10. Zakāh (Prescribed Charity)
١٠۔ كِتَابُ الزَّكَاةِ
[Machine] That the Messenger of Allah ﷺ prescribed the Zakat al-Fitr to be a sa' of dates or a sa' of barley for every free Muslim, male or female, young or old.
أَنَّ رَسُولَ اللهِ ﷺ فَرَضَ زَكَاةَ الْفِطْرِ صَاعًا مِنْ تَمْرٍ وَصَاعًا مِنْ شَعِيرٍ عَلَى كُلِّ حُرٍّ وَعَبْدٍ صَغِيرٍ أَوْ كَبِيرٍ
[Machine] "The Messenger of Allah ﷺ commanded us to give it (the zakat) before the zakat was revealed. But when the zakat was revealed, he did not command us nor forbid us, and we continued to practice it. The scholar said, 'This does not indicate the nullification of its obligation, because the revelation of one obligation does not necessitate the nullification of another.' And the scholars have unanimously agreed on the obligation of Zakat al-Fitr, although they have differed in its naming as an obligation. Therefore, it is not permissible to abandon it. And with Allah is the guidance."
أَمَرَنَا بِهَا رَسُولُ اللهِ ﷺ قَبْلَ أَنْ تَنْزِلَ الزَّكَاةُ فَلَمَّا نَزَلَتِ الزَّكَاةُ لَمْ يَأْمُرْنَا وَلَمْ يَنْهَنَا وَنَحْنُ نَفْعَلُهُ قَالَ الشَّيْخُ وَهَذَا لَا يَدُلُّ عَلَى سُقُوطِ فَرْضِهَا؛ لِأَنَّ نُزُولَ فَرْضٍ لَا يُوجِبُ سُقُوطَ آخَرَ وَقَدْ أَجْمَعَ أَهْلُ الْعِلْمِ عَلَى وُجُوبِ زَكَاةِ الْفِطْرِ وَإِنِ اخْتَلَفُوا فِي تَسْمِيَتِهَا فَرْضًا فَلَا يَجُوزُ تَرْكُهَا وَبِاللهِ التَّوْفِيقُ
