61. Sacrificial Animals (3/14)
٦١۔ كِتَابُ الضَّحَايَا ص ٣
[Machine] In the name of Allah, the Most Gracious, the Most Merciful.
Allah, may He be praised, said: "So pray to your Lord and sacrifice." [Surah Al-Kawthar, verse 2].
بِسْمِ اللهِ الرَّحْمَنِ الرَّحِيمِ.
قَالَ اللهُ جَلَّ ثَنَاؤُهُ: {فَصَلِّ لِرَبِّكَ وَانْحَرْ} [الكوثر: 2].
[Machine] The Messenger of Allah ﷺ said, "No one should slaughter before they pray." My uncle came to him and said, "O Messenger of Allah, today there is plenty of meat and I have slaughtered my sheep so that my family and neighbors can eat. I also have a neck of milk which is better than a sheep for meat. Should I slaughter it?" He said, "Yes, and you will not lose the reward of your sheep."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا يَذْبَحَنَّ أَحَدٌ قَبْلَ أَنْ يُصَلِّيَ فَقَامَ إِلَيْهِ خَالِي فَقَالَ يَا رَسُولَ اللهِ إِنَّ هَذَا الْيَوْمَ فِيهِ اللَّحْمُ كَثِيرٌ وَإِنِّي ذَبَحْتُ نَسِيكَتِي لِيَأْكُلَ أَهْلِي وَجِيرَانِي وَإِنَّ عِنْدِي عَنَاقَ لَبَنٍ خَيْرٌ مِنْ شَاةِ لَحْمٍ فَأَذْبَحُهَا؟ قَالَ نَعَمْ وَلَا تُجْزِي جَذَعَةٌ عَنْ أَحَدٍ بَعْدَكَ وَهِيَ خَيْرُ نَسِيكَتِكَ
[Machine] The Prophet ﷺ said, "Whoever sacrifices before the prayer, then he has only slaughtered for himself. And whoever sacrifices after the prayer, then his sacrifice is complete and he has followed the tradition of the Muslims." Abu Abdullah al-Hafiz informed us, Abu Abdullah Muhammad ibn Ya'qub narrated to me, who narrated from Muhammad ibn Abdus-Salam, who narrated from Yahya ibn Yahya, who narrated from Khalid ibn Abdullah, from Mutarraf, who mentioned it.
قَالَ النَّبِيُّ ﷺ مَنْ ضَحَّى قَبْلَ الصَّلَاةِ فَإِنَّمَا ذَبَحَ لِنَفْسِهِ وَمَنْ ذَبَحَ بَعْدَ الصَّلَاةِ فَقَدْ تَمَّ نُسُكُهُ وَأَصَابَ سُنَّةَ الْمُسْلِمِينَ أَخْبَرَنَاهُ أَبُو عَبْدِ اللهِ الْحَافِظُ أنبأ أَبُو عَبْدِ اللهِ مُحَمَّدُ بْنُ يَعْقُوبَ حَدَّثَنِي مُحَمَّدُ بْنُ عَبْدِ السَّلَامِ ثنا يَحْيَى بْنُ يَحْيَى أنبأ خَالِدُ بْنُ عَبْدِ اللهِ عَنْ مُطَرِّفٍ فَذَكَرَهُ
[Machine] The Messenger of Allah ﷺ exchanged it, so he said, "O Messenger of Allah, I only have a trunk that is better than an old one." He said, "Put it in its place, and it will not repay or benefit anyone after you."
رَسُولُ اللهِ ﷺ أَبْدِلْهَا فَقَالَ يَا رَسُولَ اللهِ لَيْسَ عِنْدِي إِلَّا جَذَعَةٌ خَيْرٌ مِنْ مُسِنَّةٍ قَالَ اجْعَلْهَا مَكَانَهَا وَلَنْ تُجْزِيَ أَوْ تُوفِيَ عَنْ أَحَدٍ بَعْدَكَ
[Machine] That the Messenger of Allah, ﷺ , prayed and then gave a sermon. He commanded whoever had slaughtered before the prayer to repeat the slaughter. So, a man from the Ansar stood up and said, "My neighbors are in need, or he said, they are special to me, and I slaughtered before the prayer, and I have some necks of sheep that are dearer to me than the thigh meat." He gave him the permission. If it was permission for him, then it was so. Otherwise, I have no knowledge of it. Then he turned towards two salty rams, meaning he slaughtered them, and the people dispersed to their spoils, so they became distraught.
أَنَّ رَسُولَ اللهِ ﷺ صَلَّى ثُمَّ خَطَبَ فَأَمَرَ مَنْ كَانَ ذَبَحَ قَبْلَ الصَّلَاةِ أَنْ يُعِيدَ ذَبْحًا قَالَ فَقَامَ رَجُلٌ مِنَ الْأَنْصَارِ فَقَالَ إِنَّ جِيرَانِي بِهِمْ فَاقَةٌ أَوْ قَالَ خَصَاصَةٌ فَذَبَحْتُ قَبْلَ الصَّلَاةِ وَعِنْدِي عَنَاقٌ هِيَ أَحَبُّ إِلِيَّ مِنْ شَاتَيْ لَحْمٍ قَالَ فَرَخَّصَ لَهُ فَإِنْ كَانَتْ رُخْصَةً لَهُ كَانَ ذَلِكَ وَإِلَّا فَلَا عِلْمَ لِي ثُمَّ انْكَفَأَ إِلَى كَبْشَيْنِ أَمْلَحَيْنِ يَعْنِي فَذَبَحَهُمَا وَتَفَرَّقَ النَّاسُ إِلَى غَنِيمَةٍ فَتَجَزَّعُوهَا
[Machine] I heard Jundub ibn Sufyan say, "I witnessed the Eid al-Adha (sacrifice) with the Messenger of Allah ﷺ and then a man stood up and said, 'Indeed, some people have slaughtered before the prayer.' So, the Messenger of Allah ﷺ said, 'Whoever slaughtered before the prayer, let him make it as a charity, and whoever did not, let him slaughter in the name of Allah.' This is the wording of the hadith of Ibn Al-A'raabi and in the narration of As-Saffar. He learned that some people had already slaughtered and he said, 'Let him make up for his sacrifice.' And whoever didn't, let him slaughter in the name of Allah."
سَمِعْتُ جُنْدُبَ بْنَ سُفْيَانَ ؓ يَقُولُ شَهِدْتُ الْأَضْحَى مَعَ رَسُولِ اللهِ ﷺ فَقَامَ رَجُلٌ فَقَالَ إِنَّ نَاسًا ذَبَحُوا قَبْلَ الصَّلَاةِ فَقَالَ مَنْ ذَبَحَ مِنْكُمْ قَبْلَ الصَّلَاةِ فَلْيُعِدْ ذَبِيحَتَهُ وَمَنْ لَا فَلْيَذْبَحْ عَلَى اسْمِ اللهِ لَفْظُ حَدِيثِ ابْنِ الْأَعْرَابِيِّ وَفِي رِوَايَةِ الصَّفَّارِ فَعَلِمَ أَنَّ نَاسًا وَقَالَ فَلْيُعِدْ أُضْحِيَّتَهُ وَمَنْ لَا يَكُنْ فَلْيَذْبَحْ عَلَى اسْمِ اللهِ
[Machine] Abdullah bin Busr, the companion of the Messenger of Allah ﷺ , went out with the people on the day of Eid al-Fitr or Eid al-Adha and he disapproved of the delay of the Imam. He said, "We had finished our preparations during this hour, which is the time for praising Allah. It has been narrated from Al-Hasan al-Basri that the Prophet ﷺ used to go out for Eid al-Adha and Eid al-Fitr when the sun rose a little. The Prophet ﷺ used to pray the Eid prayer in the early time. Whoever slaughtered before the Prophet's prayer and ate and fed his family and neighbors as we have been narrated in the hadith of Abu Burdah bin Niyar, his slaughter was considered invalid before its proper time, and that is not permissible. Therefore, he was commanded to repeat it. Whoever sacrifices at the proper time when the prayer is due and finishes the prayer and the sermon of the Prophet ﷺ , his sacrifice is valid, if Allah wills."
خَرَجَ عَبْدُ اللهِ بْنُ بُسْرٍ صَاحِبُ رَسُولِ اللهِ ﷺ مَعَ النَّاسِ فِي يَوْمِ عِيدِ فِطْرٍ أَوْ أَضْحًى فَأَنْكَرَ إِبْطَاءَ الْإِمَامِ وَقَالَ إِنَّا كُنَّا فَرَغْنَا سَاعَتَنَا هَذِهِ وَذَلِكَ حِينَ التَّسْبِيحِ وَرُوِّينَا عَنِ الْحَسَنِ الْبَصْرِيِّ أَنَّ النَّبِيَّ ﷺ كَانَ يَغْدُو إِلَى الْأَضْحَى وَالْفِطْرِ حِينَ تَطْلُعُ الشَّمْسُ فَيَتَتَامُّ طُلُوعُهَا فَالنَّبِيُّ ﷺ كَانَ يُصَلِّي صَلَاةَ الْعِيدِ فِي أَوَّلِ الْوَقْتِ فَمَنْ كَانَ ذَبَحَ قَبْلَ صَلَاةِ النَّبِيِّ ﷺ وَأَكَلَ وَأَطْعَمَ أَهْلَهُ وَجِيرَانَهُ كَمَا رُوِّينَا فِي حَدِيثِ أَبِي بُرْدَةَ بْنِ نِيَارٍ كَانَ ذَبْحُهُ وَاقِعًا قَبْلَ أَنْ يَحِلَّ وَقْتُهُ وَذَلِكَ لَا يَجُوزُ فَذَلِكَ أُمِرَ بِالْإِعَادَةِ فَمَنْ ضَحَّى بِالْوَقْتِ الَّذِي يَحِلُّ فِيهِ الصَّلَاةُ وَيَمْضِي مِقْدَارُ صَلَاةِ النَّبِيِّ ﷺ وَخُطْبَتِهِ أَجْزَأَتْ أُضْحِيَّتُهُ إِنْ شَاءَ اللهُ
61.10 [Machine] Who among the Imams chose to pray in the mosque, and who chose to pray at home
٦١۔١٠ بَابُ مَنْ شَاءَ مِنَ الْأَئِمَّةِ ضَحَّى فِي مُصَلَّاهُ وَمَنْ شَاءَ فِي مَنْزِلِهِ
[Machine] The Messenger of Allah ﷺ used to slaughter and sacrifice at the prayer place.
رَسُولَ اللهِ ﷺ كَانَ يَذْبَحُ وَيَنْحَرُ بِالْمُصَلَّى
[Machine] The Messenger of Allah ﷺ used to slaughter his sacrificial animal at the prayer ground. According to Nafi', Ibn Umar used to do it with the wording of the Hadith of Al-'Amiri and in the Hadith of Abu Azhar it is mentioned that the Prophet ﷺ used to do it.
كَانَ رَسُولُ اللهِ ﷺ يَذْبَحُ أُضْحِيَّتَهُ بِالْمُصَلَّى قَالَ نَافِعٌ وَكَانَ ابْنُ عُمَرَ يَفْعَلُهُ لَفْظُ حَدِيثِ الْعَامِرِيِّ وَفِي حَدِيثِ أَبِي الْأَزْهَرِ أَنَّ النَّبِيَّ ﷺ كَانَ
[Machine] Ubaidullah offered a sacrifice to the Messenger of Allah ﷺ . Ubaidullah said, "Al-Qasim used to offer sacrifices for his family."
عُبَيْدُ اللهِ مَنْحَرُ رَسُولِ اللهِ ﷺ قَالَ عُبَيْدُ اللهِ وَكَانَ الْقَاسِمُ يَنْحَرُ فِي أَهْلِهِ
61.11 [Machine] Zakat within the limit of what is between the lips and the throat
٦١۔١١ بَابُ الذَّكَاةِ فِي الْمَقْدُورِ عَلَيْهِ مَا بَيْنَ اللَّبَّةِ وَالْحَلْقِ
[Machine] The passage in Arabic translates to "The Zakat is in the throat and the collar."
الذَّكَاةُ فِي الْحَلْقِ وَاللَّبَّةِ
[Machine] The translation of the passage into English is: "The charity is in the throat and the dress."
الذَّكَاةُ فِي الْحَلْقِ وَاللَّبَّةِ
[Machine] To die, and this has been narrated from a weak and elevated source, is not a thing.
أَنْ تَزْهَقَ وَقَدْ رُوِيَ هَذَا مِنْ وَجْهٍ ضَعِيفٍ مَرْفُوعًا وَلَيْسَ بِشَيْءٍ
[Machine] The Messenger of Allah ﷺ said, "Do not eat the leftover food, as it is the sacrifice of Satan."
قَالَ رَسُولُ اللهِ ﷺ لَا تَأْكُلُوا الشَّرِيطَةَ فَإِنَّهَا ذَبِيحَةُ الشَّيْطَانِ
[Machine] The Messenger of Allah ﷺ forbade the practice of cutting the skin without fully severing the veins, and leaving it until the animal dies.
نَهَى رَسُولُ اللهِ ﷺ عَنْ شَرِيطَةِ الشَّيْطَانِ وَهِيَ الَّتِي تُذْبَحُ فَيُقْطَعُ الْجِلْدُ وَلَا تُفْرَى الْأَوْدَاجُ ثُمَّ تُتْرَكُ حَتَّى تَمُوتَ
[Machine] The Messenger of Allah ﷺ said: "Every part of an animal that is gored by another (animal), unless it is a canine tooth or a broken hoof, is permissible." Abu al-Abbas said: "I do not have in my book any narration from Ali ibn Yazid." The sheikh (may Allah have mercy on him) said: "And in this chain of narrators, there is a weakness."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ كُلُّ مَا أَفْرَى الْأَوْدَاجَ مَا لَمْ يَكُنْ قَرْضَ نَابٍ أَوْ حَزَّ ظُفُرٍ قَالَ أَبُو الْعَبَّاسِ لَيْسَ فِي كِتَابِي عَنْ عَلِيِّ بْنِ يَزِيدَ قَالَ الشَّيْخُ رَحِمَهُ اللهُ وَفِي هَذَا الْإِسْنَادِ ضَعْفٌ
61.12 [Machine] Slaughter in sheep, cattle, horses and birds, and sacrifice in camels: Discussions on sheep slaughter.
٦١۔١٢ بَابُ الذَّبْحِ فِي الْغَنَمِ وَالْبَقَرِ وَالْفَرَسِ وَالطَّائِرِ , وَالنَّحْرِ فِي الْإِبِلِ قَدْ مَضَتْ أَحَادِيثُ فِي ذَبْحِ الْغَنَمِ
[Machine] The Messenger of Allah, ﷺ , said: "Do not slaughter except a mature sheep, unless it becomes difficult for you, then you may slaughter a young sheep."
قَالَ رَسُولُ اللهِ ﷺ لَا تَذْبَحُوا إِلَّا مُسِنَّةً إِلَّا إِنْ تَعَسَّرَ عَلَيْكُمْ فَتَذْبَحُوا جَذَعَةً مِنَ الضَّأْنِ
[Machine] We used to enjoy ourselves with the Messenger of Allah ﷺ by slaughtering a cow for seven [people].
كُنَّا نَتَمَتَّعُ مَعَ رَسُولِ اللهِ ﷺ فَنَذْبَحُ الْبَقَرَةَ عَنْ سَبْعَةٍ
[Machine] We slaughtered a horse during the time of the Messenger of Allah ﷺ while we were in Medina, and then we ate it.
ذَبَحْنَا فَرَسًا عَلَى عَهْدِ رَسُولِ اللهِ ﷺ وَنَحْنُ بِالْمَدِينَةِ فَأَكَلْنَا
"There is no person who kills a small bird or anything larger for no just reason, but Allah, the Mighty and Sublime, will ask him about it." It was said: "O Messenger of Allah, what does just reason;' mean?" Her said: "That you slaughter it and eat it, and do not cut off its head and throw it aside." (Using translation from Nasāʾī 4349)
عَنِ النَّبِيِّ ﷺ قَالَ مَنْ قَتَلَ عُصْفُورًا بِغَيْرِ حَقِّهِ سَأَلَهُ اللهُ يَوْمَ الْقِيَامَةِ عَنْهُ قِيلَ وَمَا حَقُّهُ؟ قَالَ يَذْبَحُهُ فَيَأْكُلُهُ وَلَا يَقْطَعُ رَأْسَهُ فَيَرْمِي بِهِ
[Machine] "And the Messenger of Allah ﷺ said: 'And I slaughtered seven camels with my own hands while standing, and I slaughtered in Madinah two salted rams that were horned.'"
وَقَالَ وَنَحَرَ رَسُولُ اللهِ ﷺ سَبْعَ بَدَنَاتٍ بِيَدِهِ قَائِمًا وَذَبَحَ بِالْمَدِينَةِ كَبْشَيْنِ أَمْلَحَيْنِ أَقْرَنَيْنِ
61.13 [Machine] License of slaughtering animals and slaughtering of animals, evidence from what we have narrated from Umar and Ibn Abbas: "Zakat (alms) on the hair and wool." Ata ibn Abi Rabah said: Sacrifice is sufficient from the act of slaughtering and slaughtering is sufficient from the act of sacrifice for cattle and camels.
٦١۔١٣ بَابُ جَوَازِ النَّحْرِ فِيمَا يُذْبَحُ , وَالذَّبْحِ فِيمَا يُنْحَرُ اسْتِدْلَالًا بِمَا رُوِّينَا عَنْ عُمَرَ وَابْنِ عَبَّاسٍ: " الذَّكَاةُ فِي الْحَلْقِ وَاللَّبَّةِ ". وَقَالَ عَطَاءُ بْنُ أَبِي رَبَاحٍ: يُجْزِي الذَّبْحُ مِنَ النَّحْرِ وَالنَّحْرُ مِنَ الذَّبْحِ فِي الْبَقَرِ وَالْإِبِلِ.
[Machine] During the era of the Messenger of Allah ﷺ, we ate it and Abdullah said, "We slaughtered it."
عَلَى عَهْدِ رَسُولِ اللهِ ﷺ فَأَكَلْنَاهُ وَقَالَ عَبْدَةُ ذَبَحْنَا
61.14 [Machine] Dislike of camel and horse.
٦١۔١٤ بَابُ كَرَاهَةِ النَّخْعِ وَالْفَرْسِ
[Machine] That the sheep is slaughtered, then its neck is broken from the place of slaughter for its windpipe, and for the location of the break in it, or it is struck to hasten its movement, and I dislike this. He said, and it is not forbidden because it is intelligent.
أَنْ تُذْبَحَ الشَّاةُ ثُمَّ يُكْسَرُ قَفَاهَا مِنْ مَوْضِعِ الذَّبْحِ لِنَخْعِهِ وَلِمَكَانِ الْكَسْرِ فِيهِ أَوْ تُضْرَبَ لِيُعْجَلَ قَطْعُ حَرَكَتِهَا فَأَكْرَهُ هَذَا وَقَالَ وَلَمْ يُحَرِّمْهَا ذَلِكَ لِأَنَّهَا ذَكِيَّةٌ
[Machine] It is also said that he exists in the spine's fqaar, resembling the brain, and is connected to the throat. He says, "It is forbidden to slaughter the animal in that manner." Abu Ubaid says, "As for the nakh, it is as Abu Ubaida said. As for the faras, it has been declared permissible." It is said that it means breaking. He was only prohibited from breaking the neck of the sacrificial animal before it cools. And one of the evidence for that is that the hadith says, "Do not hasten yourselves until the soul departs."
وَيُقَالُ أَيْضًا بَلْ هُوَ الَّذِي يَكُونُ فِي فَقَارِ الصُّلْبِ شَبِيهٌ بِالْمُخِّ وَهُوَ مُتَّصِلٌ بِالْقَفَا يَقُولُ فَنَهَى أَنْ يَنْتَهِيَ بِالذَّبْحِ إِلَى ذَلِكَ قَالَ أَبُو عُبَيْدٍ أَمَّا النَّخْعُ فَهُوَ عَلَى مَا قَالَ أَبُو عُبَيْدَةَ وَأَمَّا الْفَرْسُ فَقَدْ خُولِفَ فِيهِ يُقَالُ هُوَ الْكَسْرُ وَإِنَّمَا نَهَى أَنْ يَكْسِرَ رَقَبَةَ الذَّبِيحَةِ قَبْلَ أَنْ تَبْرُدَ وَمِمَّا يُبَيِّنُ ذَلِكَ أَنَّ فِي الْحَدِيثِ وَلَا تَعْجَلُوا الْأَنْفُسَ حَتَّى تَزْهَقَ
[Machine] Abbas prohibited the slaughtering of an animal to be ridden before it dies, and this isn't a strong hadith.
عَبَّاسٍ ؓ نَهَى رَسُولُ اللهِ ﷺ عَنِ الذَّبِيحَةِ أَنْ تُفْرَسَ قَبْلَ أَنْ تَمُوتَ وَهَذَا إِسْنَادٌ ضَعِيفٌ
61.15 [Machine] Zakat in iron and what is lighter for the person to give and what is recommended in terms of the boundary of wealth and its preservation from animals and their rest.
٦١۔١٥ بَابُ الذَّكَاةِ بِالْحَدِيدِ وَبِمَا يَكُونُ أَخَفَّ عَلَى الْمُذَكِّي وَمَا يُسْتَحَبُّ مِنْ حَدِّ الشِّفَارِ وَمُوَارَاتِهِ عَنِ الْبَهِيمَةِ وَإِرَاحَتِهَا
There are two characteristics that I heard the Messenger of Allah ﷺ say: Allah has decreed that everything should be done in a good way, so when you kill use a good method. The version of the narrators other than Muslim says: "So kill in a good manner." And when you slaughter, you should use a good method, for one of you should sharpen his knife, and give the animal as little pain as possible. (Using translation from Abū Dāʾūd 2815)
حَفِظْتُ مِنْ رَسُولِ اللهِ ﷺ خَصْلَتَيْنِ قَالَ إِنَّ اللهَ تَبَارَكَ كَتَبَ الْإِحْسَانَ عَلَى كُلِّ شَيْءٍ فَإِذَا قَتَلْتُمْ فَأَحْسِنُوا الْقِتْلَةَ وَإِذَا ذَبَحْتُمْ فَأَحْسِنُوا الذِّبْحَةَ وَلْيُحِدَّ أَحَدُكُمْ شَفْرَتَهُ وَلْيُرِحْ ذَبِيحَتَهُ
[Machine] "Allah ﷺ said, 'Verily, Allah is Good and He loves goodness. He has prescribed kindness in all things. So, when you kill, do it in the best manner, and when you slaughter, do it in the best manner. Let one of you sharpen his knife and spare sufferings to the animal he slaughters.'"
اللهِ ﷺ قَالَ إِنَّ اللهَ مِحْسَانٌ كَتَبَ الْإِحْسَانَ عَلَى كُلِّ شَيْءٍ فَإِذَا قَتَلْتُمْ فَأَحْسِنُوا الْقِتْلَةَ وَإِذَا ذَبَحَ أَحَدُكُمْ فَلْيُحْسِنْ ذِبْحَتَهُ وَلْيُحِدَّ أَحَدُكُمْ شَفْرَتَهُ وَلْيُرِحْ ذَبِيحَتَهُ
[Machine] The Messenger of Allah ﷺ ordered the marking of the animals and to cover them, then he said: When one of you slaughters, let him prepare such and such.
أَمَرَ رَسُولُ اللهِ ﷺ بِحَدِّ الشِّفَارِ وَأَنْ تُوَارَى عَنِ الْبَهَائِمِ ثُمَّ قَالَ إِذَا ذَبَحَ أَحَدُكُمْ فَلْيُجْهِزْ كَذَا
[Machine] The Messenger of Allah ﷺ ordered the covering of the private parts and hiding them from animals, and he said, "When one of you slaughters, let him prepare (the animal)."
أَمَرَ رَسُولُ اللهِ ﷺ بِحَدِّ الشِّفَارِ وَأَنْ تُوَارَى عَنِ الْبَهَائِمِ وَقَالَ إِذَا ذَبَحَ أَحَدُكُمْ فَلْيُجْهِزْ
[Machine] The Messenger of Allah, ﷺ , came across a man who had placed his foot on the side of a sheep, while he was sharpening his knife and the sheep was looking at him. The Messenger of Allah, ﷺ , said, "Why didn't you slaughter it before this? Do you want to kill it in a slow and painful way?" Hammad ibn Zaid reported from 'Asim that he said, "Do you want to kill it multiple deaths?" And Ma'mar reported from 'Asim that he sent it and did not mention Ibn Abbas in it.
قَامَ رَسُولُ اللهِ ﷺ عَلَى رَجُلٍ وَاضِعٍ رِجْلَهُ عَلَى صَفْحَةِ شَاةٍ وَهُوَ يُحِدُّ شَفْرَتَهُ وَهِيَ تَلْحَظُ إِلَيْهِ بِبَصَرِهَا فَقَالَ أَفَلَا قَبْلَ هَذَا؟ أَتُرِيدُ أَنْ تُمِيتَهَا مَوْتًا تَابَعَهُ حَمَّادُ بْنُ زَيْدٍ عَنْ عَاصِمٍ وَقَالَ أَتُرِيدُ أَنْ تُمِيتَهَا مَوْتَاتٍ وَرَوَاهُ مَعْمَرٌ عَنْ عَاصِمٍ فَأَرْسَلَهُ لَمْ يَذْكُرْ فِيهِ ابْنَ عَبَّاسٍ
[Machine] A man sharpened a knife and took a sheep to slaughter it. Umar hit him with a stone and said, "Do you torture the soul? Haven't you done this before taking it?"
أَنَّ رَجُلًا حَدَّ شَفْرَةً وَأَخَذَ شَاةً لِيَذْبَحَهَا فَضَرَبَهُ عُمَرُ ؓ بِالدِّرَّةِ وَقَالَ أَتُعَذِّبُ الرُّوحَ؟ أَلَا فَعَلْتَ هَذَا قَبْلَ أَنْ تَأْخُذَهَا
[Machine] That Umar saw a man dragging a sheep to slaughter it, so he struck him with a stick and said to him, "Water it, you have no mercy towards it until its beautiful death."
أَنَّ عُمَرَ ؓ رَأَى رَجُلًا يَجُرُّ شَاةً لِيَذْبَحَهَا فَضَرَبَهُ بِالدِّرَّةِ وَقَالَ سُقْهَا لَا أُمَّ لَكَ إِلَى الْمَوْتِ سَوْقًا جَمِيلًا
61.16 [Machine] The translation of the heading is: "The Zakat (alms) with what flows blood and splits veins and throats and does not sever, except hooves and teeth.
٦١۔١٦ بَابُ الذَّكَاةِ بِمَا أَنْهَرَ الدَّمَ وَفَرَى الْأَوْدَاجَ وَالْمَذْبَحَ وَلَمْ يُثَرِّدْ، إِلَّا الظُّفُرَ وَالسِّنَّ
[Machine] He said to the Messenger of Allah ﷺ , "We either hope or fear that we will encounter the enemy and we do not have any provisions. Should we then slaughter the camels?" So the Messenger of Allah ﷺ said, "What is prohibited is the flowing of blood and the name of Allah has been mentioned upon it, so eat it except for the teeth and the hooves."
أَنَّهُ قَالَ لِرَسُولِ اللهِ ﷺ إِنَّا لَنَرْجُو أوْ نَخْشَى أَنْ نَلْقَى الْعَدُوَّ وَلَيْسَ مَعَنْا مُدًى أَفَنَذْبَحُ بِالْقَصَبِ؟ فَقَالَ رَسُولُ اللهِ ﷺ مَا أَنْهَرَ الدَّمَ وَذُكِرَ اسْمُ اللهِ عَلَيْهِ فَكُلُوهُ إِلَّا السِّنَّ وَالظُّفُرَ
[Machine] He asked the Prophet ﷺ and said, "O Messenger of Allah, I find game, but I do not find what I can slaughter it with except the marrow and the stick." He said, "Pass blood through whatever you wish and mention the name of Allah."
أَنَّهُ سَأَلَ النَّبِيَّ ﷺ فَقَالَ يَا رَسُولَ اللهِ إِنِّي أَجِدُ الصَّيْدَ فَلَا أَجِدُ مَا أَذْبَحُهُ بِهِ إِلَّا الْمَرْوَةَ وَالْعَصَا قَالَ أَمْرِرِ الدَّمَ بِمَا شِئْتَ وَاذْكُرِ اسْمَ اللهِ
I said: Messenger of Allah, tell me when one of us catches game and has no knife; may he slaughter with a flint and a splinter of stick. He said: Cause the blood to flow with whatever you like and mention Allah's name. (Using translation from Abū Dāʾūd 2824)

[Machine] He informed him that their female neighbor, who was grazing cattle, saw a sheep from her flock that had died. So, she broke a stone and slaughtered it with it. He said to his family, "Do not eat from it until I come to the Prophet ﷺ and ask him, or I will send someone to ask him." So, he went to the Prophet ﷺ and asked him about it, or he sent his messenger to ask him. He said, "O Prophet of Allah, our neighbor who was grazing cattle saw a sheep from her flock that had died. So, she broke a stone and slaughtered it with it." So, the Prophet ﷺ ordered him to eat it.
أَخْبَرَهُ أَنَّ جَارِيَةً لَهُمْ كَانَتْ تَرْعَى بِسَلْعٍ فَرَأَتْ شَاةً مِنْ غَنَمِهَا بِهَا مَوْتٌ فَكَسَرَتْ حَجَرًا فَذَبَحَتْهَا بِهِ فَقَالَ لِأَهْلِهِ لَا تَأْكُلُوا مِنْهَا حَتَّى آتِيَ النَّبِيَّ ﷺ فَأَسْأَلَهُ أَوْ قَالَ أُرْسِلَ إِلَيْهِ مَنْ يَسْأَلُهُ فَأَتَى النَّبِيَّ ﷺ فَسَأَلَهُ عَنْ ذَلِكَ أَوْ رَسُولُهُ فَقَالَ يَا نَبِيَّ اللهِ إِنَّ جَارِيَةً لَنَا كَانَتْ تَرْعَى بِسَلْعٍ فَأَبْصَرَتْ شَاةً مِنْ غَنَمِهَا بِهَا مَوْتٌ فَكَسَرَتْ حَجَرًا فَذَبَحَتْهَا بِهِ فَأَمَرَهُ النَّبِيُّ ﷺ بِأَكْلِهَا
A man of Banu Harith was pasturing a pregnant she-camel in one of the ravines of Uhud, (he saw that) it was about to die; he could find nothing to slaughter it; he took a stake and stabbed it in the upper part of its breast until he made its blood flow. He then came to the Prophet ﷺ and informed him about that, and he ordered him to eat it. (Using translation from Abū Dāʾūd 2823)
أَنَّهُ كَانَ يَرْعَى لِقْحَةً بِشِعْبٍ مِنْ شِعَابِ أُحُدٍ فَأَخَذَهَا الْمَوْتُ فَلَمْ يَجِدْ شَيْئًا يَنْحَرُهَا بِهِ فَأَخَذَ وَتِدًا فَوَجَأَ بِهِ فِي لَبَّتِهَا حَتَّى أُهْرِيقَ دَمُهَا ثُمَّ جَاءَ إِلَى النَّبِيِّ ﷺ فَأَخْبَرَهُ بِذَلِكَ فَأَمَرَهُ بِأَكْلِهَا
[Machine] A man from the Ansar had a camel in the Qibla of Uhud. He presented it, then slaughtered it with a stake. He asked the Prophet ﷺ about eating it, so he ordered him to eat it. Abu Al-Husayn ibn Al-Fadl Al-Qattan informed us that Abu Sahl ibn Ziyad Al-Qattan narrated to us that Muhammad ibn Ghālib narrated to us that Sulayman ibn Harb narrated to us that Jarir ibn Hazim mentioned it and Habban ibn Hilal narrated it from Jarir ibn Hazim. He added, "Is it iron?" He said, "No, rather it is wood, meaning the stake."
أَنَّ نَاقَةً كَانَتْ لِرَجُلٍ مِنَ الْأَنْصَارِ فِي قِبَلِ أُحُدٍ فَعَرَضَ لَهَا فَنَحَرَهَا بِوَتِدٍ فَسَأَلَ النَّبِيَّ ﷺ عَنْ أَكْلِهَا فَأَمَرَهُ بِأَكْلِهَا أَخْبَرَنَاهُ أَبُو الْحُسَيْنِ بْنُ الْفَضْلِ الْقَطَّانُ أنبأ أَبُو سَهْلِ بْنُ زِيَادٍ الْقَطَّانُ ثنا مُحَمَّدُ بْنُ غَالِبٍ ثنا سُلَيْمَانُ بْنُ حَرْبٍ ثنا جَرِيرُ بْنُ حَازِمٍ فَذَكَرَهُ وَرَوَاهُ حَبَّانُ بْنُ هِلَالٍ عَنْ جَرِيرِ بْنِ حَازِمٍ زَادَ فَقُلْتُ لَهُ حَدِيدٌ؟ قَالَ لَا بَلْ خَشَبٌ يَعْنِي الْوَتِدَ
[Machine] The animal is slaughtered with something that has no limit, so it does not drain blood and does not flow. Abu 'Ubayd said, "And the saying of 'They split it open' means what tears it apart and causes the blood to flow from it." Abu 'Ubayd said, "And some people misinterpreted this hadith as meaning that it applies to all food, and this is incorrect. If it meant all food, it would apply to the knife, because the knife is what causes the splitting. Rather, the meaning of the hadith is that everything that causes the splitting of veins from wood or stone after it has been soaked in water, is sharp."
تُذْبَحَ الذَّبِيحَةُ بِشَيْءٍ لَا حَدَّ لَهُ فَلَا يُنْهِرَ الدَّمَ وَلَا يُسِيلُهُ قَالَ أَبُو عُبَيْدٍ وَقَوْلُهُ مَا أَفْرَى الْأَوْدَاجَ يَعْنِي مَا شَقَّقَهَا وَأَسَالَ مِنْهَا الدَّمَ قَالَ أَبُو عُبَيْدٍ وَقَدْ تَأَوَّلَ بَعْضُ النَّاسِ هَذَا الْحَدِيثَ أَنَّ قَوْلَهُ كُلْ مِنَ الْأَكْلِ وَهَذَا خَطَأٌ وَلَوْ أَرَادَ مِنَ الْأَكْلِ لَوَقَعَ الْمَعْنَى عَلَى الشَّفْرَةِ؛ لِأَنَّ الشَّفْرَةَ هِيَ الَّتِي تُفْرِي وَإِنَّمَا مَعْنَى الْحَدِيثِ أَنَّ كُلَّ شَيْءٍ أَفْرَى الْأَوْدَاجَ مِنْ عُودٍ أَوْ حَجَرٍ بَعْدَ أَنْ يُفْرِيَهَا فَهُوَ ذَكِيٌّ
61.17 [Machine] What was mentioned about the food of the People of the Book? Allah, may He be glorified and exalted, said: {And the food of those who were given the Scripture is lawful for you} [Al-Ma'idah: 5]. Imam Shafi'i, may Allah have mercy on him, said: Their food, according to what we have learned from some of the scholars of tafsir, used to include their sacrificial animals, and the evidences indicate that their sacrificial animals were lawful.
٦١۔١٧ بَابُ مَا جَاءَ فِي طَعَامِ أَهْلِ الْكِتَابِ قَالَ اللهُ جَلَّ ثَنَاؤُهُ: {وَطَعَامُ الَّذِينَ أُوتُوا الْكِتَابَ حِلٌّ لَكُمْ} [المائدة: 5]. قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: وَكَانَ طَعَامُهُمْ عِنْدَ بَعْضِ مَنْ حَفِظْنَا عَنْهُ مِنْ أَهْلِ التَّفْسِيرِ ذَبَائِحَهُمْ , وَكَانَتِ الْآثَارُ تَدُلُّ عَلَى إِحْلَالِ ذَبَائِحِهِمْ.
[Machine] "Mujahidin wa makhaulin."

مُجَاهِدٍ وَمَكْحُولٍ

61.18 [Machine] What was in their food, even though they were at war
٦١۔١٨ بَابُ مَا جَاءَ فِي طَعَامِهِمْ وَإِنْ كَانُوا حَرْبًا
I will not give anything today from it to anybody. Then I turned round and saw that the Messenger of Allah ﷺ was smiling (at my words). (Using translation from Muslim 1772a)
أَصَبْتُ جِرَابًا مِنْ شَحْمٍ يَوْمَ خَيْبَرَ فَالْتَزَمْتُهُ فَقُلْتُ لَا أُعْطِي أَحَدًا الْيَوْمَ مِنْ هَذَا شَيْئًا فَالْتَفَتُّ فَإِذَا رَسُولُ اللهِ ﷺ مُتَبَسِّمٌ

٦١۔١٩ بَابُ مَا جَاءَ فِي ذَبِيحَةِ مَنْ أَطَاقَ الذَّبْحَ مِنِ امْرَأَةٍ وَصَبِيٍّ مِنَ الْمُسْلِمِينَ أَوْ مِنْ أَهْلِ الْكِتَابِ
[Machine] That a woman slaughtered a sheep with a stone and it was mentioned to the Messenger of Allah, peace and blessings be upon him, and he found no fault in it.
أَنَّ امْرَأَةً ذَبَحَتْ شَاةً بِحَجَرٍ فَذُكِرَ ذَلِكَ لِرَسُولِ اللهِ ﷺ فَلَمْ يَرَ بِهَا بَأْسًا
A slave girl belonging to Kaʿb used to graze some sheep at Sl'a (mountain). Once one of her sheep was dying. She reached it (before it died) and slaughtered it with a stone. The Prophet ﷺ was asked, and he said, "Eat it." (Using translation from Bukhārī 5505)
أَخْبَرَهُ أَنَّ جَارِيَةً لِكَعْبِ بْنِ مَالِكٍ ؓ كَانَتْ تَرْعَى غَنَمًا لَهُ بِالسَّلْعِ فَأُصِيبَتْ شَاةٌ مِنْهَا فَأَدْرَكَتْهَا فَذَبَحَتْهَا بِحَجَرٍ فَسُئِلَ رَسُولُ اللهِ ﷺ عَنْ ذَلِكَ فَقَالَ لَا بَأْسَ بِهَا فَكُلُوهَا
[Machine] The Prophet ﷺ permitted the slaughter of a woman and a young boy or a young slave when they mention the name of Allah. This hadith has a weak chain of narration and it was also followed by Al-Waqidi in the slaughter of a young boy, which is also weak.
أَنَّ النَّبِيَّ ﷺ رَخَّصَ فِي ذَبِيحَةِ الْمَرْأَةِ وَالصَّبِيِّ أَوِ الْغُلَامِ إِذَا ذَكَرُوا اسْمَ اللهِ هَذَا إِسْنَادٌ فِيهِ ضَعْفٌ وَقَدْ تَابَعَهُ الْوَاقِدِيُّ فِي ذَبِيحَةِ الْغُلَامِ وَهُوَ أَيْضًا ضَعِيفٌ
[Machine] That the Messenger of Allah ﷺ commanded for the sacrifice of a young boy to be eaten when Allah is mentioned, and we were informed by Mujahid that he said it is permissible to sacrifice a young boy and a woman from the Muslims and the People of the Book.
أَنَّ رَسُولَ اللهِ ﷺ أَمَرَ بِذَبِيحَةِ الْغُلَامِ أَنْ تُؤْكَلَ إِذَا سَمَّى اللهَ وَرُوِّينَا عَنْ مُجَاهِدٍ أَنَّهُ قَالَ لَا بَأْسَ بِذَبِيحَةِ الصَّبِيِّ وَالْمَرْأَةِ مِنَ الْمُسْلِمِينَ وَأَهْلِ الْكِتَابِ
61.20 [Machine] What is recommended for a person to do with regards to slaughtering their sacrifice or witnessing it?
٦١۔٢٠ بَابُ مَا يُسْتَحَبُّ لِلْمَرْءِ مِنْ أَنْ يَتَوَلَّى ذَبْحَ نُسُكِهِ أَوْ يَشْهَدَهُ
The Prophet ﷺ offered as sacrifices, two horned rams, black and white in color. He slaughtered them with his own hands and mentioned Allah's Name over them and said Takbir and put his foot on their sides. (Using translation from Bukhārī 5565)
ضَحَّى رَسُولُ اللهِ ﷺ بِكَبْشَيْنِ أَمْلَحَيْنِ أَقْرَنَيْنِ وَذَبَحَهُمَا بِيَدِهِ وَسَمَّى وَكَبَّرَ وَوَضَعَ رِجْلَهُ عَلَى صِفَاحِهِمَا
[Machine] The Messenger of Allah ﷺ said to Fatimah, "O Fatimah, stand up and bear witness to your sacrifice. Indeed, with every drop of blood that falls from it, there is forgiveness for every sin. Indeed, on the Day of Resurrection, it will be presented with its flesh and blood multiplied seventy times, until it is placed in your scale." Abu Sa'id Al-Khudri said, "O Messenger of Allah, is this specifically for the family of Muhammad, as they are the ones who deserve the goodness that they have been favored with, or is it for the family of Muhammad and the people in general?" The Messenger of Allah ﷺ said, "Rather, it is for the family of Muhammad and the people in general." Amr bin Khalid is weak.
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لِفَاطِمَةَ يَا فَاطِمَةُ قُومِي فَاشْهَدِي أُضْحِيَّتَكِ أَمَا إِنَّ لَكِ بِأَوَّلِ قَطْرَةٍ تَقْطُرُ مِنْ دَمِهَا مَغْفِرَةً لِكُلِّ ذَنْبٍ أَمَا إِنَّهُ يُجَاءُ بِهَا يَوْمَ الْقِيَامَةِ بِلُحُومِهَا وَدِمَائِهَا سَبْعِينَ ضِعْفًا حَتَّى تُوضَعَ فِي مِيزَانِكِ فَقَالَ أَبُو سَعِيدٍ الْخُدْرِيُّ ؓ يَا رَسُولَ اللهِ أَهَذِهِ لِآلِ مُحَمَّدٍ خَاصَّةً فَهُمْ أَهْلٌ لِمَا خُصُّوا بِهِ مِنْ خَيْرٍ أَوْ لِآلِ مُحَمَّدٍ وَالنَّاسِ عَامَّةً؟ فَقَالَ رَسُولُ اللهِ ﷺ بَلْ هِيَ لِآلِ مُحَمَّدٍ وَالنَّاسِ عَامَّةً عَمْرُو بْنُ خَالِدٍ ضَعِيفٌ
[Machine] The Messenger of Allah ﷺ said, "O Fatimah, stand up and bear witness to your sacrifice, for the forgiveness of your sins will be granted to you with the first drop of its blood. Say, 'Verily, my prayers, my sacrifice, my living and my dying are for Allah, the Lord of all the worlds, with no partner. And I have been commanded to be among the Muslims.'" I said, "O Messenger of Allah, is this for you and your family specifically, or for the Muslims in general?" He replied, "It is for the Muslims in general." This hadith was also narrated by Amr ibn Qays from 'Atiyyah from Abu Sa'eed Al-Khudri. And it is mentioned from Abu Musa that he ordered his daughters to sacrifice with their own hands.
قَالَ رَسُولُ اللهِ ﷺ يَا فَاطِمَةُ قُومِي فَاشْهَدِي أُضْحِيَّتَكِ فَإِنَّهُ يُغْفَرُ لَكِ بِأَوَّلِ قَطْرَةٍ تَقْطُرُ مِنْ دَمِهَا كُلُّ ذَنْبٍ عَمِلْتِيهِ وَقُولِي {إِنَّ صَلَاتِي وَنُسُكِي وَمَحْيَايَ وَمَمَاتِي لِلَّهِ رَبِّ الْعَالَمِينَ لَا شَرِيكَ لَهُ وَبِذَلِكَ أُمِرْتُ وَأَنَا أَوَّلُ الْمُسْلِمِينَ} [الأنعام 163] قُلْتُ يَا رَسُولَ اللهِ هَذَا لَكَ وَلِأَهْلِ بَيْتِكَ خَاصَّةً فَأَهْلُ ذَلِكَ أَنْتُمْ أَمْ لِلِمُسْلِمِينَ عَامَّةً؟ قَالَ بَلْ لِلْمُسْلِمِينَ عَامَّةً وَرَوَاهُ أَيْضًا عَمْرُو بْنُ قَيْسٍ الْمُلَائِيُّ عَنْ عَطِيَّةَ عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ ؓ أَنَّ النَّبِيَّ ﷺ قَالَ لِفَاطِمَةَ فَذَكَرَ مَعْنَاهُ وَيُذْكَرُ عَنْ أَبِي مُوسَى ؓ أَنَّهُ أَمَرَ بَنَاتِهِ أَنْ يُضَحِّينَ بِأَيْدِيهِنَّ
