10. Zakāh (Prescribed Charity)
١٠۔ كِتَابُ الزَّكَاةِ
[Machine] Abu Ubaid said about the saying of Ali regarding a person who has doubtful debt: "He is acquitted of what has passed, if he pays it back when he takes possession of it, if he is truthful." Yazeed bin Haroun narrated to us, from Hisham, from Ibn Sireen, from Ubaidah, from Ali. Abu Ubaid also said, "His saying 'adhanun' refers to the one whose owner does not know whether he will settle the debt or not, as if he is the one whom he does not expect [to settle the debt]."
قَالَ أَبُو عُبَيْدٍ فِي حَدِيثِ عَلِيٍّ فِي الرَّجُلِ يَكُونُ لَهُ الدَّيْنُ الظَّنُونُ قَالَ يُزَكِّيهِ لِمَا مَضَى إِذَا قَبَضَهُ إِنْ كَانَ صَادِقًا حَدَّثَنَاهُ يَزِيدُ بْنُ هَارُونَ عَنْ هِشَامٍ عَنِ ابْنِ سِيرِينَ عَنْ عُبَيْدَةَ عَنْ عَلِيٍّ ؓ وَقَالَ أَبُو عُبَيْدٍ قَوْلُهُ الظَّنُونُ هُوَ الَّذِي لَا يَدْرِي صَاحِبُهُ أَيَقْضِيهِ الَّذِي عَلَيْهِ الدَّيْنُ أَمْ لَا كَأَنَّهُ الَّذِي لَا يَرْجُوهُ
[Machine] "Pay the Zakat amount on what is in your possession and what is owed to you as a trustworthy debt. It is equivalent to what is in your possession and what is owed to you as a doubtful debt. Therefore, there is no Zakat on it until it is received."
زَكُّوا مَا كَانَ فِي أَيْدِيكُمْ وَمَا كَانَ مِنْ دَيْنٍ فِي ثِقَةٍ فَهُوَ بِمَنْزِلَةِ مَا فِي أَيْدِيكُمْ وَمَا كَانَ مِنْ دَيْنٍ ظَنُونٍ فَلَا زَكَاةَ فِيهِ حَتَّى يَقْبِضَهُ
[Machine] "That when people have received their entitlements, the wealthy detain their debts and whatever remains in their hands. Their Zakat is taken out before they even collect it, then the people are burdened with debts that are only destroyed. And they do not take from the debt except what is given willingly. But when they collect the debt, they turn away from it due to what has passed from it."
أَنَّ النَّاسَ إِذَا خَرَجَتِ الْأَعْطِيَةُ حَبَسَ لَهُمُ الْعُرَفَاءُ دُيُونَهُمْ وَمَا بَقِيَ فِي أَيْدِيهِمْ أُخْرِجَتْ زَكَاتُهُمْ قَبْلَ أَنْ يَقْبِضُوا ثُمَّ دَايَنَ النَّاسُ بَعْدَ ذَلِكَ دُيُونًا هَالِكَةً فَلَمْ يَكُونُوا يَقْبِضُونَ مِنَ الدَّيْنِ الصَّدَقَةَ إِلَّا مَا نَضَّ مِنْهُ وَلَكِنَّهُمْ كَانُوا إِذَا قَبَضُوا الدَّيْنَ أَخْرَجُوا عَنْهَا لِمَا مَضَى مِنْهَا
[Machine] That only one Zakah should be taken from it, as it was a taking in the form of charity. Then Abu 'Ubaid said, meaning the absent one who is not expected to return.
أَنْ لَا تُؤْخَذَ مِنْهُ إِلَّا زَكَاةٌ وَاحِدَةٌ فَإِنَّهُ كَانَ ضِمَارًا ثُمَّ قَالَ أَبُو عُبَيْدٍ يَعْنِي الْغَائِبَ الَّذِي لَا يُرْجَى
