10. Zakāh (Prescribed Charity)
١٠۔ كِتَابُ الزَّكَاةِ
[Machine] On the authority of my two messengers, who are messengers of Allah ﷺ , they said about the sheep that he gave them: "There is a pregnant ewe that the Messenger of Allah ﷺ prohibited us from taking a share from, as well as the share of the ewe's fetus." I asked them, "What can I take from you then?" They replied, "You can take a female lamb or a male lamb." So, I brought them a female lamb, and they said, "Bring it to us." They took it, and they carried it on their camel, which numbered 7300. Abu Al-Hasan Ibn Abdan informed us, Ahmed Ibn Ubaid Al-Saffar told us, Al-Harith Ibn Abi Usamah narrated to us, Rawh Ibn Ubada narrated to us, Zakariah Ibn Ishaq narrated to us, Amr Ibn Abi Sufyan narrated to me, and Muslim Ibn Shu'bah mentioned it except that our sheikh (teacher) did not confirm the name of Sa'ar Ibn Daisam.
عَنْ رَسُولَيْ رَسُولِ اللهِ ﷺ أَنَّهُمَا قَالَا فِي الشَّاةِ الَّتِي أَعْطَاهُمَا هَذِهِ شَافِعٌ وَقَدْ نَهَانَا رَسُولُ اللهِ ﷺ أَنْ نَأْخُذَ شَافِعًا وَالشَّافِعُ الَّتِي فِي بَطْنِهَا وَلَدُهَا قَالَ فَقُلْتُ أِيَّ شَيْءٍ تَأْخُذَانِ؟ قَالَا عَنَاقًا جَذَعَةً أَوْ ثَنِيَّةً قَالَ فَأَخْرَجْتُ إِلَيْهِمَا عَنَاقًا قَالَا ارْفَعْهَا إِلَيْنَا فَتَنَاوَلَاهَا فَحَمَلَاهَا عَلَى بَعِيرِهِمَا 7300 أَخْبَرَنَا أَبُو الْحَسَنِ بْنُ عَبْدَانَ أنبأ أَحْمَدُ بْنُ عُبَيْدٍ الصَّفَّارُ ثنا الْحَارِثُ بْنُ أَبِي أُسَامَةَ ثنا رَوْحُ بْنُ عُبَادَةَ ثنا زَكَرِيَّا بْنُ إِسْحَاقَ ثنا عَمْرُو بْنُ أَبِي سُفْيَانَ حَدَّثَنِي مُسْلِمُ بْنُ شُعْبَةَ فَذَكَرَهُ إِلَّا أَنَّ شَيْخَنَا لَمْ يُثْبِتِ اسْمَ سَعْرِ بْنِ دَيْسَمٍ
[Machine] He (the Prophet) knows that they claim that we oppress them, taking their food but not giving them any in return. So, Umar said to him, "Make sure to give them food, even if it is from the leftovers that the shepherd eats with his hands. And tell them, I will not take from you the young offspring, the prematurely born, the self-inflicted, the eaten sheep, or the male sheep. Instead, I will take the healthy and mature lambs. This is fair and just in terms of the portions of wealth and its best choices."
لَهُ اعْلَمْ أَنَّهُمْ يَزْعُمُونَ أَنَّا نَظْلِمُهُمْ نَعْتَدُّ عَلَيْهِمْ بِالْغِذَاءِ وَلَا نَأْخُذُهُ مِنْهُمْ فَقَالَ لَهُ عُمَرُ فَاعْتَدَّ عَلَيْهِمْ بِالْغِذَاءِ حَتَّى بِالسَّخْلَةِ يَرُوُحُ بِهَا الرَّاعِي عَلَى يَدِهِ وَقُلْ لَهُمْ لَا آخُذُ مِنْكُمُ الرُّبَّى وَلَا الْمَاخِضَ وَلَا ذَاتَ الدَّرِّ وَلَا الشَّاةَ الْأَكُولَةَ وَلَا فَحْلَ الْغَنَمِ وَخُذِ الْعَنَاقَ الْجَذَعَةَ وَالثَّنِيَّةَ فَذَلِكَ عَدْلٌ بَيْنَ غِذَاءِ الْمَالِ وَخِيَارِهِ
[Machine] Umar ibn al-Khattab, yes, we count them with the sakhla that the shepherd carries, and we do not take it, nor do we take the nourishment, the nanny, the levantine (a breed of sheep), nor the stallion of the sheep, and we take the branch and the dry graze, and that is fair between the nourishment of wealth and its options.
عُمَرُ بْنُ الْخَطَّابِ نَعَمْ نَعُدُّ عَلَيْهِمْ بِالسَّخْلَةِ يَحْمِلُهَا الرَّاعِي وَلَا نَأْخُذُهَا وَلَا نَأْخُذُ الْأَكُولَةَ وَلَا الرُّبَّى وَلَا الْمَاخِضَ وَلَا فَحْلَ الْغَنَمِ وَنَأْخُذُ الْجَذَعَةَ وَالثَّنِيَّةَ وَذَلِكَ عَدْلٌ بَيْنَ غِذَاءِ الْمَالِ وَخِيَارِهِ
