61. Sacrificial Animals
٦١۔ كِتَابُ الضَّحَايَا
[Machine] That the sheep is slaughtered, then its neck is broken from the place of slaughter for its windpipe, and for the location of the break in it, or it is struck to hasten its movement, and I dislike this. He said, and it is not forbidden because it is intelligent.
أَنْ تُذْبَحَ الشَّاةُ ثُمَّ يُكْسَرُ قَفَاهَا مِنْ مَوْضِعِ الذَّبْحِ لِنَخْعِهِ وَلِمَكَانِ الْكَسْرِ فِيهِ أَوْ تُضْرَبَ لِيُعْجَلَ قَطْعُ حَرَكَتِهَا فَأَكْرَهُ هَذَا وَقَالَ وَلَمْ يُحَرِّمْهَا ذَلِكَ لِأَنَّهَا ذَكِيَّةٌ
[Machine] It is also said that he exists in the spine's fqaar, resembling the brain, and is connected to the throat. He says, "It is forbidden to slaughter the animal in that manner." Abu Ubaid says, "As for the nakh, it is as Abu Ubaida said. As for the faras, it has been declared permissible." It is said that it means breaking. He was only prohibited from breaking the neck of the sacrificial animal before it cools. And one of the evidence for that is that the hadith says, "Do not hasten yourselves until the soul departs."
وَيُقَالُ أَيْضًا بَلْ هُوَ الَّذِي يَكُونُ فِي فَقَارِ الصُّلْبِ شَبِيهٌ بِالْمُخِّ وَهُوَ مُتَّصِلٌ بِالْقَفَا يَقُولُ فَنَهَى أَنْ يَنْتَهِيَ بِالذَّبْحِ إِلَى ذَلِكَ قَالَ أَبُو عُبَيْدٍ أَمَّا النَّخْعُ فَهُوَ عَلَى مَا قَالَ أَبُو عُبَيْدَةَ وَأَمَّا الْفَرْسُ فَقَدْ خُولِفَ فِيهِ يُقَالُ هُوَ الْكَسْرُ وَإِنَّمَا نَهَى أَنْ يَكْسِرَ رَقَبَةَ الذَّبِيحَةِ قَبْلَ أَنْ تَبْرُدَ وَمِمَّا يُبَيِّنُ ذَلِكَ أَنَّ فِي الْحَدِيثِ وَلَا تَعْجَلُوا الْأَنْفُسَ حَتَّى تَزْهَقَ
[Machine] Abbas prohibited the slaughtering of an animal to be ridden before it dies, and this isn't a strong hadith.
عَبَّاسٍ ؓ نَهَى رَسُولُ اللهِ ﷺ عَنِ الذَّبِيحَةِ أَنْ تُفْرَسَ قَبْلَ أَنْ تَمُوتَ وَهَذَا إِسْنَادٌ ضَعِيفٌ
