61. Sacrificial Animals

٦١۔ كِتَابُ الضَّحَايَا

61.17 [Machine] What was mentioned about the food of the People of the Book? Allah, may He be glorified and exalted, said: {And the food of those who were given the Scripture is lawful for you} [Al-Ma'idah: 5]. Imam Shafi'i, may Allah have mercy on him, said: Their food, according to what we have learned from some of the scholars of tafsir, used to include their sacrificial animals, and the evidences indicate that their sacrificial animals were lawful.

٦١۔١٧ بَابُ مَا جَاءَ فِي طَعَامِ أَهْلِ الْكِتَابِ قَالَ اللهُ جَلَّ ثَنَاؤُهُ: {وَطَعَامُ الَّذِينَ أُوتُوا الْكِتَابَ حِلٌّ لَكُمْ} [المائدة: 5]. قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: وَكَانَ طَعَامُهُمْ عِنْدَ بَعْضِ مَنْ حَفِظْنَا عَنْهُ مِنْ أَهْلِ التَّفْسِيرِ ذَبَائِحَهُمْ , وَكَانَتِ الْآثَارُ تَدُلُّ عَلَى إِحْلَالِ ذَبَائِحِهِمْ.

مُجَاهِدٍ وَمَكْحُولٍ

The verse: "So eat of (meats) on which Allah's name hath been pronounced" and the verse: "Eat not of (meats) on which Allah's name hath not been pronounced" were abrogated, meaning an exception was made therein by the verse: "The food of the people of the Book is lawful unto you and yours is lawful unto them." (Using translation from Abū Dāʾūd 2817)   

البيهقي:١٩١٥٣أَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنبأ مُحَمَّدُ بْنُ بَكْرٍ ثنا أَبُو دَاوُدَ ثنا أَحْمَدُ بْنُ مُحَمَّدِ بْنِ ثَابِتٍ الْمَرْوَزِيُّ حَدَّثَنِي عَلِيُّ بْنُ حُسَيْنٍ عَنْ أَبِيهِ عَنْ يَزِيدَ النَّحْوِيِّ عَنْ عِكْرِمَةَ عَنِ ابْنِ عَبَّاسٍ ؓ قَالَ

{فَكُلُوا مِمَّا ذُكِرَ اسْمُ اللهِ عَلَيْهِ} [الأنعام 118] {وَلَا تَأْكُلُوا مِمَّا لَمْ يُذْكَرِ اسْمُ اللهِ عَلَيْهِ} [الأنعام 121] فَنَسَخَ وَاسْتَثْنَى مِنْ ذَلِكَ فَقَالَ {وَطَعَامُ الَّذِينَ أُوتُوا الْكِتَابَ حِلٌّ لَكُمْ وَطَعَامُكُمْ حِلٌّ لَهُمْ} [المائدة 5]
