10. Zakāh (Prescribed Charity)
١٠۔ كِتَابُ الزَّكَاةِ
[Machine] "About the Messenger of Allah ﷺ , it was narrated that he would fast when the sky was cloudy, and the wells were full. Or he would fast whenever it rained half of the month."
عَنْ رَسُولِ اللهِ ﷺ أنَّهُ سَنَّ فِيمَا سَقَتِ السَّمَاءُ وَالْعُيُونُ أَوْ كَانَ عَثَرِيًّا الْعُشْرَ وَفِيمَا سُقِيَ بِالنَّضْحِ نِصْفَ الْعُشْرِ
[Machine] He used to say that the zakat of fruits and crops is what comes from date palms, grapes, or crops of wheat, barley, or salted produce that was irrigated by a river, spring, or rainfall. In it, one-tenth is due from every ten (produce). And what is irrigated by drainage, one-half of one-tenth from every twenty (produce) is due. The Prophet ﷺ wrote to the people of Yemen, to al-Harith ibn 'Abd Kilal and those who are with him, from Ma'afir and Hamdan, regarding the believers' zakat of fruits or he said the 'Aqar is one-tenth of what the spring irrigates and what the sky waters, and half of one-tenth for what is irrigated by irrigation channels to the west. The sheikh said, "This is what I found connected to the hadith, and in his statement 'upon the believers,' it is like an indication that it is not taken from the people of the covenant. And Allah knows best."
أنَّهُ كَانَ يَقُولُ صَدَقَةُ الثِّمَارِ وَالزَّرْعِ مَا كَانَ مِنْ نَخْلٍ أَوْ عِنَبٍ أَوْ زَرْعٍ مِنْ حِنْطَةٍ أَوْ شَعِيرٍ أَوْ سُلْتٍ وَسُقِيَ بِنَهْرٍ أَوْ سُقِيَ بِالْعَيْنِ أَوْ عَثَرِيًّا يُسْقَى بِالْمَطَرِ فَفِيهِ الْعُشْرُ مِنْ كُلِّ عَشَرَةٍ وَاحِدٌ وَمَا كَانَ يُسْقَى بِالنَّضْحِ فَفِيهِ نِصْفُ الْعُشْرِ مِنْ كُلِّ عِشْرِينَ وَاحِدٌ وَكَتَبَ النَّبِيُّ ﷺ إِلَى أَهْلِ الْيَمَنِ إِلَى الْحَارِثِ بْنِ عَبْدِ كُلَالٍ وَمَنْ مَعَهُ مِنْ مَعَافِرَ وَهَمْدَانَ عَلَى الْمُؤْمِنِينَ فِي صَدَقَةِ الثِّمَارِ أَوْ قَالَ الْعَقَارُ عُشْرُ مَا تَسْقِي الْعَيْنُ وَمَا سَقَتِ السَّمَاءُ وَعَلَى مَا يُسْقَى بِالْغَرْبِ نِصْفُ الْعُشْرِ قَالَ الشَّيْخُ هَكَذَا وَجَدْتُهُ مَوْصُولًا بِالْحَدِيثِ وَفِي قَوْلِهِ عَلَى الْمُؤْمِنِينَ كَالدَّلَالَةِ عَلَى أَنَّهَا لَا تُؤْخَذُ مِنْ أَهْلِ الذِّمَّةِ وَاللهُ أَعْلَمُ
[Machine] "That the Messenger of Allah ﷺ said regarding what the rivers and clouds have watered, a tenth (of the reward) and regarding what has been watered by a bucket, half of the reward."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ فِيمَا سَقَتِ الْأَنْهَارُ وَالْغَيْمُ الْعُشْرُ وَفِيمَا سُقِيَ بِالسَّانِيَةِ نِصْفُ الْعُشْرِ
[Machine] That the Messenger of Allah ﷺ said regarding what the sky, eyes, and watered fields receive, one-tenth and regarding what is watered by natural irrigation, one-half of one-tenth.
أَنَّ رَسُولَ اللهِ ﷺ قَالَ فِيمَا سَقَتِ السَّمَاءُ وَالْعُيُونُ وَالْبَعْلُ الْعُشْرُ وَفِيمَا سُقِيَ بِالنَّضْحِ نِصْفُ الْعُشْرِ
[Machine] The Messenger of Allah ﷺ said: "When the sky has rained a tenth, and it has been watered by natural springs, it is half of a tenth." Asim reported to us from Malik who said: I was informed by Sulaiman ibn Yasar and Busr ibn Sa'id, and Ibn Abi Dhubab left out mentioning the objectionable aspects in his narration. The scholar said: This hadith is sufficient without the narration of Ibn Abi Dhubab, as we have narrated it with two authentic chains from Ibn Umar, from the Prophet ﷺ , and with an authentic chain from Jabir, from the Prophet ﷺ , and this is the saying of the majority. They did not differ regarding it. And the hadith of Amr ibn Hazm, its mention has already passed.
أَنَّ رَسُولَ اللهِ ﷺ قَالَ فِيمَا سَقَتِ السَّمَاءُ الْعُشْرُ وَفِيمَا سُقِيَ بِالنَّضْحِ نِصْفُ الْعُشْرِ قَالَ عَاصِمٌ حَدَّثَنَا مَالِكٌ قَالَ خُبِّرْتُ عَنْ سُلَيْمَانَ بْنِ يَسَارٍ وَبُسْرِ بْنِ سَعِيدٍ وَتَرَكَ ابْنَ أَبِي ذُبَابٍ لِلْمُنْكَرَاتِ الَّتِي فِي رِوَايَتِهِ قَالَ الشَّيْخُ هَذَا الْحَدِيثُ مُسْتَغْنٍ عَنْ رِوَايَةِ ابْنِ أَبِي ذُبَابٍ فَقَدْ رُوِّينَاهُ بِإِسْنَادَيْنِ صَحِيحَيْنِ عَنِ ابْنِ عُمَرَ عَنِ النَّبِيِّ ﷺ وَبِإِسْنَادٍ صَحِيحٍ عَنْ جَابِرٍ عَنِ النَّبِيِّ ﷺ وَهُوَ قَوْلُ الْعَامَّةِ لَمْ يَخْتَلِفُوا فِيهِ وَحَدِيثُ عَمْرِو بْنِ حَزْمٍ قَدْ مَضَى ذِكْرُهُ
"The Messenger of Allah sent me to Yemen and he commanded me to take one-tenth of whatever is irrigated by the sky, and half of one-tenth of whatever is irrigated by means of buckets." (Using translation from Nasāʾī 2490)
بَعَثَنِي رَسُولُ اللهِ ﷺ إِلَى الْيَمَنِ وَأَمَرَنِي أَنْ آخُذَ مِمَّا سَقَتِ السَّمَاءُ وَمَا سُقِيَ بَعْلًا الْعُشْرُ وَمَا سُقِيَ بِالدَّوَالِي نِصْفُ الْعُشْرِ
[Machine] As for what the sky provided and what was watered, it opened up tenfold and was not watered by a bucket, but by half of the ten.
فِيمَا سَقَتِ السَّمَاءُ وَمَا سُقِيَ فَتْحًا الْعُشْرُ وَمَا سُقِيَ دَلْوًا فَنِصْفُ الْعُشْرِ
[Machine] What the sky has watered is one out of every ten, and what has been watered in the west is one out of every twenty.
مَا سَقَتِ السَّمَاءُ فَمِنْ كُلِّ عَشَرَةٍ وَاحِدٌ وَمَا سُقِيَ بِالْغَرْبِ فَمَنْ كُلِّ عِشْرِينَ وَاحِدٌ
[Machine] The Messenger of Allah ﷺ mandated that a tenth of the produce be given in cases of rainwater, river water, and well water, but only a fifth of the produce is to be given in cases of water from springs. Hatim said: "Ghayl is what is watered in abundance, and Ba'l is the fertility that is watered by rainwater." Yahya bin Adam asked Aba Iyas (meaning Asadi), who said: "Ba'l, Athari, and 'Adhi are what are watered by rainwater." Yahya said: "'Adhi is what is specially grown for rainclouds and is only watered by rainwater. That is 'Adhi, and Ba'l is what comes from vineyards whose roots have reached the water in the ground, so it does not need to be watered for five years, and it can tolerate not being watered for six years. This is Ba'l. The Sayl is the water of the valley when it flows, and as for Ghayl, it is a flood without excessive water flow. When there is little water flow with pure water, it is Ghayl, and 'Adhi is the water of rain."
فَرَضَ رَسُولُ اللهِ ﷺ فِيمَا سَقَتِ السَّمَاءُ أَوْ سُقِيَ بِالسَّيْلِ وَالْغَيْلِ وَالْبَعْلِ الْعُشْرُ وَمَا سُقِيَ بِالنَّوَاضِحِ فَنِصْفُ الْعُشْرِ قَالَ حَاتِمٌ الْغَيْلُ مَا سُقِيَ فَتْحًا وَالْبَعْلُ هُوَ الْعَذْيُ الَّذِي يَسْقِيَهِ مَاءُ الْمَطَرِ قَالَ يَحْيَى بْنُ آدَمَ وَسَأَلْتُ أَبَا إِيَاسٍ يَعْنِي الْأَسَدِيَّ فَقَالَ الْبَعْلُ وَالْعَثَرِيُّ وَالْعَذْيُ هُوَ الَّذِي يُسْقَى بِمَاءِ السَّمَاءِ قَالَ يَحْيَى الْعَثَرِيُّ مَا يُزْرَعُ لِلْسَحَابِ لِلْمَطَرِ خَاصَّةً لَيْسَ يُسْقَى إِلَّا بِمَاءٍ يُصِيبُهُ مِنَ الْمَطَرِ فَذَلِكَ الْعَثَرِيُّ وَالْبَعْلُ مَا كَانَ مِنَ الْكُرُومِ قَدْ ذَهَبَتْ عُرُوقُهُ فِي الْأَرْضِ إِلَى الْمَاءِ فَلَا يَحْتَاجُ إِلَى السَّقْيِ الْخَمْسَ السِّنِينَ وَالسِّتَّ يَحْتَمِلُ تَرْكَ السَّقْيِ فَهَذَا الْبَعْلُ وَالسَّيْلُ مَاءُ الْوَادِي إِذَا سَالَ وَأَمَّا الْغَيْلُ فَهُوَ سَيْلٌ دُونَ السَّيْلِ الْكَثِيرِ إِذَا سَالَ الْقَلِيلُ بِالْمَاءِ الصَّافِي فَهُوَ الْغَيْلُ وَالْعَذْيُ مَاءُ الْمَطَرِ
[Machine] The passage says: "Do the Zakah (charity) go on the land that is watered by rainfall or the land that is watered by irrigation, or do they go on both? He said: The Zakah goes on the one that is watered more. Yahya bin Adam said: It is specified by the portion."
عَنِ الْأَرْضِ تُسْقَى بِالسَّيْحِ ثُمَّ تُسْقَى بِالدَّوَالِي أَوْ تُسْقَى بِالدَّوَالِي ثُمَّ بِالسَّيْحِ عَلَى أَيِّهِمَا تُؤْخَذُ الزَّكَاةُ؟ قَالَ عَلَى أَكْثَرِهِمَا تُسْقَى بِهِ قَالَ يَحْيَى بْنُ آدَمَ تُزَكَّى بِالْحِصَّةِ
[Machine] He used to bring food from his land and give his charity, then he would hoard it for a year or two without purifying it, and he intended to sell it. Abu Al-Rabi'i said, "Then I heard it from Ibn Al-Mubarak's son."
أنَّهُ كَانَ يُخْرِجُ لَهُ الطَّعَامَ مِنْ أَرْضِهِ فَيُعْطِي صَدَقَتَهُ ثُمَّ يَحْبِسُهُ السَّنَةَ أَوِ السَّنَتَيْنِ وَلَا يُزَكِّيهِ وَهُوَ يُرِيدُ بَيْعَهُ قَالَ أَبُو الرَّبِيعِ ثُمَّ سَمِعْتُهُ أَنَا بَعْدُ مِنَ ابْنِ الْمُبَارَكِ
