10. Zakāh (Prescribed Charity)
١٠۔ كِتَابُ الزَّكَاةِ
[Machine] The Prophet ﷺ used to say to the doorman, "Do not turn away the needy."
أَنَّ النَّبِيَّ ﷺ كَانَ يَقُولُ لِلْخَرْصِ لَا تَخْرُصُوا الْعَرَايَا
[Machine] Allah ﷺ did not joke with the naked, nor did Abu Bakr or Umar. The Sheikh said that they are both messengers and there is a connected narration about it.
اللهِ ﷺ لَمْ يَكُنْ يَخْرُصُ الْعَرَايَا وَلَا أَبُو بَكْرٍ وَلَا عُمَرُ ؓ قَالَ الشَّيْخُ وَهُمَا مُرْسَلَانِ وَقَدْ رُوِيَ فِيهِ حَدِيثٌ مَوْصُولٌ
Sahl ibn Abu Hathmah came to our gathering. He said: The Messenger of Allah ﷺ commanding us said: When you estimate take them leaving a third, and if you do not leave or find a third, leave a quarter. (Using translation from Abū Dāʾūd 1605)
أَمَرَنَا رَسُولُ اللهِ ﷺ قَالَ إِذَا خَرَصْتُمْ فَخُذُوا وَدَعُوا الثُّلُثَ فَإِنْ لَمْ تَدَعُوا الثُّلُثَ فَدَعُوا الرُّبُعَ
[Machine] The Messenger of Allah ﷺ used it on the Kharṣ. He said, "Stabilize half for us and leave half for them, for they steal and it does not reach them." Muḥammad said, "I narrated this hadith to ʿUbaid Allah ibn ʿUmar, and he said, 'It has been established with us that the Prophet ﷺ said, "Stabilize two-thirds for us and leave one-third for them." The scholar said, 'This is an unknown chain of narration, and it has been narrated in it from ʿUmar ibn al-Khaṭṭāb.'"
أَنَّ رَسُولَ اللهِ ﷺ اسْتَعْمَلَهُ عَلَى الْخَرْصِ فَقَالَ اثْبِتْ لَنَا النِّصْفَ وَأَبْقِ لَهُمُ النِّصْفَ فَإِنَّهُمْ يَسْرِقُونَ وَلَا يَصِلُ إِلَيْهِمْ قَالَ مُحَمَّدٌ فَحَدَّثْتُ بِهَذَا الْحَدِيثِ عُبَيْدَ اللهِ بْنَ عُمَرَ فَقَالَ قَدْ ثَبَتَ عِنْدَنَا أَنَّ النَّبِيَّ ﷺ قَالَ اثْبِتْ لَنَا الثُّلُثَيْنِ وَأَبْقِ لَهُمُ الثُّلُثَ قَالَ الشَّيْخُ هَذَا إِسْنَادٌ مَجْهُوَلٌ وَقَدْ رُوِيَ فِيهِ عَنْ عُمَرَ بْنِ الْخَطَّابِ ؓ
[Machine] mentioned al-Shafi'i in the past about a man who mentioned it as for them to leave what they eat and not to complain.
أَنْ يَدَعَ لَهُمْ مَا يَأْكُلُونَهُ فَلَا يَخْرُصُهُ وَقَدْ ذَكَرَهُ الشَّافِعِيُّ فِي الْقَدْيمِ عَنْ رَجُلٍ عَنْ يَحْيَى بْنِ سَعِيدٍ وَقَدْ
[Machine] "And he said, when you come to a land, cultivate it and leave for it as much as they eat. And it has been mentioned by Al-Awza'i, from Umar ibn Al-Khattab, narrating it."
وَقَالَ إِذَا أَتَيْتَ أَرْضًا فَاخْرُصْهَا وَدَعْ لَهَا قَدْرَ مَا يَأْكُلُونَ وَقَدْ ذَكَرَهُ الْأَوْزَاعِيُّ عَنْ عُمَرَ بْنِ الْخَطَّابِ ؓ مُرْسَلًا
[Machine] Reduce the burden on people in harvesting, as it contains dates, dried dates, and food. Al-Walid said, I asked Abu Amr, what are the 'arriyah? He said, it is the palm tree, two palm trees, and three palm trees that a person gives to another person in need. I asked, what is the food? He said, the wealthy people eat it as dates, so that is not counted as 'arriyah and is not deducted from it. I asked, what is the watiyyah? He said, it is the one who covers them and visits them. خَفِّفُوا عَلَى النَّاسِ فِي الْخَرْصِ فَإِنَّ فِيهِ الْعَرِيَّةَ وَالْوَطِيَّةَ وَالْأَكَلَةَ قَالَ الْوَلِيدُ قُلْتُ لِأَبِي عَمْرٍو وَمَا الْعَرِيَّةُ؟ قَالَ النَّخْلَةُ وَالنَّخْلَتَانِ وَالثَّلَاثُ يَمْنَحُهَا الرَّجُلُ الرَّجُلَ مِنْ أَهْلِ الْحَاجَةِ قُلْتُ فَمَا الْأَكَلَةُ؟ قَالَ أَهْلُ الْمَالِ يَأْكُلُونَ مِنْهُ رُطَبًا فَلَا يُخْرَصُ ذَلِكَ وَيُوضَعُ مِنْ خَرْصِهِ قَالَ قُلْتُ فَمَا الْوَطِيَّةُ؟ قَالَ مَنْ يَغْشَاهُمْ وَيَزُورُهُمْ قَالَ الشَّيْخُ وَهَذَا اللَّفْظُ الَّذِي
[Machine] The Prophet ﷺ said, "Take precaution for the people of wealth in al-Watiyya, al-Amila, and al-Nawa'ib, and what is obligatory in dates for giving the due right. And Abu Sa'd al-Malini informed us that Abu Ahmad ibn 'Adi narrated to us from Shura'ih ibn 'Aqil from Abu Marwan al-Uthmani from 'Abdul Aziz ibn Abi Hazim from Haram ibn 'Uthman from 'Abdul Rahman and Muhammad, the sons of Jabir, from their father that he mentioned it as a marfu' narration. And it has been narrated from the Prophet ﷺ in a mursal hadith, which is not found in Al-'Ara'ia, "sadaqah".
أَنَّ النَّبِيَّ ﷺ قَالَ احْتَاطُوا لِأَهْلِ الْأَمْوَالِ فِي الْوَاطِيَّةِ وَالْعَامِلَةِ وَالنَّوَائِبِ وَمَا وَجَبَ فِي التَّمْرِ مِنَ الْحَقِّ 7449 وَأَخْبَرَنَا أَبُو سَعْدٍ الْمَالِينِيُّ أنبأ أَبُو أَحْمَدَ بْنُ عَدِيٍّ ثنا شُرَيْحُ بْنُ عَقِيلٍ ثنا أَبُو مَرْوَانَ الْعُثْمَانِيُّ ثنا عَبْدُ الْعَزِيزِ بْنُ أَبِي حَازِمٍ عَنْ حَرَامِ بْنِ عُثْمَانَ عَنْ عَبْدِ الرَّحْمَنِ وَمُحَمَّدٍ ابْنَيْ جَابِرٍ عَنْ أَبِيهِمَا فَذَكَرَهُ مَرْفُوعًا وَقَدْ رُوِيَ عَنِ النَّبِيِّ ﷺ فِي حَدِيثٍ مُرْسَلٍ لَيْسَ فِي الْعَرَايَا صَدَقَةٌ
[Machine] I heard the Prophet, ﷺ , saying and the Prophet, ﷺ , gestured with his hand with five fingers, "There is no less than five awq (a unit of measure) that is considered charity, and there is no less than five awsuq (another unit of measure) that is considered charity, and there is no less than five dawd (another unit of measure) that is considered charity." Muhammad ibn Yahya ibn Habban narrated this Hadith, and he said that Sheikh Muhammad ibn Yahya ibn Habban narrated the Hadith of awq, awsuq, and dawd from Yahya ibn Umarah, from Abu Sa'id. It is possible that this additional information is included in the Hadith. And Allah knows best.
سَمِعْتُ النَّبِيَّ ﷺ يَقُولُ وَأَشَارَ النَّبِيُّ ﷺ بِكَفِّهِ بِخَمْسِ أَصَابِعَ لَيْسَ فِيمَا دُونَ خَمْسِ أَوَاقٍ صَدَقَةٌ وَلَيْسَ فِيمَا دُونَ خَمْسَةِ أَوْسُقٍ صَدَقَةٌ وَلَيْسَ فِيمَا دُونَ خَمْسِ ذَوْدٍ صَدَقَةٌ وَزَادَ عَنِ النَّبِيِّ ﷺ فِي هَذَا الْحَدِيثِ وَلَيْسَ فِي الْعَرَايَا صَدَقَةٌ عَنْ مُحَمَّدِ بْنِ يَحْيَى بْنِ حَبَّانَ قَالَ الشَّيْخُ مُحَمَّدُ بْنُ يَحْيَى بْنِ حَبَّانَ يَرْوِي حَدِيثَ الْأَوَاقِ وَالْأَوْسَاقِ وَالْأَذْوَادِ عَنْ يَحْيَى بْنِ عُمَارَةَ عَنْ أَبِي سَعِيدٍ فَيُحْتَمَلُ أَنْ تَكُونَ هَذِهِ الزِّيَادَةُ مَعَهَا فِي الْحَدِيثِ وَاللهُ أَعْلَمُ
