10. Zakāh (Prescribed Charity)
١٠۔ كِتَابُ الزَّكَاةِ
[Machine] "From Mujahid in his statement: {Spend from the good things which you have earned} [Al-Baqarah 267]. He said, "Trade", {and from what We have produced for you from the earth} [Al-Baqarah 267]. He said, "Date palm."
عَنْ مُجَاهِدٍ فِي قَوْلِهِ تَعَالَى {أَنْفِقُوا مِنْ طَيِّبَاتِ مَا كَسَبْتُمْ} [البقرة 267] قَالَ التِّجَارَةُ {وَمِمَّا أَخْرَجْنَا لَكُمْ مِنَ الْأَرْضِ} [البقرة 267] قَالَ النَّخْلُ
The Messenger of Allah ﷺ used to order us to pay the sadaqah (zakat) on what we prepared for trade. (Using translation from Abū Dāʾūd 1562)
عَنْ سَمُرَةَ بْنِ جُنْدُبٍ أَمَّا بَعْدُ فَإِنَّ رَسُولَ اللهِ ﷺ كَانَ يَأْمُرُنَا أَنْ نُخْرِجَ الصَّدَقَةَ مِنَ الَّذِي نَعُدُّ لِلْبَيْعِ
[Machine] The Messenger of Allah ﷺ said: "Their charity is in camels, their charity is in sheep, and their charity is in cows."
قَالَ رَسُولُ اللهِ ﷺ فِي الْإِبِلِ صَدَقَتُهَا وَفِي الْغَنَمِ صَدَقَتُهَا وَفِي الْبَزِّ صَدَقَتُهُ
[Machine] The Prophet Muhammad ﷺ said: "In camels, their giving sadaqah (charity) is from their meat and milk. In sheep, their giving sadaqah is from their wool. And whoever accumulates dinars, dirhams, gold, or silver and does not count it for others nor spend it in the way of Allah, it will be a treasure he will be burnt with on the day of Judgment." The mention of cows is 7600 and it has been removed from this narration.
أَنَّ رَسُولَ اللهِ ﷺ قَالَ فِي الْإِبِلِ صَدَقَتُهَا وَفِي الْغَنَمِ صَدَقَتُهَا وَفِي الْبَزِّ صَدَقَتُهُ وَمَنْ رَفَعَ دَنَانِيرَ أَوْ دَرَاهِمَ أَوْ تِبْرًا أَوْ فِضَّةً لَا يَعُدُّهَا لِغَرِيمٍ وَلَا يُنْفِقُهَا فِي سَبِيلِ اللهِ فَهُوَ كَنْزٌ يُكْوَى بِهِ يَوْمَ الْقِيَامَةِ سَقَطَ مِنْ هَذِهِ الرِّوَايَةِ ذِكْرُ الْبَقَرِ 7600 وَقَدْ
[Machine] While I was sitting with Uthman, Abu Dharr came to him and mentioned a hadith. They said, "O Abu Dharr, tell us about the Messenger of Allah ﷺ." He said, "I heard the Messenger of Allah ﷺ saying, 'In camels, their truthfulness is in their humps, in sheep, their truthfulness is in their wool, in cows, their truthfulness is in their milk, and in goats, their truthfulness is in their saliva.' He said it with a ز."
بَيْنَا أَنَا جَالِسٌ عِنْدَ عُثْمَانَ جَاءَهُ أَبُو ذَرٍّ فَذَكَرَ الْحَدِيثَ قَالَ فَقَالُوا يَا أَبَا ذَرٍّ حَدِّثْنَا عَنْ رَسُولِ اللهِ ﷺ قَالَ سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ فِي الْإِبِلِ صَدَقَتُهَا وَفِي الْغَنَمِ صَدَقَتُهَا وَفِي الْبَقَرِ صَدَقَتُهَا وَفِي الْبَزِّ صَدَقَتُهُ قَالَهَا بِالزَّايِ
[Machine] Omar, don't you pay your Zakat, O Himaas? So I said, O Amir al-Mu'minin, I have nothing except what is on my back, and I am in debt. He said, "That is wealth, so pay it." I said, "So I placed it in front of him." He considered it and I found that Zakat was due on it, so he took the Zakat from it. The wording of the hadith is from Sufyan and the hadith of Ja'far ibn Awon is summarized. He said, Himaas used to sell clothes and blankets. Omar said to him, "Pay your Zakat." He said, "I only have blankets and clothes." He said, "Assess it and pay its Zakat: 7604." And Abu Zakaria and others informed us, Abu al-Abbas informed, al-Rabi' informed, al-Shafi'i informed, Sufyan informed, Ibn Ajlan narrated from Abu al-Zinad, from Abu Amr ibn Himaas, from his father, with a similar narration according to his first narration from Sufyan.
عُمَرُ أَلَا تُؤَدِّي زَكَاتَكَ يَا حِمَاسُ؟ فَقُلْتُ يَا أَمِيرَ الْمُؤْمِنِينَ مَا لِي غَيْرُ هَذِهِ الَّتِي عَلَى ظَهْرِي وَآهَبَةٌ فِي الْقَرَظِ فَقَالَ ذَاكَ مَالٌ فَضَعْ قَالَ فَوَضَعْتُهَا بَيْنَ يَدَيْهِ فَحَسَبَهَا فَوَجَدْتُ قَدْ وَجَبَتْ فِيهَا الزَّكَاةُ فَأَخَذَ مِنْهَا الزَّكَاةَ لَفْظُ حَدِيثِ سُفْيَانَ وَحَدِيثُ جَعْفَرِ بْنِ عَوْنٍ مُخْتَصَرٌ قَالَ كَانَ حِمَاسٌ يَبِيعُ الْأُدُمَ وَالْجِعَابَ فَقَالَ لَهُ عُمَرُ ؓ أَدِّ زَكَاةَ مَالِكَ فَقَالَ إِنَّمَا مَالِي جِعَابٌ وَآدَمٌ فَقَالَ قَوِّمْهُ وَأَدِّ زَكَاتَهُ 7604 وَأَخْبَرَنَا أَبُو زَكَرِيَّا وَغَيْرُهُ قَالُوا ثنا أَبُو الْعَبَّاسِ أنبأ الرَّبِيعُ أنبأ الشَّافِعِيُّ أنبأ سُفْيَانُ ثنا ابْنُ عَجْلَانَ عَنْ أَبِي الزِّنَادِ عَنْ أَبِي عَمْرِو بْنِ حِمَاسٍ عَنْ أَبِيهِ مِثْلَهُ قَالَهُ عَقِيبَ رِوَايَتِهِ الْأُولَى عَنْ سُفْيَانَ
[Machine] The meaning of his statement "If it is valid, there is no zakat on goods" means that if trade is not intended with it.
أَنْ يَكُونَ مَعْنَى قَوْلِهِ إِنْ صَحَّ لَا زَكَاةَ فِي الْعَرَضِ أَيْ إِذَا لَمْ يُرَدْ بِهِ التِّجَارَةُ
