61.107 [Machine] What is permissible for the one in need from someone else's money?

٦١۔١٠٧ بَابُ مَا يَحِلُّ لِلْمُضْطَرِّ مِنْ مَالِ الْغَيْرِ

[Machine] I arrived at the city and hunger struck me severely, so I entered a garden and took a stalk of wheat and ate from it and put some in my garment. Then the owner of the garden came and struck me and took what was in my garment. So we went to the Prophet ﷺ and mentioned that to him. The Messenger of Allah ﷺ said, "Did you teach him when he was ignorant and did you feed him when he was hungry?" So he ordered me to give him half of a wasq of barley.  

البيهقي:١٩٦٦١أَخْبَرَنَا الشَّيْخُ الزَّكِيُّ أَبُو الْقَاسِمِ مَنْصُورُ بْنُ عَبْدِ الْمُنْعِمِ بْنِ عَبْدِ اللهِ الْفَرَاوِيُّ قَالَ أَخْبَرنَا أَبُو الْمَعَالِي مُحَمَّدُ بْنُ إِسْمَاعِيلَ الْفَارِسِيُّ قَالَ أَخْبَرَنَا الْإِمَامُ الْحَافِظُ أَحْمَدُ بْنُ الْحُسَيْنِ بْنِ عَلِيٍّ الْبَيْهقِيُّ وَأَنْبَأَنَا غَيْرُ وَاحِدٍ مِنْ أَشْيَاخِنَا عَنْ زَاهِرِ بْنِ طَاهِرٍ الشَّحَّامِيِّ قَالَ أَخْبَرَنَا الْإِمَامُ الْحَافِظُ أَبُو بَكْرٍ أَحْمَدُ بْنُ الْحُسَيْنِ الْبَيْهَقِيُّ رَحِمَهُ اللهُ قَالَ أَخْبَرَنَا أَبُو بَكْرٍ مُحَمَّدُ بْنُ الْحَسَنِ بْنِ فُورَكٍ أنبأ عَبْدُ اللهِ بْنُ جَعْفَرٍ الْأَصْبَهَانِيُّ ثنا يُونُسُ بْنُ حَبِيبٍ ثنا أَبُو دَاوُدَ الطَّيَالِسِيُّ ثنا شُعْبَةُ عَنْ أَبِي بِشْرٍ عَنْ عَبَّادِ بْنِ شُرَحْبِيلَ قَالَ

قَدِمْتُ الْمَدِينَةَ وَقَدْ أَصَابَنِي جُوعٌ شَدِيدٌ فَدَخَلْتُ حَائِطًا فَأَخَذْتُ سُنْبُلًا فَأَكَلْتُ مِنْهُ وَجَعَلْتُ فِي ثَوْبِي فَجَاءَ صَاحِبُ الْحَائِطِ فَضَرَبَنِي وَأَخَذَ مَا فِي ثَوْبِي قَالَ فَانْطَلَقْنَا إِلَى النَّبِيِّ ﷺ فَذَكَرْنَا ذَلِكَ لَهُ فَقَالَ رَسُولُ اللهِ ﷺ مَا عَلَّمْتَهُ إِذْ كَانَ جَاهِلًا وَلَا أَطْعَمْتَهُ إِذْ كَانَ سَاغِبًا فَأَمَرَ لِي بِنِصْفِ وَسْقٍ مِنْ شَعِيرٍ

[Machine] I used to throw dates to the Ansar, so they took me and brought me to the Messenger of Allah ﷺ. They said, "This person is throwing our dates." He said, "O Rafa', why do you throw their dates?" I said, "O Messenger of Allah, I am hungry." He said, "Do not throw, but eat from what falls. May Allah satisfy you and quench your hunger." It was narrated to us by Abu Al-Husayn bin Al-Fadl Al-Qattan, who narrated to us from Abu Amr bin Al-Sammak, who narrated to us from Muhammad bin Ubaidullah Al-Munadi, who narrated to us from Umar bin Othman bin Akhi Ali bin Asim, who narrated to us from Abu Tuamila, from Saleh bin Abi Jubair Al-Mawla of Al-Hakam bin Amr Al-Ghaffari, who said, "Some people from the people of Madinah complained to the Messenger of Allah ﷺ that a boy from the Banu Ghifar tribe was throwing their dates. He said, "Take him and bring him to me." When they did so, it was Rafa' bin Amr bin Amr bin Amr Al-Ghaffari who mentioned this incident, and this chain of narration is disconnected, and it was narrated through another chain of narration from Rafa' bin Amr Al-Ghaffari.  

البيهقي:١٩٦٦٢أَخْبَرَنَا أَبُو حَامِدٍ أَحْمَدُ بْنُ أَبِي خَلَفٍ الصُّوفِيُّ الْإِسْفَرَايِينِيُّ بِهَا ثنا أَبُو بَكْرٍ مُحَمَّدُ بْنُ يَزْدَادَ بْنِ مَسْعُودٍ ثنا مُحَمَّدُ بْنُ أَيُّوبَ بْنِ يَحْيَى الرَّازِيُّ أنبأ مُعَاذُ بْنُ أَسَدٍ الْخُرَاسَانِيُّ أنبأ الْفَضْلُ بْنُ مُوسَى أنبأ صَالِحُ بْنُ أَبِي جُبَيْرٍ عَنْ أَبِيهِ عَنْ رَافِعِ بْنِ عَمْرٍو قَالَ

كُنْتُ أَرْمِي نَخْلًا لِلْأَنْصَارِ فَأَخَذُونِي فَذَهَبُوا بِي إِلَى رَسُولِ اللهِ ﷺ فَقَالُوا إِنَّ هَذَا يَرْمِي نَخْلَنَا فَقَالَ يَا رَافِعُ لِمَ تَرْمِي نَخْلَهُمْ؟ قُلْتُ يَا رَسُولَ اللهِ أَجُوعُ قَالَ لَا تَرْمِ وَكُلْ مِمَّا يَقَعُ أَشْبَعَكَ اللهُ وَرَوَاكَ 19663 وَأَخْبَرَنَا أَبُو الْحُسَيْنِ بْنُ الْفَضْلِ الْقَطَّانُ أنبأ أَبُو عَمْرِو بْنُ السَّمَّاكِ ثنا مُحَمَّدُ بْنُ عُبَيْدِ اللهِ الْمُنَادِي ثنا عُمَرُ بْنُ عُثْمَانَ ابْنُ أَخِي عَلِيِّ بْنِ عَاصِمٍ ثنا أَبُو تُمَيْلَةَ عَنْ صَالِحِ بْنِ أَبِي جُبَيْرٍ مَوْلَى الْحَكَمِ بْنِ عَمْرٍو الْغِفَارِيِّ عَنْ أَبِيهِ قَالَ شَكَا نَاسٌ مِنْ أَهْلِ الْمَدِينَةِ إِلَى رَسُولِ اللهِ ﷺ أَنَّ غُلَامًا مِنْ بَنِي غِفَارٍ يَرْمِي نَخْلَهُمْ؟ قَالَ خُذُوهُ فَأْتُونِي بِهِ فَإِذَا هُوَ رَافِعُ بْنُ عَمْرٍو أَخُو الْحَكَمِ بْنِ عَمْرٍو فَذَكَرَ مَعْنَاهُ وَهَذَا مُنْقَطِعٌ وَرُوِيَ ذَلِكَ بِإِسْنَادٍ آخَرَ عَنْ رَافِعِ بْنِ عَمْرٍو الْغِفَارِيِّ

[Machine] I was a young boy, throwing dates at the palm trees for the Ansar. It was said to the Prophet, ﷺ , "There is a young boy here who is throwing our palm trees." He said, "Bring him to me." He said to the boy, "Why are you throwing their palm trees?" He replied, "I want to eat." The Prophet said, "Do not throw their palm trees and instead, eat from their dates." Then, he wiped the head of the boy and said, "O Allah, satisfy his belly."  

البيهقي:١٩٦٦٤أَخْبَرَنَاهُ أَبُو الْحُسَيْنِ بْنُ الْفَضْلِ أنبأ أَبُو عَمْرِو بْنُ السَّمَّاكِ ثنا مُحَمَّدُ بْنُ عُبَيْدِ اللهِ الْمُنَادِي ثنا عُمَرُ بْنُ عُثْمَانَ ابْنُ أَخِي عَلِيِّ بْنِ عَاصِمٍ ثنا مُعْتَمِرُ بْنُ سُلَيْمَانَ قَالَ سَمِعْتُ ابْنَ أَبِي الْحَكَمِ الْغِفَارِيَّ يَقُولُ حَدَّثَتْنِي جَدَّتِي عَنْ عَمِّ أَبِي رَافِعِ بْنِ عَمْرٍو الْغِفَارِيِّ قَالَ

كُنْتُ وَأَنَا غُلَامٌ أَرْمِي نَخْلًا لِلْأَنْصَارِ فَقِيلَ لِلنَّبِيِّ ﷺ إِنَّ هَهُنَا غُلَامًا يَرْمِي نَخْلَنَا قَالَ قَالَ خُذُوهُ فَأْتُونِي بِهِ قَالَ يَا غُلَامُ لِمَ تَرْمِي نَخْلَهُمْ؟ قَالَ إِنِّي أُرِيدُ أَنْ آكُلَ قَالَ لَا تَرْمِ نَخْلَهُمْ وَكُلْ مِمَّا فِي أُصُولِهَا قَالَ وَمَسَحَ رَأْسَ الْغُلَامِ وَقَالَ اللهُمَّ أَشْبِعْ بَطْنَهُ  

رَوَاهُ أَبُو دَاوُدَ فِي السُّنَنِ عَنْ أَبِي بَكْرٍ وَعُثْمَانَ ابْنَيْ أَبِي شَيْبَةَ عَنْ مُعْتَمِرٍ بِمَعْنَاهُ

[Machine] "Indeed, if you entered the city and obtained some of its fruits from its walls, I entered a wall from the walls of the city and cut two squirts. Then its owner came while we were with me and took me to the Prophet ﷺ , who asked me about my condition, and I informed him. He asked, 'Which one is better?' So I pointed to one of them, and he said, 'Take it.' Then he ordered the owner of the wall to take the other. He cleared my path. If these events are proven, they indicate, along with others, the permissibility of eating from someone else's property in cases of necessity, and then the obligation of compensation. Therefore, it can be inferred from the evidence that indicates the prohibition of taking someone else's property without their consent, except for a valid reason. By the will of Allah, some of our companions have used what we mentioned in the Book of Purity from the narration of Imran ibn Husayn when he went on a journey with the Messenger of Allah ﷺ and his companions. They became extremely thirsty, so he sent to the woman who had a she-camel with two water containers on it until they brought it. They took some of its water, and the water containers remained full as they were before. Then he ordered his companions, and they brought from their provisions until it filled her clothes."  

البيهقي:١٩٦٦٥أَخْبَرَنَا أَبُو الْحَسَنِ عَلِيُّ بْنُ مُحَمَّدٍ الْمُقْرِئُ أنبأ الْحَسَنُ بْنُ مُحَمَّدِ بْنِ إِسْحَاقَ ثنا يُوسُفُ بْنُ يَعْقُوبَ الْقَاضِي ثنا مُحَمَّدُ بْنُ أَبِي بَكْرٍ ثنا يَزِيدُ بْنُ زُرَيْعٍ ثنا عَبْدُ الرَّحْمَنِ بْنُ إِسْحَاقَ عَنْ أَبِيهِ عَنْ عُمَيْرٍ مَوْلَى آبِي اللَّحْمِ قَالَ أَقْبَلْتُ مَعَ سَادَتِي نُرِيدُ الْهِجْرَةَ حَتَّى إِذَا دَنَوْنَا مِنَ الْمَدِينَةِ جَعَلُونِي فِي ظَهْرِهِمْ وَدَخَلُوا الْمَدِينَةَ فَأَصَابَتْنِي مَجَاعَةٌ شَدِيدَةٌ قَالَ فَمَرَّ بِي بَعْضُ مَنْ يَخْرُجُ مِنَ الْمَدِينَةِ فَقَالَ

إِنَّكَ لَوْ دَخَلْتَ الْمَدِينَةَ فَأَصَبْتَ مِنْ ثِمَارِ حَوَائِطِهَا فَدَخَلْتُ حَائِطًا مِنْ حَوَائِطِ الْمَدِينَةِ فَقَطَعْتُ قِنْوَيْنِ فَجَاءَ صَاحِبُهُ وَهُمَا مَعِي فَذَهَبَ بِي إِلَى النَّبِيِّ ﷺ فَسَأَلَنِي عَنْ أَمْرِي فَأَخْبَرْتُهُ فَقَالَ أَيُّهُمَا أَفْضَلُ؟ فَأَشَرْتُ إِلَى أَحَدِهِمَا فَقَالَ خُذْهُ وَأَمَرَ صَاحِبَ الْحَائِطِ فَأَخَذَ الْآخَرَ وَخَلَّى سَبِيلِي وَهَذِهِ الْأَخْبَارُ إِنْ ثَبَتَتْ كَانَتْ دَالَّةً مَعَ غَيْرِهَا عَلَى جَوَازِ الْأَكْلِ مِنْ مَالِ الْغَيْرِ عِنْدَ الضَّرُورَةِ ثُمَّ وُجُوبِ الْبَدَلِ فَمُسْتَفَادٌ مِنَ الدَّلَائِلِ الَّتِي دَلَّتْ عَلَى تَحْرِيمِ مَالِ الْغَيْرِ بِغَيْرِ طِيبَةِ نَفْسِهِ وَبِاللهِ التَّوْفِيقُ وَقَدِ اسْتَدَلَّ بَعْضُ أَصْحَابِنَا بِمَا ذَكَرْنَا فِي كِتَابِ الطَّهَارَةِ مِنْ حَدِيثِ عِمْرَانَ بْنِ حُصَيْنٍ حِينَ خَرَجَ مَعَ رَسُولِ اللهِ ﷺ فِي سَفَرٍ هُوَ وَأَصْحَابُهُ فَأَصَابَهُمْ عَطَشٌ شَدِيدٌ وَإِنَّهُ بَعَثَ إِلَى الْمَرْأَةِ الَّتِي كَانَ مَعَهَا بَعِيرٌ عَلَيْهِ مَزَادَتَانِ حَتَّى أَتَى بِهَا وَأَخَذُوا مِنْ مَائِهَا وَالْمَزَادَتَانِ كَمَا هُمَا لَمْ تَزْدَادَا إِلَّا امْتِلَاءً ثُمَّ أَمَرَ أَصْحَابَهُ فَجَاءُوا مِنْ زِادِهِمْ حَتَّى مَلَأَ لَهَا ثَوْبَهَا
