10. Zakāh (Prescribed Charity) (2/13)
١٠۔ كِتَابُ الزَّكَاةِ ص ٢
[Machine] God Almighty said, "And they were not commanded except to worship Allah, [being] sincere to Him in religion, inclining to truth, and to establish prayer and to give zakah. And that is the correct religion." [Al-Bayyinah: 5]
قَالَ اللهُ ﷻ {وَمَا أُمِرُوا إِلَّا لِيَعْبُدُوا اللهَ مُخْلِصِينَ لَهُ الدِّينَ حُنَفَاءَ وَيُقِيمُوا الصَّلَاةَ وَيُؤْتُوا الزَّكَاةَ وَذَلِكَ دِينُ الْقَيِّمَةِ} [البينة: 5]
I went to the Messenger of Allah ﷺ and he was sitting under the shade of the Ka'ba. As he saw me he said: By the Lord of the Ka'ba, they are the losers. I came there till I sat and I could not stay (longer) and (then) stood up. I said: Messenger of Allah, let my father, be ransom for you, who are they (the losers)? He said: They are those having a huge amount of wealth except so and so and (those who spend their wealth generously on them whom they find in front of them, behind them and on their right side and on their left side) and they are a few. And no owner of camels, or cattle or goat and sheep, who does not pay Zakat (would be spared punishment) but these (camels, cattle, goats and sheep) would come on the Day of Resurrection wearing more flesh and would gore him with their horns and trample them with their hooves. And when the last one would pass away, the first one would return (to trample him) till judgment would be pronounced among people. (Using translation from Muslim 990a)
انْتَهَيْتُ إِلَى النَّبِيِّ ﷺ وَهُوَ جَالِسٌ فِي ظِلِّ الْكَعْبَةِ فَلَمَّا رَآنِي قَالَ هُمُ الْأَخْسَرُونَ وَرَبِّ الْكَعْبَةِ قَالَ فَجِئْتُ حَتَّى جَلَسْتُ فَلَمْ أَتَقَارَّ أَنْ قُمْتُ فَقُلْتُ مَنْ هُمْ؟ فِدَاكَ أَبِي وَأُمِّي قَالَ هُمُ الْأَكْثَرُونَ إِلَّا مَنْ قَالَ بِالْمَالِ هَكَذَا وَهَكَذَا أَرْبَعَ مَرَّاتٍ وَقَلِيلٌ مَا هُمْ مَا مِنْ صَاحِبِ إِبِلٍ وَلَا بَقَرٍ وَلَا غَنَمٍ لَا يُؤَدِّي زَكَاتَهَا إِلَّا جَاءَتْ يَوْمَ الْقِيَامَةِ أَعْظَمَ مَا كَانَتْ وَأَسْمَنَهُ تَنْطَحُهُ بِقُرُونِهَا وَتَطَؤُهُ بِأَخْفَافِهَا كُلَّمَا نَفَذَتْ أُخْرَهَا عَادَتْ عَلَيْهِ أُولَاهَا حَتَّى يُقْضَى بَيْنَ النَّاسِ لَفْظُ حَدِيثِ وَكِيعٍ
[Machine] On the authority of the Prophet ﷺ , he said: "If a person does not fulfill the rights of Allah, the Most High, in giving charity for his camels, they will make it stumble in a barren area, trampling on it with their hooves and biting it with their mouths, whenever its other camels pass by, it will strike it with the front until it sees its source either from Paradise or from the Hellfire. Similarly, if a person does not fulfill the rights of Allah, the Most High, in his cows, they will make it stumble in a barren area, trampling on it with their hooves and butting it with their horns, whenever its other cows pass by, it will strike it with the front until it sees its source either from Paradise or from the Hellfire. And likewise, the sheep will butt it with their horns and trample on it with their hooves until it sees its source either from Paradise or from the Hellfire. The horses have three rewards, sins, and a covering. Whoever acquires them for chastity and enrichment, they will be a covering for him. And whoever acquires them as equipment for jihad in the way of Allah, they will be a reward for him, and if he extends them honor or two honors, he will have a reward in that. And whoever acquires them to show off, boast, and scorn the Muslims, they will be a sin for him." A person asked, "What about red camels, O Messenger of Allah?" He said, "Nothing comes in red camels except for the comprehensive, decisive verse: 'So whoever does an atom's weight of good will see it. And whoever does an atom's weight of evil will see it.'" (Quran, Surah Al-Zalzalah, 99:7-8)
عَنِ النَّبِيِّ ﷺ قَالَ إِذَا لَمْ يُؤَدِّ الْمَرْءُ حَقَّ اللهِ تَعَالَى فِي الصَّدَقَةِ فِي إِبِلِهِ بُطِحَ لَهَا بِصَعِيدٍ قَرْقَرٍ فَوَطِئَتْهُ بِأَخْفَافِهَا وَعَضَّتْهُ بِأَفْوَاهِهَا إِذَا مَرَّ عَلَيْهِ أُخْرَاهَا كرَّ عَلَيْهِ أُولَاهَا حَتَّى يَرَى مَصْدَرَهُ إِمَّا مِنَ الْجَنَّةِ وَإِمَّا مِنَ النَّارِ وَالْبَقَرُ إِذَا لَمْ يُؤَدَّ حَقُّ اللهِ تَعَالَى فِيهَا بُطِحَ لَهَا بِصَعِيدٍ قَرْقَرٍ فَوَطِئَتْهُ بِأَظْلَافِهَا وَنَطَحَتْهُ بِقُرُونِهَا إِذَا مَرَّ عَلَيْهِ أُخْرَاهَا كرَّ عَلَيْهِ أُولَاهَا حَتَّى يَرَى مَصْدَرَهُ إِمَّا مِنَ الْجَنَّةِ وَإِمَّا مِنَ النَّارِ وَالْغَنَمُ كَذَلِكَ تَنْطَحُهُ بِقُرُونِهَا وَتَطَؤُهُ بِأَظْلَافِهَا لَيْسَ فِيهَا عَقْصَاءُ وَلَا جَمَّاءُ حَتَّى يَرَى مَصْدَرَهُ إِمَّا مِنَ الْجَنَّةِ وَإِمَّا مِنَ النَّارِ وَالْخَيْلُ ثَلَاثَةٌ أَجْرٌ وَوِزْرٌ وَسِتْرٌ فَمَنِ اقْتَنَاهَا تَعَفُّفًا وَتَغَنِّيًا كَانَتْ لَهُ سِتْرًا وَمَنِ اقْتَنَاهَا عِدَّةً لِلْجِهَادِ فِي سَبِيلِ اللهِ كَانَتْ لَهُ أَجْرًا وَإِنْ طَوَّلَ لَهَا شَرَفًا أَوْ شَرَفَيْنِ كَانَ لَهُ فِي ذَلِكَ أَجْرٌ وَمَنِ اقْتَنَاهَا فَخْرًا وَرِئَاءً وَنِوَاءً عَلَى الْمُسْلِمِينَ كَانَتْ لَهُ وِزْرًا قَالَ قَائِلٌ أَرَأَيْتَ الْحُمُرَ يَا رَسُولَ اللهِ قَالَ لَمْ يَأْتِ فِي الْحُمُرِ شَيْءٌ إِلَّا الْآيَةُ الْجَامِعَةُ الْفَاذَّةُ {فَمَنْ يَعْمَلْ مِثْقَالَ ذَرَّةٍ خَيْرًا يَرَهُ وَمَنْ يَعْمَلْ مِثْقَالَ ذَرَّةٍ شَرًّا يَرَهُ } [الزلزلة 8]
10.16 [Machine] How did he enforce the obligation of cow charity?
١٠۔١٦ بَابُ كَيْفَ فَرَضَ صَدَقَةَ الْبَقَرِ
That the Messenger of Allah sent him to Yemen, and he commanded him to take a Dinar, or its equivalent in Maafr,[1] from each person who had reached the age of puberty. And with regard to cattle, from every thirty a male or female Tabi '(two-year-old). And from every forty a Musinnah (three-year-old). (Daif) (Using translation from Nasāʾī 2450)
مُعَاذٌ بَعَثَنِي رَسُولُ اللهِ ﷺ إِلَى الْيَمَنِ وَأَمَرَنِي أَنْ آخُذَ مِنْ كُلِّ أَرْبَعِينَ بَقَرَةً ثَنِيَّةً وَمِنْ كُلِّ ثَلَاثِينَ تَبِيعًا أَوْ تَبِيعَةً وَمِنْ كُلِّ حَالِمٍ دِينَارًا أَوْ عِدْلُهُ مَعَافِرِيٌّ
[Machine] The Prophet ﷺ sent him to Yemen and ordered him to take from every thirty cows either a male or a female for sale, and from every forty-year-old, and from every dhalm (camel) a dinar or its equivalent in goods. And Abu Ali al-Rudhbari informed us, Muhammad ibn Bakr informed us, Abu Dawood narrated to us, narrated to us al-Nufayli, and 'Uthman ibn Abi Shaybah and Ibn al-Muthanna said, Mutawwiya narrated to us, al-A'mash narrated to us, from Ibrahim, from Masruq, from Mu'adh, from the Prophet ﷺ in a similar manner.
بَعَثَهُ النَّبِيُّ ﷺ إِلَى الْيَمَنِ وَأَمَرَهُ أَنْ يَأْخُذَ مِنْ كُلِّ ثَلَاثِينَ بَقَرَةً تَبِيعًا أَوْ تَبِيعَةً وَمِنْ كُلِّ أَرْبَعِينَ مُسِنَّةً وَمِنْ كُلِّ حَالِمٍ دِينَارًا أَوْ عِدْلُهُ مَعَافِرٌ 7288 وَأَخْبَرَنَا أَبُو عَلِيٍّ الرُّذْبَارِيُّ أنبأ مُحَمَّدُ بْنُ بَكْرٍ أنبأ أَبُو دَاوُدُ ثنا النُّفَيْلِيُّ وَعُثْمَانُ بْنُ أَبِي شَيْبَةَ وَابْنُ الْمُثَنَّى قَالُوا ثنا مُعَاوِيَةُ ثنا الْأَعْمَشُ عَنْ إِبْرَاهِيمَ عَنْ مَسْرُوقٍ عَنْ مُعَاذٍ عَنِ النَّبِيِّ ﷺ بِنَحْوِهِ
[Machine] He said that for every thirty camels, there is either a male or female camel, and for every forty cows, there is one cow.
أَنَّهُ قَالَ فِي كُلِّ ثَلَاثِينَ تَبِيعٌ أَوْ تَبِيعَةٌ وَفِي كُلِّ أَرْبَعِينَ بَقَرَةً بَقَرَةٌ
[Machine] I hear from the messenger of Allah ﷺ in it something until I meet him and ask him, and the messenger of Allah ﷺ passed away before Mu'adh ibn Jabal came forward.
أَسْمَعْ مِنْ رَسُولِ اللهِ ﷺ فِيهِ شَيْئًا حَتَّى أَلْقَاهُ فَأَسْأَلَهُ فَتُوُفِّيَ رَسُولُ اللهِ ﷺ قَبْلَ أَنْ يَقْدَمَ مُعَاذُ بْنُ جَبَلٍ
[Machine] "The Prophet ﷺ did not command me in it with anything," said Al-Shafi'i and Al-Waqi' said, "except that it has not reached the level of obligation."
لَمْ يَأْمُرْنِي فِيهِ النَّبِيُّ ﷺ بِشَيْءٍ قَالَ الشَّافِعِيُّ وَالْوَقْصُ مَا لَمْ يَبْلُغِ الْفَرِيضَةَ
[Machine] When the Messenger of Allah ﷺ sent Mu'adh to Yemen, he was asked: "What have you been commanded?" He replied: "I have been commanded to take from the livestock thirty young she-camels or she-goats, and from every forty, one aged animal." Abu Abdullah Al-Hafiz informed us, who heard from Abu Amr Uthman bin Ahmad Ad-Daqqaq, who heard from Muhammad bin Ubaydullah Al-Munadi, who heard from Abu Badr Shuja' ibn Al-Walid, who heard from Al-Hasan bin Ammarah, who heard from Al-Hakam, who mentioned it and had a witness with a stronger chain than his.
لَمَّا بَعَثَ رَسُولُ اللهِ ﷺ مُعَاذًا إِلَى الْيَمَنِ قِيلَ لَهُ مَا أُمِرْتَ؟ قَالَ أُمِرْتُ أَنْ آخُذَ مِنَ الْبَقَرِ مِنْ ثَلَاثِينَ تَبِيعًا أَوْ تَبِيعَةً وَمِنْ كُلِّ أَرْبَعِينَ مُسِنَّةً 7292 أَخْبَرَنَا أَبُو عَبْدِ اللهِ الَحَافِظُ أنبأ أَبُو عَمْرٍو عُثْمَانُ بْنُ أَحْمَدَ الدَّقَّاقُ ثنا مُحَمَّدُ بْنُ عُبَيْدِ اللهِ الْمُنَادِي ثنا أَبُو بَدْرٍ شُجَاعُ بْنُ الْوَلِيدِ ثنا الْحَسَنُ بْنُ عُمَارَةَ ثنا الْحَكَمُ فَذَكَرَهُ وَلَهُ شَاهِدٌ بِإِسْنَادٍ أَجْوَدَ مِنْهُ
[Machine] When the Messenger of Allah, ﷺ , sent Mu'adh to Yemen, he ordered him to take from every thirty she-camels one that is ready to be sold and from every forty cows one that is old. They asked him, "What about the animals that are in between?" He replied, "He did not command me regarding them, so I will ask the Messenger of Allah, ﷺ , when I meet him." So when he met the Messenger of Allah, ﷺ , he asked him about the animals in between. He said, "There is nothing specific about them." Al-Mas'udi said, "The 'awaqas are the animals that are below thirty and those that are between forty and sixty. If there are sixty, then there are two that are ready to be sold. If there are seventy, then there is one that is old and ready to be sold. If there are eighty, then there are two that are old and ready to be sold. If there are ninety, then there are three that are ready to be sold." The remainder said, "Awaqas is written with a seen, and it should not be read as "sadin."
لَمَّا بَعَثَ رَسُولُ اللهِ ﷺ مُعَاذًا إِلَى الْيَمَنِ أَمَرَهُ أَنْ يَأْخُذَ مِنَ الْبَقَرِ مِنْ كُلِّ ثَلَاثِينَ تَبِيعًا أَوْ تَبِيعَةً جَذَعًا أَوْ جَذَعَةً وَمِنْ كُلِّ أَرْبَعِينَ بَقَرَةً بَقَرَةً مُسِنَّةً فَقَالُوا فَالْأَوْقَاصُ؟ قَالَ فَقَالَ مَا أَمَرَنِي فِيهَا بِشَيْءٍ وَسَأَسْأَلُ رَسُولَ اللهِ ﷺ إِذَا قَدِمْتُ عَلَيْهِ فَلَمَّا قَدِمَ عَلَى رَسُولِ اللهِ ﷺ سَأَلَهُ عَنِ الْأَوْقَاصِ فَقَالَ لَيْسَ فِيهَا شَيْءٌ وَقَالَ الْمَسْعُودِيُّ وَالْأَوْقَاصُ مَا دُونَ الثَّلَاثِينَ وَمَا بَيْنَ الْأَرْبَعِينَ إِلَى السِّتِّينَ وَإِذَا كَانَتْ سِتُّونَ فَفِيهَا تَبِيعَتَانِ فَإِذَا كَانَتْ سَبْعُونَ فَفِيهَا مُسِنَّةٌ وَتَبِيعٌ فَإِذَا كَانَتْ ثَمَانُونَ فَفِيهَا مُسِنَّتَانِ فَإِذَا كَانَتْ تِسْعُونَ فَفِيهَا ثَلَاثُ تَبَائِعَ قَالَ بَقِيَّةُ قَالَ الْمَسْعُودِيُّ الْأَوْقَاصُ هِيَ بِالسِّينِ الْأَوْقَاسُ فَلَا تَجْعَلْهَا بِصَادٍ
[Machine] From the Messenger of Allah ﷺ , he said, "Give one-fourth of the tithe." He mentioned a long narration in it, saying, "And for every thirty cows, (there is) one calf, and for every forty cows, (there is) one middle-aged (cow), and the laborers have no responsibility."
عَنْ رَسُولِ اللهِ ﷺ أَنَّهُ قَالَ هَاتُوا رُبْعَ الْعُشْرِ فَذَكَرَ الْحَدِيثَ بِطُولِهِ قَالَ فِيهِ وَفِي الْبَقَرِ فِي كُلِّ ثَلَاثِينَ تَبِيعٌ وَفِي الْأَرْبَعِينَ مُسِنَّةٌ وَلَيْسَ عَلَى الْعَوَامِلِ شَيْءٌ
[Machine] On the authority of the Prophet ﷺ , he said regarding cattle: "For every thirty cattle that are sold, a yearling or a yearling heifer is to be mentioned. And for every forty cattle that are old, a wing is not mentioned in his narration, a yearling or a yearling heifer is mentioned." It was narrated by Shurayk from Khusaif from Abu Ubaydah from his mother from Abdullah. Al-Bukhari narrated it.
عَنِ النَّبِيِّ ﷺ قَالَ فِي الْبَقَرِ فِي كُلِّ ثَلَاثِينَ تَبِيعًا أَوْ تَبِيعَةً جَذَعٌ أَوْ جَذَعَةٌ وَفِي أَرْبَعِينَ مُسِنَّةٌ لَمْ يَذْكُرْ جَنَاحٌ فِي رِوَايَتِهِ جَذَعٌ أَوْ جَذَعَةٌ وَرَوَاهُ شَرِيكٌ عَنْ خُصَيْفٍ عَنْ أَبِي عُبَيْدَةَ عَنْ أُمِّهِ عَنْ عَبْدِ اللهِ قَالَهُ الْبُخَارِيُّ
[Machine] The Prophet ﷺ wrote to the people of Yemen, saying: "Every thirty camels for sale should have a male or female calf, and every forty camels for sale should have a cow." Abu Abdul Rahman Al-Sulami narrated from Abu Amr bin Hamdan, who narrated from Abdullah bin Muhammad bin Abdul Aziz, who narrated from Al-Hakam bin Musa, who narrated from Yahya bin Hamza, who narrated from Sulaiman bin Dawood, who mentioned it.
عَنِ النَّبِيِّ ﷺ أَنَّهُ كَتَبَ إِلَى أَهْلِ الْيَمَنِ قَالَ فِيهِ وَفِي كُلِّ ثَلَاثِينَ بَاقُورَةً تَبِيعٌ جَذَعٌ أَوْ جَذَعَةٌ وَفِي كُلِّ أَرْبَعِينَ بَاقُورَةً بَقَرَةٌ حَدَّثَنِيهِ أَبُو عَبْدِ الرَّحْمَنِ السُّلَمِيُّ أنبأ أَبُو عَمْرِو بْنُ حَمْدَانَ أنبأ عَبْدُ اللهِ بْنُ مُحَمَّدِ بْنِ عَبْدِ الْعَزِيزِ ثنا الْحَكَمُ بْنُ مُوسَى ثنا يَحْيَى بْنُ حَمْزَةَ عَنْ سُلَيْمَانَ بْنِ دَاوُدَ فَذَكَرَهُ
the Prophet said: “For every thirty cattle, Tabi or Tabi'ah and for every forty a Musinnah.” (Using translation from Ibn Mājah 1804)
فِي أَرْبَعِينَ مِنَ الْبَقَرِ مُسِنَّةٌ وَفِي ثَلَاثِينَ تَبِيعٌ أَوْ تَبِيعَةٌ
[Machine] Al-Zuhri said: "If it (the number of cows) is twenty-five, then there is one cow for every five cows. And if it exceeds seventy-five, then there are two cows for every hundred. And if it exceeds two hundred, then for every forty cows there is one cow." Ma'mar said: "Al-Zuhri said: 'And we have received news that the Prophet ﷺ said: 'For every thirty cows, there is a livestock transaction, and for every forty cows, there is a livestock transaction.' This was a relief for the people of Yemen.' Then this (narration) came after that. This hadith is mentioned, disconnected, and narrated from another perspective, disconnected. The disconnected narration is not a valid proof, and what came before it is more abundant and more well-known. And Allah knows best."
الزُّهْرِيُّ فَإِذَا كَانَتْ خَمْسًا وَعِشْرِينَ فَفِيهَا بَقَرَةٌ إِلَى خَمْسٍ وَسَبْعِينَ فَإِذَا زَادَتْ عَلَى خَمْسٍ وَسَبْعِينَ فَفِيهَا بَقَرَتَانِ إِلَى عِشْرِينَ وَمِائَةٍ فَإِذَا زَادَتْ عَلَى عِشْرِينَ وَمِائَةٍ فَفِي كُلِّ أَرْبَعِينَ بَقَرَةً بَقَرَةٌ قَالَ مَعْمَرٌ قَالَ الزُّهْرِيُّ وَبَلَغَنَا أَنَّ قَوْلَهُمْ قَالَ النَّبِيُّ ﷺ فِي كُلِّ ثَلَاثِينَ بَقَرَةً تَبِيعٌ وَفِي كُلِّ أَرْبَعِينَ بَقَرَةً بَقَرَةٌ إِنَّ ذَلِكَ كَانَ تَخْفِيفًا لِأَهْلِ الْيَمَنِ ثُمَّ كَانَ هَذَا بَعْدَ ذَلِكَ فَهَذَا حَدِيثٌ مَوْقُوفٌ وَمُنْقَطِعٌ وَرُوِيَ مِنْ وَجْهٍ آخَرَ عَنِ الزُّهْرِيِّ مُنْقَطِعًا وَالْمُنْقَطِعُ لَا تَثْبُتُ بِهِ حُجَّةٌ وَمَا قَبْلَهُ أَكْثَرُ وَأَشْهَرُ وَاللهُ أَعْلَمُ

١٠۔١٧ جُمَّاعُ أَبْوَابِ صَدَقَةِ الْغَنَمِ السَّائِمَةِ
10.18 [Machine] How to give charity from sheep
١٠۔١٨ بَابُ كَيْفَ فَرَضَ صَدَقَةَ الْغَنَمِ
[Machine] When Abu Bakr was appointed, he sent him to Bahrain and wrote this letter to him: "In the name of Allah, the Most Merciful, the Most Compassionate. This is the obligation of charity that Allah has enjoined upon the Muslims, which the Messenger of Allah ﷺ commanded. So whoever is asked for it from among the Muslims, let him give it willingly, and whoever is asked for more than that, let him not give it. He mentioned the Hadith regarding the obligation of charity on camels and what is between their humps, then he said: "And the charity of sheep is based on their number. When they are forty to twenty, there is one sheep; when they exceed twenty to a hundred, there are two sheep; when they exceed a hundred to three hundred, there are three sheep; when they exceed three hundred, for every hundred there is one sheep. Hairless sheep, sheep with deformities, and goats are not taken as charity unless the giver wishes. Charity should not be combined between separate groups and should not be divided among a united group out of fear of charity. If there are two different groups, they should reconcile with equality. If a man's flock is less than forty sheep, there is no charity in it unless its Lord wills."
أَنَّ أَبَا بَكْرٍ ؓ لَمَّا اسْتُخْلِفَ بَعَثَهُ إِلَى الْبَحْرَيْنِ وَكَتَبَ لَهُ هَذَا الْكِتَابَ بِسْمِ اللهِ الرَّحْمَنِ الرَّحِيمِ هَذِهِ فَرِيضَةُ الصَّدَقَةِ الَّتِي فَرَضَ اللهُ عَلَى الْمُسْلِمِينَ الَّتِي أَمَرَ بِهَا رَسُولُ اللهِ ﷺ فَمَنْ سُئِلَهَا مِنَ الْمُسْلِمِينَ عَلَى وَجْهِهَا فَلْيُعْطِهَا وَمَنْ سُئِلَ فَوْقَهَا فَلَا يُعْطِهَا فَذَكَرَ الْحَدِيثَ فِي فَرْضِ الْإِبِلِ وَمَا بَيْنَ أَسْنَانِهَا ثُمَّ قَالَ وَصَدَقَةُ الْغَنَمِ فِي سَائِمَتِهَا فَإِذَا كَانَتْ أَرْبَعِينَ إِلَى عِشْرِينَ وَمِائَةٍ فَفِيهَا شَاةٌ فَإِذَا زَادَتْ عَلَى عِشْرِينَ وَمِائَةٍ إِلَى أَنْ تَبْلُغَ مِائَتَيْنِ فَفِيهَا شَاتَانِ فَإِذَا زَادَتْ عَلَى مِائَتَيْنِ إِلَى ثَلَاثِمِائَةٍ فَفِيهَا ثَلَاثُ شِيَاهٍ فَإِذَا زَادَتْ عَلَى ثَلَاثِمِائَةٍ فَفِي كُلِّ مِائَةٍ شَاةٌ وَلَا يُؤْخَذُ فِي الصَّدَقَةِ هَرِمَةٌ وَلَا ذَاتُ عَوَارٍ وَلَا تَيْسٌ إِلَّا أَنْ يَشَاءَ الْمُصَدِّقُ وَلَا يُجْمَعُ بَيْنَ مُتَفَرِّقٍ وَلَا يُفَرَّقُ بَيْنَ مُجْتَمِعٍ خَشْيَةَ الصَّدَقَةِ وَمَا كَانَ مِنْ خَلِيطَيْنِ فَإِنَّهُمَا يَتَرَاجَعَانِ بَيْنَهُمَا بِالسَّوِيَّةِ فَإِذَا كَانَتْ سَائِمَةُ الرَّجُلِ نَاقِصَةً مِنَ أَرْبَعِينَ شَاةً فَلَيْسَ فِيهَا صَدَقَةٌ إِلَّا أَنْ يَشَاءَ رَبُّهَا
10.19 [Machine] The age taken in sheep.
١٠۔١٩ بَابُ السِّنِّ الَّتِي تُؤْخَذُ فِي الْغَنَمِ
[Machine] On the authority of my two messengers, who are messengers of Allah ﷺ , they said about the sheep that he gave them: "There is a pregnant ewe that the Messenger of Allah ﷺ prohibited us from taking a share from, as well as the share of the ewe's fetus." I asked them, "What can I take from you then?" They replied, "You can take a female lamb or a male lamb." So, I brought them a female lamb, and they said, "Bring it to us." They took it, and they carried it on their camel, which numbered 7300. Abu Al-Hasan Ibn Abdan informed us, Ahmed Ibn Ubaid Al-Saffar told us, Al-Harith Ibn Abi Usamah narrated to us, Rawh Ibn Ubada narrated to us, Zakariah Ibn Ishaq narrated to us, Amr Ibn Abi Sufyan narrated to me, and Muslim Ibn Shu'bah mentioned it except that our sheikh (teacher) did not confirm the name of Sa'ar Ibn Daisam.
عَنْ رَسُولَيْ رَسُولِ اللهِ ﷺ أَنَّهُمَا قَالَا فِي الشَّاةِ الَّتِي أَعْطَاهُمَا هَذِهِ شَافِعٌ وَقَدْ نَهَانَا رَسُولُ اللهِ ﷺ أَنْ نَأْخُذَ شَافِعًا وَالشَّافِعُ الَّتِي فِي بَطْنِهَا وَلَدُهَا قَالَ فَقُلْتُ أِيَّ شَيْءٍ تَأْخُذَانِ؟ قَالَا عَنَاقًا جَذَعَةً أَوْ ثَنِيَّةً قَالَ فَأَخْرَجْتُ إِلَيْهِمَا عَنَاقًا قَالَا ارْفَعْهَا إِلَيْنَا فَتَنَاوَلَاهَا فَحَمَلَاهَا عَلَى بَعِيرِهِمَا 7300 أَخْبَرَنَا أَبُو الْحَسَنِ بْنُ عَبْدَانَ أنبأ أَحْمَدُ بْنُ عُبَيْدٍ الصَّفَّارُ ثنا الْحَارِثُ بْنُ أَبِي أُسَامَةَ ثنا رَوْحُ بْنُ عُبَادَةَ ثنا زَكَرِيَّا بْنُ إِسْحَاقَ ثنا عَمْرُو بْنُ أَبِي سُفْيَانَ حَدَّثَنِي مُسْلِمُ بْنُ شُعْبَةَ فَذَكَرَهُ إِلَّا أَنَّ شَيْخَنَا لَمْ يُثْبِتِ اسْمَ سَعْرِ بْنِ دَيْسَمٍ
[Machine] He (the Prophet) knows that they claim that we oppress them, taking their food but not giving them any in return. So, Umar said to him, "Make sure to give them food, even if it is from the leftovers that the shepherd eats with his hands. And tell them, I will not take from you the young offspring, the prematurely born, the self-inflicted, the eaten sheep, or the male sheep. Instead, I will take the healthy and mature lambs. This is fair and just in terms of the portions of wealth and its best choices."
لَهُ اعْلَمْ أَنَّهُمْ يَزْعُمُونَ أَنَّا نَظْلِمُهُمْ نَعْتَدُّ عَلَيْهِمْ بِالْغِذَاءِ وَلَا نَأْخُذُهُ مِنْهُمْ فَقَالَ لَهُ عُمَرُ فَاعْتَدَّ عَلَيْهِمْ بِالْغِذَاءِ حَتَّى بِالسَّخْلَةِ يَرُوُحُ بِهَا الرَّاعِي عَلَى يَدِهِ وَقُلْ لَهُمْ لَا آخُذُ مِنْكُمُ الرُّبَّى وَلَا الْمَاخِضَ وَلَا ذَاتَ الدَّرِّ وَلَا الشَّاةَ الْأَكُولَةَ وَلَا فَحْلَ الْغَنَمِ وَخُذِ الْعَنَاقَ الْجَذَعَةَ وَالثَّنِيَّةَ فَذَلِكَ عَدْلٌ بَيْنَ غِذَاءِ الْمَالِ وَخِيَارِهِ
[Machine] Umar ibn al-Khattab, yes, we count them with the sakhla that the shepherd carries, and we do not take it, nor do we take the nourishment, the nanny, the levantine (a breed of sheep), nor the stallion of the sheep, and we take the branch and the dry graze, and that is fair between the nourishment of wealth and its options.
عُمَرُ بْنُ الْخَطَّابِ نَعَمْ نَعُدُّ عَلَيْهِمْ بِالسَّخْلَةِ يَحْمِلُهَا الرَّاعِي وَلَا نَأْخُذُهَا وَلَا نَأْخُذُ الْأَكُولَةَ وَلَا الرُّبَّى وَلَا الْمَاخِضَ وَلَا فَحْلَ الْغَنَمِ وَنَأْخُذُ الْجَذَعَةَ وَالثَّنِيَّةَ وَذَلِكَ عَدْلٌ بَيْنَ غِذَاءِ الْمَالِ وَخِيَارِهِ
10.20 [Machine] The crimes of people's wealth cannot be taken.
١٠۔٢٠ بَابُ لَا يُؤْخَذُ كَرَائِمُ أَمْوَالِ النَّاسِ
When Messenger of Allah ﷺ sent Muʿadh to Yemen, he said (to him), "YOU are going to people of a (Divine) Book. First of all invite them to worship Allah (alone) and when they come to know Allah, inform them that Allah has enjoined on them, five prayers in every day and night; and if they start offering these prayers, inform them that Allah has enjoined on them, the Zakat. And it is to be taken from the rich amongst them and given to the poor amongst them; and if they obey you in that, take Zakat from them and avoid (don't take) the best property of the people as Zakat." أَنَّ النَّبِيَّ ﷺ لَمَّا بَعَثَ مُعَاذًا إِلَى الْيَمَنِ قَالَ إِنَّكَ تَقْدَمُ عَلَى قَوْمٍ أَهْلِ كِتَابٍ فَلْيَكُنْ أَوْلَ مَا تَدْعُوهُمْ إِلَيْهِ عِبَادَةُ اللهِ ﷻ فَإِذَا عَرَفُوا اللهَ فَأَخْبِرْهُمْ أَنَّ اللهَ قَدْ فَرَضَ عَلَيْهِمْ خَمْسَ صَلَوَاتٍ فِي يَوْمِهِمْ وَلَيْلَتِهِمْ فَإِذَا فَعَلُوا فَأَخْبِرْهُمْ أَنَّ اللهَ قَدْ فَرَضَ عَلَيْهِمْ زَكَاةً تُؤْخَذُ مِنْ أَمْوَالِهِمْ فَتُرَدُّ عَلَى فُقَرَائِهِمْ فَإِذَا أَطَاعُوا بِهَا فَخُذْ مِنْهُمْ وَتَوَقَّ كَرَائِمَ أَمْوَالِ النَّاسِ
I went myself or someone who accompanied the collector of the Prophet ﷺ told me: It was recorded in the document written by the Messenger of Allah ﷺ not to accept a milking goat or she-camel or a (suckling) baby (as zakat on animals); and those which are in separate flocks are not to be brought together, and those which are in one flock are not to be separated. The collector used to visit the water-hole when the sheep went there and say: Pay the sadaqah (zakat) on your property. The narrator said: A man wanted to give him his high-humped camel (kawma'). The narrator (Hilal) asked: What is kawma', AbuSalih? He said: A camel a high hump. The narrator continued: He (the collector) refused to accept it. He said: I wish you could take the best of my camels. He refused to accept it. He then brought another camel lower in quality than the previous one. He refused to accept it too. He then brought another camel lower in quality than the previous one. He accepted it, saying: I shall take it, but I am afraid the Messenger of Allah ﷺ might be angry with me, saying to me: You have purposely taken from a man a camel of your choice. Abu Dawud said: This tradition has also been narrated by Hushaim from Hilal bin Khabbab to the same effect. But he said: Those which are in one flock are not to be separated. أَخْبَرَنِي مَنْ سَارَ مَعَ مُصَدِّقِ النَّبِيِّ ﷺ فَإِذَا فِي عَهْدِ رَسُولِ اللهِ ﷺ أَنْ لَا تَأْخُذْ مِنْ رَاضِعِ لَبَنٍ وَلَا يُجْمَعُ بَيْنَ مُتَفَرِّقٍ وَلَا يُفَرَّقُ بَيْنَ مُجْتَمِعٍ وَكَانَ إِنَّمَا يَأْتِي الْمِيَاهَ حِينَ تُرَدُّ الْغَنَمُ فَيَقُولُ أَدُّوا صَدَقَاتِ أَمْوَالِكُمْ قَالَ فَعَمَدَ رَجُلٌ مِنْهُمْ إِلَى نَاقَةٍ كَوْمَاءَ قَالَ قُلْتُ يَا أَبَا صَالِحٍ مَا الْكَوْمَاءُ؟ قَالَ عَظِيمَةُ السَّنَامِ قَالَ فَأَبَى أَنْ يَقْبَلَهَا قَالَ فَقَالَ إِنِّي أُحِبُّ أَنْ تَأْخُذَ خَيْرَ إِبِلِي قَالَ فَأَبَى أَنْ يَقْبَلَهَا قَالَ فَخَطَمَ لَهُ أُخْرَى دُونَهَا فَأَبَى أَنْ يَقْبَلَهَا ثُمَّ خَطَمَ لَهُ أُخْرَى دُونَهَا فَقَبِلَهَا وَقَالَ إِنِّي آخُذُهَا وَأَخَافُ أَنْ يَجِدَ عَلَيَّ رَسُولُ اللهِ ﷺ يَقُولُ عَمَدْتَ إِلَى رَجُلٍ فَتَخَيَّرْتَ عَلَيْهِ إِبِلَهُ
"The Zakah collector of the prophet came to us, and I went to him, sat with him, and heard him say: In my contract it says that we should not take any sucking young, nor combine what is separate, nor separate what is combined.' A man brought a she-camel with a big hump to him and said: 'Take it, but he refused." (Daif) (Using translation from Nasāʾī 2457)
أَتَانَا مُصَدِّقُ النَّبِيِّ ﷺ فَأَتَيْتُهُ فَجَلَسْتُ إِلَيْهِ فَسَمِعْتُهُ يَقُولُ إِنَّ فِي عَهْدِي أَنْ لَا آخُذَ مِنْ رَاضِعِ لَبَنٍ وَلَا يُفَرَّقُ بَيْنَ مُجْتَمِعٍ وَلَا يُجْمَعُ بَيْنَ مُفْتَرِقٍ وَأَتَاهُ رَجُلٌ بِنَاقَةٍ كَوْمَاءَ فَقَالَ خُذْهَا فَأَبَى
[Machine] I took the hand of the Prophet Muhammad ﷺ and came to him with a large camel. He said, "Which sky will shelter me and which earth will contain me if I take the best of a person's wealth and he comes to me with a camel from among the camels?" So he accepted it.
أَخَذْتُ بِيَدِ مُصَدِّقِ النَّبِيِّ ﷺ وَأَتَيْتُهُ بِنَاقَةٍ عَظِيمَةٍ فَقَالَ أِيُّ سَمَاءٍ تُظِلُّنِي وَأِيُّ أَرْضٍ تُقِلُّنِي إِذَا أَخَذْتُ خِيَارَ مَالِ امْرِئٍ فَأَتَيْتُهُ بِنَاقَةٍ مِنَ الْإِبِلِ فَقَبِلَهَا
[Machine] The Prophet's companion came to me, so I took his hand and he took mine, and I read in his notebook that one should not separate what is joined, and one should not join what is separate, out of fear of charity mismanagement. He said, then a man came to him with a huge well-groomed camel, and he refused to take it. Then he came to him with another one, more valuable than the first, and he refused to take it. Then he came to him with another one, less valuable than the previous ones, and he refused to take it as well. Then he said, "Which land can bear me, and which sky can shade me, when I come to the Messenger of Allah ﷺ having taken the best of a Muslim's camels, as narrated in the conversation of Ubayy ibn Ka'b when he left as a companion and it indicates the permissibility of taking it if the owner offers it willingly."
أَتَى مُصَدِّقُ النَّبِيِّ ﷺ فَأَخَذْتُ بِيَدِهِ وَأَخَذَ بِيَدِي فَقَرَأْتُ فِي عَهْدِهِ أَنْ لَا يُجْمَعَ بَيْنَ مُتَفَرِّقٍ وَلَا يُفَرَّقُ بَيْنَ مُجْتَمِعٍ خَشْيَةَ الصَّدَقَةِ قَالَ فَأَتَاهُ رَجُلٌ بِنَاقَةٍ عَظِيمَةٍ مُلَمْلَمَةٍ فَأَبَى أَنْ يَأْخُذَهَا ثُمَّ أَتَاهُ بِأُخْرَى دُونَهَا فَأَبَى أَنْ يَأْخُذَهَا ثُمَّ أَتَاهُ بِأُخْرَى دُونَهَا فَأَبَى أَنْ يَأْخُذَهَا ثُمَّ قَالَ أِيُّ أَرْضٍ تُقِلُّنِي وَأِيُّ سَمَاءٍ تُظِلُّنِي إِذَا أَنَا أَتَيْتُ رَسُولَ اللهِ ﷺ وَقَدْ أَخَذْتُ خِيَارَ إِبِلِ امْرِئٍ مُسْلِمٍ وَقَدْ مَضَى فِي حَدِيثِ أُبَيِّ بْنِ كَعْبٍ حِينَ خَرَجَ مُصَدِّقًا وَفِيهِ دَلَالَةٌ عَلَى جَوَازِ الْأَخْذِ إِذَا تَطَوَّعَ بِهِ صَاحِبُهُ
[Machine] I saw a man in the place of Ayyub (Job), wearing a woolen robe (jubbah). In another narration by Al-Harith, he said: I saw in the gathering of Ayyub an Arab man wearing a woolen robe (jubbah). When the people began talking, he said, "My master, Qurrat bin Da'moos, told me..." He said, "I came to Madinah and found the Prophet ﷺ sitting with his companions around him. I wanted to get closer to him but I couldn't. So I said, 'O Messenger of Allah, seek forgiveness for the young boy, An-Numayri.' He replied, 'May Allah forgive you.' He said, 'The Messenger of Allah ﷺ sent Adh-Dhahhak as a messenger.' He said, 'He came with a large number of camels and the Prophet ﷺ said to him, 'Have you come from Hilal bin 'Aamir, Numayr bin 'Aamir, and 'Aamir bin Rabee'? I have taken their wealth.' So he said, 'O Messenger of Allah, I heard you mention war so I loved to come to you with camels that you could ride on and your companions could also ride on.' He said, 'By Allah, what you left behind is more beloved to me than what you brought. Go and return their property to them and take alms from the outskirts of their wealth.'"
رَأَيْتُ رَجُلًا فِي مَكَانِ أَيُّوبَ عَلَيْهِ جُبَّةٌ صُوفٌ وَفِي رِوَايَةِ الْحَارِثِ قَالَ رَأَيْتُ فِي مَجْلِسِ أَيُّوبَ أَعْرَابِيًّا عَلَيْهِ جُبَّةٌ صُوفٌ فَلَمَّا رَأَى الْقَوْمَ يَتَحَدَّثُونَ قَالَ حَدَّثَنِي مَوْلَايَ قُرَّةُ بْنُ دَعْمُوصٍ قَالَ أَتَيْتُ الْمَدِينَةَ فَإِذَا النَّبِيُّ ﷺ قَاعِدٌ وَأَصْحَابُهُ حَوْلَهُ فَأَرَدْتُ أَنْ أَدْنُوَ مِنْهُ فَلَمْ أَسْتَطِعْ أَنْ أَدْنُوَ مِنْهُ فَقُلْتُ يَا رَسُولَ اللهِ اسْتَغْفِرْ لِلْغُلَامِ النُّمَيْرِيِّ فَقَالَ غَفَرَ اللهُ لَكَ قَالَ وَبَعَثَ رَسُولُ اللهِ ﷺ الضَّحَّاكَ سَاعِيًا قَالَ فَجَاءَ بِإِبِلٍ جُلَّةٍ فَقَالَ لَهُ النَّبِيُّ ﷺ أَتَيْتُ هِلَالَ بْنَ عَامِرٍ وَنُمَيْرَ بْنَ عَامِرٍ وَعَامِرَ بْنَ رَبِيعٍ فَأَخَذْتُ جُلَّةَ أَمْوَالِهِمْ فَقَالَ يَا رَسُولَ اللهِ إِنِّي سَمِعْتُكَ تَذْكُرُ الْغَزْوَ فَأَحْبَبْتُ أَنْ آتِيَكَ بِإِبِلٍ تَرْكَبُهَا وَتَحْمِلُ عَلَيْهَا أَصْحَابَكَ فَقَالَ وَاللهِ لَلَّذِي تَرَكْتَ أَحَبُّ إِلَيَّ مِنَ الَّذِي جِئْتَ بِهِ اذْهَبْ فَرُدَّهَا عَلَيْهِمْ وَخُذْ صَدَقَاتِهِمْ مِنْ حَوَاشِي أَمْوَالِهِمْ
[Machine] The sheikh, if he is from those who fulfill their obligations, as
الشَّيْخُ إِذَا كَانَ فِيمَا دَفَعُوا وَفَاءٌ مِنَ الْحَقِّ كَمَا
[Machine] The Messenger of Allah, ﷺ , sent a trustworthy man who said, "Do not take anything from the wealth of people as a means of support, rather take from the generous, the wealthy, and those who are free from defects."
بَعَثَ رَسُولُ اللهِ ﷺ رَجُلًا مُصَدِّقًا قَالَ لَا تَأْخُذْ مِنْ حَزَرَاتِ أَنْفَسِ النَّاسِ شَيْئًا خُذِ الشَّارِفَ وَالْبِكْرَ وَذَوَاتِ الْعَيْبِ
[Machine] Do not take the option of their wealth, take the edge, which is the old and weak she-camel, and the young male camel, which is the young one among the male camels. And it was in the early days of Islam, before people took on laws. The scholar said that the saying is a transmitted narration, and it can be imagined that with us taking the males, the young, and the defective ones, when their gait is like that.
لَا تَأْخُذْ خِيَارَ أَمْوَالِهِمْ خُذِ الشَّارِفَ وَهِيَ الْمُسِنَّةُ الْهَرِمَةُ وَالْبِكْرَ وَهُوَ الصَّغِيرُ مِنْ ذُكُورِ الْإِبِلِ وَأَنَّهُ كَانَ فِي أَوْلِ الْإِسْلَامِ قَبْلَ أَنْ يُؤْخَذَ النَّاسُ بِالشَّرَائِعِ قَالَ الشَّيْخُ الْحَدِيثُ مُرْسَلٌ وَقَدْ يُتَصَوَّرُ عِنْدَنَا أَخْذُ الذُّكُورِ وَالصِّغَارِ وَالْمَعِيبَةِ إِذَا كَانَتْ مَاشِيَتُهُ كُلُّهَا كَذَلِكَ
[Machine] If the person giving alms reaches the sheep, he splits it into two halves, and the owner of the sheep takes the better half, and the owner of the donation takes the other half.
إِذَا انْتَهَى الْمُصَدِّقُ إِلَى الْغَنَمِ صَدَعَهَا صَدْعَيْنِ فَيَأْخُذُ صَاحِبُ الْغَنَمِ خَيْرَ الصَّدْعَيْنِ وَيَأْخُذُ صَاحِبُ الصَّدَقَةِ مِنَ الصَّدْعِ الْآخَرِ
[Machine] He said, "It is divided into three types of headaches: one-third is the best, one-third is average, and one-third is the worst." The believer should choose the best option and take from the average. Abu Bakr Al-Asbahani informed us that Abu Nasr Al-Iraqi narrated from Sufyan Al-Jawhari, who narrated from Ali Ibn Al-Hasan, who narrated from Abdullah Ibn Al-Walid, who narrated from Sufyan Al-Thawri, that both of them narrated from them all. Al-Shafi'i mentioned these two schools without naming their proponents, and we have also narrated from Al-Zuhri a statement similar to that of Al-Qasim and we have narrated from Umar Ibn Al-Khattab that he said, "The owner of the flock should choose one-third, and then choose from the remaining two-thirds."
أَنَّهُ قَالَ يَصْدَعُهَا ثَلَاثَةَ أَصْدَاعٍ ثُلُثَ خِيَارٍ وَثُلُثَ وَسَطٍ وَثُلُثَ دُونٍ فَيَدَعُ الْمُصَدِّقُ الْخِيَارَ وَيَأْخُذُ مِنَ الْوَسَطِ أَخْبَرَنَا أَبُو بَكْرٍ الْأَصْبَهَانِيُّ أَنْبَأَ أَبُو نَصْرٍ الْعِرَاقِيُّ ثنا سُفْيَانُ الْجَوْهَرِيُّ ثنا عَلِيُّ بْنُ الْحَسَنِ ثنا عَبْدُ اللهِ بْنُ الْوَلِيدِ ثنا سُفْيَانُ الثَّوْرِيُّ عَنْهُمَا بِهِمَا جَمِيعًا وَقَدْ حَكَى الشَّافِعِيُّ فِي الْقَدِيمِ هَذَيْنِ الْمَذْهَبَيْنِ مِنْ غَيْرِ تَسْمِيَةِ قَائِلَيْهِمَا وَرُوِّينَا عَنِ الزُّهْرِيِّ مِثْلَ قَوْلِ الْقَاسِمِ وَرُوِّينَا عَنِ عُمَرَ بْنِ الْخَطَّابِ ؓ أَنَّهُ قَالَ يَخْتَارُ صَاحِبُ الْغَنَمِ الثُّلُثَ ثُمَّ اخْتَارُوا مِنَ الثُّلُثَيْنِ الْبَاقِيَيْنِ
10.21 [Machine] They are blamed for neglecting their cattle and not taking what is left from them if it is still in their mothers.
١٠۔٢١ بَابُ يُعَدُّ عَلَيْهِمْ بِالسِّخَالِ الَّتِي نَتَجَتْ مَوَاشِيهِمْ وَلَا يُؤْخَذُ مِنْهَا إِذَا كَانَ فِي الْأُمَّهَاتِ بَقِيَّةٌ
[Machine] Omar used me for the charity of my people, so I multiplied it for them with a camel. They complained about that and said, "If you count it as part of the sheep, then take your charity from it." He said, "So we multiplied it for them with it." Then I met Omar and said, "Indeed, my people reproached me for multiplying it for them with a camel. They said, 'If you see it from the sheep, then take your charity from it.'" Omar said, "Multiply it on your people, O Sufyan, with a camel. Even if the shepherd brings it carrying it in his hand, say to your people, 'We leave for them the young one, the timber wolf, the sheep for meat, and the male sheep, and we take the offspring and the yearling. And that is fair between us and you in the wealth.' "
اسْتَعْمَلَنِي عُمَرُ ؓ عَلَى صَدَقَاتِ قَوْمِي فَاعْتَدَدْتُ عَلَيْهِمْ بِالْبُهْمِ فَاشْتَكَوْا ذَلِكَ وَقَالُوا إِنْ كُنْتَ تَعُدُّهَا مِنَ الْغَنَمِ فَخُذْ مِنْهَا صَدَقَتَكَ قَالَ فَاعْتَدَدْنَا عَلَيْهِمْ بِهَا ثُمَّ لَقِيتُ عُمَرَ ؓ فَقُلْتُ إِنَّ قَوْمِي اسْتَنْكَرُوا عَلَيَّ أَنِ اعْتَدَدْتُ عَلَيْهِمْ بِالْبُهْمِ وَقَالُوا إِنْ كُنْتَ تَرَاهَا مِنَ الْغَنَمِ فَخُذْ مِنْهَا صَدَقَتَكَ فَقَالَ عُمَرُ ؓ اعْتَدَّ عَلَى قَوْمِكَ يَا سُفْيَانُ بِالْبُهْمِ وَإِنْ جَاءَ بِهَا الرَّاعِي يَحْمِلُهَا فِي يَدِهِ وَقُلْ لِقَوْمِكَ إِنَّا نَدَعُ لَهُمُ الْمَاخِضَ وَالرُّبَّى وَشَاةَ اللَّحْمِ وَفَحْلَ الْغَنَمِ وَنَأْخُذُ الْجَذَعَ وَالثَّنِيَّ وَذَلِكَ وَسَطٌ بَيْنَنَا وَبَيْنَكُمْ فِي الْمَالِ
10.22 [Machine] They are not considered responsible for what they have benefited from unrelated revenue until it becomes their own property. The conversation of Asim ibn Damarah and Al-Harith from Ali, which is raised, does not include zakat on wealth until a year passes.
١٠۔٢٢ بَابٌ لَا يُعْتَدُّ عَلَيْهِمْ بِمَا اسْتَفَادُوهُ مِنْ غَيْرِ نِتَاجِهَا حَتَّى يَحُولَ عَلَيْهِ الْحَوْلُ قَدْ مَضَى حَدِيثُ عَاصِمِ بْنِ ضَمْرَةَ وَالْحَارِثِ عَنْ عَلِيٍّ مَرْفُوعًا لَيْسَ فِي مَالٍ زَكَاةٌ حَتَّى يَحُولَ عَلَيْهِ الْحَوْلُ
No zakah is due on wealth until one year has passed. (Using translation from Aḥmad 1265)
قَالَ رَسُولُ اللهِ ﷺ لَيْسَ فِي الْمَالِ زَكَاةٌ حَتَّى يَحُولَ عَلَيْهِ الْحَوْلُ
[Machine] If you have money that you have benefited from, then you are not obligated to pay Zakat on it until a year passes on it.
إِنْ كَانَ عِنْدَكَ مَالٌ اسْتَفَدْتَهُ فَلَيْسَ عَلَيْكَ زَكَاةٌ حَتَّى يَحُولَ عَلَيْهِ الْحَوْلُ
[Machine] There is no Zakat in wealth until a year passes on it. Abu Bakr al-Asbahani informed us about them, Abu Nasr al-Iraqi narrated, Sufyan ibn Muhammad narrated, Ali ibn al-Husayn narrated, and Abdullah ibn al-Walid narrated, Sufyan mentioned all of them.
لَيْسَ فِي مَالٍ مُسْتَفَادٍ زَكَاةٌ حَتَّى يَحُولُ عَلَيْهِ الْحَوْلُ أَخْبَرَنَا بِهِمَا أَبُو بَكْرٍ الْأَصْبَهَانِيُّ أَنْبَأَ أَبُو نَصْرٍ الْعِرَاقِيُّ ثنا سُفْيَانُ بْنُ مُحَمَّدٍ ثنا عَلِيُّ بْنُ الْحُسَيْنِ ثنا عَبْدُ اللهِ بْنُ الْوَلِيدِ ثنا سُفْيَانُ فَذَكَرَهُمَا جَمِيعًا
[Machine] Abu Bakr did not take zakat from his wealth until the year turned upon him.
لَمْ يَكُنْ أَبُو بَكْرٍ ؓ يَأْخُذُ مِنْ مَالٍ زَكَاةً حَتَّى يَحُولَ عَلَيْهِ الْحَوْلُ
"Whoever acquired wealth, then there is no Zakat on it until the Hawl has passed while it is in his possession." (Using translation from Tirmidhī 632)
مَنِ اسْتَفَادَ مَالًا فَلَا يُزَكِّيهِ حَتَّى يَحُولَ عَلَيْهِ الْحَوْلُ
[Machine] There is no obligation to pay Zakat on wealth until a full year has passed over it in the ownership of its owner.
لَا زَكَاةَ فِي مَالٍ حَتَّى يَحُولَ عَلَيْهِ الْحَوْلُ عِنْدَ رَبِّهِ
[Machine] He said: "If a man acquires wealth that has not yet reached the minimum threshold for zakat, he cannot give zakat until a year has passed since acquiring that wealth."
أَنَّهُ قَالَ إِذَا اسْتَفَادَ الرَّجُلُ مَالًا لَمْ تَحِلَّ فِيهِ الزَّكَاةُ حَتَّى يَحُولَ عَلَيْهِ الْحَوْلُ
[Machine] There is no zakat in wealth until a year passes over it. This is the correct (opinion), and it was narrated by Baqiyyah from Isma'il ibn 'Ayyash from 'Ubaydullah ibn 'Umar, (who said), "It is raised (i.e. a raised narration), and it is not sound."
لَيْسَ فِي مَالٍ زَكَاةٌ حَتَّى يَحُولَ عَلَيْهِ الْحَوْلُ هَذَا هُوَ الصَّحِيحُ مَوْقُوفٌ وَرَوَاهُ بَقِيَّةُ عَنْ إِسْمَاعِيلَ بْنِ عَيَّاشٍ عَنْ عُبَيْدِ اللهِ بْنِ عُمَرَ مَرْفُوعًا وَلَيْسَ بِصَحِيحٍ
[Machine] "The Messenger of Allah ﷺ said: There is no zakat in the wealth of the recipient until a year passes on it. Abu Bakr ibn al-Harith informed us, he narrated from Ali ibn Umar al-Hafiz, who narrated from al-Husayn ibn Ismail, who narrated from Abdullah ibn Shabib, who narrated from Yahya ibn Muhammad al-Jari, who narrated from Abdul Rahman ibn Zaid ibn Aslam, who mentioned it. And Abdul Rahman is weak, his narration cannot be relied upon."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَيْسَ فِي مَالِ الْمُسْتَفِيدِ زَكَاةٌ حَتَّى يَحُولَ عَلَيْهِ الْحَوْلُ أَخْبَرَنَاهُ أَبُو بَكْرِ بْنُ الْحَارِثِ أنبأ عَلِيُّ بْنُ عُمَرَ الْحَافِظُ ثنا الْحُسَيْنُ بْنُ إِسْمَاعِيلَ ثنا عَبْدُ اللهِ بْنُ شَبِيبٍ حَدَّثَنِي يَحْيَى بْنُ مُحَمَّدٍ الْجَارِيُّ ثنا عَبْدُ الرَّحْمَنِ بْنُ زَيْدِ بْنِ أَسْلَمَ فَذَكَرَهُ وَعَبْدُ الرَّحْمَنِ ضَعِيفٌ لَا يُحْتَجُّ بِهِ
10.23 [Machine] Mothers die and the aunts remain to be taken from
١٠۔٢٣ بَابُ الْأُمَّهَاتِ تَمُوتُ وَتَبْقَى السِّخَالُ نِصَابًا فَيُؤْخَذُ مِنْهَا
[Machine] When the Prophet ﷺ passed away and Abu Bakr succeeded him, those who had disbelieved among the Arabs apostatized. Umar said to Abu Bakr, "How can you fight the people when the Messenger of Allah ﷺ said, 'I have been ordered to fight the people until they say, 'There is no deity except Allah.' Whoever says, 'There is no deity except Allah,' has protected his wealth and life from me, except for his right and his account is with Allah." Abu Bakr said, "Indeed, I will fight anyone who separates prayer and zakat, for zakat is the right of wealth. By Allah, if they withhold from me even a rope that they used to give to the Messenger of Allah ﷺ, I will certainly fight them over it." Umar said, "By Allah, this is nothing but that I saw that Allah had opened the heart of Abu Bakr for fighting, so I knew that it was the truth."
لَمَّا تُوُفِّيَ رَسُولُ اللهِ ﷺ وَكَانَ أَبُو بَكْرٍ بَعْدَهُ وَكَفَرَ مَنْ كَفَرَ مِنَ الْعَرَبِ قَالَ عُمَرُ يَا أَبَا بَكْرٍ كَيْفَ تُقَاتِلُ النَّاسَ وَقَدْ قَالَ رَسُولُ اللهِ ﷺ أُمِرْتُ أَنْ أُقَاتِلَ النَّاسَ حَتَّى يَقُولُوا لَا إِلَهَ إِلَّا اللهُ فَمَنْ قَالَ لَا إِلَهَ إِلَّا اللهُ فَقَدْ عَصَمَ مِنِّي نَفْسَهُ وَمَالَهُ إِلَّا بِحَقِّهِ وَحِسَابُهُ عَلَى اللهِ قَالَ أَبُو بَكْرٍ ؓ لَأُقَاتِلَنَّ مَنْ فَرَّقَ بَيْنَ الصَّلَاةِ وَالزَّكَاةِ فَإِنَّ الزَّكَاةَ حَقُّ الْمَالِ وَاللهِ لَوْ مَنَعُونِي عَنَاقًا كَانُوا يُؤَدُّونَهَا إِلَى رَسُولِ اللهِ ﷺ لَقَاتَلْتُهُمْ عَلَى مَنْعِهَا قَالَ عُمَرُ فَوَاللهِ مَا هُوَ إِلَّا أَنْ رَأَيْتُ أَنْ قَدْ شَرَحَ اللهُ صَدْرَ أَبِي بَكْرٍ لِلْقِتَالِ فَعَرَفْتُ أَنَّهُ الْحَقُّ
10.24 [Machine] Do not conceal anything from the wealth of Zakat, nor shall you hoard
١٠۔٢٤ بَابُ لَا يَكْتُمُ شَيْئًا مِنْ مَالِ الزَّكَاةِ وَلَا يَغُلُّ
[Machine] Narrated Bashir ibn al-Khasasiyyah: The Prophet ﷺ called me Bashir. We went to him and said, "The people who give charity exceed us, so we hide what we give." He said, "No, but gather it and when they take it, order them to pray for you. Then recite the verse, 'And pray for them' (Quran 9:103) 7327." Abu Ali al-Rudhbary informed us that Abu Bakr ibn Dasah narrated to us from Abu Dawud from Hasan ibn Ali and Yahya ibn Musa. They said, "Abd al-Razzaq narrated to us from Ma'mar with the same meaning, except that he said, 'We said, O Messenger of Allah, the people who give charity...' ." And Hammad ibn Zaid did not attribute it to Anyone.
عَنْ بَشِيرِ بْنِ الْخَصَاصِيَةِ وَكَانَ النَّبِيُّ ﷺ قَدْ سَمَّاهُ بَشِيرًا قَالَ أَتَيْنَاهُ فَقُلْنَا إِنَّ أَصْحَابَ الصَّدَقَةِ يَعْتَدُونَ عَلَيْنَا فَنَكْتُمُهُمْ قَدْرَ مَا يَزِيدُونَ عَلَيْنَا قَالَ لَا وَلَكِنِ اجْمَعُوهَا فَإِذَا أَخَذُوهَا فَأْمُرُوهُمْ فَلْيُصَلُّوا عَلَيْكُمْ ثُمَّ تَلَا {وَصَلِّ عَلَيْهِمْ} [التوبة 103] 7327 وَأَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنبأ أَبُو بَكْرِ بْنُ دَاسَةَ ثنا أَبُو دَاوُدَ ثنا الْحَسَنُ بْنُ عَلِيٍّ وَيَحْيَى بْنُ مُوسَى قَالَا ثنا عَبْدُ الرَّزَّاقِ عَنْ مَعْمَرٍ بِإِسْنَادِهِ وَمَعْنَاهُ إِلَّا أَنَّهُ قَالَ قُلْنَا يَا رَسُولَ اللهِ إِنَّ أَصْحَابَ الصَّدَقَةِ وَرَوَاهُ حَمَّادُ بْنُ زَيْدٍ عَنْ أَيُّوبَ فَلَمْ يَرْفَعْهُ
10.25 [Machine] What has been mentioned about the one who conceals it?
١٠۔٢٥ بَابُ مَا وَرَدَ فِيمَنْ كَتَمَهُ
[Machine] I heard the Messenger of Allah ﷺ say regarding every forty lost female camels, if the one who finds them gives them to a herdsman, then he shall have his payment, but whoever conceals them, then we shall take them and take a portion of his camels as a penalty from the penalties of your Lord. It is not lawful for Muhammad or the family of Muhammad to do so.
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ فِي كُلِّ أَرْبَعِينَ مِنَ الْإِبِلِ السَّائِمَةِ ابْنَةُ لَبُونٍ مَنْ أَعْطَاهَا مُؤْتَجِرًا فَلَهُ أَجْرُهَا وَمَنْ كَتَمَهَا فَإِنَّا آخِذُوهَا وَشَطْرَ إِبِلِهِ عَزِيمَةً مِنْ عَزَمَاتِ رَبِّكَ لَا يَحِلُّ لِمُحَمَّدٍ وَلَا لِآلِ مُحَمَّدٍ كَذَلِكَ
10.26 [Machine] The Heading: Sadaqat al-Khulat
١٠۔٢٦ بَابُ صَدَقَةِ الْخُلَطَاءِ
[Machine] That Abu Bakr wrote this obligation of charity upon himself which the Messenger of Allah ﷺ obliged upon the Muslims. He mentioned the hadith in which it is mentioned that it should not be gathered between different things and should not be separated between things that are gathered, out of fear of charity and what comes from two mixtures. For indeed, they intermix with equality between them.
أَنَّ أَبَا بَكْرٍ ؓ كَتَبَ لَهُ هَذِهِ فَرِيضَةُ الصَّدَقَةِ الَّتِي فَرَضَ رَسُولُ اللهِ ﷺ عَلَى الْمُسْلِمِينَ فَذَكَرَ الْحَدِيثَ وَفِيهِ لَا يُجْمَعُ بَيْنَ مُتَفَرِّقٍ وَلَا يُفَرَّقُ بَيْنَ مُجْتَمِعٍ خَشْيَةَ الصَّدَقَةِ وَمَا كَانَ مِنْ خَلِيطَيْنِ فَإِنَّهُمَا يَتَرَاجَعَانِ بَيْنَهُمَا بِالسَّوِيَّةِ
[Machine] The Messenger of Allah wrote the book of charity but did not distribute it to his workers until he passed away. Then Abu Bakr used it until he passed away, then Umar used it until he passed away. The hadith mentioned in it is about the charity of camels and the charity of sheep. He said: "It should not be divided between a group, nor should it be combined between separate ones, fearing for the charity. And it should not be mixed between the two, for they compensate each other equally." And we narrated it in the hadith of Amr ibn Hazm.
كَتَبَ رَسُولُ اللهِ ﷺ كِتَابَ الصَّدَقَةِ فَلَمْ يُخْرِجْهُ إِلَى عُمَّالِهِ حَتَّى قُبِضَ فَقَرَنَهُ بِسَيْفِهِ فَعَمِلَ بِهِ أَبُو بَكْرٍ حَتَّى قُبِضَ ثُمَّ عَمِلَ بِهِ عُمَرُ حَتَّى قُبِضَ فَكَانَ فِيهِ فَذَكَرَ الْحَدِيثَ فِي صَدَقَةِ الْإِبِلِ وَصَدَقَةِ الْغَنَمِ وَقَالَ وَلَا يُفَرَّقُ بَيْنَ مُجْتَمِعٍ وَلَا يُجْمَعُ بَيْنَ مُتَفَرِّقٍ مَخَافَةَ الصَّدَقَةِ وَمَا كَانَ مِنْ خَلِيطَيْنِ فَإِنَّهُمَا يَتَرَاجَعَانِ بِالسَّوِيَّةِ وَرُوِّينَاهُ فِي حَدِيثِ عَمْرِو بْنِ حَزْمٍ
[Machine] From the Messenger of Allah ﷺ , he mentioned the hadith regarding zakat on paper, sheep, and camels, until he said: "If it exceeds ninety, then it has two rights, a pair of camels, up to one hundred and twenty. If there are more camels than that, then for every fifty, there is a right, and for every forty, another right, and it should not be separated among a group or combined between separated ones, for fear of falsehood in giving charity."
عَنْ رَسُولِ اللهِ ﷺ فَذَكَرَ الْحَدِيثَ فِي زَكَاةِ الْوَرِقِ وَالْغَنَمِ وَالْإِبِلِ إِلَى أَنْ قَالَ فَإِذَا زَادَتْ وَاحِدَةً يَعْنِي عَلَى التِّسْعِينَ فَفِيهَا حِقَّتَانِ طَرُوقَتَا الْجَمَلِ إِلَى عِشْرِينَ وَمِائَةٍ فَإِذَا كَانَتِ الْإِبِلُ أَكْثَرَ مِنْ ذَلِكَ فَفِي كُلِّ خَمْسِينَ حِقَّةٌ وَفِي كُلِّ أَرْبَعِينَ كَذَا وَلَا يُفَرَّقُ بَيْنَ مُجْتَمِعٍ وَلَا يُجْمَعُ بَيْنَ مُتَفَرِّقٍ خَشْيَةَ الصَّدَقَةِ
Suwaid bin Ghaflah reported The collector of the Prophet ﷺ came to us. I caught hold of his hand and read in the document that the goods were not to be combined nor were they to be separated for fear of zakat. There is no mention of milch animals in this tradition. أَتَانَا مُصَدِّقُ النَّبِيِّ ﷺ فَأَخَذْتُ بِيَدِهِ وَقَرَأْتُ فِي عَهْدِهِ قَالَ وَلَا يُجْمَعُ بَيْنَ مُتَفَرِّقٍ وَلَا يُفَرَّقُ بَيْنَ مُجْتَمِعٍ خَشْيَةَ الصَّدَقَةِ
[Machine] "Except for one narration, the Messenger of Allah ﷺ said, 'No distinction should be made between a gathering, nor should a separation be made between those who contribute in charity.' The two mixed together, just as they did with a stallion, a shepherd, and a watering hole."
عَنْ رَسُولِ اللهِ ﷺ إِلَّا حَدِيثًا وَاحِدًا يَقُولُ قَالَ رَسُولُ اللهِ ﷺ لَا يُفَرَّقُ بَيْنَ مُجْتَمِعٍ وَلَا يُجْمَعُ بَيْنَ مُتَفَرِّقٍ فِي الصَّدَقَةِ وَالْخَلِيطَانِ مَا اجْتَمَعَ عَلَى الْفَحْلِ وَالرَّاعِي وَالْحَوْضِ
[Machine] If the pasture is one, the shepherd is one, and the bucket is one.
إِذَا كَانَ الْمُرَاحُ وَاحِدًا وَالرَّاعِي وَاحِدًا وَالدَّلْوُ وَاحِدًا
فِيهَا شَاةٌ
[Machine] They have a sheep. I said, "If it belongs to one, it is thirty-nine, and if it belongs to another, it is one sheep."
عَلَيْهِمْ شَاةٌ قُلْتُ فَإِنْ كَانَتْ لِوَاحِدٍ تِسْعٌ وَثَلَاثُونَ وَلِآخَرَ شَاةٌ قَالَ عَلَيْهِمَا شَاةٌ
