10. Zakāh (Prescribed Charity) (4/13)
١٠۔ كِتَابُ الزَّكَاةِ ص ٤
[Machine] God Almighty said, "And they were not commanded except to worship Allah, [being] sincere to Him in religion, inclining to truth, and to establish prayer and to give zakah. And that is the correct religion." [Al-Bayyinah: 5]
قَالَ اللهُ ﷻ {وَمَا أُمِرُوا إِلَّا لِيَعْبُدُوا اللهَ مُخْلِصِينَ لَهُ الدِّينَ حُنَفَاءَ وَيُقِيمُوا الصَّلَاةَ وَيُؤْتُوا الزَّكَاةَ وَذَلِكَ دِينُ الْقَيِّمَةِ} [البينة: 5]
[Machine] That Abu Bakr Al-Siddiq wrote this book for him and wrote for him this obligation of charity that the Messenger of Allah obligated on the Muslims that Allah commanded his Messenger with, so he mentioned the hadith in which there is also the charity of livestock in its grazing.
أَنَّ أَبَا بَكْرٍ الصِّدِّيقُ ؓ كَتَبَ لَهُ هَذَا الْكِتَابَ وَكَتَبَ لَهُ هَذِهِ فَرِيضَةُ الصَّدَقَةِ الَّتِي فَرَضَ رَسُولُ اللهِ ﷺ عَلَى الْمُسْلِمِينَ الَّتِي أَمَرَ اللهُ بِهَا رَسُولَهُ فَذَكَرَ الْحَدِيثَ وَفِيهِ وَصَدَقَةُ الْغَنَمِ فِي سَائِمَتِهَا
[Machine] About the Prophet ﷺ writing a letter to the people of Yemen, he mentioned in it that every five camels there should be one sheep until it reaches twenty-four. And in every forty sheep, there should be one sheep until it reaches one hundred. If it exceeds by one, then there should be two sheep.
عَنِ النَّبِيِّ ﷺ أَنَّهُ كَتَبَ إِلَى أَهْلِ الْيَمَنِ بِكِتَابٍ فَذَكَرَ الْحَدِيثَ وَفِيهِ وَفِي كُلِّ خَمْسٍ مِنَ الْإِبِلِ سَائِمَةً شَاةٌ إِلَى أَنْ تَبْلُغَ أَرْبَعًا وَعِشْرِينَ وَفِيهِ وَفِي كُلِّ أَرْبَعِينَ شَاةً سَائِمَةً شَاةٌ إِلَى أَنْ تَبْلُغَ عِشْرِينَ وَمِائَةً فَإِنْ زَادَتْ وَاحِدَةً فَفِيهَا شَاتَانِ
The Messenger of Allah ﷺ said: For forty pasturing camels, one she-camel in her third year is to be given. The camels are not to be separated from reckoning. He who pays zakat with the intention of getting reward will be rewarded. If anyone evades zakat, we shall take half the property from him as a due from the dues of our Lord, the Exalted. There is no share in it (zakat) of the descendants of Muhammad ﷺ. (Using translation from Abū Dāʾūd 1575)
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ فِي كُلِّ إِبِلٍ سَائِمَةٍ مِنْ كُلِّ أَرْبَعِينَ ابْنَةُ لَبُونٍ لَا تُفَرَّقُ إِبِلٌ عَنْ حِسَابِهَا مَنْ أَعْطَاهَا مُؤْتَجِرًا فَلَهُ أَجْرُهَا وَمَنْ مَنَعَهَا فَإِنَّا آخِذُوهَا وَشَطْرَ إِبِلِهِ عَزْمَةٌ مِنْ عَزَمَاتِ رَبِّنَا لَا يَحِلُّ لِآلِ مُحَمَّدٍ مِنْهَا شَيْءٌ
[Machine] About the prophet, ﷺ , said: "There is no charity in working with camels" as Ghālib al-Qaṭṭān said, and it has been narrated in cows from Ibn ʿAbbās in a connected chain, and from Muʿādh ibn Jabal in a suspended chain. In their chains, there is a weakness, and the most famous narration of it is in a connected and suspended chain.
عَنِ النَّبِيِّ ﷺ قَالَ لَيْسَ فِي الْإِبِلِ الْعَوَامِلِ صَدَقَةٌ كَذَا قَالَ غَالِبٌ الْقَطَّانُ وَرُوِيَ فِي ذَلِكَ فِي الْبَقَرِ عَنِ ابْنِ عَبَّاسٍ مَرْفُوعًا وَعَنْ مُعَاذِ بْنِ جَبَلٍ مَوْقُوفًا وَفِي إِسْنَادِهِمَا ضَعْفٌ وَأَشْهَرُ مَا رُوِيَ فِيهِ مُسْنَدًا وَمَوْقُوفًا
[Machine] "That the Prophet ﷺ said, 'There is nothing in the cow's udder that is beneficial.'"
أَنَّ النَّبِيَّ ﷺ قَالَ لَيْسَ فِي الْبَقَرِ الْعَوَامِلِ شَيْءٌ
[Machine] About the Prophet ﷺ , he said, "There is nothing on the back of a cow that an employee can claim, Abu Badr Shuja' bin Al-Walid reported this from Zuhayr without any doubt, and An-Nufayli reported it from Zuhayr with doubt. Zuhayr said, 'I think it is from the Prophet ﷺ ,' and someone else reported it from Abu Ishaq as a stopped narration."
عَنِ النَّبِيِّ ﷺ قَالَ لَيْسَ عَلَى الْبَقَرِ الْعَوَامِلِ شَيْءٌ رَفَعَهُ أَبُو بَدْرٍ شُجَاعُ بْنُ الْوَلِيدِ عَنْ زُهَيْرٍ مِنْ غَيْرِ شَكٍّ وَرَوَاهُ النُّفَيْلِيُّ عَنْ زُهَيْرٍ بِالشَّكِّ فَقَالَ قَالَ زُهَيْرٌ أَحْسِبُهُ عَنِ النَّبِيِّ ﷺ وَرَوَاهُ غَيْرُهُ عَنْ أَبِي إِسْحَاقَ مَوْقُوفًا
[Machine] There is nothing on the workers regarding the cultivation of cows.
لَيْسَ عَلَى الْعَوَامِلِ مِنَ الْبَقَرِ الْحَرَّاثَةِ شَيْءٌ
[Machine] "He said that there are no working female camels or working female cows for charity."
أَنَّهُ قَالَ لَيْسَ فِي الْإِبِلِ الْعَوَامِلِ وَلَا فِي الْبَقَرِ الْعَوَامِلِ صَدَقَةٌ
[Machine] The following passage is a narration from Jabir, raised to the Prophet Muhammad, and in its chain of narration, there is weakness, and the authentic version is stopped (with no clear attribution).
عَنْ جَابِرِ مَرْفُوعًا وَفِي إِسْنَادِهِ ضَعْفٌ وَالصَّحِيحُ مَوْقُوفٌ
[Machine] "And Al-Hasan Al-Basri said, there is no voluntary charity in the cow if it is in Egypt."
وَقَالَ الْحَسَنُ الْبَصْرِيُّ لَيْسَ فِي الْبَقَرِ الْعَوَامِلِ صَدَقَةٌ إِذَا كَانَتْ فِي مِصْرٍ
10.44 [Machine] No charity in horses
١٠۔٤٤ بَابُ لَا صَدَقَةَ فِي الْخَيْلِ
[Machine] The Messenger of Allah ﷺ said, "There is no obligation on a person for his servant or his horse."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَيْسَ عَلَى الْمَرْءِ فِي عَبْدِهِ وَلَا فِي فَرَسِهِ صَدَقَةٌ
[Machine] On the authority of the Prophet (peace and blessings be upon him), he said, "There is no obligation of charity upon a Muslim for his horse or his slave."
عَنِ النَّبِيِّ ﷺ قَالَ لَيْسَ عَلَى الْمَرْءِ الْمُسْلِمِ فِي فَرَسِهِ وَلَا مَمْلُوكَهِ صَدَقَةٌ
[Machine] The Messenger of Allah ﷺ said, "There is no charity for a Muslim in his slave or his horse."
قَالَ رَسُولُ اللهِ ﷺ لَا صَدَقَةَ عَلَى الْمُسْلِمِ فِي عَبْدِهِ وَلَا فِي فَرَسِهِ
[Machine] The Messenger of Allah ﷺ said: "There is no charity in horses and slaves, except that there is charity of breaking the fast in slaves. Their words are alike." This is narrated through this chain of narration from Ubaid Allah.
قَالَ رَسُولُ اللهِ ﷺ لَيْسَ فِي الْخَيْلِ وَالرَّقِيقِ صَدَقَةٌ إِلَّا أَنَّ فِي الرَّقِيقِ صَدَقَةَ الْفِطْرِ لَفْظُهُمَا سَوَاءٌ كَذَا رُوِيَ بِهَذَا الِاسْنَادِ عَنْ عُبَيْدِ اللهِ
[Machine] Narrated by the Prophet ﷺ , there is no zakat for horses and slaves except for the zakat al-fitr on slaves. This is the correct view, and his hadith from Abu al-Zinad is not preserved, and is considered weak, as he did not hear it from Urwa.
عَنِ النَّبِيِّ ﷺ قَالَ لَيْسَ فِي الْخَيْلِ وَالرَّقِيقِ زَكَاةٌ إِلَّا زَكَاةَ الْفِطْرِ فِي الرَّقِيقِ هَذَا هُوَ الْأَصَحُّ وَحَدِيثَهُ عَنْ أَبِي الزِّنَادِ غَيْرُ مَحْفُوظٍ وَمَكْحُولٌ لَمْ يَسْمَعْهُ مِنْ عِرَاكٍ إِنَّمَا
[Machine] The Prophet ﷺ said, "There is no obligation of charity on a Muslim regarding his slave or his horse."
عَنِ النَّبِيِّ ﷺ قَالَ لَيْسَ عَلَى الْمُسْلِمِ فِي عَبْدِهِ وَلَا فَرَسِهِ صَدَقَةٌ
عَنِ النَّبِيِّ ﷺ قَالَ لَيْسَ عَلَى مُسْلِمٍ صَدَقَةٌ فِي عَبْدِهِ وَلَا فَرَسِهِ 7405 وَبِإِسْنَادِهِ ثنا أُسَامَةُ عَنْ سَعِيدِ بْنِ أَبِي سَعِيدٍ عَنْ أَبِي هُرَيْرَةَ عَنِ النَّبِيِّ ﷺ مِثْلَهُ
[Machine] The Messenger of Allah ﷺ said, "I have pardoned you from giving charity from horses and servants, so give charity from all the forty dirhams (you possess). For every ninety dirhams, there is no obligation, but once it reaches two hundred dirhams, there are five dirhams (to be given)." Al-Amash narrated this from Abu Ishaq.
قَالَ رَسُولُ اللهِ ﷺ عَفَوْتُ لَكُمْ عَنْ صَدَقَةِ الْخَيْلِ وَالرَّقِيقِ فَهَلُمُّوا صَدَقَةَ الرِّقَةِ مِنْ كُلِّ أَرْبَعِينَ دِرْهَمًا دِرْهَمٌ وَلَيْسَ فِي تِسْعِينَ وَمِائَةٍ شَيْءٌ فَإِذَا بَلَغَتْ مِائَتَيْنِ فَفِيهَا خَمْسَةُ دَرَاهِمَ وَرَوَاهُ الْأَعْمَشُ عَنْ أَبِي إِسْحَاقَ كَمَا
[Machine] On the authority of the Prophet ﷺ , he said, "I pardoned the horses and the servants." Al-Thawri mentioned in the narration, "So, fulfill the obligation of paying Zakat on wealth, and likewise."
عَنِ النَّبِيِّ ﷺ أنَّهُ قَالَ عَفَوْتُ عَنِ الْخَيْلِ وَالرَّقِيقِ قَالَ الثَّوْرِيُّ فِي الْحَدِيثِ فَأَدُّوا زَكَاةَ الْأَمْوَالِ وَكَذَلِكَ
[Machine] About the Prophet ﷺ in the book he wrote to the people of Yemen, it was mentioned that there is nothing in a Muslim servant or his horse. Abu Abdullah al-Hafiz informed us, Abu Zakaria al-Anbari informed us, Abu Abdullah al-Abdi informed us, al-Hakam ibn Musa informed us, Yahya ibn Hamza narrated from Sulaiman ibn Dawood and he mentioned it.
عَنِ النَّبِيِّ ﷺ فِي الْكِتَابِ الَّذِي كَتَبَهُ إِلَى أَهْلِ الْيَمَنِ وَأنَّهُ لَيْسَ فِي عَبْدٍ مُسْلِمٍ وَلَا فِي فَرَسِهِ شَيْءٌ أَخْبَرَنَاهُ أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو زَكَرِيَّا الْعَنْبَرِيُّ ثنا أَبُو عَبْدِ اللهِ الْعَبْدِيُّ ثنا الْحَكَمُ بْنُ مُوسَى ثنا يَحْيَى بْنُ حَمْزَةَ عَنْ سُلَيْمَانَ بْنِ دَاوُدَ فَذَكَرَهُ
[Machine] The Messenger of Allah ﷺ said: "I have exempted you from giving charity from the forehead, the knees, and the sheep. The rest of the forehead refers to horses, the knees refer to mules and donkeys, and the sheep refer to domesticated animals in houses."
قَالَ رَسُولُ اللهِ ﷺ عَفَوْتُ لَكُمْ عَنْ صَدَقَةِ الْجَبْهَةِ وَالْكُسْعَةِ وَالنُّخَّةِ قَالَ بَقِيَّةُ الْجَبْهَةُ الْخَيْلُ وَالْكُسْعَةُ الْبِغَالُ وَالْحَمِيرُ وَالنُّخَّةُ الْمُرَبَّيَاتُ فِي الْبُيُوتِ كَذَا
[Machine] The Messenger of Allah ﷺ said, "There is no charity in the kas'ah (pouch), al-jabha (forehead), and the nukhah (pubic area)." Abu 'Amr explained that kas'ah is the camels, al-jabha is the horses, and the nukhah is the slaves. Many bin Ziyad narrated it from Abu Sahl, from Al-Hasan, from the Prophet ﷺ as a mursal hadith.
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا صَدَقَةَ فِي الْكُسْعَةِ وَالْجَبْهَةِ وَالنُّخَّةِ فَسَّرَهُ أَبُو عَمْرٍو الْكُسْعَةُ الْحَمِيرُ وَالْجَبْهَةُ الْخَيْلُ وَالنُّخَّةُ الْعَبِيدُ وَرَوَاهُ كَثِيرُ بْنُ زِيَادٍ أَبُو سَهْلٍ عَنِ الْحَسَنِ عَنِ النَّبِيِّ ﷺ مُرْسَلًا
[Machine] Abu Ubaid said in the hadith of the Prophet ﷺ: "Charity is not in the forehead, nor in the arm, nor in the nose." Ibn Abi Maryam narrated to us from Hammad ibn Zaid, from Kathir ibn Ziyad al-Khurasani, who raised it, and from someone other than Hammad, from Juwaybir, from Dahhak, who raised it. Abu Ubaid said: Abu Ubaida said, "The forehead refers to horses, the nose refers to camels, and the arm refers to donkeys." Al-Kisa'i said, "And others say that the forehead and the arm have the same meaning." Al-Kisa'i said, "The arm refers to the nose, with the letter ن, and he explained it, and others say in his gathering, 'The cow is the laborers'."
قَالَ أَبُو عُبَيْدٍ فِي حَدِيثِ النَّبِيِّ ﷺ لَيْسَ فِي الْجَبْهَةِ وَلَا فِي الْكُسْعَةَ وَلَا فِي النُّخَّةِ صَدَقَةٌ حَدَّثَنَاهُ ابْنُ أَبِي مَرْيَمَ عَنْ حَمَّادِ بْنِ زَيْدٍ عَنْ كَثِيرِ بْنِ زِيَادٍ الْخُرَاسَانِيِّ يَرْفَعُهُ وَعَنْ غَيْرِ حَمَّادٍ عَنْ جُوَيْبِرٍ عَنِ الضَّحَّاكِ يَرْفَعُهُ قَالَ أَبُو عُبَيْدٍ قَالَ أَبُو عُبَيْدَةَ الْجَبْهَةُ الْخَيْلُ وَالنُّخَّةُ الرَّقِيقُ وَالْكُسْعَةُ الْحَمِيرُ قَالَ الْكِسَائِيُّ وَغَيْرُهُ فِي الْجَبْهَةِ وَالْكُسْعَةِ مِثْلُهُ وَقَالَ الْكِسَائِيُّ هِيَ النُّخَّةُ بِرَفْعِ النُّونِ وَفَسَّرَهُ هُوَ وَغَيْرُهُ فِي مَجْلِسِهِ الْبَقَرُ الْعَوَامِلُ
[Machine] On the authority of the Prophet ﷺ , he said: "Give your donations, for indeed Allah has relieved you from poverty, baldness, and disease." And he explained that these were the deities that were worshipped during the era of ignorance (pre-Islamic period). Abu Ubaid says, "This contradicts the first narration, and the interpretation in the narration is uncertain, and Allah knows best which one is preserved." The sheikh said, "The chain of this narration is weak, and in the authentic narrations preceding it is sufficiency, and with the help of Allah, success is achieved."
عَنِ النَّبِيِّ ﷺ قَالَ أَخْرِجُوا صَدَقَاتِكُمْ فَإِنَّ اللهَ قَدْ أَرَاحَكُمْ مِنَ الْجَبْهَةِ وَالسَّجَّةِ وَالْبَجَّةِ وَفَسَّرَهَا أَنَّهَا كَانَتْ آلِهَةً يَعْبُدُونَهَا فِي الْجَاهِلِيَّةِ قَالَ أَبُو عُبَيْدٍ وَهَذَا خِلَافُ مَا فِي الْحَدِيثِ الْأَوَّلِ وَالتَّفْسِيرُ فِي الْحَدِيثِ وَاللهُ أَعْلَمُ أَيُّهُمَا الْمَحْفُوظُ قَالَ الشَّيْخُ أَسَانِيدُ هَذَا الْحَدِيثِ ضَعِيفَةٌ وَفِي الْأَحَادِيثِ الصَّحِيحَةِ قَبْلَهُ كِفَايَةٌ وَبِاللهِ التَّوْفِيقُ
مَالِكٌ أَيِ ارْدُدْهَا عَلَى فُقَرَائِهِمْ
Some people from Syria came to ‘Umar and said: We have acquired wealth and horses and slaves,and we want to pay zakah on them as a purification. He said: I shall do what my two predecessors did. He consulted the Companions of Muhammad ﷺ, among whom was ‘Ali, and ‘Ali said: It is good, provided it does not become a regular tax that is taken from them after you are gone. نَاسٌ مِنْ أَهْلِ الشَّامِ إِلَى عُمَرَ ؓ فَقَالُوا إِنَّا قَدْ أَصَبْنَا أَمْوَالًا خَيْلًا وَرَقِيقًا نُحِبُّ أَنْ يَكُونَ لَنَا فِيهِ زَكَاةٌ وَطَهُوَرٌ قَالَ مَا فَعَلَهُ صَاحِبَايَ قَبْلي فَافْعَلْهُ فَاسْتَشَارَ عُمَرُ ؓ عَلِيًّا ؓ فِي جَمَاعَةٍ مِنْ أَصْحَابِ رَسُولِ اللهِ ﷺ ؓ فَقَالَ عَلِيٌّ ؓ هُوَ حَسَنٌ إِنْ لَمْ يَكُنْ جِزْيَةٌ يُؤْخَذُونَ بِهَا رَاتِبَةً
وَهَلْ فِي الْخَيْلِ صَدَقَةٌ؟
[Machine] He said that a book came from Umar Ibn Abdul Aziz to Abu while he was in Mina, saying, "Do not take from horses or honey as charity."
أنَّهُ قَالَ جَاءَ كِتَابٌ مِنْ عُمَرَ بْنِ عَبْدِ الْعَزِيزِ ؓ إِلَى أَبِي وَهُوَ بِمِنًى لَا تَأْخُذْ مِنَ الْخَيْلِ وَلَا مِنَ الْعَسَلِ صَدَقَةً
وَهَلْ فِي الْخَيْلِ صَدَقَةٌ؟
10.45 [Machine] Whoever sees goodness in horses.
١٠۔٤٥ بَابُ مَنْ رَأَى فِي الْخَيْلِ صَدَقَةً.
[Machine] The Messenger of Allah ﷺ said, "There is no owner of gold or silver who does not give their due right from it." He mentioned the hadith in the warning that came about preventing its right and the right of camels, cows, and sheep. He mentioned that from the right of camels is their milking on the day of their return. Then it was said, "O Messenger of Allah, what about horses?" He said, "Horses have three rights. They are a burden for one man, a reward for another, and a covering for another. As for the one who burdens it, he ties it ostentatiously, proudly, and arrogantly in front of the people of Islam, so it is a burden for him. As for the one for whom it is a covering, he ties it in the path of Allah, then he does not neglect the right of Allah in its appearance and its necks, so it is a covering for him. As for the one for whom it is a reward, he ties it in the path of Allah for the people of Islam in a meadow or a garden, so it does not eat anything from that meadow or garden except that a number of good deeds is written for him equal to what it ate, and a number of its footsteps and urinations are written as good deeds for him. Its length is not cut, so it seeks nobility or two noble things. Allah writes for him a number of its footsteps and urinations as good deeds, and its owner orders it to a river, so it drinks from it, and he does not intend to quench its thirst except that Allah writes for him a number of what it drank as good deeds. It was said, "O Messenger of Allah, what about donkeys?" He said, "Allah has not revealed anything to me about donkeys except this comprehensive and concise verse: 'So whoever does an atom's weight of good will see it, and whoever does an atom's weight of evil will see it.' " [Surah Az-Zalzalah 8]
قَالَ رَسُولُ اللهِ ﷺ مَا مِنْ صَاحِبِ ذَهَبٍ وَلَا فِضَّةٍ لَا يُؤَدِّي مِنْهَا حَقَّهَا فَذَكَرَ الْحَدِيثَ فِي الْوَعِيدِ الَّذِي جَاءَ فِي مَنْعِ حَقِّهَا وَحَقِّ الْإِبِلِ وَالْبَقَرِ وَالْغَنَمِ وَذَكَرَ فِي الْإِبِلِ وَمِنْ حَقِّهَا حَلْبُهَا يَوْمَ وِرْدِهَا ثُمَّ قَالَ قِيلَ يَا رَسُولَ اللهِ فَالْخَيْلُ؟ قَالَ الْخَيْلُ لِثَلَاثَةٍ هِيَ لِرَجُلٍ وِزْرٌ وَهِيَ لِرَجُلٍ أَجْرٌ وَهِيَ لِرَجُلٍ سِتْرٌ فَأَمَّا الَّذِي هِيَ لَهُ وِزْرٌ فَرَجُلٌ رَبَطَهَا رِيَاءً وَفَخْرًا وَنِوَاءً عَلَى أَهْلِ الْإِسْلَامِ فَهِيَ لَهُ وِزْرٌ وَأَمَّا الَّذِي هِيَ لَهُ سِتْرٌ فَرَجُلٌ رَبَطَهَا فِي سَبِيلِ اللهِ ثُمَّ لَمْ يَنْسَ حَقَّ اللهِ فِي ظُهُوَرِهَا وَلَا رِقَابِهَا فَهِيَ لَهُ سِتْرٌ وَأَمَّا الَّذِي هِيَ لَهُ أَجْرٌ فَرَجُلٌ رَبَطَهَا فِي سَبِيلِ اللهِ لِأَهْلِ الْإِسْلَامِ فِي مَرْجٍ أَوْ رَوْضَةٍ فَمَا أَكَلَتْ مِنْ ذَلِكَ الْمَرْجِ وَالرَّوْضَةِ مِنْ شَيْءٍ إِلَّا كُتِبَ لَهُ عَدَدَ مَا أَكَلَتْ حَسَنَاتٌ وَكُتِبَ لَهُ عَدَدَ أَرْوَاثِهَا وَأَبْوَالِهَا حَسَنَاتٌ وَلَا تَقْطَعُ طُولَهَا فَاسْتَنَّتْ شَرَفًا أَوْ شَرَفَيْنِ إِلَّا كَتَبَ اللهُ لَهُ عَدَدَ آثَارِهَا وَأَبْوَالِهَا حَسَنَاتٍ وَلَأَمَرَّ بِهَا صَاحِبُهَا عَلَى نَهَرٍ فَشَرِبَتْ مِنْهُ وَلَا يُرِيدُ أَنْ يَسْقِيَهَا إِلَّا كَتَبَ اللهُ لَهُ عَدَدَ مَا شَرِبَتْ حَسَنَاتٍ قِيلَ يَا رَسُولَ اللهِ فَالْحُمُرُ؟ قَالَ مَا أَنْزَلَ اللهُ عَلَيَّ فِي الْحُمُرِ شَيْئًا إِلَّا هَذِهِ الْآيَةَ الْفَاذَّةَ الْجَامِعَةَ {فَمَنْ يَعْمَلْ مِثْقَالَ ذَرَّةٍ خَيْرًا يَرَهُ وَمَنْ يَعْمَلْ مِثْقَالَ ذَرَّةٍ شَرًّا يَرَهُ } [الزلزلة 8]
[Machine] The Messenger of Allah ﷺ said regarding horses that are easily frightened, "In every horse, there is a dinar upon which your saddle rests." Abu Bakr ibn Al-Harith narrated that Ali ibn Umar Al-Hafiz said, "In every horse, there is a dinar upon which your saddle rests, and it is unique to your guardian, distancing it from Ja'far who is very weak, and those weaker than him."
قَالَ رَسُولُ اللهِ ﷺ فِي الْخَيْلِ السَّائِمَةِ فِي كُلِّ فَرَسٍ دِينَارٌ تَفَرَّدَ بِهِ غُورَكُ هَذَا وَأَخْبَرَنَا أَبُو بَكْرِ بْنُ الْحَارِثِ قَالَ قَالَ عَلِيُّ بْنُ عُمَرَ الْحَافِظُ تَفَرَّدَ بِهِ غُورَكُ عَنْ جَعْفَرٍ وَهُوَ ضَعِيفٌ جِدًّا وَمَنْ دُونَهُ ضُعَفَاءُ
[Machine] Umar used to take forty sheep as tax, and he didn't take anything from horses. Take one dinar from each mare. He struck the horse with a dinar, dinar, and we have narrated before this incident, it does not indicate that Umar ordered it only when its owners liked it. And if this narration is correct, it can be inferred that the narrations do not agree and there is no difference. The hadith of the argument of Abu Hurayrah is the most authentic narration in that matter, and it removes the obligation of giving charity from it. And Allah knows best.
عُمَرُ فَنَأْخُذُ مِنْ كُلِّ أَرْبَعِينَ شَاةً شَاةً وَلَا نَأْخُذُ مِنَ الْخَيْلِ شَيْئًا خُذْ مِنْ كُلِّ فَرَسٍ دِينَارًا قَالَ فَضَرَبَ عَلَى الْخَيْلِ دِينَارًا دِينَارًا وَقَدْ رُوِّينَا فِي الْبَابِ قَبْلَهُ مَا دَلَّ عَلَى أَنَّ عُمَرَ ؓ إِنَّمَا أَمَرَ بِذَلِكَ حِينَ أَحَبَّهُ أَرْبَابُهَا وَهَذِهِ الرِّوَايَةُ إِنْ صَحَّتْ تَكُونُ مَحْمُولَةً عَلَى مِثْلِ ذَلِكَ لَا تَتَّفِقُ الرِّوَايَاتُ وَلَا تَخْتَلِفُ وَحَدِيثُ عِرَاكٍ عَنْ أَبِي هُرَيْرَةَ أَصَحُّ مَا رُوِيَ فِي ذَلِكَ وَهُوَ يَقْطَعُ بِنَفْيِ الصَّدَقَةِ عَنْهَا وَاللهُ أَعْلَمُ

10.47 [Machine] The specified quantity for the zakat of fruits.
١٠۔٤٧ بَابُ النِّصَابِ فِي زَكَاةِ الثِّمَارِ
[Machine] The Messenger of Allah ﷺ said: "There is no charity in less than five awq (a measurement unit) of paper, nor in less than five usqu (a measurement unit) of dates, nor in less than five dawd (a measurement unit) of camels." 7422 narrated Bahrun on the authority of Ibn Wahb, Ayyad bin Abdullah al-Qurashi informed you, from Abu Zubair, from Jabir bin Abdullah, from the Messenger of Allah ﷺ with a similar narration.
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَيْسَ فِيمَا دُونَ خَمْسِ أَوَاقٍ مِنَ الْوَرِقِ صَدَقَةٌ وَلَيْسَ فِيمَا دُونَ خَمْسَةِ أَوْسُقٍ مِنَ التَّمْرِ صَدَقَةٌ وَلَيْسَ فِيمَا دُونَ خَمْسِ ذَوْدٍ مِنَ الْإِبِلِ صَدَقَةٌ 7422 قَالَ وَحَدَّثَنَا بَحْرٌ قَالَ قُرِئَ عَلَى ابْنِ وَهْبٍ أَخْبَرَكَ عِيَاضُ بْنُ عَبْدِ اللهِ الْقُرَشِيُّ عَنْ أَبِي الزُّبَيْرِ عَنْ جَابِرِ بْنِ عَبْدِ اللهِ عَنْ رَسُولِ اللهِ ﷺ مِثْلَهُ
That the Apostle of Allaah ﷺ as saying No sadaqah(zakat) is payable on less than five camels, on less than five ounces of silver and on less than five camel loads(wasq). (Using translation from Abū Dāʾūd 1558)
عَنِ النَّبِيِّ ﷺ قَالَ لَيْسَ فِيمَا دُونَ خَمْسَةِ أَوْسُقٍ صَدَقَةٌ وَلَا فِيمَا دُونَ خَمْسِ أَوَاقٍ صَدَقَةٌ وَلَيْسَ فِيمَا دُونَ خَمْسِ ذَوْدٍ صَدَقَةٌ
[Machine] The Messenger of Allah ﷺ said, "There is no zakat due on any amount less than five awsuq."
قَالَ رَسُولُ اللهِ ﷺ لَيْسَ فِيمَا دُونَ خَمْسَةِ أَوْسُقٍ زَكَاةٌ
[Machine] Narrated by the Prophet ﷺ that he wrote a letter to the people of Yemen, mentioning in it what the sky has poured, or whether it rained, or there was a drought. He also mentioned in it regarding the payment of one-tenth when the quantity of crops reaches five Awsuq (a specific measure), and the crops that were watered by irrigation or rainfall, in which case, the payment is half of the tenth when the quantity reaches five Awsuq.
عَنِ النَّبِيِّ ﷺ أَنَّهُ كَتَبَ إِلَى أَهْلِ الْيَمَنِ بِكِتَابٍ فَذَكَرَ فِيهِ مَا سَقَتِ السَّمَاءُ أَوْ كَانَ سَيْحًا أَوْ كَانَ بَعْلًا فَفِيهِ الْعُشْرُ إِذَا بَلَغَ خَمْسَةَ أَوْسُقٍ وَمَا سُقِيَ بِالرِّشَاءِ وَالدَّالِيَةِ فَفِيهِ نِصْفُ الْعُشْرِ إِذَا بَلَغَ خَمْسَةَ أَوْسُقٍ
[Machine] That charity should not be taken from a date palm until its cluster has reached five Wasuq.
أَنْ لَا تُؤْخَذَ صَدَقَةٌ مِنْ نَخْلٍ حَتَّى يَبْلُغَ خَرْصُهَا خَمْسَةَ أَوْسُقٍ
10.48 [Machine] The amount of rainfall
١٠۔٤٨ بَابُ مِقْدَارِ الْوَسْقِ
The Prophet ﷺ said: There is no zakat payable (on grain or dates) on less than five camel-loads. The wasq (one camel-load) measures sixty sa' in weight. (Using translation from Abū Dāʾūd 1559)
عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ يَرْفَعُهُ إِلَى النَّبِيِّ ﷺ قَالَ لَيْسَ فِيمَا دُونَ خَمْسَةِ أَوْسَاقٍ زَكَاةٌ وَالْوَسْقُ سِتُّونَ مَخْتُومًا وَرَوَاهُ يَعْلَى بْنُ عُبَيْدٍ عَنْ إِدْرِيسَ وَقَالَ فِي الْحَدِيثِ وَالْوَسْقُ سِتُّونَ صَاعًا
[Machine] Yahya, so I asked a partner about it, but he did not memorize it.
يَحْيَى فَسَأَلْتُ شَرِيكًا عَنْهُ فَلَمْ يَحْفَظْهُ
Jabir bin Abdullah said: “The Messenger of Allah said: 'A Wasq is sixty Sa.' ” (Using translation from Ibn Mājah 1833)
الْوَسْقُ سِتُّونَ صَاعًا
[Machine] About Al-Hasan, Ash-Sha'bi, An-Nakha'i, and others, the discussion about the measurement of the Sa' will be addressed at the end of this book, God willing.
عَنِ الْحَسَنِ وَالشَّعْبِيِّ وَالنَّخَعِيِّ وَغَيْرِهِمْ وَالْكَلَامُ فِي مِقْدَارِ الصَّاعِ يَرِدُ فِي آخِرِ هَذَا الْكِتَابِ إِنْ شَاءَ اللهُ تَعَالَى
10.49 [Machine] How do you calculate the Zakat of date palms and grapes?
١٠۔٤٩ بَابُ كَيْفَ تُؤْخَذُ زَكَاةُ النَّخْلِ وَالْعِنَبِ
[Machine] The Prophet ﷺ used to send someone to collect their dates and other crops as a form of charity for the people, and in the narration of Ash-Shafi'i, he used to send someone to collect the best of their fruits and crops.
أَنَّ النَّبِيَّ ﷺ كَانَ يَبْعَثُ مَنْ يَخْرُصُ عَلَيْهِمْ كَرْمَهُمْ وَثِمَارَهُمْ لَفْظُ حَدِيثِ إِبْرَاهِيمَ وَفِي رِوَايَةِ الشَّافِعِيِّ كَانَ يَبْعَثُ مَنْ يَخْرُصُ عَلَى النَّاسِ كُرُومَهُمْ وَثِمَارَهُمْ
[Machine] The Messenger of Allah ﷺ said: "Grapes are picked like dates are picked and its zakat is taken in the form of raisins, just as the zakat of dates is taken in the form of dates." And Abu Zakariya bin Abi Ishaq narrated to us, Abu Al-Abbas informed An-Nabie that Ash-Shafi'i informed Abdullah bin Nafi', and he mentioned it with its chain of narration and its meaning.
قَالَ رَسُولُ اللهِ ﷺ يُخْرَصُ الْعِنَبُ كَمَا يُخْرَصُ النَّخْلُ وَتُؤْخَذُ زَكَاتُهُ زَبِيبًا كَمَا تُؤْخَذُ زَكَاةُ النَّخْلِ تَمْرًا 7433 وَأَخْبَرَنَا أَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ ثنا أَبُو الْعَبَّاسِ أنبأ الرَّبِيعُ أنبأ الشَّافِعِيُّ أنبأ عَبْدُ اللهِ بْنُ نَافِعٍ فَذَكَرَهُ بِإِسْنَادِهِ وَمَعْنَاهُ
That the Messenger of Allah told 'Attab bin Usaid to estimate the (harvest of) grapes, and to pay Zakah in raisins, just as the Zakah on date palms is given in died dates. (Using translation from Nasāʾī 2618)
أَنَّ رَسُولَ اللهِ ﷺ أَمَرَ عَتَّابَ بْنَ أَسِيدٍ أَنْ يَخْرُصَ الْعِنَبَ كَمَا يَخْرُصُ النَّخْلَ ثُمَّ تُؤَدِّي زَكَاتَهُ زَبِيبًا كَمَا تُؤَدِّي زَكَاةَ النَّخْلِ تَمْرًا قَالَ فَتِلْكَ سُنَّةُ رَسُولِ اللهِ ﷺ فِي النَّخْلِ وَالْعِنَبِ
[Machine] That no Zakat is taken from palm trees or grapes until they reach a harvest of five uqiya. Az-Zuhri said, "And we do not know of any fruit being harvested other than dates and grapes."
أَنْ لَا تُؤْخَذَ الزَّكَاةُ مِنْ نَخْلٍ وَلَا عِنَبٍ حَتَّى يَبْلُغَ خَرْصُهَا خَمْسَةَ أَوْسُقٍ قَالَ الزُّهْرِيُّ وَلَا نَعْلَمُ يُخْرَصُ مِنَ الثَّمَرِ إِلَّا التَّمْرُ وَالْعِنَبُ
10.50 [Machine] The Sifting of Dates and Evidence That It Has a Ruling
١٠۔٥٠ بَابُ خَرْصِ التَّمْرِ وَالدَّلِيلِ عَلَى أَنَّ لَهُ حُكْمًا
خَرَجْنَا مَعَ رَسُولِ اللهِ ﷺ فِي غَزْوَةِ تَبُوكَ فَأَتَيْنَا وَادِيَ الْقُرَى عَلَى حَدِيقَةٍ لِامْرَأَةٍ فَقَالَ رَسُولُ اللهِ ﷺ اخْرُصُوهَا فَخَرَصْنَاهَا وَخَرَصَهَا رَسُولُ اللهِ ﷺ عَشَرَةَ أَوْسُقٍ وَقَالَ أَحْصِيهَا حَتَّى نَرْجِعَ إِلَيْكِ إِنْ شَاءَ اللهُ وَانْطَلَقْنَا حَتَّى قَدِمْنَا تَبُوكَ فَذَكَرَ الْحَدِيثَ قَالَ ثُمَّ أَقْبَلْنَا حَتَّى قَدِمْنَا وَادِيَ الْقُرَى فَسَأَلَ رَسُولُ اللهِ ﷺ الْمَرْأَةَ عَنْ حَدِيقَتِهَا كَمْ بَلَغَ ثَمَرُهَا؟ فَقَالَتْ بَلَغَ عَشَرَةَ أَوْسُقٍ
[Machine] "That the Messenger of Allah ﷺ said to the Jews of Khaybar when he conquered Khaybar: I will grant you a guarantee of safety that Allah has granted you, that the dates will be shared between us and you. He sent Abdullah ibn Rawaha to distribute dates among them and said: If you wish, it is for you, and if you wish, it is for me. They would take it."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لِيَهُوَدِ خَيْبَرَ حِينَ افْتَتَحَ خَيْبَرَ أُقِرُّكُمْ مَا أَقَرَّكُمُ اللهُ عَلَى أَنَّ التَّمْرَ بَيْنَنَا وَبَيْنَكُمْ قَالَ فَكَانَ رَسُولُ اللهِ ﷺ يَبْعَثُ عَبْدَ اللهِ بْنَ رَوَاحَةَ ؓ فَيَخْرُصُ عَلَيْهِمْ ثُمَّ يَقُولُ إِنْ شِئْتُمْ فَلَكُمْ وَإِنْ شِئْتُمْ فَلِي فَكَانُوا يَأْخُذُونَ
[Machine] The Messenger of Allah ﷺ used to send Abdullah bin Rawaha to negotiate with the Jews. They offered him jewelry from their women and asked him to take it and lighten their burden and be lenient in his judgment. Abdullah bin Rawaha said: "O Jews! By Allah, you are among the most disliked of Allah's creation to me. But this does not prevent me from being fair to you. As for the bribe you have offered, it is haram and we do not consume it." They said: "With this statement, the heavens and the earth stood up."
أَنَّ رَسُولَ اللهِ ﷺ كَانَ يَبْعَثُ عَبْدَ اللهِ بْنَ رَوَاحَةَ فَيَخْرُصُ بَيْنَهُ وَبَيْنَ يَهُوَدَ قَالَ فَجَمَعُوا لَهُ حُلِيًّا مِنْ حُلِيِّ نِسَائِهِمْ فَقَالُوا هَذَا لَكَ وَخَفِّفْ عَنَّا وَتَجَاوَزْ فِي الْقَسْمِ فَقَالَ عَبْدُ اللهِ بْنُ رَوَاحَةَ ؓ يَا مَعْشَرَ يَهُوَدَ وَاللهِ إِنَّكُمْ لَمِنْ أَبْغَضِ خَلْقِ اللهِ إِلَيَّ وَمَا ذَلِكَ بِحَامِلِي عَلَى أَنْ أَحِيفَ عَلَيْكُمْ فَأَمَّا الَّذِي عَرَّضْتُمْ مِنَ الرِّشْوَةِ فَإِنَّهَا سُحْتٌ وَإِنَّا لَا نَأْكُلُهَا قَالُوا بِهَذَا قَامَتِ السَّمَاوَاتُ وَالْأَرْضُ
[Machine] Did Allah bestow upon His Messenger ﷺ the children of Nadir, so the Messenger of Allah ﷺ affirmed their ownership over what they had, and he made it a covenant between him and them? So Abdullah ibn Rawaha was sent, and he divided it among them and said to them, "O Jews, you are the most hated people to me. You killed the prophets of Allah and lied about Allah. My hatred for you does not lead me to be unjust to you. I have divided among you twenty thousand measures of dates. If you want them, they are for you, and if you refuse, they should acknowledge that the heavens and the earth have risen against you." They said, "We have accepted it, so leave us alone."
أَفَاءَ اللهُ عَلَى رَسُولِهِ ﷺ بَنِي النَّضِيرِ فَأَقَرَّهُمْ رَسُولُ اللهِ ﷺ عَلَى مَا كَانُوا وَجَعَلَهَا بَيْنَهُ وَبَيْنَهُمْ فَبَعَثَ عَبْدَ اللهِ بْنَ رَوَاحَةَ فَخَرَصَهَا عَلَيْهِمْ ثُمَّ قَالَ لَهُمْ يَا مَعْشَرَ الْيَهُوَدِ أَنْتُمْ أَبْغَضُ النَّاسِ إِلَيَّ قَتَلْتُمْ أَنْبِيَاءَ اللهِ وَكَذَبْتُمْ عَلَى اللهِ وَلَيْسَ يَحْمِلُنِي بُغْضِي إِيَّاكُمْ عَلَى أَنْ أَحِيفَ عَلَيْكُمْ قَدْ خَرَصْتُ عَلَيْكُمْ عِشْرِينَ أَلْفَ وَسْقٍ مِنْ تَمْرٍ إِنْ شِئْتُمْ فَلَكُمْ وَإِنْ أَبَيْتُمْ فَلِي قَالُوا بِهَذَا قَامَتِ السَّمَاوَاتُ وَالْأَرْضُ قَالُوا قَدْ أَخَذْنَا فَاخْرُجُوا عَنَّا
The Prophet ﷺ used to send Abdullah ibn Rawahah (to Khaybar), and he would assess the amount of dates when they began to ripen before they were eaten (by the Jews). He would then give choice to the Jews that they have them (on their possession) by that assessment or could assign to them (Muslims) by that assignment, so that the (amount of) zakat could be calculated before the fruit became eatable and distributed (among the people).
