10. Zakāh (Prescribed Charity) (8/13)
١٠۔ كِتَابُ الزَّكَاةِ ص ٨
[Machine] God Almighty said, "And they were not commanded except to worship Allah, [being] sincere to Him in religion, inclining to truth, and to establish prayer and to give zakah. And that is the correct religion." [Al-Bayyinah: 5]
قَالَ اللهُ ﷻ {وَمَا أُمِرُوا إِلَّا لِيَعْبُدُوا اللهَ مُخْلِصِينَ لَهُ الدِّينَ حُنَفَاءَ وَيُقِيمُوا الصَّلَاةَ وَيُؤْتُوا الزَّكَاةَ وَذَلِكَ دِينُ الْقَيِّمَةِ} [البينة: 5]
[Machine] Uthman ibn Affan used to say, "This is the month of your Zakat, so whoever has a debt should pay off his debt before you pay your Zakat, so that your wealth may be collected, and you may pay the Zakat from it."
أَنَّ عُثْمَانَ بْنَ عَفَّانَ ؓ كَانَ يَقُولُ هَذَا شَهْرُ زَكَاتِكُمْ فَمَنْ كَانَ عَلَيْهِ دَيْنٌ فَلْيُؤَدِّ دَيْنَهُ حَتَّى تُحَصَّلَ أَمْوَالُكُمْ فَتُؤَدُّونَ مِنْهَا الزَّكَاةَ
[Machine] He heard Uthman ibn Affan delivering a sermon from the pulpit of the Messenger of Allah ﷺ , saying, "This is the month of your zakat, and the month has not been named for me as the month of shafts, and I have not asked about it." Uthman then said, "So whoever among you has a debt, let him pay off his debt until your wealth is clear, and then you will pay zakat from it."
أَنَّهُ سَمِعَ عُثْمَانَ بْنَ عَفَّانَ ؓ خَطِيبًا عَلَى مَنْبَرِ رَسُولِ اللهِ ﷺ يَقُولُ هَذَا شَهْرُ زَكَاتِكُمْ وَلَمْ يُسَمِّ لِيَ السَّائِبُ الشَّهْرَ وَلَمْ أَسْأَلْهُ عَنْهُ قَالَ فَقَالَ عُثْمَانُ فَمَنْ كَانَ مِنْكُمْ عَلَيْهِ دَيْنٌ فَلْيَقْضِ دَيْنَهُ حَتَّى تَخْلُصَ أَمْوَالُكُمْ فَتُؤَدُّوا مِنْهَا الزَّكَاةَ
[Machine] Ibn Abbas said, "He spends what he has earned on the fruit and then he purifies what remains."
وَقَالَ ابْنُ عَبَّاسٍ يَقْضِي مَا أَنْفَقَ عَلَى الثَّمَرَةِ ثُمَّ يُزَكِّي مَا بَقِيَ
لَيْسَ عَلَيْهِ صَدَقَةٌ
ادْفَعْ نَفَقَتَكَ وَزَكِّ مَا بَقِيَ
[Machine] "There is no obligation of Zakat on a man's wealth if he has debts that exceed his wealth." 7612 He said, and Yahya narrated to us, on the authority of Ibn Al-Mubarak, from Hisham, from Al-Hasan, the like of it.
لَيْسَ عَلَى الرَّجُلِ زَكَاةٌ فِي مَالِهِ إِذَا كَانَ عَلَيْهِ دَيْنٌ يُحِيطُ بِمَالِهِ 7612 قَالَ وَحَدَّثَنَا يَحْيَى ثنا ابْنُ الْمُبَارَكِ عَنْ هِشَامٍ عَنِ الْحَسَنِ مِثْلَهُ
[Machine] "You are not responsible for his debt, but it is obligated on the owner of the debt to pay it."
مَا عَلَيْكَ مِنَ الدَّيْنِ فَزَكَاتُهُ عَلَى صَاحِبِهِ
Muhammad bin Ja'far narrated to us, from Shu'bah, from Amr bin Murrah who said: "I asked Abu Ubaidah bin Abdullah: 'Did you remember anything from Abdullah?' He said, 'No'" (Using translation from Tirmidhī 624)

[Machine] About the man who borrows against his wall and his field what surrounds what his land produces, he said, "We do not know in the Sunnah that if a man has a debt upon him, his cultivation or his crops should not be purified. However, he purifies it and upon him is his debt. As for the man who has gold and silver upon which he has a debt, he does not purify it until he settles the debt."
عَنِ الرَّجُلِ يَسْتَسْلِفُ عَلَى حَائِطِهِ وَحَرْثِهِ مَا يُحِيطُ بِمَا تُخْرِجُ أَرْضُهُ فَقَالَ لَا نَعْلَمُ فِي السُّنَّةِ أَنْ يُتْرَكَ حَرْثُ أَوْ ثَمَرُ رَجُلٍ عَلَيْهِ فِيهِ دَيْنٌ فَلَا يُزَكِّي وَلَكِنَّهُ يُزَكِّي وَعَلَيْهِ دَيْنُهَ فَأَمَّا الرَّجُلُ يَكُونُ لَهُ ذَهَبٌ وَوَرِقٌ عَلَيْهِ فِيهِ دَيْنٌ فَإِنَّهُ لَا يُزَكِّي حَتَّى يَقْضِيَ الدَّيْنَ
[Machine] This sheikh is the Shafi'i school of thought in the old days, distinguishing between the apparent wealth and the hidden wealth in that.
الشَّيْخُ هَذَا هُوَ مَذْهَبُ الشَّافِعِيِّ فِي الْقَدِيمِ فَرَّقَ فِي ذَلِكَ بَيْنَ الْأَمْوَالِ الظَّاهِرَةِ وَالْأَمْوَالِ الْبَاطِنَةِ
فَكَلَّمْتُهُ حَتَّى رَجَعَ عَنْهُ
[Machine] He said that a person should purify his wealth even if he has debts equal to it, because he uses it and gets married with it. The scholar and the apparent evidence that came with the obligation of zakat on wealth testify to the authenticity of this statement, and it is the statement of Al-Shafi'i in the modern sense. He used to say that the hadith of Uthman is similar. Allah knows best whether or not He commanded the Payment of debt before the distribution of zakat on wealth. His statement, "this is the month of your zakat" could mean that this is the month when your zakat becomes due, like saying "the month of Dhul-Hijjah" even though the Hajj comes after a few days from it. Abu Sa'id informed us of this statement, Abu Abbas narrated it, and Al-Rabi'a reported that Al-Shafi'i mentioned it.
أَنَّهُ قَالَ يُزَكِّي الرَّجُلُ مَالَهُ وَإِنْ كَانَ عَلَيْهِ مِنَ الدَّيْنِ مِثْلُهُ؛ لَأَنَّهُ يَأْكُلُ مِنْهُ وَيَنْكِحُ فِيهِ قَالَ الشَّيْخُ وَالظَّوَاهِرُ الَّتِي وَرَدَتْ بِإِيجَابِ الزَّكَاةِ فِي الْأَمْوَالِ تَشْهَدُ لِهَذَا الْقَوْلِ بِالصِّحَّةِ وَهُوَ قَوْلُ الشَّافِعِيِّ فِي الْجَدِيدِ وَكَانَ يَقُولُ حَدِيثُ عُثْمَانَ يُشْبِهُ وَاللهُ أَعْلَمُ أَنْ يَكُونَ إِنَّمَا أَمَرَ بِقَضَاءِ الدَّيْنِ قَبْلَ حُلُولِ الصَّدَقَةِ فِي الْمَالِ وَقَوْلُهُ هَذَا شَهْرُ زَكَاتِكُمْ يَجُوزُ أَنْ يَقُولَ هَذَا الشَّهْرُ الَّذِي إِذَا مَضَى حَلَّتْ زَكَاتُكُمْ كَمَا يُقَالُ شَهْرُ ذِي الْحِجَّةِ وَإِنَّمَا الْحِجَّةُ بَعْدَ مُضَيِّ أَيَّامٍ مِنْهُ أَخْبَرَنَا بِهَذَا الْكَلَامِ أَبُو سَعِيدٍ ثنا أَبُو الْعَبَّاسِ أَنْبَأَ الرَّبِيعُ قَالَ قَالَ الشَّافِعِيُّ فَذَكَرَهُ
10.90 [Machine] The Zakat of Debt When It Is Payable
١٠۔٩٠ بَابُ زَكَاةِ الدَّيْنِ إِذَا كَانَ عَلَى مَلِيٍّ مُوَفًّى
[Machine] "Zakkihi" means to purify one's debt when it is in the possession of individuals.
زَكِّهِ يَعْنِي الدَّيْنَ إِذَا كَانَ عِنْدَ الْمُلَاءِ
[Machine] Abdullah ibn Abbas and Abdullah ibn Umar said, "Whoever gives wealth in advance, must pay its Zakat every year if it reaches the nisab (minimum amount) and he is financially capable."
أَنَّ عَبْدَ اللهِ بْنَ عَبَّاسٍ وَعَبْدَ اللهِ بْنَ عُمَرَ قَالَا مَنْ أَسْلَفَ مَالًا فَعَلَيْهِ زَكَاتُهُ فِي كُلِّ عَامٍ إِذَا كَانَ فِي ثِقَةٍ
عَنْ ثَوْرٍ
[Machine] Al-Hasan, Tawus, Mujahid, Al-Qasim ibn Muhammad, Al-Zuhri, and Al-Nakha'i.
الْحَسَنِ وَطَاوُسٍ وَمُجَاهِدٍ وَالْقَاسِمِ بْنِ مُحَمَّدٍ وَالزُّهْرِيِّ وَالنَّخَعِيِّ
10.91 [Machine] Zakat of debt when it is upon a person who is in difficulty or a fighter.
١٠۔٩١ بَابُ زَكَاةِ الدَّيْنِ إِذَا كَانَ عَلَى مُعْسِرٍ أَوْ جَاحِدٍ.
[Machine] Abu Ubaid said about the saying of Ali regarding a person who has doubtful debt: "He is acquitted of what has passed, if he pays it back when he takes possession of it, if he is truthful." Yazeed bin Haroun narrated to us, from Hisham, from Ibn Sireen, from Ubaidah, from Ali. Abu Ubaid also said, "His saying 'adhanun' refers to the one whose owner does not know whether he will settle the debt or not, as if he is the one whom he does not expect [to settle the debt]."
قَالَ أَبُو عُبَيْدٍ فِي حَدِيثِ عَلِيٍّ فِي الرَّجُلِ يَكُونُ لَهُ الدَّيْنُ الظَّنُونُ قَالَ يُزَكِّيهِ لِمَا مَضَى إِذَا قَبَضَهُ إِنْ كَانَ صَادِقًا حَدَّثَنَاهُ يَزِيدُ بْنُ هَارُونَ عَنْ هِشَامٍ عَنِ ابْنِ سِيرِينَ عَنْ عُبَيْدَةَ عَنْ عَلِيٍّ ؓ وَقَالَ أَبُو عُبَيْدٍ قَوْلُهُ الظَّنُونُ هُوَ الَّذِي لَا يَدْرِي صَاحِبُهُ أَيَقْضِيهِ الَّذِي عَلَيْهِ الدَّيْنُ أَمْ لَا كَأَنَّهُ الَّذِي لَا يَرْجُوهُ
[Machine] "Pay the Zakat amount on what is in your possession and what is owed to you as a trustworthy debt. It is equivalent to what is in your possession and what is owed to you as a doubtful debt. Therefore, there is no Zakat on it until it is received."
زَكُّوا مَا كَانَ فِي أَيْدِيكُمْ وَمَا كَانَ مِنْ دَيْنٍ فِي ثِقَةٍ فَهُوَ بِمَنْزِلَةِ مَا فِي أَيْدِيكُمْ وَمَا كَانَ مِنْ دَيْنٍ ظَنُونٍ فَلَا زَكَاةَ فِيهِ حَتَّى يَقْبِضَهُ
[Machine] "That when people have received their entitlements, the wealthy detain their debts and whatever remains in their hands. Their Zakat is taken out before they even collect it, then the people are burdened with debts that are only destroyed. And they do not take from the debt except what is given willingly. But when they collect the debt, they turn away from it due to what has passed from it."
أَنَّ النَّاسَ إِذَا خَرَجَتِ الْأَعْطِيَةُ حَبَسَ لَهُمُ الْعُرَفَاءُ دُيُونَهُمْ وَمَا بَقِيَ فِي أَيْدِيهِمْ أُخْرِجَتْ زَكَاتُهُمْ قَبْلَ أَنْ يَقْبِضُوا ثُمَّ دَايَنَ النَّاسُ بَعْدَ ذَلِكَ دُيُونًا هَالِكَةً فَلَمْ يَكُونُوا يَقْبِضُونَ مِنَ الدَّيْنِ الصَّدَقَةَ إِلَّا مَا نَضَّ مِنْهُ وَلَكِنَّهُمْ كَانُوا إِذَا قَبَضُوا الدَّيْنَ أَخْرَجُوا عَنْهَا لِمَا مَضَى مِنْهَا
[Machine] That only one Zakah should be taken from it, as it was a taking in the form of charity. Then Abu 'Ubaid said, meaning the absent one who is not expected to return.
أَنْ لَا تُؤْخَذَ مِنْهُ إِلَّا زَكَاةٌ وَاحِدَةٌ فَإِنَّهُ كَانَ ضِمَارًا ثُمَّ قَالَ أَبُو عُبَيْدٍ يَعْنِي الْغَائِبَ الَّذِي لَا يُرْجَى
10.92 [Machine] Who said there is no zakat in debt; It was narrated by Al-Za'farani from Al-Shafi'i, then he retracted it in the recent, and retracting it is more appropriate due to the previous evidence and other obvious signs.
١٠۔٩٢ بَابُ مَنْ قَالَ لَا زَكَاةَ فِي الدَّيْنِ رَوَاهُ الزَّعْفَرَانِيُّ عَنِ الشَّافِعِيِّ ثُمَّ رَجَعَ عَنْهُ فِي الْجَدِيدِ، وَالرُّجُوعُ أَوْلَى بِهِ لِمَا مَضَى مِنَ الْآثَارِ وَغَيْرِهَا مِنَ الظَّوَاهِرِ.
عَنِ ابْنِ عُمَرَ وَعَائِشَةَ ثُمَّ عِكْرِمَةَ وَعَطَاءٍ
10.93 [Machine] Selling charity before reaching its intended recipient without necessity.
١٠۔٩٣ بَابُ بَيْعِ الصَّدَقَةِ قَبْلَ وُصُولِهَا إِلَى أَهْلِهَا مِنْ غَيْرِ حَاجَةٍ.
[Machine] Because the Messenger of Allah ﷺ ordered that the wealthy be taken from and given to their poor, so the poor of the Ansar would be returned to with their own wealth, and its price would not be returned. The Sheikh said, and the news that has been mentioned in the obligations of charity and the distribution of alms is evidence in this matter.
لِأَنَّ رَسُولَ اللهِ ﷺ أَمَرَ أَنْ تُؤْخَذَ مِنْ أَغْنِيَائِهِمْ فَتُرَدَّ عَلَى فُقَرَائِهِمْ فُقَرَاءِ أَهْلِ السُّهْمَانِ فَتُرَدُّ بِعَيْنِهَا وَلَا يُرَدُّ ثَمَنُهَا قَالَ الشَّيْخُ وَالْأَخْبَارُ الَّتِي وَرَدَتْ فِي فَرَائِضِ الصَّدَقَاتِ وَتَقْدِيرِ الْجُبْرَانَاتِ دَلِيلٌ فِي هَذِهِ الْمَسْأَلَةِ
[Machine] They offered to the Prophet ﷺ to buy from him the remainder of what remained from their charity, so he said, "We do not sell anything from the charity until we receive it." This narrated chain is not strong and it is reported from Isma'il ibn 'Ayash through two chains, both of which are disconnected from Abu Sa'id, and from Abu Hurairah, it is connected and raised in the prohibition of that. And Isma'il's narration is not relied upon. And Allah knows best.
عَرَضُوا عَلَى النَّبِيِّ ﷺ أَنْ يَشْتَرُوا مِنْهُ بَقِيَّةَ مَا بَقِيَ عَلَيْهِمْ مِنْ صَدَقَاتِهِمْ فَقَالَ إِنَّا لَا نَبِيعُ شَيْئًا مِنَ الصَّدَقَاتِ حَتَّى نَقْبِضَهُ وَهَذَا إِسْنَادٌ غَيْرُ قَوَيٍّ وَرُوِيَ عَنْ إِسْمَاعِيلَ بْنِ عَيَّاشٍ بِإسْنَادَيْنِ لَهُ عَنْ أَبِي سَعِيدٍ مُنْقَطِعًا وَعَنْ أَبِي هُرَيْرَةَ مَوْصُولًا وَمَرْفُوعًا فِي النَّهْيِ عَنْ ذَلِكَ وَإِسْمَاعِيلُ غَيْرُ مُحْتَجٍّ بِهِ وَاللهُ أَعْلَمُ
[Machine] "That the Messenger of Allah ﷺ said, 'Do not sell the Sadaqah (charitable gifts) until it is marked and weighed.'"
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا تَشْتَرُوا الصَّدَقَاتِ حَتَّى تُوسَمَ وَتُعْقَلَ
10.94 [Machine] Disliking the purchase of what one donates from the hands of the one who is being donated to.
١٠۔٩٤ بَابُ كَرَاهِيَةِ ابْتِيَاعِ مَا تَصَدَّقَ بِهِ مِنْ يَدَيْ مَنْ تَصَدَّقَ عَلَيْهِ.
Once I gave a horse (for riding) in Allah's Cause. Later I saw it being sold. I asked Messenger of Allah ﷺ (whether I could buy it). He said, "Don't buy it, for you should not get back what you have given in charity." (Using translation from Bukhārī 2636)
عُمَرُ بْنُ الْخَطَّابِ ؓ حَمَلْتُ عَلَى فَرَسٍ فِي سَبِيلِ اللهِ فَرَأَيْتُهُ يُبَاعُ فَسَأَلْتُ رَسُولَ اللهِ ﷺ أَشْتَرِيهِ فَقَالَ لَا تَشْتَرِهِ وَلَا تَعُدْ فِي صَدَقَتِكَ
[Machine] Umair ibn al-Khattab rode on a horse in the way of Allah and saw something from its produce being sold. He wanted to buy it, so he asked the Prophet ﷺ. The Prophet ﷺ said, "Do not buy it, nor include it in your charity."
حَمَلَ عُمَرُ بْنُ الْخَطَّابِ ؓ عَلَى فَرَسٍ فِي سَبِيلِ اللهِ فَرَأَى شَيْئًا مِنْ نِتَاجِهِ يُبَاعُ فَأَرَادَ شِرَاءَهُ فَسَأَلَ النَّبِيَّ ﷺ فَقَالَ لَا تَشْتَرِهِ وَلَا تَعُدْ فِي صَدَقَتِكَ
[Machine] "Regarding this, the Messenger of Allah ﷺ said, 'Do not buy it, even if he gives it to you for one dirham, for the return on his charity is like a dog that returns to its vomit.'"
عَنْ ذَلِكَ رَسُولَ اللهِ ﷺ فَقَالَ لَا تَشْتَرِهِ وَإِنْ أَعْطَاكَ بِدِرْهَمٍ وَاحِدٍ فَإِنَّ الْعَائِدَ فِي صَدَقَتِهِ كَالْكَلْبِ يَعُودُ فِي قَيْئِهِ
[Machine] That Umar gave a horse in the cause of Allah as charity, but then he found it being sold. So, he wanted to buy it back. He then went to the Messenger of Allah ﷺ and sought his guidance in this matter. The Messenger of Allah ﷺ told him not to count it as part of his charity. From that point on, Ibn Umar used to refrain from buying anything that he had given as charity or used for a good cause, except that he would consider it as an act of charity.
أَنَّ عُمَرَ تَصَدَّقَ بِفَرَسٍ فِي سَبِيلِ اللهِ فَوَجَدَهُ يُبَاعُ بَعْدَ ذَلِكَ فَأَرَادَ أَنْ يَشْتَرِيَهُ ثُمَّ أَتَى رَسُولَ اللهِ ﷺ فَاسْتَأْمَرَهُ فِي ذَلِكَ فَقَالَ لَهُ رَسُولُ اللهِ ﷺ لَا تَعُدْ فِي صَدَقَتِكَ فَبِذَلِكَ كَانَ ابْنُ عُمَرَ يَتْرُكُ أَنْ يَبْتَاعَ شَيْئًا تَصَدَّقَ بِهِ أَوْ بَرَّ بِهِ إِلَّا جَعَلَهُ صَدَقَةً
10.95 [Machine] Who said that it is permissible to acquire with dislike and that it is permissible to possess what has left his hands by what makes ownership lawful. Its meaning was narrated from Al-Hasan Al-Basri, and Ibn Umar remained silent about its prohibition despite his prohibition being narrated from him.
١٠۔٩٥ بَابُ مَنْ قَالَ يَجُوزُ الِابْتِيَاعُ مَعَ الْكَرَاهِيَةِ وَأَنَّهُ يَجُوزُ أَنْ يَمْلِكَ مَا خَرَجَ مِنْ يدَيْهِ بِمَا يَحِلُّ بِهِ الْمُلْكُ رُوِيَ مَعْنَاهُ عَنِ الْحَسَنِ الْبَصْرِيِّ وَسَكَتَ ابْنُ عُمَرَ عَنْ تَحْرِيمِهِ مَعَ نَهْيِهِ عَنْهُ فِيمَا رُوِيَ عَنْهُ.
[Machine] I was with the Prophet ﷺ when a woman came to him and said, "O Messenger of Allah, I had made a vow to provide financial support for my mother until my mother passed away, and now my mother has died but the person I made the vow for is still alive." The Prophet ﷺ said, "You have fulfilled your vow, and the person should return to you in terms of inheritance." She said, "But she died while owing a month of fasting." He said, "Then I will fast on behalf of your mother." She said, "But she died without performing the Hajj pilgrimage." He said, "Then I will perform the Hajj pilgrimage on behalf of your mother."
كُنْتُ عِنْدَ النَّبِيِّ ﷺ فَأَتَتْهُ امْرَأَةٌ فَقَالَتْ يَا رَسُولَ اللهِ إِنِّي كُنْتُ تَصَدَّقْتُ بِوَلِيدَةٍ عَلَى أُمِّي فَمَاتَتْ أُمِّي وَبَقِيَتِ الْوَلِيدَةُ قَالَ قَدْ وَجَبَ أَجْرُكِ وَرَجَعَتْ إِلَيْكِ فِي الْمِيرَاثِ قَالَتْ فَإِنَّهَا مَاتَتْ وَعَلَيْهَا صَوْمُ شَهْرٍ قَالَ صُوْمِي عَنْ أُمِّكِ قَالَتْ وَإِنَّهَا مَاتَتْ وَلَمْ تَحُجَّ قَالَ فَحُجِّي عَنْ أُمُّكِ
10.96 [Machine] Zakat al-ma'din, and whoever said: al-ma'din is not verifiably valuable according to the statement of the Prophet ﷺ: "Al-ma'din is base and in the rikaz (ore) is one-fifth." So he distinguished between them in mention and added one-fifth to the rikaz.
١٠۔٩٦ بَابُ زَكَاةِ الْمَعْدِنِ وَمَنْ قَالَ: الْمَعْدِنُ لَيْسَ بِرِكَازٍ لِقَوْلِ النَّبِيِّ ﷺ: " الْمَعْدِنُ جُبَارٌ وَفِي الرِّكَازِ الْخُمُسُ " فَفَصَلَ بَيْنَهُمَا فِي الذِّكْرِ وَأَضَافَ الْخُمُسَ إِلَى الرِّكَازِ.
[Machine] "The Prophet ﷺ granted Bilal ibn al-Harith al-Muzani the mining rights in the region of al-Far' for the purpose of collecting Zakat. These mining rights were only allowed for the collection of Zakat until this day. Al-Shafi'i said that this is not something that the people of Hadith have established, and even if they did, there would not be any narration from the Prophet ﷺ except for the granting of these mining rights. As for Zakat on the minerals, aside from one-fifth (khums), there is no narration from the Prophet ﷺ . The sheikh said that this is the same as what al-Shafi'i said in the narration of Malik. It has been narrated from Abdul Aziz al-Darawardi, from Rabi'ah, as a connected chain."
أَنَّ النَّبِيَّ ﷺ قَطَعَ لِبِلَالِ بْنِ الْحَارِثِ الْمُزَنِيِّ مَعَادِنَ الْقَبَلِيَّةِ وَهِيَ مِنْ نَاحِيَةِ الْفَرْعِ فَتِلْكَ الْمَعَادِنُ لَا يُؤْخَذُ مِنْهَا إِلَّا الزَّكَاةُ إِلَى الْيَوْمِ قَالَ الشَّافِعِيُّ لَيْسَ هَذَا مِمَّا يُثْبِتُ أَهْلُ الْحَدِيثِ وَلَوْ ثَبَتُوهُ لَمْ تَكُنْ فِيهِ رِوَايَةٌ عَنِ النَّبِيِّ ﷺ إِلَّا إِقْطَاعَهُ فَأَمَّا الزَّكَاةُ فِي الْمَعَادِنِ دُونَ الْخُمُسِ فَلَيْسَتْ مَرْوِيَّةً عَنِ النَّبِيِّ ﷺ فِيهِ قَالَ الشَّيْخُ هُوَ كَمَا قَالَ الشَّافِعِيُّ فِي رِوَايَةِ مَالِكٍ وَقَدْ رُوِيَ عَنْ عَبْدِ الْعَزِيزِ الدَّرَاوَرْدِيِّ عَنْ رَبِيعَةَ مَوْصُولًا
أَنَّ رَسُولَ اللهِ ﷺ أَخَذَ مِنَ الْمَعَادِنِ الْقَبَلِيَّةِ الصَّدَقَةَ وَأَنَّهُ أَقْطَعَ بِلَالَ بْنَ الْحَارِثَ الْعَقِيقَ أَجْمَعَ فَلَمَّا كَانَ عُمَرُ بْنُ الْخَطَّابِ ؓ قَالَ لِبِلَالٍ إِنَّ رَسُولَ اللهِ ﷺ لَمْ يَقْطَعْكَ إِلَّا لِتَعْمَلَ قَالَ فَأَقْطَعَ عُمَرُ بْنُ الْخَطَّابِ ؓ لِلنَّاسِ الْعَقِيقَ
[Machine] To be a foundation, and if it is a foundation, then it contains the fifth part.
أَنْ تَكُونَ رِكْزَةً فَإِذَا كَانَتْ رِكْزَةً فَفِيهَا الْخُمُسُ
10.97 [Machine] Who said: "The mineral is a backbone, and it contains tithes"?
١٠۔٩٧ بَابُ مَنْ قَالَ: الْمَعْدِنُ رِكَازٌ فِيهِ الْخُمُسُ.
[Machine] The Messenger of Allah ﷺ said, "The gold treasure that grows in the earth."
قَالَ رَسُولُ اللهِ ﷺ الرِّكَازُ الذَّهَبُ الَّذِي يُنْبِتُ فِي الْأَرْضِ
[Machine] The Messenger of Allah ﷺ said regarding the fifth (the fifth part of the wealth taken as charity): "What is the fifth, O Messenger of Allah?" He said, "Gold and silver that Allah created on the earth on the day it was created." Abu Sa`d Az-Zahid told us, Abu Al-`Abbas bin Mīkal told us, Isma`il bin Ibrahim Al-Faqih from Fāris, Muhammad bin Al-Hasan told us, Bishr bin Al-Walid Al-Kindi told us, Abu Yusuf mentioned to us. Abd Allah bin Sa`id Al-Maqburi narrated this Hadith in a unique way, however, he is very weak and was criticized by Ahmad bin Hanbal and Yahya bin Ma`in, as well as a group of Hadith scholars. Ash-Shafi`i mentioned in the narration of Abu Abd Ar-Rahman Ash-Shafi`i Al-Baghdadi from him that Abu Salamah, Sa`id, Ibn Sirin, Muhammad bin Ziyad, and others narrated from Abu Hurairah his Hadith regarding the fifth (the fifth part of the wealth taken as charity), but none of them mentioned anything from what Al-Maqburi mentioned in his Hadith. The sheikh who narrated this is weak.
قَالَ رَسُولُ اللهِ ﷺ فِي الرِّكَازِ الْخُمُسُ قِيلَ وَمَا الرِّكَازُ يَا رَسُولَ اللهِ؟ قَالَ الذَّهَبُ وَالْفِضَّةُ الَّذِي خَلَقَهُ اللهُ فِي الْأَرْضِ يَوْمَ خُلِقَتْ حَدَّثَنَاهُ أَبُو سَعْدٍ الزَّاهِدُ ثنا أَبُو الْعَبَّاسِ بْنُ مِيكَالٍ ثنا إِسْمَاعِيلُ بْنُ إِبْرَاهِيمَ الْفَقِيهُ بِفَارِسَ ثنا مُحَمَّدُ بْنُ الْحَسَنِ ثنا بِشْرُ بْنُ الْوَلِيدِ الْكِنْدِيُّ ثنا أَبُو يُوسُفَ فَذَكَرَهُ تَفَرَّدَ بِهِ عَبْدُ اللهِ بْنُ سَعِيدٍ الْمَقْبُرِيُّ وَهُوَ ضَعِيفٌ جِدًّا جَرَّحَهُ أَحْمَدُ بْنُ حَنْبَلٍ وَيَحْيَى بْنُ مَعِينٍ وَجَمَاعَةٌ مِنْ أَئِمَّةِ الْحَدِيثِ وَقَالَ الشَّافِعِيُّ فِي رِوَايَةِ أَبِي عَبْدِ الرَّحْمَنِ الشَّافِعِيِّ الْبَغْدَادِيِّ عَنْهُ قَدْ رَوَى أَبُو سَلَمَةَ وَسَعِيدٌ وَابْنُ سِيرِينَ وَمُحَمَّدُ بْنُ زِيَادٍ وَغَيْرُهُمْ عَنْ أَبِي هُرَيْرَةَ حَدِيثَهُ عَنِ النَّبِيِّ ﷺ فِي الرِّكَازِ الْخُمُسُ لَمْ يَذْكُرَ أَحَدٌ مِنْهُمْ شَيْئًا مِنَ الَّذِي ذَكَرَ الْمَقْبُرِيُّ فِي حَدِيثِهِ وَالَّذِي رَوَى ذَلِكَ شَيْخٌ ضَعِيفٌ إِنَّمَا
[Machine] A man from Muzaynah came to the Messenger of Allah ﷺ and said, "O Messenger of Allah, how do you see the share of the pasture?" He replied, "It is the same for it and its equivalent. The nukal (a type of fine) is not applicable to any grazing animal except for what the herdsmen take. If it reaches the value of a mudd, then it includes the cutting off of the hand, and if it does not reach the value of a mudd, then it includes a fine equal to it and the lashes of the nukal. He said, "O Messenger of Allah, how do you see the hanging fruit?" He replied, "It is the same for it and its equivalent. The nukal is not applicable to any hanging fruit except for what the greenery sustains. So whatever it produces from the greenery, if it reaches the value of a mudd, then it includes cutting off, and if it does not reach the value of a mudd, then it includes a fine equal to it and the lashes of the nukal." He said, "So how do you see what is taken on the road of a hundred miles or in an inhabited village?" He replied, "Inform him with a year of waiting. If his claimant comes, then hand it over to him. Otherwise, it is your matter. But if its claimant arrives one day in his lifetime, then hand it over to him, for what is on the road is not more than a hundred miles, and what is in a village is not more than an inhabited village. So there will be the fifth in the rikaz (buried treasure)." He said, "O Messenger of Allah, how do you see a stray sheep?" He replied, "It is a food that is eaten by you, your brother, or the wolf. Confine its stray to your brother." He said, "O Messenger of Allah, how do you see a stray camel?" He said, "Neither you nor it has a watertight container or shoe, and the wolf is not feared over it. It eats from the pasture and drinks water. Leave it until its claimant comes." Whoever said it was answered, "This news is related to what is found of the pre-Islamic wealth on the surface of the road, not more than a hundred miles, and in a village, not more than an inhabited village. Thus, it is in the fifth in the rikaz. Ash-Shafi'i mentioned in the narration of Az-Zuafarani from him that they considered the hadith weak. And he mentioned their refutation of the hadith regarding cutting off and hanging dates when nourished from the greenery, and in cases of scraps. Then he said, "He contradicted the hadith of 'Amr, which is..."
أَنَّ رَجُلًا مِنْ مُزَيْنَةَ أَتَى رَسُولَ اللهِ ﷺ فَقَالَ يَا رَسُولَ اللهِ كَيْفَ تَرَى فِي حَرِيسَةِ الْجَبَلِ؟ قَالَ هِيَ وَمِثْلُهَا وَالنَّكَالُ لَيْسَ فِي شَيْءٍ مِنَ الْمَاشِيَةِ قَطْعٌ إِلَّا فِيمَا آوَاهُ الْمُرَاحُ وَبَلَغَ ثَمَنَ الْمِجَنِّ فَفِيهِ قَطْعُ الْيَدِ وَمَا لَمْ يَبْلُغْ ثَمَنَ الْمِجَنِّ فَفِيهِ غَرَامَةُ مِثْلَيْهِ وَجَلَدَاتُ نَكَالٍ قَالَ يَا رَسُولَ اللهِ فَكَيْفَ تَرَى فِي الثَّمَرِ الْمُعَلَّقِ؟ قَالَ هُوَ وَمِثْلُهُ مَعَهُ وَالنَّكَالُ وَلَيْسَ فِي شَيْءٍ مِنَ الثَّمَرِ الْمُعَلَّقِ قَطْعٌ إِلَّا مَا آوَاهُ الْجَرِينُ فَمَا أَخَذَ مِنَ الْجَرِينِ فَبَلَغَ ثَمَنَ الْمِجَنِّ فَفِيهِ الْقَطْعُ وَمَا لَمْ يَبْلُغْ ثَمَنَ الْمِجَنِّ فَفِيهِ غَرَامَةُ مِثْلَيْهِ وَجَلَدَاتُ نَكَالٍ قَالَ فَكَيْفَ تَرَى فِيمَا يُؤْخَذُ فِي الطَّرِيقِ الْمِئْتَاءِ أَوِ الْقَرْيَةِ الْمَسْكُونَةِ؟ قَالَ عَرِّفْهُ سَنَةً فَإِنْ جَاءَ بَاغِيهِ فَادْفَعْهُ إِلَيْهِ وَإِلَّا فَشَأْنَكَ بِهِ فَإِنْ جَاءَ طَالِبُهُ يَوْمًا مِنَ الدَّهْرِ فَأَدِّهِ إِلَيْهِ فَمَا كَانَ فِي الطَّرِيقِ غَيْرِ الْمِئْتَاءِ وَفِي الْقَرْيَةِ غَيْرِ الْمَسْكُونَةِ فَفِيهِ وَفِي الرِّكَازِ الْخُمُسُ قَالَ يَا رَسُولَ اللهِ فَكَيْفَ تَرَى فِي ضَالَّةِ الْغَنَمِ؟ قَالَ طَعَامٌ مُأْكُولٌ لَكَ أَوْ لِأَخِيكَ أَوْ لِلذِّئْبِ احْبِسْ عَلَى أَخِيكَ ضَالَّتَهُ قَالَ يَا رَسُولَ اللهِ فَكَيْفَ تَرَى فِي ضَالَّةِ الْإِبِلِ فَقَالَ مَا لَكَ وَلَهَا مَعَهَا سِقَاؤُهَا وَحِذَاؤُهَا وَلَا يُخَافُ عَلَيْهَا الذِّئْبَ تَأْكُلُ الْكَلَأَ وَتَرِدُ الْمَاءَ دَعْهَا حَتَّى يَأْتِيَ طَالِبُهَا مَنْ قَالَ بِالْأَوَّلِ أَجَابَ عَنْ هَذَا بِأَنَّ هَذَا الْخَبَرَ وَرَدَ فِيمَا يُوجَدُ مِنْ أَمْوَالِ الْجَاهِلِيَّةِ ظَاهِرًا فَوْقَ الْأَرْضِ فِي الطَّرِيقِ غَيْرِ الْمِئْتَاءِ وَفِي الْقَرْيَةِ غَيْرِ الْمَسْكُونَةِ فَيَكُونُ فِيهِ وَفِي الرِّكَازِ الْخُمُسُ وَلَيْسَ ذَلِكَ مِنَ الْمَعْدِنِ بِسَبِيلٍ وَذَكَرَ الشَّافِعِيُّ فِي رِوَايَةِ الزَّعْفَرَانِيِّ عَنْهُ اعْتِلَالَهُمْ بِالْحَدِيثِ الْأَوَّلِ ثُمَّ قَالَ هُوَ عِنْدَ أَهْلِ الْحَدِيثِ ضَعِيفٌ وَذَكَرَ اعْتِلَالَهُمْ بِحَدِيثِ هِشَامِ بْنِ سَعْدٍ عَنْ عَمْرِو بْنِ شُعَيْبٍ هَذَا ثُمَّ قَالَ إِنْ كَانَ حَدِيثُ عَمْرٍو يَكُونُ حُجَّةً فَالَّذِي رَوَى حُجَّةٌ عَلَيْهِ فِي غَيْرِ حُكْمٍ وَإِنْ كَانَ حَدِيثُ عَمْرٍو غَيْرَ حُجَّةٍ فَالْحُجَّةُ بِغَيْرِ حُجَّةٍ جَهْلٌ ثُمَّ ذَكَرَ مُخَالَفَتَهُمُ الْحَدِيثَ فِي الْغَرَامَةِ وَفِي التَّمْرِ الرُّطَبِ إِذَا آوَاهُ الْجَرِينُ وَفِي اللُّقَطَةِ ثُمَّ قَالَ فَخَالَفَ حَدِيثَ عَمْرٍو الَّذِي
[Machine] That Umar ibn Al-Khattab made the revenue equal to one-fifth (khums), and this is a fixed and determined amount that was not reached during the time of Umar.
أَنَّ عُمَرَ بْنَ الْخَطَّابِ ؓ جَعَلَ الْمَعْدِنَ بِمَنْزِلَةِ الرِّكَازِ فِيهِ الْخُمُسُ وَهَذَا مُنْقَطِعٌ مَكْحُولٌ لَمْ يُدْرِكْ زَمَانَ عُمَرَ ؓ
10.98 [Machine] Who said: "there is nothing in the mineral until it reaches the threshold"?
١٠۔٩٨ بَابُ مَنْ قَالَ: لَا شَيْءَ فِي الْمَعْدِنِ حَتَّى يَبْلُغَ نِصَابًا
While we were sitting with the Messenger of Allah ﷺ a man brought him some gold equal in weight to an egg, and said: Messenger of Allah, I have got this from a mine; take it; it is sadaqah. I have no more than this. The Messenger of Allah ﷺ turned his attention from him. Then he came to him from his right side and repeated the same words. But he (the Prophet) turned his attention from him. He then came to him from his left side and repeated the same words. But he (again) turned his attention from him. He then came to him from behind. The Messenger of Allah ﷺ took it and threw it away. Had it hit him, it would have hurt him or wounded him. The Messenger of Allah ﷺ said: One of you brings all that he possesses and says: This is sadaqah. Then he sits down and spreads his hand before the people. The best sadaqah is that which leaves a competence. (Using translation from Abū Dāʾūd 1673)
كُنَّا عِنْدَ رَسُولِ اللهِ ﷺ إِذْ جَاءَ رَجُلٌ بِمِثْلِ بَيْضَةٍ مِنْ ذَهَبٍ فَقَالَ يَا رَسُولَ اللهِ أَصَبْتُ هَذِهِ مِنْ مَعْدِنِي فَخُذْهَا فَهِيَ صَدَقَةٌ مَا أَمْلِكُ غَيْرَهَا فَأَعْرَضَ عَنْهُ رَسُولُ اللهِ ﷺ ثُمَّ أَتَاهُ مِنْ قِبَلِ رُكْنِهِ الْأَيْمَنِ فَقَالَ مِثْلَ ذَلِكَ فَأَعْرَضَ عَنْهُ ثُمَّ أَتَاهُ مِنْ رُكْنِهِ الْأَيْسَرِ فَأَعْرَضَ عَنْهُ ثُمَّ أَتَاهُ مِنْ خَلْفِهِ فَأَخَذَهَا رَسُولُ اللهِ ﷺ فَحَذَفَهُ بِهَا فَلَوْ أَصَابَتْهُ لَأَوْجَعَتْهُ أَوْ لَعَقَرَتْهُ فَقَالَ رَسُولُ اللهِ ﷺ يَأْتِي أَحَدُكُمْ بِمَا يَمْلِكُ فَيَقُولُ هَذِهِ صَدَقَةٌ ثُمَّ يَقْعُدُ يَسْتَكِفُّ النَّاسَ خَيْرُ الصَّدَقَةِ مَا كَانَ عَنْ ظَهْرِ غَنِيًّ وَهَذَا يَحْتَمِلُ أَنْ يَكُونَ إِنَّمَا امْتَنَعَ مِنْ أَخْذِ الْوَاجِبِ مِنْهَا لِكَوْنِهَا نَاقِصَةً عَنِ النِّصَابِ وَيُحْتَمَلُ غَيْرُهُ وَقَدْ مَضَتِ الْأَحَادِيثُ فِي نِصَابِ الذَّهَبِ وَالْوَرِقِ
10.99 [Machine] Who said: "There is nothing in it until the year passes by the one who benefits from it"? This is a statement mentioned in the summaries of Al-Bouyuti, Ar-Rabi and Ibn Abi Al-Jarud, which is narrated by Abu Abdul Rahman Ahmad bin Yahya Ash-Shafi'i Al-Baghdadi from Ash-Shafi'i. He cited a hadith from Malik regarding the raw materials, and we mentioned it. He said: Ibn Abi Dhi'b narrated from Sa'id Al-Maqburi that the Prophet ﷺ was approached by a man with five ounces of metal, but he did not take anything from it, which contradicts the narration of Abdullah bin Sa'id.
١٠۔٩٩ بَابُ مَنْ قَالَ: لَا شَيْءَ فِيهِ حَتَّى يَحُولَ عَلَيْهِ الْحَوْلُ مَنْ يوْمِ اسْتِفَادِهِ هَذَا قَوْلٌ مَذْكُورٌ فِي مُخْتَصَرِ الْبُوَيْطِيِّ وَالرَّبِيعِ وَابْنِ أَبِي الْجَارُودِ مَنْصُوصٌ عَلَيْهِ فِي رِوَايَةِ أَبِي عَبْدِ الرَّحْمَنِ أَحْمَدَ بْنِ يَحْيَى الشَّافِعِيِّ الْبَغْدَادِيِّ عَنِ الشَّافِعِيِّ وَاحْتَجَّ بِحَدِيثِ مَالِكٍ فِي الْمَعَادِنِ الْقَبَلِيَّةِ وَقَدْ ذَكَرْنَاهُ. قَالَ: وَقَدْ رَوَى ابْنُ أَبِي ذِئْبٍ عَنْ سَعِيدٍ الْمَقْبُرِيِّ أَنَّ النَّبِيَّ ﷺ أَتَاهُ رَجُلٌ بِخَمْسَةِ أَوَاقٍ مِنْ مَعْدِنٍ فَلَمْ يَأْخُذْ مِنْهَا شَيْئًا وَهَذَا خِلَافُ رِوَايَةِ عَبْدِ اللهِ بْنِ سَعِيدٍ.
[Machine] A man brought five camels to the Messenger of Allah ﷺ and said, "O Messenger of Allah, I obtained this from a mine, so take the Zakat (charity) from it." He ﷺ said, "There is nothing in it (that requires Zakat)," and he returned it to him. It is possible that this incident is mentioned in the narration of Jabir ibn Abdullah as part of a single story, except that Jabir did not mention the amount. This is mentioned in the narration of Abu Hurairah, and the two narrations are in agreement that nothing was found in it. Allah knows best.
أَنَّ رَجُلًا جَاءَ بِخَمْسَةِ أَوَاقٍ إِلَى رَسُولِ اللهِ ﷺ فَقَالَ يَا رَسُولَ اللهِ إِنِّي أَصَبْتُ هَذَا مِنْ مَعْدِنٍ فَخُذْ مِنْهُ الزَّكَاةَ قَالَ لَا شَيْءَ فِيهِ وَرَدَّهُ إِلَيْهِ وَيُحْتَمَلُ أَنْ يَكُونَ هَذَا وَحَدِيثُ جَابِرِ بْنِ عَبْدِ اللهِ خَبَرًا عَنْ قِصَّةٍ وَاحِدَةٍ إِلَّا أَنَّ جَابِرًا لَمْ يَذْكُرِ الْمِقْدَارَ وَذَكَرَ ذَلِكَ فِي حَدِيثِ أَبِي هُرَيْرَةَ وَالْحَدِيثَانِ مُتَّفِقَانِ فِي أَنَّهُ لَمْ يَرَ فِيهِ شَيْئًا فِي الْحَالِ وَاللهُ أَعْلَمُ
10.100 [Machine] Zakat of Rikaz.
١٠۔١٠٠ بَابُ زَكَاةِ الرِّكَازِ.
[Machine] "On the authority of the Prophet ﷺ who said, 'The wounds of the Ajam (non-Arabs) are severe, as are the wells, and the metals are also severe. And in the (distribution of) fifth, in the amount of 7,646 it was narrated to us by Abu Abdullah Al-Hafiz that Al-Hasan ibn Ya'qub informed us, from Ibrahim ibn Ali, from Yahya ibn Yahya, narrated by Sufyan who mentioned it in a similar way.'"
عَنِ النَّبِيِّ ﷺ أَنَّهُ قَالَ الْعَجْمَاءُ جَرْحُهَا جُبَارٌ وَالْبِئْرُ جُبَارٌ وَالْمَعْدِنُ جُبَارٌ وَفِي الرِّكَازِ الْخُمُسُ 7646 أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنبأ الْحَسَنُ بْنُ يَعْقُوبَ ثنا إِبْرَاهِيمُ بْنُ عَلِيٍّ ثنا يَحْيَى بْنُ يَحْيَى أنبأ سُفْيَانُ فَذَكَرَهُ بِنَحْوِهِ
[Machine] That the Messenger of Allah ﷺ said: The injury of the non-Arabs is severe, and the well is severe, and the mine is severe, and in the treasure is one-fifth.
أَنَّ رَسُولَ اللهِ ﷺ قَالَ جُرْحُ الْعَجْمَاءِ جُبَارٌ وَالْبِئْرِ جُبَارٌ وَالْمَعْدِنِ جُبَارٌ وَفِي الرِّكَازِ الْخُمُسُ
[Machine] The Prophet ﷺ said about a treasure that a man found in an abandoned area during the time of ignorance: if you find it in an inhabited village or within a distance of two hundred farsakhs, then report it. But if you find it in an abandoned area or in a village that is not inhabited, then it belongs to you and the fifth part of it belongs to the treasury.
أَنَّ النَّبِيَّ ﷺ قَالَ فِي كَنْزٍ وَجَدَهُ رَجُلٌ فِي خَرِبَةٍ جَاهِلِيَّةٍ إِنْ وَجَدْتَهُ فِي قَرْيَةٍ مَسْكُونَةٍ أَوْ سَبِيلٍ مِئْتَاءٍ فَعَرِّفْهُ وَإِنْ وَجَدْتَهُ فِي خَرِبَةٍ جَاهِلِيَّةٍ أَوْ فِي قَرْيَةٍ غَيْرِ مَسْكُونَةٍ فَفِيهِ وَفِي الرِّكَازِ الْخُمُسُ
[Machine] He informed him, saying, "We traveled with the Messenger of Allah, ﷺ . One of our companions entered a ruined house to fulfill his need. He went to take a stone from it, but it collapsed on him as if it were made of iron. So he took it and brought it to the Prophet, ﷺ . The Prophet, ﷺ , said, "Weigh it." So it was weighed, and it turned out to be two hundred dirhams. The Messenger of Allah, ﷺ , said, "This is the treasure, and it includes one-fifth. Abdur Rahman bin Zaid bin Aslam is weak."
أَخْبَرَهُ قَالَ قَدِمْنَا مَعَ رَسُولِ اللهِ ﷺ فَدَخَلَ صَاحِبٌ لَنَا خَرِبَةً يَقْضِي فِيهَا حَاجَتَهُ فَذَهَبَ لِيَتَنَاوَلَ مِنْهَا لَبِنَةً فَانْهَارَتْ عَلَيْهِ تِبْرًا فَأَخَذَهَا فَأَتَى بِهَا النَّبِيُّ ﷺ فَقَالَ زِنْهَا فَوَزَنَهَا فَإِذَا هِيَ مِائَتَيْ دِرْهَمٍ فَقَالَ رَسُولُ اللهِ ﷺ هَذَا رِكَازٌ وَفِيهِ الْخُمُسُ عَبْدُ الرَّحْمَنِ بْنُ زَيْدِ بْنِ أَسْلَمَ ضَعِيفٌ
[Machine] He heard some scholars saying about the Rikaz that it is the burial of Jahiliyyah as long as it is not sought after with money and a great deed is not assigned to it. But as for what is sought after with money or a great deed is assigned to it, then it is obtained once and missed once, so it is not a Rikaz. Abu Dawud narrated from Yahya ibn Ayyub from Abbad ibn Al-Awwam from Hisham from Al-Hasan who said: Rikaz is the ordinary treasure, and that is mentioned in my book.
أَنَّهُ سَمِعَ بَعْضَ أَهْلِ الْعِلْمِ يَقُولُونَ فِي الرِّكَازِ إِنَّمَا هُوَ دَفْنُ الْجَاهِلِيَّةِ مَا لَمْ يُطْلَبْ بِمَالٍ وَلَمْ يُكَلَّفْ فِيهِ كَبِيرُ عَملٍ فَأَمَّا مَا طُلِبَ بِمَالٍ أَوْ كُلِّفَ فِيهِ كَبِيرُ عَمَلٍ فَأُصِيبَ مَرَّةً وَأُخْطِئَ مَرَّةً فَلَيْسَ بِرِكَازٍ وَرَوَى أَبُو دَاوُدَ عَنْ يَحْيَى بْنِ أَيُّوبَ عَنْ عَبَّادِ بْنِ الْعَوَّامِ عَنْ هِشَامٍ عَنِ الْحَسَنِ قَالَ الرِّكَازُ الْكَنْزُ الْعَادِي وَسَقَطَ ذَلِكَ مِنْ كِتَابِي
10.101 [Machine] Who performed the obligatory zakat in the way of giving charity, and Al-Miqdad named it as charity in front of the Prophet ﷺ and he did not deny it.
١٠۔١٠١ بَابُ مَنْ أَجْرَى بِالْخُمُسِ الْوَاجِبِ فِيهِ مَجْرَى الصَّدَقَاتِ فَقَدْ سَمَّاهُ الْمِقْدَادُ بَيْنَ يَدَيِ النَّبِيِّ ﷺ صَدَقَةً وَلَمْ يُنْكِرْهُ.
Al-Miqdad went to Baqi' al-Khabkhabah for a certain need. He found a mouse taking out a dinar from a hole. It then continued to take out dinars one by one until it took out seventeen dinars. It then took out a red purse containing a dinar. There were thus eighteen dinars. He took them to the Prophet ﷺ, informed him and said to him: Take its sadaqah. The Prophet ﷺ asked him: Did you extend your hand toward the hole? He replied: No. The Messenger of Allah ﷺ then said: May Allah bless you in it. (Using translation from Abū Dāʾūd 3087)
ذَهَبَ الْمِقْدَادُ لِحَاجَتِهِ بِبَقِيعِ الْخَبْخَبَةِ فَإِذَا جُرَذٌ يُخْرِجُ مِنْ جُحْرٍ دِينَارًا ثُمَّ لَمْ يَزَلْ يُخْرِجُ دِينَارًا دِينَارًا حَتَّى أَخْرَجَ سَبْعَةَ عَشَرَ دِينَارًا ثُمَّ أَخْرَجَ خِرْقَةً حَمْرَاءَ يَعْنِي فِيهَا دِينَارٌ فَكَانَتْ ثَمَانِيَةَ عَشَرَ دِينَارًا فَذَهَبَ بِهَا إِلَى النَّبِيِّ ﷺ فَأَخْبَرَهُ وَقَالَ لَهُ خُذْ صَدَقَتَهَا فَقَالَ لَهُ النَّبِيُّ ﷺ هَلْ هَوَيْتَ إِلَى الْجُحْرِ؟ قَالَ لَا فَقَالَ رَسُولُ اللهِ ﷺ بَارَكَ اللهُ لَكَ فِيهَا
10.102 [Machine] What is buried in the graves of the people of the Jahiliyyah?
١٠۔١٠٢ بَابُ مَا يُوجَدُ مِنْهُ مَدْفُونًا فِي قُبُورِ أَهْلِ الْجَاهِلِيَّةِ
When we went out along with the Messenger of Allah ﷺ to at-Ta'if we passed a grave. I heard the Messenger of Allah ﷺ say: This is the grave of AbuRighal. He was in this sacred mosque (sanctuary) protecting himself (from punishment). When he came out, he suffered the same punishment which his people suffered at this place, and he was buried in it. The sign of it is that a golden bough was buried with him. If you dig it out, you will find it with him. The people hastened to it and took out the bough. (Using translation from Abū Dāʾūd 3088)
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ حِينَ خَرَجْنَا مَعَهُ إِلَى الطَّائِفِ فَمَرَرْنَا بِقَبْرٍ فَقَالَ رَسُولُ اللهِ ﷺ هَذَا قَبْرُ أَبِي فُلَانٍ وَكَانَ بِهَذَا الْحَرَمِ يَدْفَعُ بِهِ عَنْهُ فَلَمَّا خَرَجَ أَصَابَتْهُ النِّقْمَةُ الَّتِي أَصَابَتْ قَوْمَهُ بِهَذَا الْمَكَانِ فَدُفِنَ فِيهِ وَآيَةُ ذَلِكَ أَنَّهُ دُفِنَ مَعَهُ غُصْنٌ مِنْ ذَهَبٍ إِنْ أَنْتُمْ نَبَشْتُمْ عَنْهُ وَجَدْتُمُوهُ مَعَهُ فَابْتَدَرَهُ النَّاسُ فَاسْتَخْرَجُوا مِنْهُ الْغُصْنَ
[Machine] Narrated Abdullah ibn Amr: We were with the Messenger of Allah ﷺ on a journey or an expedition, when we passed by a grave. He said, "This is the grave of Rijal, who belonged to the Thamud tribe. When Allah destroyed his people, He forbade him from entering the sacred territory. So he went out, and when he reached this place or the site, he died and was buried with a golden branch. We unearthed it and took it out."
عَنْ عَبْدِ اللهِ بْنِ عَمْرٍو ؓ أَنَّهُمْ كَانُوا مَعَ رَسُولِ اللهِ ﷺ فِي سَفَرٍ أَوْ مَسِيرٍ فَمَرُّوا بِقَبْرٍ فَقَالَ هَذَا قَبْرُ أَبِي رِغَالٍ كَانَ مِنْ قَوْمِ ثَمُودَ فَلَمَّا أَهْلَكَ اللهُ قَوْمَهُ بِمَا أَهْلَكَهُمْ بِهِ مَنَعَهُ لِمَكَانِهِ مِنَ الْحَرَمِ فَخَرَجَ حَتَّى إِذَا بَلَغَ هَذَا الْمَكَانَ أَوِ الْمَوْضِعَ مَاتَ وَدُفِنَ مَعَهُ غُصْنٌ مِنْ ذَهَبٍ فَابْتَدَرْنَاهُ فَأَخْرَجْنَاهُ
[Machine] The sheikh and this, if they find it in a dead animal that they possess, then in it is the fifth, as if it did not reach the minimum amount or they have authorized them to remove it, and Allah knows best.
الشَّيْخُ وَهَذَا إِنْ وَجَدُوهَا فِي مَوَاتٍ مَلَكُوهَا فَفِيهَا الْخُمُسُ وَكَأَنَّهَا لَمْ تَبْلُغْ نِصَابًا أَوْ فَوَّضَ ذَلِكَ إِلَيْهِمْ لِيُخْرِجُوهُ وَاللهُ أَعْلَمُ
10.103 [Machine] What has been narrated about Ali regarding Al-Rikaz
١٠۔١٠٣ بَابُ مَا رُوِيَ عَنْ عَلِيٍّ فِي الرِّكَازِ.
[Machine] I found one thousand and five hundred dirhams in a ruin in As-Sawad. Ali said, "Shouldn't I distribute it amongst the people clearly? If you found it in a village that pays its taxes to another village, then it belongs to the people of that village. But if you found it in a village that does not pay its taxes to another village, then you get four fifths, and we get one fifth. Al-Shafi'i said, "They narrated from Ali with a connected chain of narration that he said, 'You get four fifths, and divide the fifth among the needy of your family.' This hadith is most similar to the opinion of Ali. Allah knows best." The scholar said, "He, as said 7655, Sa'id bin Mansur reported in his book from Ibn 'Uyaynah from Abdullah bin Bishr al-Khath'ami from a man from his people called Humamah. He said, 'A jug from an old monastery fell on me in Al-Kufa and it had four thousand dirhams in it. I went to Ali and he said, 'Divide it into five fifths.' So I divided it and Ali took one fifth from it and gave me four fifths. When I was leaving, he called me and said, 'Are there any poor or needy among your neighbors?' I said, 'Yes.' He said, 'Take it and divide it among them."
إِنِّي وَجَدْتُ أَلْفًا وَخَمْسَمِائَةِ دِرْهَمٍ فِي خَرِبَةٍ فِي السَّوَادِ فَقَالَ عَلِيٌّ ؓ أَمَا لَأَقْضِيَنَّ فِيهَا قَضَاءً بَيِّنًا إِنْ كُنْتَ وَجَدْتَهَا فِي قَرْيَةٍ تُؤَدِّي خَرَاجَهَا قَرْيَةٌ أُخْرَى فَهِيَ لِأَهْلِ تِلْكَ الْقَرْيَةِ وَإِنْ كُنْتَ وَجَدْتَهَا فِي قَرْيَةٍ لَيْسَ تُؤَدِّي خَرَاجَهَا قَرْيَةٌ أُخْرَى فَلَكَ أَرْبَعَةُ أَخْمَاسِهِ وَلَنَا الْخُمُسُ ثُمَّ الْخُمُسُ لَكَ قَالَ الشَّافِعِيُّ قَدْ رَوَوْا عَنْ عَلِيٍّ ؓ بِإِسْنَادٍ مَوْصُولٍ أَنَّهُ قَالَ أَرْبَعَةُ أَخْمَاسِهِ لَكَ وَاقْسِمِ الْخُمُسَ فِي فُقَرَاءِ أَهْلِكَ هَذَا الْحَدِيثُ أَشْبَهُ بِعَلِيٍّ ؓ وَاللهُ أَعْلَمُ قَالَ الشَّيْخُ هُوَ كَمَا قَالَ 7655 فَقَدْ رَوَى سَعِيدُ بْنُ مَنْصُورٍ الْمَكِّيُّ فِي كِتَابِهِ عَنِ ابْنِ عُيَيْنَةَ عَنْ عَبْدِ اللهِ بْنِ بِشْرٍ الْخَثْعَمِيِّ عَنْ رَجُلٍ مِنْ قَوْمِهِ يُقَالُ لَهُ حُمَمَةُ قَالَ سَقَطَتْ عَلَيَّ جَرَّةٌ مِنْ دَيْرٍ قَدْيمٍ بِالْكُوفَةِ فِيهَا أَرْبَعَةُ آلَافِ دِرْهَمٍ فَذَهَبْتُ بِهَا إِلَى عَلِيٍّ ؓ فَقَالَ اقْسِمْهَا خَمْسَةَ أَخْمَاسٍ فَقَسَمْتُهَا فَأَخَذَ مِنْهَا عَلِيٌّ ؓ خُمُسًا وَأَعْطَانِي أَرْبَعَةَ أَخْمَاسٍ فَلَمَّا أَدْبَرْتُ دَعَانِي فَقَالَ فِي جِيرَانِكَ فُقَرَاءُ وَمَسَاكِينُ قُلْتُ نَعَمْ قَالَ خُذْهَا فَاقْسِمْهَا بَيْنَهُمْ
[Machine] A jar fell on a man from a monastery near Kufa, so he brought it to Ali. He said, "Swear by it as five parts." Then he said, "Take four-fifths of it and leave one part." Then he said, "Are there poor and needy people in your neighborhood?" He said, "Yes." He said, "Take it and distribute it among them."
أَنَّ رَجُلًا سَقَطَتْ عَلَيْهِ جَرَّةٌ مِنْ دَيْرٍ بِالْكُوفَةِ فَأَتَى بِهَا عَلِيًّا ؓ فَقَالَ اقْسِمْهَا أَخْمَاسًا ثُمَّ قَالَ خُذْ مِنْهَا أَرْبَعَةَ أَخْمَاسٍ وَدَعْ وَاحِدًا ثُمَّ قَالَ فِي حَيِّكَ فُقَرَاءُ وَمَسَاكِينُ؟ قَالَ نَعَمْ قَالَ خُذْهَا فَاقْسِمْهَا فِيهِمْ
10.104 Section
١٠۔١٠٤ بَابُ مَا يَقُولُ: الْمُصَدِّقُ إِذَا أَخَذَ الصَّدَقَةَ لِمَنْ أَخَذَهَا مِنْهُ. قَالَ اللهُ تَعَالَى لِنَبِيِّهِ ﷺ: {خُذْ مِنْ أَمْوَالِهِمْ صَدَقَةً تُطَهِّرُهُمْ وَتُزَكِّيهِمْ بِهَا وَصَلِّ عَلَيْهِمْ إِنَّ صَلَاتَكَ سَكَنٌ لَّهُمْ} [التوبة: 103] قَالَ الشَّافِعِيِّ رَحِمَهُ اللهُ: وَالصَّلَاةُ عَلَيْهِمُ الدُّعَاءُ لَهُمْ عِنْدَ أَخْذِ الصَّدَقَةِ مِنْهُمْ.
[Machine] The Prophet, when a people came to him with their charity, would say, "O Allah, bless the family of so-and-so." And when his father came to him with his charity, he would say, "O Allah, bless the family of my father." This is the most accurate narration of the hadith of Abu Umara, and in the narration of Abu Al-Walid, it is reported that Abdullah bin Abu Umara, who was one of the companions of the tree, said that the Prophet, when a people came to him with their charity, would say, "O Allah, bless them," and then mention what comes after.
النَّبِيُّ ﷺ إِذَا أَتَاهُ قَوْمٌ بِصَدَقَتِهِمْ قَالَ اللهُمَّ صَلِّ عَلَى آلِ فُلَانٍ وَأَتَاهُ أَبِي بِصَدَقَتِهِ فَقَالَ اللهُمَّ صَلِّ عَلَى آلِ أَبِي أَوْفَى لَفْظُ حَدِيثِ أَبِي عُمَرَ وَفِي رِوَايَةِ أَبِي الْوَلِيدِ قَالَ عَنْ عَبْدِ اللهِ بْنِ أَبِي أَوْفَى وَكَانَ مِنْ أَصْحَابِ الشَّجَرَةِ ؓ أَنَّ النَّبِيَّ ﷺ كَانَ إِذَا أَتَاهُ قَوْمٌ بِصَدَقَتِهِمْ قَالَ اللهُمَّ صَلِّ عَلَيْهِمْ ثُمَّ ذَكَرَ مَا بَعْدَهُ
