10. Zakāh (Prescribed Charity) (5/13)
١٠۔ كِتَابُ الزَّكَاةِ ص ٥
[Machine] God Almighty said, "And they were not commanded except to worship Allah, [being] sincere to Him in religion, inclining to truth, and to establish prayer and to give zakah. And that is the correct religion." [Al-Bayyinah: 5]
قَالَ اللهُ ﷻ {وَمَا أُمِرُوا إِلَّا لِيَعْبُدُوا اللهَ مُخْلِصِينَ لَهُ الدِّينَ حُنَفَاءَ وَيُقِيمُوا الصَّلَاةَ وَيُؤْتُوا الزَّكَاةَ وَذَلِكَ دِينُ الْقَيِّمَةِ} [البينة: 5]
[Machine] The Prophet ﷺ used to say to the doorman, "Do not turn away the needy."
أَنَّ النَّبِيَّ ﷺ كَانَ يَقُولُ لِلْخَرْصِ لَا تَخْرُصُوا الْعَرَايَا
[Machine] Allah ﷺ did not joke with the naked, nor did Abu Bakr or Umar. The Sheikh said that they are both messengers and there is a connected narration about it.
اللهِ ﷺ لَمْ يَكُنْ يَخْرُصُ الْعَرَايَا وَلَا أَبُو بَكْرٍ وَلَا عُمَرُ ؓ قَالَ الشَّيْخُ وَهُمَا مُرْسَلَانِ وَقَدْ رُوِيَ فِيهِ حَدِيثٌ مَوْصُولٌ
Sahl ibn Abu Hathmah came to our gathering. He said: The Messenger of Allah ﷺ commanding us said: When you estimate take them leaving a third, and if you do not leave or find a third, leave a quarter. (Using translation from Abū Dāʾūd 1605)
أَمَرَنَا رَسُولُ اللهِ ﷺ قَالَ إِذَا خَرَصْتُمْ فَخُذُوا وَدَعُوا الثُّلُثَ فَإِنْ لَمْ تَدَعُوا الثُّلُثَ فَدَعُوا الرُّبُعَ
[Machine] The Messenger of Allah ﷺ used it on the Kharṣ. He said, "Stabilize half for us and leave half for them, for they steal and it does not reach them." Muḥammad said, "I narrated this hadith to ʿUbaid Allah ibn ʿUmar, and he said, 'It has been established with us that the Prophet ﷺ said, "Stabilize two-thirds for us and leave one-third for them." The scholar said, 'This is an unknown chain of narration, and it has been narrated in it from ʿUmar ibn al-Khaṭṭāb.'"
أَنَّ رَسُولَ اللهِ ﷺ اسْتَعْمَلَهُ عَلَى الْخَرْصِ فَقَالَ اثْبِتْ لَنَا النِّصْفَ وَأَبْقِ لَهُمُ النِّصْفَ فَإِنَّهُمْ يَسْرِقُونَ وَلَا يَصِلُ إِلَيْهِمْ قَالَ مُحَمَّدٌ فَحَدَّثْتُ بِهَذَا الْحَدِيثِ عُبَيْدَ اللهِ بْنَ عُمَرَ فَقَالَ قَدْ ثَبَتَ عِنْدَنَا أَنَّ النَّبِيَّ ﷺ قَالَ اثْبِتْ لَنَا الثُّلُثَيْنِ وَأَبْقِ لَهُمُ الثُّلُثَ قَالَ الشَّيْخُ هَذَا إِسْنَادٌ مَجْهُوَلٌ وَقَدْ رُوِيَ فِيهِ عَنْ عُمَرَ بْنِ الْخَطَّابِ ؓ
[Machine] mentioned al-Shafi'i in the past about a man who mentioned it as for them to leave what they eat and not to complain.
أَنْ يَدَعَ لَهُمْ مَا يَأْكُلُونَهُ فَلَا يَخْرُصُهُ وَقَدْ ذَكَرَهُ الشَّافِعِيُّ فِي الْقَدْيمِ عَنْ رَجُلٍ عَنْ يَحْيَى بْنِ سَعِيدٍ وَقَدْ
[Machine] "And he said, when you come to a land, cultivate it and leave for it as much as they eat. And it has been mentioned by Al-Awza'i, from Umar ibn Al-Khattab, narrating it."
وَقَالَ إِذَا أَتَيْتَ أَرْضًا فَاخْرُصْهَا وَدَعْ لَهَا قَدْرَ مَا يَأْكُلُونَ وَقَدْ ذَكَرَهُ الْأَوْزَاعِيُّ عَنْ عُمَرَ بْنِ الْخَطَّابِ ؓ مُرْسَلًا
[Machine] Reduce the burden on people in harvesting, as it contains dates, dried dates, and food. Al-Walid said, I asked Abu Amr, what are the 'arriyah? He said, it is the palm tree, two palm trees, and three palm trees that a person gives to another person in need. I asked, what is the food? He said, the wealthy people eat it as dates, so that is not counted as 'arriyah and is not deducted from it. I asked, what is the watiyyah? He said, it is the one who covers them and visits them. خَفِّفُوا عَلَى النَّاسِ فِي الْخَرْصِ فَإِنَّ فِيهِ الْعَرِيَّةَ وَالْوَطِيَّةَ وَالْأَكَلَةَ قَالَ الْوَلِيدُ قُلْتُ لِأَبِي عَمْرٍو وَمَا الْعَرِيَّةُ؟ قَالَ النَّخْلَةُ وَالنَّخْلَتَانِ وَالثَّلَاثُ يَمْنَحُهَا الرَّجُلُ الرَّجُلَ مِنْ أَهْلِ الْحَاجَةِ قُلْتُ فَمَا الْأَكَلَةُ؟ قَالَ أَهْلُ الْمَالِ يَأْكُلُونَ مِنْهُ رُطَبًا فَلَا يُخْرَصُ ذَلِكَ وَيُوضَعُ مِنْ خَرْصِهِ قَالَ قُلْتُ فَمَا الْوَطِيَّةُ؟ قَالَ مَنْ يَغْشَاهُمْ وَيَزُورُهُمْ قَالَ الشَّيْخُ وَهَذَا اللَّفْظُ الَّذِي
[Machine] The Prophet ﷺ said, "Take precaution for the people of wealth in al-Watiyya, al-Amila, and al-Nawa'ib, and what is obligatory in dates for giving the due right. And Abu Sa'd al-Malini informed us that Abu Ahmad ibn 'Adi narrated to us from Shura'ih ibn 'Aqil from Abu Marwan al-Uthmani from 'Abdul Aziz ibn Abi Hazim from Haram ibn 'Uthman from 'Abdul Rahman and Muhammad, the sons of Jabir, from their father that he mentioned it as a marfu' narration. And it has been narrated from the Prophet ﷺ in a mursal hadith, which is not found in Al-'Ara'ia, "sadaqah".
أَنَّ النَّبِيَّ ﷺ قَالَ احْتَاطُوا لِأَهْلِ الْأَمْوَالِ فِي الْوَاطِيَّةِ وَالْعَامِلَةِ وَالنَّوَائِبِ وَمَا وَجَبَ فِي التَّمْرِ مِنَ الْحَقِّ 7449 وَأَخْبَرَنَا أَبُو سَعْدٍ الْمَالِينِيُّ أنبأ أَبُو أَحْمَدَ بْنُ عَدِيٍّ ثنا شُرَيْحُ بْنُ عَقِيلٍ ثنا أَبُو مَرْوَانَ الْعُثْمَانِيُّ ثنا عَبْدُ الْعَزِيزِ بْنُ أَبِي حَازِمٍ عَنْ حَرَامِ بْنِ عُثْمَانَ عَنْ عَبْدِ الرَّحْمَنِ وَمُحَمَّدٍ ابْنَيْ جَابِرٍ عَنْ أَبِيهِمَا فَذَكَرَهُ مَرْفُوعًا وَقَدْ رُوِيَ عَنِ النَّبِيِّ ﷺ فِي حَدِيثٍ مُرْسَلٍ لَيْسَ فِي الْعَرَايَا صَدَقَةٌ
[Machine] I heard the Prophet, ﷺ , saying and the Prophet, ﷺ , gestured with his hand with five fingers, "There is no less than five awq (a unit of measure) that is considered charity, and there is no less than five awsuq (another unit of measure) that is considered charity, and there is no less than five dawd (another unit of measure) that is considered charity." Muhammad ibn Yahya ibn Habban narrated this Hadith, and he said that Sheikh Muhammad ibn Yahya ibn Habban narrated the Hadith of awq, awsuq, and dawd from Yahya ibn Umarah, from Abu Sa'id. It is possible that this additional information is included in the Hadith. And Allah knows best.
سَمِعْتُ النَّبِيَّ ﷺ يَقُولُ وَأَشَارَ النَّبِيُّ ﷺ بِكَفِّهِ بِخَمْسِ أَصَابِعَ لَيْسَ فِيمَا دُونَ خَمْسِ أَوَاقٍ صَدَقَةٌ وَلَيْسَ فِيمَا دُونَ خَمْسَةِ أَوْسُقٍ صَدَقَةٌ وَلَيْسَ فِيمَا دُونَ خَمْسِ ذَوْدٍ صَدَقَةٌ وَزَادَ عَنِ النَّبِيِّ ﷺ فِي هَذَا الْحَدِيثِ وَلَيْسَ فِي الْعَرَايَا صَدَقَةٌ عَنْ مُحَمَّدِ بْنِ يَحْيَى بْنِ حَبَّانَ قَالَ الشَّيْخُ مُحَمَّدُ بْنُ يَحْيَى بْنِ حَبَّانَ يَرْوِي حَدِيثَ الْأَوَاقِ وَالْأَوْسَاقِ وَالْأَذْوَادِ عَنْ يَحْيَى بْنِ عُمَارَةَ عَنْ أَبِي سَعِيدٍ فَيُحْتَمَلُ أَنْ تَكُونَ هَذِهِ الزِّيَادَةُ مَعَهَا فِي الْحَدِيثِ وَاللهُ أَعْلَمُ
10.52 [Machine] Charitable donation is not taken from anything other than the palm trees and grapes.
١٠۔٥٢ بَابُ لَا تُؤْخَذُ صَدَقَةُ شَيْءٍ مِنَ الشَّجَرِ غَيْرَ النَّخْلِ وَالْعِنَبِ.
[Machine] The Prophet ﷺ sent them to Yemen and commanded them to teach the people about their religion, and he said to them, "Do not take from the charity except from these four types: barley, wheat, raisins, and dates."
أَنَّ رَسُولَ اللهِ ﷺ بَعَثَهُمَا إِلَى الْيَمَنِ فَأَمَرَهُمَا أَنْ يُعَلِّمَا النَّاسَ أَمْرَ دِينِهِمْ وَقَالَ لَا تَأْخُذَا فِي الصَّدَقَةِ إِلَّا مِنْ هَذِهِ الْأَصْنَافِ الْأَرْبَعَةِ الشَّعِيرِ وَالْحِنْطَةِ وَالزَّبِيبِ وَالتَّمْرِ
[Machine] Musab al-Ash'ari and Muadh were sent to Yemen, and when they were there, they only took wheat, barley, dates, and raisins.
مُوسَى الْأَشْعَرِيِّ وَمُعَاذٍ ؓ أَنَّهُمَا حِينَ بُعِثَا إِلَى الْيَمَنِ لَمْ يَأْخُذَا إِلَّا مِنَ الْحِنْطَةِ وَالشَّعِيرِ وَالتَّمْرِ وَالزَّبِيبِ
[Machine] When he came to Yemen, he only took the charity from wheat, barley, dates, and raisins.
أنَّهُ لَمَّا أَتَى الْيَمَنَ لَمْ يَأْخُذِ الصَّدَقَةَ إِلَّا مِنَ الْحِنْطَةِ وَالشَّعِيرِ وَالتَّمْرِ وَالزَّبِيبِ
[Machine] That its (referring to a certain place) walls have vineyards, and in it there are greater amounts of grapes and pomegranates than the vineyards several times over. So he (someone) wrote to him (someone else) asking him for the tenth (a certain percentage) of it. So 'Umar wrote to him (someone else) that it is not subject to tithe. He (someone) said, "It is all part of the cultivated land, so it is not subject to tithe." And this is the statement of Mujahid, Al-Hasan, Al-Nakha'i, and 'Amr ibn Dinar, and we narrated it from the seven jurists among the successors of the people of Al-Madinah.
أَنَّ قِبَلَهُ حِيطَانًا فِيهَا كُرُومٌ وَفِيهَا مِنَ الْفِرْسِكِ وَالرُّمَّانِ مَا هُوَ أَكْثَرُ غَلَّةً مِنَ الْكُرُومِ أَضْعَافًا فَكَتَبَ إِلَيْهِ يَسْتَأْمِرُهُ فِي الْعُشْرِ فَكَتَبَ إِلَيْهِ عُمَرُ أنَّهُ لَيْسَ عَلَيْهَا عُشْرٌ قَالَ هِيَ مِنَ الْعِضَاهِ كُلِّهَا فَلَيْسَ عَلَيْهَا عُشْرٌ وَهَذَا قَوْلُ مُجَاهِدٍ وَالْحَسَنِ وَالنَّخَعِيِّ وَعَمْرِو بْنِ دِينَارٍ وَرُوِّينَاهُ عَنِ الْفُقَهَاءِ السَّبْعَةِ مِنْ تَابِعِي أَهْلِ الْمَدِينَةِ
10.53 [Machine] What is mentioned in the olive?
١٠۔٥٣ بَابُ مَا وَرَدَ فِي الزَّيْتُونِ.
فِيهِ الْعُشْرُ
[Machine] That the one who takes the olives when he presses them during the rainy season or when the rivers flow, or if it is a tenth of the yield, and what is watered with fresh rain is half of the tenth. 7456. Al-Walid narrated to us, 'Uthman ibn 'Ata narrated to me from his father 'Ata al-Khorasani that when 'Umar ibn al-Khattab arrived in Jabiya, the companions of the Messenger of Allah ﷺ presented to him their difference regarding the tenth of the olives. 'Umar said regarding it: When its fruit reaches five osuqs, he presses it and takes a tenth of its oil. This is the narration of 'Umar in this topic, it is disconnected, and its narrator is not strong. The most authentic narrations regarding it are the statements of Ibn Shihab al-Zuhri, and the narrations of Mu'adh ibn Jabal and Abu Musa al-Ash'ari. Allah knows best.
أَنْ تُؤْخَذَ مِمَّنْ عَصَرَ زَيْتُونَهُ حِينَ يَعْصِرُهُ فِيمَا سَقَتِ السَّمَاءُ وَالْأَنْهَارُ أَوْ كَانَ بَعْلًا الْعُشْرُ وَفِيمَا سُقِيَ بِرِشَاءِ النَّاضِحِ نِصْفُ الْعُشْرِ 7456 قَالَ وَحَدَّثَنَا الْوَلِيدُ أَخْبَرَنِي عُثْمَانُ بْنُ عَطَاءٍ عَنْ أَبِيهِ عَطَاءٍ الْخُرَاسَانِيِّ أَنَّ عُمَرَ بْنَ الْخَطَّابِ لَمَّا قَدِمَ الْجَابِيَةَ رَفَعَ إِلَيْهِ أَصْحَابُ رَسُولِ اللهِ ﷺ أَنَّهُمُ اخْتَلَفُوا فِي عُشْرِ الزَّيْتُونِ فَقَالَ عُمَرُ فِيهِ الْعُشْرُ إِذَا بَلَغَ خَمْسَةَ أَوْسُقٍ حَبُّهُ عَصَرَهُ وَأَخَذَ عُشْرَ زَيْتِهِ حَدِيثُ عُمَرَ ؓ فِي هَذَا الْبَابِ مُنْقَطِعٌ وَرَاوِيهِ لَيْسَ بِقَوِيٍّ وَأَصَحُّ مَا رُوِيَ فِيهِ قَوْلُ ابْنِ شِهَابٍ الزُّهْرِيِّ وَحَدِيثُ مُعَاذِ بْنِ جَبَلٍ وَأَبِي مُوسَى الْأَشْعَرِيِّ أَعْلَى وَأَوْلَى أَنْ يُؤْخَذَ بِهِ وَاللهُ أَعْلَمُ
10.54 [Machine] What is mentioned in "Al-Wars"? Al-Shafi'i, may Allah have mercy on him, said: Hisham bin Yusuf informed me that the people of Hafash produced a book from Abu Bakr Al-Siddiq regarding a piece of land in Adim, in which he ordered them to pay a tenth of Al-Wars. Al-Shafi'i said: I do not know whether this is established or not, and whether it is practiced in Yemen. If it is established, then the tenth could be either a small or large amount. The scholar said: There is no established Isnad (chain of narrators) for this, which could be considered as evidence, and the principle is that it is not obligatory. Therefore, nothing should be taken from other than what is mentioned in a valid narration or if it has a different meaning. And Allah knows best.
١٠۔٥٤ بَابُ مَا وَرَدَ فِي الْوَرْسِ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: أَخْبَرَنِي هِشَامُ بْنُ يُوسُفَ أَنَّ أَهْلَ حَفَاشٍ أَخْرَجُوا كِتَابًا مِنْ أَبِي بَكْرٍ الصِّدِّيقِ فِي قِطْعَةِ أَدِيمٍ إِلَيْهِمْ يَأْمُرُهُمْ بِأَنْ يُؤَدُّوا عُشْرَ الْوَرْسِ. قَالَ الشَّافِعِيُّ: وَلَا أَدْرِي أَثَابِتٌ هَذَا وَهُوَ يُعْمَلُ بِهِ بِالْيَمَنِ فَإِنْ كَانَ ثَابِتًا عُشْرٌ قَلِيلُهُ وَكَثِيرُهُ قَالَ الشَّيْخُ: لَمْ يَثْبُتْ فِي هَذَا إِسْنَادٌ تَقُومُ بِمِثْلِهِ حُجَّةٌ وَالْأَصْلُ أَنْ لَا وُجُوبَ فَلَا يُؤْخَذُ مِنْ غَيْرِ مَا وَرَدَ بِهِ خَبَرٌ صَحِيحٌ أَوْ كَانَ فِي غَيْرِ مَعْنَى مَا وَرَدَ بِهِ خَبَرٌ صَحِيحٌ وَاللهُ أَعْلَمُ
10.55 [Machine] What is mentioned in honey
١٠۔٥٥ بَابُ مَا وَرَدَ فِي الْعَسَلِ
[Machine] From the Prophet ﷺ , he said: "Honey is found in every ten marketplaces, there is a particular quality that distinguishes it. Likewise, Sadaqah bin Abdullah Al-Sameen is weak, and he has been weakened by Ahmad bin Hanbal, Yahya bin Ma'een, and others." Abu Isa Al-Tirmidhi said: "I asked Muhammad ibn Isma'il Al-Bukhari about this hadith, and he said it is narrated by Nafi' from the Prophet ﷺ as Mursal."
عَنِ النَّبِيِّ ﷺ قَالَ الْعَسَلُ فِي كُلِّ عَشَرَةِ أَزْقَاقٍ زِقٌّ تَفَرَّدَ بِهِ هَكَذَا صَدَقَةُ بْنُ عَبْدِ اللهِ السَّمِينُ وَهُوَ ضَعِيفٌ قَدْ ضَعَّفَهُ أَحْمَدُ بْنُ حَنْبَلٍ وَيَحْيَى بْنُ مَعِينٍ وَغَيْرُهُمَا وَقَالَ أَبُو عِيسَى التِّرْمِذِيُّ سَأَلْتُ مُحَمَّدَ بْنَ إِسْمَاعِيلَ الْبُخَارِيَّ عَنْ هَذَا الْحَدِيثِ فَقَالَ هُوَ عَنْ نَافِعٍ عَنِ النَّبِيِّ ﷺ مُرْسَلٌ
[Machine] I said, "O Messenger of Allah, I have some bees." He said, "Give away a tenth." I said, "O Messenger of Allah, help me carry them up the mountain." So, he helped me carry them up.
قُلْتُ يَا رَسُولَ اللهِ إِنَّ لِي نَحْلًا قَالَ أَدِّ الْعُشْرَ قُلْتُ يَا رَسُولَ اللهِ احْمِ لِي جَبَلَهَا فَحَمَاهُ لِي
[Machine] The Messenger of Allah ﷺ wrote to the people of Yemen that one-tenth of honey should be taken.
كَتَبَ رَسُولُ اللهِ ﷺ إِلَى أَهْلِ الْيَمَنِ أَنْ يُؤْخَذَ مِنَ الْعَسَلِ الْعُشْرُ
[Machine] One of the sons of Muta'an came to the Messenger of Allah ﷺ with a tenth of honey and asked him to protect a valley called Salaba for him. The Messenger of Allah ﷺ protected that valley for him. When Umar ibn Al-Khattab took over, Sufyan ibn Wahb wrote to him asking about it. Umar wrote back saying, "Give him what used to be given to the Messenger of Allah ﷺ from his tenth of honey, and protect the valley for him. Otherwise, it is only a swarm of flies that anyone can eat." Abu Ali reported from Muhammad, who reported from Abu Dawud, who reported from Ahmad ibn Abdeh Ad-Dabbi, who reported from Al-Mughirah ibn Abdul Rahman ibn Al-Harith Al-Makhzumi, who reported from his father, who reported from his grandfather, that Shababah bin Fahm mentioned something similar and said, "For every ten Qirat, there is a Qirbah." Sufyan ibn Abdullah Ath-Thaqafi also said, "He used to protect two valleys for them, and they would give him what they used to give to the Messenger of Allah ﷺ . He also protected their valleys for them." Usamah ibn Zaid narrated something similar from Amr.
جَاءَ هِلَالٌ أَحَدُ بَنِي مُتْعَانَ إِلَى رَسُولِ اللهِ ﷺ بِعُشُورِ نَحْلٍ لَهُ وَسَأَلَهُ أَنْ يَحْمِيَ وَادِيًا يُقَالُ لَهُ سَلَبَةُ فَحَمَى لَهُ رَسُولُ اللهِ ﷺ ذَلِكَ الْوَادِيَ فَلَمَّا تَوَلَّى عُمَرُ بْنُ الْخَطَّابِ ؓ كَتَبَ سُفْيَانُ بْنُ وَهْبٍ إِلَى عُمَرَ ؓ يَسْأَلُهُ عَنْ ذَلِكَ فَكَتَبَ إِلَيْهِ أَنْ أَدِّ إِلَيْكَ مَا كَانَ يُؤَدَّى إِلَى رَسُولِ اللهِ ﷺ مِنْ عُشُورِ نَحْلِهِ فَاحْمِ لَهُ سَلَبَةَ وَإِلَّا فَإِنَّمَا هُوَ ذُبَابُ غَيْثٍ يَأْكُلُهُ مَنْ شَاءَ 7461 وَأَخْبَرَنَا أَبُو عَلِيٍّ أنبأ مُحَمَّدٌ أنبأ أَبُو دَاوُدَ ثنا أَحْمَدُ بْنُ عَبْدَةَ الضَّبِّيُّ ثنا الْمُغِيرَةُ بْنُ عَبْدِ الرَّحْمَنِ بْنِ الْحَارِثِ الْمَخْزُومِيُّ حَدَّثَنِي أَبِي عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ أَنَّ شَبَابَةَ بَطْنٌ مِنْ فَهْمٍ فَذَكَرَ نَحْوَهُ وَقَالَ مِنْ كُلِّ عَشْرِ قِرَبٍ قِرْبَةٌ وَقَالَ سُفْيَانُ بْنُ عَبْدِ اللهِ الثَّقَفِيُّ قَالَ وَكَانَ يَحْمِي لَهُمْ وَادِيَيْنِ زَادَ فَأَدُّوا إِلَيْهِ مَا كَانُوا يُؤَدُّونَ إِلَى رَسُولِ اللهِ ﷺ وَحَمَى لَهُمْ وَادِيَيْهِمْ وَرَوَاهُ أَيْضًا أُسَامَةُ بْنُ زَيْدٍ عَنْ عَمْرٍو نَحْوَ ذَلِكَ
[Machine] I went to the Messenger of Allah ﷺ and embraced Islam. Then I said, "O Messenger of Allah, make something for my people that they can embrace Islam with from their wealth." So the Messenger of Allah ﷺ did so and appointed me to collect it from them. Abu Bakr also appointed me, then Umar appointed me. Saad was one of the people of Sura, and I spoke to my people about honey and said to them, "It is a form of charity because there is no good in a fruit that is not purified." They asked, "How much?" I said, "One tenth." So I took one tenth from them and went to Umar bin Khattab and informed him. Umar took it and sold it, and then placed its price in the charities of the Muslims.
قَدِمْتُ عَلَى رَسُولِ اللهِ ﷺ فَأَسْلَمْتُ ثُمَّ قُلْتُ يَا رَسُولَ اللهِ اجْعَلْ لِقَوْمِي مَا أَسْلَمُوا عَلَيْهِ مِنْ أَمْوَالِهِمْ فَفَعَلَ رَسُولُ اللهِ ﷺ وَاسْتَعْمَلَنِي عَلَيْهِمْ ثُمَّ اسْتَعْمَلَنِي أَبُو بَكْرٍ ثُمَّ عُمَرُ قَالَ وَكَانَ سَعْدٌ مِنْ أَهْلِ السُّرَاةِ قَالَ فَكَلَّمْتُ قَوْمِي فِي الْعَسَلِ فَقُلْتُ لَهُمْ زَكَاةٌ فَإِنَّهُ لَا خَيْرَ فِي ثَمَرَةٍ لَا تُزَكَّى فَقَالُوا كَمْ قَالَ؟ فَقُلْتُ الْعُشْرُ فَأَخَذْتُ مِنْهُمُ الْعُشْرَ فَأَتَيْتُ عُمَرَ بْنَ الْخَطَّابِ ؓ فَأَخْبَرْتُهُ بِمَا كَانَ قَالَ فَقَبَضَهُ عُمَرُ ؓ فَبَاعَهُ ثُمَّ جَعَلَ ثَمَنَهُ فِي صَدَقَاتِ الْمُسْلِمِينَ 7463 وَأَخْبَرَنَاهُ عَلِيُّ بْنُ أَحْمَدَ بْنِ عَبْدَانَ أنبأ أَحْمَدُ بْنُ عُبَيْدٍ الصَّفَّارُ ثنا عَبْدُ اللهِ بْنُ أَحْمَدَ بْنِ حَنْبَلٍ ثنا مُحَمَّدُ بْنُ عَبَّادٍ الْمَكِّيُّ ثنا أَنَسُ بْنُ عِيَاضٍ أَبُو ضَمْرَةَ فَذَكَرَهُ بِنَحْوِهِ وَرَوَاهُ عَبْدُ الرَّحْمَنِ بْنُ إِسْحَاقَ عَنِ ابْنِ أَبِي ذُبَابٍ عَنْ أَبِيهِ عَنْ جَدِّهِ فِي الْعَسَلِ وَرَوَاهُ الصَّلْتُ بْنُ مُحَمَّدٍ عَنْ أَنَسِ بْنِ عِيَاضٍ عَنِ الْحَارِثِ بْنِ أَبِي ذُبَابٍ عَنْ مُنِيرٍ هُوَ ابْنُ عَبْدِ اللهِ عَنْ أَبِيهِ عَنْ سَعْدٍ وَكَذَلِكَ
[Machine] Mu'adh, neither of them, the Messenger of Allah ﷺ did not command me anything regarding this.
مُعَاذٌ ؓ كِلَاهُمَا لَمْ يَأْمُرْنِي فِيهِ رَسُولُ اللهِ ﷺ بِشَيْءٍ
[Machine] "That the Messenger of Allah ﷺ did not command him to take charity from honey, and that it is something he saw, so he voluntary took it from his family. Al-Za'farani said, Abu Abdullah Al-Shafi'i said: The hadith about the tenth in honey is weak, and the hadith about not taking the tenth from it is weak, except for 'Umar Ibn Abdul Aziz. And my choice is that it is not taken from it because the Sunnah and the narrations are established in what is taken from it, and there is no establishment in it, as if it is forgiveness."
أَنَّ رَسُولَ اللهِ ﷺ لَمْ يَأْمُرْهُ بِأَخْذِ الصَّدَقَةِ مِنَ الْعَسَلِ وَأنَّهُ شَيْءٌ رَآهُ فَتَطَوَّعَ لَهُ بِهِ أَهْلُهُ قَالَ الزَّعْفَرَانِيُّ قَالَ أَبُو عَبْدِ اللهِ الشَّافِعِيُّ الْحَدِيثُ فِي أَنَّ فِي الْعَسَلِ الْعُشْرَ ضَعِيفٌ وَفِي أَنْ لَا يُؤْخَذَ مِنْهُ الْعُشْرُ ضَعِيفٌ إِلَّا عَنْ عُمَرَ بْنِ عَبْدِ الْعَزِيزِ وَاخْتِيَارِي أنَّهُ لَا يُؤْخَذُ مِنْهُ لِأَنَّ السُّنَنَ وَالْآثَارَ ثَابِتَةٌ فِيمَا يُؤْخَذُ مِنْهُ وَلَيْسَتْ فِيهِ ثَابِتَةٌ فَكَأنَّهُ عَفْوٌ
عَنِ الْعَسَلِ فَلَمْ يَرَ فِيهِ شَيْئًا
[Machine] The Prophet ﷺ sent Mu'adh to Yemen and mentioned something similar to it.
بَعَثَ النَّبِيُّ ﷺ مُعَاذًا إِلَى الْيَمَنِ وَذَكَرَ نَحْوَهُ
10.56 [Machine] Community of Charity Crop Donation
١٠۔٥٦ جُمَّاعُ أَبْوَابِ صَدَقَةِ الزَّرْعِ
10.57 [Machine] There is nothing in fruits and grains until each type of them reaches five osq (grains, e.g. rice, barley, etc.), then it becomes a form of charity to give from what has reached five osq.
١٠۔٥٧ بَابُ لَا شَيْءَ فِي الثِّمَارِ وَالْحُبُوبِ حَتَّى يَبْلُغَ كُلُّ صِنْفٍ مِنْهَا خَمْسَةَ أَوْسُقٍ فَيَكُونُ فِيمَا بَلَغَ مِنْهُ خَمْسَةَ أَوْسُقٍ صَدَقَةٌ
[Machine] From the Prophet ﷺ , he said, "There is no charity in love, nor in giving a bunch of dates less than five orusik."
عَنِ النَّبِيِّ ﷺ قَالَ لَا صَدَقَةَ فِي حَبٍّ وَلَا تَمْرٍ دُونَ خَمْسَةِ أَوْسُقٍ
No Sadaqa is payable on the grains and dates till it (comes to the Weight) of five wasqs, or less than five heads of camels, or less than five uqiyas (of silver). (Using translation from Muslim 979f)
أَنَّ النَّبِيَّ ﷺ قَالَ لَيْسَ فِي حَبٍّ وَلَا تَمْرٍ صَدَقَةٌ حَتَّى يَبْلُغَ خَمْسَةَ أَوْسُقٍ وَلَا فِيمَا دُونَ خَمْسِ ذَوْدٍ صَدَقَةٌ وَلَا فِيمَا دُونَ خَمْسِ أَوَاقٍ صَدَقَةٌ
[Machine] The Prophet ﷺ said: "There is no charity in crops, vineyards, or palm trees except for what reaches five wasqs, which is equivalent to one hundred saa'."
قَالَ النَّبِيُّ ﷺ لَا صَدَقَةَ فِي الزَّرْعِ وَلَا فِي الْكَرْمِ وَلَا فِي النَّخْلِ إِلَّا مَا بَلَغَ خَمْسَةَ أَوْسُقٍ وَذَلِكَ مِائَةُ فَرْقٍ
[Machine] "The Messenger of Allah ﷺ said that a Muslim man is not required to pay Zakat on his nobility, nor on his cultivation if it is less than five awsuq."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَيْسَ عَلَى الرَّجُلِ الْمُسْلِمِ زَكَاةٌ فِي كَرْمِهِ وَلَا فِي زَرْعِهِ إِذَا كَانَ أَقَلَّ مِنْ خَمْسَةِ أَوْسُقٍ
[Machine] It is not permissible to mix wheat and barley, or dates and raisins, in charity, unless each individual does not reach five wasaq.
لَا يُجْمَعُ بَيْنَ الْحِنْطَةِ وَالشَّعِيرِ وَلَا بَيْنَ التَّمْرِ وَالزَّبِيبِ فِي الصَّدَقَةِ إِذَا لَمْ يَبْلُغْ كُلُّ وَاحِدٍ خَمْسَةَ أَوْسَاقٍ
10.58 [Machine] Charity in what humans sow, dry, hoard, and consume without the earth producing it from greens.
١٠۔٥٨ بَابُ الصَّدَقَةِ فِيمَا يَزْرَعُهُ الْآدَمِيُّونَ وَيَيْبَسُ وَيُدَّخَرُ وَيُقْتَاتُ دُونَ مَا تُنْبِتُهُ الْأَرْضُ مِنَ الْخُضَرِ.
[Machine] Narrated by the Prophet ﷺ, he mentioned that he only took charity from wheat, barley, raisins, and dates. It was also narrated by Abdullah ibn al-Walid al-Adani from Sufyan, who added that al-Hajjaj sent Musa ibn al-Mughira to al-Khudr and as-Sawad and he wanted to take dates and grains from al-Khudr. Musa ibn Talha informed him that there was a book with them from Mu'adh, that the Messenger of Allah ﷺ ordered to take wheat, barley, raisins, and dates. So he wrote to al-Hajjaj about it, and al-Hajjaj said: "He has spoken the truth." Muhammad ibn Ibrahim al-Asbahani informed us, who was informed by Abu Nasr al-'Iraqi, who was told by Sufyan ibn Muhammad al-Jawhari, who was told by Ali ibn al-Hasan, who was told by Abdullah, and he mentioned it.
عَنِ النَّبِيِّ ﷺ أنَّهُ إِنَّمَا أَخَذَ الصَّدَقَةَ مِنَ الْحِنْطَةِ وَالشَّعِيرِ وَالزَّبِيبِ وَالتَّمْرِ 7475 وَرَوَاهُ عَبْدُ اللهِ بْنُ الْوَلِيدِ الْعَدَنِيُّ عَنْ سُفْيَانَ وَزَادَ فِيهِ قَالَ بَعَثَ الْحَجَّاجُ بِمُوسَى بْنِ الْمُغِيرَةِ عَلَى الْخُضَرِ وَالسَّوَادِ فَأَرَادَ أَنْ يَأْخُذَ مِنَ الْخُضَرِ الرِّطَابِ وَالْبُقُولِ فَقَالَ مُوسَى بْنُ طَلْحَةَ عِنْدَنَا كِتَابُ مُعَاذٍ عَنْ رَسُولِ اللهِ ﷺ أنَّهُ أَمَرَهُ أَنْ يَأْخُذَ مِنَ الْحِنْطَةِ وَالشَّعِيرِ وَالتَّمْرِ وَالزَّبِيبِ قَالَ فَكَتَبَ إِلَى الْحَجَّاجِ فِي ذَلِكَ فَقَالَ صَدَقَ أَخْبَرَنَاهُ مُحَمَّدُ بْنُ إِبْرَاهِيمَ الْأَصْبَهَانِيُّ أنبأ أَبُو نَصْرٍ الْعِرَاقِيُّ ثنا سُفْيَانُ بْنُ مُحَمَّدٍ الْجَوْهَرِيُّ ثنا عَلِيُّ بْنُ الْحَسَنِ ثنا عَبْدُ اللهِ فَذَكَرَهُ
[Machine] "From the Messenger of Allah ﷺ , he said: 'So they wrote that to al-Hajjaj, and al-Hajjaj wrote that Musa bin Talha is more knowledgeable than Musa bin al-Mughira.'"
عَنْ رَسُولِ اللهِ ﷺ قَالَ فَكَتَبُوا بِذَلِكَ إِلَى الْحَجَّاجِ فَكَتَبَ الْحَجَّاجُ أَنَّ مُوسَى بْنَ طَلْحَةَ أَعْلَمُ مِنْ مُوسَى بْنِ الْمُغِيرَةِ
[Machine] The Messenger of Allah ﷺ said that when the sky, palm tree, and mountain give water, it is a tenth. And when it is given by means of surface water, then it is half of the tenth. And this only applies to dates, wheat, and grains. As for cucumber, watermelon, pomegranate, and squash, the Messenger of Allah ﷺ pardoned them. This was narrated by Yahya ibn al-Mughira from Ibn Nafi' who said that the Messenger of Allah ﷺ pardoned cucumber and green vegetables. Abu Bakr ibn al-Harith al-Faqih informed us, and Ali ibn Umar al-Hafiz narrated to us, and Ali ibn Ahmad al-Azraq in Egypt narrated to us, and Muhammad ibn Muhammad ibn al-Naffah narrated to us, and Yahya ibn al-Mughira mentioned it with addition.
أَنَّ رَسُولَ اللهِ ﷺ قَالَ فِيمَا سَقَتِ السَّمَاءُ وَالْبَعْلُ وَالسَّيْلُ الْعُشْرُ وَفِيمَا سُقِيَ بِالنَّضْحِ نِصْفُ الْعُشْرِ وَإِنَّمَا يَكُونُ ذَلِكَ فِي التَّمْرِ وَالْحِنْطَةِ وَالْحُبُوبِ فَأَمَّا الْقِثَّاءُ وَالْبِطِّيخُ وَالرُّمَّانُ وَالْقَضْبُ فَقَدْ عَفَا عَنْهُ رَسُولُ اللهِ ﷺ 7478 وَرَوَاهُ يَحْيَى بْنُ الْمُغِيرَةِ عَنِ ابْنِ نَافِعٍ فَقَالَ الْقَضْبُ وَالْخُضَرُ فَقَدْ عَفَا عَنْهُ رَسُولُ اللهِ ﷺ أَخْبَرَنَا أَبُو بَكْرِ بْنُ الْحَارِثِ الْفَقِيهُ أنبأ عَلِيُّ بْنُ عُمَرَ الْحَافِظُ ثنا عَلِيُّ بْنُ أَحْمَدَ الْأَزْرَقُ بِمِصْرَ ثنا مُحَمَّدُ بْنُ مُحَمَّدِ بْنِ النَّفَّاحِ ثنا يَحْيَى بْنُ الْمُغِيرَةِ فَذَكَرَهُ بِزِيَادَتِهِ
[Machine] Charity during the time of the Messenger of Allah ﷺ only consisted of five things: wheat, barley, dates, raisins, and maize.
لَمْ تَكُنِ الصَّدَقَةُ فِي عَهْدِ رَسُولِ اللهِ ﷺ إِلَّا فِي خَمْسَةِ أَشْيَاءَ الْحِنْطَةِ وَالشَّعِيرِ وَالتَّمْرِ وَالزَّبِيبِ وَالذُّرَةِ
[Machine] The Messenger of Allah ﷺ did not impose (taxes) except on ten things: camels, cows, sheep, gold, silver, wheat, barley, dates, and raisins. Ibn 'Uyaynah said, "I think he also imposed (taxes) on corn."
لَمْ يَفْرِضْ رَسُولُ اللهِ ﷺ إِلَّا فِي عَشَرَةِ أَشْيَاءَ الْإِبِلِ وَالْبَقَرِ وَالْغَنَمِ وَالذَّهَبِ وَالْفِضَّةِ وَالْحِنْطَةِ وَالشَّعِيرِ وَالتَّمْرِ وَالزَّبِيبِ قَالَ ابْنُ عُيَيْنَةَ أُرَاهُ قَالَ وَالذُّرَةُ
[Machine] The Prophet Muhammad ﷺ only specified charitable giving in ten instances. He mentioned them and mentioned in them the value of dates, but did not mention corn.
لَمْ يَجْعَلْ رَسُولُ اللهِ ﷺ الصَّدَقَةَ إِلَّا فِي عَشَرَةٍ فَذَكَرَهُنَّ وَذَكَرَ فِيهِنَّ السُّلْتَ وَلَمْ يَذْكُرِ الذُّرَةَ
[Machine] "Messenger of Allah ﷺ to the people of Yemen. Indeed, charity consists of wheat, barley, dates, and raisins. All of these hadiths are narrations except that they are from different sources. Some of them confirm others, along with the narration of Abu Burdah from Abu Musa. They have already been mentioned in the chapter of palm trees, and it includes the statement of some companions."
رَسُولُ اللهِ ﷺ إِلَى أَهْلِ الْيَمَنِ إِنَّمَا الصَّدَقَةُ فِي الْحِنْطَةِ وَالشَّعِيرِ وَالتَّمْرِ وَالزَّبِيبِ هَذِهِ الْأَحَادِيثُ كُلُّهَا مَرَاسِيلُ إِلَّا أَنَّهَا مِنْ طُرُقٍ مُخْتَلِفَةٍ فَبَعْضُهَا يُؤَكِّدُ بَعْضًا وَمَعَهَا رِوَايَةُ أَبِي بُرْدَةَ عَنْ أَبِي مُوسَى وَقَدْ مَضَتْ فِي بَابِ النَّخْلِ وَمَعَهَا قَوْلُ بَعْضِ الصَّحَابَةِ ؓ
عَنْ عُمَرَ بْنِ الْخَطَّابِ ؓ فِي بَابِ النَّخْلِ
[Machine] It was narrated that it was elevated to the Prophet ﷺ and it was narrated from Aisha that the sunnah was practiced with it, but there is no zakat in what is grown from the green vegetation. And Abu Sa'id told us that Abu Al-Abbas Al-Asamm told us that Al-Hasan ibn Ali told us that Yahya ibn Adam told us that Ibn Mubarak narrated from Ibn Jurayj from Ata that he said: There is no charity except in dates, grapes, or grains, and there is no charity in anything from green vegetation or fruits.
ؓ مَرْفُوعًا إِلَى النَّبِيِّ ﷺ وَرُوِيَ عَنْ عَائِشَةَ ؓ فِيمَا ذَكَرَتْ أَنَّ السُّنَّةَ جَرَتْ بِهِ وَلَيْسَ فِيمَا نَبَتَتِ الْأَرْضُ مِنَ الْخُضَرِ زَكَاةٌ 7484 وَأَخْبَرَنَا أَبُو سَعِيدٍ ثنا أَبُو الْعَبَّاسِ الْأَصَمُّ ثنا الْحَسَنُ بْنُ عَلِيٍّ ثنا يَحْيَى بْنُ آدَمَ ثنا ابْنُ الْمُبَارَكِ عَنِ ابْنِ جُرَيْجٍ عَنْ عَطَاءٍ قَالَ لَا صَدَقَةَ إِلَّا فِي نَخْلٍ أَوْ عِنَبٍ أَوْ حَبٍّ وَلَيْسَ فِي شَيْءٍ مِنَ الْخُضَرِ بَعْدُ وَالْفَوَاكِهِ كُلِّهَا صَدَقَةٌ
10.59 [Machine] The amount of charity that the Earth has produced.
١٠۔٥٩ بَابُ قَدْرِ الصَّدَقَةِ فِيمَا أَخْرَجَتِ الْأَرْضُ.
[Machine] "About the Messenger of Allah ﷺ , it was narrated that he would fast when the sky was cloudy, and the wells were full. Or he would fast whenever it rained half of the month."
عَنْ رَسُولِ اللهِ ﷺ أنَّهُ سَنَّ فِيمَا سَقَتِ السَّمَاءُ وَالْعُيُونُ أَوْ كَانَ عَثَرِيًّا الْعُشْرَ وَفِيمَا سُقِيَ بِالنَّضْحِ نِصْفَ الْعُشْرِ
[Machine] He used to say that the zakat of fruits and crops is what comes from date palms, grapes, or crops of wheat, barley, or salted produce that was irrigated by a river, spring, or rainfall. In it, one-tenth is due from every ten (produce). And what is irrigated by drainage, one-half of one-tenth from every twenty (produce) is due. The Prophet ﷺ wrote to the people of Yemen, to al-Harith ibn 'Abd Kilal and those who are with him, from Ma'afir and Hamdan, regarding the believers' zakat of fruits or he said the 'Aqar is one-tenth of what the spring irrigates and what the sky waters, and half of one-tenth for what is irrigated by irrigation channels to the west. The sheikh said, "This is what I found connected to the hadith, and in his statement 'upon the believers,' it is like an indication that it is not taken from the people of the covenant. And Allah knows best."
أنَّهُ كَانَ يَقُولُ صَدَقَةُ الثِّمَارِ وَالزَّرْعِ مَا كَانَ مِنْ نَخْلٍ أَوْ عِنَبٍ أَوْ زَرْعٍ مِنْ حِنْطَةٍ أَوْ شَعِيرٍ أَوْ سُلْتٍ وَسُقِيَ بِنَهْرٍ أَوْ سُقِيَ بِالْعَيْنِ أَوْ عَثَرِيًّا يُسْقَى بِالْمَطَرِ فَفِيهِ الْعُشْرُ مِنْ كُلِّ عَشَرَةٍ وَاحِدٌ وَمَا كَانَ يُسْقَى بِالنَّضْحِ فَفِيهِ نِصْفُ الْعُشْرِ مِنْ كُلِّ عِشْرِينَ وَاحِدٌ وَكَتَبَ النَّبِيُّ ﷺ إِلَى أَهْلِ الْيَمَنِ إِلَى الْحَارِثِ بْنِ عَبْدِ كُلَالٍ وَمَنْ مَعَهُ مِنْ مَعَافِرَ وَهَمْدَانَ عَلَى الْمُؤْمِنِينَ فِي صَدَقَةِ الثِّمَارِ أَوْ قَالَ الْعَقَارُ عُشْرُ مَا تَسْقِي الْعَيْنُ وَمَا سَقَتِ السَّمَاءُ وَعَلَى مَا يُسْقَى بِالْغَرْبِ نِصْفُ الْعُشْرِ قَالَ الشَّيْخُ هَكَذَا وَجَدْتُهُ مَوْصُولًا بِالْحَدِيثِ وَفِي قَوْلِهِ عَلَى الْمُؤْمِنِينَ كَالدَّلَالَةِ عَلَى أَنَّهَا لَا تُؤْخَذُ مِنْ أَهْلِ الذِّمَّةِ وَاللهُ أَعْلَمُ
[Machine] "That the Messenger of Allah ﷺ said regarding what the rivers and clouds have watered, a tenth (of the reward) and regarding what has been watered by a bucket, half of the reward."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ فِيمَا سَقَتِ الْأَنْهَارُ وَالْغَيْمُ الْعُشْرُ وَفِيمَا سُقِيَ بِالسَّانِيَةِ نِصْفُ الْعُشْرِ
[Machine] That the Messenger of Allah ﷺ said regarding what the sky, eyes, and watered fields receive, one-tenth and regarding what is watered by natural irrigation, one-half of one-tenth.
أَنَّ رَسُولَ اللهِ ﷺ قَالَ فِيمَا سَقَتِ السَّمَاءُ وَالْعُيُونُ وَالْبَعْلُ الْعُشْرُ وَفِيمَا سُقِيَ بِالنَّضْحِ نِصْفُ الْعُشْرِ
[Machine] The Messenger of Allah ﷺ said: "When the sky has rained a tenth, and it has been watered by natural springs, it is half of a tenth." Asim reported to us from Malik who said: I was informed by Sulaiman ibn Yasar and Busr ibn Sa'id, and Ibn Abi Dhubab left out mentioning the objectionable aspects in his narration. The scholar said: This hadith is sufficient without the narration of Ibn Abi Dhubab, as we have narrated it with two authentic chains from Ibn Umar, from the Prophet ﷺ , and with an authentic chain from Jabir, from the Prophet ﷺ , and this is the saying of the majority. They did not differ regarding it. And the hadith of Amr ibn Hazm, its mention has already passed.
أَنَّ رَسُولَ اللهِ ﷺ قَالَ فِيمَا سَقَتِ السَّمَاءُ الْعُشْرُ وَفِيمَا سُقِيَ بِالنَّضْحِ نِصْفُ الْعُشْرِ قَالَ عَاصِمٌ حَدَّثَنَا مَالِكٌ قَالَ خُبِّرْتُ عَنْ سُلَيْمَانَ بْنِ يَسَارٍ وَبُسْرِ بْنِ سَعِيدٍ وَتَرَكَ ابْنَ أَبِي ذُبَابٍ لِلْمُنْكَرَاتِ الَّتِي فِي رِوَايَتِهِ قَالَ الشَّيْخُ هَذَا الْحَدِيثُ مُسْتَغْنٍ عَنْ رِوَايَةِ ابْنِ أَبِي ذُبَابٍ فَقَدْ رُوِّينَاهُ بِإِسْنَادَيْنِ صَحِيحَيْنِ عَنِ ابْنِ عُمَرَ عَنِ النَّبِيِّ ﷺ وَبِإِسْنَادٍ صَحِيحٍ عَنْ جَابِرٍ عَنِ النَّبِيِّ ﷺ وَهُوَ قَوْلُ الْعَامَّةِ لَمْ يَخْتَلِفُوا فِيهِ وَحَدِيثُ عَمْرِو بْنِ حَزْمٍ قَدْ مَضَى ذِكْرُهُ
"The Messenger of Allah sent me to Yemen and he commanded me to take one-tenth of whatever is irrigated by the sky, and half of one-tenth of whatever is irrigated by means of buckets." (Using translation from Nasāʾī 2490)
بَعَثَنِي رَسُولُ اللهِ ﷺ إِلَى الْيَمَنِ وَأَمَرَنِي أَنْ آخُذَ مِمَّا سَقَتِ السَّمَاءُ وَمَا سُقِيَ بَعْلًا الْعُشْرُ وَمَا سُقِيَ بِالدَّوَالِي نِصْفُ الْعُشْرِ
[Machine] As for what the sky provided and what was watered, it opened up tenfold and was not watered by a bucket, but by half of the ten.
فِيمَا سَقَتِ السَّمَاءُ وَمَا سُقِيَ فَتْحًا الْعُشْرُ وَمَا سُقِيَ دَلْوًا فَنِصْفُ الْعُشْرِ
[Machine] What the sky has watered is one out of every ten, and what has been watered in the west is one out of every twenty.
مَا سَقَتِ السَّمَاءُ فَمِنْ كُلِّ عَشَرَةٍ وَاحِدٌ وَمَا سُقِيَ بِالْغَرْبِ فَمَنْ كُلِّ عِشْرِينَ وَاحِدٌ
[Machine] The Messenger of Allah ﷺ mandated that a tenth of the produce be given in cases of rainwater, river water, and well water, but only a fifth of the produce is to be given in cases of water from springs. Hatim said: "Ghayl is what is watered in abundance, and Ba'l is the fertility that is watered by rainwater." Yahya bin Adam asked Aba Iyas (meaning Asadi), who said: "Ba'l, Athari, and 'Adhi are what are watered by rainwater." Yahya said: "'Adhi is what is specially grown for rainclouds and is only watered by rainwater. That is 'Adhi, and Ba'l is what comes from vineyards whose roots have reached the water in the ground, so it does not need to be watered for five years, and it can tolerate not being watered for six years. This is Ba'l. The Sayl is the water of the valley when it flows, and as for Ghayl, it is a flood without excessive water flow. When there is little water flow with pure water, it is Ghayl, and 'Adhi is the water of rain."
فَرَضَ رَسُولُ اللهِ ﷺ فِيمَا سَقَتِ السَّمَاءُ أَوْ سُقِيَ بِالسَّيْلِ وَالْغَيْلِ وَالْبَعْلِ الْعُشْرُ وَمَا سُقِيَ بِالنَّوَاضِحِ فَنِصْفُ الْعُشْرِ قَالَ حَاتِمٌ الْغَيْلُ مَا سُقِيَ فَتْحًا وَالْبَعْلُ هُوَ الْعَذْيُ الَّذِي يَسْقِيَهِ مَاءُ الْمَطَرِ قَالَ يَحْيَى بْنُ آدَمَ وَسَأَلْتُ أَبَا إِيَاسٍ يَعْنِي الْأَسَدِيَّ فَقَالَ الْبَعْلُ وَالْعَثَرِيُّ وَالْعَذْيُ هُوَ الَّذِي يُسْقَى بِمَاءِ السَّمَاءِ قَالَ يَحْيَى الْعَثَرِيُّ مَا يُزْرَعُ لِلْسَحَابِ لِلْمَطَرِ خَاصَّةً لَيْسَ يُسْقَى إِلَّا بِمَاءٍ يُصِيبُهُ مِنَ الْمَطَرِ فَذَلِكَ الْعَثَرِيُّ وَالْبَعْلُ مَا كَانَ مِنَ الْكُرُومِ قَدْ ذَهَبَتْ عُرُوقُهُ فِي الْأَرْضِ إِلَى الْمَاءِ فَلَا يَحْتَاجُ إِلَى السَّقْيِ الْخَمْسَ السِّنِينَ وَالسِّتَّ يَحْتَمِلُ تَرْكَ السَّقْيِ فَهَذَا الْبَعْلُ وَالسَّيْلُ مَاءُ الْوَادِي إِذَا سَالَ وَأَمَّا الْغَيْلُ فَهُوَ سَيْلٌ دُونَ السَّيْلِ الْكَثِيرِ إِذَا سَالَ الْقَلِيلُ بِالْمَاءِ الصَّافِي فَهُوَ الْغَيْلُ وَالْعَذْيُ مَاءُ الْمَطَرِ
[Machine] The passage says: "Do the Zakah (charity) go on the land that is watered by rainfall or the land that is watered by irrigation, or do they go on both? He said: The Zakah goes on the one that is watered more. Yahya bin Adam said: It is specified by the portion."
عَنِ الْأَرْضِ تُسْقَى بِالسَّيْحِ ثُمَّ تُسْقَى بِالدَّوَالِي أَوْ تُسْقَى بِالدَّوَالِي ثُمَّ بِالسَّيْحِ عَلَى أَيِّهِمَا تُؤْخَذُ الزَّكَاةُ؟ قَالَ عَلَى أَكْثَرِهِمَا تُسْقَى بِهِ قَالَ يَحْيَى بْنُ آدَمَ تُزَكَّى بِالْحِصَّةِ
[Machine] He used to bring food from his land and give his charity, then he would hoard it for a year or two without purifying it, and he intended to sell it. Abu Al-Rabi'i said, "Then I heard it from Ibn Al-Mubarak's son."
أنَّهُ كَانَ يُخْرِجُ لَهُ الطَّعَامَ مِنْ أَرْضِهِ فَيُعْطِي صَدَقَتَهُ ثُمَّ يَحْبِسُهُ السَّنَةَ أَوِ السَّنَتَيْنِ وَلَا يُزَكِّيهِ وَهُوَ يُرِيدُ بَيْعَهُ قَالَ أَبُو الرَّبِيعِ ثُمَّ سَمِعْتُهُ أَنَا بَعْدُ مِنَ ابْنِ الْمُبَارَكِ
10.60 [Machine] The Muslim cultivates land from the land of kharaaj so that upon his cultivation, the tithe or half-tithe is due upon him. God Almighty said: "Take from their wealth a charity to purify them" [9:103] and He said: "And give its due on the day of its harvest" [6:141] and He said: "And from what We have produced for you from the earth" [2:267]. The Prophet ﷺ said: "There is no charity in less than five awsuq" and he said: "In what is watered by the sky and springs, the tithe is due and in what is irrigated by other means, half-tithe is due.
١٠۔٦٠ بَابُ الْمُسْلِمِ يَزْرَعُ أَرْضًا مِنْ أَرْضِ الْخَرَاجِ فَيَكُونُ عَلَيْهِ فِي زَرْعِهِ الْعُشْرُ أَوْ نِصْفُ الْعُشْرِ. قَالَ اللهُ تَعَالَى: {خُذْ مِنْ أَمْوَالِهِمْ صَدَقَةً تُطَهِّرُهُمْ} [التوبة: 103] وَقَالَ: {وَآتُوا حَقَّهُ يَوْمَ حَصَادِهِ} [الأنعام: 141] وَقَالَ: {وَمِمَّا أَخْرَجْنَا لَكُمْ مِنَ الْأَرْضِ} [البقرة: 267] وَقَالَ النَّبِيُّ ﷺ: " لَيْسَ فِيمَا دُونَ خَمْسَةِ أَوْسُقٍ صَدَقَةٌ " , وَقَالَ: " فِيمَا سَقَتِ السَّمَاءُ وَالْعُيُونُ الْعُشْرُ وَفِيمَا سُقِيَ بِالنَّضْحِ نِصْفُ الْعُشْرِ ".
[Machine] About a Muslim who has land in his possession and is asked about paying Zakat, he says, "Indeed, I have to pay the Kharaaj." The Kharaaj is due on the land, and the Zakat is due on the crops." I asked him again and he replied with the same response.
عَنْ مُسْلِمٍ يَكُونُ فِي يَدَهِ أَرْضُ الْخَرَاجِ فَيُسْأَلُ الزَّكَاةَ فَيَقُولُ إِنَّ عَلَيَّ الْخَرَاجَ قَالَ الْخَرَاجُ عَلَى الْأَرْضِ وَفِي الْحَبِّ الزَّكَاةُ قَالَ وَسَأَلْتُهُ مَرَّةً أُخْرَى فَقَالَ مِثْلَ ذَلِكَ
