61. Sacrificial Animals

٦١۔ كِتَابُ الضَّحَايَا

61.116 [Machine] What was forbidden to the children of Israel, and then abrogated by the legislation of our Prophet Muhammad ﷺ Al-Shafi'i (may Allah have mercy on him) said: Allah, may He be blessed and exalted, said: "All food was lawful to the children of Israel except what Israel had made unlawful to himself." [Al-Imran: 93] the verse.

٦١۔١١٦ بَابُ مَا حُرِّمَ عَلَى بَنِي إِسْرَائِيلَ , ثُمَّ وَرَدَ عَلَيْهِ النَّسْخُ بِشَرِيعَةِ نَبِيِّنَا مُحَمَّدٍ ﷺ قَالَ: الشَّافِعِيُّ رَحِمَهُ اللهُ قَالَ اللهُ تَبَارَكَ وَتَعَالَى: {كُلُّ الطَّعَامِ كَانَ حِلًّا لِبَنِي إِسْرَائِيلَ إِلَّا مَا حَرَّمَ إِسْرَائِيلُ عَلَى نَفْسِهِ} [آل عمران: 93] الْآيَةَ

[Machine] So the Jews prohibited it and then descended (revealed) {All food was lawful to the Children of Israel except what Israel had made unlawful to himself before the Torah was revealed. Say, "So bring the Torah and recite it, if you should be truthful."} [Al-e-Imran 93]. That is, this was before the Torah. 'Abd al-Razzaq said, Sufyan said in a high pitched voice, Al-Shafi'i said, 'May Allah bless him, and those are what is meant. And Allah knows best, lawful things were made permissible for them. And he said, {And for those who are Jews We prohibited every animal of uncloven hoof and of the cattle and We prohibited to them the fat of the ox and the sheep, except what adheres to their backs or the entrails or what is joined with bone.} [Al-Anam 146]. Al-Shafi'i said, the entrails are what contains food and drink in the stomach.  

البيهقي:١٩٧٠٢أَخْبَرَنَا عَبْدُ اللهِ بْنُ يَحْيَى بْنِ عَبْدِ الْجَبَّارِ بِبَغْدَادَ أنبأ إِسْمَاعِيلُ الصَّفَّارُ ثنا أَحْمَدُ بْنُ مَنْصُورٍ ثنا عَبْدُ الرَّزَّاقِ أنبأ الثَّوْرِيُّ ح وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنبأ أَبُو بَكْرِ بْنُ إِسْحَاقَ أنبأ أَبُو الْمُثَنَّى ثنا مُسَدَّدٌ ثنا يَحْيَى بْنُ سَعِيدٍ عَنْ سُفْيَانَ عَنْ حَبِيبِ بْنِ أَبِي ثَابِتٍ عَنْ سَعِيدِ بْنِ جُبَيْرٍ عَنِ ابْنِ عَبَّاسٍ ؓ أَنَّ إِسْرَائِيلَ أَخَذَهُ عِرْقُ النَّسَا فَكَانَ يَبِيتُ وَلَهُ زُقَاءٌ قَالَ فَجَعَلَ إِنْ شَفَاهُ اللهُ أَنْ لَا يَأْكُلَ لَحْمًا فِيهِ عُرُوقٌ قَالَ

فَحَرَّمَتْهُ الْيَهُودُ فَنَزَلَتْ {كُلُّ الطَّعَامِ كَانَ حِلًّا لِبَنِي إِسْرَائِيلَ إِلَّا مَا حَرَّمَ إِسْرَائِيلُ عَلَى نَفْسِهِ مِنْ قَبْلِ أَنْ تُنَزَّلَ التَّوْرَاةُ قُلْ فَأْتُوا بِالتَّوْرَاةِ فَاتْلُوهَا إِنْ كُنْتُمْ صَادِقِينَ} [آل عمران 93] أَيْ إِنَّ هَذَا كَانَ قَبْلَ التَّوْرَاةِ قَالَ عَبْدُ الرَّزَّاقِ قَالَ سُفْيَانُ زُقَاءً صِيَاحًا قَالَ الشَّافِعِيُّ قَالَ اللهُ تَبَارَكَ وَتَعَالَى {فَبِظُلْمٍ مِنَ الَّذِينَ هَادُوا حَرَّمْنَا عَلَيْهِمْ طَيِّبَاتٍ أُحِلَّتْ لَهُمْ} [النساء 160] الْآيَةَ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ وَهُنَّ يَعْنِي وَاللهُ أَعْلَمُ طَيِّبَاتٌ أُحِلَّتْ لَهُمْ وَقَالَ {وَعَلَى الَّذِينَ هَادُوا حَرَّمْنَا كُلَّ ذِي ظُفُرٍ وَمِنَ الْبَقَرِ وَالْغَنَمِ حَرَّمْنَا عَلَيْهِمْ شُحُومَهُمَا إِلَّا مَا حَمَلَتْ ظُهُورُهُمَا أَوِ الْحَوَايَا أَوْ مَا اخْتَلَطَ بِعَظْمٍ} [الأنعام 146] قَالَ الشَّافِعِيُّ الْحَوَايَا مَا حَوَى الطَّعَامَ وَالشَّرَابَ فِي الْبَطْنِ

[Machine] In His saying, "Every animal with nails" [Al-An'am 146], He means the camel and ostrich. And in His saying, "except what their backs carry" [Al-An'am 146], it refers to what is attached to the back, such as fat or entrails. And it refers to the livestock that Ibn Abi Najeeh narrated from Mujahid, from his interpretation of "Every animal with nails" and "the backs". It has been mentioned in the authentic hadeeth from Umar ibn Al-Khattab and others from the Prophet ﷺ that he said, "May Allah curse the Jews, the fats have been forbidden upon them, so they sold it and consumed its price." Ash-Shafi'i, may Allah have mercy on him, said that what Allah has forbidden upon the Children of Israel, specifically the Jews, and others generally, remains forbidden since the time when it was made forbidden until Allah sent Muhammad ﷺ and obligated belief in him and made known to him that his religion is Islam, which abrogated all previous religions. He said, "Indeed, the religion in the sight of Allah is Islam" [Al Imran 19], and he revealed to the People of the Scripture from among the polytheists, "Say, 'O People of the Scripture, come to a word that is equitable between us and you'" [Al Imran 64]. He commanded fighting them until they pay the jizyah if they do not embrace Islam. And he revealed regarding them, "Those who follow the Messenger, the unlettered Prophet, whom they find written in what they have of the Torah and the Gospel, who enjoins upon them what is right and forbids them what is wrong and makes lawful for them the good things and prohibits for them the evil and relieves them of their burden and the shackles which were upon them" [Al-A'raf 157]. Ash-Shafi'i, may Allah have mercy on him, said, "It is said that Allah knows best what burdens they have and what they are prevented from with regards to what they invented before the legislation of Muhammad's religion ﷺ."  

البيهقي:١٩٧٠٣أَخْبَرَنَا أَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ أنبأ أَبُو الْحَسَنِ الطَّرَائِفيُّ ثنا عُثْمَانُ بْنُ سَعِيدٍ ثنا عَبْدُ اللهِ بْنُ صَالِحٍ عَنْ مُعَاوِيَةَ بْنِ صَالِحٍ عَنْ عَلِيِّ بْنِ أَبِي طَلْحَةَ عَنِ ابْنِ عَبَّاسٍ ؓ

فِي قَوْلِهِ {كُلَّ ذِي ظُفُرٍ} [الأنعام 146] قَالَ هُوَ الْبَعِيرُ وَالنَّعَامَةُ وَفِي قَوْلِهِ {إِلَّا مَا حَمَلَتْ ظُهُورُهُمَا} [الأنعام 146] يَعْنِي مَا عَلَقَ بِالظَّهْرِ مِنَ الشَّحْمِ {أَوِ الْحَوَايَا} [الأنعام 146] وَهُوَ الْمَبْعَرُ وَبِمَعْنَاهُ رَوَاهُ ابْنُ أَبِي نَجِيحٍ عَنْ مُجَاهِدٍ مِنْ قَوْلِهِ فِي تَفْسِيرِ كُلِّ ذِي ظُفُرٍ والْحَوَايَا وَقَدْ مَضَى فِي الْحَدِيثِ الثَّابِتِ عَنْ عُمَرَ بْنِ الْخَطَّابِ ؓ وَغَيْرِهِ عَنِ النَّبِيِّ ﷺ أَنَّهُ قَالَ لَعَنَ اللهُ الْيَهُودَ حُرِّمَتْ عَلَيْهِمُ الشُّحُومُ فَجَمَلُوهَا فَبَاعُوهَا وَأَكَلُوا أَثْمَانَهَا قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ فَلَمْ يَزَلْ مَا حَرَّمَ اللهُ ﷻ عَلَى بَنِي إِسْرَائِيلَ الْيَهُودَ خَاصَّةً وَغَيْرَهُمْ عَامَّةً مُحَرَّمًا مِنْ حِينِ حَرَّمَهُ حَتَّى بَعَثَ اللهُ ﷻ مُحَمَّدًا ﷺ فَفَرَضَ الْإِيمَانَ بِهِ وَأَعْلَمَ خَلْقَهُ أَنَّ دِينَهُ الْإِسْلَامُ الَّذِي نَسْخَ بِهِ كُلَّ دِينٍ قَبْلَهُ فَقَالَ {إِنَّ الدِّينَ عِنْدَ اللهِ الْإِسْلَامُ} [آل عمران 19] وَأَنْزَلَ فِي أَهْلِ الْكِتَابِ مِنَ الْمُشْرِكِينَ {قُلْ يَا أَهْلَ الْكِتَابِ تَعَالَوْا إِلَى كَلِمَةٍ سَوَاءٍ بَيْنَنَا وَبَيْنَكُمْ} [آل عمران 64] الْآيَةَ وَأَمَرَ بِقِتَالِهِمْ حَتَّى يُعْطُوا الْجِزْيَةَ إِنْ لَمْ يُسْلِمُوا وَأَنْزَلَ فِيهِمْ {الَّذِينَ يَتَّبِعُونَ الرَّسُولَ النَّبِيَّ الْأُمِّيَّ الَّذِي يَجِدُونَهُ مَكْتُوبًا عِنْدَهُمْ فِي التَّوْرَاةِ وَالْإِنْجِيلِ يَأْمُرُهُمْ بِالْمَعْرُوفِ وَيَنْهَاهُمْ عَنِ الْمُنْكَرِ وَيُحِلُّ لَهُمُ الطَّيِّبَاتِ وَيُحَرِّمُ عَلَيْهِمُ الْخَبَائِثَ وَيَضَعُ عَنْهُمْ إِصْرَهُمْ وَالْأَغْلَالَ الَّتِي كَانَتْ عَلَيْهِمْ} [الأعراف 157] قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ فَقِيلَ وَاللهُ أَعْلَمُ أَوْزَارُهُمْ وَمَا مُنِعُوا بِمَا أَحْدَثُوا قَبْلَ مَا شُرِعَ مِنْ دِينِ مُحَمَّدٍ ﷺ

[Machine] "He is the one whom Allah did not impose any covenant upon regarding what He prohibited them from, that he would keep that away from them. Al-Shafi'i, may Allah have mercy on him, said: Since Allah ﷻ sent Muhammad ﷺ, no created being, whether jinn or human, has come to understand his call except that the proof of Allah has been established upon him by following his religion. It is incumbent upon each of them to forbid what Allah has prohibited on the tongue of His Prophet, and to permit what he has permitted on the tongue of Muhammad ﷺ."  

البيهقي:١٩٧٠٤أَخْبَرَنَا أَبُو زَكَرِيَّا أنبأ أَبُو الْحَسَنِ الطَّرَائِفِيُّ ثنا عُثْمَانُ بْنُ سَعِيدٍ ثنا عَبْدُ اللهِ بْنُ صَالِحٍ عَنْ مُعَاوِيَةَ بْنِ صَالِحٍ عَنْ عَلِيِّ بْنِ أَبِي طَلْحَةَ عَنِ ابْنِ عَبَّاسٍ ؓ قَالَ

هُوَ مَا كَانَ اللهُ أَخَذَ عَلَيْهِمْ مِنَ الْمِيثَاقِ فِيمَا حَرَّمَ عَلَيْهِمْ أَنْ يَضَعَ ذَلِكَ عَنْهُمْ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ فَلَمْ يَبْقَ خَلْقٌ يَعْقِلُ مُنْذُ بَعَثَ اللهُ ﷻ مُحَمَّدًا ﷺ مِنْ جِنٍّ وَلَا إِنْسٍ بَلَغَتْهُ دَعْوَتُهُ إِلَّا قَامَتْ عَلَيْهِ حُجَّةُ اللهِ بِاتِّبَاعِ دِينِهِ وَلَزِمَ كُلَّ امْرِئٍ مِنْهُمْ تَحْرِيمُ مَا حَرَّمَ اللهُ عَلَى لِسَانِ نَبِيِّهِ وَإِحْلَالُ مَا أَحَلَّ عَلَى لِسَانِ مُحَمَّدٍ ﷺ

Would I enter Paradise if I say the obligatory prayers and deny myself that which is forbidden and treat that as lawful what has been made permissible (by the Shari'ah)? The Prophet ﷺ replied in the affirmative. (Using translation from Muslim 15a)   

البيهقي:١٩٧٠٥أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أَخْبَرَنِي أَبُو النَّضْرِ مُحَمَّدُ بْنُ مُحَمَّدِ بْنِ يُوسُفَ ثنا مُحَمَّدُ بْنُ نَصْرٍ الْمَرْوَزِيُّ ثنا إِسْحَاقُ بْنُ إِبْرَاهِيمَ أنبأ أَبُو مُعَاوِيَةَ ح قَالَ وَأَخْبَرَنِي أَبُو عَمْرِو بْنُ أَبِي جَعْفَرٍ أنبأ الْحَسَنُ بْنُ سُفْيَانَ ثنا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ ثنا أَبُو مُعَاوِيَةَ عَنِ الْأَعْمَشِ عَنْ أَبِي سُفْيَانَ عَنْ جَابِرٍ ؓ قَالَ

أَتَى النَّبِيَّ ﷺ النُّعْمَانُ بْنُ قَوْقَلٍ فَقَالَ يَا رَسُولَ اللهِ أَرَأَيْتَ إِذَا صَلَّيْتُ الْمَكْتُوبَةَ وَحَرَّمْتُ الْحَرَامَ وَأَحْلَلْتُ الْحَلَالَ أَأَدْخُلُ الْجَنَّةَ؟ فَقَالَ النَّبِيُّ ﷺ نَعَمْ

[Machine] The Messenger of Allah, ﷺ , said: "Act according to the Quran, make lawful its lawful things and prohibit its prohibited things, follow it and do not disbelieve in anything from it. If you come across anything in it that is ambiguous, refer it back to Allah and to those who have knowledge after me. Believe in the Torah, the Gospel, and the Psalms, and in what the prophets have been given from their Lord. The Quran and its explanations are sufficient for you, as it has intercession and is intercession. Whatever is lawful is confirmed, and every verse has a light on the Day of Resurrection. I was given Surah Al-Baqarah from the earlier revelations, and I was given Taha and Tawasin and the Ha Mim from the Tablets of Moses, and I was given the Opening of the Book from beneath the Throne. The servants of Allah Ibn Abi Hameed spoke about it." Al-Shafi'i said: "Allah made the food of the people of the Book permissible, so according to the scholars of interpretation, their sacrifices were not exempted from this. It is not permissible for a sacrifice of the people of the Book to be permissible, and in the sacrifice there is something that is prohibited for every Muslim from what was prohibited for the people of the Book before Muhammad, ﷺ ."  

البيهقي:١٩٧٠٦أَخْبَرَنَا مُحَمَّدُ بْنُ عَبْدِ اللهِ الْحَافِظُ أنبأ بَكْرُ بْنُ مُحَمَّدٍ الصَّيْرَفِيُّ ثنا عَبْدُ الصَّمَدِ بْنُ الْفَضْلِ ثنا مَكِّيُّ بْنُ إِبْرَاهِيمَ ثنا عُبَيْدُ اللهِ بْنُ أَبِي حُمَيْدٍ عَنْ أَبِي الْمَلِيحِ عَنْ مَعْقِلِ بْنِ يَسَارٍ ؓ قَالَ

قَالَ رَسُولُ اللهِ ﷺ اعْمَلُوا بِالْقُرْآنِ أَحِلُّوا حَلَالَهُ وَحَرِّمُوا حَرَامَهُ وَاقْتَدُوا بِهِ وَلَا تَكْفُرُوا بِشَيْءٍ مِنْهُ وَمَا تَشَابَهَ عَلَيْكُمْ مِنْهُ فَرُدُّوهُ إِلَى اللهِ وَإِلَى أُولِي الْعِلْمِ مِنْ بَعْدِي كَمَا يُخْبِرُوكُمْ وَآمِنُوا بِالتَّوْرَاةِ وَالْإِنْجِيلِ وَالزَّبُورِ وَمَا أُوتِيَ النَّبِيُّونَ مِنْ رَبِّهِمْ وَلِيَسَعْكُمُ الْقُرْآنُ وَمَا فِيهِ مِنَ الْبَيَانِ فَإِنَّهُ شَافِعٌ مُشَفَّعٌ وَمَا حَلَّ مُصَدَّقٌ أَلَا وَلِكُلِّ آيَةٍ نُورٌ يَوْمَ الْقِيَامَةِ وَإِنِّي أُعْطِيتُ سُورَةَ الْبَقَرَةِ مِنَ الذِّكْرِ الْأَوَّلِ وَأُعْطِيتُ طَهَ وَطَوَاسِينَ وَالْحَوَامِيمَ مِنْ أَلْوَاحِ مُوسَى وَأُعْطِيتُ فَاتِحَةَ الْكِتَابِ مِنْ تَحْتِ الْعَرْشِ عُبَيْدُ اللهِ بْنُ أَبِي حُمَيْدٍ تَكَلَّمُوا فِيهِ قَالَ الشَّافِعِيُّ وَأَحَلَّ اللهُ ﷻ طَعَامَ أَهْلِ الْكِتَابِ فَكَانَ ذَلِكَ عِنْدَ أَهْلِ التَّفْسِيرِ ذَبَائِحَهُمْ لَمْ يَسْتَثْنِ مِنْهَا شَيْئًا فَلَا يَجُوزُ أَنْ تَحِلَّ ذَبِيحَةُ كِتَابِيٍّ وَفِي الذَّبِيحَةِ حَرَامٌ عَلَى كُلِّ مُسْلِمٍ مِمَّا كَانَ حُرِّمَ عَلَى أَهْلِ الْكِتَابِ قَبْلَ مُحَمَّدٍ ﷺ

"A bag of fat was thrown on the day of Khaibar, and I caught it and said: "I will not give anything of this to anyone.' I turned around and saw the Messenger of Allah there, smiling." (Sahih ) (Using translation from Nasāʾī 4435)   

البيهقي:١٩٧٠٧أَخْبَرَنَا أَبُو الْحُسَيْنِ مُحَمَّدُ بْنُ الْحُسَيْنِ الْعَلَوِيُّ رَحِمَهُ اللهُ أنبأ أَبُو الْأَحْرَزِ مُحَمَّدُ بْنُ عُمَرَ بْنِ جَمِيلٍ الطُّوسِيُّ ثنا أَبُو إِسْحَاقَ إِبْرَاهِيمُ بْنُ إِسْحَاقَ الْمَرْوَزِيُّ الْحَرْبِيُّ ثنا سَعْدَوَيْهِ ثنا سُلَيْمَانُ هُوَ ابْنُ الْمُغِيرَةِ عَنْ حُمَيْدِ بْنِ هِلَالٍ عَنْ عَبْدِ اللهِ بْنِ مُغَفَّلٍ ؓ قَالَ

لَمَّا كَانَ يَوْمُ خَيْبَرَ دُلِّيَ جِرَابٌ مِنْ شَحْمٍ فَاحْتَضَنْتُهُ فَقُلْتُ لَا أُعْطِي أَحَدًا مِنْهُ شَيْئًا فَالْتَفَتُّ فَإِذَا النَّبِيُّ ﷺ يَتَبَسَّمُ

[Machine] I found a sock made of fat on the day of Khaybar, so I picked it up and said, "This is mine, I will not give it to anyone." Then I turned around and saw the Prophet ﷺ smiling, so I felt embarrassed and took it out in the authentic narration as it was before. And in this, it indicates that he allowed the use of fat from the slaughter of the People of the Book. And in that, it indicates the correctness of the statement of Imam Shafi'i, may Allah have mercy on him.  

البيهقي:١٩٧٠٨وَأَخْبَرَنَا أَبُو سَعْدٍ الْمَالِينِيُّ أنبأ أَبُو أَحْمَدَ بْنُ عَدِيٍّ أَخْبَرَنِي الْفَضْلُ بْنُ حُبَابٍ ثنا أَبُو الْوَلِيدِ نا شُعْبَةُ عَنْ حُمَيْدِ بْنِ هِلَالٍ عَنْ عَبْدِ اللهِ بْنِ مُغَفَّلٍ قَالَ

دُلِّيَ جِرَابٌ مِنْ شَحْمٍ يَوْمَ خَيْبَرَ فَالْتَزَمْتُهُ فَقُلْتُ هَذَا لِي لَا أُعْطِي أَحَدًا شَيْئًا فَالْتَفَتُّ فَإِذَا النَّبِيُّ ﷺ يَتَبَسَّمُ فَاسْتَحْيَيْتُ مِنْهُ أَخْرَجَاهُ فِي الصَّحِيحِ كَمَا مَضَى وَفِي هَذَا مَا دَلَّ عَلَى أَنَّهُ أَبَاحَ الشَّحْمَ مِنْ ذَبِيحَةِ أَهْلِ الْكِتَابِ وَفِي ذَلِكَ مَا دَلَّ عَلَى صِحَّةِ قَوْلِ الشَّافِعِيِّ رَحِمَهُ اللهُ
