61. Sacrificial Animals
٦١۔ كِتَابُ الضَّحَايَا
[Machine] Did you hear that from the Messenger of Allah ﷺ ? He replied, "Yes." And Abu Zakariya bin Abi Ishaq, Abu Bakr bin al-Hasan, and Abu Sa'id bin Abi 'Amr informed us, they said: Abu al-'Abbas, who is the deaf one, narrated to us that Rabi' bin Sulayman narrated to us from al-Shafi'i, who narrated from Muslim and Abdul Majid and 'Ubaidullah bin al-Harith, from Ibn Juraij, who mentioned it in its meaning. Abu Sa'id added in his narration, al-Shafi'i said, "The meat of hyenas is not sold in Makkah except between Safa and Marwa." Abu al-Husayn bin Bishran al-'Adl informed us in Baghdad, Abu al-Hasan 'Ali bin Muhammad al-Misri narrated to us, 'Ubaidullah bin Sa'id bin 'Ufair narrated to us from 'Abdullah bin Salih, from al-Layth bin Sa'd, he said: 'Abdullah bin Wahb narrated to me from Ibn Juraij. He also narrated from 'Ali, Ahmad bin Hammad narrated, Ibn Abi Maryam narrated, Yahya bin Ayyub narrated to me, Ismail bin Umayyah and Ibn Juraij, and Jarir bin Hazim, that 'Abdullah bin 'Ubayd bin 'Umair narrated to them. 'Abd al-Rahman bin Abi 'Ammar informed me that he asked Jabir bin 'Abdullah about the hyena, and he mentioned it in its manner.
أَسَمِعْتَ ذَلِكَ مِنْ رَسُولِ اللهِ ﷺ؟ قَالَ نَعَمْ 19384 وَأَخْبَرَنَا أَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ وَأَبُو بَكْرِ بْنُ الْحَسَنِ وَأَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو قَالُوا ثنا أَبُو الْعَبَّاسِ هُوَ الْأَصَمُّ أنبأ الرَّبِيعُ بْنُ سُلَيْمَانَ أنبأ الشَّافِعِيُّ أنبأ مُسْلِمٌ وَعَبْدُ الْمَجِيدِ وَعُبَيْدُ اللهِ بْنُ الْحَارِثِ عَنِ ابْنِ جُرَيْجٍ فَذَكَرَهُ بِمَعْنَاهُ زَادَ أَبُو سَعِيدٍ فِي رِوَايَتِهِ قَالَ الشَّافِعِيُّ وَمَا يُبَاعُ لَحْمُ الضِّبَاعِ بِمَكَّةَ إِلَّا بَيْنَ الصَّفَا وَالْمَرْوَةِ 19385 أَخْبَرَنَا أَبُو الْحُسَيْنِ بْنُ بِشْرَانَ الْعَدْلُ بِبَغْدَادَ أنبأ أَبُو الْحَسَنِ عَلِيُّ بْنُ مُحَمَّدٍ الْمِصْرِيُّ ثنا عُبَيْدُ اللهِ بْنُ سَعِيدِ بْنِ عُفَيْرٍ ثنا عَبْدُ اللهِ بْنُ صَالِحٍ ثنا اللَّيْثُ بْنُ سَعْدٍ قَالَ حَدَّثَنِي عَبْدُ اللهِ بْنُ وَهْبٍ عَنِ ابْنِ جُرَيْجٍ حَدَّثَهُ ح وَقَالَ وأنبأ عَلِيٌّ ثنا أَحْمَدُ بْنُ حَمَّادٍ ثنا ابْنُ أَبِي مَرْيَمَ ثنا يَحْيَى بْنُ أَيُّوبَ حَدَّثَنِي إِسْمَاعِيلُ بْنُ أُمَيَّةَ وَابْنُ جُرَيْجٍ وَجَرِيرُ بْنُ حَازِمٍ أَنَّ عَبْدَ اللهِ بْنَ عُبَيْدِ بْنِ عُمَيْرٍ حَدَّثَهُمْ أَخْبَرَنِي عَبْدُ الرَّحْمَنِ بْنُ أَبِي عَمَّارٍ أَنَّهُ سَأَلَ جَابِرَ بْنَ عَبْدِ اللهِ ؓ عَنِ الضَّبُعِ فَذَكَرَهُ بِنَحْوِهِ
[Machine] From the Prophet ﷺ, he said, "The fox is a prey and its reward is an old sheep, and it is eaten."
عَنِ النَّبِيِّ ﷺ قَالَ الضَّبُعُ صَيْدٌ وَجَزَاؤُهَا كَبْشٌ مُسِنٌّ وَتُؤْكَلُ
[Machine] "O Messenger of Allah, what do you say about the wild cat?" He said, "I neither eat it nor forbid it." I said, "What you have not forbidden, I will eat." He said, "O Prophet of Allah, what do you say about the hyena?" He said, "I neither eat it nor forbid it." I said, "What you have not forbidden, I will eat." I said, "O Prophet of Allah, what do you say about the rabbit?" He said, "I neither eat it nor forbid it." I said, "What you have not forbidden, I will eat." I said, "O Prophet of Allah, what do you say about the wolf?" He said, "Does anyone eat that?" I said, "O Prophet of Allah, what do you say about the fox?" He said, "Does anyone eat that?" It is narrated from 'Abd al-Karim ibn Abi al-Mukhariq from Habban ibn Jaz' from his brother Khuzaymah that he said, "I came to the Messenger of Allah ﷺ and mentioned a hadith that agrees with al-Sulami in some of his hadiths and contradicts him in others. In both chains of narrations, there is weakness. And we have narrated in the book of Hajj from 'Umar ibn al-Khattab, 'Ali ibn Abi Talib, and Abdullah ibn Abbas that they considered the hyena to be a substitute sacrifice when it is affected (by prohibition)."
يَا رَسُولَ اللهِ مَا تَقُولُ فِي الضَّبُعِ؟ فَقَالَ لَا آكُلُهُ وَلَا أَنْهَى عَنْهُ قَالَ قُلْتُ مَا لَمْ تَنْهَ عَنْهُ فَأَنَا آكُلُهُ قَالَ قُلْتُ يَا نَبِيَّ اللهِ مَا تَقُولُ فِي الضَّبِّ؟ قَالَ لَا آكُلُهُ وَلَا أَنْهَى عَنْهُ قَالَ قُلْتُ مَا لَمْ تَنْهَ عَنْهُ فَإِنِّي آكُلُهُ قَالَ قُلْتُ يَا نَبِيَّ اللهِ مَا تَقُولُ فِي الْأَرْنَبِ؟ قَالَ لَا آكُلُهَا وَلَا أُحَرِّمُهَا قَالَ قُلْتُ مَا لَمْ تُحَرِّمْهُ فَإِنَّى آكُلُهُ قَالَ قُلْتُ يَا نَبِيَّ اللهِ مَا تَقُولُ فِي الذِّئْبِ؟ قَالَ أَوَيَأْكُلُ ذَلِكَ أَحَدٌ؟ فَقُلْتُ يَا نَبِيَّ اللهُ مَا تَقُولُ فِي الثَّعْلَبِ؟ قَالَ أَوَيَأْكُلُ ذَلِكَ أَحَدٌ ؟ وَرُوِيَ عَنْ عَبْدِ الْكَرِيمِ بْنِ أَبِي الْمُخَارِقِ عَنْ حَبَّانَ بْنِ جَزْءٍ عَنْ أَخِيهِ خُزَيْمَةَ ؓ قَالَ قَدِمْتُ عَلَى رَسُولِ اللهِ ﷺ فَذَكَرَ الْحَدِيثَ يُوَافِقُ السُّلَمِيَّ فِي بَعْضِ حَدِيثِهِ وَيُخَالِفُهُ فِي بَعْضِهِ وَفِي كِلَا الْإِسْنَادَيْنِ ضَعْفٌ وَرُوِّينَا فِي كِتَابِ الْحَجِّ عَنْ عُمَرَ بْنِ الْخَطَّابِ وَعَلِيِّ بْنِ أَبِي طَالِبٍ وَعَبْدِ اللهِ بْنِ عَبَّاسٍ ؓ أَنَّهُمْ جَعَلُوا فِي الضَّبُعِ كَبْشًا إِذَا أَصَابَهُ الْمُحْرِمُ
ذَاكَ الْفُرْعُلُ نَعْجَةٌ مِنَ الْغَنَمِ
[Machine] Abu Ubaid Al-Fur'ul is a descendant of the "Dabua" (a type of wild wolf) among the Arabs. The meaning of this saying is that he compared a female sheep to a sheep, saying that it is permissible (halal) just like the sheep.
أَبُو عُبَيْدٍ الْفُرْعُلُ عِنْدَ الْعَرَبِ وَلَدُ الضَّبُعِ وَالَّذِي يُرَادُ مِنْ هَذَا الْحَدِيثِ قَوْلُهُ نَعْجَةٌ مِنَ الْغَنَمِ يَقُولُ إِنَّهَا حَلَالٌ بِمَنْزِلَةِ الْغَنَمِ
[Machine] He is called "Al-Jubn" so look at how he mixes the halal and the haram. And you wear fur, so look at how you adorn yourself with the skin of the dead.
يُقَالُ لَهُ الْجُبْنُ فَانْظُرُوا مَا حَلَالُهُ مِنْ حَرَامِهِ وَتَلْبَسُونَ الْفِرَاءَ فَانْظُرُوا ذَكِيَّهُ مِنْ مَيِّتِهِ
[Machine] The Messenger of Allah ﷺ was asked about cheese, ghee, and fur. So the Messenger of Allah ﷺ said, "The halal is what Allah has made lawful in the Quran, and the haram is what Allah has made forbidden in the Quran, and whatever He has remained silent about is forgiven." This hadith was narrated by Sa'if bin Harun from At-Taymi from Abu Uthman from Salman, with the exception that he said in his book, "And that is subject to the will of Allah."
أَنَّ رَسُولَ اللهِ ﷺ سُئِلَ عَنِ الْجُبْنِ وَالسَّمْنِ وَالْفِرَاءِ فَقَالَ رَسُولُ اللهِ ﷺ الْحَلَالُ مَا أَحَلَّ اللهُ فِي الْقُرْآنِ وَالْحَرَامُ مَا حَرَّمَ اللهُ فِي الْقُرْآنِ وَمَا سَكَتَ عَنْهُ فَقَدْ عَفَا عَنْهُ وَرَوَاهُ سَيْفُ بْنُ هَارُونَ عَنِ التَّيْمِيِّ عَنْ أَبِي عُثْمَانَ عَنْ سَلْمَانَ مَرْفُوعًا إِلَّا أَنَّهُ قَالَ فِي كِتَابِهِ وَذَلِكَ يَرِدُ إِنْ شَاءَ اللهُ
