْ عَلَى مِيَاهِهِمْ وَأَفْنِيَتِهِمْ وَقَالَ عَنْ عَبْدِ اللهِ بْنِ أَبِي بَكْرِ بْنِ مُحَمَّدِ بْنِ عُمَرَ بْنِ حَزْمٍ
10.34 [Machine] Borrowing from the people who give charity and then repaying it from their own shares.
١٠۔٣٤ بَابُ الِاسْتِسْلَافِ عَلَى أَهْلِ الصَّدَقَةِ ثُمَّ قَضَائِهِ مِنْ سُهَمَائِهِمْ
[Machine] The Messenger of Allah ﷺ requested a loan from a man, and then some camels from the camels of charity came to him. He commanded me to give them to him.
أَنَّ رَسُولَ اللهِ ﷺ اسْتَسْلَفَ مِنْ رَجُلٍ بِكْرًا فَجَاءَتْهُ إِبِلٌ مِنَ إِبِلِ الصَّدَقَةِ فَأَمَرَنِي أَنْ أَقْضِيَهُ إِيَّاهُ

١٠۔٣٥ بَابُ تَعْجِيلِ الصَّدَقَةِ اعْتَمَدَ الشَّافِعِيُّ رَحِمَهُ اللهُ فِيهِ عَلَى مَا ثَبَتَ عَنِ النَّبِيِّ ﷺ فِي الْيَمِينِ فَلْيُكَفِّرْ عَنْ يَمِينِهِ وَلْيَأْتِ الَّذِي هُوَ خَيْرٌ , ثُمَّ عَلَى مَا ثَبَتَ عَنْ بَعْضِ أَصْحَابِ النَّبِيِّ ﷺ فِي ذَلِكَ مِنْهُمْ عَبْدُ اللهِ بْنُ عُمَرَ بْنِ الْخَطَّابِ رُبَّمَا كَفَّرَ عَنْ يَمِينِهِ قَبْلَ أَنْ يَحْنَثَ وَرُبَّمَا كَفَّرَ بَعْدَ مَا يَحْنَثُ وَمَوْضِعُهُ كِتَابُ الْأَيْمَانِ. أَخْبَرَنَا أَبُو سَعِيدٍ , ثنا أَبُو الْعَبَّاسِ , أَنْبَأَ الرَّبِيعُ قَالَ: قَالَ الشَّافِعِيُّ: وَيُرْوَى عَنِ النَّبِيِّ ﷺ وَلَا أَدْرِي أَيَثْبُتُ أَمْ لَا أَنَّ النَّبِيَّ ﷺ تَسَلَّفَ صَدَقَةَ مَالِ الْعَبَّاسِ قَبْلَ أَنْ تَحِلَّ، يَعْنِي بِهِ مَا
[Machine] The Messenger of Allah ﷺ asked about hastening his charity before it is due, so he allowed him to do so. 7366 Abu Ali al-Rudhbari informed us that Muhammad ibn Bakr narrated to us, Abu Dawood narrated to us, Sa'id ibn Mansur mentioned it, and Abu Dawood said: This is the narration.
ؓ سَأَلَ رَسُولَ اللهِ ﷺ فِي تَعْجِيلِ صَدَقَتِهِ قَبْلَ أَنْ تَحِلَّ فَأَذِنَ لَهُ فِي ذَلِكَ 7366 أَخْبَرَنَا أَبُو عَلِيٍّ الرُّذْبَارِيُّ أنبأ مُحَمَّدُ بْنُ بَكْرٍ ثنا أَبُو دَاوُدَ ثنا سَعِيدُ بْنُ مَنْصُورٍ فَذَكَرَهُ قَالَ أَبُو دَاوُدَ هَذَا الْحَدِيثُ
عَنْ عَلِيٍّ ؓ فَذَكَرَ قِصَّةً فِي بَعْثِ رَسُولِ اللهِ ﷺ عُمَرَ ؓ سَاعِيًا وَمَنْعِ الْعَبَّاسِ صَدَقَتَهُ وَأَنَّهُ ذَكَرَ لِلنَّبِيِّ ﷺ مَا صَنَعَ الْعَبَّاسُ فَقَالَ أَمَا عَلِمْتَ يَا عُمَرُ أَنَّ عَمَّ الرَّجُلِ صِنْوُ أَبِيهِ إِنَّا كُنَّا احْتَجْنَا فَاسْتَسْلَفْنَا الْعَبَّاسَ صَدَقَةَ عَامَيْنِ لَفْظُ حَدِيثِ الْقَطَّانِ وَفِي رِوَايَةِ ابْنِ قَتَادَةَ أَنَّ النَّبِيَّ ﷺ تَعَجَّلَ مِنَ الْعَبَّاسِ صَدَقَةَ عَامٍ أَوْ صَدَقَةَ عَامَيْنِ وَفِي هَذَا إِرْسَالٌ بَيْنَ أَبِي الْبَخْتَرِيِّ وَعَلِيٍّ ؓ وَقَدْ وَرَدَ هَذَا الْمَعْنَى فِي حَدِيثِ أَبِي هُرَيْرَةَ مِنْ وَجْهٍ ثَابِتٍ عَنْهُ
[Machine] The Messenger of Allah, ﷺ , sent 'Umar, may Allah be pleased with him, for charity. It was said that Ibn Jamil, Khalid Ibn Al-Walid, and Al-Abbas, the uncle of the Messenger of Allah, ﷺ , prevented 'Umar, may Allah be pleased with him. The Messenger of Allah, ﷺ , said, "Ibn Jamil does not seek revenge except for being poor and Allah has enriched him. As for Khalid, you have oppressed him. I have appointed him as a leader and honored him in the cause of Allah. As for Al-Abbas, it is for me and the same is for her," and then he said, "O 'Umar, do you not know that the uncle of a man is like his father?"
بَعَثَ رَسُولُ اللهِ ﷺ عُمَرَ ؓ عَلَى الصَّدَقَةِ فَقِيلَ مَنَعَ ابْنُ جَمِيلٍ وَخَالِدُ بْنُ الْوَلِيدِ وَالْعَبَّاسُ عَمُّ رَسُولِ اللهِ ﷺ فَقَالَ رَسُولُ اللهِ ﷺ مَا يَنْقِمُ ابْنُ جَمِيلٍ إِلَّا أَنَّهُ كَانَ فَقِيرًا فَأَغْنَاهُ اللهُ وَأَمَّا خَالِدٌ فَإِنَّكُمْ تَظْلِمُونَ خَالِدًا قَدِ احْتَبَسَ أَعْتُدَهُ وَأَدْرُعَهُ فِي سَبِيلِ اللهِ وَأَمَّا الْعَبَّاسُ فَهِيَ عَلَيَّ وَمِثْلُهَا مَعَهَا ثُمَّ قَالَ يَا عُمَرُ أَمَا عَلِمْتَ أَنَّ عَمَّ الرَّجُلِ صِنْوُ أَبِيهِ
أَنَّ عَبْدَ اللهِ بْنَ عُمَرَ كَانَ يَبْعَثُ بِزَكَاةِ الْفِطْرِ إِلَى الَّذِي تُجْمَعُ عِنْدَهُ قَبْلَ الْفِطْرِ بِيَوْمَيْنِ أَوْ ثَلَاثَةٍ
10.36 [Machine] The intention in giving charity.
١٠۔٣٦ بَابُ النِّيَّةِ فِي إِخْرَاجِ الصَّدَقَةِ
I heard the Messenger of Allah ﷺ say: “Action is but by intention and each person will have but that which he intended. So whoever migrated for the sake of Allah and His Messenger, then his migration was for the sake of Allah and His Messenger, whoever migrated for some worldly purpose or for the sake of a woman whom he could marry, his migration was for the purpose for which he migrated.” (Using translation from Aḥmad 300)
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ إِنَّمَا الْأَعْمَالُ بِالنِّيَّةِ وَإِنَّمَا لِامْرِئٍ مَا نَوَى فَمَنْ كَانَتْ هِجْرَتُهُ إِلَى اللهِ وَإِلَى رَسُولِهِ فَهِجْرَتُهُ إِلَى اللهِ وَرَسُولِهِ وَمَنْ كَانَتْ هِجْرَتُهُ إِلَى دُنْيَا يُصِيبُهَا أَوْ إِلَى امْرَأَةٍ يَتَزَوَّجُهَا فَهِجْرَتُهُ إِلَى مَا هَاجَرَ إِلَيْهِ
10.37 [Machine] He does not fulfill his obligation regarding his wealth except what is mandatory for him, based on what has been mentioned in the narrations about Zakat and its specific requirements, and it includes both general and specific cases, with some being replaced by specific alternatives and their calculation being determined according to certain standards, all while taking into account the variation of values with changing times and different locations.
١٠۔٣٧ بَابُ لَا يُؤَدِّي عَنْ مَالِهِ فِيمَا وَجَبَ عَلَيْهِ إِلَّا مَا وَجَبَ عَلَيْهِ اسْتِدْلَالًا بِمَا مَضَى فِي أَحَادِيثِ الصَّدَقَاتِ وَتَنْصِيصِهِ عَلَى الْوَاجِبِ فِي كُلِّ جِنْسٍ وَنَقْلِهِ فِي بَعْضِهِ إِلَى بَدَلٍ مُعَيَّنٍ وَتَقْدِيرِهِ الْجُبْرَانَ فِي بَعْضِهِ بِمِقْدَرٍ مَعَ اخْتِلَافِ الْقِيَمِ بِاخْتِلَافِ الزَّمَانِ وَافْتِرَاقِ الْمَكَانِ.
When the Messenger of Allah ﷺ sent him to the Yemen, he said (to him): Collect corn from the corn, sheep from the sheep, camel from the camels, and cow from the cows. Abu Dawud said: In Egypt I saw a cucumber thirteen spans in length and a citron cut into two pieces loaded on a camel like two loads. (Using translation from Abū Dāʾūd 1599)
أَنَّ رَسُولَ اللهِ ﷺ بَعَثَهُ إِلَى الْيَمَنِ فَقَالَ خُذِ الْحَبَّ مِنَ الْحَبِّ وَالشَّاةَ مِنَ الْغَنَمِ وَالْبَعِيرَ مِنَ الْإِبِلِ وَالْبَقَرَةَ مِنَ الْبَقَرِ
10.38 [Machine] Who authorized taking the value in zakat?
١٠۔٣٨ بَابُ مَنْ أَجَازَ أَخْذَ الْقِيَمِ فِي الزَّكَوَاتِ.
إِبْرَاهِيمُ بْنُ مَيْسَرَةَ
[Machine] Mu'adh said, "Bring me a stack of clothes that I will take from you in place of barley and wheat." Abu Sa'id narrated to us that Abu Al-Abbas narrated to us that Al-Hasan ibn Ali narrated to us that Yahya ibn Adam ibn Sulayman narrated to us that Sufyan ibn Uyaynah narrated from Amr ibn Dinar, who mentioned it. Abu Bakr Al-Isma'ili explained to us what Abu Amr Al-Adib narrated from him as a statement from Tawus, quoting Mu'adh: "If it is designated, then there is no proof in it." And he also said regarding it that some of them considered it as a substitute for zakat. The scholar said, "This is the most appropriate opinion according to Mu'adh and is similar to what the Prophet ﷺ commanded concerning taking from the same kind as charity and taking dinars, or providing them with sets of clothes from Yemen as jizyah, and allocating the charity to their poor, rather than transferring it to the emigrants in Madinah, most of whom were from the Ansar, not from the Ahl Sadaqah. And Allah knows best."
قَالَ مُعَاذٌ بِالْيَمَنِ ائْتُونِي بِعَرَضِ ثِيَابٍ آخُذُهُ مِنْكُمْ مَكَانَ الذُّرَةِ وَالشَّعِيرِ أَخْبَرَنَاهُ أَبُو سَعِيدٍ ثنا أَبُو الْعَبَّاسِ ثنا الْحَسَنُ بْنُ عَلِيٍّ ثنا يَحْيَى بْنُ آدَمَ بْنِ سُلَيْمَانَ ثنا سُفْيَانُ بْنُ عُيَيْنَةَ عَنْ عَمْرِو بْنِ دِينَارٍ فَذَكَرَهُ قَالَ أَبُو بَكْرٍ الْإِسْمَاعِيلِيُّ فِيمَا أَخْبَرَنَا أَبُو عَمْرٍو الْأَدِيبُ عَنْهُ حَدِيثَ طَاوُسٍ عَنِ مُعَاذٍ إِذَا كَانَ مُرْسَلًا فَلَا حُجَّةَ فِيهِ وَقَدْ قَالَ فِيهِ بَعْضُهُمْ مِنَ الْجِزْيَةِ بَدَلَ الصَّدَقَةِ قَالَ الشَّيْخُ هَذَا هُوَ الْأَلْيَقُ بِمُعَاذٍ وَالْأَشْبَهُ بِمَا أَمَرَهُ النَّبِيُّ ﷺ بِهِ مِنْ أَخْذِ الْجِنْسِ فِي الصَّدَقَاتِ وَأَخْذِ الدِّينَارِ أَوْ عَدَّ لَهُ مَعَافِرَ ثِيَابٍ بِالْيَمَنِ فِي الْجِزْيَةِ وَأَنْ تُرَدَّ الصَّدَقَاتُ عَلَى فُقَرَائِهِمْ لَا أَنْ يَنْقُلَهَا إِلَى الْمُهَاجِرِينَ بِالْمَدِينَةِ الَّذِينَ أَكْثَرُهُمْ أَهْلُ فَيْءٍ لَا أَهْلُ صَدَقَةٍ وَاللهُ أَعْلَمُ
[Machine] Indeed, the Messenger of Allah ﷺ saw an old camel among the camels of charity, so he became angry and said, "May Allah curse the owner of this camel." A man said, "O Messenger of Allah, I have retrieved her with two young camels from the outskirts of the charity." He ﷺ said, "Then this is good," and this is what Abu Abdullah Al-Haafiz informed me that Abu Al-Walid informed them that Al-Hasan ibn Sufyan reported to him that Abu Bakr ibn Abi Shaybah reported to him that Abdulrahim ibn Sulayman reported from Al-Mujalid, who mentioned it. Abu Eisa said, "I asked Al-Bukhari about it, and he said, 'This hadith was narrated by Ismaeel ibn Abi Khalid from Qays ibn Abi Hazim that the Prophet ﷺ saw a branded camel among the camels of charity and depreciated it.'"
إِنَّ رَسُولَ اللهِ ﷺ أَبْصَرَ نَاقَةً مُسِنَّةً فِي إِبِلِ الصَّدَقَةِ فَغَضِبَ وَقَالَ قَاتَلَ اللهُ صَاحِبَ هَذِهِ النَّاقَةِ فَقَالَ يَا رَسُولَ اللهِ إِنِّي ارْتَجَعْتُهَا بِبَعِيرَيْنِ مِنْ حَوَاشِي الصَّدَقَةِ قَالَ فَنِعْمَ إِذًا وَهَذَا فِيمَا أَنْبَأَنِي أَبُو عَبْدِ اللهِ الْحَافِظُ أَنَّ أَبَا الْوَلِيدِ أَخْبَرَهُمْ أنبأ الْحَسَنُ بْنُ سُفْيَانَ ثنا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ ثنا عَبْدُ الرَّحِيمِ بْنُ سُلَيْمَانَ عَنِ الْمُجَالِدِ فَذَكَرَهُ فَقَدْ قَالَ أَبُو عِيسَى سَأَلْتُ عَنْهُ الْبُخَارِيَّ فَقَالَ رَوَى هَذَا الْحَدِيثَ إِسْمَاعِيلُ بْنُ أَبِي خَالِدٍ عَنْ قَيْسِ بْنِ أَبِي حَازِمٍ أَنَّ النَّبِيَّ ﷺ رَأَى فِي إِبِلِ الصَّدَقَةِ مُرْسَلًا وَضَعَّفَ مُجَالِدًا
[Machine] He informed us as a messenger, Abu Abdullah al-Sulami, he informed us, Abu al-Hasan al-Karizi, narrated to us Ali ibn Abdul Aziz, from Abu Ubaid, narrated to us Hushaim, from Ismail ibn Abi Khalid, from Qais ibn Abi Hazim, from the Prophet ﷺ that he saw a female camel among the charity camels and asked about it. The one giving charity (the donator) said, "I took it for exchange with other camels," and he remained silent.
أَخْبَرَنَاهُ مُرْسَلًا أَبُو عَبْدِ الرَّحْمَنِ السُّلَمِيُّ أنبأ أَبُو الْحَسَنِ الْكَارِزِيُّ ثنا عَلِيُّ بْنُ عَبْدِ الْعَزِيزِ عَنْ أَبِي عُبَيْدٍ ثنا هُشَيْمٌ عَنْ إِسْمَاعِيلَ بْنِ أَبِي خَالِدٍ عَنْ قَيْسِ بْنِ أَبِي حَازِمٍ عَنِ النَّبِيِّ ﷺ أَنَّهُ رَأَى فِي إِبِلِ الصَّدَقَةِ نَاقَةً كَوْمَاءَ فَسَأَلَ عَنْهَا فَقَالَ الْمُصَدِّقُ إِنِّي أَخَذْتُهَا بِإِبِلٍ فَسَكَتَ
10.39 [Machine] The man takes care of dividing his hidden wealth Zakat personally.
١٠۔٣٩ بَابُ الرَّجُلِ يَتَوَلَّى تَفْرِقَةَ زَكَاةِ مَالِهِ الْبَاطِنَةِ بِنَفْسِهِ.
اذْهَبْ بِهَا أَنْتَ فَاقْسِمْهَا
10.40 [Machine] The governor takes voluntary donations from his visible wealth, whether he likes it or dislikes it.
١٠۔٤٠ بَابُ الْوَالِي يُأْخَذُ مِنْهُ زَكَاةُ أَمْوَالِهِ الظَّاهِرَةِ أَحَبَّ ذَلِكَ أَوْ كَرِهَهُ.
When the Messenger of Allah ﷺ died and Abu Bakr ؓ became (caliph) after him, and some of the Arabs apostatized,ʻUmar ؓ said: O Abu Bakr, how can you fight the people when the Messenger of Allah ﷺ said: ʿI have been ordered to fight the people until they bear witness that there is no god except Allah. Whoever bears witness that there is no god except Allah has protected his wealth and his life from me, except in cases dictated by Islamic law, and their reckoning will be with Allahʿ? Abu Bakr ؓ said: by Allah I shall certainly fight the one who separates prayer and zakah, for zakah is what is due from wealth. By Allah, whoever withholds from me a goat that they used to give (in zakah) to the Messenger of Allah ﷺ, I shall fight them for withholding it. 'Umar said: By Allah, as soon as I realized that Allah had opened the heart of Abu Bakr to fighting, I realized that it was the right thing to do. (Using translation from Aḥmad 117)
أَخْبَرَهُ قَالَ لَمَّا تُوُفِّيَ رَسُولُ اللهِ ﷺ وَاسْتُخْلِفَ أَبُو بَكْرٍ ؓ بَعْدَهُ وَكَفَرَ مَنْ كَفَرَ مِنَ الْعَرَبِ قَالَ عُمَرُ ؓ يَا أَبَا بَكْرٍ كَيْفَ تُقَاتِلُ النَّاسَ وَقَدْ قَالَ رَسُولُ اللهِ ﷺ أُمِرْتُ أَنْ أُقَاتِلَ النَّاسَ حَتَّى يَقُولُوا لَا إِلَهَ إِلَّا اللهُ فَمَنْ قَالَ لَا إِلَهَ إِلَّا اللهُ عَصَمَ مِنِّي مَالَهُ وَنَفْسَهُ إِلَّا بِحَقِّهِ وَحِسَابُهُ عَلَى اللهِ ؟ قَالَ أَبُو بَكْرٍ وَاللهِ لَأُقَاتِلَنَّ مَنْ فَرَّقَ بَيْنَ الصَّلَاةِ وَالزَّكَاةِ فَإِنَّ الزَّكَاةَ حَقُّ الْمَالِ وَاللهِ لَوْ مَنَعُونِي عَنَاقًا كَانُوا يُؤَدُّونَهَا إِلَى رَسُولِ اللهِ ﷺ لَقَاتَلْتُهُمْ عَلَى مَنْعِهَا قَالَ عُمَرُ فَوَاللهِ مَا هُوَ إِلَّا أَنْ رَأَيْتُ اللهَ قَدْ شَرَحَ صَدْرَ أَبِي بَكْرٍ لِلْقِتَالِ فَعَرَفْتُ أَنَّهُ الْحَقُّ
10.41 [Machine] The choice in sending it to the governor.
١٠۔٤١ بَابُ الِاخْتِيَارِ فِي دَفْعِهَا إِلَى الْوَالِي.
[Machine] The Messenger of Allah ﷺ came to a group of Bedouins and they said, "We are visited by believers who then betray us." The Messenger of Allah ﷺ said, "Accept them and they will not harm you." They accepted them three times. Each time, they said, "Accept them." Jarir said, "No one came to me as a believer and then left while they were still pleased with him except for him (the Messenger of Allah).
أَتَى رَسُولَ اللهِ ﷺ أَعْرَابٌ فَقَالُوا يَأْتِينَا مُصَدِّقُونَ فَيَعْتَدُونَ عَلَيْنَا فَقَالَ رَسُولُ اللهِ ﷺ أَرْضُوهُمْ فَأَعَادُوا عَلَيْهِ ثَلَاثَ مَرَّاتِ كُلُّ ذَلِكَ يَقُولُ أَرْضُوهُمْ قَالَ جَرِيرٌ ؓ فَمَا أَتَانِي مُصَدِّقٌ بَعْدُ إِلَّا ذَهَبَ وَهُوَ رَاضٍ
[Machine] The Messenger of Allah ﷺ said, "A group of people you dislike will come to you. When they come to you, welcome them and create a space between them and what they seek. If they are just, they are upon themselves (their reward), and if they are oppressive, the burden is on them. And please them, for their complete zakat is their satisfaction. And let them pray for you."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ سَيَأْتِيكُمْ رَكْبٌ مُبْغَضُونَ فَإِذَا أَتَوْكُمْ فَرَحِّبُوا بِهِمْ وَخَلُّوا بَيْنَهُمْ وَبَيْنَ مَا يَبْتَغُونَ فَإِنْ عَدَلُوا فَلِأَنْفُسِهِمْ وَإِنْ ظَلَمُوا فَعَلَيْهَا وَأَرْضُوهُمْ فَإِنَّ تَمَامَ زَكَاتِهِمْ رِضَاهُمْ وَلْيَدْعُوا لَكُمْ
[Machine] Some of it I give to the sultan, and some of it I give in charity. He said, "What is it for? Why do you do that?" He said, "They buy silver coins with it, marry women with it, and buy land with it." He said, "Give it to them, for the Prophet ﷺ commanded us to give it to them, and they are responsible for its distribution."
مِنْهَا مَا أَدْفَعُهَا إِلَى السُّلْطَانِ وَمِنْهَا مَا أَتَصَدَّقُ بِهَا فَقَالَ مَا لَكَ وَمَا لِذَلِكَ؟ قَالَ إِنَّهُمْ يَشْتَرُونَ بِهَا الْبِزُوزَ وَيَتَزَوَّجُونَ بِهَا النِّسَاءَ وَيَشْتَرُونَ بِهَا الْأَرَضِينَ قَالَ فَادْفَعْهَا إِلَيْهِمْ فَإِنَّ النَّبِيَّ ﷺ أَمَرَنَا أَنْ نَدْفَعَهَا إِلَيْهِمْ وَعَلَيْهِمْ حِسَابُهُمْ
[Machine] Pay your charity from your wealth to those whom Allah has made responsible for your affairs. Whoever is righteous, it is only for the benefit of oneself. And whoever does evil, it is against themselves.
ادْفَعُوا صَدَقَاتِ أَمْوَالِكُمْ إِلَى مَنْ وَلَّاهُ اللهُ أَمْرَكُمْ فَمَنْ بَرَّ فَلِنَفْسِهِ وَمَنْ أَثِمَ فَعَلَيْهَا
[Machine] The Messenger of Allah ﷺ said, "When the beggar comes to you, give him your charity. But if he transgresses against you, turn away from him and do not curse him. Instead, say, 'O Allah, I seek reward with You for what he has taken from me.'"
قَالَ رَسُولُ اللهِ ﷺ إِذَا أَتَاكُمُ الْمُصَدِّقُ فَأَعْطِهِ صَدَقَتَكَ فَإِنِ اعْتَدَى عَلَيْكَ فَوَلِّهِ ظَهْرَهُ وَلَا تَلْعَنْهُ وَقُلْ اللهُمَّ إِنِّي احْتَسَبْتُ عِنْدَكَ مَا أَخَذَ مِنِّي
[Machine] Pay it to them, and if they drink alcohol with it, meaning the princes.
ادْفَعُوهَا إِلَيْهِمْ وَإِنْ شَرِبُوا بِهَا الْخَمْرَ يَعْنِي الْأُمَرَاءَ
[Machine] He used to pay them, meaning the Sultan, in the turmoil, they would bite their animals with it.
كَانَ يَدْفَعُهَا إِلَيْهِمْ يَعْنِي السُّلْطَانَ فِي الْفِتْنَةِ يَقْضَمُونَ بِهَا دَوَابَّهُمْ
[Machine] His charity is due, and I find a place for it, and these people do in it what you have seen. So he said, give it to them. So I asked Abu Sa'id the same question, and he said, give it to them. And I asked Ibn 'Umar the same question, and he said, give it to them. And we have also been narrated from Abu Huraira, Jabir ibn 'Abdullah, and Abdullah ibn Abbas on this matter.
زَكَاتَهُ وَأَنَا أَجِدُ لَهَا مَوْضِعًا وَهَؤُلَاءِ يَصْنَعُونَ فِيهَا مَا قَدْ رَأَيْتَ فَقَالَ أَدِّهَا إِلَيْهِمْ قَالَ وَسَأَلْتُ أَبَا سَعِيدٍ مِثْلَ ذَلِكَ فَقَالَ أَدِّهَا إِلَيْهِمْ قَالَ وَسَأَلْتُ ابْنَ عُمَرَ مِثْلَ ذَلِكَ فَقَالَ أَدِّهَا إِلَيْهِمْ وَرُوِّينَا فِي هَذَا أَيْضًا عَنْ أَبِي هُرَيْرَةَ وَجَابِرِ بْنِ عَبْدِ اللهِ وَعَبْدِ اللهِ بْنِ عَبَّاسٍ ؓ
10.42 [Machine] The heading translates to: "The choice in her department by herself, if possible, to be confident in her performance. This was narrated by Sa'id ibn al-Musayyib, Hasan, Tawus, and Ibrahim al-Nakha'i.
١٠۔٤٢ بَابُ الِاخْتِيَارِ فِي قَسْمِهَا بِنَفْسِهِ إِذَا أَمْكَنَهُ ذَلِكَ لِيَكُونَ عَلَى يَقِينٍ مِنَ أَدَائِهَا رُوِيَ ذَلِكَ عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ وَالْحَسَنِ وَطَاوُسٍ وَإِبْرَاهِيمَ النَّخَعِيِّ.
[Machine] I passed by a perfumer woman in the market. If I had something with me, I would have given it to her. Then he said, "O angry (person), give him five hundred dirhams from Zakat." Then Ibn 'Umar said, "They tried to deceive us, so may Allah deceive them."
مَرَرْتُ بِامْرَأَةٍ عَطَّارَةٍ فِي السُّوقِ فَلَوْ كَانَ مَعِي شَيْءٌ لَأَعْطَيْتُهَا فَقَالَ يَا غَضْبَانُ أَعْطِهِ خَمْسَمِائَةَ دِرْهَمٍ مِنَ الزَّكَاةِ فَقَالَ ابْنُ عُمَرَ لَبَّسُوا عَلَيْنَا لَبَّسَ اللهُ عَلَيْهِمْ
أَنْ تَدْفَعَهَا إِلَى السُّلْطَانِ
