10. Zakāh (Prescribed Charity)
١٠۔ كِتَابُ الزَّكَاةِ
[Machine] The Prophet ﷺ said that silk and gold are forbidden for the males of my community but permissible for their females. This has been narrated to us in the hadith of Ali ibn Abi Talib, Uqbah ibn Amir, and Abdullah ibn Amr from the Prophet ﷺ .
قَالَ النَّبِيُّ ﷺ الْحَرِيرُ وَالذَّهَبُ حَرَامٌ عَلَى ذُكُورِ أُمَّتِي حِلٌّ لِإِنَاثِهِمْ وَقَدْ رُوِّينَاهُ مِنْ حَدِيثِ عَلِيِّ بْنِ أَبِي طَالِبٍ وَعُقْبَةَ بْنِ عَامِرٍ وَعَبْدِ اللهِ بْنِ عَمْرٍو عَنِ النَّبِيِّ ﷺ
The Prophet ﷺ got some ornaments presented by Negus as a gift to him. They contained a gold ring with an Abyssinian stone. The Messenger of Allah ﷺ turning his attention from it took it by means of a stick or his finger, then called Umamah, daughter of Abul'As and daughter of his daughter Zaynab, and said: Wear it, my dear daughter. (Using translation from Abū Dāʾūd 4235)
قَدِمَتْ عَلَى النَّبِيِّ ﷺ حِلْيَةٌ مِنْ عِنْدِ النَّجَاشِيِّ أَهْدَاهَا لَهُ فِيهَا خَاتَمٌ مِنْ ذَهَبٍ فِيهِ فَصٌّ حَبَشِيٌّ قَالَتْ فَأَخَذَهُ رَسُولُ اللهِ ﷺ بِعُودٍ مُعْرِضًا عَنْهُ أَوْ بِبَعْضِ أَصَابِعِهِ ثُمَّ دَعَا أُمَامَةَ بِنْتَ أَبِي الْعَاصِ بِنْتِ ابْنَتِهِ زَيْنَبَ فَقَالَ تَحَلَّيْ هَذَا يَا بُنَيَّةِ
[Machine] That the Messenger of Allah ﷺ adorned her mother and her aunt, and their father was Abu Umamah As'ad bin Zurarah. He entrusted them to the Messenger of Allah ﷺ , so he adorned them with a necklace made of gold and pearls. Zainab said, "I already possessed some of the jewelry or parts of it."
أَنَّ رَسُولَ اللهِ ﷺ حَلَّى أُمَّهَا وَخَالَتَهَا وَكَانَ أَبُوهُمَا أَبُو أُمَامَةَ أَسْعَدُ بْنُ زُرَارَةَ أَوْصَى بِهِمَا إِلَى رَسُولِ اللهِ ﷺ فَحَلَّاهُمَا رِعَاثًا مِنْ تِبْرٍ ذَهَبٍ فِيهِ لُؤْلُؤٌ قَالَتْ زَيْنَبُ وَقَدْ أَدْرَكْتُ الْحُلِيَّ أَوْ بَعْضَهُ
[Machine] I was in the company of the Prophet ﷺ along with my two sisters, and the Messenger of Allah ﷺ would adorn us with gold and pearls. The narration of Muhammad ibn Abi Bakr states that the Prophet ﷺ would adorn us. According to the narration of Abu 'Ubaid, Ibn Ja'far said: "He would adorn us with golden bracelets and pearls," and Safwan said: "He would adorn us with silver and pearls." Abu 'Ubaid said: Abu 'Amr, the narrator of this hadith, said that the word "Ra'athah" refers to earrings. These narrations and the evidence mentioned in them indicate the permissibility of adorning women with gold. We also deduced its permissibility for them from the consensus on the permissibility, as there is no clear prohibition related to them. And Allah knows best.
كُنْتُ فِي حِجْرِ النَّبِيِّ ﷺ أَنَا وَأُخْتَايَ فَكَانَ رَسُولُ اللهِ ﷺ يُحَلِّينَا الذَّهَبَ وَاللُّؤْلُؤَ لَفْظُ حَدِيثِ مُحَمَّدِ بْنِ أَبِي بَكْرٍ وَفِي رِوَايَةِ أَبِي عُبَيْدٍ فَكَانَ يُحَلِّينَا قَالَ ابْنُ جَعْفَرٍ رِعَاثًا مِنْ ذَهَبٍ وَلُؤْلُؤٍ وَقَالَ صَفْوَانُ يُحَلِّينَا التِّبْرَ وَاللُّؤْلُؤَ قَالَ أَبُو عُبَيْدٍ قَالَ أَبُو عَمْرٍو وَاحِدُ الرِّعَاثِ رَعَثَةٌ وَرَعْثَةٌ وَهُوَ الْقُرْطُ فَهَذِهِ الْأَخْبَارُ وَمَا وَرَدَ فِي مَعْنَاهَا تَدُلُّ عَلَى إِبَاحَةِ التَّحَلِّي بِالذَّهَبِ لِلنِّسَاءِ وَاسْتَدْلَلْنَا بِحُصُولِ الْإِجْمَاعِ عَلَى إِبَاحَتِهِ لَهُنَّ عَلَى نَسْخِ الْأَخْبَارِ الدَّالَّةِ عَلَى تَحْرِيمِهِ فِيهِنَّ خَاصَّةً وَاللهُ أَعْلَمُ
